2501/1 PRAYER
The Clerk led the Council in prayer.

2501/2 APOLOGIES

2501/3 POLICE REPORT
In the absence of Constable Parker, who had tendered his apologies, the
Clerk reported that only one “crime” had occurred within the parish
since the last meeting, that being an arrest for driving on Marine
Parade with excess alcohol on the 25th December 2004. (Noted)

2501/4 PARISHIONERS
TTEF Update: - Mrs Rose Day, Chairman of The Taw and Torridge Estuary
Forum, provided a briefing on a recent meeting of the TTEF that had been
held at Bideford Town Hall on the 17th January 2005. She spoke in
particular about the Braunton Burrows UNESCO International Biosphere
Reserve, Fast Leisure Craft on the Taw/Torridge Estuary, North Devon
Areas of Outstanding Natural Beauty, MCS Adopt-A-Beach, Beach
Lifeguards, Appledore Quay Wall and Permanent Moorings in the Fairway.
She provided Cllrs with a copy of her notes of the meeting and answered
questions. (Noted)

2501/5 REPORT COUNTY COUNCILLOR R CANN
a) General Matters: - Cllr Cann spoke of the Greensweep Rollout,
Mollands Garage Site (Planning - believed application to be
resubmitted), proposed Charter Toilets on the Marine Car Park (Planning
- see also item 2501/11 (c)), Charter Toilets at Lane End/Marine Parade
((Sand Dunes) - should be completed by late March 2005), the New Instow
School Site (site of preference soon to be publicised), Marine Parade 20
mph Speed Limit (should be in place by the end of January/1st week in
February), New Roundabout for the Barnstaple Western Bypass, and Dog Bin
- Atturm/Anstey Way Footpath (has been agreed and ordered and to be
installed when the contractor next visits North Devon). (Noted)
b) Instow Community Facilities/Ransom Strip Monies (see item 21412/11
(a)): - Cllr Cann said that NDDC (District Officers) would wish to be
proactively involved in supporting Instow Parish Council in the manner
in which the “Ransom Strip Monies” should be spent and that he was in
the throes of arranging a meeting for the purpose asap. (Noted)
c) Defective “Off” Street Light - Venn Close: - Cllr Cook asked Cllr
Cann if he could make contact with North Devon Homes (NDh) so as to have
a defective light within the Venn Close cul-de-sac repaired. He said
that countless calls from residents to NDh had failed to get a positive
response. (Action: Cllr Cann)

2501/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
In the absence of Cllr Mrs L Brown, who had tendered her apologies, Cllr
Cann reported (on her behalf) that NDDC had withdrawn from providing a
“Pest Control Service” in 1996 although the public had continued to
request such a service. As a consequence NDDC has now agreed, that for a
6-month trial period, the provision of a discounted “Pest Control”
service would be available to householders - costs available on request.
He said it was not intended to vigorously promote and advertise this new
service to avoid a rush of treatment request that would be very
difficult to meet. (Noted)

2501/7 MINUTES
It was RESOLVED that the December Minutes of Instow Parish Council be
approved and signed. (Noted)

