MINUTES OF THE JANUARY 2009 MEETING OF INSTOW PARISH COUNCIL

Present: - Councillors P Cook, N Crombie, Mrs T Dipper, C Harper, M Green (Chairman), A Johns, B Thomas, and Mr R Jacob (Parish Clerk).
In the absence of the Chairman (Cllr White) Cllr Green (Vice Chairman) took the chair.

In Attendance: - Cllr R Cann (DCC) and 1 parishioner.

2901/1 PRAYER
The Clerk led the Council in prayer

2901/2 APOLOGIES

2901/3 POLICE REPORT
a) Crime: -
PC Hodgson reported that 5 crimes had been reported in the parish since the last meeting, namely, assault occasioning actual bodily harm (x 1 – offender cautioned), theft from a motor vehicle (x 1 – undetected), criminal damage (x 1), theft (non specific; x 1 – outboard engines/navigational equipment from motor boat) and theft (non specific; x 1 – theft of gear box from motor boat). (Noted)
b) Other Matters: -
PC Hodgson reported that 10 incidents had been reported in the parish since the last meeting, namely, female trapped under car, 2 horses loose on road, sudden death, disorder public house (x 2), found bicycle, crime related information, suspicious vehicle, suspicious male and prank phone call. (Noted)
c) Crime Prevention – Boat Watch: -
PC Hodgson said that PCSO Cornish was considering starting a boat watch scheme in the area and was looking for volunteers to help and run the scheme. (Noted)
d) Instow and West Yelland Crime Figures and Performance 2008 (against 2007):-
PC Hodgson said there had been a 22.67% decrease in overall crime (58 from 75), a 57.15 increase in detected crime (11 from 7), a 27.42% decrease in undetected crime (45 from 62) and a 60% decrease in no crimes (2 from 5). (Noted)

2901/4 PARISHIONERS
Green Issues/Fly Tipping etc: -
(i) A parishioner reported upon issues of relevance to (a) “Green Collections – Rectory Lane”, (b) “Fly Tipping – Instow Town”, (c) “Human Waste – Tarka Trail/Footpaths”, (d) “Defective Rectory Lane Sign” and (e) “Morsden – Grass Verge”. (Noted)
(ii) After a discussion IPC RESOLVED to report items (a) and (b) to NDC Environmental Health Dept via Cllr Cann, item (c) to NDC Environmental Health Dept via Cllr Cann and NDCCS and (d) DCC’s Local Services Superintendent. It was noted that item (e) would be discussed later in the meeting see items 2901/8 (c) (v) and 2901/11 (a)). (Action: The Clerk)

2901/5 REPORT COUNTY COUNCILLOR R CANN
(a) General: -
Cllr Cann reported upon “Collection of Food Waste” (an “in vessel composter” has been commissioned at Deepmoor that will enable NDC to gradually roll out a weekly waste food collection), “Waste Recycling Rates” (43% recycled to date – 50% target by 2011), “Bin Tax – Government Proposal” (NDC has no plans to introduce and will resist any such move), “Big Freeze Update” (20% {1650 miles} of all road network {8000 miles} has been treated; 8,076 tonnes of salt has been used to date {3711 tonnes in 2007/8 and 2,520 in 2006/7}) and “Instow Church Wall Project” (very pleased with this scheme). (Noted)
(b) Instow New School: -
Cllr Cann said a proposed new school site decision had been postponed and that he was becoming increasingly frustrated by DCC’s inactivity and drive. (See also item 2901/8 (d)) (Noted)
(c) Gateway Project: -
Cllr Cann reported that positive progress was being made on this initiative and that he would add detail to the discussions that he knew were to follow. (See also item 2901/8 (b)) (Noted)
(d) Missed Waste Collections: -
Cllr Cook asked whether NDC had any alternative arrangements to hand if a refuse collection was missed by a parishioner. Cllr Cann said that NDC had recently installed a “Wheelie Bin” at its civic amenity site at Seven Brethren for such a purpose. (Noted)

