The meeting was preceded at 7 pm by an excellent talk on “Councillors Code of
Conduct/Declaration of Interests” by Don Pratt (Assistant Chief
Executive/Monitoring Officer NDDC).
Don Pratt set out the basic framework of the Code of Conduct and the criteria
for Cllr declaration of interests and said that a new code of conduct entitled
“Community Interest” was to be introduced early in 2007.

2610/3 POLICE REPORT
a) Annual Crime Figures: - Inspector Toby Davies reported that for the four
main crime areas, namely theft from motor vehicles, house burglaries, violent
crime and criminal damage he was pleased to report that for the previous 12
months, a decrease had been achieved in theft from vehicles and violent crime
but that regrettably house burglaries and criminal damage were up. He spoke of
an initiative that had been launched to deal with criminal damage offences. It
was pointed out to Inspector Davies by Cllr White that unquestionably some
crime was not being reported to the police because of communication
difficulties (that had recently been the subject of local publicity); he said
he doubted if this applied to house burglaries and that in any event they were
endeavouring to overcome the problems of communications.(Noted)
b) Neighbourhood Policing: - (i) Inspector Toby Davies reported that the force
was going through a period of change; it had been decided at Home Office/ACPO
level that most forces, including Devon and Cornwall, were “not fit for
purpose” when it came to tackling terrorism and major cross border crimes. He
said the Devon and Cornwall Constabulary had decided, as a consequence, to cut
its Neighbourhood Beat Managers (NBMs’) by between 30% and 50% and put these
officers back on to proactive policing duties throughout the two counties.
However, and in a positive sense, it was intended to replace each lost NBM
with 2 Police Community Support Officers’ (PCSO’s). Inspector Davies added it
was intended to leave the boundary of the Instow beat as it was and that by
2008 it would be covered by 2 PCSO’s, it was currently covered by PCSO
Charles, and two NBM’s who would also be responsible for the Longbridge area
of Barnstaple right through to Bickington, Fremington, West Yelland to Instow.
He told Council that Constable’s Earl Napier and Shauna Cobb were currently in
post and covering these areas between them together with PCSO Charles. (Noted)
(ii) Cllr Crombie questioned Inspector Davies on the powers, or lack of the
powers, of PCSOs’. He was assured by the Inspector that PCSO’s powers were to
be drastically enhanced in due course and that each would have the necessary
“tools” to be effective and efficient. (Noted)
(iii) The Clerk asked whether Constable’s Napier and Cobb could now visit the
village on a regular basis and make themselves known to shopkeepers, business
owners and parishioners; he accepted that Instow was a low crime area but
parishioners, he added, deserved to see their officer on the patch from time
to time if only to allay anxiety and overcome the fear of crime and all that
entailed. Inspector Davies said he would take this on board. (Noted)
(iv) Cllr Johns (Chairman) thanked Inspector Davies for giving up his valuable
time to come and address Council and said he now looked forward to meeting
Constable’s Napier and Cobb. He complimented PCSO Charles for all the sterling
work he had done within the parish since his appointment albeit would be nice
to see him more often. (Noted)
(c) Current Crime: - The Clerk told IPC he had been informed by PCSO Charles
that 3 crimes had been reported in the parish since the last meeting, namely
three thefts (of 20 metres of copper lightning conductor, a dinghy and a
cycle). (Noted)

Taw and Torridge Matters: - (i) Mrs Rose Day (Chairman of TTEF) addressed IPC
and spoke to a report she had previously tabled. She spoke of Climate Change,
Bathing Water Quality 2006: Instow had passed both the EU Imperative Standard
and the Guideline (Blue Flag) Standard, Bideford Harbourmaster’s Report, NDCCS
Coastal Project Officer, Proposed Hovercraft Operation (Ilfracombe to Swansea
and Minehead to Barry), Dredging at Appledore Shipbuilders, Instow Ferry,
Fremington Quay, Knapp House, TTEF Website (now has a 10 day weather forecast
facility) , Biosphere Reserve, Braunton Burrow (and Public Information
Meeting), Natural England, North Devon AONB, Slipway Warden at Churchfield

