MINUTES OF THE OCTOBER 2003 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 16th OCTOBER 2003 - 7.30 PM

2310/1 PRAYER
The Clerk led the Council in prayer.

2310/2 APOLOGIES

2310/3 POLICE REPORT
(a) General: - In the absence of Constable Johnson there was no report. (Noted)
(b) Traffic Matters; - Cllr Green said he was concerned at the apparent disregard by motorists of the 30 mph speed limit in Anstey Way. After discussion it was RESOLVED to notify Constable Johnson and enquire if some form of speed enforcement and monitoring could take place. (Action: The Clerk)

2310/4 PARISHIONERS
Marine Parade - Blown Sand: - A parishioner enquired as to what action was proposed to deal with the blown sand that had settled on the highway/pavement following the recent bad weather. The Chairman said the matter was in hand (DCC had notified IPC of its intentions to move it) and would be discussed in more detail later in the meeting - see item 2310/9 (v). (Noted)

2310/5 REPORT COUNTY COUNCILLOR R CAN
(i) Boathouse Telephone Kiosk: - The Clerk said Cllr Cann wished to inform IPC that DCC Highways intends to increase the pavement width in the vicinity of this kiosk (TK), by approximately 1 metre, in the very near future so as to enable disabled access passed the TK without needing to go into the road (Item 2309/5 (b)). Cllr Cann also wanted IPC to know that it was intended to (Noted)
(ii) Resurface - B3233 between the junctions of Westleigh and Huish Cllr Cann also wished IPC to note that this was in the pipeline in the very near future. (Noted)

2310/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
In the absence of Cllr Mrs Brown there was no report. (Noted)

2310/7 MINUTES
It was RESOLVED that the September 2003 minutes of Instow Parish Council be approved and signed. (Noted)

