MINUTES OF THE APRIL 2008 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON
THURSDAY 17th APRIL 2008 AT 7.45 PM

Present: - Councillors P Cook, N Crombie, M Green, C Harper, Cllr Johns (Chairman), B Moores (Also NDDC), S White (Vice Chairman) and Mr R Jacob (Parish Clerk).

2804/1 PRAYER
The Clerk led the Council in prayer.

2804/2 APOLOGIES

2804/3 POLICE REPORT
a) General: -
Constable Hodgson said that 5 crimes had been reported in the parish since the last meeting, namely, theft (inflatable life raft), non-crime domestic, theft (mobile phone), theft from motor vehicle (bike removed from rear) and criminal damage to a motor vehicle. (Noted)
b) Other Matters: -
Constable Hodgson said that in addition there had been 12 incidents logs created in respect of x4 anti-social behaviour, x2 crime related, x1 accidental 999 call, x1 stray dog, x1 hot dog, x1 parking, x1 suspicious behaviour and x1 domestic incident. (Noted)
c) Section 27: Violent Crime Reduction Act 2006: -
PC Hodgson referred to new powers under this act that had just come into force. He said the act gave Constables (not PCSOs’) the power to direct people to leave an area if they suspected that person was under the influence of alcohol and they would commit crime as a result. (Noted)
d) Speeding – Hand Held Speed Gun: -
Constable Hodgson said both he and PCSO Cornish were booked on a speed gun course at the end of April and that it was their intention to put this training straight to use and start high visibility speed surveys and enforcement throughout Instow and Yelland. (Noted)
e) Vulnerable Vehicle Forms: -
Constable Hodgson said these were still being used in the area to prevent car crime from reaching the Instow area. (Noted)
f) Vandalism – Bus Shelters: -
Constable Hodgson referred to a number of incidents that had been reported to him by the Clerk and which he confirmed was receiving attention. (Action: PC Hodgson)

2804/4 PARISHIONERS
a) Boathouse Bus Shelter: -
A parishioner reported she had seen broken glass in this shelter recently; the Clerk said an incident had been reported to him earlier in the week and the handyman had dealt with it. He added that he would ask the handyman to check it out again in the event this was a separate incident. (Action: The Clerk)
b) Community Website – Local Eyes: -
A parishioner spoke of this website (www.localeyes.org) that he felt might be of value to the parish council and the community. After a discussion it was RESOLVED the Clerk would provide Cllrs with full details of the website so that an informed discussion could ensue at the next meeting. (Action: The Clerk)

2804/5 REPORT COUNTY COUNCILLOR R CANN
a) General Matters: -
Cllr Cann spoke of “A39 Surface Dressing” (A39 between Westleigh Junction and Roundswell for period 2.6.08 to 13.7.08 between 1900-0200 hours with possible slight variations), “Clean Sweep Estuary Litter Pick” (30 bags of rubbish collected at Fremington Quay/Penhill – grateful to members of IIB for support – further clean up planned for 27.4.08 NDCC to Old Power Station), “Community Composting” (several successful village schemes in existence – further information available on 0164732880/www.dccn.org.uk or contact NDDC/recycling credits currently £46 per tonne for material composted), “Proposed New Cycle Link/Footpath” (DCC proposes to create this from Yelland to Tarka Trail on land alongside the industrial road to the former power station site - £25,000 has been allocated subject to planning consent), “DCC – Civil Enforcement” (DCC taking on this from Police early in May; enforcement will be carried out in partnership with District Councils) and “Toucan Crossing” (funding of £24,000 has been included in this year’s budget to provide this crossing for the Tarka trail in the vicinity of the Signal Box; this will provide a safer crossing point and may also slow traffic speed along this stretch of road). (Noted)
b) New Charter Toilets – Quay Car Park: -
In answer to a question from Cllr Cook, Cllr Cann said NDDC were still hopeful of getting these toilets built during the current financial year although proceedings were being regrettably delayed by legal actions of an adjoining landowner. (Noted)
c) DCC Grants 2008/9: -
Cllr Cann told Council he had £25,000 to provide in grants for the current financial year and that he looked forward to receiving suitable bids that could be for small or large projects. (Noted)

2804/6 REPORT OF DISTRICT COUNCILLOR B MOORES
a) General: -
Cllr Moores spoke of “Local Government Review – Northern Unitary Vision” (i.e. creation of a new single tier authority {North Devon Council} centred on Barnstaple as the regional centre supported by the two gateway towns of Bideford and Tiverton), “Civil Car Park Enforcement” (see item 2804/5 (a)), “AGM of NDDC – 9th April”, “New Instow County Primary School” (NDDC’s response to planning application), “Planning Application 46220 – Marsden” (Cllr Moores had met with planning officer – decision still awaited) and “Instow Ransom Strip” (a meeting had taken place on 17.4.08 at Civic Centre and current position, funding and options discussed). (Noted)
b) Instow – NDDC Cllr Surgeries: -
Cllr Moores said it was his intention to set up a system of surgeries in the parish to enable parishioners to bring their concerns to him and as a consequence make him more familiar with those issues that were of real concern to the parish. He said he was still deliberating on the detail of such an initiative. (Noted)

