MINUTES OF THE DECEMBER 2008 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 11th DECEMBER 2008 AT 7.30

 

 
Present: - Councillors P Cook, N Crombie, Mrs T Dipper, M Green, G May, B Thomas, S White (Chairman) and Mr R Jacob (Parish Clerk).

In Attendance: - Cllr R Cann (DCC), Cllr Moores (NDC) and 5 parishioners.

2812/1 PRAYER
The Clerk led the Council in prayer

2812/2 APOLOGIES
Cllrs A Johns, C Harper (both IPC), Constable T Hodgson and PCSO D Cornish.

2812/3 POLICE REPORT
In the absence of PC Hodgson and PCSO Cornish the Clerk read a report, namely: -
a) Crime: -
There had been no reported crimes in the parish since the last meeting. (Noted)
b) Other Matters: -
There had been 6 incident logs created for the same period namely, report of dangerous driving (x1), flooding (x1), male sleeping in church (x1), smoke grenade on beach (x1), phone scam (x1) and neighbourhood dispute (x1). (Noted)
c) Crime Prevention: -
PCSO Cornish was continuing to issue vulnerable vehicle forms in the parish with the intention of alleviating thefts from unattended vehicles. (Noted)
d) Man Sleeping Rough: -
The police believed an elderly gentleman was sleeping rough in the area; information required so he can be referred to NDC’s “rough sleepers’ refuge” worker. (Noted)
e) Xmas/New Year Greetings 2008: -
PC Hodgson and PCSO wished IPC and Instow parishioners a Merry Christmas and a Happy New Year! (Noted)
2812/4 PARISHIONERS
a) Boathouse Bus Shelter: -
A parishioner said this shelter was currently very draughty with three windows missing; the Clerk said building materials had been purchased (see finance) the previous day to improve this state of affairs and it was hoped to complete the job before the Xmas period. (Noted)
b) Carol Singing Event: -
A parishioner said how much she had enjoyed the recent carol singing event and thanked IPC for arranging it. She added that Instow was fortunate to have such an excellent parish council. The Chairman thanked the parishioner for her very kind remarks. (Noted)
c) Bideford Minor Injury Unit: -
A parishioner said he was dismayed it was proposed to cut back the hours at this essential “local” resource; after a discussion IPC RESOLVED to write to the Hospital Trust/Primary Car Trust and make its views known and to ensure the telephone number of the unit was published in the parish magazine. (Action: The Clerk)
d) Grass Verge/Trees – Morsden, Rectory Lane: -
A parishioner said he was concerned at the way this verge had been “used- manoeuvred” in the building process at this location; the Clerk told the parishioner that IPC shared this view and had made this view known to NDC Planning and was still in liaison with DCC Local Services – see planning vide 2812/11 (a) (Noted)



2812/5 REPORT COUNTY COUNCILLOR R CANN
a) Quay Car Park Charter Toilets: -
Cllr Cann thanked Cllr Moores (NDC) for his support as regards these toilets at a recent NDC Executive Meeting; he said Cllr Moores would report in more detail later. (Noted)
b) Instow new School: -
Cllr Cann said he had visited the DCC Education Department at County Hall earlier in the day and had advised them that when identifying suitable sites they needed to bear in mind there was a presumption against development in planning terms on the seaward side of the main Barnstaple to Bideford road and that he had additionally raised the issue at a full meeting of DCC with the relevant portfolio holder. (Noted)
c) Recycling Rates: -
Cllr Cann said these were up on 2007 and account for just over 43% of all rubbish collected. (Noted)
d) Shaw Healthcare: -
Cllr Cann said because of the credit crunch DCC was most likely to go out for tender again for suitable companies to run its Old People’s Homes and that he, and his group, personally opposed closures. (Noted)
e) Village Gateway Project: -
Cllr Cann said he had recently met informally with the Chairman of IIB and the Clerk with the intention of fulfilling this road safety initiative as soon as possible; the Clerk and Chairman of IIB advised Council of some possibilities and a discussion ensued. At the conclusion IPC RESOLVED to form a sub committee to consider all options and to report back to Cllr Cann as a matter of some urgency; the sub committee consisted of the Chairman/Cllrs Green/Mrs Dipper.

