MINUTES OF THE OCTOBER 2005 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 20th OCTOBER 2005 - 7.30

The meeting was preceded, at 7 pm, by a talk on the “Licensing Act 2003” given by Mark Curgenven (Principal Licensing Officer – NDDC) and Constable Paul Daw of the Devon and Cornwall Constabulary.

Present: - Councillors P Cook, N Crombie, M Green, C Harper, G May, Ms A Mayoh, F Scott, S White (Chairman), and Mr R Jacob (Parish Clerk).

In Attendance: - Cllr R Cann (DCC), Cllr Mrs L Brown (NDDC) and 7 parishioners.

2510/3 POLICE REPORT
a) Venn Cross Bus Shelter - Damage: - Constable Benbow reported that his enquiries concerning this matter were almost complete. Parents of the offender(s) had dealt with the graffiti, hopefully to the satisfaction of the parish council. The Clerk said the graffiti was virtually obliterated although there was a small amount of fresh damage (burns) to the perspex window in the shelter on the seaward side. Cllr White said that the slates on the “landward” shelter still needed to be repaired. Constable Benbow said he would sort these issues out. (Action: Constable Benbow)
b) Crime – General: - Constable Benbow said that three crimes (thefts from unattended motor vehicles) had been reported in the parish since the last meeting although he was pleased to report that a suspect had been arrested. (Noted)
c) Police “Walk About”: - Constable Benbow said he would be walking from Fremington to Instow on Thursday 3rd November so as to make himself available to parishioners who wished to speak to him about issues of concern to them. He added that he would like to be accompanied by prestigious members of the community, such as Cllrs, and were there any volunteers? He added that publicity of the walkabout would take place beforehand and that the purpose of the exercise was to give reassurance to the public, help in solving their problems and to initiate more interest by the government in the provision of Police Support Officers for each and every neighbourhood. IPC RESOLVED to advise the Clerk of the interest of any particular Cllr to join PC Benbow with the Clerk, in turn, advising Constable Benbow of their details. (Action: IPC Cllrs and The Clerk)
d) Illegal Parking – Evenings: - Cllr White asked why Traffic Wardens could not patrol in the evenings to deal with the flouting of parking regulations within the parish, particularly along Marine Drive – he said he had witnessed Traffic Wardens patrolling during the evenings at Bideford recently. Constable Benbow said he would liaise with the Senior Traffic Warden, Kate Olds, and report back to IPC at the next meeting. (Action: PC Benbow)
e) Police Surgery: - The Clerk asked Constable Benbow if he could advise him when he intended to initiate his police surgery prior to each IPC Meeting. He said he would then advertise it on IPC’s meeting agenda that was published one week before each meeting. Parishioners would then be aware of this initiative and could respond as necessary. (Action: Constable Benbow)

2510/4 PARISHIONERS
Taw and Torridge Estuary Forum Matters: - Mrs Rose Day, Chairman of the TTEF, gave a report of the subjects discussed at the recent TTEF Meeting held on Monday 17th October 2005. These subjects included Dredging at Appledore Shipyard, Pontoon moored downstream of the Torridge Bridge, Wrecks in the Port of Bideford, Houseboats on the Taw, Avian Influenza, Super boom trialled in the Helford Estuary, North Devon Maritime Museum Trafalgar Weekend, Beach Lifeguards, Marine Bill Forum, Shoreline Management Plan, Meeting with TDC Chief Executive, Braunton Burrow Files, Fast Leisure Craft Joint Working Party, Appledore Slip, Appledore Quay Wall (TTEF extremely disappointed at the recommended “concrete” cladding proposal), Bathing Water Quality, Liaison with NDDC, Barnstaple Western Bypass and Downstream Bridge and Fullabrook Down Wind Turbine Project. (Noted)
2510/5 REPORT COUNTY COUNCILLOR R CANN
a) General Matters: - Cllr Cann reported upon Gaia Trust Project Yelland (Haven for birds and wildlife), Tarka Trail (SWW proposes to lay a sewer near the junction to East the Water industrial estate), Greensweep (NDDC has acquired a 4.4 ton RCV Mini Refuse Lorry – hoped to rollout the wheelie bin service to an additional 2,400 dwellings), Quay Car Park Toilets (matter is to be discussed at a future Executive Briefing – late November/early December), Ransom Strip Project (expressed concern at slow progress), Litter Bin provision in Anstey Way lay By (wheelie bin type), Variation of Premise Licence at The Bar and The Decks (believed a satisfactory compromise had been reached), NDDC Local Plan (NDDC’s Executive had accepted Inspectors recommendations) and Fullabrook Down Wind Turbine Project (DCC had recommended refusal). (Noted)
b) Waste Bin – Marine Parade/Yacht Club Entrance (See also item 2510/9 (iii) (c)): - Cllr Harper enquired when the damaged bin that had been removed for repair was to be replaced. The Clerk advised Cllr Cann of the background of this particular bin. Cllr Cann said he would liaise with NDDC Environmental Health Department and resolve asap. (Cllr Cann)
c) Marine Parade – Sand Dunes Toilets: - Cllr Harper said he thought a sign should be provided to point out these toilets to visitors. Cllr Cann said he would investigate and report back in due course. (Cllr Cann)
d) Rectory Lane – ND Homes Garages: - Cllr Cook reported there to be a pothole in the yard of these garages – Cllr Cann said he would speak to ND Homes and advise them asap. (Action: Cllr Cann)