2501/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2412/8 (a) - Instow Beach/Crown Estates Lease - Lifeguards: -
(i) Cllr Johns (IPC’s Finance Sub Committee) gave a report on the
progress to have the Crown Estates Beach Lease re-assigned. The Clerk
reported receipt of a letter from Mr Peter Short (Instow Marine
Services) setting out his interest in taking it on adding that if the
lease was to be re-assigned a letter needed to be sent to the agents of
the Crown Commissioners (CC) including the details of the re-assignee.
He added that if the CC agreed to the re-assignment there would be legal
fees, which IPC or the re-assignee would need to pay. After discussion
it was unanimously RESOLVED to write to the CC with a request it
considers Mr Short’s request that had the support of IPC. (Action: The
Clerk)
(ii) IPC’s then discussed a “Beach Lease” Action Plan for the summer
season 2005 so as to comply with insurance implications up to the time
the lease is re-assigned, assuming it is. It was RESOLVED that Cllr
Crombie (H and S) and the Clerk put together a draft plan for the
consideration of IPC.(Action: Cllr Crombie/The Clerk)
(iii) Lifeguard Meeting/RNLI (see item 2412/9 9(i) (j) (iv) - The Clerk
reported he had ascertained (by email to NDDC - 20.12.04 and reply
10.1.05 (Jon Parkinson)) that a meeting had already taken place between
RNLI, NDDC and some of the beach owners at the end of last year.
However, the RNLI were unable to provide cover for 2005 but are able to
do so in the 2006 season. IPC RESOLVED to note this situation for the
time being. (Noted)
(b) Item 2412/9 (i) (g) - DCC “Towards a Rights of Way Improvement
Plan”: - The Chairman provided Council with a full briefing at the
conclusion of which it was RESOLVED to communicate with DCC (Rights of
Way Department) and congratulate it on an excellent report. (Action: The
Clerk)
c) Item 2412/9 (i) (j) (iii)) - Steps and Chestnut Fencing - Instow
Beach: - (i) Damaged Steps: - The Clerk told IPC he had advised DCC
(Local Services Foreman and John Beardsley - email etc 20.12.04) and
Andy Bell (NDCCS); he said the wall/steps were the property of DCC and
that they had now been repaired. (Noted)
(ii) Chestnut Fencing: - The Clerk advised IPC he had liaised with Andy
Bell (NDCCS) by email (20.12.04) and that his response was that he “has
this job earmarked for his team early in the new year”. IPC RESOLVED to
express its concern at the time it was taking for this
defective/dangerous fencing to be repaired/replaced and the Clerk was
asked to communicate this concern to Andy Bell (NDCCS) soonest. (Action:
The Clerk)
(d) Item 24123/12 (a) - Anstey Way Lay By - Dropped Pavement - (i) The
Clerk told IPC he had liaised with DCC (John Beardsley - email 20.12.04)
and that this was not possible on the grounds of road safety i.e. it
would encourage pedestrians, especially disabled or pushchair users, to
cross at this location. The Clerk said he had reminded DCC there was an
agreed plan to have a refuge put in place on Anstey Way at the bottom of
Rectory Lane (Venn Cross) so as to enable pedestrians to cross at this
location to the bus stops and footpath; he said DCC had agreed this
would be borne in mind for the future. (Noted)
(ii) Cllr Cann said that when the new Instow School was built this would
be borne in mind as no doubt some highways gains would materialise at
that time. (Noted)

2501/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Estuary Alliance Meeting - Wednesday 12th January 2005: - (i) The
Clerk reported the agenda for this meeting had only been received on the
7th January and that Cllrs had been informed immediately by email/post.
The Clerk then referred to a letter from NDDC (dd 7.1.05) cancelling the
meeting; apologies had been expressed with the meeting to be rearranged
later in the month - Cllrs had been notified at the time. (Noted)
b) Letter (dd 6.1.05) from Andy Bell (NDCCS) reference meeting
concerning “Management of Access for Recreational Craft on the
Taw/Torridge Estuary”: - The Clerk said that the Chairman/Vice Chairman
had been advised immediately (7.1.05 by email) - the meeting to be held
at Civic Centre at 7 pm on Tuesday 11th January 2005. However, the
Chairman/Vice Chairman were not available to attend. The Clerk then
referred to an email (dd 13.1.05) from the Chairman TTEF together with
notes of said meeting - copies were provided to Cllrs for perusal. (See
also item 2501/4). (Noted)
c) Letter (dd 7.1.05) from NDDC reference “House to House Act 1939 -
Clothes Aid on behalf of Great Ormond Street Hospital Children’s Charity
(Mrs Grace, Clothes Aid, Unit 4NR, Leroy House, 436 Essex Road, London
N1 3QP”: - The Clerk referred to an email (dd 12.1.05) from NDDC
reference this collection - he read it out. IPC RESOLVED to offer no
objection to the application - Clerk to advise NDDC. (Action: The Clerk)
d) Email (dd 13.1.05) from Ex Cllr Mrs Rose Day to Chairman IPC (copied
to all IPC Cllrs and Clerk - email) reference “Sandhills Toilets Ransom
Strip and Community Facilities”: -The Clerk said this was for the
information of IPC particularly Cllrs Ms Mayoh, Scott and White -
Community Project Sub Group (see item 2412/11 (b)) - see also item
2501/5 (b) and 2505/12. (Noted)
e) Letter and enclosure (undated - received 14.1.05) from Office of
Deputy Prime Minister concerning “Freedom of Information Act 2000 -
Authorisation of the Qualified Person and Amendment to Schedule 12A of
the Local Government Act 1972”: - The Clerk referred to a copy provided
to Cllrs at the meeting. After discussion it was RESOLVED to note it.

