MINUTES OF THE JANUARY 2004 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 15th JANUARY 2004 - 7.30 PM



The meeting was preceded by at talk by Andy Bell (UNESCO Biosphere Reserve Coordinator and North Devon Countryside Service Manager) on the UNESCO Biosphere (Braunton) and a briefing from Robert Crabb (NDDC’s Sports and Recreation Manager) on the “Future of Beach Lifeguard Provision” - See items 2401/8 (f) and 2312/9 (iii) (c).

Present: - Councillors P Cook, N Crombie, C Harper, M Green, A Johns, Ms A Mayoh, F Scott, S White (Chairman) and Mr R Jacob (Parish Clerk).

2401/3 POLICE REPORT
(a) Introduction: - The Clerk reported he had received a letter from Constable Darren Johnson informing IPC he was to take a 12-month career break from the Devon and Cornwall Constabulary and that he was to be replaced by Constable John Parker. PC Johnson said he had thoroughly enjoyed his time working within the parish and that he had found the work most rewarding. He thanked Cllrs and parishioners for all their support. It was RESOLVED the Clerk should contact PC Johnson and wish him well. (Action: The Clerk)
(b) Welcome: - The Clerk, on behalf of IPC, welcomed Constable John Parker to his first meeting. (Noted)
(c) Crime: -(i) Constable Parker reported that since the last meeting two persons had been arrested in relation to a series of thefts of diesel from the Holmacott Landfill site; both had been bailed to Barnstaple Police Station on the 19th February. He also reported upon the theft of a mobile telephone from The Quay Inn and an offence of arson at Venn Close, Instow where a lit firework had been pushed through a letterbox. (Noted)
(ii) The Clerk enquired as to whether police enquiries were complete as regards the recent minor damage that had occurred at the Venn Cross Bus Shelters; Constable Parker reported he had interviewed a youth and given him “advice”. (Noted)
(d) Miscellaneous Matters: - Constable Parker said there had been one incident of “harassment” on the seafront (a pedestrian by a motorist who had been warned by the police) and a non-injury road traffic accident at New Road. (Noted)
(e) Traffic Issues - Boathouse Loading Bay (Obstruction) : - The Clerk asked PC Parker if he knew of the outcome of Constable Johnson’s discussion with John Beardsley (DCC Highways) reference this issue and associated obstruction matters. Constable Parker said he would make further enquires and come back to the Clerk/IPC as soon as possible. (Action: The Clerk and Constable Parker)
2401/4 PARISHIONERS
(i) Kiln Close Lane - New Traffic Order: - A parishioner enquired as to the progress of the proposed new traffic order (Clerk’s note: south side from a point 62 metres east of “front” road westward for 20 metres). Cllr Cann reported this was in hand and that he anticipated it being in place before the forthcoming summer period. (Noted)
(ii) Removal of Double Yellow Lines between Pinchpoints: - In answer to a question from Cllr Harper, Cllr Cann reported that this would be dealt with along with the issue as at 2401/4 (i) above. (Noted)



2401/5 REPORT COUNTY COUNCILLOR R CANN
(a) Cllr Cann reported there had been some minor teething problems with the New junction scheme at Marine Parade/Anstey Way; bollards had been suggested for one of the parking refuges, the pavement needed lowering to enable wheelchair access in the main parking bay and there appeared problems when buses were parked at the new bus stop area. He said all these issues were under consideration/review and that the full markings for the scheme had yet to be put in place. He suggested the scheme, as a whole, be reviewed when all markings were in situ. (Noted)
(b) Cllr Cann also spoke on DCC/NDDC Budget implications, the Portable Speed Sign (for Anstey Way), Devon Composting Partnership, Council Tax on Second Homes and the New Instow School (DCC decision imminent). (Noted)

2401/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN

2401/7 MINUTES
It was RESOLVED that the December 2003 minutes of Instow Parish Council be approved and signed. (Noted)