2804/7 MINUTES
It was RESOLVED that the March 2008 minutes of Instow Parish Council be approved and signed. (Noted)

2804/8 MATTERS ARISING FROM THE MINUTES
a) Item 2803/3 (b) – Police Surgeries: -
PC Terry Hodgson advised Council that PCSO Cornish was still progressing this initiative and that it was hoped to hold a monthly surgery prior to the meeting of IPC commencing at 6 pm. The Clerk added that PCSO Cornish saw this as a venture to which other agencies might become involved including the attendance of a parish councillor(s) and/or the Clerk. (Noted)
b) Item 2803/10 (e) – IPC’s Self Help Emergency Plan Update: -
(i) Cllr Harper reported he has arranged for an entry to appear in a forthcoming parish magazine with a view to seeking an update of parishioner’s skills and relevant emergency resource availability. (Noted)
(ii) The Clerk referred to an email (dd 16.4.08) from the Emergency Planning Officer (Waveney and Suffolk Coastal District Councils) requesting to have sight of IPC’s plan. He said he had copied the email to Cllr Harper for attention. Cllr Harper confirmed he had forwarded the information as requested. (Noted)
c) Item 2803/9 (i) (a) – Review of Local Government/Boundary Committee: -
(i) The Clerk referred to an email (dd 17.3.08) from DCC reference “Town and Parish Listening Events – Update”; he said he had forwarded a copy by email (19.3.08) to those Cllrs with email addresses. (Noted)
(ii) The Clerk referred to a letter (dd 3.3.08) and attachments (poster etc) from The Boundary Committee for England reference “Structural Review of Devon”; he said he had forwarded a copy of the letter to Cllrs with their agenda papers (10.4.08) and had placed a copy of the poster on all parish council notice boards for the information of parishioners. (Noted)
(iii) The Clerk referred to a letter (dd 20.3.08) and attachments (previous letter of 26.2.08/presentation papers) from NDDC (Chief Executive) reference “Local Government Review”; he said he had forwarded a copy of the letter/attachments to Cllrs with their agenda papers (10.4.08). (Noted)
(iv) The Clerk referred to a letter (dd 26.3.08) from NDDC (Leader of NDDC) reference “Local Government Review”; he said he had forwarded a copy of the letter to Cllrs with their agenda papers (10.4.08). (Noted)
(v) The Clerk referred to an email (dd 9.4.08) from DCC reference “County Council Unveil Vision for Unitary Local Government”; he said he had forwarded this by email (9.4.08) to those Cllrs with email addresses. (Noted)
(vi) The Clerk referred to an email (dd 15.4.08) from DCC together with a copy of DCC’s “Initial Concept Report for Unitary Local Government”; he said he had forwarded this by email (9.4.08) to those Cllrs with email addresses. (Noted)
(vii) The Clerk referred to a letter (dd 11.4.08) from NDDC (Chief Executive) together with a report entitled “NDDC – A concept for a four Unitary Model of Local Government in Devon”; he said the letter stated that action was in hand for NDDC to meet up with groups of town and parish councils to discuss the issue. (Noted)
(viii) After a discussion IPC RESOLVED to form a sub committee to consider all the implications; Cllrs Johns, White, Green and Harper were duly appointed to said committee and it was agreed that Cllr Moores (NDDC) and Cann (DCC) would join that committee. It was noted that the consultation on the proposed concept(s) for unitary authority in Devon would take place between 7th July and 26th September; IPC RESOLVED that it should set a target of its July (17th) meeting for formulating its recommendation to the Boundary Commission. d) Item 2803/9 (i) (e) – Instow Ransom Strip: -
Cllr Moores provided an update; see item 2804/6 (a). (Noted)