4. RESOLUTION REQUIRED: -
IPC RESOLVED to transfer £220.00 from Lloyds Bank Business account
number 02350065 to Lloyds Bank Treasurers account number 02348842 to
cover cheques as at 2 above. (Action: The Clerk)

5. MISCELLANEOUS: -
(a) Beach Grant 2004: - The Clerk reported progress since the last
meeting i.e. had made contact with Brain Holme of NDDC Community
Department (subsequent to a letter he received from NDDC dd 23.12.04 -
the Clerk read it to Council) and subsequently submitted a claim for a
beach cleaning grant 2004/5 by email on 7.1.05 The Clerk outlined the
claim. (Noted)
(b) Parish Seat - Insurance Claim: - (i) The Clerk advised IPC that he
and Cllr Crombie had inspected all seats on the 19th January - Cllr
Crombie gave a full report at the conclusion of which it was RESOLVED to
condemn 8 seats that were deemed unsafe and hazardous when considering
all the health and safety and insurance implications that impinged on
the responsibilities of IPC. It was further RESOLVED that an explanation
would be printed in a forthcoming Parish Magazine and that similar
information should be placed in the local press and on IPC’s website.
This would ensure that the donors of the 4 named condemned seats (“Rebel
and Labsa”, “James and Ada Lane” (x2) and “Irene Scott-Stanborough”)
might be made aware and be given the option of taking the seat(s) back,
authorising their disposal and/or donating a replacement seat in its
place. It was further RESOLVED that new donors for replacement seats
should be sought and it was suggested this be included in the publicity
as above. (Action: Cllr Scott and The Clerk)
(ii). The Clerk advised IPC there was still a necessity to draw up a
policy reference acquisition, type of construction of seat, maintenance
etc. After discussion it was RESOLVED that Cllr Crombie and the Clerk
would put together a draft policy for future consideration by IPC.

