MINUTES OF THE SEPTEMBER 2008 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON

Present: - Councillors N Crombie, P Cook, M Green, C Harper, G May, S White (Chairman) and Mr R Jacob (Parish Clerk).

2809/1 PRAYER

2809/2 APOLOGIES

2809/3 POLICE REPORT
a) Crime: -
PCSO Cornish reported that 9 crimes had been reported in the parish since the last meeting namely, non-crime domestic incident (x2), false representation – enquiries continuing (x1), Theft (x5) of boat oars, property from doorstep, boat and fuel from cars and criminal damage (x1) – person arrested and charged. (Noted)
b) Other Matters: -
PCSO Cornish also reported that over the same period 15 incident logs had been created for, road related (x3), crime related (x5), anti social behaviour (x2), domestic incident (x2), suspicious activity (x2) and request for contact (x1). (Noted)
c) Crime Prevention: -
PCSO Cornish said he was still continuing to issue vulnerable vehicle forms with the intention of alleviating thefts from unattended vehicles that were now prevalent in the North Devon area. (Noted)
d) Theft of Wheelie Bins – Holmacott: -
Cllr May said he had been advised that a number of these had been stolen in the area of Holmacott; PCSO Cornish said he was unaware but would investigate as soon as possible. (PCSO Cornish)
2809/4 PARISHIONERS
a) Instow In Bloom – Awards: -
(i) Cllr Harper said he was pleased to report that Instow was the only village/town in North Devon to receive a trophy this year in the South West in Bloom Competition; he said it had been awarded the Mary Mortimer Trophy and a Gold Award. (Noted)
(ii) The Chairman asked Cllr Harper to pass on the congratulations of IPC to IIB’s committee; it was also RESOLVED that the Clerk would write to the Chairman of IIB and re-affirm its congratulations. (Action: The Clerk)

2809/5 REPORT COUNTY COUNCILLOR R CANN
a) Cllr Cann spoke about “NDC – In-house Dry Recycling Service” (£264,000.00 saved to date); “Fire Hydrants – Marine Parade” (inspected and now in good working order), “Surface Water – Downs Road Improvements” (works programmed by SWH for early autumn); Speed Limit Extension – Anstey Way (Bideford Direction)” (order signed and funded by ward fund); “Gateway Project” (poor design response – researching possibilities); Instow School Update” (Exeter University Magnetic Field Survey report received – negligible health risk at any of the sites investigated); “Instow Devon Bank Community Restoration Project (Barton Lane – Church)” (funding bid of £3,000 submitted from ward funds – initiative involving DCC, NDCCS, IIB and Instow School); “Proposed Prohibition of Right Turn – Huish Moor Tip“ (to be funded from ward funds), “Outstanding Highways Issues – New Road/Excess Speed” (20 mph speed limit inappropriate); “Toucan Crossing – Marine Parade/Tarka Trail (Signal Box)” (EDG Consultancy’s report does not support this road safety initiative although other options might be suitable – being explored); “Pedestrian Refuges – B3233 Anstey Way” (initial design schemes completed – safety/environmental audit in hand) and “Unitary Council – DCC Option” (£29 million savings in first five years after transition costs repaid/invested in local communities). (Noted)
b) County Debt: -
Cllr May asked what was the current County Debt; Cllr Cann said he was not aware but would make enquiries and report back asap. (Action: Cllr Cann)
c) Charter Toilets – Quay Car Park: -
Cllr Cook asked when these toilets were likely to be built. Cllr Cann confirmed the money to build them had been set aside by NDC and once the objection by DCE had been challenged there was no reason why the build could not commence. (Noted)
d) Highways/Environmental Issues (Various): -
(i) Pothole – Marine Parade/Near Commodore: -
Cllr Harper said this was dangerous and needed repairing. Cllr Cann agreed to take the appropriate action. (Action: Cllr Cann)
(ii) Loose Stones – Seawall near Commodore Slipway: -
Cllr Harper said this had not been attended to despite it being reported at the July meeting of IPC. The Clerk confirmed that DCC Local Services had been told. Cllr Cann agreed to chase it up. (Action: Cllr Cann)
(iii) Tarka Trail – Decrepit Dog Bin (Tunnel between Quay Lane & Signal Box): -
Cllr Harper said this had not been attended to despite it being reported at the July meeting of IPC. Cllr Cann agreed to chase it up. (Action: Cllr Cann)
(iv) Loose Boat Trailer – Beach near Commodore Slipway: -
Cllr Harper said this was a potential hazard. IPC RESOLVED to have the Clerk make enquiries and take any action as appropriate. (Action: The Clerk)
(v) Lampposts – Repainting: -
Cllr Harper said the lampposts on Marine Parade needed repainting. Cllr Cann agreed to take the appropriate action. (Action: Cllr Cann)

