MINUTES OF THE FEBRUARY 2005 MEETING OF INSTOW PARISH COUNCIL

2502/1 PRAYER
The Clerk led the Council in prayer.

2502/2 APOLOGIES

2502/3 POLICE REPORT
(i) General: - Constable Parker said he was pleased to report that no
crimes had been reported in the parish since the last meeting. (Noted)
(ii) Parish Bus Shelters - Criminal Damage: - The Clerk reported that
the two stone bus shelters at Venn Cross, and the new one at Atturm, had
been vandalised in the previous month; he said the perspex windows had
been kicked out and would need replacing (see item 2502/9 (i) (i) (i)
and (ii) below). The Clerk told Council he had come into the possession
of a name of a suspect and that Constable Parker had been advised. PC
Parker said he would take the necessary action and report back to IPC in
due course. (Action: Constable Parker)

2502/4 PARISHIONERS
(i) Instow Village Show 2005: - A parishioner provided IPC with an
update on this show that is to be held on the 16th July; she said it was
hoped to hear soon whether Leader + funding had been secured. (Noted)
(ii) Marine Parade - Seawall: - A parishioner reported that several
large stones had fallen/been washed out of this wall on the beach side
and needing repairing before it got much worse. It was RESOLVED the
Clerk should contact DCC who own the wall. (Action: The Clerk)
(iii) Marine Parade - 20 mph Speed Limit: - A parishioner said that it
was her view that motorists were exceeding the speed limit and that the
police should take steps to enforce it. The Clerk reminded Council it
was clearly advised, prior to its introduction, that any 20 mph speed
limit needed to be “self enforcing” and it was unlikely the police would
take any proactive steps. After discussion it was RESOLVED to approach
Cllr Cann and ask whether repeater signs could be placed along Marine
Parade and have the flashing speed sign in situ for a period in the very
near future. (Action: Cllr Cann)
(iv) Road Signs - Victoria Terrace: - A parishioner asked why the
authorities had not installed a street sign at Victoria Terrace (Marine
Parade). The Clerk referred the parishioner to a letter he had recently
received from NDDC (see item 2502/11 (l) below) which stated road
signing would only been provided on highways. (Noted)
(v) Road Signs - Dirty/Paintwork Shoddy: - A parishioner commented on a
number of road signs within the village that were unkempt and/or needing
repainting. It was RESOLVED the Clerk would contact the appropriate
authority once the parishioner had provided him with a list of the
relevant signs. (Action: The Clerk)
(vi) Instow Community Facilities/Ransom Strip Monies: - A parishioner
enquired as to progress of this initiative. The Chairman advised him it
was to come up under “Matters Arising” - see item 2502/8 (c). (Noted)

2502/5 REPORT COUNTY COUNCILLOR R CANN
(i) General: - Cllr Cann spoke of Instow Seafront - 20 mph Speed Limit,
DCC Council Tax 2005/6 (3.5% adopted - additional funding from second
homes split between District Council’s Affordable Homes function and DCC
Social Services Function of relevance to providing accommodation for
vulnerable sections of the community), Beach Grant (should be made
available in the next 2 weeks), Flooding Problems (Culverts blocked),
Request for Footpath at Instow/Yelland (feasibility study in progress),
Dog Bin - Atturm Footpath (still on order), and Venn Close - Defective
Light (defect reported and repair in hand by contractors). (Noted)
(ii) Instow New School - Community Facilities: - Cllr Cann said that
following a parish council request some months ago he had established
that NDDC had ring fenced something like £70,000 for the Instow
Community. He said these funds became available as the result of the
sale of a ransom strip to a developer. He added that as this was NDDC’s
money there were certain policy guidelines as to how it could be spent,
for example, “any project should serve the community of Instow, and the
money must have social, economic and/or environmental impact on the
community”. Cllr Cann said a steering group had been established to
explore the findings of a previous consultation exercise and would meet
again in mid March - further consultation might then be necessary but
should follow a format and procedure and be supported by the steering
group as a whole”. The Chairman thanked Cllr Cann and said further
discussion would take place on this issue under “Matters Arising” in due
course - see item 2502/8 (c). (Noted)