2610/5 REPORT COUNTY COUNCILLOR R CANN
a) Instow – Traffic Issues: - (i) Cllr Cann reported that the suggested
one-way system along Marine Parade and the banning of buses would not be in
the best interest of the parish in his opinion and that he would not be
pursuing this proposal – see later discussion under item 2610/8 (b) (ii) to
(iv) inclusive. (Noted)
(ii) Cllr Cann said he had been copied in on a letter from a parishioner to
the local bus company, as regards the alteration to the bus service to Exeter
and Plymouth and the detrimental effect this would have on Instow. He said he
had personally intervened by liaising with the bus company and had written
personally to the parishioner as regards his intervention. He said this issue
was a DCC issue and he would chase it up as necessary – see also item 2610/8
(vi) to (viii) inclusive. (Noted)
b) Speeding – Marine Parade and Anstey Way: - (i) Cllr Cann said he had held a
site meeting with a DCC Highway’s Engineer as regards the suggestion of
sleeping policemen and rumble strips and he had been told this would cost in
the region of £20.000. He said it might be possible to place low level speed
bumps in the vicinity of the Signal Box/Tarka Trail crossing and the straight
near to the Atturm Camp. These, he added, would have some noise implications
which he would pursue and report back on. (Noted)
(ii) Cllr Cann added, however, that village gateways, in addition to road
strips, might help from a preventative point of view although there was no
provision in the DCC budget for any traffic orders this year and that next
year’s funding was uncertain. He said, therefore, that any scheme would have
to come from his annual DCC Cllr allowance of £6,000 which was almost
committed for this year although something might be achieved if the parish
agreed to part funding any agreed proposal. After discussion IPC RESOLVED to
consider such an initiative but asked that Cllr Cann come up, in the first
instant, with a form of costing and firm proposal including drawing etc.

(iii) Cllr Cann said the speed of traffic through Anstey Way needed police
enforcement and that he had, as a result, liaised with PCSO Charles. (Noted)
(c) Instow School – Traffic Safety Measures: - Cllr Cann said the school had
introduced a road safety initiative by setting up a drop off area in the
lay-by along Anstey Way so the children and parents could walk up/down Rectory
Lane to school, thus reducing some of the congestion around the school gates.
However, because Rectory Lane was narrow the school have asked whether there
is anything DCC can do to warn motorists. Cllr Cann said DCC was considering,
as a consequence, additional road markings as well as a set of flashing lights
and that the Road Safety Officer was seeking IPC’s views on this. After
discussion IPC RESOLVED to fully support this excellent road safety
initiative. (Action: Cllr Cann)
(d) Instow New School Update: - (i) Cllr Cann said nothing further had been
heard from the landowner of the lay-by site and that DCC, therefore, was about
to proactively progress the original proposal. (Noted)
(ii) Cllr Cann said he had heard of a letter that had been sent to DCC (Cllr
Greenslade) by the Chairman of the Instow School Governors as regards the new
school. He said he regretted not having had sight of the letter as he had done
everything he could to ensure the new school progressed as effectively as was
possible in all the circumstances. (Noted)
(e) Miscellaneous: - Cllr Cann spoke of Westleigh Junction (DCC was assessing
possible improvements on which the parish council would be consulted), Devon
Pound (a DCC initiative to address financial exclusion), DCC Disability
Information Service (available to disabled residents, their families and
carers; telephone number 0845 155 1005 and website “csc.disabityinfo@devon.gov.uk”),
and Dropped Kerb – Marine Parade opposite Commodore (DCC Local Services to
review – markings?) – see also item 2610/9 (i) (a). (Noted)

It was RESOLVED that the September 2006 minutes of Instow Parish Council be

2610/8 MATTERS ARISING FROM THE MINUTES
a) Item 2609/3 (a) (iii) - Speeding/ Anstey Way & Marine Parade: - The Clerk
provided IPC with a report on his liaison with PCSO Charles who in turn had
liaised with the Traffic Department; speed guns etc would be used on site as
and when they had been calibrated and officers were available to use them.
(See also item 2610/5 (b) (iii)). (Noted)
b) Item 2609/3 (a) (i) &2609/4 (d) - Traffic Congestion – Instow: - (i) The
Clerk provided IPC with a report on his liaison with PCSO Charles who in turn
had liaised with the Traffic Warden Supervisor. The Clerk read to Council an
email (dd 28.9.06) that set out the current dire predicament as regards
traffic warden employment and their scant availability as a consequence.

