2807/3 POLICE REPORT
a) Crime: -
PCSO Cornish reported that 6 crimes had been reported in the parish since the
last meeting namely, exposure (sexual offences x2 - male arrested and
charged), non crime (vulnerable adult – dealt with by social services),
criminal damage (electricity sub station – under investigation), theft
(quantity of copper from electricity sub station) and burglary (dwelling –
undetected). (Noted)
b) Other Matters: -
PCSO Cornish also reported that over the same period 7 incident logs had been
created for, road traffic collision (RTC) hit and run, aggressive guest in
hotel, request for contact (information), driver refusing to reverse for bus
(obstruction), crime related x4 (sexual offences, dwelling burglary and
electrical sub station x2). (Noted)
c) Crime Prevention: -
PCSO Cornish said he was still continuing to issue vulnerable vehicle forms
with the intention of alleviating thefts from unattended vehicles. (Noted)
d) Excess Speed: -
PCSO Cornish said he had recently carried out an excess speed detection
initiative in partnership with Instow School. This involved the setting up of
a speed trap on the B3233 approaching the area of the school (and site of the
proposed new school) with offending motorists being given the opportunity to
talk to the children or receive an endorseable fixed penalty ticket (FPT).
PCSO Cornish said all offending motorists had chosen to talk to the children
although one FPT was issued to a motorist driving at 48 mph (in a 30 mph
limit). PCSO Cornish said this was a high profile media event that featured on
Westcountry TV News, WMN and North Devon Gazette and it had been hailed a
success with residents who had noticed a difference already; he said it would
be repeated in the near future. Cllrs complimented PCSO Cornish on this
excellent initiative. (Noted)
2807/4 PARISHIONERS
a) New School Update: -
A parishioner asked for an update on the provision of the new school; Cllr
Cann said DCC were awaiting a consultation report on “issues” raised by NDC in
its response to the original planning application and assured the parishioner
and council that this was appropriate and should not be seen as divisive.

b) Excess Speed – New Road: -
(i) A parishioner said she was concerned at the speed some motorists were
travelling up and down New Road and enquired whether a 20 mph speed limit
could be considered adding that some of the current signage was “blurred” and
unclear. (Noted)
(ii) Cllr Cann agreed to speak to the parishioner and look into the issues
raised by her in conjunction with DCC Local Services. It was noted that PCSO
Cornish was aware having been advised earlier by the parishioner in question.

c) Wetland Project – Land between Elm Terrace and Marshfield (See also item
2807/8 (f)): -
(i) A parishioner said he wished to advise IPC he objected to this proposal on
the grounds that flooding problems could materialise in the immediate vicinity
(it was flood plain) if it ever went ahead as well as creating more parking
problems for nearby residents. (Noted)
(ii) The Chairman told the parishioner that this particular initiative was at
a very early stage; Cllr Cann said he would not provide funding for this
initiative if it was not supported by residents. (Noted)
2807/5 REPORT COUNTY COUNCILLOR R CANN
a) Cllr Cann spoke about “Foot Care Service – Devon” (a DCC, Devon Primary
Care Trust etc initiative), “Quay Car Park - New Toilet Block Update”
(discussions ongoing with local landowner and deadline being considered), “The
Devon Rural Road Safety Demonstration Project 2008 – 2010 The Open Road” (a
road safety initiative that will be centred between Exeter and Barnstaple),
“Boundary Committee Review – Update” (see later as at item 2807/8 (e)),
“Instow Litter Bins” (have been repainted) and “DCC – Adult and Community
Learning Courses” (details placed at post office for information of
parishioners). (Noted)
b) “Village Gateway Design”: -
Cllr Cann said he had placed an article in the recent parish magazine asking
for design suggestions from parishioners and that he had personally pledged a
£10 M & S voucher to the winner. (Noted)
c) Fire Hydrants –Marine Parade: -
Cllr Johns said these were found to be inoperative when the fire service
attended a boat fire earlier in the day because of sand blockage and that this
could well have proven to be catastrophic had it been a house fire. Cllr Cann,
as Chairman of the Devon and Somerset Fire and Rescue Services Human Resources
and Development Committee, said he would take the matter up as a matter of
urgency. (Action: Cllr Cann)
d) Tarka Trail – Decrepit Dog Bin (Tunnel between Quay Lane & Signal Box): -
Cllr Harper said this bin was “falling apart” and required replacing or
removing completely. Cllr Cann agreed to investigate/consider the options.

