Council for the ensuing year. Councillor White signed the Declaration of
Acceptance of Office and took the chair. (Noted)
2905/4 ELECTION OF VICE CHAIRMAN FOR THE ENSUING YEAR
RESOLVED unanimously that Councillor M Green, being duly proposed (Cllr
Harper) and seconded (Cllr Cook), be elected Vice Chairman for the ensuing

2905/5 POLICE REPORT
a) Crime: -
Constable Hodgson reported that five offences had been reported in the parish
since the last meeting, namely, possession of a class B drug (x2), theft from
a motor vehicle (x1), criminal damage to a motor vehicle (x1) and the theft of
a dinghy (x1). (Noted)
b) Other Matters: -
Constable Hodgson said that in the same period 8 other incidents had been
reported to the police, namely, x3 “information”, x2 “crime related”, x1
“traffic related” and x2 “concern”. (Noted)
c) Parking Issues: -
Constable Hodgson said he was currently dealing with some parking issues in
Kiln Close Lane and that he was, as a consequence, in liaison with the North
Devon Housing Association. (Noted)
d) Sand Dunes – Rubbish from Parties: -
In answer to a question from a parishioner, Constable Hodgson said there
continued to be a regular police presence in the vicinity of the sand dunes to
combat rowdiness and related matters and that police were patrolling as part
of its PACT (Police and Communities Together) commitment. He added they were
concentrating on unsociable behaviour and underage drinking and had seized
alcohol and moved youngsters on. He spoke of the police Youth Intervention
Team, who monitored websites for information on local gatherings, and of
Dispersal Orders that could be implemented if felt appropriate. (Noted)
e) Instow Businesses – Crime Information: -
In answer to a question from Cllr Johns, Constable Hodgson said he would look
into resurrecting a former business watch initiative that had formerly
operated in the area whereby the police passed information of crime, crime
trends and criminals to local businesses on a needs and necessary basis.

2905/6 PARISHIONERS
a) Sand Dunes – Rubbish: -
A parishioner said there was evidence of a bonfire and broken bottles in the
sand dunes. Cllr Cook said he had seen this himself and tidied it up. (Noted)
b) TTEF Matters: -
Mrs Rose Day (IPC’s TTEF Representative) spoke to a paper she circulated to
Cllrs. She spoke of “The Seven Sands – Fremington Quay” (cannot be broken up
on site), “Churchfield Slip – Appledore”, (jet skis causing a problem),
“Penhill Marsh” (quad bike users warned), “Appledore Quay Wall”(trial panel in
place), “Defra – Application to designate Torridge Estuary as a Nitrate
Vulnerable Zone” (EA would be pleased to hear of evidence of eutrophication
{i.e. green weed growth, foaming, algae blooms etc} in the estuary vide
melanie.hitchens@environment-agency.gov.uk (Noted)
c) DCC Footpath – Yelland to Old Power Station:-
A parishioner said he had written to DCC (see item 2905/14 (l)) as regards
this particular venture and noted that vegetation could not be cleared during
the period 19.3.09 to 31.7.09. He outlines his objections to the project.