2809/6 REPORT OF DISTRICT COUNCILLOR B MOORES
Cllr Moores spoke of “Local Council Review” (deadline for response to Boundary Committee 26th September 2008); “Concessionary Fare Scheme” (concerns raised about cost – to be monitored); “Environment Health and Housing Service” (has been granted Charter Mark Award); “NDC P.A.N.D.A. (Play Activity in North Devon Area)” (secured £200k from national lottery); “Community Cllr Grant Scheme” (grant of £320 awarded to Instow Parish Hall and Management Committee to upgrade hall for disabled users); “Instow County Primary School Update” (see item 2807/6 (a) above) and “Sands Development – Marine Parade” (appeal lodged by owners – some parishioners have raised concern about current appearance). (Noted)

2809/7 MINUTES
It was RESOLVED that the July 2008 minutes of Instow Parish Council be approved and signed. (Noted)

2809/8 MATTERS ARISING FROM THE MINUTES
a) Item 2807/5 (c) - Fire Hydrants/Marine Parade: -
(i) The Clerk advised IPC that Cllr Cann had liaised (emails of 26.7.08 and 29.7.08 refer) with Devon and Somerset Fire and Rescue Services and arranged for the Marine Parade hydrants to be cleaned at the earliest opportunity; they had previously been assessed to require three-year inspections (next one November 2008) but in light of the recent problems faced the frequency of inspections would be revised. (Noted)
(ii) The Clerk referred to an email (dd 3.9.08) from Cllr Cann confirming that the hydrants had been inspected and they were all now in good working order. (Noted)
b) Item 2807/8 (a) - IPC – Cllr Vacancies: -
(i) The Clerk confirmed he had again placed notices on all parish council notice boards (18.7.08) and on the Instow Website (IPC Pages) with a closing date of 25th August 2008. (Noted)
(ii) The Clerk told IPC that 4 persons had applied for the post of parish councillor at Instow and that interviews had taken place at the parish hall on Tuesday 2nd September; one candidate withdrew before the interviews (personal reasons). He said the interviewing panel consisted of Cllr White (Chairman), Cllr Green (Vice Chairman) and Cllr Crombie; the Clerk was also present. (Noted)
(iii) The Clerk suggested that the report/recommendations of the interviewing panel could be discussed at this point of the meeting or at the end of the meeting when standing order number 62 could be invoked. (Noted)
(iv) After a discussion IPC RESOLVED to defer this matter until the conclusion of the meeting on the basis of its confidentiality at which time standing order 62 could be invoked. (Noted)
c) Item 2807/8 (c) – Bottle Bank/Quay Car Park (Insurance/Lighting): -
(i) The Clerk reported he had finally received confirmation from NDC (email of 11.9.08 refers), following much prompting, that NDC would be liable for any insurance claims in respect of the car park and bottle bank but that a review was to take place before 2009 when the agreement between NDC and IPC was drawn up as regards use of the car park/bottle bank. (Noted)
(ii) The Clerk suggested that IPC ought to consider the likely outcomes here and take appropriate proactive action to alleviate the possibility of IPC being “deemed” liable as part of the revised lease conditions and thereby increase the cost. IPC RESOLVED to accept this recommendation which should be considered further by IPC’s FSC when considering the budget 2009/10. (Action: The Clerk/IPC’s FSC)
(iii) The Clerk advised IPC of further problems with the car park security light; it had been reported defective by a parishioner on 10.9.08. He said he had, as a result, contacted NDC’s Car Park’s Dept who had agreed to get it seen to. The Clerk reminded IPC that this light had been defective from at least November 2007 to late April/early May 2008; it had blown the fuse in the car park machine. (Noted)
d) Item 2807/8 (d) – IPC’s Self Help Emergency Plan Update: -
(i) Cllr Harper reported on progress of the updated plan; he said the take up of parishioners had been poor but that in any event he would now prepare a draft amended plan for the consideration of adoption by IPC. (Action: Cllr Harper)
(ii) The Clerk advised IPC of the situation regarding public liability insurance implications; namely, Cllrs were covered by IPC’s public liability insurance but there was a grey area where volunteers were concerned. He added this was a national problem that DCC Emergency Planning Officer (EPO) was considering with appropriate government bodies. (Noted)
(iii) The Clerk confirmed that a copy of various emails exchanged between the Clerk and DCC’s EPO had been forwarded to Cllrs with their summer recess memorandum (20.8.08). (Noted)
(iv) The Clerk suggested that IPC place this issue on the “back burner” for the time being until guidance was received from DCC’s EPO/Government. IPC RESOLVED to adopt this recommendation. (Noted)
(v) Cllr Harper then referred to some research he had done on the internet as regards “Parish Councils – Litigation”. (Noted)
f) Item 2807/8 (f) – Instow Ransom Strip/Wetland Project: -
(i) The Clerk updated IPC from an email (dd 3.8.08) he had received regarding an informal meeting the IIB representative had had with the landowner which appeared promising. (Noted)
(ii) The Clerk then advised IPC that this project was now deemed a non-starter; the Clerk read the contents of an email from the IIB representative (dd 29.8.08) following a letter she had received from the landowner’s agent. (Noted)
g) Item 2807/8 (g) – Roundhouse, Instow Recreation Ground/Picnic Site: -
(i) The Clerk advised IPC he had received a copy letter (dd 18.7.08) from Wings to NDCCS with attachments (plans and copy photographs) requesting that a formal handover of the cob house from Wings to NDCCS take place with legal/insurance liabilities thereafter being “taken over” by NDCCS. (Noted)
(ii) The Clerk advised IPC of the position as of the date of the meeting i.e. NDCCS had now taken over responsibility for the cob house including third party insurance that covered public liability but not damage to the cob house – emails of 20.8.08 refer and letter (dd 20.8.08) from NDCCS to Wings and copied to IPC. The Clerk read it to IPC. (Noted)