e) Community on Show – Composters: -
Cllr Harper thanked Cllr Cann for promoting these at the show and for
providing 25 complimentary ones to parishioners. (Noted)
2807/6 REPORT OF DISTRICT COUNCILLOR B MOORES
In the absence of Cllr Moores the Clerk read from a report that had been
provided by Cllr Moores. It spoke of “Fullabrook Wind Farm Judicial Review” (NDC’s
action failed), “Antisocial Behaviour Act 2003” (provided Section 30 examples
i.e. Landkey & delegation of decisions), “Implementation of Clean
Neighbourhood and Environment Act 2005” (to improve the amenity and quality of
the area through proper implementation of the powers given to locals
authorities), “Rough Sleeping Strategy” (to meet ministerial targets – close
to zero as possible), “Homelessness Strategy” (because of legislative
requirements), “Relocation of North Devon College” (vision to create state of
the art learning facility, close to the town, with first class community
benefits), Plans for Anchorwood” (outline planning permission granted for a
scheme to redevelop prime riverfront land), “Queen Street/Bear Street
Consultation” (plans have been on public display), “DCC – Retention of Post
Offices” (10 in particular identified) and “Local Government Review” (see
later as at item 2807/8 (e). (Noted)
2807/7 MINUTES
It was RESOLVED that the June 2008 minutes of Instow Parish Council be
approved and signed. (Noted)
2807/8 MATTERS ARISING FROM THE MINUTES
a) Item 2806/8 (a) - IPC – Cllr Vacancies: -
(i) The Clerk confirmed he had placed notices on parish council notice boards
(21.6.08) and on the Instow Website (IPC pages) and informed two parishioners
who had previously expressed an interest. (Noted)
(ii) The Clerk then advised IPC of the situation as of the date of the
meeting; only one person had applied to be co-opted. (Noted)
(iii) After a discussion it was RESOLVED to re-advertise the two vacancies
with a closing date of 25th August; Cllrs agreed to “spread the word”.

b) Item 2806/8 (b) (i) – Instow “Grot” Spot Initiative: -
(i) Cllr Harper updated IPC on progress adding the initiative was to run under
the umbrella of IIB for insurance purposes. (Noted)
(ii) The Clerk reported he had “obtained” a quantity of black plastic bags and
some metal grabbers for use in this initiative by parishioner volunteers.

c) Item 2806/8 (c) – Bottle Bank/Quay Car Park (Insurance Implications): -
(i) The Clerk reported that despite “chasing” NDC for an answer on this
important issue he had yet to receive a reply; latest email of 12.7.08 refers.

(ii) After discussion IPC RESOLVED to support the Clerk in his endeavours to
obtain this information that should be resolved by the next meeting. (Action:

d) Item 2806/8 (d) – IPC’s Self Help Emergency Plan Update: -
(i) Cllr Harper reported on progress; he said an article had appeared in the
Parish Magazine (June 2008) although responses from parishioners had been
extremely disappointing. (Noted)
(ii) Cllr Harper said that public liability insurance implications had arisen
as regards “volunteer parishioners”; after a discussion it was RESOLVED that
an enquiry to establish a position as a matter of some urgency. (Action: The
Clerk)
e) Item 2806/8 (e) – Review of Local Government/Boundary Committee: -
(i) The Clerk reported receipt of an email (dd 28.6.08) from Cllr Cann (DCC)
reference “Boundary Committee Review”; this email set out the timetable for
publication of the Boundary Committee’s Proposals for Devon (i.e. 7.7.08).