2812/6 REPORT OF DISTRICT COUNCILLOR B MOORES
a) General: -
Cllr Moores reported on the “Local Government Review” (Boundary Committee’s decision now 13th February 2009), “Quay Car Park Charter Toilets” (NDC Executive has resolved, at its meeting of 9th December, to take the necessary legal proceedings to have the covenant on the car park removed), “Dog Fouling” (an Ilfracombe woman has recently been fined £150 for failing to pick up after her dog) and “Morsden – Planning Issues” (see planning – 2812/11 (a)) (Noted)

2812/7 MINUTES
It was RESOLVED that the November 2008 minutes of Instow Parish Council be approved and signed. (Noted)

2812/8 MATTERS ARISING FROM THE MINUTES
a) Item 2811/5 (b) - Maintenance of Highways: -
(i) Cllr Cann and the Clerk reported on progress of the proposed site meeting between a sub committee of IPC and a DCC Local Services manager to discuss road maintenance (general), flailing of hedges adjacent to grass verges/footpaths, review of annual grass cutting grant and “other” highway matters. (Noted)
(ii) The Clerk referred, in particular, to an email (dd 2.12.08) from Rhys Davies (Chief Assistant Engineer North Area Highway Management) requesting contact to set up a meeting at a mutually convenient time. The Clerk advised IPC he had requested (email 2.12.08) that Mr Davies provided three dates of his availability so that IPC’s Sub committee might fit in as necessary. (Noted)
(iii) The Clerk then referred to an email (dd 10.12.08) from Rhys Davies (DCC Highways) advising IPC he was available to meet on the following Monday (15th), Tuesday (16th) or Friday (18th am only) or the 6th, 7th or 9th January 2009. (Noted)
(iv) Following a discussion it was RESOLVED that the sub committee would consist of the Chairman, Vice Chairman and Cllr May, together with the Clerk, and that the Clerk would ascertain the best date/time for all concerned and arrange the meeting accordingly. (Action: The Clerk)
(v) The Clerk advised IPC he had recently received a complaint from the management of the Commodore Hotel to the effect that during the summer months it was often difficult for delivery lorries to access and egress his premises because of parked cars opposite the entrance. After a discussion IPC RESOLVED to add this issue to the list as at (i) above. (Noted)
b) Item 2811/8 (c ) – Cllr Code of Conduct/Indemnity (CCOCI) : -
(i) The Clerk advised IPC he had sent an email (dd 26.11.08) to the DAPC asking for guidance on this matter and an update on the NALC national survey that was the catalyst for IPC’s concerns in the first instant. (Noted)
(ii) The Clerk then referred to an email (dd 5.12.08) from Lesley Smith (Secretary DAPC) that stated that the end of the NALC CCOCI process had not as yet been reached and suggested, if Cllrs felt it appropriate, that a quotation was requested from the Allianz Cornhill at the time of renewal in 2009. The Clerk recommended this course of action and IPC RESOLVED to adopt it. (Noted)
(iii) The Clerk added that Lesley Smith had also agreed to circulate this matter to the DAPC Egroup to establish what depth of feeling there was within the County and which may well mirror IPC’s concerns; she added that this might also elicit what action other Councils have taken/intended to take. (Noted)
c) Item 2811/8 (e) – New School Instow: -
(i) The Clerk advised IPC that in view of the fact DCC had not replied to his letter (dd 29.10.08) he had sent an email (dd 2.12.08) to Vic Ebdon (Head of Strategic Planning) requesting a response was forwarded to IPC by the 11th December. (Noted)
(ii) The Clerk reported that after much prompting by further emails he had received a letter (dd 9.12.08) from Vic Ebdon reference “Instow School” that he copied to Cllrs at the meeting. The Clerk read it out to the meeting. (Noted)
(iii) A discussion ensued at the conclusion of which IPC RESOLVED to take no further action for the time being whilst it considered its options. (Noted)
d) Item 2811/9 (i) (b) (ii) – Proposed Devon Unitary Authority/Community Boards/Forums - Focus Group: -
(i) The Clerk advised IPC he had been invited to attend a meeting in Exeter on 20th January 2009 and would ensure IPC was informed of any progress. (Noted)
(ii) The Clerk referred to an email (dd 9.12.08) from the DAPC reference “Boundary Committee – Devon Unitary Council/Review Date 13th February 2009”; he said this confirmed that the original date of 31st December 2008 had been moved forward to 13.2.09. (Noted)
e) Item 2811/9 (i) (j) – Freedom of Information of Act Update: -
(i) The Clerk reported receipt of a letter (dd 26.11.08) from The Information Commissioner’s Office (ICO) together with a pamphlet reference “Freedom of Information: Fulfilling your Obligations to Disclose Information”; he said the letter and pamphlet had been copied to Cllrs with their agenda papers (4.12.08). (Noted)
(ii) The Clerk also reported that as a consequence of this letter he had downloaded (1.12.08) the “Model Publication Scheme” from the ICO’s website and copied it on to Cllrs with email addresses; he said a hard copy had also been provided to all Cllrs with their agenda papers (4.12.08). (Noted)
(iii) The Clerk then said he had spoken to the ICO (1.12.08) and as a result ascertained it was necessary to also download a further document for completion by IPC once the model publication scheme had been adopted (by 1.1.09), namely, a “Completed Guide for Information”. He confirmed he had done so and then copied it to IPC Cllrs with email addresses; he said a hard copy had also been provided to all Cllrs with their agenda papers (4.12.08). (Noted)
(iv) The Clerk summarised by saying that IPC was now obliged to adopt this scheme (by 1.1.09 – the ICO would assume its adoption and does not need to be notified) and would be in breach of the relevant Act if it did not do so; there was also an obligation to publish the scheme by website, notice boards etc. (Noted) (v) After a discussion IPC RESOLVED to adopt the “model publication scheme” immediately and the Clerk and Cllr Crombie were asked to complete the “guide for information” as necessary in draft form and bring it back to the next meeting of IPC for approval. (Action: Cllr Crombie & The Clerk)
f) Item 2811/9 (i) k) – Proposed Wind Farm - Bickleton: -
(i) The Clerk confirmed he had sent an email (dd 26.11.08) to NDC Planning requesting that IPC be notified of any specific planning application for this project as a neighbouring parish; he said the email had been acknowledge by NDC Planning and passed to relevant officer. (Noted)
(ii) The Clerk referred to an email (dd 10.12.08) from Mr K P Bines (Lead Planning Officer – Instow area) confirming that if a formal planning application was received IPC would be consulted and that if any further pre-application meetings were held he would request that the applicant included IPC within the community consultation which NDC encouraged every applicant to undertake when involving a major application. (Noted)
(iii) The Clerk also advised IPC that Mr Bines was seeking to undertake to build on relations with the parishes that were within his area of responsibility and that he would be willing to attend IPC to discuss specific issues and/or a general discussion about the planning process. (Noted)
(iv) After a discussion it was RESOLVED to invite Mr Bines to attend before the February meeting of IPC (12th) commencing at 7 pm. (Action: The Clerk)
g) Item 2811/9 (i) (n) – Parish Carol Singing Event (7th December): -
(i) The Chairman and Clerk provided IPC with an update i.e. an excellent turnout of in excess of 100 people with £163.25 collected (£129.28 collected in 2007). The Chairman thanked all those IPC Cllrs who had assisted; for costings and donations to charities see finance 2812/10 (1) and (2). (Noted)