2502/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
(i) Council Tax 2005/6: - Cllr Mrs L Brown said that NDDC’s Executive
were to recommend to Council that this year’s Council Tax (2005/6) be
set at an increase of 3.5% in line with inflation; however, it would be
necessary to find further savings to achieve this figure. (Noted)
(ii) General: - Cllr Mrs L Brown said the New Toilet Block (Marine
Parade/Lane End Close) was on schedule for opening before the
commencement of the new season and that NDDC’s Executive had agreed to
authorise the Sports and Recreation Officer to enter into a contract
with Surfguard UK to provide a Lifeguards Service on beaches at owner’s
request; she added the management and administration would be undertaken
by NDDC at a cost of not more than £10,000 but that the actual service
provided would be at the expense of the beach owners and the agreement
would be for one year only. (Noted)
(iii) Proposed Charter Toilets - Quay Car Park: - In answer to a
question from Cllr White, Cllr Mrs L Brown said this planning
application was still “live” and would be the subject of further
discussion in due course. (Noted)

2502/7 MINUTES
It was RESOLVED that the January Minutes of Instow Parish Council be
approved and signed. (Noted)

2502/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2501/8 (a) - Instow Beach/Crown Estates Lease - Lifeguards (i)
The Clerk advised IPC he had written to the agent of The Crown
Commissions (CC) (dd 21.1.05) asking that the CCs’ consider IPC’s
request to re-assign the beach lease to Instow Marine Services asap.
(Noted)
(ii) The Clerk reported receipt of a letter (dd 24.1.05) from the CCs’
agent noting IPC’s request but pointing out that “under paragraph 3.13
of the lease any assignment or sub-letting was not permitted except for
the mooring buoys”. However, the agent further stated he would enter
into correspondence with the CCs’ (his client) regarding the matter and
would notify IPC of any further developments if the CCs’ would consider
any further alternative. The agent suggested that if IPC was prepared to
pay for the legal fees for the surrender of the lease then this might be
a viable option. The Clerk said he had sent an email to the agent
(26.1.05), stating that IPC might be interested in such an arrangement
subject to the costs. (Noted)
(iii) The Clerk said he received a further letter (dd 7.2.05) from the
CC’s agent stating that the costs for the surrender of the lease would
be approx £500 plus Vat and the new lease £800 plus Vat - there would
also be the agents fee of £400 plus Vat subject to negotiations with the
new lessor; he said he had copied the letter to Cllrs Crombie and Johns
with their agenda papers. (Noted)
(iv) After debate, lead by Cllr Johns, it was RESOLVED to defer making a
decision until the March meeting of IPC to allow Cllrs Johns and Crombie
further time to carry out a “Swot” type analysis and come back to IPC
with a firm recommendation. (Action: Cllr Johns, Crombie and The Clerk)
(v) The Clerk report dispatch of an email (dd 21.1.05 - also later
copied by post) to The Allianz Cornhill Insurance Company seeking
clarification as to the manner in which IPC should “police” the sands if
it were to comply with its public liability policy. (Noted)
(vi) The Clerk advised IPC of an email reply (dd 9.2.05) from the
Allianz Cornhill -he read it to Council inclusive of his supplementary
response (email dd 10.2.05). He said he still awaited a reply. (Noted)
(b) Item 2501/8 (c) (ii) - Chestnut Fencing - Instow Beach: - The Clerk
reported he had expressed IPC’s concern at the time it was taking for
the chestnut fence to be repaired in an email to Andy Bell (NDCCS) on
Friday 21st January. In a reply email from Andy Bell (dd 24.1.05) the
Clerk said he had been advised that the work was to commence in March
and would be completed by a group of volunteers from Bristol University.

