In the absence of PC Parker (no apologies tendered) there was no report.

2503/4 PARISHIONERS
a) Planning Application No. 39545 - Erection of a dwelling on land at
Lane End Close: - A parishioner said he was horrified and concerned as
regards this planning application and cited, amongst other issues,
traffic/road safety concerns - see also item 2503/11 (c). (Noted) b)
Planning Application No 39590 - Extension to dwelling to form double
garage together with internal alterations at 5 Chichester Close, Instow
- Parishioners said they felt the published information in respect of
this application was very misleading and objected most strongly to the
proposed plans that would, amongst other things, infringe on the privacy
of neighbouring properties. One parishioner added she was also concerned
that, as a neighbour, she had not been contacted direct by NDDC Planning
Department and been advised personally of the full details of the
application. Cllr Mrs L Brown said this was most unusual, most probably
an oversight, and promised to look into it as a matter of some urgency -
see also item 2503/11 (d). (Noted and Action by: Cllr Mrs L Brown)
c) Planning Application No. 39404 - Erection of 8 self-contained units
together with erection of a workshop at The Meadows, Anstey Way, Instow:
- Concern was expressed by a parishioner at this application citing
reasons of over-development and privacy - see also 2503/11 (a). (Noted)
d) Planning Issues - 2503/4 (a), (b) and (c ) above: - (i) The Chairman
advised parishioners that their comments would be borne in mind when
Cllrs deliberated on these planning applications later in the meeting.

(ii) Cllrs Cann and Mrs L Brown reminded Council that it was within its
remit to ask them to “call in” any contentious planning applications for
consideration by Committee, thus removing the delegated powers of
planning officers. (Noted)

2503/5 REPORT COUNTY COUNCILLOR R CANN
a) General: - Cllr Cann provided a report of relevance to Instow 20 mph
Zone (traffic speeds to be monitored and if necessary painted 20 mph
roundels will be painted on to the carriageway as well as making use of
the portable flashing sign), Flooding Problems (further work is ongoing
at Marine Parade/Anstey Way), Request for Footpath Instow-Yelland
(feasibility study now in progress), Dog Bin - Atturm Footpath (now in
place), Instow Community Facilities (next meeting - 7th April), Venn
Close Light (now sorted), Instow Self Help Emergency Plan (guidance
letter from DCC available - copy handed to Clerk/Chairman), and New
Instow School Site. (Noted)
b) Waste Disposal - Wheelie Bins: - (i) Cllr Cann said there had been a
number of teething problems with the new “wheelie bin” scheme although
it was estimated that 90% of the electorate was now pleased with it. He
added that issues that required addressing were being dealt with as a
matter of some urgency and that he was pleased to report that re-cycling
had recently gone up by 12%. (Noted)
(ii) Cllr Cook asked why the local tip would not now accept household
waste - Cllr Cann said there had never been a policy in being to receive
household waste at local council tips. (Noted)
(iii) Cllr White said he anticipated there might be problems during the
summer months particularly if the weather was hot and as household
rubbish was only now collected fortnightly. Cllr Cann said the scheme
had been previously tested in the Newport area of Barnstaple and that no
problems of this nature had been encountered. (Noted)
(iv) Cllr May said he was of an opinion that fly tipping was now on the
increase as a consequence of the new household waste disposal system;
Cllr Cann said this was being monitored by NDDC. (Noted)

2503/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
Cllr Mrs L Brown said she had nothing to report. (Noted)

2503/7 MINUTES
It was RESOLVED that the February Minutes of Instow Parish Council be
approved and signed. (Noted)

