| NOTICE BY INSTOW PARISH COUNCIL – CONTROL OF DOGS | |

DOG WARDENS REGULARY PATROL INSTOW BEACH • North Devon District Council (NDC) has adopted the Dog Control Order pursuant to Section 55 of the Clean Neighbourhoods and Environment Act 2005. • The Order is known as the “Fouling of Land by Dogs (NDC) Order 2009” and under the terms of the Order: - • It is an offence for a person in charge of a dog which defecates on land to which the Order applies to fail to remove the faeces from the land forthwith. • Instow Parish Council (IPC) supports the enforcement of the Order on all those parts of Instow Sands as leased by it from the Crown Estate (CE) and with its permission a copy of a map, setting out those parts of Instow Sands as leased by it to IPC, is attached to this article. • Failure to comply with this Order will result in a fixed penalty notice in the sum of £75 issued by the Dog Wardens who regularly patrol the area. If the fine is paid within 14 days the sum is dropped to £65; however, if the fine is not paid the offender could on conviction by a magistrates court be liable a maximum fine of £1,000 plus costs of over £500. • IPC and the CE have agreed to fully endorse the implementation of this Order and as a result when the Dog Wardens patrol the beach fixed penalties will be issued to offenders. • Instow Parish Council would encourage all parishioners and visitors that witness inconsiderate dog owners who allow their animals to breach this order to: - • Advise the Council’s Dog Wardens of the name and address of the offender, and provide a description of the person and their dog, and even just the times and location could be enough for them to commence targeted visits.
