MINUTES OF THE DECEMBER 2007 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 13th DECEMBER 2007 AT 7.30

 

 
Present: - Councillors P Cook, N Crombie, M Green, A Johns (Chairman), G May, B Moores (Also NDDC), S White (Vice Chairman) and Mr R Jacob (Parish Clerk).

In Attendance: Cllr R Cann (DCC) and 8 parishioners.

2712/1 PRAYER
The Clerk led the Council in prayer.

2712/2 APOLOGIES
Cllr C Harper and Mrs P Renshaw.

2712/3 WELCOME & INTRODUCTION
(i) The Clerk, in welcoming everyone to the meeting, said that he wished to point out, at an early stage, that the planning application for the new school had not been received and that as a consequence the planning application for the school’s playing field (see item 2712/12 (a)) would not be dealt with by IPC at the meeting but would be deferred until the January meeting. (Noted)

2712/4 POLICE REPORT
a) Crime Matters: -
(i) Constable Hodgson reported that 6 crimes had been reported in the parish since the last meeting, namely, an arson (offender arrested), criminal damage to a vehicle (undetected), non-crime domestic (verbal) dispute, criminal damage to a dwelling (graffiti - under investigation; Yelland area), assault occasioning actual bodily harm (suspect on police bail – Yelland area) and theft from motor vehicle (diesel – Holmacott). He added that vulnerable vehicle forms were still being used and letters sent to prevent car crime from reaching the Instow area. (Noted)
b) Other Matters: -
PC Hodgson said that over the same period of time 11 incidents logs had been created for issues relating to arson, domestic (x3), flare demonstration, suspect burglary, lost property, disturbance, found dog, anti social behaviour, assault occasioning actual bodily harm (x5), nuisance calls (harassment order issued) and concern for persons welfare (found safe and well). c) Traffic Matters: -
(i) Constable Hodgson said that three tickets had recently been issued for obstruction/parking on the bus stop outside of the Boathouse. (Noted)
(ii) In answer to a comment from a parishioner, PC Hodgson said he had just noted vehicles were contravening parking regulations in the vicinity of The Boathouse/Beach Flood Defence Gate and this would be receiving his attention immediately after the meeting, (Action: PC Hodgson)
d) Underage Drinking - Noise/Xmas Drink-Driving Campaign: -
(i) PC Hodgson said that both he and PCSO Cornish had been visiting public houses in the area to raise awareness about drink driving and that they had received a really good reception and impact on patrons and landlords. (Noted)
(ii) PCSO Cornish said he was intending to circulate posters to promulgate these campaigns throughout the parish (public houses, bus shelters etc) particularly over the Xmas period. (Noted)

2712/5 PARISHIONERS
a) Thanks to Council: -
A parishioner thanked Council for all it did for the parish and wished Cllrs a Merry Christmas and Happy New Year. (Noted)

b) New Instow School/Playing Field – Planning Application: -
A parishioner spoke in favour of the new Instow School and Playing Field being built on the Lay By site; he said he had written a letter personally to all Instow Cllrs but wished to also speak publicly to reiterate his support for the project. He said that Instow School demonstrated extremely high standards and served the community well, including Yelland, whose previous school catchment area had been absorbed into the Instow area when the school at Yelland had closed about 20 years ago. 2712/6 REPORT COUNTY COUNCILLOR R CANN
(a) Traffic Issues – Update: -
Cllr Cann said he was to meet up with the members of IPC’s Traffic Management Sub Committee in the very near future and that the Clerk had prepared and circulated a report to each member for use at the meeting. (Noted)
(b) Children’s Play Area: -
(i) Cllr Cann said that DCC had, since the last meeting, superimposed the relevant land under its ownership onto a satellite picture of the area concerned; he provided copies for Cllrs to view. (Noted)
(ii) After a discussion it was RESOLVED to have the land in question surveyed by an appropriate officer of DCC/NDDC to establish whether the land was suitable for use as a children’s play area and if so, to have a footprint diagram drawn up to indicate what space might be available and what type of children’s playground equipment could be placed thereon. Cllr Cann agreed to deal with this. (Action: Cllr Cann)
(iii) A parishioner (through the Chair) enquired who would be responsible for this play area if and when it was established; Cllr Cann said it would become the responsibility of the parish council who would be able to draw down grants to cover some of the costs. Cllr Cann reminded Council that this project had been highlighted as a “need” in the relatively recent “Ransom Strip” consultation within the parish. (Noted)
(c) New Charter Toilet - Quay Car Park: -
Cllr Cann said this protracted matter was still ongoing and was soon to be considered by NDDC’s Executive. He said it was hoped the building works might begin in January 2008. (Noted)
(d) Recycle Litter Bin – Marine Parade: -
Cllr Cann said that a recycle litter bin had been installed on Marine Parade near to the Commodore slipway (bottom of Quay Lane); IPC thanked him for arranging to have this asset placed within the parish and in the vicinity of the beach. (Noted)
(e) NDDC and South Molton Recycling: -
Cllr Cann explained the recent impasse between NDDC and South Molton Recycling and said that NDDC was now to establish its own DLU depot at Roundswell that would give it the capacity to improve and expand its recycling programme to the tax payer. (Noted)
(f) General Report: -
Cllr Cann spoke about Investing in Devon (proposals for additional investment in the council’s strategic priorities funded through the Exeter Airport capital receipt) and DCC Cllr Grant 2008 (Cllrs will have the opportunity to bid for projects in their wards to the tune of £25,000). (Noted)

