Item 2102/6 (a) – Instow/Residents Parking Survey - Cllr Johns declared a pecuniary interest, left the room and did not speak. (Noted)

2102/4 POLICE REPORT
a) In the absence of the Police there was no report. (Noted)
a) Crime: -
Constable Hodgson said that no crimes had been reported in the parish since the last meeting. (Noted)
(b) Clerk’s Note: -
In a subsequent report received (19.2.11) from PCSO Meaker it was noted that three crimes (x1 theft non specific, x1 theft by employee and x1 theft of conveyance other than motor vehicle) had been reported in the parish since the last meeting and that 9 other matters had been the subject of an incident log namely, admin (x1), crime related/theft (x3), anti-social behaviour (x 1), public safety/device (firework) found on beach (x1), public safety (x1), domestic (x1) and insecure property (x1). (Noted)
2102/5 PARISHIONERS
(a) Miscellaneous Matters: -
A parishioner spoke on the following matters: -
(i) Footpath (Oil Pipeline Site) – Tarka Trail: -
(i) The parishioner said it would be desirable to have this link, between the Tarka Trail and the Coastal footpath, adopted as an official footpath. (Noted)
(ii) Footnote: - Since the meeting Cllr Cann (DCC) has agreed to look into this and act as necessary. (Action: Cllr Cann)
(ii) DuneZed: -
The parishioner outlined a number of ways by which this initiative (on the old power station site) would, in his opinion, have a detrimental effect on the parish and he urged IPC to retain an interest albeit it had yet reached a planning application stage. (Noted)
(iii) Street Lighting: -
(a) The parishioner said he would be interested to know, in due course, what progress had been made in cost and energy saving by the reduction of lighting hours. (Noted)
(b) Cllr Cann said this was an on-going process and was in hand. (Noted)
(iv) Children’s Play Area/Tarka Trail: -
The parishioner enquired what progress had been made on this scheme; he highlighted a number of issues that were of concern to him. He was advised that this matter was to be discussed later in the meeting. (Noted)
(b) Children’s Play Area/Tarka Trail: -
A parishioner said she was not in favour of this initiative. (Noted)





2102/6 REPORT OF COUNTY COUNCILLOR R CANN
(a) Instow – Residents Parking Survey: -
(i) Cllr Cann said he had received a number of responses from parishioners and that they were more or less split down the middle with about half in favour and half against. Cllr Cann suggested that IPC form a Traffic Management Sub Committee with the sole intention of meeting with him and an appropriate DCC Officer so as to take the matter forward. (Noted) (ii) After a discussion IPC RESOLVED that the Chairman, Vice Chairman and Cllrs Thomas and Harper together with the Clerk would form that committee; Cllr Cann agreed to liaise with the Clerk as regards suitable meeting dates. (Action: Cllr Cann) *** Cllr Johns declared a pecuniary interest on this matter, did not speak and left the room ***
(b) Grass Cutting: -
(i) Cllr Cann said that DCC had, that day, taken the decision, for cost cutting/budgetary reasons, to reduce verge grass cutting to only twice per annum (instead of 6) and although he had spoken against this policy it had, regrettably, been adopted. (Noted)
(ii) The Clerk said he had yet to receive an official notification from DCC Highways but that he suspected this decision was bound to have a detrimental impact on its annual grass cutting grant that presumably would be cut by 2/3rds. The Clerk reminded IPC that this would equate to a grant of somewhere just short of £1,000 and that it currently had a “agreement” with a local contractor that related to a financial outlay of something in excess of £2,000. IPC RESOLVED to discuss this at its next meeting when more detailed information might be available. (Action: The Clerk)
(c) Sand on Highway near Boathouse: -
Cllr Cann said he was pleased that DCC Highways had moved the vast amount of sand that had accumulated at this location following a period of strong winds but that he was most disappointed at the lack of support and involvement from NDC. Cllr Cann was thanked by the Chairman for facilitating its removal. (Noted)
c) General: -
Cllr Cann spoke of “Reduction of Bus Subsidies” (equating to a saving of many thousands of pounds), “Highways – Budgetary Savings” (relevant initiatives were outlines) and “NDC – Planning Enforcement” (612 cases currently being investigated).
(d) Potholes – Insurance Claims: -
In reply to a question from Cllr Thomas, Cllr Cann said that this was “substantial”. (Noted)
(e) DCC Budget 2011/12: -
In answer to a question from Cllr May, Cllr Cann said that £55M had been cut and that this would involve staff lay-offs at all levels. (Noted)