2804/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Copy email (dd 17.3.08) from Cllr Harper to DCC reference “Dead Sheep – Instow Beach”: -
(i) The Clerk reported receipt of this and other associated emails (various) between DCC, Cllr Cann and Cllr Harper. (Noted)
(ii) Cllr Harper elaborated on the content and progress of his enquiries and stated that all he was endeavouring to achieve was a “one-stop” contact through which such incidents could be reported. (Noted)
(iii) Cllr Moores said he was similarly liaising with relevant NDDC Officers and hoped for a similar outcome as Cllr Harper. (Noted)
b) Copy letter from parishioner to DCC (Highways Department) reference “Flooding at Bar Beacon, Anstey Way, Instow”: -
The Clerk appraised IPC of the content of the letter and of the action(s) subsequently taken by DCC. He added that the parishioner had been kept up to speed by DCC at all times. (Noted)

c) (i) Email (dd 4.4.08) and attachment from DAPC reference “The Way Ahead – The Future of Health and Social Care in Devon”: -
The Clerk said this letter stated that Devon Primary Care Trust and DCC had recently published “The Way Ahead” vision and strategy for improving health and social care over the next 5 years and that the views of Devon people were now being sought before the strategy was finalised in the summer. He added that to this end, Devon PCT/DCC was inviting people to attend a number of meetings throughout the County & that details were contained in the email attachment that had been copied to Cllrs with their agenda papers (10.4.08) - Closing date 17th April 2008. (ii) The Clerk also referred to a letter (dd 11.4.08) from DCC and Devon NHS Primary Care Trust reference “Joint Strategic Review”; he said this referred to the strategy as at (i) above and enclosed a profile of “Bideford and Northam” as being Instow’s “Town/Parish”. A copy of the letter and attachment was provided to Cllrs at the meeting. (Noted)
(iii) After a discussion it was RESOLVED to defer this item for further discussion at the next meeting and for Cllrs to attend one of the seminars if able to do so and to advise DCC/Devon PCT as necessary. (Action: IPC Cllrs)
d) Email (dd 7.4.08) and attachment letter from member of Bideford & Instow Railway Group (BIRG) reference “Proposed Toucan Crossing at Instow Signal Box”: -
(i) The Clerk reminded Cllrs that this letter had been copied to them with their agenda papers for perusal; he read the letter to Council. (Noted)
(ii) After a discussion IPC RESOLVED to advise the writer (and Bideford and Instow Railway Group) that whilst IPC fully understood his (its) concerns that IPC had to consider the safety of motorists and pedestrians at this locality and along Marine Parade and was, as a consequence, fully supportive of DCC’s intentions to place a toucan crossing at this location; road safety, in its view, had to come first. In addition IPC and DCC were fully appreciative of the importance of the heritage of the signal box (and of its listed building status) and what work was done on location (on the highway) would take such an important consideration into the equation.

e) Damage to Bus Shelters – Boathouse and Venn Cross: -
The Clerk referred to reports of damage to the Boathouse bus shelter (window pushed out/beading damaged/replaced by handyman and then window removed & now missing) and a small fire (paper) started in Venn Cross bus shelter (Instow Town side of Anstey Way); minimal smoke damage to wall. The Clerk confirmed he had advised the Police and attention had been promised by patrols. (Noted)

The Clerk advised IPC he had not received any further correspondence on this matter since the last meeting; he said he would chase it up asap. (Action: The Clerk)
(c) Beach Cleaning Grant 2008: - .
The Clerk advised IPC that now the end of year accounts 2007/8 had been completed he would be able to apply for the grant (£1,800.00 – letter {dd 11.3.08} from NDDC refers). (Action: The Clerk)
(d) Draft Annual Accounts 2007/2008: -
The Clerk provided Councillors with a copy for perusal/discussion; he said it had been checked by Cllr Crombie (11.4.08) with IPC’s financial records and found to be in order. Cllr Crombie confirmed this to be the case. (Noted)
(d) Budget (Income/Expenditure) 2007/2008 against Actual (Income/Expenditure) 2007/2008: -
The Clerk provided Councillors with a copy for discussion; he said it had been checked by Cllr Crombie (11.4.08) with IPC’s financial records and found to be in order. Cllr Crombie confirmed this to be the case. (Noted)


