MINUTES OF THE JUNE 2006 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 15th JUNE 2006 - 7.30pm

Present: - Councillors P Cook, N Crombie, M Green, C Harper, A Johns (Chairman), Ms A Mayoh, F Scott, S White and Mr R Jacob (Parish Clerk).

In Attendance: Cllr R Cann (DCC/NDDC), Cllr Mrs L Brown (NNDC) and 3 parishioners.

The Clerk led the Council in prayer

2606/2 APOLOGIES
There were no apologies.

2606/3 POLICE REPORT
(i) In the absence of PC Benbow/PCSO Charles (no apologies tendered) there was no police report. (Noted)
(ii) The Clerk told Council he understood, though the “grape vine”, that PC Benbow was soon to retire and was currently on annual leave. He added he was also led to believe that another PCSO, other than PCSO Charles, had attended a recent Fremington Parish Council meeting which presumably meant that PCSO Charles had been assigned elsewhere. The Clerk said he would take steps to ascertain what policing provision was now in place for Instow. (Action: The Clerk)

2606/4 PARISHIONERS

2606/5 REPORT COUNTY COUNCILLOR R CANN
a) General: - Cllr Cann spoke on “Art Feature – Western Bypass Roundabout/Downstream Bridge” (12 groups of Delabole stone – budgeted at 90K but likely to cost in excess of 120K), Ransom Strip Consultation (draft proforma had been prepared for consideration by IPC), Handyperson Scheme (an initiative between NDDC, DCC and seven other District Councils in Devon – to reduce accidents in the home), Holmacott Landfill Site – Retrospective application for Lighting Scheme (dealt with by NDDC’s Planning Officer), Missing Litter Bin – Anstey Way Lay-by (had been returned to manufacturer for repainting), Toilet Fire – Marine Parade Car Park (smoke and scorch damage – police notified), Instow New School Update (meeting held in May to review all evidence; County Solicitor has advised that correct procedures/formalities have been followed. Landowners have been asked what land they have offered in the past and DCC is to carry out an option appraisal of all sites previously considered – ready by end of current term) and Alleged Unauthorised Signs – The Bar (DCC had been advised by “owner(s)” they can prove the land, where the signs are, belongs to it – this is being reviewed. The “owner” has also applied for retrospective consent). (Noted)
b) Visitor Information Signs: - Cllr White asked if signs (not brown tourist signs) could be placed at each end of the village showing all premises of interest within the parish such as pubs, shops etc. Cllr Cann said he would look into this and report back. (Action: Cllr Cann)
c) Charter Toilets – Quay Car Park: - In answer to a question from Cllr Cook, Cllr Cann said he was still chasing the Chief Executive and Leader of NDDC for an answer to this long standing issue. After a discussion IPC RESOLVED to write a strong letter to NDDC’ Chief Executive (copies to Cllrs Cann and Mrs L Brown) and express its dismay at the time this issue was taking. (Action: The Clerk)
d) DCC Funds – Community Projects: - Cllr Cann said that DCC had agreed to allocate a sum of money to each District Committee for allocation in its area as it saw fit. North Devon’s Committee had yet to form a view on this initiative, that is criteria for allocation for example, but that a suitable “community project” seemed the most likely recipient. Cllr Cann suggested that IPC give this some thought in the meantime. (Noted)

2606/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
a) General: - Cllr Mrs L Brown spoke of NDDC’s Plans to scrap late night Parking Charges, Toilets: Additional Cleaning, Street Sweeping: Additional Cleaning (an additional 90K to be spent), Waste (recycled/composted over 1/3rd domestic refuse exceeding target of 30%), NDDC Landlords (need for multi occupancy housing to register), Moorings - Castle Quay (almost 90k {DCC/NDDC} invested in new facilities at waterfront), Fremington Quay (NDDC at early stages of investigating the possibility of developing this as a leisure quay), North Devon Direct (Summer Edition) (recently delivered to all homes), North Devon Museum (Surfs Up Exhibition), Grant Funding (cuts have had to be made for the current year but free advice is given to applicants as to where else to apply), Barnstaple Bypass – Downstream Bridge (webcam etc), North Devon Local Plan `1995 – 2011/Adoption and Clerk Vacancy – Lovacott, Horwood and Newton Tracey. (Noted)
b) Toilet Cleaning: - In answer to a statement from Cllr Harper to the effect that the toilets in the village were badly maintained/cleaned, Cllr Mrs L Brown said she would take this up with the relevant NDDC department and report back at the next meeting. Cllr Harper cited recent incidents of relevance to this issue at both sets of toilets within the village. (Action: Cllr Mrs L Brown)