d) Footpath and Vegetation Issues: -
(i) A parishioner reported upon issues of relevance to the Venn Cross to Tarka
Trail footpath (hedges, livestock, fingerpost signage, obliterated signs etc),
Down Road footpath (new fingerpost sign), Coastal Footpath sign on beach of
second sand dunes (incorrect siting?), “inappropriate” vegetation clearance on
the seaward side of the Cricket Club and no access to coastal footpath at this
location at high tide. (Noted)
(ii) The Clerk said the Venn Cross to Tarka Trail footpath had recently been
passed as being within the appropriate criteria by the DCC footpath warden,
signs were only necessary at the beginning and end of a footpath (waymarks
were in place at the Tarka Trail intersection), a new sign had recently been
fitted at Down Road to replace one that had been reported missing to IPC
(April 2009), the stiles (x2) on this particular footpath had recently been
made more user friendly as a result of a recent complaint (lowered and an
extra step fitted), land owners had no obligation to separate livestock from
users of footpaths, the coastal footpath sign on the beach had previously been
reported to the NDCCS (IPC March 2009), and that the route for the coastal
footpath from the second sand dunes to the main beach at high tide was by way
of the footpath/lane adjacent the cricket club. The Clerk said he could not
comment on the “inappropriate” vegetation clearance on the seaward side of the
Cricket Club as this was private land and the parishioner was advised to take
this up direct with the landowner; he said he would investigate the
“obliterated” signs near to the cricket club and act as necessary. (Noted)
e) Village Signs: -
A parishioner said both signs at either end of the village along Anstey Way
were scruffy and needed attention. IPC RESOLVED to have the Clerk liaise with
DCC Highways. (Action: The Clerk)
f) Allotments: -
(i) A parishioner enquired whether the need for allotments within the parish
could be solved by way of utilising the field to the village side of Atturm.
The Clerk reminded Council that a previous approach to the landowners to
utilise this area as a Children’s Play Area had not materialised. (Noted)
(ii) Cllr Moores (NDC) said a recent enquiry of his within NDC had not found
evidence of ownership of this particular piece of land and that his enquiries
were continuing. (Noted)
g) Cllr Cann (DCC Elections): -
A parishioner said he wished to compliment Cllr Cann for the outstanding work
he had done for the parish and that he sincerely hoped this would continue
after the forthcoming DCC elections. (Noted)
2905/7 REPORT COUNTY COUNCILLOR R CANN
a) General: -
Cllr Cann spoke of “Westleigh Junction” (15 accidents in 2 years), “New School
Site” (ongoing negotiations with landowner in Yelland area), “DCC Footpath –
Power Station” (work to commence soon), “Utilities – Road Maintenance” (DCC
can now fine them if roads not replaced as found), “Road Surface Dressing” (£2
million set aside for North Devon), “NDC Environment Portfolio” (has retained
this portfolio; food waste collection to commence soon), “Toilets – Vandalism”
(a major problem), “Allotments – Bickington” (36 provided), and “P3 Monies –
Walks Leaflets”. (Noted)
b) Thanks to IPC/Clerk: -
Cllr Cann said he wished to thank IPC and the Clerk for all the positive
support given to him over the last 8 years. (Noted)
c) Charter Toilets – Lane End Close: -
Cllr Harper said he had noted mould on the walls of these toilets that
suggested the air vent was not working efficiently. In addition, somebody had
sprayed silver paint on the rear of a door. Cllr Cann agreed to advise the
necessary NDC department and have the issues rectified. (Action: Cllr Cann)
2905/8 REPORT OF DISTRICT COUNCILLOR B MOORES
a) General: -
Cllr Moores spoke of “New School – Instow” (still awaiting a reply from DCC),
“NDC’s Action Plan – What Communities Want” (£165,000 approved by NDC’s
Executive to support this initiative), “Strategic Housing Inspection” (had a
good report), “Anti Social Behaviour – Students” (ND College Students have
produced an innovative leaflet), “Community Cllr Grant Scheme” (grants to
Instow Parish Hall - £300/Centenary Celebrations, Instow Primary School -
£1,000/Tools & Training to become a Forest School and Instow in Bloom -
£585/Annual Floral Displays). (Noted)
b) Cllr Cann (DCC Elections): -
Cllr Moores said although he could not support Cllr Cann in the forthcoming
DCC elections, he wished him well and if successful would be very happy to
work with him as in the past. (Noted)
c) Traffic Congestion - Buses: -
(i) The Chairman reminded Cllr Moores that at the last meeting he had said the
action by Mr Milton as regards traffic congestion and buses in the village was
nothing to do with him and yet within a day or so of that meeting had appeared
in Mr Gill’s DCC Election manifesto supporting such an initiative. (Noted)
(ii) Cllr Moores said IPC were well aware of his personal views on the matter,
that had not differed, and that when asked by a fellow Cllr, who had put
himself forward for election as the area’s DCC Cllr, had merely advised Mr
Gill of the pressing issues within the parish. (Noted)
(iii) The Chairman reminded Cllr Moores that as far as IPC was concerned, the
village was happy with the current situation and that the issue was not up for
debate. (Noted)
(iv) Cllr Cann (DCC) said he was always happy to take an active part in
discussing/resolving traffic management issues within the parish and to
support, as a result, the views of parishioners. (Noted)
(vi) Cllr Moores said he agreed with the sentiments as expressed by Cllr Cann.

