MINUTES OF THE DECEMBER 2004 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 16th DECEMBER 2004 - 7.30

2412/1 PRAYER

2412/2 APOLOGIES

2412/3 POLICE REPORT
(a) Crime: - (i) Constable Parker reported that between the period
9.11.04 to 15.12.04 three offences of theft had occurred within the
parish (pedal cycle, boat trailer and purse) and one offence of criminal
damage to a motor vehicle. (Noted)
(ii) He then added that a burglary had recently taken place at West
Yelland and a quantity of Benson and Hedges stolen that bore a Thailand
Health Warning. He mentioned this in the event they were seen to be
used/sold in the parish. (Noted)
(b) General: - Constable Parker reported the Neighbourhood Beat Team at
Barnstaple had recently taken possession of a sponsored car and he hoped
this would enable both him and his colleagues to patrol their areas more
frequently. (Noted)
(c) Traffic Wardens/Boathouse: - The Chairman, Cllr Harper, asked
Constable Parker if he could arrange for a traffic warden to visit
Instow at about 1 pm on Saturdays and Sundays to deal with traffic
congestion/illegal parking in and around the vicinity of The Boathouse
on Marine Parade. IPC RESOLVED to support this request. (Action:
Constable Parker)

2412/4 PARISHIONERS
(a) Marine Conservation Society - Instow Beachwatch 2004: - The Chairman
read a written report from Val Robson (Organiser). It stated that in
common with the national trend, the most prevalent material collected
from Instow beach was plastic (68%) and that where sources of beach
litter could be attributed, fishing activity and beach users dominated
locally (26% each). The report finalised by saying that the issues
surrounding litter on the beach and the necessary local action would be
discussed at the forthcoming Instow in Bloom AGM that was to be held on
the 14th January 2005 and to which all would be welcome to attend and
contribute. (Noted)
(b) B3233 - Request for New Footpath: - A parishioner spoke to a letter
he had written to Instow Parish Council seeking its support for a new
footpath on the seawards side of the B3233 between Estuary View and the
road to the Power Station. The Chairman advised the parishioner it would
be discussed later in the meeting. (see items 2412/5 & 2412/9 (i) (h))

(c ) TTEF Update: - Mrs Rose Day, Chairman of The Taw and Torridge
Estuary Forum. provided an update on recent TTEF matters particularly
issues of relevance to Fast Leisure Craft. (see item 2412/9 (ii)) (Noted)

2412/5 REPORT COUNTY COUNCILLOR R CANN
Cllr Cann spoke of a petition DCC had received requesting the
construction of a footpath from the entrance of the Power Station to
Estuary View (see item 2412/4 (b) above) - he said he had asked DCC
Highways to prepare a plan for inclusion in a future programme because
there were no funds in existing budgets for such a project. He then went
on to talk about Traveller Sites (he welcomed the withdrawal of these
proposals in the face of significant public objection and failure to
observe correct procedures in submitting the application - see item
2412/9 (i) (f)) and Planning Issues (Mollands Garage, Charter Toilets
and Instow new School site) (Noted)

2412/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
Cllr Mrs L Brown said she was deeply concerned as to the time it was
taking for planning permission to be considered for the proposed new
charter toilets on the Quay Car Park site and that she would do all she
could to resist alternative development on the site thereon. (Noted)

2412/7 MINUTES
It was RESOLVED that the November Minutes of Instow Parish Council be
approved and signed. (Noted)

2412/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2411/8 (a) - Instow Beach/Crown Estates Lease - Lifeguards -
(i) The Clerk explained that IPC’s Finance Sub Committee (in particular
Cllr Johns) had been positively progressing the re-assignment of the
lease and that it was hoped to report in favourable terms by the next
meeting. (Noted)
(ii) After discussion it was RESOLVED that IPC would need to consider,
in any event, the appropriate action(s) necessary for the 2004/5 season
so as to comply with insurance requirements in the event the lease was
not re-assigned by then. The Clerk was asked to ensure the issue came up
for further discussion at the January meeting; in the meantime he and
Cllr Crombie were tasked with preparing an action plan for consideration
by Council. (Action: The Clerk)
(b) Item 2411/9 (b) - Devon Local Transport Plan 2006 - 2011: - The
Clerk referred to an email from Cllr Green (dd 17.11.04) setting out his
recommended response from IPC, adding that as the closing date for
responses to DCC was 3rd December he had already forwarded Cllr Green’s
views as that of IPC subject to ratification at the meeting of the 16th
December. He reminded Cllrs he had copied the relevant email to them
with their agenda papers (9.12.04) for perusal. After discussion IPC
RESOLVED to support the action taken. (Noted)

