MINUTES OF THE OCTOBER 1st 1896 MEETING OF INSTOW PARISH COUNCIL


October 1st 1896

A meeting of the Parish Council was held in the vestry room at 7 p.m.
Present. Messrs Lock, Winter, Joslin, Nation, Bellew, W.A. Easterbrook, J
Easterbrook, A. Pidler and W.H.J. Pidler.

The minutes of the last meeting were read and approved

The following letter was read from the clerk to the Rural District Council.

"Barnstaple
26th Sept 1896

Dear Sir
Marsh Cottages
Instow

The District Council have consulted their engineer as to the desirability of
constructing a ventilating shaft at the end of the sewer at Instow which
they are given to understand might remove the objection taken by the owner
of Marsh Cottages as to connecting the slop water from these cottages with
the sewer.

I am directed to send a copy of the Mr Thorne's report thereon for the
consideration of the Parish Council and shall be glad to receive any
observations or suggestions they may desire to offer thereon,

The report was read and discussed as was also a letter from Mr Bosson, Mrs
Gregory's solicitor respecting the same.

The Clerk was instructed to reply to that report and to enclose Mr Bosson's
letter the following is a copy of reply sent.

"Instow
7th October 1896
Dear Sir

Marsh Cottages
Instow

I am desired by the Parish Council to acknowledge the receipt of your letter
of the 26th Sept with the copy to the report to the desirability of
constructing a ventilating shaft at the end of the sewer at Marsh Cottages
enclosed therewith.

The Parish Council entirely agree with the opinion expressed in the
engineer's report that there is less need of a ventilating shaft in the
sewer in question than in most sewers.

The sewer is laid with an easy gradient and it is effectively flushed whilst
it is within the knowledge of some members of the Parish Council that the
Local Government Board Inspector when he held the inquiry at Instow ordered
a ventilating shaft to be fixed in the Worlington Road which is laid at a
steep gradient and is not flushed and did not require a shaft at Marsh
Cottages.

It has been stated that the Parish Council have not been actuated by a sense
of public duty in urging the District Council to direct that Marsh Cottages
shall be connected to the sewer, but that they have been so actuated is
shown by the fact that the Medical Officer of Health has confirmed their
statement that a nuisance exists.

The Parish Council have recently received from Mr Bosson the legal advisor
of the owner of Marsh Cottages which I am directed to enclose to you. The
Parish Council cannot accept Mr Bosson's view that the present nuisance
arises from sewerage discharged into the stream from the houses on the other
side as these houses were connected to the sewer in 1895.

In conclusion I am desired to say that the Parish Council consider they
would not have performed their duty if they had not brought this matter to
the notice of the District Council and the responsibility of dealing with it
now rests with the latter body.