(c) Instow Recreation Ground Trust Account (Instow Allotment and
Recreation Field a/c) - Portman Building Society: - (i) The Clerk said
this account was now officially known as “The Instow Allotment and
Recreation Field Account” (Noted)
(ii) The Clerk reported receipt of a statement (dd 1.1.05) from the
Portman Building Society confirming that the sum of £146.14 had been
added to this account as interest for the year 2004. After discussion it
was RESOLVED by IPC to have this sum drawn as a cheque made payable to
the “Instow Parish Hall Committee” as for previous years. (Action: The
Clerk)
(d) DCC P3 Footpath Inspection 2004/P3 Claim for 2005: - The Clerk
reported that the P3 2005 Finance form (and necessary P3 reports for
2004/5) had been sent to DCC (8.1.05); he said he had claimed a sum of
£400 that would cover all necessary costs for 2005/6, mainly strimming
costs for footpaths 5 (Downs Road), 6 (Instow School Stile), 7 (Atturm),
10 (Huish) and 16 (Venn Cross) together with bridge/gully maintenance
(Footpath No. 6); he said this would also include some administration
costs adding that Mel Harris would carry out the necessary work. IPC
RESOLVED to approve this claim. (Noted)
(e) Letter (dd 12.11.04) from NDDC reference “Parish Council Expenditure
2005/6”: - The Clerk confirmed he had received a letter (dd 22.12.04)
from NDDC setting out a statement of IPC’s proposed Parish Council Tax
for 2005/6 i.e. Precept of £5,800 - Band D Council Tax required to
produce £5,800 = £13.78 (Estimated based on year 2004/5 properties). He
added that NDDC required confirmation from IPC that these figures were
acceptable and whether IPC wished to have its subscription to DAPC
deducted from IPC’s first precept payment. After discussion it was
RESOLVED to confirm the figures and agree to IPC’s DAPC subscription
being deducted from IPC’s first precept payment. (Action: The Clerk)
() Tractor Scrape Maintenance (see item 2412/10 (5) (i)): - The Clerk
reported that Peter Cook was unable to get the tractor scrape “serviced”
by Atturm during the first week in January 2005 for security reasons;
however, this necessary piece of maintenance had been satisfactorily
completed by Peter Cook himself (see costs as at 2 above). IPC RESOLVED
to approve this payment. (Noted)
(g) (i) Parish Tree Group & (ii) Village Show 2005: - (i) The Clerk
confirmed he had corresponded with Mrs Pam Cantle (email 23.12.04)
requesting further details. (ii) The Clerk further reported receipt of a
reply email from Mrs Cantle (dd 8.1.05) noting the resolution of IPC;
she had thanked IPC for its interest in the tree group, adding that a
claim would be made when required by the group. (Noted)
(ii) The Clerk confirmed he had sent Mrs Cantle a letter (dd 11.1.05)
pledging IPC’s support for the village show - he said this was required
for a Leader + funding application. (Noted)
(h) Xmas Carol Singing Charitable Collection 2004/Band: - (i) The Clerk
reported receipt of letters from North Devon Hospice, Children’s Hospice
(SW) and RNLI (Appledore Branch) thanking IPC and the parishioners of
Instow for their donations - £88.63 each. (Noted)
(ii) The Clerk reported receipt of a letter from the Two Rivers Wind
Ensemble (TRWE) thanking IPC for its donation of £30 towards its funds
and confirming its availability for the Instow Parish Carol Singing
event to be held on Sunday 11th December 2005 at The Commodore Hotel. He
added that the Band was also keen to give an outdoor concert at Instow
during the summer (2005) and was enquiring of IPC if this was possible.
After discussion it was RESOLVED to confirm the date for the parish
carol singing as Sunday 11th December (Clerk to advise The Commodore and
Instow PCC) and enquire of The Commodore if an open-air concert by the
TRWE might be held on its premises during the summer. (Action: The Clerk)
(i) IPC’s Internal Audit October - December 2004: - Cllr Crombie
confirmed he had carried this out (13.1.05) and all was found to be in
order. (Noted)
(j) Bank Reconciliation - 1st October 2004 to 31st December 2004: - The
Clerk circulated a copy of this to Cllrs at the meeting; Cllr Crombie
said he had checked the figures and confirmed them to be correct
(13.1.05). (Noted)
(k) (c) War Memorial - Insurance: -The Clerk updated IPC i.e. he had
been chasing a local stonemason for the cost to rebuild the war memorial
and that he had finally made contact with him on the 12th January. He
said the stonemason was to take photographs/measurements as a matter of
some urgency to send to a fellow stonemason specialist in Cornwall and
that a price for rebuild should be available by the February meeting.