2905/9 MINUTES
It was RESOLVED that the April 2009 minutes of Instow Parish Council be
approved and signed. (Noted)
2905/10 MATTERS ARISING FROM THE MINUTES
a) Item 2904/3 (b) - Neighbourhood Watch (NW): -
(i) The Clerk advised IPC he had liaised with PCSO Dan Cornish (email of
17.4.09 refers) and had ascertained there were currently Neighbourhood Watch
groups up and running in New Road, Victoria Terrace and Lane End Close and
that subject to a coordinator being found another was soon to be set up in
White House Close. (Noted)
(ii) The Clerk said he had also ascertained that PCSO Cornish was looking at
setting up a Boat Watch group in Instow. (Noted)
(iii) The Clerk said that if a volunteer Cllr were available it would be
possible for NW messages, sent out by the police by email, to be forwarded to
that Cllr and then disseminated as appropriately throughout the parish e.g.
parish magazine, notice boards etc. (Noted)
(iv) After a discussion, Cllr Mrs Dipper agreed to liaise with the coordinator
of the New Road NW scheme, monitor the quantity and quality of such messages,
and report back to Council as and when. (Action: Cllr Mrs Dipper)
b) Item 2904/8 (a) – Village Gateway Initiative: -
The Chairman provided IPC with an update; he said he had visited DCC Highways
at the Civic Centre and provided them with a plan of the gateways as drawn by
Cllr Thomas. He said DCC were now engaged on a safety audit as regards the
gateway construction and locations and had promised to get back to him asap.
He could then liaise with NDC Planning and make the necessary planning
applications. IPC RESOLVED to support this course of action. (Noted)
c) Item 2904/8 (b) - Parish Plan: -
(i) Cllr Harper provided IPC with an update and produced the final draft of
the proforma that IPC RESOLVED to adopt. (Noted)
(ii) The Clerk confirmed he had made contact with NDC
(Community Development Officer) who had agreed to cover the cost of printing
750 double sided leaflets when required. (Noted)
(iii) After a discussion, led by Cllr Harper, IPC RESOLVED to circulate the
parish plan proforma to parishioners in September thus avoiding the current
election season and summer holiday period. (Noted)
d) Item 2904/8 (d) - DCC Commons Act 2006 Seminar: -
(i) The Clerk confirmed that he and Cllr Harper had visited County Hall on
Friday 1st May 2009 and attended this seminar. (Noted)
(ii) Cllr Harper then provided a verbal report and made recommendations of
relevance to the Recreation Ground/Picnic Area (registered as a Village Green
– VG92) and land (beach) between mean high tide mark and the seawall along
Marine Parade between the Commodore and Boathouse. He tabled a report at the
meeting that was circulated to Cllrs for perusal. (Noted)
(iii) Following a discussion, IPC RESOLVED to take the necessary action to
have the land (beach) between the mean high tide mark and the seawall (as at
(ii) above) registered as common land (Cllr Harper to deal) and to establish
the best course of action as regards the “common land” status of the
Recreation Ground/Picnic Area, that is, have it deregistered completely or
de-registered/re-registered in the name of IPC (Clerk to deal). (Action: Cllr
Harper/The Clerk)
(iv) The Clerk reported receipt of an email (dd 8.5.09) from DAPC reference
“Re-registration of Common Land under The Commons Act 2006”; he said it had
originally come from a Steve Byrne (Lancashire) who Cllr Harper had
ascertained to be undertaking a public interest project that is funded by the
Joseph Rowntree Reform Trust Ltd; results can be found on
www.commonsreregistration.org.uk (Noted)
(v) Cllr Thomas reported that two of the picnic benches at the picnic site had
been damaged; IPC RESOLVED to report this to NDCCS. (Action: The Clerk)
e) Item 2904/9 (i) (d) – Marine Parade/One Way Bus Service Proposal: -
(i) The Clerk confirmed he had sent a letter (by email – 20.4.09), as
instructed, to Mr Milton and said that Cllrs had been forwarded a copy by
email etc. (21.4.09). He read the letter to Council. (Noted)
(ii) The Clerk reported receipt of a copy email (dd 20.4.09) from Mr Milton to
DCC (Mr Netherway) reference “Bus Routing – Instow”; he said Cllrs had been
forwarded a copy by email etc. (21.4.09). The Clerk summarised the content.