2712/7 REPORT OF DISTRICT COUNCILLOR B MOORE
Cllr Moores spoke of the Integration of NDDC and TDC (there were no such plans – any proposals would need to be supported by a strong business case), NDDC CEO Selection (in light of the referral of the future of local government in Devon to the Boundaries Committee, NDDC’s Executive had decided to recommend to NDDC to put this process on hold until the picture becomes clearer), Review of Polling Stations (review to take place in 2008/9), Waste and Recycling Portfolio (see item 2712/6 (e) above) and Community Council Grant (£500 has been awarded to the North Devon Cricket Club towards the purchase of a roll on cricket net). It was RESOLVED that the November 2007 minutes of Instow Parish Council be approved and signed. (Noted)

d) Item 2711/10 (b) - Clean N/hood Act – Dog Control Order: -
(i) The Clerk updated IPC on his liaison with the Clerk to Combe Martin Parish Council and particularly NDDC’s Environmental Health Department; he provided Cllrs with a copy of the salient part of a email (dd 29.11.07) from NDDC’s EH Dept that set out the current situation as regards Instow’s beach and its by-law status etc. The Clerk confirmed he had replied to this email and provided a copy of a map that indicated those parts of Instow Sands that were leased by the parish council from the Crown Commissioners. (Noted)
(ii) After a brief discussion it was RESOLVED to defer this matter to the next meeting to allow Cllrs time to digest the information contained in the relevant email and to hopefully permit NDDC’s EH Department more time to clarify the situation and get back to The Clerk. e) Item 2711/11 (i) (a) – Marine Parade/Sewer Pumping Station Replacement: -
(i) The Clerk reminded Cllrs with email access (others received a copy with their agenda papers 6.12.07) that he forwarded a copy of the proposed one-way system to them (21.11.07) that had been received from the contractors. (Noted)
(ii) The Clerk also referred to emails (dd 28.11.07) received by him from DCC Local Services and Cllr Cann (DCC) together with a notice as regards said road closure and a map showing the details of the diversion; he said he had also copied these papers to Cllrs with their agenda papers and had also placed a copy at the Post Office for the information of parishioners. f) Item 2711/11 (i) (g) – Tarka Trail/Access Improvements – NDCCS: -
(i) The Clerk advised IPC that he had forwarded IPC’s views as regards these proposed improvements to NDCCS (email – 16.11.07) and that he had received a positive and constructive reply (email of 20.11.07 refers). He read this email to Council. (Noted)
g) Item 2711/11 (i) (h) – NDDC/TDC Core Strategy Development Plan: -