j) Item 2806/9 (j) – Standing Order Review:-
(i) The Clerk advised IPC that following liaison between himself and Cllr Harper a draft amended copy of standing orders had been circulated to Cllrs with their agenda papers (11.9.08) for perusal. (Noted)
(ii) After a discussion IPC RESOLVED to adopt it. (Action: The Clerk)

2809/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
a) Letter (dd 18.7.08) from NDC (Licensing) reference “House to House Collection (Clothing) – African Orphans UK (AOUK); 1.9.08 to 30.9.08”: -
(i) The Clerk said this stated that AOUK had authorised Fortune International Ltd of Bedford to act as its collectors and who would pay a guaranteed royalty of £2,000 per month to AOUK from proceeds of the clothing collection. The amount of £2,000 had been agreed as 85% of the estimated profit made from clothing collections (derived from historical data reviewed annually). (Noted)
(ii) The Clerk advised IPC he had told NDC (Licensing – 7.8.08) that although IPC was not in a position to object to this application as per House to House Act 1939 it would not be happy for this form of collection taking place within its parish on the basis not all income derived was going to the applicant, a UK charity, and that it believed a “fear of crime” emanated from this form of door to door collection in a parish where there were a considerable number of elderly parishioners. (Noted)
(iii) IPC RESOLVED to ratify action as at (ii) above. (Noted)
b) Letter (dd 23.7.08) from NDC reference “House to House Act 1939:Clothes Aid; 2.8.08 to 9.2.09”: -
(i) The Clerk advised IPC he had told NDC (Licensing – 7.8.08) that although IPC offered no objection to this application it would be concerned that a “fear of crime” emanated from this form of door to door collection in a parish where there were a considerable number of elderly parishioners. (Noted)
(ii) IPC RESOLVED to ratify action as at (i) above. (Noted)
c) Letter (dd 1.8.08) from NDC reference “North Devon Web Survey”: -
(i) The Clerk said this stated that NDC was running a survey inviting web users to give their opinion on the services and information provided by the council’s website www.northdevon.gov.uk (Noted)
(ii) The Clerk said he had copied the letter and survey form to Cllrs with their summer recess memorandum (20.8.08) with replies to be collated by him and survey forms returned to NDC by 1.9.08. (Noted)
(iii) The Clerk told IPC he had forwarded a suitable reply (6.9.08). (Noted)
d) Complaint from parishioner (1.8.08) reference “Mud on Beach - Dredging at Appledore Shipyard”: -
(i) The Clerk said this stated that regular recent dredging near Appledore Shipyard (2 hours before and after high tide) had apparently caused a great deal of mud to settle on Instow beach (near Quay/Commodore Slipway and near Yacht Club). (Noted)
(ii) The Clerk said he had passed the information to the Chairman of the TTEF for suitable action to be taken. (Noted)
(iii) The Clerk reported receipt of an email (dd 5.8.08) from Natural England (Cornwall, Devon and Isles of Scilly Team) requesting further information on this issue; it had been provided. (Noted)
(iv) The Clerk reported receipt of an email (dd 13.8.08) from the Chairman of the TTEF containing a response she had received from the Environment Agency; the Clerk read it to Council. (Noted)
(v) The Clerk reported receipt of an email (dd 14.8.08) from the Chairman of the TTEF containing a response she had received from Natural England; the Clerk outlined this to Council. (Noted)
(vi) The Clerk reported receipt of an email (dd 18.9.08) from a parishioner reference “Dredging – Appledore”; the Clerk said this stated that dredging was still continuing and had been evidenced as recently as 17.9.08. He said he had passed on the information to the Chairman of the TTEF. (Noted)