2310/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2309/8 (d) - Community Alliance: - The Clerk reported that Ian Hobbs (IH) (DCC) was unable to visit IPC on 16.10.03 and give a talk but was in the throes of writing to the Chairmen/Vice Chairmen and Clerks of the parishes of Fremington, Instow, Horwood, Westleigh and Tawstock to invite all to a presentation (approx 1 hour) at the Civic Centre, Barnstaple at 6.30 pm on Monday 10th November 2003. The Vice Chairman said he would be unable to attend; Cllr Scott offered to take his place - IPC RESOLVED to support this. (Noted)
(b) Item 2309/8 (f) - Toilets - Marine Parade/Sand Dunes & Quay Car Park: - (i) The Clerk said he had recently received an email from Geoff Barclay (GB) - NDDC (14.10.03), in response to his of the 21st September 2003, that confirmed he had spoken to NDDC Cllr Mrs Sue Sewell (Portfolio Holder Environment) and that she had indicated as follows: - “We (NDDC) would be able to arrange a meeting but it would be most unlikely that any change could result to the Instow situation as previously discussed”. The Clerk said he had replied to the effect that IPC still wanted a “face-to-face” and “on-site” meeting with NDDC and that its alternative proposal to a Charter toilet on the Quay Car Park (i.e. x 2 single unit unisex toilets with disabled facilities - Quay Car Park and Sand Hills/Marine Parade) would make little difference as regards overall costs. The Clerk said he still awaited a reply to this email. (Noted)
(ii) The Clerk reported receipt of an email (7.10.03) from Cllr Harper reference the poor state of the current parish toilets; Cllr Harper elaborated. After discussion it was RESOLVED that Cllr Harper should raise these issues at the “on site” meeting being arranged as at (i) above. (Action: Cllr Harper)
(c) Item 2309/8 (k) - Hedge Trimming - Rectory Lane: - (i) The Clerk reported on his recent enquiries with DCC (Steve McCrory) - i.e. DCC only cuts certain category roads (main roads) and where road safety is paramount. Otherwise it is the landowners’ responsibility. After discussion it was unanimously RESOLVED that IPC would do all it could to “encourage” the cutting of Rectory Lane by the relevant landowners at a suitable time in 2004 (May/June) so as to improve the road safety for school children and their families going to and from Instow school (both on foot and in vehicles) prior to them breaking up for the summer term The Clerk distributed various guidelines he had received from Steve McCrory (DCC) (Noted)
(ii)The Clerk said he had received a request from DCC (Steve McCrory) to identify the landowners/occupiers of land adjacent to B3233 at Welch’s Lane/B3233 and Rectory Lane/B3233; he said DCC had received complaints as regards overgrown brambles at these locations that impeded the progress of pedestrians on abutting footpaths. It was RESOLVED the Clerk should take the appropriate action and provide DCC with the necessary details. (Action: The Clerk)
(d) Item 2309/9 (b) - Instow Beach Water Results 2003: - (i) The Clerk reported receipt of a great deal of information from various agencies (particularly a letter from NDDC (dd 24.9.03) - Mr Millie; Clerk outlined to Council) since the last meeting where it was resolved to consider the formulation of some form of positive publicity at the October meeting of IPC. The Clerk said all the data confirmed that Instow had passed the EU Mandatory Standards 2003. Mrs Day (TTEF Chairman), who was present, said that the TTEF publicises the relevant data on its website (www.ttef.org.uk <http://www.ttef.org.uk>). After discussion it was RESOLVED to seek guidance from the Environment Agency/NDCCS (particularly reference use of beach notice boards), send a letter to the North Devon Journal (subject to the advice provided) and place a poster on the parish notice boards. (Action: The Clerk)
(ii) The Clerk referred to The Environment Agency’s free phone telephone number to which “suspect” discharges of effluent into the Taw/Torridge should be reported - 0800 - 807060. He added the only discharge that should remain is the “old Yelland outfall pipe” (situated between the jetty’s of the old power station and oil terminal) in that it is now an intermittent storm overflow and/or emergency overflow although there should not be any continual discharge (unless immediately after heavy rain) occurring at this location or anywhere near it. (e) Item 2309/9 (g) - Code of Practice - Local Councils in Handling Complaints: -
The Clerk said he had been unable to type up this policy but that he hoped to have it ready for consideration/approval of IPC at its November/December meeting. (Noted)
(f) Item 2309/9 (h) - DAPC AGM 2003: - The Clerk reported upon his attendance at this excellent meeting and spoke to the main issues viz: -
A talk given by the Chief Constable of Devon and Cornwall Constabulary - Maria Wallis - new cheaper telephone number to Police HQ is 08452 777 444.

(g) Item 2309/12 (b) - Braunton Biosphere Talk: - The Clerk said he had spoken to Andy Bell (15.10.03) and subject to him still being “responsible” for The Biosphere (NDCCS is currently going through a restructure) would gladly come and talk to IPC at its January meeting. The Clerk said that Andy Bell was to contact him and confirm asap. (Noted)

2310/9 CORRESPONDENCE
(i) TTEF Correspondence: -
(a) Email (dd 9.10.03) from the Chairman TTEF together with attachments reference “Report of meeting of TTEF 6th October 2003”, “Letter from TTEF to NDCCS concerning Braunton Burrows Biosphere Reserve & Review of NDCCS” and “Letter from TTEF to Taw Torridge Estuary Jet Skiers and Caesar Thunder Car Owners”: - The Clerk said the Chairman of the TTEF had sent this direct to Cllrs Scott, Mayoh, Harper, Crombie, Johns and White (by email) and copied it to Cllrs Cook, May and Green by post. Mrs R M E Day (Chairman TTEF) spoke to these papers and answered questions posed by Cllrs. The Chairman thanked Mrs Day for coming to the meeting. (Noted)