(iii) The Clerk then reported receipt of an email (dd 21.4.09) from Mr Milton
to IPC’s Chairman, Cllr White, reference “Bus Routing – Instow”; he said he
had forwarded a copy to Cllrs by email etc. (21.4.09). The Clerk read said
email to Council. (Noted)
(iv) A discussion then ensure at the conclusion of which IPC RESOLVED to
liaise with DCC Highways so as to determine what action it proposed as regards
“bus congestion” issues. IPC recognised it would not be effective or rational
to act in haste and that the best course of action was most probably the
formation of a traffic management sub committee in the autumn and to work
closely with DCC Highways to establish a measured and practical way forward.
IPC noted that the inclusion of a further pinch point between the Boathouse
Bus shelter and the Sand Dunes Car Park might be appropriate and a meeting
with the Bus Companies could prove fruitful. The Clerk was asked to liaise
with Cllr Cann (DCC). (Action: The Clerk)
f) Item 2904/9 (i) (f) – Instow Parish Council’s Draft Annual Report 2008/9: -
(i) The Clerk reported he had received no response(s) from Cllrs as regards
the draft Annual Report 2008/9 that had been circulated at the last meeting.

(ii) He then submitted a final copy to Cllrs for approval that contained an
updated “Receipts and Payments” analysis (see item 2905/12 (5) (f) (b)).

(ii) After a discussion, IPC RESOLVED to adopt the report as written and the
Clerk ` was asked to circulate it as necessary. (Action: The Clerk)
g) Item 2904/12 (a) – 65th Anniversary D Day Landings: -
(i) Cllr Dipper provided a report, that is, there is to be a service held at
Instow Church at 11am on Sunday 7th June 2009 (D Day Landing Anniversary is on
the 6th June) led by the Reverend Geoff Calway with input by Major Lugg and
his staff from Atturm together with Instow School and maybe Bideford Sea
Cadets. Cllr Dipper said she had arranged for an appropriate wreath to be laid
at the War memorial after the service – see finance item 2. Cllr Mrs Dipper
said she hoped that as many Cllrs might attend as possible. (Action: IPC Cllrs)
(ii) The Clerk said the Church would be open on the previous day with an
exhibition of the school’s recent project on the “Effects on Children Post War
Time”. (Noted)
2905/11 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 8.4.09) fr5om DCC reference “Parish Lengthsman Service”: -
(i) The Clerk said this stated that the lengthsman was to visit Instow for
weeks commencing 24.8.09 and 8.2.10 and that requests for particular work in
which they should be engaged in should be addressed to the Customers Service
Centre (0845 1551004), Customer Technical Support Team (01271 388727) or by
email to the Customer Technical Support Team at northareahm@devon.gov.uk

(ii) The Clerk advised IPC that in the past, contacting the area’s Highways
Superintendent had proved to be the best solution (on a day to day and needs
basis) although this was becoming increasingly more difficult because of his
“pressure of work”, lack of resources and budget constraints. The Clerk
suggested that he continue as normal but copy in each request to the email
address as at (i) above as a back up. IPC RESOLVED to support this
recommendation. (Noted)
b) Letter (dd 14.4.09) and pamphlet from “Equality and Human Rights Commission
(EHRC) reference “Public Sector Duties”: -
(i) The Clerk advised IPC that this stated that the forthcoming Equality Bill
would harmonise the existing three public sector duties into one equality duty
which would also be extended to cover all seven equality strands of age,
disability, gender, gender identity, race, religion or belief and sexual
orientation. He said these changes were unlikely to come into force until the
latter part of 2011. (Noted)
(ii) The Clerk said the EHRC was advising IPC of the prospect and likely
timing for a single public duty and to underline the importance of continuing
to meet its existing obligations under the current race, disability and gender
equality duties until then. He added that under existing duties IPC was
obliged to pay “due regard” to race, disability, and gender equality; in
practice this meant that the EHRC were expecting public bodies, like IPC, to
be clear about what significant issues for race, disability and gender
equality were in relation to its core business and taking appropriate and
proportionate action to deliver between equality outcomes. (Noted)
(iii) The Clerk said he had copied the letter to Cllrs with their agenda
papers (14.5.09) and that the pamphlet was held by him for future information.