e) Letter (dd 8.8.08) and attachment from NDC reference “Local Government Reviews”: -
(i) The Clerk said this stated that NDC was gauging opinion as to how well IPC felt it had been consulted by DCC, NDC and Boundary Committee reference above. (Noted)
(ii) He said the letter and attachment had been forwarded to Cllrs with their agenda papers (20.8.08). (Noted)
(iii) The Clerk advised IPC he had forwarded a suitable response (6.9.08). (Noted)
f) Email (dd 4.8.08 from Department for Culture Media and Sport (Licensing and Tourism Team) reference “Minor Variations and DPS Community Premises Consolations – Licensing Act 2003: Consultation”: -
(i) The Clerk said this stated the government was consulting on proposed amendments to this act, that is, to introduce a new process for making minor variations to premises licences and club premises certificates and remove the requirement for a Designated Premises Supervisor (DPS) and personal licence for community premises – closing date 1st September 2008. (Noted)
(ii) The Clerk advised IPC he had forwarded the email (4.8.08) to all IPC Cllrs with email addresses and the Acting Chairman of Instow Parish Hall Committee for perusal and comments. (Noted)
(iii) The Clerk told IPC he had received a Nil Return from Cllrs and Parish Hall Committee so no response had been sent. (Noted)
g) Email (dd 11.8.08) from Chairman of TTEF reference “Bathing Water Data (11.8.08) – Westward Ho!, Instow and Saunton”: -
(i) The Clerk said this stated that Instow had sadly failed the bathing water imperative standard for the year following a second failure on 1st August; results attached to email. He added that information was awaited as regards a possible abnormal weather waiver or whether the failure was due to diffuse pollution coming downriver or to the combined storm overflow in Instow. (Noted)
(ii) The Clerk reminded Cllrs he had copied the email to them with their summer recess memorandum (20.8.08) for information. (Noted)
(iii) The Clerk reported receipt of an email (dd 11.9.08) from the Chairman of the TTEF reference “Bathing Water Results – 11th September 2008”; it stated that not all analysis for the season was complete and there was a slight possibility of a blanket derogation of failing samples due to unusual summer weather. (Noted)
h) Letter (dd 11.8.08) from North Devon’s Biosphere Reserve (NDBR) reference “Our Strategy and Action Plan 2008 – 2012”: -
(i) The Clerk said this invited IPC to consider what role it might play in delivering the NDBR’s 5-year Action Plan and how it might use the NDBR to meet its own objectives, including the development and support of innovative projects. (Noted)
(ii) The Clerk reminded Cllrs he had copied the email to them with their summer recess memorandum (20.8.08) and that the Strategy/Action Plan was available at the meeting for perusal as necessary. (Noted)
(iii) After discussion IPC RESOLVED to take no further action. (Noted)
i) Email (dd 18,8.08) and attachments from DAPC reference “Councillors Indemnity – Code of Conduct”: -
(i) The Clerk said that with the advent of Part 10 of the Local Government and Public Involvement in Health Act, which amended Part 3 of the Local Government Act 2000, NALC was seeking the views of parish councils as regards “Local Determination over a National One”, “Sufficient Information received as regards New Determination” and “Is there any interest in Indemnifying Members from Legal Costs”. He said responses were required by DAPC (26.9.08) and NALC 30.9.08). (Noted)