(ii) Other Correspondence: -
(a) Telephone Call (19.9.03) from Cllr May reference allegations of “inappropriate” use of Huish Road to access Holmacott Tip by Coles Tractor/Trailers - damage to Hedges etc: - The Clerk said he had contacted DCC by sending an email (22.9.03, initially to Andy Bowman, and then to Andy Hill (3.10.03) so that the necessary enquires could be made. He had since been reliably informed that this was now in the hands of Andy Bowman/Nicola Wilson. (Noted)
(b) Letter (received 22.9.03) from Devon Playing Fields Association reference “Subscription Fees 2003/2004”: - The Clerk outlined the purpose of this letter at the conclusion of which it was RESOLVED to advise writer that IPC had no playing fields. (Action: The Clerk)
(c) Instow School Newsletters (12.9.03 and 19.9.03) from Headteacher Peter Kent for information of IPC: - The Clerk said that Peter Kent wished IPC to note that the school does advise parents of the use of appropriate speed in Rectory Lane, both to and from the school, as was outlined in both Newsletters. (Noted)
(d) Email (dd 23.9.03) from Parishioner (David Jeremy) for the attention of the Chairman concerning “Hedge cutting (Rectory Lane), Speeding in Rectory Lane, RSPB and “Freddy” the Cock Pheasant”: - The Clerk confirmed he had copied this to the Chairmen. The Chairman asked the Clerk to read it out for the information of IPC. (Noted)
(e) Letter from North Devon Community Health Council concerning “Public Involvement Contacts Database: - The Clerk confirmed he had taken the necessary action and reminded IPC that CHC’s were about to be abolished (as of 1st December) and that above records would be held by ND PCT subject to the willingness of relevant bodies; the ND PCT commissions NHS services in North Devon and has a statutory duty to involve local people in monitoring and developing “Public Involvement Contact databases”. IPC RESOLVED to support this. (Noted)
(f) Telephone Call (30.9.03) from Cllr May reference broken down and apparently abandoned car (facing Bideford) on B3233 Rectory Lane/Marine Parade opposite Atturm Camp - causing an obstruction:: - The Clerk reported he had notified Devon & Cornwall Police - Log Number 302/30.9.03. (Noted)
(g) Letter (dd 4.9.03) from DCC reference “Caredirect Devon” including a number of leaflets and handouts: - The Clerk advised IPC of the principles of Caredirect and confirmed he had placed the leaflets/handouts at Instow Post Office. (Noted)
(h) Letter (September 2003) from MORI reference The Standards Board and Matters Akin with accompanying questionnaire for completion by Clerk and a “random” Cllr (Cllr Harper): - The Clerk and Cllr Harper confirmed they had returned their questionnaires. (Noted) (i) Letter (dd 22.9.03) from DCC reference “Public Access to Countryside: Rights of Way Improvement Plan (ROWIP) and Consultation Document for Parish Councils: - The Clerk said this questionnaire needed to be completed by the 28th November 2003. It was RESOLVED the Clerk should deal. (Action: The Clerk)
(j) Telephone Call (3.10.03) from parishioner concerning Fire at Quay car Park Toilets: -The Clerk said the parishioner had confirmed that the Fire Service had been in attendance. He added he had heard nothing since from either NDDC or the Police but that perhaps PC Johnson could update IPC at the next meeting. (Noted)
(k) Letter from Devon and Cornwall Police Authority concerning North Devon Police Liaison Meeting at Ilfracombe on 22nd October 2003: - The Clerk said he had copied this to Cllr Mrs A Mayoh, for information only, and had placed a copy of the poster in the Post Office. (Noted)
(l) Letter (dd 9.10.03) from Northern Devon Community Transport Association Ltd reference “”A Study of the Transport Needs of Young People in the North Devon District Area: - The Clerk said he had passed this to Cllr Green for perusal and attention. (End of consultation period 14th November 2003). (Noted)
(m) P3 Footpaths - Survey 2003/4: - (i) The Clerk said he had liaised with Andrew Moulton (NDCCS) and awaits a copy of his survey report of Instow’s footpaths before embarking on his survey (2003/4) together with Mel Harris. (Noted)
(ii) The Clerk said the P3 Xmas Workshop had been arranged for 10th December 2003 at Chittlehamholt. It was RESOLVED the Clerk would attend with Mel Harris (Handyman). (Action: The Clerk and Mel Harris)
(n) Letter (dd 10.10.03) from Members Services of NDDC reference “DAPC Ethical Framework Training - 29th October 2003: - The Clerk said he had copied this to all Cllrs and that he was to attend. (Action: Cllrs)