2503/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2502/8 (a) - Instow Beach/Crown Estates Lease - Lifeguards: -
(i) Cllr Crombie together with the Clerk provided a verbal report of
their deliberations since the last meeting (together with Cllr Johns).
This consisted of “budget” issues of relation to the beach lease
re-assignment (the Clerk provided a “costing”/budget paper to all Cllrs
for perusal), a risk assessment of the beach, a draft beach policy and
finally their liaison with the Allianz Cornhill (AC) Insurance Company.
After discussion it was RESOLVED to provisionally adopt the proposed
beach policy as regards the checking of the beach three times a week by
the beach cleaner (Clerk to advise beach cleaner) and to explore the
costing and provision of a sign that would comply with the requirements
of the AC, i.e. “no lifeguards patrol the beach and users of the
beach/sea do so at their own risk”. (Action: Cllr Crombie/The Clerk)
(ii) It was further RESOLVED to construct a draft risk assessment policy
in respect of the beach and to bring it back to Council for approval at
the next meeting before forwarding a copy to the AC. (Action: Cllr Crombie)
(iii) Letter (dd 16.3.05) and RNLI Booklet from NDDC (Robert Crabb -
Sport and Recreation Manager) reference” Beach Safety Signs, Flags and
Symbols” - The Clerk advised Council of the content - it was handed to
Cllr Crombie to assist him with the beach risk assessment/signage
proposals as at (ii) & (iii) above. (Noted)
(b) Item 2502/9 (c) - Sandhills Ransom Strip: - (i) The Clerk updated
Council on progress since last meeting (see item (ii) below) and in
particular provided feedback on the origin of the statistics entitled
“Facility” (Page 11 “Consultation on possible community facilities at
Instow new School - 14th February 2002”). (Noted)
(ii) The Clerk advised IPC that the next meeting of the Ransom Strip
Steering Group had been pencilled in for Thursday 7th April at The Civic
Centre at 4 pm. He said the IPC members had been advised by email
(16.3.05). (Noted)
(c) Item 2502/9 (i) (c) - Parish Emergency Plan Update: - The Clerk
advised Council that he had liaised with Cllr Cann as requested (18.2.05
plus letter) as regards the format of the draft questionnaire and the
manner of the compilation of the results thereafter plus possible
funding sources - see also item 2503/5 (a) (Noted)
(d) Item 2502/12 (ii) - Wheelie Bins/Black Bags: - The Clerk reported he
had liaised with Cllr Cann (18.2.05) and that he had ascertained that
black bags would be collected every other week as per black wheelie
bins. (Noted)