(ii) The Clerk reminded Cllrs he had copied the email to those Cllrs with email addresses and had also forwarded a copy with their summer recess memorandum (20.8.08). (Noted)
(iii) After a discussion IPC RESOLVED to respond as follows: “Don’t know”, “No” and “Interested in Indemnification”. (Action: The Clerk)
j) Email (dd 18.8.08) from a visitor reference “Instow – Dogs on Beach”: -
(i) The Clerk advised IPC of the content of the email and of the action he had taken, that is, liaise with Cllr Cann and NDC’s Environmental Health Dept (EHD) (emails of 19/20.8.08 refers). (Noted)
(ii) The Clerk advised IPC of the content of an email (dd 21.8.08) he had received from NDC EHD reference “ownership of beach” and the implications of this. The Clerk updated IPC on progress since that date. (Noted)
(iii) The Clerk said he was to meet the agent of the Crown Commissioners on 23.9.08 and would discuss the ownership of the various parts of Instow Sands; the Chairman agreed to attend with him. (Action: Chairman Clerk)
(ii) The Clerk said this complaint was one of a number he had received during the summer season and that the EHD of NDC had assured him that the dog wardens had regularly attended (and would continue to attend) the area. (Noted)
k) Letter (dd 14.8.08) and attachments from DCC (External Affairs) reference “Draft Proposals for Unitary Government Arrangements in Devon”: -
(i) The Clerk said this letter from the Leader of DCC had been forwarded by post (22.8.08) to IPC Cllrs; the booklet entitled “Your Questions Answered” and leaflet entitled “A Stronger Voice for Devon” had been passed to the Chairman of IPC to circulate amongst Cllr colleagues with other copies being left at the post office for the information of parishioners. (ii) The Clerk referred to an email (dd 2.9.08) from DCC (Chief Executive) and a letter (dd 2.9.08) reference “Parish and Town Council Updates – Meetings”; he said the email had been copied on to Cllrs with email addresses (2.9.08) and a copy of the letter had been provided to all Cllrs with their agenda papers (11.9.08). (iii) The Clerk referred to an email (dd 12.9.08) reference “Single Unitary – Could Save Millions”; he said he had copied it to Cllrs with email addresses. (Noted)
l) Letter (dd 21.8.08) and attachment (Pamphlet entitled “Stand Up for North Devon”) from NDC (Chief Executive) reference “Local Government Review”: -
(i) The Clerk reminded Cllrs he had copied this email together with a pamphlet to all Cllrs with their agenda papers (11.9.08) and that a copy had also been left at the post office for the information of parishioners. (Noted)
(ii) The Clerk reported receipt of a letter (dd 3.9.08) and posters from NDC (Chief Executive) reference “Local Government Review”; he said the posters had been placed by him on all parish notice boards as requested and a copy provided to Cllrs with their agenda papers (11.9.08). (Noted)
m)“Draft Paper (received 10.9.08) from DAPC reference “Response to Boundary Committee’s Draft Proposals for Devon 2008”: -
The Clerk reminded Cllrs he had copied this draft paper to them with their agenda papers (11.9.08). (Noted)
n) Letter (dd 21.8.08) from PPS reference “Fullabrook Wind Farm Community Interest Company (CIC)”: -
(i) The Clerk said this stated that a meeting was to be held at Braunton Parish Hall at 7 pm on Thursday 9th October and that a representative of IPC was invited to attend; meeting is to discuss the formation of the CIC etc. (Noted)
(ii) The Clerk reminded Cllrs he had copied the letter to them with their agenda papers (11.9.08). (Noted)