2412/9 CORRESPONDENCE
i) Matters for discussion/resolution or noting
a) DAPC Overview of Recent Legislation Seminar - Exeter, 10th November
2004: - The Clerk reported he had attended an excellent DAPC seminar
that covered talks on Planning Legislation, The Disability
Discrimination Act, Data Protection/Freedom of Information Acts and
Employment Law. (Noted)
b) Letter (dd 12.11.04) from NDDC concerning “House to House Act 1939
-National Missing Persons Helpline: Mr M G Waters, Littlebrook Cottage,
Frog Street, Bampton, Devon”: - The Clerk reported receipt of this on
15.11.04 (whilst on holiday) and that when he had checked with NDDC by
email (3.12.04) he ascertained that the licence had already been
granted. He said a similar licence had been granted last year (and no
complaints had been received) and there was a condition attached that
any collector must not visit any area more than once in 6 months. (Noted)
(ii) Letter (dd 3.12.04) from NDDC reference “House to House Act 1939:
National Deaf Children’s Society, Action for Blind People, RSPCA and
GORTA- Mr C G Wichard, Fundraising Initiatives, 15B Kangley Bridge Road,
London SE26 5BA”: - The Clerk told IPC this was a request for a licence
to collect throughout the whole of the NDDC area and not just Instow.
After discussion it was RESOLVED to recommend the granting of said
licence but to make the point to NDDC that IPC was not generally in
favour of this form of door to door collection particularly as the
parish had a large number of elderly residents who could feel harassed
and threatened as a consequence. (Action: The Clerk)
c) Letter (dd 12.11.04) from The Standards Board for England concerning
“Lobby Groups, Dual-Hatted Members and the Code of Conduct: Guidance for
Members”: The Clerk reminded Cllrs he had copied this letter to them
with their agenda papers (9.11.04) including a Guidance Book. (Noted)
(ii) Letter (dd 25.11.04) from The Standards Board for England
concerning “Local Investigations: Guidance for Monitoring Officers and
Standards Committees”: - The Clerk reminded Cllrs he had copied this
letter to them with their agenda papers (9.11.04) and that he had
retained the guidance booklet on file (see also item 2411/9 (i) (e)).

d) Letter (dd 15.11.04) from The Planning Inspectorate reference
“Countryside and Rights of Way Act 2000 - Section 6 (2) - Appeal by The
Trustees of the Tapeley 1991 Life Interest Trust; Site at Land at Instow
Sandhills, Instow, near Bideford, Devon”: - The Clerk said this letter
stated that the appeal by DCE had been dismissed; he said the Planning
Inspector found that the provisional map, issued by The Countryside
Agency and showing the relevant site as “Registered Common Land”, was
accurate according to relevant records and approved the provisional map
without modification. (Noted)
e) Letter (dd 17.11.04) from Victims Support - North Devon Branch
concerning “Use of Room/s within the Parish”: - The Clerk suggested that
IPC’s Parish Hall Cllrs (Cllrs Harper/Green) take this request to the
next meeting of the Parish Hall Committee for discussion/decision. IPC
RESOLVED to support this course of action. (Action: Cllr Harper)
f) Email (dd 19.11.04) and subsequent correspondence from DCC (Peter
Doyle) of relevance to “Gypsy and Traveller Transit Site Proposals”: -
(i) The Clerk said this email stated that DCC was submitting planning
applications for 4 gypsy and traveller transit sites, all on land
currently owned by DCC. He added that one site was at the Lydacott
Picnic Area just off the A39 (Link Road - Barum to Bideford) near
Fremington. He said copies of the necessary paperwork had immediately
been sent by email (20.11.04) to the Chairman and Vice Chairman for
their information. The Clerk reminded Cllrs that a copy of a subsequent
letter (dd 22.11.04) from DCC’s Chief Executive (Philip Jenkinson) and a
Fact Sheet had been forwarded to all Cllrs with their agenda papers
(9.12.04) for perusal prior to the meeting. (Noted)
(ii) The Clerk reported that according to press reports (14.12.04) DCC
had withdrawn all planning applications and that no further action was
now required of IPC - see also item 2412/5. (Noted)
g) Letter (dd 22.11.04) and attachments from DCC (County Environment
Director) concerning “Towards a Rights of Way Improvement Plan -
Consultation”: - The Clerk said this invited IPC to give its views on
the enclosed draft “Rights of Way Improvement Plan” for Devon -
consultation period ends on Monday 14th February 2005 and replies could
be sent via proforma (enclosed), email at prow@devon.gov.uk