2401/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2312/3 (b) - Traffic Issues i.e. (i) Boathouse Loading Bay and (ii) New Road Layout at junction Marine Parade/Anstey Way: - (i) Boathouse: See item 2401/3 (e). (Action: Constable Parker)
(ii) New Road Layout/Anstey Way: The Clerk reported receipt of a telephone call from a parishioner (6.1.04) to the effect that (a) problems were being encountered with bus drivers who were refusing to stop at the new delineated bus stop (set back from the bus shelter) because, in their view, it presented a traffic hazard by doing so and (b) that the traffic island on Anstey Way did not provide sufficient space for a pedestrian and a pram/wheelchair when awaiting traffic to pass and before crossing the main road. The Clerk advised IPC he had immediately contacted Cllr Cann (DCC) who agreed to visit the site soonest and speak to parishioner in question who was updated. See also item 2401/5 (a). (Noted)
(b) Item 2312/4 (a) - Wheelie Bins - Instow: - The Clerk updated IPC on his enquiries with the Clerk to Braunton Parish Council and referred in particular to an email (17.12.03) from the Clerk to Braunton Parish Council. (Noted)
(c) Item 2312/8 (a) - Toilets/Marine Parade/Sand Dunes & Quay Car Park: - The Clerk reported he had still not received a response from Geoff Barclay (NDDC), despite numerous emails and letters since the November meeting, and that he had, as a consequence, liaised with Cllr Cann with a view to him making enquiries of NDDC and reporting back to IPC. Cllr Cann reported he was in possession of the most recent plans (Quay Car Park and Sand Dunes - Marine Parade), which he then presented to Council. After a debate it was RESOLVED, through Cllr Cann, to ascertain from NDDC what its rationale was to place the new Charter toilets on the Quay Car Park immediately behind the bus shelter (as opposed to using the current site); IPC recognised likely concerns as regards privacy from residents of neighbouring properties, a likely loss of car parking spaces and therefore reduction in revenue to IPC during the summer period and problems with the storage of boats during the winter period. It was unanimously RESOLVED not to comment on both of the plans until a response was to hand from NDDC as regards to the Quay Car Park siting issue. (Action: Cllr Cann)
(d) Item 2312/8 (b) - Doggy Bin Atturm/Anstey Way: -The Clerk reported he had received a response (email dd 23.12.03) from Martin Coles (NDDC) to the effect this request had been put on a “doggy bin” list for consideration in 2004/5. (Noted)
(e) Item 2312/8 (c) - IPC - Training Needs: - (i) The Clerk reported he had received confirmation that a Planning Officer (David Heard) was to attend the February meeting of IPC (19th February), his talk to begin at 7 pm. (Noted)
(ii) The Clerk further advised Council that The Monitoring Officer of NDDC was to arrange further training sessions on the “Code of Conduct/Declaration of Interest” which would undoubtedly take place at The Civic Centre, Barnstaple with dates to be advised. He encouraged all Cllrs to attend this valuable training session. (Noted)
(iii) The Clerk further advised IPC that a NDDC Planning Enforcement Officer (Lewis Andrews) had been “booked” for the March meeting. (Noted)
(f) Item 2312/9 (iii) (c)) NDDC - Future of Lifeguard Provision: - Council considered its stance in the light of the presentation given by Robert Crabb (NDDC) prior to the meeting; Cllr Crombie (Risk Assessment Cllr) led the debate. It was RESOLVED to contact IPC’s insurers and enquire what cover was currently available for IPC’s liabilities as regards the parts of Instow beach leased by IPC from The Crown Commissioners; in addition, what ought IPC do, in a proactive sense, to reduce and/or safeguard its current level of insurance cover. The Clerk was asked to write to Allianz Cornhill Insurance plc soonest. (Action: The Clerk)
(g) Item 2312/9 (iii) (p) - IPC - (i) Website Domain and (ii) Broadband: - (i) The Clerk reported that to register a website domain, for example, www.instowparishcouncil.gov.uk <http://www.instowparishcouncil.gov.uk>, would cost anywhere between £50 (Source of information: “The Phone Coop”) and £188 (Source of information: Westleigh Parish Council - Eclipse Internet). The Clerk suggested he liaise with Cllr Harper and the “facilitators” of the current Instow Website to determine how such a domain could be interlinked with their site; he added that to do so would assist IPC in subsequently acquiring Quality Parish status. IPC RESOLVED to adopt this suggestion - see also item 2401/9 (iii) (k) (iv). (Action: The Clerk and Cllr Harper)
(ii) The Clerk said he had ascertained that BT charge £28 per month (inc of vat) for broadband (£27 if paying by direct debit). He said there was a connection charge of £30 plus a cost for specialised equipment (i.e. modem, micro filters etc) of £50 with a minimum contract period of 12 months. He added that BT recommended broadband if a “user” made use of the internet for more than 1 hour per day which, during peak times, would cost approx £2 - broadband costs approx. £6.50 per week. The Clerk said there were other providers e.g. The Phone Co-op/ Demon etc - he advised IPC of the differences, which as regards costs were minimal. The Clerk reported he had claimed approx £60 for Internet usage (mainly for emails) for the previous 12 months albeit usage is very much on the increase. After a discussion it was RESOLVED to take no further action on broadband for the time being. (Noted)
(h) Item 2312/9 (ii) (q) (iii) - SWW Ground Pollution from new sewage pipe/footpath Venn Cross to Tarka Trail): - The Clerk reported he had received confirmation (3.1.04) from The Environment Agency that this alleged leak had been investigated (on 22.12.03) and that it had been confirmed not to be sewage. It would seem that it is an ingress of clear water, which Brent and SWW are investigating further. The Clerk confirmed he had updated the parishioner who had raised this issue. (Noted)