(c) Item 2501/9 (i) (d) - Sandhills Ransom Strip: - (i) The Chairman
spoke at length to a paper entitled “Consultation on Possible Community
Facilities at Instow New School - 14th February 2002” - Cllrs were in
possession of a copy. The Chairman said he felt the report to be
unreliable and made reference to statistics listed therein as being, in
his view, dubious and unclear to say the least. Cllr Cann reminded IPC
that the consultation process that had preceded this report had been
facilitated by parishioners, some of whom were present at the meeting,
and that the Community Council for Devon (CCD) had put the report
together on their behalf and with their agreement particularly as
regards the findings. After discussion IPC RESOLVED to accept the report
as read but with the proviso the Clerk establish the manner by which the
statistics referred to as “Facility” (Page 11) had been established and
to report back to the next meeting. (Action: The Clerk)
(ii) Cllrs Ms Mayoh, Scott and White (IPC’s Ransom Strip Sub Committee
(RSC)) then gave a report of a meeting they had attended at the Civic
Centre (9.2.05) together with the Clerk and Chairman. The Clerk reminded
Cllrs he had previously provided them with a copy of the notes of that
meeting (email and post 14.2.05) - the members of IPC’s RSC agreed the
notes to be a true record of the meeting. After discussion it was
RESOLVED to support the final recommendations of said meeting, that is,
to (a) Allow Brian Holme (NDDC) to carry out a feasibility study as
regards a full size football pitch/recreational facilities and that when
his work was complete, call a further meeting of the steering group
which it was agreed would be mid March (b) Any additional
feedback/thoughts from IPC Cllrs/IPC, should be channelled to Brian
Holme (NDDC) via Roger Jacob (Clerk) and finally (c) No further
consultation would take place by either IPC or NDDC until Brian Holme
had completed his work and another meeting had been held. It was
accepted, however, that some additional consultation might be necessary
and that the steering group would decide upon its format as and when
necessary”. (Noted)

2502/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letters from NDDC (dd 28.1.05 and 1.2.05) reference (i) House to
House Collection for PDSA and Beechwood Kennels, Hartland (Miss Susan
Andrew of Appledore) and (ii) House to House and Street Collection for
RNLI (Mrs Elizabeth Wilson of Bideford): - The Clerk told IPC that as
both charities were bone fide he had advised NDDC (email 2.2.05) that
IPC had no objection. IPC RESOLVED to ratify this decision. (Noted)
b) Letter (dd 31.1.05) from Community Messaging Officer of Devon and
Cornwall Constabulary reference “Community Messaging”: - The Clerk
reminded IPC that this letter and accompanying pamphlet had been copied
to Cllrs with their agenda papers. After discussion it was RESOLVED to
note it. (Noted)
c) Parish Emergency Plan (PEP) Update: - The Chairman provided a report
of relevance to IPC’s EPSC meeting held on Thursday 3rd February 2005.
He talked to a circulated draft questionnaire, which, he suggested,
might be sent out to parishioners by way of the parish magazine. Cllr
Johns said he felt that before this was done IPC ought to seek the
guidance of Cllr Cann as regards the format of the questionnaire, the
manner of the compilation of the results and possible funding sources to
cover IPC’s expenses. After discussion it was RESOLVED to adopt this
recommendation and the Clerk was asked to liaise with Cllr Cann.