2510/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
Cllr Mrs L Brown reported upon Proposed Modifications to the North Devon Plan (particularly as it related to Instow – a 6 weeks public consultation period will take place), Drink Control Order - Barnstaple and Safer Food Better Business Initiative. (Noted)

2510/7 MINUTES
It was RESOLVED that the September 2005 minutes of Instow Parish Council be approved and signed. (Noted)

2510/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2509/7 (b) - Charter Toilets/Quay Car Park: - (i) The Clerk advised IPC that NDDC was not prepared to permit an IPC Cllr to join the NDDC’s Sub Committee that is considering this site, in particular the implications of the new charter toilets and the current planning consent to build flats. The Clerk referred to emails (various – 19/20th Sept), which he had drawn to the attention of the Chairman/Vice Chairman at the time. (Noted)
(iii) Cllr Cann said this request could be reconsidered by NDDC, at a later date, following the impending Executive meeting particularly if a “contrary” decision was taken and which was not in accordance with the interests/current recommendations of the parish council. (Noted)
(b) Item 2509/7 (c) – Instow Bathing Water Tests/Little Torrington: - The Clerk advised IPC of his enquiries with the Environment Agency (Various emails refer). He said the matter had been fully investigated by them since it first came to notice in 1989, together with TDC, and that IPC had been categorically reassured that this intermittent problem did not appear to cause a problem in the receiving watercourse and it had no implications for the bathing water quality at Instow. (Noted)
(c) Item 2509/9 (a) - Village Show 2005/Wishing Tree: - The Clerk told IPC that it had not been possible for him and the Chairman/Vice Chairman to meet and discuss this matter since the last meeting although it was anticipated a meeting would take place in the near future at which point a report would be made to Council under “Correspondence”. (Noted)
(d) Item 2509/5 and 2509/9 (b) – Sewers/Instow: - (i) The Clerk reported that following a further complaint from a parishioner (27.9.05) about sewage smells along Marine Parade he had contacted the Environment Agency who in turn had contacted the SWW Control Hotline (0800 1691144). (Noted)
(ii) The Clerk reported receipt of a telephone call (28.9.05) from May Gurney advising him that the complaint had been fully investigated into and nothing had been found. (Noted)
(iii) The Clerk referred to an email (dd 12.10.05) from the Chairman of the TTEF reference “Beach Data” and in particular a reference to the current action(s) being taken by the Environment Agency (EA) reference the sewage system at Instow; the Clerk read it to Council. (Noted)
(e) Item 2509/9 (c) - Appledore Quay Wall: - (i) The Clerk reminded Cllrs of the public exhibition currently on view at the parish hall; he said a copy of a poster had been forwarded to Cllrs with their agenda papers (13.10.05). The Clerk confirmed he had placed similar posters throughout the parish on 13.10.05. (Noted)
(ii) The Clerk reminded Cllrs that any response by IPC to EA/Holcrow, on the current consultation process, would need to be formulated at the meeting although no doubt Torridge District Council would send a copy of the subsequent planning application to IPC for comments once tendered by EA/Holcrow (H). After discussion IPC RESOLVED to recommend to EA/H that it was in favour of a "concrete stone-cast/traditional masonry look" i.e. natural, much like the cast taken from Instow Quay Wall in the consultation brochure. (Action: The Clerk)
(f) Item 2509/9 (d) - Sandhills Ransom Strip: - (i) The Clerk confirmed he had liaised with Brian Holme (NDDC) by email (various); he appraised IPC of the response. (Noted)
(ii) The Clerk said that Brian Holme thought the idea of allotments on the new Instow School site was a good idea that he would bear in mind. (Noted)
(g) Item 2509/9 (e) - Parish Emergency Plan Update: - (i) Cllr Harper updated IPC on progress to date (76 parishioners responded to the questionnaire); he spoke to a draft copy of the plan (10 pages). After discussion it was RESOLVED that the Clerk would circulate a draft copy to each Cllr prior to the next meeting at which time Council could resolve to adopt (amended or otherwise) the plan and put it into circulation by way of the website etc. Action: The Clerk)
(ii) The Clerk advised IPC of an “Emergency Planning” presentation at the recent DAPC AGM; he passed the relevant papers to Cllr Harper. (Noted)