2102/7 REPORT OF DISTRICT COUNCILLOR B MOORES
(a) Meeting NDC and IPC – 17th March 2011 (Management of Quay Car Park etc): -
Cllr Moores said this meeting had, in his view, been most productive and had reached a good outcome; he said full details would be given later in the meeting. (Noted)
(b) Instow Methodist Chapel: -
Cllr Moores said he had been advised by NDC Planning that it was investigating an unauthorised change of use. (Noted)
(c) Sand on Highway – Boathouse: -
Cllr Moores said he was most unhappy as to the lack of immediate and positive action by the local authorities following a period of strong winds and which had resulted a in large quantity of sand being blown onto the pavement and road at this location. He said he was determined to come up with a policy that ensured quick and prompt action in the future. (Action: Cllr Moores)
(d) Council/Business Tax – Use of: -
In answer to a question from Cllr May, (IPC Meeting – 13th January 2011), Cllr Moores said NDC’s Income on Council/Business Tax was 78M made up of Council Tax 45M, Business Rates 26M and Council Tax Benefits £2M. He added that Expenditure consisted of DCC £38M, NDC £7M, D and C Police £5M and D and S Fire and Rescue £2M. He added that NDC’s reserves were approximately £1.2M. Cllr May thanked him for the information. (Noted)
(e) NDC Budget: -
(i) Cllr Moores said that NDC had found £2M in savings to meet the budget shortfall created by government spending cuts and the economic downturn. He said Cllrs had agreed a budget which included over £1M in savings identified by the council’s senior managers; he said it had been achieved mainly through more efficient working practices, not replacing staff that leave and general day to day spending reductions. Cllr Moores added that it also included cut in grants to a number of external organisations all of which had been consulted on the likely impacts of the decision – he gave examples. Following further details, Cllr Moores said that the budget, so far agreed to by the Executive, would now be put forward for approval at a meeting of full council on the 22nd February. (Noted)
(ii) Cllr May asked why only cuts in staff were being done at the coal face and not in administration/offices for example. Cllr Moores said there were to be no compulsory redundancies, just natural wastage. (Noted)
(f) NDC’s Car Lease Scheme:-
Cllr Thomas said a parishioner had approached him with a view to establishing what savings NDC had made by scrapping this scheme; after a discussion it was agreed that Cllr Thomas should advise the parishioner to write to Cllr Moores direct; he would then furnish a full answer. (Action: Cllr Thomas/Cllr Moores)
(g) Revised Bathing Water Directives: -
Cllr Moores said he had attended a recent meeting on this subject at the Civic Centre and to which Cllr Green had also been in attendance. He said he felt the meeting had been most productive. (Noted)

2102/8 MINUTES
It was RESOLVED that the January 2011 minutes of Instow Parish Council be approved and signed. (Noted)

2102/9 MATTERS ARISING FROM THE MINUTES
a) Item 2101/6 (a) – Instow: Residents Parking Survey: -