(ii) IPC then discussed traffic congestion in the village and possible
solutions following on from Cllr Cann’s earlier report on his liaison with DCC
Local Services as regards a one way system/the banning of buses along Marine
Parade and “silent” rumble strips etc. (see item 2610/5 (a) (i) and (ii) and
2610/5 (b) (i) & (ii)). (Noted)
(iii) The Clerk advised IPC he had received a letter from a parishioner
together with a petition signed by 79 residents, objecting to the proposal
that buses should be directed along Anstey Way as opposed to Marine Parade, if
only one way/circuitous, and that many other parishioners and affected people
had expressed an intention of wishing to sign it after it had been sent to the
Clerk. (Noted)
(iv) After debate IPC unanimously RESOLVED not to consider any further a
one-way system/circuitous bus route/banning of buses from Marine Parade
particularly as so many affected parishioners had expressed their objection
and in a very short space of time and un-prompted. (Noted)
(v) IPC did, however, RESOLVE to reaffirm its support of Cllr Cann’s proposals
on village gateways/road strips (see item 2610/5 (b) (ii) and requested he
come up with a plan and costings as soon as possible. (Action: Cllr Cann)
(vi) The Clerk advised IPC of two copy letters (dd 12.10.06) he had received
from a parishioner to Stagecoach Devon UK/First Devon and Cornwall Ltd (copied
also to Nick Harvey MP, Cllr Cann (DCC), Cllr Greenslade (DCC), Chief
Executive NDDC and Parish Clerk at Fremington) reference bus routes through
Instow and the alteration in particular of the Exeter and Plymouth routes from
Barnstaple that now travel direct to Bideford via the link road and miss out
Instow completely. (Noted)
(vii) The Clerk then referred to an email (dd 18.10.06) from Cllr Cann
reference letters as at (vi) above and a response he had received from First
Bus and Stagecoach Bus Companies and which he had forwarded to the relevant
parishioner. The Clerk appraised IPC of the content of the letter etc. (Noted)
(vii) In the light of item 2610/5 (a) (ii), IPC RESOLVED to take no further
action other than for the Clerk to contact the parishioner in question and
update him on what had transpired at the meeting. (Action: The Clerk)
c) Item 2609/8 (a) - Charter Toilets/Quay Car Park: - (i) Cllr Cann said he
had nothing further to report other than to reassure IPC he had its interest
at heart and would report any relevant progress as and when it materialised.

(ii) The Clerk advised IPC of an email (dd 14.10.06) from an Edegehill College
Student regarding “Proposed Flats at Instow – Marine Car Park”; he said the
writer had been advised to contact NDDC Car Parks etc. (Noted)
d) Item 2609/8 (b) - Sandhills Ransom Strip/Questionnaire: - (i) The Clerk
reported that all members of the Steering Group had been provided with a copy
of all returned questionnaires and that NDDC’s Community Dept, and the IPC
steering group, were currently in the midst of preparing a synopsis of the
replies for comparison and to aid discussion at a forthcoming meeting. He
added that in due course Council would be provided with an “agreed” update
(i.e. NDDC’s analysis merged with IPC’s) for discussion in open council.

(ii) The Clerk advised IPC that Cllr Harper, assisted by Cllr Ms Mayoh, had
prepared a graphical analysis of the returns; Cllr Harper provided a copy to
each Cllr and a discussion ensued. Cllr Johns (Chairman) thanked Cllr Harper
for his work that was comprehensive and useful. (Noted)
(iii) Cllr Cann said he would liaise with Brian Holme (NDDC) and Ian Hobbs (DCC)
and call a meeting of the Steering Group in the very near future. (Action:

e) Item 2609/9 (i) (c) - Neighbourhood Policing – Instow: - The Clerk provided
IPC with a report on his liaison with PCSO Charles and Inspector Toby Davies.
He added that it was as a consequence of this that he had secured the
attendance of Inspector Davies at the meeting. (Noted)
f) Item 2609/9 (i) (g) - Damage to Round (Cob) House, Tarka Trail: - The Clerk
reported upon the details of an email and photographs sent to him from Cllr
Harper that indicated minimal damage had been done to the roundhouse and
picnic bench. The Clerk advised IPC of his liaison with NDCCS who had the
matter very much in hand. (Noted)