2401/9 CORRESPONDENCE
(i) TTEF Correspondence (For information only): -
(a) Letter (undated - received 7.1.04) from Devon Sea Fisheries Committee (DSFC) reference “Proposed Shellfish Regulating Order Taw/Torridge Estuary” together with “Notes for Guidance”: - The Clerk said this referred to the promotion of a regulating order for shellfish within the Taw/Torridge estuary adding the letter was part of a consultation process to make IPC aware of the intention to regulate the shellfisheries in the estuary and to give IPC an opportunity to comment. The Clerk said a presentation was to be given at the next TTEF Meeting that was to be held at Bideford Town Hall at 7pm on Monday 19th January 2004 (see 2401/9 (i) (b) below). He said DSFC was seeking IPC’s support and that a response was required by 1st March 2004. He said a copy of the letter, and notes for guidance, had been copied by him to the Chairman of the TTEF for information. After discussion it was RESOLVED to seek the views of the TTEF; the Clerk was asked to liaise with its Chairman so its reply could be considered at the next meeting. (Action: The Clerk)

(a) Letter (dd 10.12.03) from NDDC reference “House to House Act 1939: Bideford and District Sea Cadet Corp - Mr C D Harper, Seaquel, Bridge Lane, Instow, Bideford: - The Clerk advised IPC that as this was a regular collection in the parish (on an annual basis) and a bone fide charity he had advised NDDC that IPC had no objection. IPC RESOLVED to ratify this decision. (Noted)

(b) Letter (received 13.12.03) from Steve Cole (Earthers Landscaping and Maintenance) of Bideford offering his company’s services to IPC: - The Clerk advised IPC of its content. (Noted)
(c) IPC - Siting of Xmas Tree at Signal Box: - The Clerk reported receipt of an email (dd 12.12.03) from Andy Bell (NDCCS) reference a recommended future “agreement” between NDCCS (DCC) and IPC to site its Xmas Tree at the Signal Box on an annual basis. He said a draft agreement was still awaited and that it might possibly be associated with a peppercorn rent of “£1, if claimed”. (Noted)
(d) Email (dd 16.12.03) from Clerk to DCC reference “Sand on the highway - Marine Parade”: - The Clerk reported this matter had been attended to and that Julian Roskilly had replaced Steve McCrory as DCC’s Area Highway’ Foreman for the parish. (Noted)
(e) Minutes of NDDC - Standards Committee of 17th December 2003 - The Clerk said NDDC’s Standards Committee had noted “IPC’s Complaints Code of Practice”. Cllr Cann said it had been recognised as an example of good practice (Noted)
(f) Correspondence (including a poster) from CCD (received 18.12.03) concerning “Training Opportunity - Community Project/Taster Sessions Barnstaple Library on 22.1.04 between 2pm and 4pm & 7.30pm and 8.30 pm: - The Clerk appraised Council and said the poster had been placed at the Post Office. He added a reminder letter and poster had also been received (7.1.04) and that on this occasion he had placed the poster at the Parish Hall. (Noted)
(g) Letter (dd 15.12.03) from Nick Harvey MP reference “Council Tax - Expected Increase 2004/5”: - The Clerk reminded Cllrs he had copied this letter to them with their agenda papers and that it referred to item 2311/13 (b). (Noted)