2503/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
(a) Letter (dd 25.2.05) from NDDC concerning “Local Government Act -
2000/Standards Committee - Parish Council Member: - (i) The Clerk said
this letter stated that the Parish Member of NDDC’s Standards Committee
has recently given notice of his intention to retire and invited
applications from eligible Parish and Town Councillors of North Devon to
replace him. Enclosed with the letter was a copy of the terms of
reference for this position, which broadly outlined the role of the
Standards Committee; also enclosed was a copy of a person specification
that lists criteria against which applicants would be interviewed. The
Clerk said that a copy of the letter and relevant documents had been
forwarded to Cllrs with their agenda papers (10.3.05) and that he had
possession of application forms if required. Applications, he added, had
to be returned by Monday 11th April 2005, applicants would be short
listed on Wednesday 13th April and interviews would be held on Tuesday
19th April 2005. (Noted)
(ii) Cllr Mrs L Brown said that unfortunately, and according to the
relevant rules, no parish councillor within her ward (that included
Instow) was eligible as she was a substantive member of NDDC’s Standards
Board. (Noted & NFA)
(b) Letter (dd 18.2.05) from The Standards Board for England (TSBE)
referring to “A Code for the Future”: - The Clerk said this letter
stated that over the next few months, at the request of the government,
the TSBE was to conduct a review of the Local Government Code of Conduct
and invited Cllrs and Clerks to contribute to that consultation. He
added that a proforma response form was provided with the letter and
copies were forwarded to IPC Cllrs with their agenda papers (10.3.05) -
deadline for responses to the consultation is 17th June 2005. IPC, after
discussion, RESOLVED that this was a matter for individual Cllrs who
might decide to respond direct as necessary. (Action: IPC Cllrs)
(c) Instow Parish Council - Dates 2005: - The Clerk reminded Cllrs he
had circulated a copy of IPC’s meeting dates 2005 with their agenda
papers (10.3.05) and that other copies would be published throughout the
parish as usual. (Noted)
(d) Instow Parish Council - Cllr Data: - The Clerk reminded Cllrs he had
circulated a copy of the most recent list (July 2004) with their agenda
papers (10.3.05) and ascertained, through the meeting, that the data
thereon was still correct. He said he would circulate an updated version
throughout the parish. (Action: The Clerk)
(e) Local Government Act 2000 - Declaration of Interests: - (i) The
Clerk advised IPC he was endeavouring to organise some training on this
subject for Cllrs and/or Clerk following liaison with NDDC and DAPC; the
Clerk reported upon progress to date. (Noted)
(ii) The Clerk advised Cllrs that it was their sole responsibility, as
individuals, to decide whether they needed to declare an interest
(personal or pecuniary) on any topic brought before Council and not for
the Clerk, for example, to direct, advise or lead them. He added that if
in doubt, guidance could be sought from NDDC’s Monitoring Officer. The
Clerk then referred to “The Standards Board for England Guidebook”
entitled “How do I register and declare interest and register gifts and
hospitality”; he reminded Cllrs that copies had been circulated to them
in July 2003 (see item 2307/8 (a) (iii)). (Noted)
(f) Copy email (dd 4.3.05) from Andy Bell (NDCCS) to DCE concerning
“Instow Dunes Restoration Work 12/13th March”: - The Clerk appraised IPC
of the contents - it was noted that the work had been completed. (Noted)
(g) Instow Parish Council - Traffic Management Sub Committee 2005: -The
Clerk suggested it might be timely, in conjunction and with Cllr Cann’s
facilitation, to seek a site meeting in the very near future with the
DCC Local Services Manager to consider necessary traffic management
issues for Instow for 2005/6. After discussion it was RESOLVED to make
one request of DCC only and that was for the creation of a pedestrian
refuge on Anstey Way at its junction with Rectory Lane - the Clerk was
asked to confirm this request to DCC and Cllr Cann agreed to speak on
its behalf. (Action: Cllr Cann and The Clerk)
(h) Letter (dd 10.3.05) from NDDC (Jeremy Mann - Environmental Health
Manager) reference “NDDC Briefing on the Licensing Act 2003”: - The
Clerk said this letter invited representatives of IPC to a briefing on
the Licensing Act 2003 on the 22nd March 2005 at The Taw Room of the
Civic Centre at 7 pm; he provided Cllrs with a copy of the letter. (Noted)
(i) Letter (dd 8.3.05) from Defra/dti concerning “Partnership in rolling
out broadband to rural communities”: - The Clerk said this letter sets
out Defra’s strategy to introduce broadband into the community and
enclosed a CD-ROM (“A New Way to Live, Work and Play - Making Sense of
Broadband”) to reinforce its strategy. The Clerk provided Cllrs with a
copy of the letter - the Chairman took possession of the CD Rom. (Noted)
(l) Devon In Touch Roadshow (DITR) - Village Show 2005: - The Clerk
reported that the DITR would be at The Commodore Car Park between 11 am
and 4 pm on Thursday 9th June. (Noted)
(m) Letter (dd 12.3.05) from Robert D Wright AB11 (Licensing Consultant)
reference “Notice of Application - Transfer/The Wayfarer Inn, Instow”: -
The Clerk said he had acknowledged receipt of this letter which he read
out to Council. After discussion IPC RESOLVED to offer no objection/take
NFA. (Noted)
(n) Email (dd 17.3.05 - copied to Cllr Cann) from parishioner concerning
“Footpath (Crowbarn), Venn Cross Refuge, Lane End Toilets, Lane End
Development and Refuse Collection”: - (i) The Clerk read the email to
Council and answers to all questions were provided to the parishioner
who was present at the meeting. (Noted)
(ii) Charter Lane End Toilets: - Following a discussion IPC RESOLVED to
request of NDDC that a sign be placed at or near to the Anstey Way
lay-by directing persons to these toilets; Cllr Cann agreed to take this
up. (Action: Cllr Cann)