2901/6 REPORT OF DISTRICT COUNCILLOR B MOORES
In the absence of Cllr Moores (apologies) there was no report. (Noted)

2901/7 MINUTES
It was RESOLVED that the December 2008 minutes of Instow Parish Council be approved and signed. (Noted)

2901/8 MATTERS ARISING FROM THE MINUTES
a) Item 2812/4 (c) – Bideford Minor Injury Unit (BMIU)/Closure: -
(i) The Clerk confirmed he had spoken to and then sent a letter (dd 17.12.08) to the Matron of the BMIU expressing IPC’s concern at the closure of some of the opening hours of this essential, high quality service and life saving unit; letter copied to Cllrs with their agenda papers. (Noted)
(ii) The Clerk then referred to a letter (dd 31.12.08) from the Matron of the BMIU; copied to Cllrs with their agenda papers and read out at the meeting. (Noted)
(iii) After a discussion it was RESOLVED to have the telephone number of the BMIU placed in the parish magazine. (Action: The Clerk)
b) Item 2812/5 (e) – Village Gateway Initiative: -
(i) The Chairman, together with Cllr Cann, provided an update. Each referred to a meeting of IPC’s Sub Committee and a “highways” meeting with Rhys Davies (Chief Assistant Engineer – North Devon Area Highways Management); see item 2901/8 (c) below. It was said that a “Yacht” design was favoured but that details such as fixing, additional signage etc needed to be resolved. Cllr Cann said he had an estimated cost for the “appropriate” road markings. (Noted)
(ii) The Clerk referred to an email (dd 15.1.09) and a telephone conversation (15.1.09) he had had with Cllr Moores (NDC) who was able to “source” the metal “yachts” at a cost of approximately £700 each. (Noted)
(iii) After a discussion IPC RESOLVED to support the recommendations in principle but to leave the detail to the sub committee (Cllrs White, Green and Mrs. Dipper) together with Cllrs Cann (DCC) and Moores (NDC).

c) Item 2812/8 (a) - Maintenance of Highways: -
(i) The Chairman and Clerk provided an update of their meeting, with others (Cllrs White, Cann and Moores & Rhys Davies {Chief Assistant Engineer – North Area Highway Management}), on 9th January 2009. (Noted)
(ii) The Clerk then referred to an email (dd 14.1.09) he had received from Rhys Davies and which summarised the meeting and its findings, namely: -
i) Village Gateway Project: -
A safety audit would be undertaken by the highways authority before a licence was granted. (Noted)
ii) Additional Street Lighting – Anstey Way/Rectory Lane: -
There is a very limited county budget for street lighting enhancement and it would be difficult to justify lighting improvements of this particular section of road. (Noted)