i) Item 2711/11 (i) (l) – Parish Carol Singing Event (9th December 2007): -
The Chairman and Clerk provided IPC with an update i.e. it had been held in the Parish Hall because of inclement weather, approximately 100 people had attended and £129.28 had been collected for charity (see finance item 2). (Noted)
j) Item 2711/13 (c) – Venn Cross Bus Shelter/Lighting: -
(i) The Clerk reported he had made contact with a company called Solagen (email 20.11.07) as regards a quotation for a solar powered lighting system at this location and in fact met a sales representative on site on Friday 30th November. He said the quotation had arrived by email (9.12.07) = £1419.00 (plus VAT - recoverable) but this did not include provision of a post that was necessary, (Noted)
(ii) The Clerk advised IPC that he had received a quotation from SEC Ltd for the provision and installation of a post - £395.00 (plus VAT – recoverable). (Noted)
(ii) The Clerk advised IPC of his quest for a grant to cover these costs and of the outcome i.e. Cllr Cann (DCC) had agreed to finance all costs from his DCC Cllr allowance – Cllr Cann confirmed this to be the case. (Noted)
(iii) After a discussion IPC RESOLVED to proceed with this project and thanked Cllr Cann most sincerely for providing the grant to pay for it. (Noted)
k) Item 2711/13 (d) – Wooden Kiosk/Instow Beach (Rear of Boathouse Bus Shelter) -
The Clerk confirmed he had written to DCE (dd 17.11.07) enquiring what its intentions were for this hut but that no reply had been received as of date of meeting. (Noted)




2712/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 15.11.07) from TDC reference “Planning and Compulsory Purchase Act 2004: Draft Supplementary Planning Documents: Area Design Statements for Appledore, Northam and Westward Ho! and Associated Sustainability Appraisal – TD Local Development Framework”: -
(i) The Clerk said this stated that this document had now been published for consultation, the main purpose being to provide design guidance for development control purposes. The full document was available on www.torridge.gov.uk/dawn and if IPC wished to make any comments it could do so on above website or by email at dawn.spd@torridge.gov.uk or by post and by 5 pm on 10th January 2008. b) Letter (dd 12.11.07) from Defra reference “Bathing Water Quality: Consultation on the Implementation of the Revised Bathing Water Directive”: -
(i) The Clerk said letter invited views on the above consultation and in particular responses to the 9 questions in the document (summarised on page 7 of the document); the document could be found on Defra’s website, namely, www.defra.gov.uk/corporate/consult/bathingwaters/index.htm (Noted)
(ii) The Clerk reminded Cllrs he had provided them with a copy letter with their agenda papers (6.12.07) in addition to the list of questions as at (i) above. (Noted)
(iii) The Clerk said he had also provided Cllrs with a copy of the “Defra News Release 2007 Bathing Season Report “that he had copied from the Defra’s website. (Noted)
(iv) The Clerk told IPC that any response should be received by Defra by 4th February 2008. (Noted)
(v) It was RESOLVED to defer this item until the next IPC Meeting to allow Cllrs to consider a response; Cllr Green agreed to look into the questions and come back to the January meeting with a suggested reply. (Action: Cllr Green)
c) Telephone call followed by letter (dd 16.11.07) from Nationwide reference “Deeds and Associated Papers – The Green, Instow”: -
(i) The Clerk said this stated that following an audit of securities held by the Society it transpired it held some documents in respect of the above property that it no longer required and wished to pass them on to IPC in the hope it might prove beneficial to any research into local history. (Noted)
(ii) IPC RESOLVED to pass the information to Dr Allison Grant (Instow Historian); Cllr Moores to deal. (Action: Cllr Moores)
(iii) The Clerk agreed to notify the Nationwide of the outcome. (Action: The Clerk)
d) Letter (dd 28.11.07) from NDDC reference “Parish Polls and EU Referendum”: -
(i) The Clerk said the letter clarified the legal situation, that was, under paragraph 18(4) of Schedule 12 of the LGA 1972 “a poll may be demanded before the conclusion of a parish meeting on any question arising at the meeting; but no poll shall be taken unless either the person presiding at the meeting consents to the poll and it is demanded by not less than 10, or one-third, of the local government electors present at the meeting, whichever is the less”; there are similar provisions in paragraph 34(4) relating to Community Councils. The Clerk said the letter went on to refer to the various interpretations of this paragraph/schedule and that he had copied it to Cllrs with their agenda papers (6.12.07). (Noted)