2501/11 PLANNING
a) Letter (dd 22.12.04) and enclosure (certificate) from Planning
Manager, NDDC reference “Erection of Dwelling - garden of Myrtle
Cottage, Kiln Close Lane, Instow (Planning Reference No 38941)”: - The
Clerk reported this stated that NDDC had REFUSED to grant this planning
application for reasons as listed; the letter adding that highway
objections had been raised to the proposed development and that a
planning application for a dwelling on the site was refused in 1985 and
an appeal was dismissed in 1986 - again, the grounds related to the
shortcomings of the access. The Clerk reminded Cllrs he had provided
them with a copy of the letter/certificate with their agenda papers
(13.1.05). (Noted)
b) Conversion of loft space over detached garage to form dependant
relative annexe at Gorse Hill, Instow (Reference No. 39248): - The Clerk
reported receipt of this application (7.1.05) and of having posted it to
the Chairman (8.1.05) for the attention of IPC’s Planning Officers/Sub
Committee. Members of IPC’s Planning Sub Committee then addressed
Council at the conclusion of which it was RESOLVED to recommend approval
of the application on the grounds that said application would proceed on
the exact lines as set out in the architects letter (dd 21.12.04) to
NDDC’s Chief Planning Officer. (Action: The Clerk)
c) Application under Regulations 3 of the T and CP General Regulations
1992 for demolition of existing toilet block and construction of new
Charter Toilets at Marine Car Park, Instow (Reference No. 38516): -(i)
The Clerk confirmed he had written to the Chief Executive of NDDC
(22.12.04) along the lines as resolved by IPC at its December meeting
(see 2412/11 (i) (b)); he reminded Cllrs he had copied it to them with
their agenda papers (13.1.05). He added that as no response had been
received as of 17.1.05 he had spoken to the PA of Chief Executive so as
to facilitate a response by 20.1.05. The Clerk then referred to an email
(dd 19.1.05) from Geoff Barclay (NDDC Environmental Health Dept) a copy
of which he provided to Cllrs for perusal at the meeting - he also read
the email out aloud. (Noted)
(ii) The Clerk then reported to IPC that the official minutes of NDDC’s
Planning Committee for Wednesday 15th December 2004 stated that
“Committee resolved that the application be deferred to (a) enable the
Executive and Corporate Management Team to consider the cost of
relocating the toilets (b) the safety aspect of vehicles entering and
exiting the car park and (c) the views of the neighbouring residents at
Marine Court in relation to visual intrusion, noise and smell”. Cllr
Cann added that at the NDDC’s Planning Committee meeting of the 12th
January 2005 these minutes had been amended to insert a further point,
that is, “(d) the existing planning consent for the site and its value
to the Council”. A discussion ensued. (Noted)
d) Planning Application - Redevelopment of Mollands Garage, Quay Lane,
Instow (Reference No 38787) -- The Clerk reported receipt of a copy
memorandum (dd 4.1.05) from Planning Manager (NDDC) to NDDC’s Members
Services requesting advice in respect of IPC’s observations (see item
2412/11 (c)): on this planning application in the light it had declared
a pecuniary interest in the site, subject of this planning application.
The Clerk read out the content of the memorandum to Council and provided
Cllrs with a copy for their information. (Noted)
e) Replacement of UPVC windows with wooden framed windows at The
Wayfarer Inn, Lane End, Instow (Reference No. 39055): - The Clerk
reported receipt of this application (8.1.05) and of having posted it to
the Chairman (8.1.05) for the attention of IPC’s Planning Officers/Sub
Committee. Members of IPC’s Planning Sub Committee then addressed
Council at the conclusion of which it was RESOLVED to recommend approval
of the application. (Action: The Clerk)
f) Enclosure of first floor balcony at The Boathouse, Marine Parade,
Instow (Reference no. 38931): The Clerk reported receipt (8.1.05) of a
letter from NDDC stating this application had been GRANTED with
conditions as listed. (Noted)
g) Extension to residential home to provide 20 bed nursing accommodation

Anstey Way, Instow (Reference No. 39314): - The Clerk reported receipt
(19.1.05) of this application and of having handed it to the Vice
Chairman (19.1.05) for the attention of IPC’s Planning Officers/Sub
Committee. After discussion it was RESOLVED to seek an extension from
NDDC until the next meeting so that the Clerk could make further
enquiries on behalf of IPC’s PSC. (Action: The Clerk)

2501/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
IPC’s Ransom Strip Community Project Group”: - Cllr Ms A Mayoh said it
was her belief she had been “appointed” as the Chairperson of this group
at the last meeting. The Clerk reported that the minutes of the December
meeting, that had been earlier been approved by Cllrs, did not reflect
that. After discussion IPC RESOLVED to “appoint” Cllr Ms A Mayoh as
Chairperson of said group although Cllrs noted that meetings were now to
be facilitated by NDDC (see item 2501/5 (b)) as outlined previously by
Cllr Cann. (Noted)

2501/13 STANDING ORDER NO. 59
RESOLVED that in view of the special nature of the business about to be
transacted, it was advisable in the public interest, that the
press/public be temporarily excluded and they were instructed to withdraw.