iii) Access/Egress to Commodore Hotel on Marine Parade: -
On pure traffic grounds parking restrictions could be justified; however, parking in the area is limited and any changes would need to go through a consultation process. Traffic team have been asked to examine in next financial year. (Noted)
iv) Morsden, Rectory Lane – Trees/Grass Verge: -
The owner has a right to remove overhanging branches and was granted consent to trim trees adjacent to his property provided tree surgeon used to maintain form of existing trees. Hardening of the verge needs to be investigated. (Noted)
v) Flailing of Hedges – Anstey Way (Various): -
Removal of debris is the responsibility of the landowner and action has been taken in the past; any issues of concern to be reported to highways for the local services superintendent to address. (Noted)
vi) Annual IPC Grass Cutting Grant – Review: -
DCC Highways will make a contribution to IPC but only to the extent of costs associated with providing the level of service needed for highways safety. The concern over lack of increases has been noted and a review of the areas cut and appropriate payment received will take place. (Noted)
vii) Maintenance of Highways including Minor Roads:-
Repairs and maintenance of highways are prioritised on a needs basis throughout the county. The poor condition, particularly of the non principal network, has been acknowledged by the County and work is being carried out to address this. However, funds available are limited. Safety defects such as potholes are dealt with when reported. (Noted)
(ii) Cllr Cann said he condemned DCC’s Highways Maintenance programme. (Noted)
d) Item 2812/8 (c) – New School Instow: -
(i) The Clerk said it might be timely for Cllrs to reconsider their necessity to declare an interest in view of the fact the lay by site was no longer an issue. He said that if Cllrs were in any doubt they could discuss their situation with him or preferably, Mr Don Pratt (NDC’s Monitoring Officer). (Noted)
(ii) The Clerk then advised IPC of an enquiry from a former parishioner from Australia as regards the “demise” of the new school lay by site; email of 31.12.08 etc. The Clerk explained the context of his enquiry. (Noted)
(iii) The Chairman then led a discussion on what action(s) if any IPC should now take; he was supported by Cllr Cann. (Noted)
(iv) IPC then RESOLVED to contact DCC and enquire what their immediate strategy was and to seek assurances that DCC was working in an expeditious manner to resolve the current impasse. (Action: The Clerk)
e) Item 2812/8 (d) – Proposed Devon Unitary Authority/Community Boards/Forums - Focus Group: -
The Clerk advised IPC he had been invited to attend a meeting in Exeter on 20th January 2009 and would ensure IPC was informed of progress. (Action: The Clerk)
f) Item 2812/8 (e) – Freedom of Information of Act Update: -
(i) Cllr Crombie and the Clerk reported on their recommendations for completion of the “Information Sheet – Publication Scheme” as it related to IPC; a draft copy was provided for Cllrs at the meeting. (Noted)
(ii) After a discussion IPC RESOLVED to adopt it as recommended; it was further RESOLVED to place an item on the Instow Website advising parishioners of the adoption of the recent “Information Commissions Model Publication Scheme” and of the implications of the “Information Sheet”, subject of this item. (Action: The Clerk)
g) Item 2812/9 (i) (a) – Tug Cannis: -
(i) The Clerk referred to an email (dd 11.12.08) from the Chairman of the TTEF reference “Houseboats/Live-Aboard Vessels – Town and Country Planning Act”; the Clerk summarised the contents for the information of Cllrs. (Noted)
(ii) The Clerk then referred to a letter (dd 11.12.08) from DCE reference “Instow Beach – Vessel Mooring”; the Clerk read it to Council. (Noted)
(iii) The Clerk confirmed he had forwarded a suitable reply letter to DCE (dd 17.12.08); the Clerk read it to Council. (Noted)
2901/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 17.12.08) from NDC reference “Street Collection Permit – RNLI”: -
(i) The Clerk said this stated that the RNLI had applied to hold a street collection within the parish of Instow on Saturday 1st August 2009 between the hours of 9 am and 6 pm. (Noted)
(ii) The Clerk further advised IPC that in view of the fact this was an application by a bone fide charity he had told NDC that IPC would have no objection. (Noted)
(iii) IPC RESOLVED to ratify this action. (Noted)
b) Letter (dd 19.12.08) from NDC reference “House to House Act 1939: Clothes Aid for Make a Wish Foundation UK”: -
(i) The Clerk said this stated this applicant (Clothes Aid) had applied for a licence to collect second hand clothing to sell on behalf of Make a Wish Foundation UK (a registered charity) between 1st February 2009 and 31st January 2010 within the parish of Instow. (Noted)
(ii) The Clerk advised IPC that as the applicant (Clothes Aid) wished to collect “under licence” from Make a Wish Foundation UK (a registered charity) that he had advised NDC (email of 22.12.08 refers) that although IPC would not be in a position to object to this application as per House to House Act 1939 criteria, it would not be happy for this form of collection taking place within its parish on the basis that presumably not all income derived would be going to the charity (Make a Wish Foundation UK) and that it believed a “fear of crime” emanated from this form of door to door collection in the parish where there were a considerable number of elderly parishioners. (Noted)
(iii) IPC RESOLVED to ratify this decision. (Noted)
c) Email (dd 15.12.08) from Chairman of IIB reference “Instow Beach – Dogs”: -
(i) The Clerk said this stated that at a recent “adopt a beach clean/survey” 10 portions of dog excrement had been found over a 100m survey strip (Quay to northern boundary of Commodore), that is, one every 10 metres. It was suggested that “we” start flagging these offending items. (Noted)
(ii) The Clerk said he had suggested to the Chairman of IIB that this initiative would need to be done with accompanying high profile publicity, on an ad hoc basis, and in a coordinated manner together with NDC and possibly NDCCS. (Noted)
(iii) The Clerk further advised IPC that this imitative did seem to have struck a positive chord with IIB members and NDCCS who were already planning a similar initiative with NDC’s dog wardens; IPC RESOLVED to support this initiative in league with Cllr Cann (portfolio holder Environment NDC) and Cllr Moores (NDC); Clerk to contact Chairman of IIB. d) Telephone call (15.12.08) from a parishioner of West Yelland reference “Dead Animal on Instow Beach”: -
(i) The Clerk said he had ascertained, following a visit to the beach by the beach cleaner, that this was a calf carcass and was positioned in front of the Boathouse and thus on a part of Instow beach leased by IPC from the Crown Commissioners. (Noted)
(ii) The Clerk said he had immediately contacted Cllr May who had agreed to move it from the beach and suitably dispose of it; there was no identifying tag on the animal. The Clerk said that IPC could well receive an invoice to cover the cost of the calf’s ` “appropriate” disposal. (Noted)
(iii) Council expressed its gratitude to Cllr May for his valuable assistance. (Noted)
e) Letter (dd 17.12.08) and Paper from Communities and Local Government reference“ Communities in Control: Real People, Real Power: Code of Recommended Practice on Local Authority Publicity – A Consultation”: -
(i) The Clerk said this paper had been published on the Communities and Local Government website (17.12.08) and it invited views on the content by Thursday 12th March 2009. The paper was made available at the meeting. (Noted)
(ii) The Clerk said he had forwarded a copy of the letter to Cllrs with their agenda papers (8.1.08). (Noted)