e) Email (dd 5.12.07) from DCC reference “Unitary Update – Exeter City Council”: -
(i) The Clerk said this stated that the government had announced that it would not be proceeding with Exeter City Council’s proposals for a unitary council for the city. Instead, it had asked the independent Boundary Committee, a division of the Electoral Commission, to carry out a thorough review of local government arrangements in Devon and report its findings in 12 months. (Noted)
(ii) The Clerk reminded Cllrs he had copied the letter to them with their agenda papers (6.12.07). (Noted)
(iii) The Clerk told IPC there was similar correspondence reference this matter contained in the miscellaneous folder as at 2712/10 (iii) (a) (v) and (viii) below). (Noted)
(f) Letter (undated – received 8th December 2007) reference “Register of Electors 2008”: -
(i) The Clerk advised IPC that the number of parishioners had fallen yet again to 655 (734 in 2002). (Noted)
(ii) The Clerk confirmed that the relevant public notice had been exhibited at the post office as requested. (Noted)
(g) Copy email (dd 10.12.07) from a parishioner to Cllr Cann DCC reference “Down Road, Instow”:-
(i) The Clerk said this concerned a complaint about Down Road (lower section) which was left a total mess after periods of heavy rainfall. It suggested that Instow Parish Cllrs “seem unwilling or are unable to deal with the matter” and invited Cllr Cann to meet the complainant on site; it had been sent to IPC for information. (Noted)
(ii) IPC RESOLVED to place on record that this was the first time such a problem had come to its attention. (Noted)
(iii) Cllr Cann said he had met the parishioner earlier in the day and that the matter was in hand. (Action: Cllr Cann)

5. MISCELLANEOUS: -
a) Contractors – Use of IPC’s Equipment: -
(i) The Clerk referred to an email from the Allianz Cornhill (dd 16.11.07) that stated that if the parish council maintained and inspected the relevant equipment (chain saw/engine blower) on a regular basis this was acceptable as far as its policy is concerned; however, all inspections and maintenance of the equipment should be logged. (Noted)
(ii) After a discussion IPC RESOLVED to adopt this policy and to act as necessary albeit IPC recognised that any servicing of said equipment would be minimal. (Noted)
b) NDDC – Recovery of Election Costs: -
(i) The Clerk confirmed that he had advised NDDC (email 16.11.07) that IPC understood that the Executive were reviewing such payments and that IPC had no intention of paying this until the conclusion of that review. (Noted)
(ii) The Clerk referred to an email (dd 16.11.07) from NDDC stating that above information was to known to it but that the claim would be investigated. (Noted)
(iii) Cllr Cann said this matter was to be discussed by the full NDDC and that IPC would be advised of the outcome in due course. (Noted)
(iv) IPC RESOLVED to take no further action in the meantime. (Noted)
(c) DCC P3 Footpath Inspection 2007/8 & P3 Claim for 2007/8:-
(i) The Clerk reported that the footpath inspections were still to be completed and that once done the necessary paperwork would be returned to DCC i.e. footpath status reports and expenditure claim for 2007/8. (Noted)
(ii) The Clerk reported that he and the parish handyman had attended a P3 Xmas Workshop at Swimbridge on 4th December; he provided a report to Council. (Noted)
(d) Letter (dd 7.11.06) from NDDC reference “Parish Council Expenditure 2007/8”:-
(i) The Clerk said he had spoken to NDDC Finance Dept (12.12.07) as regards the anticipated statement of “IPC’s proposed Parish Council Tax for 2008/9” and that it was not expected to be sent out until after the date of the current meeting. It was believed the final reply date to respond to this letter would be Friday 18th January 2008. The Clerk explained that this letter was one whereby NDDC required confirmation from IPC that the precept/grant figures are (a) acceptable and (b) whether IPC wished to have its subscription to DAPC deducted from IPC’s first precept payment. (Noted)
(ii) The Clerk advised IPC that the parish precept figure was likely to be £8 more than requested (£6,000) because IPC’s maximum grant request (i.e. £2 per head of population) was likely to be only £1,310 based on 655 head of population – Source: Electoral Roll 2008. This, he said, was a shortfall of 4 parishioners on the current (2007) electoral roll (659). (Noted)
(iii) The Clerk suggested that if this was the case that IPC reduced its grant request to £1,310 (from £1318) that would have the effect of also reducing the precept back to what was originally requested i.e. £6,000.00. (Noted)
(iv) IPC RESOLVED to adopt this recommendation. (Action: The Clerk)
(e) Theft of Seat – Jill and Eric Watts – see item2711/12 5 (f) : -
(i) The Clerk reported that the replacement seat was now in situ on Marine Parade. (Noted)
(ii) The Clerk reported that the donor of this original seat (details unknown to IPC prior to) had contacted the Clerk (26.11.07) to report it stolen; the Clerk said he had advised them of the situation. (Noted)
(f) Mole Valley Farmers – IPC Account (November): -
The Clerk advised IPC this confirmed IPC was in balance and owed nothing. (Noted)
(g) Letter (November 2007) from HM Revenue and Customs reference “Employer Annual Return Online for 2008/9”: -