(o) Email (dd 8.10.03) from Nadeem Rehman from India requesting to join North Devon Cricket Club: -The Clerk reported that this was the second email received from Nadeem, the first (12.7.03) having been passed to David Lea (Treasurer NDCC) for attention. The Clerk said he had replied to the effect his details had already been passed to NDCC but that a letter in support, by him, might be appropriate. The Clerk finalised by saying he had advised David Lea. (Noted)
(p) Email (dd 10.10.03) from Jon Turner (Community - NDDC) concerning Beach Management Conference on Friday 8th November 2003 at Civic Centre, Barnstaple: -It was RESOLVED that Cllr Cook would attend and represent IPC; any agenda items to the Clerk prior to 1st November. (Action: Cllr Cook)
(q) (i) Letter (September 2003) from SLCC reference Regional One day Conference on Quality Councils at Gloucestershire County Cricket Ground on Monday 15th December 2003: - The Clerk said this was for noting by IPC. (Noted)
(ii) Notes of SLCC AGM and Branch Meeting held at Exminster Village Hall on 19th September 2003: -Noted by IPC. (Noted)
(r) Various items of correspondence from DAPC concerning “Budgeting and Financial Risk Assessment” Training at Tiverton on 26th November 2003, “Quality Councils - Clerks AQA Qualification News”, and “Ethical Framework - Your Chance to Meet the Standards Board” at County Hall, Exeter on 20th November 2003: - This was noted by IPC. (Noted)
(s) DCC Monthly News Round Up for October 2003 together with pamphlets concerning “Discover Devon’s Gardens” & “Walking in Devon”: - The Clerk said a copy of this had been provided for Cllrs and that one had also been placed in the Post Office together with the pamphlets. (Noted)
(t) Email (7.10.03) from Cllr Harper reference Dogs on Sand Dunes and a proposal to extend the current “banning of dogs from the beach” order: - Cllr Harper led Council in a discussion at the conclusion of which it was RESOLVED he should raise this matter with those Officers/Members of NDDC’s Environmental Health Department when they visit Instow for the on site toilet meeting (vide item 2310/8 (b)) and enquire what action was intended as regards additional signing at or near the sand dunes. (See 2309/9 (w)) (Action: Cllr Harper)
(u) Email (13.10.03) from Clerk to DCC (Steve McCrory) reference sand on highway/pavement on Marine Parade due to recent heavy winds: - The Clerk said Steve McCrory had responded by email (16.10.03) to the effect that DCC was to bring in a digger to drag the blown sand back from the walls on the seaward side and to use the parish lengthsmen to tidy up the footpaths at the same time. The Clerk said he had subsequently been told this would take place not before the 22nd October when the tides would be more favourable.(see also 2310/4) (Noted)
(v) IPC - Website/Home Page: - The Clerk and Cllr Harper updated IPC on their progress to date. (Noted)
(w) Letter and enclosures (dd25.9.03) from DCC reference “Rural Transport Forum Meetings”: - The Clerk confirmed he had passed this to Cllr Green for information and attention. (Noted)
(x) Annual Remembrance Day Service at Instow Parish Church - Sunday 9th November 2003: -The Clerk said Council needed to determine who was to attend and represent IPC; he confirmed that the wreath has been ordered. After discussion it was RESOLVED that Cllrs Harper and Green would be attending and that other Cllrs would do all they could to ensure their attendance. (Noted)
(y) Parish Xmas Carol Singing Event - 6.30 pm on Sunday 7th December 2003: - IPC discussed the organisation of this event that would be situated around the Village Xmas tree at The Signal Box. It was RESOLVED the mulled wine would be provided by Cllr Johns, the mince pies by Cllrs and that all Cllrs would endeavour to be in attendance to assist it its organisation i.e. preparation, serving of drinks/mince pies, collecting monies and generally hosting the event. IPC expressed their grateful thanks to ex Cllr Mrs Carol Grant who had offered her services. (Noted)
(z) Instow Parish Council Meeting - Thursday 11th December 2003/Xmas “Do”: - The Clerk reminded Cllrs that this meeting was to be held on the 2nd Thursday of the month and that it would be followed by the Council Xmas “Do” at The Commodore. Suggestions were made as to invitees and an agreement was reached as to the funding of the event. The Clerk was asked to liaise with Mr Woolaway. (Action: The Clerk)