(i) The Clerk advised IPC there were two entries within the list of relevance to Instow, namely, “Sands Sandhills” and “Grass Areas above High Water Mark” and that he had forwarded details to Cllr Harper who had agreed to research the matter and report to Council. (Noted)
(ii) The Clerk then referred to an email (dd 10.1.09) and attachment (Instow Common Land) from Cllr Harper that he had circulated to Cllrs with email addresses (10.1.09) and copied to others at the meeting. (Noted)
(iii) Cllr Harper then gave a full report and referred in particular to his enquires at The Land Registry (email of 9.1.09 refers). (Noted) (iv) Council thanked Cllr Harper for his valuable research and IPC RESOLVED to note his findings. (Noted)

(i) The Clerk told IPC he had approached Mary Jane Scott (as per item 2812/10 (5) (c)) and she was willing to act as IPC’s Internal Auditor. (Noted)
(ii) IPC, after discussion, RESOLVED to ratify the appointment; Clerk to advise Mary Jane Scott. (Action: The Clerk) (c) Parish Council Expenditure 2009/10 – Precept and NDC Grant: -
The Clerk reported he had, as anticipated, received a letter (dd 19.12.08) from NDC setting out a statement of IPC’s adjusted Parish Council Tax for 2009/10 i.e. precept of £6,334 – Band D Council Tax required to produce £6,334 = £14.82 (Estimated based on year 2008/9 properties). (Noted)
(ii) The Clerk advised IPC that the parish precept figure (as adjusted by NDC) was £34 more than IPC had “requested” (i.e. £6,300) and that as per item 2812/10 (5) (d) (ii) he had responded to NDC accordingly; he said the grant payment would now be £1,276 (and not £1,310) and the precept £6,300. (iii) The Clerk added that IPC’s annual DAPC subscription would be taken from IPC’s first 6 monthly precept payment as agreed vide 2812/10 (5) (d) (iv). (Noted)
(d) DCC P3 Footpath Inspection 2008/9 - P3 Claim for 2009/10:-
(i) The Clerk confirmed that the necessary footpaths inspection and paperwork had been completed and returned to DCC (2.1.09) and that a claim of £350.00 had been made to cover the cost of anticipated P3 activity for the year 2009/10. (Noted)