a) Email (dd 30.9.06) reference “Dropped Kerb on Marine Parade (Opposite
Commodore Hotel” : - (i) The Clerk said this message highlighted the fact that
this dropped kerb was often inaccessible to wheelchair/disabled users because
of parked cars and asked what could be done about it. (Noted)
(ii) The Clerk reported that having been to the location and assessed the
situation he had passed the “complaint” to Cllr Cann to see what DCC Local
Services might be able to do about it. (Noted)

situation and possibly place some hatchway markings in the vicinity to deter

“House to House Collection – Clothes Aid”: - The Clerk said this letter stated
that an application had been made to carry out this collection between 2nd
February 2007 and 1st February 2008. After discussion IPC RESOLVED to offer no
objection to the application but to point out it did not favour such open
ended applications and that it would prefer to have prior notice as to when
the applicant would be visiting the parish so that its parishioners, many
elderly/vulnerable and fearful of crime, might be forewarned. (Action: The

The Clerk read the letter to Council that had also been copied, for

RESOLVED to advise the parishioner that she should contact DCC as regards her

contents of the letters i.e. non return addresses and visiting officers. He

return addresses (copy of list provided to Cllrs) and that if any Cllr wished
to put themselves forward as a visiting officer he had possession of the job

16.10.06}) reference “Instow – Water Quality Tests 2006”: - The Clerk advised
IPC that Instow had not only passed the Imperative EU Bathing Water Standard,
but had also passed the Guidelines (Blue Flag) Standard. After a discussion it
was RESOLVED to facilitate some local publicity by way of the North Devon

g) Email (dd 19.10.06) from Secretary of Westleigh, Instow and West Yelland
“Community on Show” Committee reference “Community on Show 2007”: - The Clerk
said this stated that this event was scheduled for 21-22nd July 2007 and
sought IPC’s permission to once again have access to the beach for various
activities with required proof of liability insurance to be provided to IPC in
May/June 2007 once the beach events had been agreed and risk assessments
provided to parish hall’s insurers. IPC RESOLVED to agree subject to proof of
insurance cover. (Action: The Clerk)
h) Remembrance Day Service 2006 – Instow Church: -The Clerk reported that this
was to take place at 10.55 am on Sunday 12th November 2006 and that he had
already got IPC’s wreath. After a discussion it was RESOLVED that Cllr Harper
would attend and lay the wreath, it being IPC’s turn to do so. The Clerk said
he had every intention of also attending. (Action: Cllr Harper/The Clerk)
i) Parish Carol Singing Event 2006: - (i) The Clerk reported that this event
was to be held on Sunday 10th December at The Commodore/Parish Hall (to be
confirmed asap by Clerk). (Action: The Clerk)
(ii) The Clerk said that IPC’s FSC would consider the recipient of the
charitable collection and report back to IPC at the November meeting. He
reminded IPC that in 2005 IPC had resolved that the monies should go jointly
between ND Hospice, Children’s Hospice (SW) and RNLI (Appledore) with IPC
matching collection up to £100. (Noted)
(iii) The Clerk reminded Cllrs that thought would need to be given to the
arrangements on the night i.e. mince pies. mulled wine, hospitality,
collectors. He said The Two Rivers Wind Ensemble had been booked to lead the
singing which would be organised by Instow Church. (Noted) (iv) The Clerk said
that IPC’s FSC would be asked to discuss the funding of this event; he had
been reliably advised by DAPC that a grant could be provided by IPC, for
example to the Parish Hall Committee, towards a “Community Charity Event

might like to consider the invitation list prior to the next meeting; he

of Wight (IOW) Council’s appeal against a judgement of the High Court Tribunal
in favour of HMR and C that was to be held on 27th – 30th November 2006. He
said if the IOW Council was successful it could have an impact on IPC as up to
3 year ago, when it was VAT registered, it paid VAT on its car park takings.