(iv) The Clerk advised IPC he had liaised with DAPC (18.5.09) and as a
consequence drafted an “Equality Policy” document for IPC to consider
adopting. The Clerk summarised the advice provided by DAPC and provided Cllrs
with a copy of the draft document for perusal. (Noted)
(v) After a discussion, IPC RESOLVED to adopt the draft “Equality Policy” that
was signed by the Chairman and Clerk. (Noted)
c) Letter (dd 15.4.09) from NDC (Legal Services Unit) reference “Fouling of
Land by Dogs (NDC) Order 2009”: -
(i) The Clerk said this stated that NDC was proposing to adopt such an order
and that any representations should be addressed to the Head of Service for
Environmental Health and Housing at NDC by the 21st May 2009. (Noted)
(ii) The Clerk said he had forwarded a copy of the letter and order to Cllrs
with their agenda papers (14.5.09). (Noted)
(iii) The Clerk advise IPC that in view of the response date (21.5.09) he had
advised NDC that, in principle, IPC would undoubtedly be in favour of this
proposal; IPC RESOLVED to ratify this decision. (Noted)
(iv) The Clerk then referred to a series of emails (17.4.09 to 20.4.09)
between him, Cllr Cann and Andrew Millie (NDC Environmental Health Dept)
reference “Beach Dog Signs” and the implications of the proposed “Fouling of
Land by Dogs (NDC) Order 2009”. He said the appropriate part of an email (dd
20.4.09) from Andrew Millie had been forwarded to Cllrs with their agenda
papers (14.5.09). (Noted)
( (v) The Clerk summarised the crux of the email; i.e. removed dog signs being
replaced by new signs, if adopted, the “Fouling of Land by Dogs (NDC) Order
2009” would not come into force until early July (2009), adoption of this
order would not affect Instow’s unique and local “land ownership” problems
(for example landowners can still give dog owners permission to foul their
land), dog wardens would continue to visit Instow on a regular basis,
residents should be reminded of the need to provide dog wardens with as much
information as possible of “offending” dogs and their owners (i.e.
description/name/address of offender, dog, location, time, date etc) and
finally, and on a positive note, since liaison with the Crown Estate in 2008,
greater clarity on the beach ownership had been achieved and this is a
significant step forward. A discussion ensued. (Noted)
(vi) In response to a recommendation by Cllr May, and following a discussion,
IPC RESOLVED to enquire of the appropriate authorities (i.e. NDC and NDCCS) if
they could include on their “dog mess” publicity the fact that dog faeces
could cause abortions in sheep. (Action: The Clerk)
d) Email (dd 18.4.09) from Cllr Dipper reference “Beck’s Sign – The Bar”: -
(i) The Clerk said this issue had been raised because of the apparent light
pollution this new sign seemed to emanate in the vicinity and questioned
whether anything should/needed to be done about it. (Noted)
(ii) The Clerk said he had liaised with Cllr Harper who felt the relevant sign
did not appear to be “out of the ordinary” and suggested that unless
complaints were received that no further action was taken. (Noted)
(iii) The Clerk advised IPC that although this light could well be (or need to
be) subject of a planning application (conservation area, AONB etc) he had not
been advised by NDC Planning and that to date no complaints had been received
by him as regards light pollution. (Noted)
(iv) The Clerk suggested that no further action should be taken unless
complaints were received and that these should then be referred to the
appropriate department of NDC by the complainant personally. (Noted)
(v) After a discussion, IPC RESOLVED to monitor the situation closely and take
action as seen fit particularly if the situation were to escalate. (Noted)
e) Letter (dd 21.4.09) from NDC (Community Development) reference “Parish
Council Workshop: An Update on the Local Development Framework (LDF) and
Sustainable Communities”: -
(i) The Clerk said this stated that IPC was invited to attend a LDF Parish
Council workshop at one of the following venue; Thursday 28th May at Braunton
Parish Hall (9.30 am to 12.15 pm) or Monday 1st June at Filleigh Village Hall
(6.30 pm to 9.15 pm). He said the workshop would provide an update on the
preparation of the Core Strategy within the LDF and would outline the key
policy areas that were being considered. He added that the Core strategy set
out the vision and strategic spatial objectives for North Devon and Torridge
Districts and was therefore an important document. (Noted)
(ii) The Clerk advised IPC that this workshop was somewhat related to the
recent “Settlement Assessment” survey that was processed by Cllr Harper and an
IPC sub committee. (Noted)
(iii) The Clerk provided a copy of the letter and workshop programme to Cllrs
with their agenda papers (14.5.09). (Noted)
(iv) After a discussion IPC RESOLVED to support the attendance of Cllr Mrs
Dipper and the Clerk to whichever event was most suitable to them.