Exeter. It was RESOLVED the Chairman (who had received the plan prior to
the meeting - with agenda papers 9.12.04) would report back to IPC at
the next meeting with any recommendations. (Action: The Chairman)
h) Letter (dd 26.11.04) from parishioner (M J Harper) concerning
“Petition for a Pavement on the Seaward side of the B3233 between the
Power Station Road and Estuary View”: - The Clerk said this
letter/petition sought the support of IPC to lobby DCC Highways with a
view to achieving a footpath at this location and for road safety
reasons - see also item 2412/4 (b). After discussion IPC RESOLVED to
support this and the Clerk was asked to make IPC’s views known to DCC
Highways asap. (Action: The Clerk)

i) Email (dd 24.11.04) from Peter Yeo (Chairman of IIB) concerning (i)
“IIB Brochure” and (ii) “IIB AGM 2005”: - (i) The Clerk said the final
proof of the brochure had been seen by a number of Cllrs (and the Clerk
- 13.12.04) and that a photocopy was available to Cllrs at the meeting
for their perusal. He finalised by saying that any constructive comments
should be directed to Peter Yeo (Chairman IIB) asap. (Action: IPC Cllrs)
(ii) The Clerk said that IPC was to note that IIB’s AGM was to be held
on the 14th January 2005 in the Parish Hall - evening/time still to be
decided He said there were to be approx 6 presentations on proposed or
embryonic village projects (parish trees, sand/beach processes, litter,
parish hall ceramic project, village show) and perhaps other village
issues warranting solutions. There would also be refreshments and an
opportunity for attendees to discuss, brainstorm, refine, volunteers etc
for any of the agreed projects - in other words a community workshop.
The Clerk said IIB wished to know if IPC had any issues/projects that
might benefit exposure at the AGM. After discussion it was RESOLVED to
take no further action on the grounds that IIB seemed to have covered a
great deal of significant ground with its agenda. (Noted)
j) (i) Email (dd 26.11.04) and attachment from Jon Turner (NDDC) of
relevance to “Beach Owners Meeting - 25th November 2004”: - The Clerk
said the attachment set out the action points agreed at meeting one of
which referred to the investigation of possible road gullies being
inappropriately connected to the sewerage system at Instow seafront.

(ii) Emails (dd 26.11.04) from Andy Bell (NDCCS) reference same meeting:
- The Clerk said this email added that a Leader + transitional project,
relating to surfing and beach use, was being developed as well as the
marketing of North Devon collectively with Finistere and Donegal and
environmental information and guarantee (biodiversity and water
quality). It also referred to a project team meeting at The Fortescue
Hotel on the 6th December between 11 am and 3 pm. (Noted)
(iii) Copy email (dd 22.11.04) from Andy Bell (NDCCS) to DCE reference
“Beach Levels at Instow”: -The Clerk said this email talked of the use
of temporary warning signs and possible handrails to steps and that he
had responded to the effect that IPC would undoubtedly support this
excellent initiative. After discussion it was RESOLVED to notify DCC
(i.e. NDCCS and Local Services) of the dangerous steps to the beach
(opposite The Crow’s Nest) and to enquire why the chestnut fencing in
the dunes had not been replaced. (Action: The Clerk)
(iv) Lifeguard Meeting - NDDC: - The Clerk confirmed he had still not
heard about this proposed meeting - it was RESOLVED he should enquire of
NDDC as a matter of some urgency. (Action: The Clerk)
k) Letter (dd December 2004 - received 4.12.04) and attachments from
NDDC (Don Pratt - Deputy Electoral Registration Officer) concerning
“Register of Electors 2004/5": - The Clerk confirmed this new electoral
roll would be held by him (old one destroyed) and that the appropriate
notices had been placed on the parish notice boards and at the post
office. (Noted)
l) Email (dd 4.12.04) from Chairman to Clerk reference “Doggie Bin at
the top of the footpath adjacent to Atturm”: - The Chairman said it was
timely, in his view to re-apply to NDDC for a doggy bin at this location
particularly as the parish had “lost” one from the dunes car park. It
was RESOLVED the Clerk should make such a request of NDDC Environmental
Health Department - Cllr Cann said he would support this request.