2812/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Email (dd 29.11.08) from Chairman of TTEF reference “Tug - Anchored on Instow Beach”: -
(i) The Clerk advised IPC he had ascertained that the tug, named “Cannis”, had “beached” at Instow, believed temporarily until the next high tide (12th December), when it was intended to move it up the Taw to Chivenor for the winter. (Noted)
(ii) The Clerk told IPC of a further email (dd 2.12.08) from the Chairman of the TTEF reference “Tug Cannis – Information from Ilfracombe Harbourmaster”; he said he had copied it to Cllrs with email address (2.12.08). (Noted)
(iii) The Clerk advised IPC of a further copy email (dd 2.12.08) from the Chairman of the TTEF to the Environment Agency and North Devon Council reference the “Tug Cannis – Bathing Water Directive/Town and Country Planning Act”. The Clerk outlined the content. (Noted)
(iv) The Clerk referred to an email (dd 3.12.08) he had sent to the Crown Commissioners reference “Tug Cannis – Mooring Fees”’; the Clerk outlined its response. (Noted)
(v) The Clerk referred to an email (dd 4.12.08) sent by him to the Ilfracombe Harbourmaster reference “Mooring Fees - Ilfracombe”; the Clerk outlined the response. (Noted)
(vi) The Clerk advised IPC of a telephone conversation he had had with Instow Marine reference “Tug Cannis – Mooring Fee Instow”; the Clerk outlined the content of that conversation i.e. mooring fee paid up to 11th December. (Noted)
(vii) The Clerk advised IPC he had updated, by email (4.12.08), the Chairman of the TTEF and the Ilfracombe Harbourmaster reference (vi) above. (Noted)
(viii) The Clerk then referred to a series of emails (4/5.12.08) between himself, the Chairman of TTEF and the Crown Estate reference “Ownership of Foreshore – Taw and Torridge”. The Clerk summarised the outcome. (Noted)
(ix) IPC noted that the tug “Cannis” had left the beach at Instow earlier in the day and was believed to have moved up river towards Barnstaple. (Noted)
b) Letter (undated – received 8th December 2008) and public notice reference “Register of Electors 2009”: -
The Clerk advised IPC that the number of parishioners had fallen yet again to 638 (734 in 2002 & 655 in 2008); he confirmed the public notice had been exhibited at the post office as requested. (Noted)
c) Instow Beach – Dogs: -
The Clerk confirmed he had been in touch with NDC’s Environmental Health Department (emails of 26.11.08 and 8.12.08) and that a new batch of doggy bins was being pursued as well as a number of new signs for the beach. It was NDC’s proposal to remove the current defunct signs which referred to zones and replace them with a limited number of physically much smaller metal signs which simply advise that owners must clean up after their dogs, the image/message being similar to that already used on adhesive signs at other locations. The Clerk said these would be placed at beach access points, that is, Commodore slipway, the entry point at the Boathouse and the steps in between. (Noted)
d) Letter (dd 5.12.08) from NDC reference “Street Collection Permit – Royal British Legion Poppy Appeal (RBLPA)”: -
(i) The Clerk said this stated that the RBLPA had applied for a street collection permit to collect in the parish of Instow on Friday 6th and Saturday 7th November 2009 between the hours of 8 am and 8 pm. (Noted)
(ii) The Clerk advised IPC that in view of the fact this was a collection by a bone fide charity he had advised NDC that IPC would have no objection. IPC RESOLVED to ratify this decision. (Noted)
e) Letter (dd 5.12.08) from a parishioner reference (i) “Overgrown Hedges/Verges and (ii) Lighting between Rectory Lane and Atturm”: -
(i) The Clerk said the hedges referred to were “between Atturm and Bridge along Marine Parade seaward side” (already dealt with by handyperson following similar complaint), “Atturm to Rectory Lane along Anstey Way – seaward side)” (handyperson to deal asap) and “Overgrown grass verge onto pavement on Anstey Way opposite Valeridge” (handyperson to deal asap). (ii) The Clerk said the parishioner had also requested that street lighting was increased to include the whole stretch of road from Atturm to Rectory Lane; the Clerk said he had told Cllr Cann who had advised him that this was most unlikely due to budget restrictions. (Noted)
(iii) The Clerk confirmed he had spoken to the parishioner concerned (9.12.08) and advised him of actions taken. (Noted)