(j) Boathouse Bus Shelter Alterations: -
The Clerk advised IPC that this work had not as yet been completed due to the recent unfavourable weather conditions; he said it was hoped to get it done by the next meeting and that temporary repairs had been done in the meantime. (Noted)
(k) IPC Audit 2007/8 – External Auditors Certificate of Opinion: -
The Clerk advised IPC he had removed this notice (and a copy of the relevant accounts) from the Post Office on 8.1.09 and that no parishioner(s) had been in contact with him in its regard. The Clerk affirmed it had been filed for future reference.(Noted)
(l) Crown Commissioners – Beach Lease Extension Meeting 2009: -
The Clerk advised IPC he was to meet up with Michael Bapty (CC Agent) on Monday 9th February 2009 to discuss the renewal of said lease as of 1.1.10. He said Cllr Crombie had agreed to accompany him adding that Mr Bapty was also to meet up with the Chairman of TTEF at the same time. (Noted)
(m) Instow Allotment and Recreation Field a/c – Nationwide Building Society: -
(i) The Clerk reported he had yet to receive a letter from the Nationwide Building Society advising IPC of the sum of the annual interest 2008. The Clerk said he would visit the offices of Nationwide and find out soonest. (Noted)
(ii) After a discussion, IPC RESOLVED to have these monies drawn as a cheque made payable to the “Instow Parish Hall Committee” as in previous years.

The Clerk confirmed he had spoken to the DCC Local Services Superintendent (as per item 2812/11 (a) (v)) and that he had agreed to consider this issue and take action as appropriate. (Noted)
b) “Raising of roof to enable second floor extension to dwelling at Westwinds, New Road, Instow (Reference (47798)”: -
(i) The Clerk reported receipt (19.12.08) of this application and of having passed it immediately to the Chairman for the attention of IPC’s PSC; for response by 7th January 2009 or an extension to be applied for. (Noted)
(ii) The Clerk confirmed that an entry had been placed on the Instow website for the information of parishioners. (Noted) (iii) The Clerk advised Council that IPC’s PSC had unanimously recommended approval of this recommendation and that NDC Planning was advised 7.1.09. (Noted)

2901/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
(a) Parish Initiatives: -
(i) Cllr Cook said he was becoming increasingly frustrated at the lack of progress on local initiatives such as “Street Lighting – e.g. Anstey Way”, “New Charter Toilets – Quay Car Park”, “Ransom Strip Projects” and “Instow New School”. He added that all IPC seemed to do was continually discuss the progress/lack of progress of such issues, receive assurances from DCC/NDC Cllrs/Officers that each initiative “was in hand” and that work was being carried out elsewhere with a view to sorting out matters that were preventing progress for whatever reason. A discussion ensued. (Noted)
(ii) It was RESOLVED that Cllr Harper would re-circulate the results of the “Ransom Strip” consultation and the Clerk would liaise with Cllrs Cann (DCC/NDC) and Moores (NDC) and make IPC’s concerns known to them over lack of tangible and expeditious progress. (Action: The Clerk)
(b) Bath Terrace/Marine Parade – Potholes: -
Cllr Harper reported upon the poor state of this stretch of road; IPC RESOLVED to advise DCC Local Services Superintendent. (Action: The Clerk)
(c) Sand on Pavement - Commodore Slipway: -
Cllr Cook said this sand had not been moved since being reported at the December meeting; IPC RESOLVED to advise DCC Local Services Superintendent.