(iv) Cllr May enquired of Cllr Cann as to the state of potential plans for wind turbines within the Bickington/Fremington area. Cllr Cann said he was aware of an enquiry and would report back with more detail in due course. (Action: Cllr Cann)
o) Letter (dd 27.8.08) from NDC (Licensing Dept) reference “House to House Act 1939: PDSA and Beechwood Boarding Kennels”; Monday 6th October to Sunday 19th October 2008:
The Clerk advised IPC that because the application had been made by a bone fide charity he had notified NDC that IPC would have no objection; IPC RESOLVED to ratify this decision. (Noted)
p) Letter (received 30.8.08) from Digital TV reference “Digital TV – Westcountry Switchover”: -
(i) The Clerk said the writer offered information regarding the switchover to digital TV (July 2009) and would address IPC at a later date if required. (Noted)
(ii) The Clerk reminded Cllrs he had copied the letter to them with their agenda papers (11.9.08). (Noted)
(iii) After a discussion IPC RESOLVED to take no further action. (Noted)
q) Email (dd 1.9.08) from BT via DAPC reference “BT’s Proposals – Re-align Payphone Provision” : -
The Clerk explained the context of the email i.e. adopt a red kiosk (not applicable to Instow) and sponsored kiosk programme. (Noted)
r) DAPC Quality Parish Councils Conference entitled “Throwing Light on the Role of Town and Parish Councils in Devon – Outcomes and Actions and Lifelong Learning Network”: -
The Clerk advised IPC he had attended this conference, by invitation that had been held at Newton Abbot Racecourse on Thursday 11th September; the Clerk provided IPC with an update and distributed a copy of the relevant report for perusal. (Noted)