(ii) The Clerk reported receipt of an email (dd 7.7.08) and attachment (In
Touch Review) from DCC reference “County Welcomes Boundary Committee Plan to
Keep Devon United”; he said he had immediately copied this to Cllrs with email
addresses and also provided copies of the “In Touch Review” to all Cllrs with
their agenda papers (10.7.08). (Noted)
(iii) The Clerk reported receipt of an email (dd 7.7.08) from DAPC reference
“Boundary Committee (BC)/Devon Structural Review/Stage 3 Proposals - Website”;
he said he had copied the BC’s website summary and associated papers to Cllrs
with their agenda papers (10.7.08). (Noted)
(iv) The Clerk reported receipt of a letter (dd 7.7.08), Summary of Proposals
and Poster/Pamphlet from The Boundary Committee for England reference
“Structural Review of Devon”; he said the Draft Proposals, letter and summary
of proposals had been copied to Cllrs for perusal at the meeting and that a
copy of the poster and summary of proposals had been placed at the Post Office
and Parish Hall for the information of parishioners. (Noted)
(v) The Clerk reported receipt of an email (dd 16.7.08) from DCC reference
“Boundary Review – Letter to Parishes from Leader DCC”; he provided copies for
Cllrs to perusal at the meeting. (Noted)
(vi) After a discussion IPC RESOLVED to support the BC recommendations for a
single unitary authority for Devon and to cite examples of where it was hoped
vast improvements would ensue where DCC and NDC had, in the past, not accepted
responsibility to deal with an issue (e.g. dead animals on the foreshore) and
to pass on responsibility to the other or at least “muddy the waters” and thus
cause inordinate delays. (Action: The Clerk)
f) Item 2806/8 (f) – Instow Ransom Strip/Wetland Project: -
The Clerk updated IPC having recently spoken to the parishioner who was
leading on this project in conjunction with IIB. He said a positive view was
still held that the landowner would cooperate. (Noted)
g) Item 2806/8 (g) – Roundhouse, Instow Recreation Ground/Picnic Site: -
(i) The Clerk advised IPC he was still endeavouring to establish what NDCCS
and WINGS were intending to do to legally and insurance wise as regards the
cob house; he referred to his latest emails of 12.7.08/16.7.08. (Noted)
(ii) After a discussion IPC RESOLVED to continue to endeavour to facilitate a
satisfactory end to this unfortunate state of affairs and to ask NDCCS to tidy
up the site in general; it was felt that grass was extremely long and untidy
and its general appearance was far from inviting to the vast number of
visitors who frequented the area at this time of the year. (Action: The Clerk)
h)Item 2806/9 (i) g) – Removal of Payphone Provision by BT”: -
(i) The Clerk reported that the Chairman did a TV interview for Westcountry TV
(27.6.08) in respect of this matter. (Noted) (ii) The Clerk reported receipt
of a letter (dd 30.6.08) from Maitland Walker (Solicitors) of Minehead
reference “BT’s Removal of Public Call Boxes”; the Clerk outlined the content
to Cllrs at the conclusion of which it was RESOLVED to provide the information
as requested. (Action: The Clerk)
(iii) The Clerk reported receipt of a copy email from BT to NDC Planning
reference “Removal of Payphone Provision”; he said it stated that IPC’s
response should have been sent via NDC Planning and not direct (email of
20.6.08 refers). The Clerk told IPC this was not the case according to NDC
Planning’s original letter and this fact was pointed out to BT/NDC Planning.

Environmental Health Department (EHD) advising this request could not be met
and provided reasons why; email copied on to Cllr Johns so that parishioner

The Clerk advised IPC he had contacted NDC’s EHD with the information in the
event it might wish to commence an investigation/prosecution. (Noted)
(v) The Clerk told IPC that NDC’s Dog Warden had confirmed (16.7.08) they had
recently done 14 ½ hours of patrol in Instow, spoken to and warned several dog
owners and that the information as at (iv) above was insufficient to pursue a
prosecution. The Clerk said he had thanked the Dog Wardens for their

The Clerk outlined the content to Cllrs; it was said that to date Instow’s
post office facility was not effected but that further cuts were expected.

(i) The Clerk advised IPC this confirmed that all COS events taking place on
the parts of Instow Beach leased by IPC from the Crown Estate were covered by
the parish hall insurance or that of the organisers themselves. IPC noted that
the event (open air events) had had to be cancelled because of atrocious

signing the DE lease in such circumstances and asked for further instructions.

requesting that MOD be granted an “interim” licence renewal for period 1.6.08
to 31.12.09 and then a 10 year lease be negotiated subject to IPC successfully
obtaining a further lease from the Crown Estates for the beach post December
2009; the Clerk added that interim costs would be £250 per annum. The Clerk
suggested that this interim lease, if agreed, should be subject to 2 payments,
that is, one in December 2008 and the other in December 2009. (Noted)
(iii) After a discussion IPC RESOLVED to agree to this “interim” lease and to
request payments therein as suggested by the Clerk as at (ii) above. (Action:

(c) Beach Cleaning Grant 2008/9: -
The Clerk advised IPC that following Cllr Cann’s intervention and further
negotiations by himself it had been agreed by NDC that IPC would receive 80%
of the £1,800.00 beach grant 2008/9 immediately and 20% at the end of the
summer season; he confirmed it had been received and banked - see item 1
above. (Noted)
(d) Quay Car Park: -
(i) The Clerk advised IPC he had liaised with the NDC’s Car Parks’ Manager and
formally asked him to have NDC’s Parking Civil Enforcement Officers supervise
parking charges payments in this car park; email of 12.7.08 refers. (Noted)
(ii) The Clerk advised IPC he had spoken to/left messages for season ticket
holders to ensure they were aware of the new “enforcement” arrangements and
that they placed their season tickets in a prominent position inside their
vehicle’s windscreen. (Noted)
(iii) The Clerk told IPC that NDC’s Car Parks Manager had been advised (email
of 12.7.08 refers) of the details of all season ticket holders (and weekly
ticket holders as necessary) for the information of its Civil Enforcement
Officers. (Noted)
(iv) After a discussion it was RESOLVED to ask NDC’s Car Parks’ Department to
provide IPC with details of the number of fixed penalty tickets issued during
the season. (Action: The Clerk)
(e) Audit Commission (AC) Annual Return for the Year ended 31st March 2008 and
associated papers: -
(i) The Clerk reported receipt of a copy letter (dd 25.6.08) from IPC’s IA to
the Audit Commission reference the completion of the above; the Clerk provided
copies to Cllrs at the meeting. (Noted)
(ii) The Clerk said that no parishioners had requested to view the Council’s
financial records/audit papers during the “Inspection” period that was Monday
to Friday (9 am to 5 pm) for period 1st June to the 28th June 2008. (Noted)
(iii) The Clerk confirmed he had taken down the relevant notices (16.7.08) and
retained them for future reference. (Noted)
(f) Damaged Bench – Marine Parade/(Motor Car Accident): -
The Clerk advised IPC this bench had now been repaired satisfactorily and
replaced on Marine Parade at no cost to IPC. (Noted)
(g) Letter (dd 17.6.08) from Knight Frank (KF) reference “Crown Estate –
Devon/Re: Royalty Returns”: -
(i) The Clerk confirmed that following a meeting between him, IPC’s IA and
Cllr Crombie (23.6.08) a letter had been sent to KF setting out IPC’s initial
stance on this emotive issue; he reminded Cllrs he had provided them with a
copy letter with their agenda papers (10.7.08). (Noted)
(ii) The Clerk reported receipt of a response letter (dd 4.7.08) from KF and
which had been forwarded following a telephone conversation with the writer.
The Clerk outlined the crux of the letter. (Noted)
(iii) The Clerk advised IPC that following subsequent telephonic negotiations
between him and KF (who had liaised with the Crown Commissioners) a settlement
sum of £2,000 has been “agreed” subject to ratification by IPC. The Clerk said
if this sum was agreed an invoice would be forward to IPC for payment of the
“agreed” sum (£2,000) and the issue would then be “laid to rest”. The Clerk
said the sum that IPC was most probably in debt to the CC was, without
prejudice, in the region of £5,000 including interest. (Noted)
(iv) After a discussion IPC RESOLVED to accept this settlement figure and
thanked KF and the CC for their consideration and public spiritedness.

(v) The Clerk finalised by saying that KF would, from now on, send a “Moorings
etc” royalty form to IPC each February for the recovery of 50% of income from
mooring fees and similar beach income generating initiatives covering the
financial year in question. (Noted)
(h) Letter (dd 23.6.08) from Metric Group (Car Park Machine Service) reference

The Clerk said this offered quotations for specific “business” cover related
to Local Government Work at Home; he said he had filed it for future

(j) Internal Audit – April to June 2008: -
The Clerk reported that Cllr Crombie had carried out this internal audit
(9.7.08) and found all to be in order. (Noted)
(k) Bank Reconciliation – 1st April 2008 to 30th June 2008: -
The Clerk referred to a copy of this paper circulated to Cllrs at the meeting;
he said the figures had been checked and confirmed by Cllr Crombie (9.7.08).

(i) The Clerk reported he had contacted NDC Planning (email – 20.6.08) to
enquire whether permission for this application (as advised at IPC of 19.6.08)
in effect supeceded previous applications to develop this site or if not, what
other approved applications were still valid. (Noted)
(ii) The Clerk told IPC he had received no acknowledgement to this email (as
requested) so sent a further one on 26.6.08. (Noted)
(iii) The Clerk reported receipt of two acknowledgement emails (dd 27.6.08 and
30.6.08) advising him this matter was “under consideration” by a NDC Planning
Officer. (Noted)
(iv) The Clerk reported receipt of a letter (dd 27.6.08) from NDC Planning

a) Highways Matter – Worlington Hill (Various): -
Cllr May said the drains needed clearing out and the sides planed to cope with
heavy rainfall, there was water rising near the bridge (a spring/blocked
drain?) and that a concrete plinth had been dislodged near the well. IPC
RESOLVED to have the Clerk advise DCC Local Services Superintendent. (Action:

b) Sea Wall – Marine Parade near Commodore Slipway: -
Cllr Harper said there were a number of stones missing/loose at this location
that needed to be repaired. IPC RESOLVED to have the Clerk advise DCC Local

c) Defective Lamppost – Rectory Close: -
Cllr White said one of the new lamps recently installed was not working; it
was situated outside of No. 13. IPC RESOLVED to have the Clerk advise the

It was RESOLVED that the Chairman, Vice Chairman and Clerk take any necessary
action during the August recess of the Parish Council, to canvass Councillors
should the need arise, and should the situation demand it to convene a special