c) Item 2101/9 (a) – Management of Quay Car Park: -
(i) The Chairman and Clerk reported on a meeting that had been held at The Commodore Hotel, Instow at 3pm that day, Thursday 17th February 2011; the Chairman and Clerk represented IPC together with Mrs Rose Day (former Chair of IPC) and NDC was represented by Cllr Des Brailey (Leader of NDC) and Cllr Moores (NDC Instow). (Noted)
(ii) It was said that the meeting had been most productive despite the fact it had been established, once and for all, that the Ransom Strip monies (said to be in the region of £72,000) no longer existed having been used in the build of the new Charter Toilets at Lane End/Marine Parade (circa 2002), It was agreed there had been a massive breakdown in communications in this regard that had resulted ever since, in countless hours spent by IPC and certain NDC Cllrs/Officer on exploring ransom strip projects and community consultation. (Noted)
(iii) The Clerk reported, however, that an offer had been made by NDC, subject to agreement by IPC and NDC’s Executive, to pay IPC £72,000 up front to IPC and to transfer the freehold of the Quay Car Park to IPC who could then explore the refurbishment of the Quay Car Park toilets itself and resurface the car park surface as and when necessary. The Clerk said there was obviously quite a bit of detail to discuss, if and when said offer was finalised, such as contracts to clean the toilets and “police” the car park but that this should not affect the principle of the offer and whether it was a good one for IPC or not. (Noted)
(iii) A full discussion then ensued at the conclusion of which IPC unanimously RESOLVED to accept the offer in principle but to seek answers to the following questions: -
(a) Christie Estates has a covenant on the Quay car Park – is this likely to harm the transfer of the freehold to IPC?
(b) Who owns the boundary walls to the car park? It was believed that NDC owned the boundary abutting onto the main road as IPC pays it an annual licence fee for its bus shelter that is situated there
(c) Have the petrol tanks below the surface of the car park been made safe? (Noted)
(iv) IPC further RESOLVED to allow the Clerk to continue negotiations on its behalf and in the meantime to convey its agreement in principle to the offer “on the table”.
(Action: The Clerk) d) Item 22101/9 (c) - Village Gateway Initiative: -
(i) The Clerk reported he was still endeavouring to get this project completed prior to the end of the current financial year so that the outstanding grant payment (£788) could be obtained from DCC. He said Cllr Cann (DCC) had, yet again, prompted DCC Highways reference the additional road markings required. (Noted)
(ii) The Clerk then produce a number of potential transfers prepared by SW Signs with a view to replacing the existing ones that are currently exhibited on the Instow signs on Anstey Way at each end of the village. (Noted)
(iii) After a discussion IPC RESOLVED to select the one that depicted the Instow Coat of Arms and he was authorised to order 12 for appropriate use.
(Action: The Clerk)
e) Item 2012/9 (e) – Ransom Strip Projects Children’s Play Area – Tarka Trail etc : -
(i) The Clerk reported receipt of an email (dd 1.2.11) from a parishioner supporting the children’s play area project; the Clerk read it to Council. (Noted)
(ii) The Clerk reported receipt of an email (dd 5.2.11) from a parishioner objecting to the provision of a children’s play area; the Clerk read it to Council. (Noted)
(iii) The Clerk reported receipt of a letter (dd 3.2.11) from a parishioner objecting to the provision of a children’s play area; the Clerk read it to Council. (Noted)
(iv) After a discussion IPC RESOLVED to shelve this project pro tem (a project that had been identified as an objective in the current parish plan) on the grounds the necessary funds were no longer available (due to the demise of the ransom strip monies); Clerk to advise the appropriate bodies. (Action: The Clerk)
f) Item 2101/9 (e) – Revised Bathing Water Directives: -
(i) The Clerk reported receipt of an email (dd 15.2.11) from EA reference “Bathing Water Directive – EA Website/Publishing of Instow Date”; he said it confirmed that the EA would not publish details of relevance to Instow’s profile without IPC seeing it first. (Noted)
(ii) The Clerk reported receipt of an email (dd 14.1.11) from NDC reference “Proposed Bathing Water Directive – Meeting”; this invited IPC to attend a meeting at the Civic Centre on the 2nd February. (Noted)
(iii) The Clerk advised IPC that Cllr Green was available to attend this meeting and NDC was advised accordingly. (Noted)
(iv) The Clerk reported receipt of a copy email (dd 3.2.11) from Cllr Green to NDC thanking it for inviting IPC to the meeting that had clarified a number of issues.(Noted)
(v) The Clerk reported receipt of an email (dd 11.2.11) from NDC reference the meeting of 2nd February and which enclosed minutes of the meeting and associated papers; he said he had copied it on to Cllr Green. (Noted)
(v) Cllr Green then addressed Council; he said it seemed that Defra were now making the process much easier to de-designate having adopted a much more positive attitude to said process. It was said that no feedback had been received from parishioners following the recent entry on the parish magazine. (Noted)
(vi) After a discussion it was RESOLVED to write to Defra seeking guidance on the process for de-designation but to have it vetted first by NDC and Jonathon Ponting (EA). Cllr Green agreed to draft said letter and forward it to the Clerk.
(Action: Cllr Green)
(vi) IPC also RESOLVED to consider what action(s) were necessary locally, such as a public meeting and bathing survey during the summer period. It was agreed that this would take place at the next meeting once the letter had been agreed and sent off to Defra. (Noted)