2606/7 MINUTES
It was RESOLVED that the May 2006 minutes of Instow Parish Council be approved and signed. (Noted)

2606/8 MATTERS ARISING FROM THE MINUTES
a) Item 2605/10 (a) – Sandhills Ransom Strip: - (i) Cllr Cann and the Clerk updated IPC on progress since the last meeting i.e. a draft questionnaire had been produced by the Clerk (with Cllr Cann and County Hall support) and was tabled at the meeting for discussion. Cllr Cann said DCC/NDDC was prepared to assist this project in both financial and administrative terms. (Noted)
(ii) After a lengthy discussion it was RESOLVED to reconvene the Ransom Strip Steering Group to consider the draft proforma and report back to the next IPC meeting. (Action: Ransom Strip Steering Group)
b) Item 2605/10 (d) - Instow, Westleigh and West Yelland Village Show 2006: - (i) Cllr Crombie reported to IPC on his findings as regards insurance cover for those events to be held on the parts of Instow beach as “leased” by IPC from Crown Commissioners having liaised with the show committee. He said it was still not “evidenced” that all events were covered and after a discussion IPC RESOLVED to communicate a message to the Chairman of the show committee to the effect that if “evidence” was not forthcoming by 1st July then IPC would seriously consider withdrawing its permission to use the beach. (Action: The Clerk)
(ii) The Clerk reported receipt of an email (dd 5.6.06) and attachments from DCC Local Services, Barnstaple reference “Road Closure, Quay Lane, Instow – 22nd July 2006”. He said this had been requested by the show committee and that IPC had not opposed it. (Noted)
c) Item 2605/10 (h) – “Illegal” Signage/The Bar: - The Clerk provided an update to IPC on his enquiries with NDDC Planning. He said the Planning Officer was progressing the issue. (Noted)

d) Item 2605/11 (i) (a) – Local Authority By Laws in England – ODPM: - The Clerk asked if IPC had any observations/recommendations following Cllrs review of the papers since the last meeting – there were none. (Noted)
e) Item 2605/11 (i) (b) - IPC Appointments Review 2006: - The Clerk reminded Cllrs he had copied this to Cllrs with their agenda papers (8.6.06); IPC RESOLVED to confirm the document as printed. (Noted)
f) Item 2605/11 (i) (c) – Instow Quay/Traffic Congestion/Speed: - (i) The Clerk briefed IPC on his liaison with Cllr Cann/DCC Local Services Group; he referred to an email (dd 23.5.06) from DCC LSG to Cllr Cann in which they said there was little they could do in the area (they had no evidence for example to support a danger to motorists, pedestrians i.e. no reported accidents) but that a feasibility study could be done by them if IPC was prepared to pay approximately £500. (Noted)
(ii) The Chairman and Clerk referred to conversations they had recently had with the parishioner who had originally raised the issue and it was not her wish that any further action be taken. IPC RESOLVED, in the circumstances, to take no further action other than to monitor the situation. (Noted)
(iii) The Clerk referred to an email (dd 24.5.06) from DCE to DCC LSG (copied to IPC) reference “Instow: Parking Disruption”. The Clerk briefed IPC on the content of the email and attachments. (Noted)