b) Audit Commission - Annual Return for the Year ended 31st March 2006: - The
Clerk confirmed that no parishioner(s) had requested to see the return
following the publication of the “Notice of Conclusion of Audit and Right to
Inspect the Annual Return for the year ending 31st March 2006” form that had
been exhibited on IPC’s notice board at John’s Post Office for the period
Wednesday 13th September (for a 14 day period) to end on 27th September. He
said he had retained the papers on file for future reference. (Noted)
c) NDDC Beach Grant 2006: - The Clerk advised IPC he had sent in the necessary
paperwork to claim this grant which totals £1,800.00. (Noted)
d) IPC’s Finance Sub Committee Meeting - Budget 2006/7: - The Clerk reported
that IPC’s FSC was to meet at 6.30 pm on Monday 30th October 2006 to discuss
IPC’s draft budget for 2006-7. He added that the draft budget would then, as
usual, be brought before IPC at its next meeting (16th November) for
discussion and amendment/ratification. (Noted)
(e) Internal Audit – July to September 2006: - The Clerk reported that Cllr
Crombie had carried out this internal audit on 16th October and found all to
be in order. Cllr Crombie confirmed this to be the case. (Noted)
(f) Bank Reconciliation – 1st July 2005 to 30th September 2005: - The Clerk
circulated a copy of this to Cllrs at the meeting; he said the figures had
been checked and confirmed by Cllr Crombie (16th October). Cllr Crombie
confirmed this to be the case. (Noted)
(g) Budget 2006/7 against Actual Income/Expenditure April to September 2006: -
The Clerk circulated a copy to each Cllr and a discussion ensued. Cllr Crombie
confirmed he had checked it on 16th October. (Noted)
(h) DAPC Annual Subscription 2006: - The Clerk advised IPC that IPC’s
subscription for 2007 would be £129.00; he said it had been £136 in 2006 (it
was relevant to population that had decreased) and had been agreed at the
recent DAPC AGM 2006. (Noted)
i) DCC Grass Cutting Grant 2006: - The Clerk confirmed that an invoice had
been sent to DCC Local Services in the sum of £615 and that a cheque had been
received and banked (14th October). (Noted)
j) DCC P3 Footpath Inspection 2005/P3 Claim for 2007:- The Clerk said the
necessary papers were still awaited from DCC and that he would action them on
receipt. There were no comments from Cllrs as to the state of the parish
footpaths other than each was in a, by and large, excellent condition.

a) Letter from NDDC Planning reference “Listed building application for
alterations to storeroom to form garage and store at The Barn, Middle Huish,
Instow (Reference 42683): - The Clerk reported that this stated that NDDC
Planning had GRANTED this application with conditions as listed. (Noted)
b) Letter from NDDC reference “ Retrospective application for the demolition
of existing and erection of new extension to dwelling at Westaway, Anstey Way,
Instow (Reference No 42732): - The Clerk reported that this stated that NDDC
Planning had GRANTED this application with conditions as listed. (Noted)
c) Listed building application for alterations and repairs to dwelling at The
Anchorage, Marine Parade, Instow (Reference No 43039): - (i) The Clerk
reported receipt of this (29.9.06) and of having passed it immediately to
IPC’s PSC for attention; for response by 19th October or an extension to be
applied for. (Noted)
(ii) The Clerk confirmed that the details of this application had been placed
on Instow website for the information of parishioners. (Noted)
(iii) After a briefing by IPC’s PSC, IPC RESOLVED to recommend approval of

d) Letter from NDDC Planning reference “Erection of 1 Dwelling (amended design
to planning permission 39545) at Land at Lane End Close, Instow (Reference No
42819): - The Clerk reported that this stated that NDDC Planning had REFUSED
to grant planning permission for this application for reasons as listed; he
provided a copy of the letter to Cllrs for their information. (Noted)
e) Letter from NDDC Planning reference “Extension to dwelling together with
raising of roof to create first floor at Oaktree, Anstey Way, Instow
(Reference No 42438): - The Clerk reported that this stated that NDDC Planning
had GRANTED this planning application with conditions as listed and that he
had copied the letter to Cllrs for their information. (Noted)
f) Email (dd 2.10.06) from DAPC reference “Planning Guide for Councillors” : -
(i) The Clerk said this referred to a planning guide for Cllrs that was being
developed by the Local Government Information Unit (LGIU) and who had invited
comments from Cllrs as to its format. (Noted)
(ii) The Clerk reported he had circulated said email (26.9.06) to IPC Cllrs
with an email address and invited comments. (Noted)
(iii) The Clerk reported receipt of a response from Cllrs Harper (30.9.06) and
of having passed in on the LGIU. (Noted)
2610/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
(i) Flooding – Marine Parade (Opposite Commodore): - Cllr White said that
during a recent period of heavy rainfall this road had flooded and that it was
undoubtedly due to the fact the road drains at that location and that run out
onto the beach were blocked. It was RESOLVED the Clerk should contact DCC
Local Services to deal. (Action: The Clerk)