# Once all outstanding cheques (£52) had been cleared from this account (that was closed on 17.9.03) there was a balance of £3.51. The Portman Building Society levied this sum as their account fee for the month of September having also removed £5 in similar circumstances in August. NB: -This was the reason IPC moved from The Portman Building Society to Lloyds Bank.

5. MISCELLANEOUS: -
(a) Instow Welfare Trust: - (i) The Clerk reported that the meeting of Trustees (previously arranged for Thursday 9th October 2003) had been postponed and had still to be re-arranged. He added that the Charity Commissioners (CC) hadn’t opened Mark Kidson’s email until 1.10.03 and that it would take them up to 15 working days to send a response. The Clerk said that once a reply had been received a Trustees meeting would be convened soonest. (Noted)
(ii) The Clerk said the Chairman of Instow Parish Hall Committee was still expressing an “interest” in this account and that she was being kept informed by email. (Noted)
(b) Recreation Ground: - The Clerk provided IPC with an update adding he still awaited a written response from a “parishioner” solicitor as regards collection of the peppercorn rent from DCC and the possibility of “squatting”. (Noted)
(c) Letter and booklet from CCLA Investment Management Ltd (COIF Charity Fund) - Change to Annual Management Charges/Changes to Scheme Particulars: The Clerk said this was for the information of IPC and that the letter had been copied to Mr G Day (IPC’s IA). (Noted)
(d) Completion of Annual Audit for the Year ended 31st March 2003: - The Clerk confirmed that a response had been received from The Audit Commission (AC) (20.9.03) concerning the completion of the Annual Audit 2002/3. The Clerk added that the External Auditor had confirmed, “On the basis of “his/her” review, in their opinion the information contained in the annual return is in accordance with the AC’s requirements and no matters have come to their attention giving cause for concern that relevant legislation and regulatory requirements have not been met”. The External Auditor added ”There were no other matters, not affecting their opinion that he/she wished to draw to the attention of IPC”. The Clerk confirmed he had placed a “Notice of Conclusion of Audit and Right to Inspect the Annual Return (AR)” Form at the Post Office (26.9.03), for the information of parishioners to comply with Section 14 of the Audit Commission Act 1998 and The Accounts and Audit Regulations 2003 (SI 2003/533) and was relevant for the period 29.9.03 -10.10.03. He said that to date, no requests to examine the Annual Return had been received. (Noted)
(e) Bus Shelter (Atturm - Marine Parade): - The Clerk reported he had spoken to Jon Turner (NDDC’s Community Officer) since the last meeting of IPC and as a result completed and returned (2.10.03) a Locality Grant application form seeking up to £1,700.00 from NDDC for this project. He said the offer of £500 towards this shelter still stood from DCC (Dave Netherway). The Clerk reminded IPC that the last new stone shelter (Venn Cross) had cost £2,200.00.and that IPC’s Finance Sub Committee might like to consider the use of current reserves for this project subject to the final decision from NDDC. It was RESOLVED to await the decision of NDDC. (Noted)
(f) Beach Cleaning Grant: - The Clerk advised IPC that this had been discussed at The Barnstaple, Fremington and Instow Area Committee of NDDC on 8.10.03 and that, subject to ratification, should be paid asap - £1800.00. (Noted)
(g) Instow Parish Council Grants 2003/4: - The Clerk told IPC of a letter he had received (by email 10.10.03) from Peter Cantle (Secretary Instow Parish News Magazine) requesting payment of its grant 2003/4. The Clerk reminded IPC that this grant, together with others, is normally dealt with at the November meeting and that the writer had been advised accordingly. (Noted)
(h) Internal Audit - July to September 2003: - The Clerk, supported by Cllr Crombie, said this had been carried out on the 13th October 2003 and all had been found to be in order. The Clerk said that Cllr Crombie had also checked the records of closure of the Portman Instant Access a/c number 137-4375752-5 & Portman Current a/c number 15783618 and of the transfer, where applicable, of the appropriate monies to the Lloyds Bank Business account. (Noted)
(i) IPC Finance Sub Committee Meeting - Budget 2004/5: - The Clerk said a suitable date needed to be fixed so that a draft budget 2004/5 could be prepared and presented to the November IPC meeting. After discussion it was RESOLVED to hold it at 2.30 pm on Thursday 6th November at The Commodore Hotel. It was unanimously agreed that Mr G Day (IPC’s IA) should be invited to attend as an observer. (Action: IPC’s Finance Sub Committee)
(j) Budget 2003/2004 against Actual Income/Expenditure April to September 2003: The Clerk circulated this paper and spoke to it. (Noted)