2606/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
a) Letter (dd 17.5.06) from Cllr Ricky Knight reference “Dispute between DCE and Chalet Owner – Instow Sand Dunes”: - The Clerk reminded Cllrs that each had been provided with a copy of the letter with their agenda papers (8.6.06). After discussion it was RESOLVED to write to Cllr Knight and advise him that whilst IPC sympathised with the predicament of the chalet owner it was a civil matter and that IPC, as a consequence, had no jurisdiction. (Action: The Clerk)
b) Letter (undated – received 22.6.06) from Charter 88 (Campaign for a Modern and Fair Democracy) reference “Community Decline and Charter 88’s Campaign for a Modern Democracy – Empowering Citizens and Local Councils”: - The Clerk reminded Cllrs that each had been provided with a copy of the letter with their agenda papers (8.6.06). After a discussion IPC RESOLVED to take no further action. (Noted) c) (i) Email (dd 1.6.06) from Environment Agency reference “Water Quality Tests”: - The Clerk said that this stated that tests at Instow for 3/5/06, 7/5/06 and 16/5/06 were “Excellent” but that the test for the 23/5/06 was “Poor”; IPC noted that this was a period of bad weather with heavy rain and undoubtedly the “run off” from fields was the cause. (Noted)
(ii) Email (dd 8.6.06) from EA reference “Water Quality Tests”: - The Clerk said this stated that the test for 1/6/06 was “Excellent”. (Noted)
(iii) Email (dd 15.6.06) from EA reference “Water Quality Tests”: - The Clerk said this stated that the test for the 8/6/06 was “Good”. (Noted)
(iv) Unfavourable Publicity – Instow: - It was noted by IPC that Instow was singled out by the press, yet again (Saturday 10th June), presumably because of the “Poor” result of 23/5/06. After a discussion IPC RESOLVED to take this up with the appropriate authority and the Clerk was asked to investigate. (Action: The Clerk)
d) Letter (dd 1.6.06) from Devon and Cornwall Police Authority reference “Police Authority Liaison Meeting – North Devon (Barnstaple Sector) – Civic Centre, Barnstaple at 7.30 pm on Friday 23rd June 2006”: - The Clerk told IPC he had placed a copy of the poster at the post office for the information of parishioners; he reminded Cllrs he had circulated a copy of the letter to them with their agenda papers particularly Cllr Ms A Mayoh (IPC’s Police Liaison Cllr). (Noted)
e) Letter (dd 1.6.06) from RCS (a Balfour Beatty Company) reference “Highway Parish Forum 19th/26th June 2006: - The Clerk said RCS was preparing a tender for DCC for the maintenance of roads throughout the county and invited representatives of parish councils to attend a forum (at two locations, Exeter {19th June – 7 pm} and Barnstaple {26th June – 7 pm}) to discuss highways issues of concern to them and which RCS might then include in their bid to DCC. He said any replies were required by Friday 9th June with the venues of the meetings to be revealed later. After discussion IPC RESOLVED to take no further action. (Noted)
f) Letter (dd 31.5.06) from Chief Superintendent Colin Terry of Devon and Cornwall Constabulary reference “Changes to Neighbourhood Policing Teams”: - The Clerk said this referred to the future police structure in the South West particularly the changes to the delivery of neighbourhood policing in communities. He reminded Cllrs he had copied the letter to them with their agenda papers (8.6.06) and also placed a copy at the post office for the information of parishioners. (Noted) g) Letter (dd 31.5.06) from DCC (Chief Executive) reference “Local Government White Paper – Establishment of the new Department for Communities and Local Government (DCLG)”: - The Clerk said this sought IPC’s views on this initiative so as to develop DCC’s thinking prior to the publication of the white paper. He reminded Cllrs he had copied the letter to them with their agenda papers (8.6.06) – he said any views had to be made by 31st July 2006. IPC RESOLVED to take no further action. (Noted)