f) Letter (dd 24.4.09) from DCC (Cllr Brain Greenslade) reference “Highway
Maintenance 2009/2010”: -
The Clerk said this stated that a cash increase of 6% (£58,895 million) had
been set aside in this year’s budget (2009/10) for highway maintenance but in
view of the fact the past winter pattern had led to a significant amount of
damage to the highway through snow, frost and water, DCC’s Executive had
allocated a further £2 million to ensure this winter’s damage was made safe
resulting in a overall cash increase of just over 9.5%. (Noted)

(iii) The Clerk reported receipt of a further letter (dd 14.5.09) and poster
attachment from NDC (Local Returning Officer) reference “Statement of Polling
Stations (European/DCC) – 4th June 2009”; he confirmed that the posters had

h) Email (dd 3.5.09) and attachment from Cllr Harper reference “30’ Highway –
Allotment Field and Recreation Ground”: -
(i) The Clerk said Cllr Harper had been researching the old minute books (so
far 1898 to 1991) to establish all the historical data as regards these areas
of land within the parish; he said his work was not as yet complete and that
the attachment was a précis of his work. (Noted)
(ii) Cllr Harper then summarised his work to date and suggested that the
attachment, as above, that contained all the salient data (and comments by
Cllr Harper) was filed with the minutes of this meeting for future reference.

reference “Admissions to Schools 2010-11”: -
(i) The Clerk said this stated that admission arrangements for schools in the
Devon Local Authority area had been determined for the academic year 2010/11
and that as representatives of the local community it wished to draw IPC’s
attention (and that of the community) to the arrangements which were available
for inspection at http://www.devon.gov.uk/admissions-determined2010; the Clerk
said he had forwarded the email to Cllrs with email addresses together with
the Headteacher of Instow School who could offer IPC some advice and guidance
on the subject. (Noted)
(ii) The Clerk also advised IPC he had also copied the email (dd 6.5.09) to
the Instow Pre School Group Organiser in order to seek her comments. (Noted)
(iii) The Clerk reported receipt of an email (dd 7.5.09) from the Instow Pre

The Clerk reported he had attended a meeting at Exeter on Tuesday 12th May
2009 and that discussions had taken place on such issues as devolution of
services and assets, for example, in the event of a county unitary authority.
He added that a DAPC organised conference entitled “Empowering Communities in
Devon” was to be held at Sandy Park (Exeter Rugby Ground) on 22nd July with
speakers from the police, health, town/parish councils, DCC, Government SW
etc. He said IPC would be invited to send probably two representatives.

k) Quality Parish Council –Reaccreditation (IPC): -
(i) The Clerk reported he had completed his “Power of Well Being” (POWB)
assignment and was about to submit it to NALC for approval. He said if
successful, he would have topped up his current AQA Qualification in Local
Government which was a necessary factor in IPC’s QPC reaccreditation. (Noted)
(ii) The Clerk advised Cllrs that his next step, on IPC’s behalf, was to
review the full conditions for QPC reaccreditation and to advise IPC what
additional processes it might have to adopt or accomplish (such as Cllr POWB

The Clerk advised Cllrs that this confirmed IPC was in balance. (Noted)
(b) Crown Estate (CE) Beach Lease 2010+ : -
(i) The Clerk reported he had forwarded an email to the CE (29.4.09) seeking
some guidance as to when the process to renew the lease might commence.
(Noted)
(ii) The Clerk further reported receipt of an email (dd 6.5.09) from the CE
advising that “some head of terms” would be forwarded for IPC’s perusal asap
and if acceptable could then be drawn up into a legal document i.e. a lease
(by Bond Pearce – presumably CE’s solicitors). (Noted)
(iii) The Clerk told IPC he had suggested to the CE’s agent that IPC would
most probably be happy for a fixed term rent based on average incomes over the
past few years; this would also include RPI rent reviews which are,
apparently, more straightforward to implement for both sides. IPC RESOLVED to
support this assumption of the Clerk. (Noted)
(iv) The Clerk reported he was to meet with the CE’s agent (Michael Bapty) at
Instow on 26th June when he would undoubtedly discuss the lease in greater
detail and ownership of the foreshore etc in the vicinity of Instow. (Noted)
(v) The Clerk also reported receipt of a letter (undated – received 7.5.09)
from the CE (Finance Process Manager) reference “Changes to Your Rent
Invoice”; he said it stated that some changes had been made to the standard
invoice so that it would be easier to read and understand. The Clerk said it
had been filed for future reference. (Noted)
(c) Quay Car Park Lease 2009: -
(i) The Clerk reported receipt of a letter (dd 21.4.09) from NDC (Estates
Unit) offering IPC a new licence to run from 1st May 2009 to 30th September
2009 on the same terms and conditions as in former years with a revised
licence fee of £2,000. The Clerk confirmed he had accepted the offer and
returned the appropriate paperwork (24.4.09). IPC RESOLVED to support this
course of action. (Noted)
(ii) The Clerk confirmed the car park machine had been serviced on Monday 27th
April – see finance item 2. (Noted)
(d) NDC Licence for Quay Car Park Bus Stop and Bottle Bank: -
(i) The Clerk reported receipt of x 2 letters (dd 21.4.09) from NDC (Estates
Unit) offering IPC a new licence for the Bus Shelter (NDC advised {24.4.09}
that this offer had already been received, accepted and paid {£14 plus VAT =
£16.10} – see April 2009 meeting) and bottle bank (free). (Noted)
(ii) The Clerk confirmed he had accepted the bottle bank offer and returned
the appropriate paperwork (24.4.09). IPC RESOLVED to support this course of