(iii) Cllr Harper supervised the draw of IPC’s Emergency Planning “Lucky” proforma “competition” and declared Dr Alison Grant the winner – Cllr Harper to advise Dr Grant. (Action: Cllr Harper)
(h) Item 2509/9 (f) (iii) - Instow Beach Cleaning: - (i) The Clerk confirmed he had liaised with Andy Bell (NDCCS) and that there was no proposed beach cleaning strategy available as yet. (Noted)
(ii) The Clerk confirmed he had sent a copy of IPC’s letter to DCE (reference “Beach/Dune Cleaning by IPC - Without Prejudice” – see item 2509/9 (f) (i)), to the Allianz Cornhill Insurance Company. The Clerk then referred to the response of the AC (letter of 27.9.05 refers) and his email (30.9.05) reply. (Noted)
(iii) The Clerk advised IPC of an email he had received from the Chairman of the TTEF reference “Water Quality Test”; it stated “Instow has failed the mandatory standard for 2005 because it failed two tests. Ironically, the tests also show that the bathing water was of Blue Flag quality for 13 out of the 20 tests taken during the bathing season, but the two failures are sufficient to cause a failure of the Imperative Standard. There was a slight question that Instow might have been given a "wet weather waiver" for the first failure (which would have been granted if the rain was so torrential that it would have been unreasonable to expect the sewerage system to have had sufficient storage capacity to cope with the flash flooding, and so any discharging from the storm overflows, with the consequent pollution, would have been inevitable). Unfortunately, the rainfall at the time of the first failure in 2005 was not sufficient to have triggered this situation, so either the storm overflow in Instow or the pumping station or the sewerage system was not functioning properly” Council was pleased to hear of this positive synopsis; the Clerk said that the EA would now be doing all it could to ensure that SWW played its part in ensuring Instow passed at least the imperative standard for 2006. (Noted)
(i) Item 2509/8 (h) (ii) - Instow Parish Council/Quality Parish Status: - (i) The Clerk suggested that The Countess of Arran DL (President of DAPC), together with Lesley Smith (Secretary to DAPC), be invited to present IPC’s Quality Parish Certificate at IPC’s Xmas Social (15th December). After discussion IPC RESOLVED to adopt this suggestion of the Clerk. (Action: The Clerk)
(ii) The Clerk referred to an email (dd 3.10.05) from NALC reference “Questionnaire for Quality Councils”; the Clerk appraised IPC of the content. IPC RESOLVED to instruct the Clerk to complete this as he saw fit. (Action: The Clerk)
(j) Item 2509/10 (i) (e) - Variation of Premises Licence (Various): - (i) The Clerk confirmed that Cllr Scott had attended the Civic Centre on 26th September and represented IPC at the licensing hearings of relevance to The Bar and The Decks – he added that copies of “Notice of Decision” letters, of relevance to both premises, had been forwarded to Cllrs with their agenda papers (13.10.05). (Noted)
(ii) The Clerk reported that as far as he had ascertained The Boathouse and The Wayfarer had only applied for a straightforward “Conversion” meaning they have exactly what they had before, just under a different heading – no additional conditions applied. (Noted)
(k) Item 2509/10 (i) (h) - DAPC AGM 2005: - The Clerk confirmed he had attended this excellent event at County Hall, Exeter on Saturday 1st October; he provided IPC with a synopsis and passed on a folder to Cllrs containing all relevant documents, including a copy of the DAPC Annual Report 2004/5. (Noted)
(l) Item 2509/10 (i) (k) – Flood Defence Wall/Benches: - (i) The Clerk confirmed he had written to Mr Hector Christie (DCE) as had been agreed at the last meeting (see item 2509/10 (i) (k) iv)); he reminded Cllrs he had forwarded a copy of the letter to them with their agenda papers (13.10.05). IPC RESOLVED to support the tenor of the letter, which it noted, had not been responded to. (Noted)
(ii) The Clerk advised IPC of a telephone conversation he had had with the Environment Agency (28.9.05) and a subsequent email (28.9.05); he outlined the content of the email and of his response. He added he had been obliged to provide the information so requested by virtue of the Data Protection Act. (Noted)
(iii) The Clerk advised IPC that no person(s) had contacted him to complain about the removal of the seats from the flood defence wall in response to the poster that had been affixed to the wall by DCE. (Noted)