(f) Internal Audit – January to March 2008: -
Cllr Crombie confirmed he had carried out this internal audit (11.4.08) and found all to be in order. (Noted)
(g) Bank Reconciliation – 1st January 2008 to 31st March 2008: -
The Clerk referred to a copy of this paper that he circulated to Cllrs at the meeting; he said it had been checked by Cllr Crombie (11.4.08) with IPC’s financial records and found to be in order. Cllr Crombie confirmed this to be the case. (Noted)
(h) Inland Revenue – End of Year (2007/2008) Returns (P35 and P14s’): -
The Clerk confirmed this process was in hand (P14’s awaited) and all relevant papers would be dispatched to Inland Revenue asap. (Action: The Clerk)
(i) Quay Car Park: -
The Clerk advised IPC that the annual service for the car park machine had been arranged for Tuesday 29th April; he added that the car park would become operative 1st May. (Noted)
(j) Letter (dd 17.3.08) from Audit Commission reference “IPC’s External Auditor – Financial Years 2007/8 to 2011/12: -
The Clerk said this stated that Alun Williams had been appointed as auditor to IPC for the financial year 2007/8 to 2011/12; he confirmed that a copy of the letter had been forwarded to IPC’s Internal Auditor, Mr G Day. (Noted)
(k) Letter (undated – received 12.4.08) from Audit Commission (AC) together with Annual Return for the Year ended 31st March 2008 and associated papers: -
(i) The Clerk confirmed he was to meet up with Mr G Day (IPC’s IA) on 23.4.08 and would then take action as necessary; he confirmed that a copy of the papers had been forwarded to Mr Day on 15.4.08. (Noted)
(ii) The Clerk added that all appropriate paperwork needed to be completed and returned to the AC by the 23rd June 2008 and that the notice to electors had to be published on 1.6.08. (Action: IPC’s IA/Clerk)
(l) Letter (received 10.4.08) from Allianz Cornhill reference “Insurance Renewal 2007/8 – 1st June 2008”: -
(i) The Clerk advised IPC he had copied all salient papers to Cllrs Johns and Crombie so each could peruse and then meet up with him to review the overall cover and come back to IPC at the next meeting (15th May) and make a recommendation. (Noted)
(ii) IPC RESOLVED to ratify this action. (Action: Cllrs Johns/Crombie/Clerk)
(m) Telephone call (dd 19.3.08) from a parishioner reference “Damaged Bench – Marine Parade”: -
The Clerk said this stated that a parish council bench had been damaged by a car that had rolled out of a driveway along Marine Parade and crossed the road. The Clerk added that the matter had been attended to by the parish handyman and once the bench had been repaired an account would be forwarded to the parishioner for settlement as agreed – liability had been admitted. (Action: The Clerk)
(n) Letter (dated April 2008) from EDF Energy reference “Energy Prices are Rising”: -
(i) The Clerk said he had spoken to EDF Energy and ascertained that IPC’s un-metered supply (Car Park Machine) would rise from 11.31p per unit to 12.41 per unit and that IPC currently “uses” approx. 54 units per quarter; he added that IPC was currently charged £6.42 per quarter (VAT 31p) and that would, therefore, rise to approx £7.87 inc of VAT. (Noted)
(ii) The Clerk confirmed that a certificate of un-metered supply had been provided to him by email (dd 14.4.08) from EDF Energy and that a copy would be kept in IPC’s General Finance file 2008/9. (Noted)

2804/11 PLANNING
a) Erection of single storey extension to provide 6 units of accommodation at The Meadows, Anstey Way, Instow (Reference No 46320): -
(i) The Clerk reported receipt (15.3.08) of this application and of having passed it immediately to IPC’s PSC for attention; for response by 2.4.08 or an extension would need to be applied for. (Noted)
(ii) The Clerk confirmed that details of the application had been placed on Instow website for the information of parishioners. (Noted)
(iii) The Clerk advised IPC that in view of the nature of the application an extension had been applied for to allow this matter to be discussed at IPC’s meeting of 17th April 2008. (Noted)
(iv) After a discussion, led by IPC’s PSC, IPC RESOLVED to recommend APPROVAL of this application conditional on previously approved applications being withdrawn to avoid an over-intensification of the site. (Action: The Clerk)

2804/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
a) Unlit Light – Rectory Close: -
Cllr White said the light of the lamp post outside of No 6 was unlit. It was RESOLVED the Clerk should contact the appropriate authority. (Action: The Clerk)



b) Roundhouse – Instow Recreation Ground/Picnic Area: -
Cllr Cook said that this roundhouse was in a poor state of repair and that the “owners” should have this drawn to its attention. It was RESOLVED the Clerk should contact the appropriate authority. (Action: The Clerk)
c) Pier Steps/Handrails – The Quay, Instow: -
Cllr Cook said these steps and handrails were in a poor state of repair and that it had been brought to his attention by a parishioner that a young girl had tripped in the locality recently and had nearly fallen into the river. It was RESOLVED the Clerk should write to the owners, Devon Christie Estates and draw this health and safety issue to its attention. (Action: The Clerk)
d) Sand on Highway – Marine Parade: -
Cllr Moores said that because of the recent bad weather and high winds that a considerable amount of sand had been deposited on the highway between the Boathouse flood defence gate and the entrance to the sand dunes car park. It was RESOLVED the Clerk should contact DCC Local Services. (Action: The Clerk)
e) Remains of Wooden Kiosk – Boathouse Bus Shelter: -
Concern was expressed by Cllr Moores at the time it was taking the owner to remove the remains of the wooden kiosk that had been completely destroyed in the recent gales; he said it was a fire risk in that youths had recently been seen to endeavour to set fire to it. It was RESOLVED the Clerk should contact the owner again and ask him to move it forthwith. (Action: The Clerk)