(e) Inland Revenue – End of Year (2008/2009) Returns (P35 and P14s’): -
The Clerk confirmed all relevant papers had been dispatched to the Inland
Revenue as necessary. (Noted)
(f) Annual Return for the Year ended 31st March 2009: -
(i) The Clerk confirmed he had met up with Mrs Mary Jane Scott (IPC’s IA –
23.4.09) and handed her all the necessary financial paperwork to complete the
audit. (Noted)
(ii) The Clerk said he had collected all IPC’s financial paperwork from Mrs
Mary Jane Scott (7.5.09) together with a letter (dd 15.5.09) and partly
completed Annual Return (19.5.09). (Noted)
(iii) The Clerk reported that Mrs Mary Jane Scott (IPC’s IA) had completed the
internal audit/necessary paperwork and then referred in particular to her
letter (dd 15.5.09); the relevant letter was copied to Cllrs at the meeting
together with a copy of the Annual Return Form (partly completed).
(iv) The Clerk then said that the following actions were now necessary by IPC:

(a) Annual Return 2008/9 (General): -
The Clerk advised IPC that Mrs Mary Jane Scott had confirmed that nothing had
arisen in the course of her examination of the parish records which she
considered should be brought to the attention of Councillors. (Noted)
. (b) Audited Receipts and Payments Account 2008/9: -
(i) The Clerk advised IPC that Mrs Mary Jane Scott was advising IPC to ratify
the original Draft Receipts and Payments Account 2008/9 (as prepared by the
Clerk and circulated at the Annual Parish Meeting/IPC Meeting in April 2009)
but to do so in a slightly amended format. (Noted)
(ii) The Clerk then spoke to a copy of both the original draft and IPC’s
“approved” IA’s copy; copies were provided to Cllrs at the meeting – the Clerk
explained the minor differences. (Noted)
(iii) IPC RESOLVED to ratify the amended IPC Receipts and Payments account.
(Noted) (c) Annual Return (Specific) –
(i) The Clerk advised IPC that Mrs Mary Jane Scott had confirmed she had
completed all the relevant sections of the annual return and advised
Councillors that, if they saw fit, they should adopt the Return at this (May)
meeting with the details (in green spaces) at the foot of page 2 being
completed and signed by the Chairperson/Clerk (Responsible Financial Officer)
as necessary and similarly at the foot of page 3. (Noted)
(ii) The Clerk then added that before signing at the foot of page 3, however,
Mrs Mary Jane Scott was advising that Council should carefully consider the
answers she had provisionally entered to the 9 questions on that page and if
altered in any way whatsoever that an explanation be given to her as to
reason(s) for change. (Noted)
(iii) The Clerk further advised Council that after completing/signing pages 2
and 3, Mrs Mary Jane Scott had asked for the annual return form to be sent
back to her for submission to the District Auditor. (Noted)
(iv) A discussion then ensued with the Clerk running through the Annual Return
in detail at the conclusion of which IPC unanimously RESOLVED to adopt it as
written and to complete the form as advised; the Chairman and Clerk signed in
the appropriate places. (Noted)
(d) District Auditor/Public Notices
(i) The Clerk confirmed that the appropriate “Exercise of Electors’ Rights”
form had been exhibited at the Post Office (together with a copy of IPC’s
Draft Annual Accounts 2008/9) on the 7th May with details of “Inspection Days”
(being Monday to Friday {9 am to 5 pm}) for the period 22nd May to the 19th
June 2009 (i.e. 20 working days). (Noted)
(ii) The Clerk said that no requests, as of the date of the meeting, had been
received by him to examine IPC’s financial records albeit the actual relevant
period didn’t commence until 22nd May 2009. (Noted)
(iv) Instow Parish Hall – Charity Number 300873
The Clerk then advised IPC that in Mrs Mary Jane Scott’s view IPC are the
custodian trustees of the parish hall, called the village hall, which means
that IPC holds the legal title, but can only act under the directions of the
Managing Trustees of the Hall (the Management Committee). Each of the Managing