(i) Letter (dd 18.12.03) from Philip Babbs (Home Office - Police Grants Team/Police Resources Unit) concerning “Policing in Devon and Cornwall - Council Tax 2004/5”: - The Clerk reminded Cllrs he had copied this letter to them with their agenda papers and that it referred to item 2311/9 (n). (j) Letter (dd 11.12.03 - received 3.1.04) from Northern Devon Community Transport Association Ltd concerning “Funding Support for ND Transport Development Project 2004/7”: - The Clerk said he had copied this to Cllr Green who spoke to Council. It was RESOLVED to take no further action. (Noted)
(k) Email (dd 12.1.04) from Cllr Harper reference “(i) Parish Seats - Security, (ii) IPC Minutes of Yesteryear, (iii) Tree Preservation Orders (TPOs’) and (iv) Website”: - (i) The Clerk reported that the Parish Seats issue had been passed to Mel Harris (Handyman) for attention. (Noted)
(ii) Cllr Harper suggested that IPC’s Minutes of Yesteryear” be published on the Instow website. It was RESOLVED to support this suggestion. The Clerk was asked to arrange for Cllr Harper to liaise with Tim Wormleighton (DCC’s Archivist) at The Athenaeum. (Action: The Clerk and Cllr Harper)
(iii) Cllr Harper confirmed he had passed on the TPO information as at item 2311/9 (ii) (h) (ii). (Noted)
(iv) Cllr Harper and The Clerk reported upon the Instow Website; they suggested they arrange a meeting to assess progress to date and discuss improvements for the future i.e. separate domain fro IPC for example. IPC RESOLVED to support this recommendation - See also 2401/8 (g) (i) (Action: The Clerk and Cllr Harper)
(l) Use of Parish Sand Bags: - The Clerk reported that 30 parish sand bags had been issued by Cllr Cook to a business premise situated on the road to the old power station during the morning of Monday 12th January when heavy rain was being experienced. He added that 30 replacement bags had been requested from NDDC who would deliver to Cllr Cook soonest. (Noted)
(m) Press Release note (received 13.1.04) from NDDC reference “An Invite to North Devon Biodiversity Forum”: - The Clerk said that this was to be held at The Civic Centre on 19th January and that he had copied the note to Cllrs. (Noted)
(n) DCC Monthly News Round-Up (January 2004): - The Clerk said he had copied this to Cllrs and placed a copy at the Post Office for parishioners. (Noted)
(o) Letter (undated - received 14.1.04) from DCC North Devon Youth Offending Team reference “Community Reparation Placements”: - The Clerk provided Council with a resume of the letter that he had also copied on to Westleigh PC. After a discussion it was RESOLVED to take no further action. (Noted)
(p) Clerk received information reference “Damage (slates) to Stone Bus Shelter at Venn Cross (seaward side)”: - The Clerk said he had liaised with Terry Shilvock (Builder) and Mel Harris (Handyman); the latter was to carry out a temporary repair and the former would replace the damaged slates when in the locality to build the new stone shelter at Atturm site (Feb/March). Note: - The Clerk advised IPC that these 3 uncleared cheques included the Parish Magazine (£250) and Parish Hall (£360) Grants 2003/4 that had apparently been misplaced by the recipients. He recommended that he take action to cancel the appropriate cheques and that they be re-issued. IPC RESOLVED to adopt this course of action; the re-issued cheques were duly signed. 4. RESOLUTION REQUIRED: -
IPC RESOLVED to transfer £370.00 From Lloyds Bank Business account number 02350065 to Lloyds Bank Treasurers account number 02348842 to cover cheques as at 2 above. (Action: The Clerk)
5. MISCELLANEOUS: -
(a) Instow Welfare Trust: - (i) The Clerk confirmed he had received a letter from CCLA Investment Management Ltd (dd 31.12.03) of relevance to the Instow Welfare Trust stating “the latest payment (£0.40) arising from this account has been returned to this office as we are apparently quoting incorrect details. I am therefore enclosing a cheque for £ 0.40 for your attention and would be grateful to receive revised bank statement details etc”. The Clerk told IPC he had contacted the Trustees of the Welfare Trust to put them in the picture and would come back to IPC, in due course, after he had written to CCLA Investment Management Ltd to explain the situation. He said the Trustees of the Welfare Trust anticipated receiving a letter from The Charities Commissioners, before the next meeting of IPC, and that this would hopefully determine whether the Welfare Trust could finally be merged with the Devon Community Foundation. (Action: The Clerk)
(ii) The Clerk also advised Council he had received (15.1.04) a “COIF Charities Investment Fund Income Units - Statement of Unitholding” for “The Instow Welfare Trust” (as of 31.12.03) which he would copy to the Trustees. (Action: The Clerk)