5. MISCELLANEOUS: -
(a) Beach Grant 2004: - The Clerk reported upon progress since the
previous meeting, that is, he had received (2.3.05) and returned
(2.3.05) a NDDC Community Grant application form (x15 pages) and an
answer was still awaited. (Noted)
(b) Seats: - (i) The Clerk confirmed that all 8 condemned seats had been
removed from Marine Parade by the handyperson and himself and that 6
“new seat” letters had been sent out to potential donors. (Noted)
(ii) The Clerk advised Council that the handyperson had provided an
estimate for the agreed (January 2005 Meeting) re-staining of parish
seats, that was, £250 (i.e. 19 seats at £12 per seat plus stain
estimated at £22). IPC RESOLVED to accept this estimate and the Clerk
was asked to advise the handyperson. (Action: The Clerk)
(c) War Memorial - Insurance: - The Clerk updated IPC - he said he had
made contact with Peter Roberts (Stonemason) and that he had provided an
estimate for replacing the war memorial (i.e. replace; letters etc) =
£25,000 plus £800 for lettering and Vat = £30,315.00. After discussion
it was RESOLVED the Clerk should write to the Allianz Cornhill Insurance
Company so as to establish the costs of the premium to insure the war
memorial. (Action: The Clerk)
(d) Letter (dd 21.2.05) from South and West Internal Audit (Ken Abraham
ACIS AMIMC AIMgt): - The Clerk said the writer offered his services to
IPC for its internal audit 2004/5. The Clerk reminded Cllrs that Mr G
Day was IPC’s Internal Auditor. (Noted)
(e) Email (dd 8.3.05) from DAPC concerning “Section 137 Cash Limit from
1st April 2005”: The Clerk said this email advised IPC that the cash
limit for Section 137 expenditure was to rise to £5.30 per elector with
effect from 1st April 2005 thus catching up with, and correcting, the
loss of indexation for the year 2004/5 for which the value remained at
£5 per elector. (Noted)
(f) Letter (dd March 2005) from Devon Playing Fields Association (DPFA)
concerning “Membership Fees 2005/6: - The Clerk reported that DPFA were
advised annually that IPC had no playing fields within the parish and
that membership was declined. He suggested NFA on this occasion adding,
however, that it might be appropriate to seek membership if the “playing
fields” at the new Instow School should ever materialise. IPC RESOLVED
to agree. (Noted)

2503/11 PLANNING
a) Erection of 8 self contained residential units together with erection
of workshop/store at The Meadows, Anstey Way, Instow (Reference No.
39404) - see also item 2503/4 (c)): - (i) The Clerk reported receipt
(21.2.05) and of having posted it to the Chairman (21.2.05) for the
attention of IPC’s PSC; he said an extension for response from IPC
(11.3.05) had been applied for. (Noted)
(ii) The Clerk reported receipt of 2 emails from parishioners with
reference to this application; he briefed Cllrs as to the content. He
said he had advised both parishioners to write directly to NDDC Planning
Dept. (Noted)
(iii) The Clerk then read aloud three letters from parishioners as
regards this application. (Noted)
(iv) After discussion, led by the Planning Cllrs, IPC unanimously
RESOLVED to recommend REFUSAL of this application on the grounds of
“over development of the site and not in keeping with surrounding
properties/visual impact, adverse affect on privacy of adjoining
properties, car parking issues both within the site and on adjoining
roads, development could exacerbate flooding problems as recently
experienced by neighbouring properties due to the run-off from new
buildings/hard surfacing, road safety concerns - the existing access in
Anstey Way is inadequate to service the proposed development and part of
the proposed development is outside of the Local Plan Development
Boundary. (Action: The Clerk)
(v) IPC RESOLVED to ask Cllrs Cann and Mrs L Brown to “call” this
application in for consideration of committee. (Action: Cllrs Cann and
Mrs L Brown)
b) Letter (dd 17.2.05) from NDDC (Andrew Austen - Senior Planning Policy
Officer) concerning “Previously Developed Land and Buildings in North
Devon”: The Clerk said that NDDC was soon to start its review of its
Urban Capacity Strategy (UCS) for North Devon, the purpose being to
estimate the potential capacity for new housing on previously developed
(“Brownfield”) land and buildings within the main settlements of North
Devon in order to assess how much additional “Greenfield” land would be
required to provide sufficient housing land for the district. He said
IPC was asked to consider possible sites (as per above criteria) within
the parish and to pass this information on to NDDC within two months of
the date of the letter (i.e. 17.4.05). He reminded Cllrs he had copied
the letter to them with their agenda papers (10.3.05). After discussion
it was RESOLVED to consider this request and bring any recommendation(s)
back to Council within the allotted time. (Action: IPC Cllrs)
c) Erection of a dwelling on land at Lane End Close, Instow (Reference
No. 39545) - see also item, 2503/4 (a)): - (i) The Clerk reported
receipt (4.3.05) and of having posted it to the Chairman (5.3.05) for
the attention of IPC’s PSC - final date for response 23.3.05 or
extension to be applied for. (Noted)
(ii) After discussion, led by the Planning Cllrs, IPC unanimously
RESOLVED to recommend REFUSAL of this application on the grounds of “the
application was contrary to the “open” space design of the estate, it
would bring about the loss of an open space amenity, would create
hazards of a road traffic nature and there was a current condition to
landscape this plot as an amenity area - this has not been complied
with”. (Action: The Clerk)
(iii) IPC RESOLVED to ask Cllrs Cann and Mrs L Brown to “call” this
application in for consideration of committee. (Action: Cllrs Cann and