Trustees agrees each year to act under the terms of the Deed of Trust by
signing the Parish Hall Management Committee Minute Book. The Deed of Trust
terms, therefore, apply to all the Managing Trustees in deciding their actions
and they would be obliged, under the terms of the Deed, to act in accordance
with those terms. In particular, it is held in trust for the purposes of a
Village Hall for the use of the inhabitants of Instow and the neighbourhood,
without distinction of sex or of political, religious or other opinions and,
in particular, for use for meetings, lectures and classes and for other forms
of recreation and leisure-time occupation, with the object of improving the
conditions of life for the said inhabitants. If at any time, the Management
Trustees (or the Custodian Trustees in their absence) decide to dispose of the
parish hall, a general meeting of all the inhabitants of Instow over the age
of 18 years would need to be called to obtain their approval. Any monies
arising from such a sale shall be used to provide another such building to
giver the inhabitants the same benefits, or held such that the monies be used
to provide equivalent benefits for all of the people of Instow, subject to the
approval of the Secretary of State. As such, it should be recognised that the
parish hall is not the “property” of Instow Parish Council, but it has been
included in the Asset Register since they are the Custodian Trustees. (Noted)
(g) Allianz Cornhill (AC) reference “Insurance Renewal 2008/9 – 1st June
2009”: -
(i) The Clerk told IPC he had spoken with Cllrs Johns and Crombie and it was
recommended that the AC’s current terms for renewal were accepted without
amendment or addition. (Noted)
(ii) IPC RESOLVED to accept and adopt this course of action. (Noted)
(h) Letter (dd 20.4.09) from NDC (Insurance and Technical Assistant) reference
“DAPC Subscriptions 2009/10”: -
The Clerk said this stated that DAPC were currently reviewing its VAT status
and that as a result they were unable to advise the amount of subscription due
from IPC. Therefore, no deductions would be made at source (from NDC precept
first payment as usual); DAPC would be charging IPC direct in due course.

(k) Letter (dd 5.5.09) from a Fremington parishioner reference “Dispensation
from Quay Car Parking Charges – Charity Swim Collections”: -
(i) The Clerk said the writer had been swimming daily at Instow for 14 year
and to date had collected £12,170 for Children’s Hospice SW. He said he wished
to park for free in the Quay Car Park between the hours of 8 am and 9 am (1/2
hour approx) in order to change in the toilets as opposed to changing beside
his car on Marine Parade. (Noted)
(ii) After a lengthy deliberation IPC RESOLVED not to accede to this request
on the basis it might set a precedence for the future however honourable this
particular request might be. (Action: The Clerk)
(l) Email (dd 13.5.09) from MOD reference “MOD/IPC Beach Lease – Post 2010”: -
(i) The Clerk said the MOD had enquired when it might be appropriate to
commence negotiations with IPC to renew its beach lease post December 2009.

(ii) The Clerk said he had suggested to the MOD that it engaged IPC in
preliminary talks on or about July (2009) when the current IPC negotiations
with the CE’s, as regards the renewal of its beach lease, would be clearer.

passed it immediately to the Chairman for the attention of IPC’s PSC; for

(iii) The Clerk reported that IPC’s PSC had resolved to recommend APPROVAL of
this application but had expressed some concerns as regards privacy issues on

(iv) The Clerk reported receipt of a telephone call (11.5.09) from a
parishioner who lived in the immediate vicinity expressing some concern as
regards his privacy and the possible removal of trees along the Tarka Trail to
improve the view from Loventor. The Clerk said he had advised the parishioner
to write to NDC Planning to articulate his concerns about loss of privacy and
to speak to the NDCCS as regards the trees issue. (Noted)