5. MISCELLANEOUS: -
(a) Mole Valley Farmers – IPC Account (October 2008): -
The Clerk advised IPC that this confirmed IPC was in balance. (Noted)
(b) Car Park Charges 2009: -
The Clerk told IPC he had advised NDC Car Park’s Manager (email of 26.11.08 refers) of IPC’s decision to leave car park charges 2009 the same as for 2008 and confirmed that the budget for IPC 2009/10 had been set accordingly. (Noted)
(c) IPC’s Internal Auditor: -
After a discussion regarding the successor to Mr G Day as IPC’s Internal Auditor it was RESOLVED that the Clerk should formally approach Mary Jane Scott to enquire whether she might be interested in fulfilling such a role. (Action: The Clerk)
(d) Parish Council Expenditure 2009/10 – Precept and NDC Grant: -
(i) The Clerk advised IPC that the parish precept figure was most probably going to be £34 more than requested (£6,300) because IPC’s maximum grant request (i.e. £2 per head of population) was likely to be £1,276 based on 638 head of population – Source: Electoral Roll 2009. He said this was a shortfall of 17 parishioners on the current (2008) electoral roll (655). (Noted)
(ii) The Clerk suggested that if this was the case that IPC reduced its grant request to £1,276 (from £1310) and that this would have the effect of also reducing the precept back to what was originally requested i.e. £6,300.00. (Noted)
(iii) The Clerk advised IPC he anticipated receiving a letter from NDDC (before the January meeting) requiring confirmation from IPC that the precept/grant figures were (a) acceptable and (b) whether IPC wished to have its annual subscription to DAPC deducted from IPC’s first precept payment. (Noted)
(iv) After a discussion IPC RESOLVED to act as at (ii) above as regards the grant figure and to agree to the DAPC annual subscription being taken from its first precept payment. (Action: The Clerk)
(e) DCC P3 Footpath Inspection 2008/9/P3 Claim for 2009/10:-
(i) The Clerk reported that appropriate action would be taken by him asap, that was, check all footpaths with handyperson, complete necessary inspection forms and forward to DCC P3 Department with a request for P3 grant payment 2009/10. (Action: The Clerk)
(ii) The Clerk reported that he and the parish handyman had attended a P3 Xmas Workshop at Ashreigney on 28.11.08; issues discussed included “Public Rights of Way: Advice for Users and Landowners”, “Waymarking Public Rights of Way”, “Public Rights of Way Condition Criteria” and “Legal Issues”. (Noted)
(f) IPC Grant 2008 – Parish Magazine: -