d) Letter from DAPC (dd January 2005) reference “Royal Garden Party -
21st July 2005”: - The Clerk read this letter to Council at the
conclusion of which a RESOLUTION was made as regards a nominee. (Action:
The Clerk)
e) Email (dd 9.2.05) from Chairman to Clerk reference “Cyberspace Notice
Board CNB)”: - The Chairman outlined his thoughts as regards IPC’s use
of a “CNB” on the Instow Website; the Clerk told Council this would be
seen as another form of communicating with parishioners when the Quality
Parish application was subsequently made. After discussion it was
RESOLVED to adopt this course of action but with the proviso that items
for inclusion be agreed by IPC by way of RESOLUTION and that it be
handled by the Clerk as at present with approved minutes of parish
council meetings. (Action: IPC Cllrs and The Clerk)
f) Letter (undated - received 9.2.05) from Office of The Deputy Prime
Minister reference “Citizen Engagement and Public Services: Why
Neighbourhoods Matter” and “Vibrant Local Leadership”: - The Clerk
advised IPC that although these were not formal consultation documents
any comments could be forwarded by email or post; he said views and
comments were encouraged. The Clerk reminded Cllrs he had provided a
copy of the letter to each with their meeting papers and that both
documents were available for perusal if required. (Noted)
g) Letter (undated - received 10.2.05) from Defra concerning “Clean
Neighbourhoods and Environment Bill”: - The Clerk said this letter
stated that this Bill, introduced on the 7th December 2004, included
specific recognition of the important role of parish and town councils
and played a key role in the government’s plan to create cleaner, safer,
greener communities. It further deals with many of the problems
affecting the quality of our environment, which form a continuum with
anti social behaviour, vandalism, disorder and level of crime. The Bill
does increase parish council powers so that the most local level of our
democratic structure can play a part in making things better. In
particular it gives parish councils new powers to issue fixed penalty
notices for litter, dog control, graffiti and fly posting. It does add,
however, that not all parish councils will want to use these extra
powers and that they are powers, rather than duties, and parish councils
are under no obligation to use them. The Clerk said he had provided a
copy of the letter (and attachment) to each Cllrs with their meeting
papers. After discussion it was RESOLVED to note the paper. (Noted)
h) Letter (dd 9.2.05) from parishioner reference “Devon In Touch
Roadshow (DITR)” - “Village Show”: - ”The Clerk said this letter sought
the support of IPC to invite the DITR to the parish late May/early June
to publicise the proposed Village Show. The Clerk said the invitation to
the DIRS and arrangements thereafter would be facilitated by the Village
Show Committee. After discussion it was RESOLVED to support this
initiative. (Action: The Clerk)
i) Damage to IPC’s Bus Shelters - Venn Cross - (i) The Clerk said he had
been advised by Cllr White (5.2.05) that all windows (plastic - not
broken) in these two shelters had been removed by acts of vandalism
(although still in situ and undamaged) and needed replacing. (Noted)
(ii) The Clerk said he had received further information (12.2.05) from
the parish handyman that the Atturm Bus Shelter had been similarly
“damaged. (Noted)
(iii) The Clerk said the parish handyperson estimated that it would take
him about 4 hours to repair all bus shelter (Labour = £22) plus
materials. After discussion IPC RESOLVED to approve this expenditure.
(Action: The Clerk)
(iv) The Clerk said he had received information from the Vice Chairman
that a parishioner had enquired whether the inside of the bus shelter to
the rear of the Signal Box could be painted. The Clerk reported he had
liaised with the parish handyperson and established that the wall in
question was of a rough “pebble dash” texture and once painted would
need more “regular” attention than normal - he said the handyperson had
estimated that it would cost £40 plus paint to carry out the work. After
discussion it was RESOLVED not to have the shelter painted (but to
review it again in 2006) but to ask the handyperson to give said bus
shelter a good clean up asap. (Action: The Clerk)

The Clerk reported on the financial transactions since the January

*NB: - £115 less than applied for - some planned footpath strims will,
therefore, need to be curtailed. Clerk suggested to IPC that he use his
discretion (in liaison with parish handyman) as summer season

5. MISCELLANEOUS: -
(a) Beach Grant 2004/Beach Cleaning 2005: - (i) Grant - The Clerk
reported upon progress since the last meeting i.e. he had spoken to
Brian Holme (NDDC) who had agreed to “chase it up” together with Cllr
Cann. (Noted)
(ii) Cleaning - The Clerk confirmed he had notified Mr P Cook (Beach
Cleaner) of the hours to be worked for the summer season 2005 and
forwarded a contract of employment/agreement for signing and return.