The Clerk told IPC that this confirmed IPC was in balance and owed nothing. (Noted)
(b) Use of Instow Sands – Atturm: -
(i) The Clerk advised IPC that an interim licence (1.6.08 to 31.12.09) has been received (17.9.08) for signature and that it had been provisionally checked by Cllr Crombie; Cllr Crombie spoke to it. (Noted)
(iii) After a discussion IPC RESOLVED to accept the terms of the lease that was signed by Cllr Crombie and the Clerk. (Noted)
(c) Beach Cleaning Grant 2008: -
(i) The Clerk advised IPC that at the end of the month it would be possible to claim the remaining 20% of the NDC Beach Grant; he would take the appropriate action.(Noted)
(d) Quay Car Park: -
The Clerk advised IPC that NDC had confirmed that its Civil Parking Attendants had visited the car park on several occasions throughout the summer period but that to date no parking tickets had been issued. (Noted)
(e) Letter (dd 21.7.08) from Nationwide reference “Action Required on Account No 0015783626: Instow Allotments and Recreation Ground Account”: -
(i) The Clerk said this letter stated that the Nationwide could not continue to support this kind of account type and that an alternative arrangement needed to be made. As an alternative option the Nationwide offered a Treasurer’s Trust account which might suit IPC’s needs. (Noted)
(ii) The Clerk said that following a discussion with the Chairman, he arranged for the necessary paperwork to be completed and handed in at the Barnstaple branch of Nationwide; receipt obtained for paperwork/passbook handed over. (Noted)
(iii) The Clerk reported receipt of a letter (dd 13.8.08) from the Nationwide confirming receipt of IPC’s application for a Treasurer’s account; it also confirmed that the former Portman account 15783626 would be closed and the closing balance transferred to the new account; when this was been done IPC would be notified of new account number, balance and how a new passbook could be obtained. (j) Letter (dd August 2008) from DAPC reference “Proposed Subscription Rates 2009-2010”: -
(i) The Clerk said this stated that the proposed subscriptions had been worked out on the basis of a recommended increase of 4.5%; this was a percentage that NALC was working towards and reflected current inflationary figures. He said this increase would allow the DAPC a fully balanced budget with modest contingency assuming no increase in officer support or other major costs adding that IPC’s proposed subscription rate was £139 (currently £133 for 2008/9). (Noted)
(ii) After discussion IPC RESOLVED to accept this increases on the basic that DAPC was extremely good value for money. (Noted)
(j) DCC – Grass Cutting Grant 2008 Application: -
The Clerk confirmed he had applied for this grant (email/invoice dd 4.9.08 refers) and that a cheque for £745.08 had been received (13.9.08) - see item 1 above. (Noted)
(k) Grass Cutting Tender 2009/2011: -
(i) The Clerk confirmed he had arranged for the necessary advertisement to be placed in the North Devon Journal (4.9.08) and that 4 contractors had applied for details; closing date 18th September 2008. (Noted)
(ii) The Clerk told IPC that 3 out of the 4 contractors had actually put in a tender and suggested that said applications were considered by IPC’s Finance Sub Committee when it met in mid-late October to put together IPC’s Draft Budget 2009/2010 and which was then ratified at the November meeting of IPC. (Noted)
(iii) After a discussion IPC RESOLVED to adopt this recommendation. (Noted)
(l) IPC Grant to Instow Parochial Church Council 2008/9: -
(i) The Clerk advised IPC that Cllr Cann was to provide Instow PCC with a DCC grant to suitably reinstate the wall to the graveyard near the Lytch Gate – see item ??(Noted)
(ii) The Clerk added that a request had been made by the PCC for some financial assistance from IPC, in addition to its annual grant (already agreed), to reinstate the sloping pathway within the proximity of the Lytch Gate (and that runs up to the graveyard) and which was currently dangerous because of weeds and exposed tree roots; it was a health and safety hazard. (Noted)
(iii) The Clerk advised IPC it was estimated it would cost Instow PCC somewhere in the region of £270 to pay for the necessary work to be done (i.e. grinding out of exposed tree roots, path reinstatement etc) and the Clerk, who had liaised with the Chairman, suggest that the annual IPC grant 2008/9 to Instow PCC be increased by this sum to cover said costs i.e. £830 to £1100.00. (Noted)
(iv) After a discussion IPC RESOLVED to adopt this recommendation. (Noted)
(m) Instow Recreation Ground (IRG)– Cabinet Office/Office of Third World Sector Survey”: -
(i) The Clerk said this letter stated that a survey was being conducted by MORI for the Cabinet Office within third sector organisations; local decision makers would learn from, and be judged by, the detailed picture that emerged and the survey would shape policy decisions at the local and national level aimed at helping organisations like IRG. The results of the survey will be published. (Noted)
(ii) After a discussion IPC RESOLVED to complete the survey, once received, but only if it was going to be of value to IPC/IRG. (Action: The Clerk)
(n) Audit Commission - Annual Return for the Year ended 31st March 2008: -
(i) The Clerk reported receipt of a letter (dd 12.9.08) from the Audit Commission together with the Certified Annual Return for the financial year ending 31st March 2008. The Clerk advised Cllrs that the External Auditors Certificate and Opinion (Section 3) stated, “on the basis of our review, in our opinion the information contained in the annual return is in accordance with the Audit Commissioner’s requirements and no matters have come to our attention giving cause for concern that relevant legislation and regulatory requirements have not been met”. (Noted)
(ii) The Clerk further reported that no other matters, not affecting the opinion of the Audit Commission, had been drawn to the attention of Council and that he had copied all correspondence to Mr G Day (IPC’s IA) and thanked him for his work and support in performing the internal audit process. (iii) The Clerk said that “Notice of Conclusion of Audit and Right to Inspect the Annual Return for the year ending 31st March 2008” form would be displayed asap on IPC’s notice board at the Post Office for a 14 day period together with a copy of the audit report. (Action: The Clerk)