(i) The Clerk said the beach cleaner had advised him that there was additional work needed to be carried out on the council’s tractor namely, warning light on dash, rev counter, electrical fault on indicators, hydraulic filters to be changed and check oil levels. He added that these jobs required special tools and testing equipment and were necessary if the tractor was to be kept in good working order. (Noted)
(ii) The Clerk reported that one reputable contractor had so far been approached to do the necessary work and provide an estimate/quotation but had declined to do so on the grounds he could not be sure of what work was necessary until he began to do the job. (Noted)
(iii) After a discussion was RESOLVED to ask another suitable contractor to provide a quote for the work. (Noted)
(ii) It was further RESOLVED that the Chairman, Vice Chairman, Cllr May and the Clerk be permitted to act on behalf of IPC if this matter (items (ii) and (iii) above) was satisfactorily resolved before the next meeting.

2712/12 PLANNING
a) Town and Country Planning General Regulations 1992 – Regulation 3: Change of use of land from agricultural to education purposes, construction of grass playing pitch with land drainage, access road and turning head. Construction of temporary path from existing school to proposed playing field at land to south of B3233, adjacent to Venn, Instow (Reference No ACB/DCC/256/2007): -
i) The Clerk reminded IPC that it had previously RESOLVED to defer this application to its meeting of 13th December 2007 for debate and decision on the grounds that a similar and intrinsically linked application for a new school on the same site was imminently expected and in order to give Cllrs, who found it necessary to declare an interest on personal/prejudicial grounds, time to apply to NDDC’s Standards Board for dispensation to debate/vote on the applications on the basis each application were vitally important issues for the parish of Instow and that otherwise IPC might not be quorate and in a position to debate/make a recommendation. (Noted)
(ii) The Clerk advised IPC he had emailed DCC Planning (29.11.07) to enquire when the new school application might be expected and was told that it might not now arrive before the 13th December. (Noted)
(iii) The Clerk further advise IPC that he had again spoken to DCC Planning (10.12.07) to enquire when the new school application was likely to be received and was told it was unlikely to be received before IPC’s meeting of 13th December; DCC, at that time, stated it was more than happy for the playing field planning application to be adjourned for deliberation until IPC’s January meeting. i) The Clerk reported receipt (8.12.07) of this application and of having passed it immediately to IPC’s PSC for attention; for response by 25th December or an extension would need to be applied for. (Noted)
(ii) The Clerk confirmed that details of the application had been placed on the Instow website for the information of parishioners. (Noted)
(iii) After discussion, led by IPC’s PSC, it was RESOLVED to recommend APPROVAL of this application but to comment as follows: -
“Instow Parish Council (IPC), although recommending approval of this application, still has reservations as regards the intention to convert The Sands Residential Home into 12 units of holiday accommodation.
IPC is of the belief that the occupants of these holiday flats, although contributing to the community in an economic sense, would provide no community input into the parish of Instow which it believes is essential in a close-knit and community minded parish like Instow.
IPC would prefer the intended flats were for residential use, partially because, it is understood, a proportion would have to be “set aside” as “affordable housing” (Instow is in dire need of affordable housing for its parishioners - this is an opportunity to provide some) and the occupants of the residential flats would not only contribute to the community in an economic sense but also proactively add to the fabric and “heartbeat” of the community.
In addition, IPC has concerns about parking issues within the confines of the Sands (at the front – there is a private lane to the rear) and access/egress (road safety issues) onto Marine Parade, a busy highway along the seafront of Instow”.