2510/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
a) Letter (dd 3.10.05) from Peter Peter and Wright (Solicitors) concerning “The Commodore Hotel – Application for Transfer of Justices’ Licence”: - The Clerk said this letter stated that an application, for the transfer of the Justice’s Licence in respect of The Commodore Hotel, Instow into the names of Gary Woolaway and Annette Marlow, was to be made at the Civic Centre, Barnstaple on Wednesday 2nd November. IPC RESOLVED to offer no objection to this application. (Noted)
b) DCC P3 Autumn Newsletter: - The Clerk said this itemised “Survey and Finance Forms 2005/6” (See Finance Item 5 (e)), “Seasonal Vegetation Clearance”, “Ploughing and Cropping”, “Xmas Workshops” (IPC RESOLVED that Clerk and Handyperson would attend and represent IPC), “Devon Local Access Forum”, “Public Rights of way Improvement Plan”, “Access Land in Devon” and “Interactive Map”. (Noted)
c) Letter (dd 12.10.05) from DCC reference “Devon County Council Waste Local Plan”: - (i) The Clerk said this letter stated that a public local enquiry was to hear unresolved objections to this plan on Tuesday 10th January 2006 with a pre-inquiry meeting on 31st October 2005 (Guildhall, Exeter). He said it requested IPC to advise DCC of its current position by use of a proforma provided - The Clerk appraised IPC of the content of the proforma. (Noted)
(ii) After discussion it was RESOLVED to advise DCC that IPC would not be attending the hearing and nor would it be represented. (Action: The Clerk)
d) Remembrance Day Service 2005 – Instow Church: - The Clerk reported this service was to take place at 10.55 am on Sunday 13th November 2005 and that he had already got IPC’s wreath that was currently with the Chairman. After discussion IPC RESOLVED to appoint Cllr Scott as its representative (The Chairman Cllr Johns was unavailable) – Cllr Green said he would also attend. (Noted)
e) Parish Carol Singing Event 2005: - The Clerk reported that this event was earmarked to be held on Sunday 11th December (6.30 pm) at The Commodore/Parish Hall although he had yet to confirm all was still in order with The Commodore Hotel. He added that IPC needed to discuss the recipient of the charitable collection (NB: - In 2004 IPC resolved monies should go jointly between ND Hospice, Children’s Hospice (SW) and RNLI (Appledore) with IPC matching collection up to £100) and the arrangements on the night i.e. mince pies. mulled wine, hospitality, and collectors. The Clerk added that The Two Rivers Wind Ensemble had been previously booked but needed to be reminded by him. IPC RESOLVED to bring this back to the November meeting for more detailed debate. (Action: The Clerk)
f) IPC’s Xmas Social 2004 (Thursday 15th December 2005): - The Clerk provided Cllrs with a draft invitation list (based on 2004). After discussion a final approved list was drawn up and IPC passed a RESOLUTION to invite all those persons included thereon to the Xmas Social 2005. (Action: The Clerk)
g) Service of Thanksgiving for the Life and Work of Bruce Woolaway (The Commodore): - The Clerk report that he had attended this service at The Parish Church, Barnstaple on Monday 17th October 2005 and represented IPC adding that Cllr May was also in attendance. (Noted)
g) Instow Recreation Ground – Roundhouse: - (i) The Clerk referred to an email (dd 20.10.05) from Cllr Harper reporting that the thatched roof to the roundhouse at this site had yet to be completed despite assurances it was to be done at the end of September. (Noted)
(ii) The Clerk advised IPC he had been in touch with Wings UK and been told that the thatcher, to be used by them, had let them down at late notice (had given up thatching) and that alternative local thatchers were not available until October 2006. Wings were now actively seeking alternative options and had promised to keep IPC in the picture. (Noted)