h) Letter (undated – received 5.6.06) and attachments from South West Regional Assembly reference “Consultation on the Draft Regional Spatial Strategy (RSS) for the South West 2006-2026”: - The Clerk said this letter said that the draft RSS had been submitted to the government on 24th April 2006 and that consultation on behalf of the Independent Panel of Inspectors would run for 12 weeks from 6.6.06 to 30.8.06 closing at 5 pm. He reminded Cllrs he had copied the letter to them with their agenda papers (8.6.06). IPC RESOLVED to take no further action. (Noted)
i)Email (dd 6.6.06) from Chairman of Instow in Bloom (IIB) reference “Climbers/Wall Shrubs – Atturm Stone Bus Shelter”: - The Clerk said this sought permission from IPC to place some climbers/shrubs alongside this bus shelter. IPC RESOLVED to permit this initiative. (Action: The Clerk)
j) Letter (dd 8.6.06) from North Devon Homes reference “AGM 2006”: - The Clerk said this letter invited a representative(s) from IPC to this meeting that was to be held on Friday 30th June at 11 am at The Barnstaple Hotel. IPC RESOLVED to take no further action. (Noted)
k) IPC’s Annual Report 2005/6 – “Circulation”: - The Clerk confirmed that copies had been circulated to Instow Parish Hall Committee, Instow in Bloom, Instow Twinning Association, Instow School, TTEF, IPC’s IA, NDCCS, Instow PCC, DCC Local Services (Julian Roskilly), Instow Website, Cllr Cann (DCC/NDDC), Cllr Mrs Brown (NDDC), Instow Post Office for parishioners, Parish News, DAPC and Pat Staddon (IPC Press Liaison). l) Letter (undated – received 10.6.06) from DAPC reference “New DAPC Website”: The Clerk said this stated that a new website was to be launched on 12.6.06 that would include, for the first time, by password, an area for DAPC members to advertise Clerk and Cllr vacancies and provide details of County Committee members and an online booking service for training courses with an online enquiry form. A copy of the letter was provided to each Cllr for their information. (Noted)
m) Letter (dd 8.6.06) from NDDC (Senior Planning Policy Officer) reference “Notice of Intention to Adopt North Devon Local Plan 1995 to 2011”: - The Clerk said this stated that the final version of the plan had been adopted by NDDC on 31st May 2006 and that it would now form part of the development plan for the whole district outside Exmoor National Park and would form the basis for decisions on land use planning within the area. The letter added that copies of the plan could be viewed on website www.northdevon.gov.uk/localplan; a copy of the letter was provided to Cllrs for their information. (Noted)
n) Email (dd 15.6.06) from Instow PCC representative reference “Instow PCC – Church Wardens”: - The Clerk said this stated that Instow Church Wardens were now Pam Cantle and Mrs Marion Spencer. (Noted)
o) Code of Conduct – Declaration of Interests: - (i) The Clerk advised IPC that following recent informal discussion with the Chairman and Vice Chairman it had been felt appropriate to bring this controversial issue back to the forefront of discussion and to do so by circulating a copy of a booklet entitled “Parish Council Guide to The Code of Conduct (Personal and Prejudicial Interests)”. The Clerk said that hopefully this would be of interest and helpful to Cllrs when making their deliberations for the future. (Noted)
(ii) The Clerk added that IPC might also like to consider inviting NDDC’s Monitoring Officer to a meeting later in the year to give a short presentation on the matter. After discussion IPC RESOLVED to support this suggestions and the Clerk was asked to try and arrange it for the October meeting. (Action: The Clerk)
p) TTEF Meeting – Moorings: - The Chairman reported upon a meeting he had attended earlier in the week, arranged by the TTEF, concerning the proliferation of moorings in the channel between Instow and Appledore and the concerns of the Bideford Harbourmaster. (Noted)