m) Email (dd 4.12.04) from Chairman to Clerk reference “New Fold Down
Seats - Flood Defence Wall opposite Shops”: - Cllr White said he was
still negotiating with a supplier of such seats and he would report back
to IPC asap. (Action: Cllr White)
n) Letter (dd 10.12.04) from Winkleigh Working Party concerning
“Planning Application for Biomass Power Station - Winkleigh”: - The
Clerk said this letter sought the support of IPC to object to this
application and if so, to write to TDC. He said he had forwarded the
original correspondence to the Chairman to peruse before the meeting.
After discussion it was RESOLVED to take no further action. (Noted)
o) Village Show 2005: - The Chairman said Mrs P Cantle (Chairman Parish
Hall Committee) would like a letter from IPC “pledging” its support for
this show. After discussion it was RESOLVED to enquire of Mrs Cantle as
to what form of “support” she was seeking and that if this involved the
provision of a grant she should write to IPC setting out the aims of the
show and how any grant monies would be used. The Clerk was asked to
contact Mrs Cantle asap. (Action: The Clerk)

a) Email (dd 12.11.04) from Chairman TTEF reference “TTEF - Update 11th

spoke to parishioner (6/7.12.04) - all now in order.

4. RESOLUTION REQUIRED: -
IPC RESOLVED to transfer £2230.00 from Lloyds Bank Business account
number 02350065 to Lloyds Bank Treasurers account number 02348842 to
cover cheques as at 2 above. (Action: The Clerk)

5. MISCELLANEOUS: -
(a) Beach Grant 2004: - The Clerk reported progress since last meeting
i.e. still nothing heard from NDDC. Cllr Cann said he still had every
reason to believe this grant would be received during the current
financial year. (Noted)
(b) Parish Seat - Insurance Claim: - (i) The Clerk updated IPC as to
progress i.e. he referred to a letter from Allianz Cornhill (dd
11.11.04) that stated that this claim had been settled at a total cost
of £500.00. (Noted)
(ii) The Clerk appraised Council of a further letter from AC (dd
19.11.04) noting that IPC’s benches were being checked to ensure they
are fully secured in place and that all property would now be subject to
a weekly inspection routine with all the inspections, maintenance and
remedial work being logged and recorded. He said the handyman was
currently doing this. (Noted)
(iii) The Clerk reminded IPC that a Works Committee, consisting of Cllrs
Harper, Crombie and him, still had to meet up and inspect all seats and
draw up a policy appertaining to seat acquisition, type of seat and
maintenance and that it was hoped to achieve this prior to the next
meeting. (Action: Works Committee)
(c) Instow Recreation Ground Trust Account - Portman Building Society: -
The Clerk reported that two signatories were required to sign a form in
order for the account to have its name changed. Cllrs Green and White
signed the necessary form - Clerk to liaise with Portman Building
Society. (Action: The Clerk)
(d) DCC P3 Footpath Inspection 2004/P3 Claim for 2005: - (i) The Clerk
reported that the P3 2005 Finance form was still awaited and that once
it had been received he would complete the annual report on parish
footpaths. (Noted)
. (ii) The Clerk said he had attended the P3 Xmas Workshop at Hemyock on
9.12.04 with the parish handyman - he provided a brief report. (Noted)
(e) Letter (dd 12.11.04) from NDDC reference “Parish Council Expenditure
2005/6”: - The Clerk confirmed he could now forward the appropriate
return to NDDC in respect of Instow’s “Parish Grant and Precepted
Expenditure 2005/2006” However, he wished to enquire if IPC wished to
raise its budget 2004/5 grant application (£2 per head of population)
now that the current electoral roll indicated that Instow had 714
parishioners; this would involve, he said, a total request for £1428 (as
opposed to £1418) made up of Burial Ground (£800), Parish Hall (£400 -
maximum payment) and “Parks and Open Spaces” (£228) - Total £1428. After
discussion IPC RESOLVED to support this recommendation. (Action: The Clerk)
(f) Email (dd 1.12.04) from Charity Commissioners concerning “Charity
Commissioner News”: - The Clerk said this could be found on website
www.charitycommissione.gov.uk/tcc/newslist.asp

trustees (cheque signatories) of Instow Recreation Ground a/c (current
name) should note. (Noted)
(g) Letter (dd November 2004) concerning “Parish of Instow - Ground
Maintenance Tenders etc”: - The Clerk said this referred to a company
called “Any Job Squad” and asked to be considered for suitable work in
Instow. (Noted)
(h) NALC Memoranda concerning “Implementation of the National Agreement
on Salaries and Conditions of Service of Local Council Clerks in England
and Wales”: - The Clerk reported receipt of this correspondence and said
he would retain it for the information of IPC’s FSC. (Noted)
(i) Tractor Scrape Maintenance: - The Clerk said that Peter Cook had
arranged for the tractor scrape to be “serviced” by Atturm during the
first week in January 2005 and that this would require 4 hours labour to
complete the process (i.e. 4 hours at £4.85 per hour = £19.40). The