5. MISCELLANEOUS: -
(a) Beach Grant 2005: - The Clerk reported receipt of a letter from NDDC (dd 11.10.05) stating that IPC had been awarded £1,800.00 towards its beach cleaning and that the necessary paperwork had been completed by him and returned to NDDC – cheque awaited. (Noted)
(b) Lloyds Bank Business Account – Tax on Interest/Inland Revenue: - The Clerk referred to a letter (dd 29.9.05) from Lloyds TSB confirming that the relevant “double” tax refunds of £63.78 (2004/5) and £18.33 (2003/4) had been debited from IPC’s Business a/c – shown as a tax reclaim (by Lloyds TSB). He added that a subsequent check of the bank statements had confirmed this to be the case. (Noted)
(c) IPC – Chairman’s Chain of Office: - The Clerk reported he had not, as yet, actioned the engraving of the chain as it could be required by the Chairman for the Instow Church Remembrance Day Service (13th November) and might not be finished in time. (Noted)
(d) IPC’s – Finance Sub Committee Meeting (Budget 2006/7): - The Clerk reported that IPC’s FSC would be meeting on Tuesday 8th November to discuss the budget for 2006-7. He added that the draft budget would be brought before IPC at the next meeting (17th November) for discussion and amendment/ratification. (Noted)
(e) DCC P3 Footpath Inspection 2005/P3 Claim for 2006: - The Clerk invited any comments from Cllrs as regards the state of each footpath within the parish. He reported receipt of the necessary paperwork for the footpath inspections 2005, including the P3 Finance form 2006. He said he would complete the forms as necessary following IPC’s FSC Budget 2006-7 meeting and the November meeting of IPC. (Action: IPC Cllrs and The Clerk)
(g) Internal Audit – July to September 2005: - The Clerk reported that Cllr Crombie had carried out this internal audit on 19th October and had found all to be in order. Cllr Crombie confirmed this to be the case. (Noted)
(h) Bank Reconciliation – 1st July 2005 to 30th September 2005: - (i) The Clerk circulated a copy of this to Cllrs at the meeting. He said the figures had been checked and confirmed by Cllr Crombie (19th October); Cllr Crombie confirmed this to be the case. (Noted)
(ii) Cllr Green said it would be helpful if the “carried forward” income could be indicated on this quarterly bank reconciliation. IPC RESOLVED to support this recommendation. The Clerk provided a verbal report on the current “carried forward” income sum i.e. £13,857.34. (Action: The Clerk)
(i) Budget 2005/6 against Actual Income/Expenditure April to September 2005: - The Clerk circulated and presented this paper to Cllrs. He said Cllr Crombie had checked it on 19.10.05; Cllr Crombie confirmed this to be the case. (Noted)
(j) DAPC Annual Subscription 2006: - The Clerk advised IPC that IPC’s subscription for 2006 would be £136.00 (was £124 in 2005); he said the figure had been agreed at the recent DAPC AGM 2005. (Noted)
(k) HM Revenue and Customs Employers Bulletin (Issue 21 – October 2005): - The Clerk confirmed he had retained this for future reference. (Noted)