d) Extension to dwelling to form double garage together with internal
alterations at 5 Chichester Close, Instow (Reference No. 39590) - see
also item 2503/4 (b)): - -(i) The Clerk reported receipt (4.3.05) and of
having posted it to the Chairman (5.3.05) for the attention of IPC’s PSC
- final date for response 23.3.05 or extension to be applied for. (Noted)
(ii) After discussion, led by the Planning Cllrs, IPC unanimously
RESOLVED to recommend REFUSAL of this application on the grounds “it
would result in an over-intensification of the site, create privacy
issues for neighbouring properties as well as the loss of light, have an
adverse impact on the amenities of adjoining properties and increase
vehicular use and create road safety issues”. IPC further RESOLVED to
advise NDDC’s Planning Dept that it felt the public notices and
associated papers were extremely misleading. (Action: The Clerk)

e) Letter (undated - received 12.3.05) from NDDC Planning concerning
“Application for consent for works to trees covered by a tree
preservation order in respect of felling 1 evergreen oak and 6 sycamores
at The Commodore Hotel, Instow (Reference No 39356): - The Clerk said
this stated that NDDC had GRANTED permission for this application with
conditions as listed. (Noted)
f) Copy letter (dd 4.3.05) from NDDC Planning Manager to parishioner (Mr
M Green) concerning “Application for consent for works to trees covered
by a tree preservation order in respect of felling of 2 willows and 1
cherry at Bar Beacon and All Saints Chapel, Anstey Way, Instow
(Reference No. 39385): -The Clerk said this stated that NDDC had
resolved to raise no objection to the proposed work given that it was
considered the trees were in a dangerous condition and works should be
completed to make safe; works must take place within 2 years of the date
of the letter and it was recommended that a qualified and insured tree
surgeon be employed to carry out the work. (Noted)
g) Extension to dwelling together with a balcony at 10 White House
Close, Instow (Reference No. 39662): - -(i) The Clerk reported receipt
(14.3.05) and of having posted it to the Chairman (14.3.05) for the
attention of IPC’s PSC; final date for deliberation 1.4.05 or extension
to be applied for. (Noted)
(ii) The Chairman reported that to date, he had not received this
application through the post. The Clerk said he had already contacted
NDDC Planning Department and requested a further copy be sent to the
Chairman asap. (Noted)

2503/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
a) Cyberspace Notice Board (Website) : - The Chairman said he felt it
was appropriate to advise parishioners, via this communication facility,
to write to NDDC’s Planning Department to register any complaints as
regards planning applications and to copy it to The Clerk and Cllrs Cann
and Mrs L Brown. IPC RESOLVED to endorse this recommendation. (Action:
Chairman)
b) Doggy Bin - Anstey Way/Rectory Lane: - Cllr White said it might be
appropriate to provide a doggy bin at this location (near to the gate to
footpath No. 16) as this footpath was as equally well used as the Atturm
footpath that had recently been provided with a new doggy bin. IPC
RESOLVED to support this recommendation - Cllr Cann said he would look
into it and report back. (Action: Cllr Cann)
c) Marine Court Charter Toilets: - (i) Cllr Cook asked if there was an
update as regards these toilets. Cllr Cann said the relevant planning
application was still very much “alive” - Officers of NDDC were
considering the worth of the land (for the provision of 14 flats, as per
the “current” planning consent) that must be somewhere in the region of
£700,000. (Noted)
(ii) Cllr White enquired whether these flats might include affordable
dwelling opportunities for local parishioners; Cllr Cann said it was too
early to decide upon this. (Noted)
d) Atturm Footpath - Water Sumping: - Cllr May said this footpath,
approximately half way, was very wet and that a channel was needed to
allow the excess water to drain off. It was RESOLVED the Clerk should
contact the parish handyperson; Cllr White said he would liaise with
Atturm to see what action(s) it might be able to take in addition.

e) Instow School Footpath - Bridge: - Cllr May said the culvert
underneath this bridge was blocked and that some repairs to the bridge
were also necessary. It was RESOLVED that the handyman be asked to deal.

f) Marine Parade - Seawall: - Cllr Ms A Mayoh said that a number of
holes had appeared in this wall - the Clerk advised Cllr Ms A Mayoh that
this had been reported at the last meeting and that the DCC Local
Services Manager had been notified. (Noted)