(j) Xmas Carol Singing Event - Sunday 12th December 2004: - The Clerk
recommended that a £30 cheque be sent to The Two Rivers Ensemble who led
the Carol Singing event so well. IPC RESOLVED to support this. (Noted)
(k) Parish Tree Group: - The Chairman said he had been approached by
this group, led by Mrs P Cantle, to be provided with a grant of £50
towards its costs i.e. postage, photocopying etc. The Clerk advised
Council that he recommended Mrs Cantle be asked to submit a letter
(along the same lines as item 2412/9 (i) (o)) to IPC and that once
received her request be formally considered. IPC RESOLVED to adopt this
course of action. (Action: The Clerk)

2412/11 PLANNING
a) Application under Regulation 3 of the T and C P General regulations
1992 in respect of demolition of existing toilet block and erection of
new Charter Toilets at NDDC’s Public Conveniences, Lane End, Instow
(Reference No. 38281): - The Clerk reminded IPC of the requirement to
consider a suitable “community project” if the monies (£70,000 plus -
source Cllr Cann) from the sale of the ransom strip at this location
from NDDC was to eventually materialise and suggested that a Sub Group
be set up to lead on ideas. After discussion it was RESOLVED that group
would consist of Cllrs Ms A Mayoh/Scott/White.(Action: Cllrs Ms A
Mayoh/Scott/White)
b) Application under Regulations 3 of the T and CP General Regulations
1992 for demolition of existing toilet block and construction of new
Charter Toilets at Marine Car Park, Instow (Reference No. 38516): - (i)
The Clerk reported upon NDDC’s Planning Committee’s deliberations at its
meeting of Wednesday 17th November 2004 (2 pm at the Council Chamber of
the Civic Centre, Barnstaple) - deferred until Wednesday 15th December
2004 at 2 pm. He went on to say that the papers for this subsequent
meeting had been received (8.12.04) and that Cllrs Harper, Scott and
Cook attended and represented IPC. Cllrs Harper, Scott and Cook then
fully appraised IPC of the outcome of that meeting, that is, it was
deferred yet again to another date to be fixed so as to explore
“alleged” planning permission for flats to be built on this site with
the obvious financial benefits to NDDC. Cllr Cook expressed his great
dismay at the time this process was taking particularly as the parish
council was fully supportive to the building of the new charter toilets
and that the money was available to pay for it. After debate it was
unanimously agree to write a strong letter of protest to NDDC’s Chief
Executive at the time this project was taking to materialise and of the
real concerns of IPC at the possible loss of this valuable resource (car
park) if flats should be built thereon. (Action: The Clerk)

(ii) The Clerk reported receipt of a letter (dd 10.11.04) from “The 1991
Devon Discretionary Trust” concerning “Marine Court Car Park - Proposed
Revised Public Facilities” - he said he had already provided a copy to
the Chairman. The Clerk read it to Council. (Noted)
c) (i) Notice (received 20.10.04) from Michael J Smith and Associates
(Chartered Architect on behalf of Mr O Cook) under Article 6 of
Application for Planning Permission (Town and Country Planning (General
Development Procedure) Order 1995 - Proposed Residential Development
comprising of 7 Dwellings at Mollands Garage together with improved
access and visibility to Quay Lane (ii) Conservation Area Application
for demolition of non-listed Buildings in connection with the Erection
of 7 Dwellings together with construction of improved access at Mollands
Garage, Quay Lane, Instow (Reference No. 38830) and (iii) Outline
application for Erection of 7 Dwellings together with construction of
improved access at Mollands Garage, Quay Lane, Instow (Reference No
38787): - (a) The Chairman appraised IPC of the action taken since the
last meeting which included a site meeting After debate it was RESOLVED
to respond to the Article 6 Notice (as at (c) (i) above) to the effect
IPC did not recommend approval of the application on the grounds there
would be a loss of units to the parish, no provision for affordable
housing, it would result in an over-intensification of buildings and
there was concern about the lack of visibility at the entrance. (Action:
The Clerk)
(b) IPC RESOLVED to declare an interest as regards the two planning
applications 38830 and 38787 (see (c) (ii) and (ii) above) on the
grounds it had a pecuniary interest. (Action: The Clerk)