(b) Instow Recreation Ground a/c: - The Clerk reported receipt of a letter (received 7.1.04) from The Portman Building Society, together with an Annual Statement of relevance to the Instow Recreation Ground Instant Access Account (A/C No 15783626). He said it indicated gross annual interest of £121.96 and a current capital balance of £5,146.84. The Clerk advised IPC he had had the Portman Instant Access passbook made up (9.1.04) and this confirmed the gross sum as above. The Clerk recommended that a cheque be drawn from the account in the sum of £121.96 (annual interest) and it be paid, as usual, to the Instow Parish Hall Committee. IPC RESOLVED to adopt this course of action. (Action: The Clerk)
(c) IPC Finance Sub Committee Meeting - Budget 2004/5: -
The Chairman/Clerk updated IPC on the following issues: -
(i) Bus Shelter - Marine Parade-Atturm: - (i) The Chairman said he still had to liaise with Mark Kidson reference the draft plans. (Action: The Chairman)
(ii) The Clerk said he had spoken to Terry Shilvock (Builder) and that he hoped to start to build the shelter in late Feb/early March. (Noted)
(ii) Instow Website - Grant for 2003/4 (£50) and 2004/5 (£100): - The Clerk advised IPC he still awaited details of the person(s) to whom these grant should be sent and that he needed to liaise with Cllr Harper (IPC’s Webmaster) who had been on holiday. (Action: Cllr Harper and The Clerk)
(iii) IPC - Use of Reserves: - The Clerk reminded IPC of this issue. (Noted)
(d) Parish Precept 2004/2005: - The Clerk confirmed he had received a letter (dd 22.1.03) from NDDC setting out a statement of IPC’s proposed Parish Council Tax for 2004/5 i.e. Precept of £5,600 - Band D Council Tax required to produce £5,600 = £14.39 (Estimate based on year 2003/4 properties). He added that NDDC required confirmation from IPC that these figures were acceptable and whether IPC wished to have its annual subscription (2004/5) to DAPC deducted from IPC’s first precept payment. IPC RESOLVED to confirm NDDC’s Precept statement as being correct and to agree to have the DAPC subscription deducted from IPC’s first precept payment. (Action: The Clerk)
(e) Xmas Charity Nominee 2003/4: - The Clerk confirmed he had received letters of thanks from North Devon Hospice (dd 15.1.03) & Children’s Hospice (South West) (17.12.03). (Noted)
(f) P3 Agreement (IPC - DCC) - Finance Forms and Grant Application 2004/5: - (i) The Clerk confirmed he had sent all the necessary paperwork to DCC (29.12.03) and that £100 had been claimed for expected work (strimming etc) during the season 2004/5. He said Mel Harris had submitted an “estimate” to carry out the appropriate work, totalling £150, and as there was a £50 surplus for the current year (2003/4) only £100 had been claimed. (Noted)
(ii) The Clerk advised IPC that all footpaths within the parish were acknowledged by DCC and NDCCS (who manage footpaths locally for DCC) to be in an excellent condition and up to governmental PSA standards. The Clerk said he had, however, pointed out one anomaly, namely footpath 9 that, according to the ordnance survey map, “navigates” through a pond at one spot (near to the Power Station) albeit it had been “replaced” (at said location) by footpath 15 that links footpath 9 with footpath 64. He added that guidance was awaited from DCC. (Noted)
(iii) The Clerk further reported he had received a letter (dd 8.1.04) from Ros Davies (DCC P3 Liaison Officer) confirming receipt of IPC’s P3 financial claim for 2004/5 (as at item 2401/10 (5) (f) (i) above) and congratulating IPC (Mel Harris in particular) on achieving PSA criteria standard. He said the letter also advised IPC that the “issue” of relevance to Footpath 9 (see 2401/10 (5) (f) (ii) above) would be considered and IPC advised of action to be taken in due course. (Noted)
(iv) The Clerk said that Ros Davies had also advised IPC that all P3 surplus monies should be carried forward year by year; he said this had been done since 2000/1 although there could well be a little surplus prior to that time when detailed records did not appear to have been made. The Clerk suggested that this “minimal” sum be written off bearing in mind that a proportion of the annual P3 grant monies covered administration costs such as postage, telephone calls, mileage etc. It was RESOLVED in principle to adopt the Clerk’s suggestion although he was asked to liaise with IPC’s IA, Mr G Day. (Action: The Clerk)
(g) IPC’s Internal Audit October - December 2003: - The Clerk & Cllr Crombie confirmed that this had been carried out (by Cllr Crombie on 14.1.04) and that all had been found to be in order. (Noted)