g) Item 2101/9 (f) – Refurbishment of Toilets/Quay Car Park: -
See item 2102/9 (c) . (Noted)
h) Item 2101/9 (h) - Democracy Pack/Local Elections 2011: -
(i) Cllr Green recommended that the posters provided with this pack were used throughout the parish and that an article, that he agreed to write, should be placed in a forthcoming edition of the parish magazine with the expressed intention of encouraging parishioners to put themselves forward as parish Cllr candidates and to vote. (Noted)
(ii) After a discussion IPC RESOLVED to adopt this course of action.
(Action: Cllr Green and The Clerk)
i) Item 2101/10 (i) (c) – EA Community Flood Planning: -
(i) The Clerk confirmed that an entry did appear in the February 2011 Parish Magazine concerning this matter having been initiated by Cllr Harper. (Noted)
(ii) The Clerk reported receipt of a letter (undated) and folder entitled “Helping You to Help Yourselves” from DCC reference “Town and Parish Community Emergency Planning Pack”; the Clerk elaborated and suggested the folder be retained by Cllr Harper (IPC’s Emergency Planning Cllr). IPC RESOLVED to support this recommendation. (Noted)
(iii) The Clerk reported receipt of an email (dd 26.1.11) and attachments from DCC reference “Parish Flood Survey”; he said the letter outlined the relevant legislation concerning flooding that required DCC to prepare a Devon-wide assessment of surface water and local flooding in order to produce a strategy to deal with significant flood risks. The Clerk added that DCC was asking IPC to provide a baseline of historic local flooding data so that the extent and potential impact of future events could be assessed, adding that DCC required a response by 28th February 2011. (Noted)
(iv) The Clerk advised IPC that Cllr Harper had agreed to deal with this matter; Cllr Harper then addressed Council and provided Cllrs with extensive details gleaned as a result of his enquiries to date. (Noted)
(v) After a discussion IPC RESOLVED to adopt the excellent work of Cllr Harper who agreed to forward it to DCC b ythe required date. (Action: Cllr Harper) . j) Item 2101/19 (i) (d) – Salt/Grit Bins/Community Clusters: -
(i) The Clerk advised IPC that salt/grit could be purchased direct from a company called Supply Zone with the costs as follows: -
• 1-2 bags £9 each excluding VAT
• 3-19 bags £5.66 each excluding VAT
• 20-39 bags £5.31 each excluding VAT
• 40+ bags £4.75 each excluding VAT
(ii) IPC then discussed the formation of Community Clusters led, wherever possible, by a parish Cllr); after a discussion it was RESOLVED that this could be achieved by placing an entry in the parish magazine (to ascertain interest) and that once groups were established bags of salt/grit could be ordered by IPC and charged at cost to relevant group(s) and securely stored by them for subsequent usage. It was agreed that the Clerk would arrange for the necessary entry to be placed in as forthcoming parish magazine. (Action: The Clerk)
(iii) The Clerk reported receipt (31.1.11) of an email and attachments from DALC reference “Winter Maintenance Community Self Help Schemes: Safe Working Snow Wardens”; the attachments, entitled, “Winter Maintenance Community Self Help Schemes” and “Snow Warden Training: Safety Whilst Undertaking Duties” were copied to Cllrs at the meeting. It was RESOLVED to use this excellent information as and when community clusters were formed within the parish. He said NDC had enclosed a copy template it proposed to use; however, if IPC felt this wasn’t sufficient then it would issue separate parish poll cards but at the expense of IPC. (Noted)