After a discussion IPC RESOLVED not to provide a grant on the basis the request did not accord to its policy. (Noted)
(h) Letter (dd Nov/Dec 2008) from HM Revenue and Customs reference “Advance Warning - Employer Annual Return: Online for 2009-10”: -
The Clerk advised IPC this had been filed for future reference. (Noted)
(i) Verbal thanks (7.12.08) from Treasurer of Instow Parochial Church Council reference “Thanks to IPC for Burial Ground Grant 2008/9”: -
The Clerk confirmed he had been verbally thanked (7.12.08) by the Treasurer of the Instow PCC thanking IPC for its generous contribution. (Noted)
(j) Boathouse Bus Shelter Alterations: -
The Clerk told IPC that the materials had now been purchased (see 2 above) and that the handyperson anticipated getting the work finished before Xmas; the Clerk reminded IPC that DCC (Cllr Cann) had already provided a £90 grant for this project (banked July 2008) and that the labour charges should be approximately £90. 2812/11 PLANNING
a) Letter (received 28.11.08) from NDC Planning reference “Erection of Garage at Morsden, Rectory Lane, Instow (Reference No 47326): -
(i) The Clerk said this stated that NDC Planning had GRANTED permission for this application with conditions as listed; he said a copy of said letter had been provided to Cllrs with their agenda papers (4.12.08). (Noted)
(ii) The Clerk advised IPC he had liaised with the Chairman (28.11.08) and that as a consequence of (i) above had forwarded a letter to NDC Planning (in accordance with item 2811/11 (h)); he said a copy of the letter had been provided to Cllrs with their agenda papers (4.12.08). (Noted) (iii) The Clerk advised IPC he had sent an email (dd 9.12.08) to NDC’s Planning Manager requesting a response to his letter (as at (ii) above) by the 11th December and as a result he was told that NDC’s Lead Planning Officer for Instow, Mr K Bines, was to respond hopefully in time for the meeting of the 11th. (Noted)
(iv)The Clerk then reported receipt of a letter (by email – 11.12.08) from NDC Planning (Mr K Bines); a copy was provided to Cllrs at the meeting and the Clerk read it to Council. (Noted) (v) IPC then discussed the implications of the response from NDC and RESOLVED to ensure that appropriate liaison had been made between NDC and DCC (as regards the grass verge/trees) and the Clerk was asked to speak to the DCC Local Services Superintendent. b) Letter (received 28.11.08) from NDC Planning reference “Raising of roof to enable second floor extension to dwelling ay Westwinds, New Road, Instow (Reference (47415)”: -
The Clerk said this stated that NDC Planning had REFUSED permission for this application for reasons as listed; the Clerk outlined the reasons. (Noted)
c) Installation of 36 photo-voltaic panels on flat roof (angled at 30 degrees to the south) on Clubhouse of North Devon Yacht Club (Reference No 47646)”: -
(i) The Clerk reported receipt (29.11.08) of this application and of having passed it immediately to the Chairman for the attention of IPC’s PSC; for response by 17th December or an extension to be applied for. (Noted)
(ii) The Clerk confirmed that an entry had been placed on the Instow website for the information of parishioners. (Noted)
(iii) After a discussion, led by IPC’s PSC, IPC RESOLVED to recommend approval of this application. (Action: The Clerk)

d) Instow Parish Council – Planning Visits/Code of Conduct: -
(i) The Clerk advised IPC that in view of the fact IPC now had a number of new Cllrs amongst its midst that he had forwarded a copy of this to Cllrs with their agenda papers (4.12.08). (Noted)
(ii) After a discussion IPC RESOLVED there was no need for amendment/addition and Cllrs were urged to follow the code of conduct as written. (Action: IPC Cllrs)

2812/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
a) Street Lighting Wiring – Rectory Lane: -
Cllr Thomas said some resident of Rectory Lane considered some of the street lighting wiring (between the posts) to be too low and in danger of being touched by high sided vehicles delivering in the area. IPC RESOLVED to have the appropriate authority informed. (Action: The Clerk)

b) Sand on Pavement – Near Commodore Slipway: -
Cllr Cook said this was now looking unsightly and required being removed; IPC RESOLVED to inform DCC Local Services. (Action: The Clerk)