2401/11 PLANNING
(a) (i) Copy letter (dd 10.12.03) from NDDC’s Planning Department to Mr and Mrs P J Webb of 26 White House Close, Instow reference “The Town and Country Planning Act 1990 - Section 211 Notice Trees in Conservation Areas - Notification of Intended Arboriculture Works to Protected Trees” (Reference AGT/SS/Conservation Area at Instow): - The Clerk appraised Council of the content (see also item 2311/11 (c)). (ii) Town and Country Planning Act 1990 - Section 211 Notice: Notification for works to trees in a conservation area in respect of felling of 2 willows at land in front of 23-27 White House Close, Instow (Reference no 36813): - The Clerk reported receipt of this planning application (6.1.04) and of having passed it immediately to the Chairman for the attention of IPC’s Planning Officers. The Clerk notified IPC that this was not a planning application, could not be conditioned, and that the Local Planning Authority had only 6 weeks from the date of the notice being registered to consider whether the works should be authorised, or that for reasons of amenity a tree preservation order should be made. The Clerk said IPC needed to reply within 21 days from the date of the letter i.e. 5th January 2004. After discussion, led by the Planning Officers, it was unanimously RESOLVED to recommend approval of the application. (Action: The Clerk)

(b) (i) Letter from DCC concerning “Town and Country Planning General Regulations 1992 - Regulation 3 - Renewal of an expired consent (02/35/23060/96) to allow three temporary mobile classrooms to remain on site for a period of a further 5 years, at Instow Community Primary School, Instow” (Reference no. NW.02/35/36582/03): -The Clerk said the letter stated that DCC had GRANTED planning permission to carry out this development subject to conditions as listed. (Noted)
(ii) Copy letter (dd 18.12.03) from NDDC Planning Manager to DCC reference 2401/11 (b) (i) above (Reference No 36582): - The Clerk reported that this letter stated that the Local Planning Authority had resolved to INDICATE APPROVAL with conditions as listed; the Clerk read these to Council. (Noted)
(c) Letter (received 13.1.04) from NDDC reference “Extension to Dwelling and Erection of Conservatory at Gorse Hill, Instow (Reference No 36494): - The Clerk said that this stated that NDDC had GRANTED permission for this application with conditions as listed. (Noted)
(d) Extension and Alterations to Dwelling (Renewal of Unimplemented Permission 26220) at The Old Dairy, Marsh Lane, Instow (Reference No 36857): - The Clerk reported receipt of this application (13.1.03) and of having passed it immediately to the Chairman for the attention of IPC’s Planning Officers. He said a response was required by 2nd February 2004. After discussion it was RESOLVED to leave this application for the attention of IPC’s Planning Sub Committee who would liaise with the Clerk soonest.