(b) Parish Seats: - (i) The Clerk advised IPC that Cllr Crombie and him
had prepared a draft letter to future donors setting out IPC’s policy of
acceptance. He reminded Cllrs he had copied this to them with their
agenda papers (10.2.05). After discussion IPC RESOLVED to approve the
draft letter subject to minor amendments/additions the Clerk suggested
as regards to recommendations as to where such “agreed” seats could be
obtained and the use of plaques. (Noted)
(ii) The Clerk reported that two owners of the 4 “named” condemned seats
had been traced (as a result of the article in the Parish Magazine/North
Devon Journal) and that three new ones had already been pledged. (Noted)
(iii) The Clerk confirmed that 4 of the condemned seats had been removed
from Marine Parade during the morning of Wednesday 16th February by the
handyperson and himself and that it was anticipated removing the
remaining 4 in the next week to 10 days. (Noted)
(c) Xmas Carol Singing 2005/Band: - (i) The Clerk confirmed he had
advised The Commodore Hotel and Instow PCC reference Carol Singing Event
date of 11th December 2005 and that all was in order. (Noted)
(ii) The Clerk reported upon his liaison with The Commodore Hotel and a
suggested summer concert 2005 by the Two Rivers Wind Ensemble. (Noted)
(d) War Memorial - Insurance: - The Clerk updated IPC i.e. he still
awaited a response from Peter Roberts (Stonemason) for a cost to rebuild
the war memorial - he said he would chase him up again. (Noted)
(e) Car Park Machine: - The Clerk reported receipt of a letter from
Metric (dd 15.1.05) stating it was to discontinue production of its
Metric Autoslot Pay and Display Machines (as per the one owned by IPC)
but that it was to continue to support said machines with service/spare
parts for a minimum of ten years. (Noted)
(f) NALC 2005/6 National Salary Award for Local Council Clerks: - The
Clerk advised IPC he would make this available to IPC’s Finance Sub
Committee as and when required - i.e. Budget meeting of Autumn 2005 for
Budget 2006/7. (Noted)
(g) Car Park Licence inc Bottle Bank and Bus Shelter 2005/6: - (i) The
Clerk reported he had, on behalf of IPC, asked for the Car Park Licence
to be renewed (letter from NDDC 8.2.05 refers) for the period 1.5.05 to
30.9.05 - total cost of £1,459.35 (£1,242.00 + Vat) - NB: - an increase
of £69.32 on 2004. IPC RESOLVED to support this decision. (Noted)
(ii) In addition a similar request has been made (letters from NDDC
8.2.05 refers) to renew the Bottle Bank Licence (no fee) and Bus
Shelter. The Clerk said the relevant invoices were still awaited. IPC
RESOLVED to support this decision. (Noted)

2502/11 PLANNING
a) Extension to residential home to provide 20 bed nursing accommodation
(renewal of unimplemented planning permission 27375) at The Meadows,
Anstey Way, Instow (Reference No. 39314): - The Clerk reported upon his
enquiries with NDDC Planning Department (21.1.05) following IPC’s
deliberations on 17.1.05 and of the receipt of a letter/documents
(28.1.05) as a consequence. The Clerk said this had been forwarded to
IPC’s PSC (Cllr White) by post (28.1.05). After discussion, it was
RESOLVED to recommend approval of this application but to point out to
NDDC that the road layout in Anstey Way had changed since the last
application and that this might have a bearing on the entrance to The
Meadows.(Action: The Clerk)
b) (i) Copy letter from NDDC Planning Department (dd 12.1.05) to Bowden
Partnership Tree Surgeons of Bishops Nympton concerning “Town and
Country Planning Act 1990 - Application for consent to carry out
arboricultural works to trees in an area subject to a Tree Preservation
Order made by the Local Planning Authority - Commodore Hotel and (ii)
“Application for consent for works to trees covered by a tree
preservation order in respect of felling 1 evergreen oak and 6 sycamores
at The Commodore Hotel, Instow (Reference No 39356): - (i) The Clerk
briefed Council as to the content of this letter. (Noted)
(ii) The Clerk reported receipt of this application (28.1.05) and of
having posted it to the Chairman (29.1.05) for the attention of IPC’s
PSC. After discussion, it was RESOLVED to recommend approval of this
application. (Action: The Clerk)
c) Letter (received 24.1.05) from NDDC concerning “Outline Application
for erection of a bungalow (amended indicative drawings) at All Saints
Chapel, Anstey Way, Instow (Reference No 36690): - The Clerk reported
that NDDC had GRANTED outline planning permission for this application
with conditions as listed; he said the letter had been copied to Cllrs
with their agenda papers (10.2.05). (Noted)
d) Letter (dd 21.1.05) from NDDC Planning Manager reference “Appeal -
Town and Country Planning Act 1990: Addition of second floor to dwelling
(amendment to planning permission 35529) at Plot 2, Lane End Road,
Instow (Reference NO. 38471): - The Clerk reported that this appeal was
against the decision of the local planning authority to refuse planning
permission for the above development. The Clerk advised IPC that it had
unanimously recommended refusal of this application (September 2004) on
the grounds the design was not in keeping with dwellings in the
vicinity/there was concern it would have an adverse effect on the
neighbouring properties. He added that any further observations of IPC
needed to be submitted by 28th February 2005 direct to the Planning
Inspectorate. After discussion it was RESOLVED to take no further
action. (Noted)
e) Application for consent for works to trees covered by a tree
preservation order in respect of felling of 2 willows and 1 cherry at
Bar Beacon and All Saints Chapel, Anstey Way, Instow (Reference No.
39385): - (i) The Clerk reported receipt of this application (4.2.05)
and of having posted it to the Chairman (4.2.05) for the attention of
IPC’s PSC. After discussion it was RESOLVED to recommend approval of the
application. (Action: The Clerk)