a) Erection of single storey extension to provide additional 6 units of accommodation at The Meadows, Anstey Way, Instow (Reference No 46320)”: -
(i) The Clerk reported receipt of a letter (dd 18.7.08) from NDC Planning reference above and an email sent by him to NDC Planning (20.6.08). He said the letter confirmed that as far as writer was aware, the only outstanding and implementable consent at The Meadows was the above planning application that had recently been approved. The writer also enclosed a copy of the planning history for IPC’s information. (Noted)
(ii) The Clerk confirmed he had forwarded a copy of the letter and planning history to Cllrs with their summer recess memorandum (20.8.08). (Noted)
b) “Yelland Quay/Tipping of Waste - Bideford College” (see item 2807/9 (i) e)) : -
(i) The Clerk referred to an email from DCC Planning (dd 22.7.08) to Chairman of TTEF (and copied to Clerk 22.7.08); he said it stated that a site visit had taken place (21.7.08) and that legal advice was being sought as to whether any enforcement action could be taken. He said he had copied the email to Cllrs with their summer recess memorandum (20.8.08). (Noted)
(ii) The Clerk then referred to an email (dd 6.8.08) from DCC Planning to Cllr Cann; it stated “a stop notice is being issued to prevent any further waste material being taken on to the ash bed site until a licence has been issued by Natural England to close the badger sett and/or a restoration plan has been approved for the site. Inert waste and soils (including those from Bideford College) can still be taken into the transfer station and next Tuesday (12.8.08) DCC Planning is to meet on site with Nott’s Contractors regarding a restoration plan”. (i) The Clerk reported that Cllr Harper had heard of this application “through the grapevine” and as a result visited the Offices of TDC where confirmation was received; he advised the Clerk. (Noted)
(ii) The Clerk reported that he contacted TDC Planning (1.8.08) and was told that TDC did not consult neighbouring parishes and that information could be found on its website vide www.torrideg.gov.uk (Noted)
(iii) The Clerk said he visited TDC’s website and placed a holding comment thereon so that IPC’s PSC would have time to consider the application. (Noted)
(iv) The Clerk then reported receipt of an email (1.8.08) from TDC Planning stating that IPC would not be afforded extra time to consider its response (determination was expected shortly) and as Instow was not within TDC’s area had not been consulted; it added that information on the application had however, been placed in the ND Journal and on TDC’s website. (v) The Clerk reported he then replied (email 1.8.08) to the effect that Instow had hitherto been consulted on “neighbouring” matters (e.g. re-cladding of Appledore Quay Wall) and that not to do so was felt by IPC to be short-sighted and disrespectful especially as the impact of the bell in question would, from a noise point of view, impact on Instow perhaps more than Appledore. (vi) The Clerk said he then circulated details to members of IPC’s PSC by email (1.8.08) and to Chairman of TTEF. (Noted)
(vii) The Clerk reported that following responses from IPC’s PSC (and a conversation with the Chairman) he had advised TDC (by email 4.8.08) that, to quote, “IPC recommends REFUSAL of this application on the grounds of noise nuisance (in the absence of evidence to prove to the contrary). It would also wish TDC to note that it regrets that TDC did not see fit to specifically consult with IPC, an adjoining parish, and a community which is going to be directly affected by this bell. This decision of TDC (not to consult IPC directly) is seen by IPC as being very short-sighted and disrespectful and not in keeping with similar applications where IPC has been consulted officially as a "neighbouring parish". I cite here the example of the refurbishment (re-cladding) of the Appledore Quay Wall”. (Noted)

(i) IPC discussed this matter and RESOLVED to co-opt Mrs Tracy Dipper and Mr Ben Thomas on to Instow Parish Council. (Action: The Clerk)
(ii) In doing so IPC unanimously RESOLVED that the unsuccessful candidate should be sincerely thanked for putting himself forward for consideration of co- option particularly as he had proven himself to be eminently suitable to be a parish councillor; it was noted that all candidates had all been subjected to a thorough and structured interview as part of the selection process.
