A meeting of the parish Council was held in the vestry room at seven o'clock p
m.
Present. Messrs. Lock, Robertson, Pidler, Bellew, J Easterbrook, H.A.
Easterbrook, Joslin, Nation
The Clerk reported that the seats had been placed on the parade to the
satisfaction of the Council. The following letter from the Rector relating to
the vestry room was then read.
"Instow Rectory
North Devon
July 17th 1895
Dear Sir
In reply to your letter dated July 11th but received July 14th. I beg to say
that the Rector and Churchwardens submitted it to the Bishop of Exeter, who
again handed it to the Registrar, Mr Burch.
His reply is that he finds no power in the Act constituting parish Councils for
the parish council to demand possession of any vestry room. He says they have
the right of using it in common with the Church but that the key must remain
with the church. He further asks to see the opinion which the Instow Parish
Council has taken and upon which they found their demand for the key.
I as an elector and the Churchwardens as electors of the parish Council also
desire to see that legal opinion, it being the property of the parish and not
the private property of the parish Council.
Our desire is to act correctly and legally as trustees, therefore we shall thank
you to favour us with a copy of that legal opinion.
Mr Burch advises this supposing that the room you want is parish property.
I believe if the title be examined that it will be found to be the private
property of Mr Christie and not parish property at all.
The Rector and Churchwardens have always granted the free use of this room to
the parish Council and they are therefore at a loss to understand what is
desired by the Council in making this claim, at Fremington the parish Council
also uses the parish room but has never thought of demanding its custody.

Moved by Mr Easterbrook and seconded by Mr Joslin that the statement of case and
opinion of the editor of the parish Councils Journal as to the right of the
parish Council be forwarded to the Rector.
Moved by Mr J Easterbrook and seconded by Mr Joslin that the District Council
informed him that the drainage would be proceeded with at once.
Mr Nation on behalf of the Rector and Churchwardens handed in cheque £9-19-11
being the balance of the Recreation ground fund in their hands to Lady Day last
and it was resolved to place the money on deposit with the Devon & Cornwall
Banking Co. at Bideford.
Bills relating to the repairs done to the Flushing tank under the
superintendence of Mr Thorne amounting to £11-10-7 were then examined and the
charges being found fair and reasonable the same was recommended to be paid by
the District Council.
The Clerk reported the following analysis of the Union Assessment Valuation List
for the parish of Instow had been forwarded to the Local Government Board.