f) Telephone call from a Barnstaple parishioner reference “Boat on Instow Beach – Removal of Mooring Anchor”: - Caller alleged that the Instow beach cleaner had placed the mooring anchor of his boat on to the deck and that as a consequence he would be holding IPC liable if it was damaged as a result by the tide/weather etc. The Clerk made enquiries and advised caller that the Instow beach cleaner had not done as alleged and that he ought to speak to the Atturm camp as his boat had apparently been causing the Marines some difficulties in entering/leaving the beach by the slipway near the NDCC. 4. RESOLUTION REQUIRED: -

5. MISCELLANEOUS: -
(a) Tractor Matters: - (i) Murch Bros – The Clerk advised IPC that a reply letter had subsequently been received (dd 25.5.06) following dispatch of a reminder letter sent by him (19.5.06). The Clerk read it to IPC. After discussion it was RESOLVED to take no further action. (Noted)
(ii) Tractor H94 TYC – The Clerk reported receipt of a letter (dd 15.5.06) from DVLA confirming receipt of change of ownership notification. (Noted)
(iii) Insurance Cover for J459OTT – The Clerk confirmed he had contacted the Allianz Cornhill (AC) (19.5.06) and arranged to have the new tractor’s insurance altered to comprehensive (from fire and theft) adding that a letter (dd 30.5.06) from the AC, together with an amended insurance schedule, had been received. He said the additional premium (including insurance premium tax) was £20.64 (see expenditure above). (Noted)
(iv) Purchase of tractor J4590TT – (a) The Clerk confirmed he had sent a letter (dd 19.5.06) to the vendor of this tractor (Brian Thorne (BT)), together with the payment cheque (£8,225.00), and noted therein that the sale included a 3 month warranty period (11th May to 11th August 2006 inclusive) and that this warranty agreement would include all parts and labour as necessary. In addition it was noted that some minor repairs were required to a door and wing mirror, an operator’s manual (OM) and vehicle registration document (VRD) was still required and that IPC was grateful for the offer of providing tyres in due course at trade price. (Noted)
(b) The Clerk reported that a receipt for payment had been received from BT (w/c 29.5.06), that the minor repairs had been carried out on the door/wing mirror but that the OM and VRD were still awaited; he said he would be chasing them up without delay. (Action: The Clerk)
(v) Purchase and storage tank for bulk diesel for tractor – (i) The Clerk reported upon a verbal estimate (£300+) from the parish handyman for constructing a concrete stand/surround for the current single skinned tank and costs for an alternative double skinned new tank i.e. £957.45 plus Vat for a 1300 litre tank including fuel pipe, nozzle and flow meter or £625.00 for a 500 litre tank plus £100 for a meter and £35 for a hose – total £760.00 (plus Vat). (Noted)
(ii) After discussion it was RESOLVED that the Clerk, on behalf of IPC, should explore the purchase of the 500 litre tank and fittings on the proviso it was no more expensive that £760 + Vat (which is recoverable), that delivery would be free and that it could be filled by a delivery tanker from its location on site at The Barton. IPC came to this decision on the basis that even though a double skinned tank was in excess of twice the amount of paying for a concrete plinth for the current single skinned tank it could be removed from The Barton if ever necessary, at a later date, and placed elsewhere. In addition, diesel bought in bulk would be much cheaper that buying as at present in small quantities with Vat recoverable. (Action: The Clerk)
(b) Audit Commission - Annual Return for the Year ended 31st March 2006: - (i) The Clerk referred to a copy letter (dd 4.6.06) from Mr G Day (IPC’s IA) to the Audit Commission concerning IPC Annual return 2005/6. He reminded Cllrs he had copied said letter to them with their agenda papers (8.6.06) together with a copy of IPC’s Annual Return to the Audit Commission. (Noted)
(ii) The Clerk confirmed that the appropriate “Exercise of Electors’ Rights” form had been placed at the Post Office (together with a copy of the relevant “Annual Return”, “Income and Expenditure Summary” and “Council’s Accounts: A Summary of Your Rights” form”) on the 29th May with details of “Inspection Days” (being Monday to Friday (9 am to 5 pm)) for the period 12th June to the 7th July 2006 (i.e. 20 working days). (c) Email (dd 11.5.06) from Inland Revenue reference “Lump Sum on Retirement” - See Items 2604/10 (5) ( m)): - (i) The Clerk advised IPC that following direct liaison with HMRC Pension Scheme Office (2.6.06), Nottingham he had sent a letter (dd 2.6.06), together with a copy of the signed minutes of the March 2006 IPC Meeting, evidencing that IPC had passed an appropriate resolution. (Noted)