2510/11 PLANNING
a) Erection of dwelling (additional drawings) at Land at Lane End Close, Instow (Reference 39545): - (i) The Clerk confirmed he had notified NDDC Planning (19.9.05 – email) of IPC’s concerns about the amount of noise that would be created, 24 hours a day, by BT vehicles going in and out of Lane End Close to visit its sub station at the end of the cul-de-sac when their vehicles went over the traffic calming street furniture that was to be erected. (Noted)
(ii) Cllr Mrs L Brown said NDDC’s Planning Committee had GRANTED this application. The Clerk said he had not, to date, received written confirmation to that effect. (Noted)
b) Erection of agricultural building on land off Orchard Farm, Instow (Reference No 40665): - The Clerk reported receipt of a letter (24.9.05) from NDDC’s Planning Dept advising IPC it had GRANTED planning permission for this application with conditions as listed. (Noted)
c) Demolition of single garage and erection of triple garage at Ocean View, Millards Hill, Instow (Reference No 40931): - (i) The Clerk reported receipt (22.9.05) of this application and of having immediately passed it to the Chairman for the attention of IPC’s PSC – for response by 11.10.05 or an extension to be applied for. (Noted)
(ii) The Clerk said that IPC’s PSC had unanimously resolved to recommend approval of this application and that NDDC had been told 14.10.05 (Noted)
(iii) IPC RESOLVED to ratify the decision. (Noted)
d) Extension and alteration to dwelling together with conversion of garage to form additional living accommodation at Offshore, Marine Parade, Instow (Reference No 40759): - The Clerk reported receipt (1.10.05) of a letter from NDDC’s Planning Dept stating this application had been GRANTED with conditions as listed. e) Letter (dd 10.10.05) from Barnstaple Town Clerk reference “Planning School” – Friday/Saturday 28th/29th October 2005: - The Clerk said that this letter stated that Barnstaple Town Council was to run a Planning School at The Castle Centre, Barnstaple and that IPC Cllrs/Clerk were invited to attend. He added that details of the course had been circulated to Cllrs with their agenda papers (13.10.05). After discussion IPC RESOLVED to note this invitation. (Noted)
f) Listed building application for erection of conservatory with internal alterations together with alteration of a door to a window at Cobbles, Bridge Lane, Instow (Reference No 40998): - The Clerk reported receipt (13.10.05) of this application and of having immediately passed it to the Chairman for the attention of IPC’s PSC – for response by 3rd November or an extension to be applied for. (Noted)
(ii) After discussion it was RESOLVED to leave this matter for the continued attention of IPC’s PSC as a site visit had yet to be done. (Action: IPC’s PSC)
g) Extension and alterations to dwelling at 5 Chichester Close, Instow (Reference No 41070): - The Clerk reported receipt (19.10.05) of this application and of having immediately passed it to Cllr Crombie (IPC’s current PSC Member) for the attention of IPC’s PSC – for response by 8.11.05 or an extension applied for. (ii) The Clerk advised IPC that a similar application has been considered by it on 17th March and 19th May 2005; he provided details of each decision taken. (Noted)
(iii) After discussion, led by IPC’s PSC, IPC RESOLVED unanimously to recommend refusal of this application on the grounds “of over-development of the site, privacy issues with neighbouring properties, not in keeping with other buildings in the area, necessity (there is already a double garage) and traffic safety issues by virtue of additional cars on site”. a) Overgrown Footpath – Atturm: - Cllr May reported that the hedge alongside this footpath needed cutting back. IPC RESOLVED to have the parish handyperson deal with this asap – Clerk to advise him. (Action: The Clerk)
b) Damaged Flagpole – Sand Dunes: - Cllr Harper reported damage to the base of this flagpole making it, in his opinion, dangerous. After discussion, IPC RESOLVED to advise Devon Christie Estates of this fact on the belief the flagpole belonged to it. (Action: The Clerk)