over detached garage to form dependant relative annexe at Gorse Hill,
Instow (Reference No. 39248): - The Clerk said this letter stated that
NDDC had GRANTED permission for this application with conditions as
listed and that a copy of the letter had been copied to Cllrs with their
agendas papers (10.2.05) for their information. (Noted)
g) Outline application for erection of dwelling set in existing walled
garden of The White House, Lane End, Instow (Reference No. 39423): - The
Clerk reported receipt of this application (7.2.05) and of having posted
it to the Chairman (7.2.05) for the attention of IPC’s PSC. After
discussion it was RESOLVED to recommend refusal of the application on
the grounds that the proposed entrance would create a road safety hazard
on the highway. (Action: The Clerk)
h) Application under Regulations 3 of the T and CP General Regulations
1992 for demolition of existing toilet block and construction of new
Charter Toilets at Marine Car Park, Instow (Reference No. 38516): - The
Clerk reported receipt of a letter (dd 4.2.05) from the Planning Manager
NDDC concerning “Charter Toilets - Marine Parade Car Park, Instow”. The
Clerk appraised Council of the contents the gist of which was that on
the 4th October 1973 outline-planning approval was granted under
reference N.I.7171 for residential development on the Marine Hotel site
and the Garage/Car Park opposite. Detailed consent was then given on the
16th April 1974 under reference N.I. 19478 showing 15 flats, which have
been built on the site of the hotel, and 14 on the car park site which
have not been built. The Clerk said that some plans were available for
perusal. (Noted)

having posted it to the Chairman (11.2.05) for the attention of IPC’s
PSC. After discussion it was RESOLVED to recommend refusal of the
application on the grounds the development would not be in keeping with
other dwellings in the vicinity, would adversely affect the privacy of
neighbouring properties and create a traffic hazard through the increase
of motor vehicles parking and/or stopping in Anstey Way/New Road.

k) Copy Letter (dd 10.2.05) from NDDC to parishioner (Mr Roger Steer
Passmore) reference “Town and Country Planning (General Permitted
Development) Order 1995, Schedule 2 and Part 6 and 7 Agricultural and
Forestry Building and Operations: agricultural prior notification for
erection of steel framed building for storage and for housing animals at
Land off Orchard Farm, Instow (Reference No. 39355): - The Clerk
appraised Council of the content of the letter. (Noted)
l) Email (dd 27.1.05) from Chairman to Clerk reference “Road Signs -
Marine Parade”: - The Clerk reported he had contacted Mr Tucker (NDDC -
Planning) and asked him for an update (email of 28.1.05 refers). He said
he had subsequently received a letter (dd 11.2.05) and booklet on
“Street Name Plates & House Numbering” - the Clerk appraised IPC of the
content of letter. The booklet was retained by the Chairman for
inclusion with IPC’s Planning papers. (Noted)

2502/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
(i) Blocked Culvert/Barton Cross-Anstey Way: - Cllr May said a blocked
culvert, previously reported by IPC to DCC (see item 2502/9 (ii) (g)),
had still not been cleared and needed urgent attention. It was RESOLVED
the Clerk should speak to DCC. (Action: The Clerk)
(ii) Wheelie Bins/Black Bags: - Cllr Johns said there was still some
confusion in the parish as to when black bags were collected as opposed
to black wheelie bins that within the next week or so would only be
collected fortnightly. It was RESOLVED the Clerk should speak to Cllr
Cann to establish an answer. (Action: The Clerk)
(iii) Footpath/Overgrown Hedge (Barton Cross): - Cllr Cook said this
footpath was overgrown and impeded the progress of pedestrians. The
Clerk said this was the responsibility of the landowner who Cllr Cook
agreed to speak to (Noted)