(ii) The Clerk reported receipt of a reply letter (dd 7.6.06) stating that IPC’s “Gratuity Scheme” had been approved as a retirement benefit scheme for the purpose of Chapter 1 Part XIV Income and Corporation Taxes Act 1988 with effect from 6th April 2005 and would be treated as an “exempt approved scheme” for the purposes of section 592 of that Act. For members retiring on or after 6th April 2005, this means that the scheme may pay the following benefits in accordance with Regulation 41 of the Local Government (Discretionary Payments) Regulations 1966: - (a) a tax free lump sum of 100% in respect of the member’s service up to 5th April 2006, (b) a tax free lump sum of 25% in respect of the member’s rights accrued for service from 6th April 2006 to the date of retirement, (c) a pension in respect of the residual 75% of the member’s rights accrued for service from 6th April 2006 to the date of retirement ……etc. etc. (Noted)
(iii) IPC RESOLVED to note this for future reference. The Clerk suggested that all papers of relevance to this matter were copied to IPC’s IA for his information and future reference and that he also retain a copy with IPC’s Inland Revenue documents. He added that in the event of a gratuity/pension being considered for a retiring member of staff, at a later date, undoubtedly some form of professional guidance would be necessary. (Noted)
(d) IPC Certificate of Employer’s Liability Insurance 2005/6: - The Clerk confirmed that a copy had been placed at the parish hall. (Noted)
(e) Alliance Cornhill (AC) Insurance 2006/7 – Beach Cover: - The Clerk confirmed he had liaised with the AC (emails of 19.5.06 and 24.5.06 refers) and ascertained that as “the beach” was part of “the business” of IPC then it was covered by the AC insurance without being named as such in the policy documents. (f) Letter (dd 19.5.06) from NDDC reference “Licence Fee for Bus Shelter/Marine Car Park (£14.10) – Late Payment”: - The Clerk confirmed that the necessary cheque had been sent (19.5.06) following approval/signing at IPC’s meeting of 18.5.06. He said he had advised NDDC of the payment. (Noted)
(g) Email (dd 25.5.06) from Charity Commissioners reference “Charity Commissioners News – Instow Recreation Ground (IRG)”: - The Clerk said he had copied this by email to Cllrs Crombie, Johns, White and Green (Trustees of IRG a/c with Portman Building Society). (Noted)
(h) Letter (dd 2.6.06) from Lloyds TSG (LTSG) reference “Deposit Account Interest Rates”: - The Clerk said this letter stated that the current interest rates were on LTSG’s website www.lloydstsb.com/business, Branches, Daily Telegraph, Times, Daily Mail/Express and Daily Record (Scotland). He added he had copied the letter to IPC’s cheque signatories for their information. (Noted)
i) DCC P3 Spring Newsletter 2005: - The Clerk advised IPC that he and the parish handyperson would be attending a P3 summer workshop and would report back to IPC thereafter. He added that a new system of path surveys was to be introduced in 2007 and that the parish handyperson had commenced IPC’s P3 summer maintenance programme of footpaths – see expenditure above. 2606/11 PLANNING
a) Letter (received 31.5.06) from NDDC reference “Erection of Dwelling (additional drawings) at Land at Lane End Close, Instow (Reference No 39545): The Clerk advised IPC that this letter stated that NDDC Planning had GRANTED planning permission for this application with conditions as listed; he reminded Cllrs he had copied the letter to them with their agenda papers (8.6.05). (Noted)
b) Letter (dd 8.5.06) from Torridge District Council reference “TDC Core Strategy – Regulation 25 Consultation”: - The Clerk enquired of IPC if there was any response to this letter that had been brought up at the last meeting and deferred for consideration by Cllrs (see item 2605/13 (h)). There was no response. (Noted)
c) Email (dd 23.5.06) from Cllr Harper reference “NDDC Website Portal – Coastal Preservation Area, AONB etc”: - The Clerk reminded Cllrs he had copied this email to them with their agenda papers (8.6.06) for information. (Noted)
d) Erection of stable block at Springfield, New Road, Instow (Reference No 42205): (i) The Clerk said this application had been received by him (24.5.06) and immediately passed to the Vice Chairman for the attention of IPC’s PSC; for response by 9th June 2006 or an extension to be applied for. (Noted)
(ii) The Clerk confirmed that the application details had been placed on the Instow Website for the information of parishioners. (Noted)
(iii) The Clerk advised Council that IPC’s PSC had unanimously agreed to recommend approval of this application (**Cllr Johns declared an interest**) and that NDDC had been told (9.6.06). (Noted)
(iv) IPC RESOLVED to ratify this decision. (Noted)

2606/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
a) Rubbish - Sandhills: - Cllr Scott commented upon the inordinate amount of rubbish (bottles, cans etc) being left in the dunes by late night party revellers and which had subsequently been removed by IPC’s beach cleaner. After discussion it was RESOLVED to make a note of this for the future and once the Clerk had ascertained who was currently responsible for policing in the area to advise them. IPC also noted that some minor acts of vandalism had occurred in the parish over the last week or two. (Action: The Clerk)