d) Extension to dwelling together with conversion of loft space to form
additional living accommodation and formation of terrace at Sandpipers,
Anstey Way, Instow (Reference No. 38792): (i) The Clerk reported receipt
of two copy letters of objection (originals to NDDC’s Planning
Department) from parishioners subsequent to the meeting of the 11th
November. (Noted)
(ii) The Clerk also reported receipt of a letter from NDDC stating that
NDDC had REFUSED planning permission for this application for reasons as
listed; copy of letter handed to Cllrs for their information. (Noted)
e) Letter (dd 1.11.04) from Dave Smart, Customer Care Officer of NDDC’s
Planning Department reference “Planning Unit - Request for Visit”: - The
Clerk advised IPC of the content of an email (dd 12.11.04) from Mr Smart
who was now unable to attend evening meetings. (Noted)
f) Erection of a dwelling in garden of Myrtle Cottage, Kiln Close Lane,
Instow (Reference No. 38941): - The Clerk reported receipt (13.11.04) of
this application and of having passed it immediately to the Chairman for
the attention of IPC’s PSC - reply date 1st December. (ii) The Clerk
said that as no response had been received from IPC’s PSC (2.12.04) he
had applied for and received an extension to this application so that
full Council might consider it on the 16th December - for reply to
NDDC’s Planning Dept by 17th December. After a discussion, led by the
Planning Officers, IPC RESOLVED to recommend approval. (Action: The Clerk)
g) Duplicate copy letters (dd 18.11.04 - received 20th and 27th November
2004) from NDDC’s Planning Department to parishioner (Mr M Green)
concerning (i) “Tree Preservation Order 202 - All Saints Chapel and
Area, Instow” and (ii) “The Town and Country Planning Act 1990 -
Application for consent to carry out arboricultural works to trees in an
area subject to a Tree Preservation Order made by the Local Planning
Authority”: - The Clerk appraised IPC of the content of the letters
which were for information only. (Noted)

h) Letter (undated - received 22.11.04) from DCC (A C Bowman - for
County Environment Director) concerning “County Matters Planning
Application - North Devon District/Proposed transfer station and
recycling centre at Holmacott Landfill Site, Holmacott, Barnstaple”: -
The Clerk said that this stated that conditional planning permission had
been issued on the 17th November. The Clerk reminded IPC it had
previously recommended approval of this application - see item 2402/11

i) NALC Policy Update No. P18/04 concerning “ODPM Consultation - Draft
Revised Circular on Planning Obligations”: - The Clerk said this
referred to a published consultation document from ODPM relating to the
negotiation of planning obligations under section 106 of The Town and
Country Planning Act 1990 (as substituted by the 1991 Act). The aim of
the document was to seek views on proposals for reforming and improving
the current system of planning obligations in England in the short and
medium term. The intention was to create a system that was faster, more
transparent and accountable and which gave greater clarity and certainty
to all concerned. The proposals set out in the revised draft circular
also sought to bring the use of planning obligations into line with the
new arrangements established by the Planning and Compulsory Purchase Act
2004 and to set the provision of affordable housing through section 106
on a more consistent basis. The Clerk said full details of the
consultation could be found on website www.odpm.gov.uk/planning
<http://www.odpm.gov.uk/planning> and that any response to NALC was
required by 18th January 2005 (ODPM closing date 25th January 2005). He
said he had circulated copies of the circular to Cllrs with their agenda

Instow (Reference No. 38931): - The Clerk reported receipt (30.11.04)
and of having passed it immediately to the Chairman for the attention of

Planning Officers, IPC RESOLVED to recommend approval of the

said it would be used whenever a planning application was received for

2412/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
(a) Anstey Way Lay By: - Cllr White said it would be useful to users of
disabled vehicles and prams, for example, if part of the pavement on the
seaward side of the Anstey Way lay by be dropped to allow them to get on
to the pavement in safety. After discussion IPC RESOLVED to support this
request and the Clerk was asked to liaise with DCC. (Action: The Clerk)
(b) Venn Cross Bus Shelter (Instow Town Side): - Cllr Cook said this bus
shelter needed cleaning because of recent unsavoury use by an
inconsiderate person. The Clerk said he would contact the parish handy
person. (Action: The Clerk)