2310/11 PLANNING
(a) Listed Buildings and Tree Preservation Orders - Instow: - The Clerk reported he had finally received (13.10.03) this information from NDDC’s Planning Dept (together with identical details from Cllr Harper (less TPO information) who had also obtained it from NDDC). After debate IPC RESOLVED to publish this information on it’s website but as a list only. Cllr Harper expressed a view that photographs should be published alongside the list but Council RESOLVED that this might infringe on individual/corporate liberties and breach confidentiality/security. The Clerk said he was still chasing NDDC’s Planning Dept for more detailed information in connection with the parish TPOs’ as to date his list did not identity specific trees, merely locations. It was RESOLVED to await this information before going live on the internet. (Action: The Clerk)
(b) Letter (dd 17.9.03) from Mr C Dryden (Senior Policy Planner) concerning “Draft Supplementary Planning Guidance on Provision of Public Open Space, Sports and Recreation”: - The Clerk reported he had passed this immediately to the Chairman (24.9.03) for perusal and briefing of IPC. The Chairman outlined the purpose of the paper at the conclusion of which it was RESOLVED that IPC was not in a position to comment on the basis it did not have any “open spaces, sports and recreation facilities”. Clerk to advise NDDC. (Action: The Clerk)
(c) Approval of details in respect of Erection of 4 No. Dwellings, Garages and Access (amended plans) at Land at Lane End Road, Instow (Reference No. 35529): The Clerk reported receipt of this application on 4.10.03 and said he had passed it immediately to the Vice Chairman for his attention (Chairman on holiday) and that of IPC’s Planning Officers. After debate, lead by the Planning Officers, it was RESOLVED that IPC was not in a position to comment on the basis it had been sent insufficient information. The Clerk was, therefore, asked to liaise with NDDC’s Planning Department and obtain additional information. (Action: The Clerk)
(d) Extension to Lounge at The Commodore Hotel, Marine Parade, Instow (Reference no. 36124): - The Clerk reported he had received this application on 14.10.03 and had passed it to the Chairman immediately for the attention of IPC’s Planning Officers. After discussion, lead by the Planning Officers, it was RESOLVED unanimously to recommend approval. (Action: The Clerk)

2310/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
(i) Parish Hall - Parish Council’s Noticeboard: - Cllr Harper reported that the Parish Hall Committee had requested that this board be given a “face lift”. It was RESOLVED the Clerk should liaise with the Parish Handyman and act as necessary and as soon as possible. (Action: The Clerk)
(ii) Atturm/Anstey Way Footpath - Doggy Bin: - Cllr Harper suggested that a “doggy bin” be located at this location as the footpath in question was regularly used by dog walkers who parked their cars in the lay by nearby. After discussion it was RESOLVED to ask NDDC for such a resource. (Action: The Clerk)
