2403/3 POLICE REPORT
Constable Parker apologised for his non-attendance at the February meeting.

a) Crime: - PC Parker said that since the January meeting there had been a
number of crimes reported within the parish namely, a burglary at Gorse Hill
(unattended dwelling entered and builders power tools stolen), an assault
(offender given a formal warning) and two offences of criminal damage namely a
broken window (by air pellet - possibly accidental) and a car window. (Noted)
b) General: - (i) Constable Parker said a male had been arrested for being
drunk and disorderly and a female arrested for being drunk in charge of a
motor vehicle following a minor road traffic accident. (Noted)
(ii) Cllr May reported that a number of car tyres were being indiscriminately
dumped in the area of Holmacott and Eastleigh believed because of excessive
charges being levied upon persons taking such item to the Holmacott tip and
local scrap yards to cover environmental disposal costs. Constable Parker
agreed to investigate this and in doing so liaise with local scrap yards and
NDDC’s Environmental Health Department. (Action: Constable Parker)
(iii) Cllr Johns enquired as to what cover Instow could expect during the
coming summer season as regards traffic wardens. PC Parker assured IPC that
Instow would receive regular visits from Traffic Wardens. (Noted)
2403/4 PARISHIONERS
Traffic Island - Anstey Way/Rectory Lane: - A parishioner enquired whether a
traffic island could be placed on Anstey Way at its junction with Rectory Lane
on the grounds of road safety. The Clerk reminded IPC that this had been
previously raised (see item 2402/9 (ii) (b)) and was to form part of the
agenda for the forthcoming Traffic Management Sub Committee meeting with DCC
(see also 2403/8 (g))(Noted)
2403/5 REPORT COUNTY COUNCILLOR R CANN
(i) Cllr Cann reported upon Instow School (the final choice by DCC was for the
Lay By site; final soil tests are to be undertaken before acquisition and
planning consent - it is hoped to provide urgently needed playing fields at an
early stage), Yelland Power Station (Cllr Cann had removed delegated powers
and called this application in because of concerns over the operation of the
site) and the removal of the 30/40 mph signs on Anstey Way (see item 2402/4
(c)); Cllr Cann said these had no legal standing and could create difficulties
with enforcement of the speed limit if left in situ. (Noted)
(ii) Yelland Power Station Application: - IPC was concerned it was not,
apparently, being consulted on this application - it was RESOLVED the Clerk
should contact NDDC/DCC and seek further information as soon as possible on
which it might proffer a view. (Action: The Clerk)
(iii) Portable Speed Enforcement Sign: - Cllrs complimented Cllr Cann on
arranging for this sign to be placed on Anstey Way at its junction with Marine
Parade (Atturm); it was agreed to be having a marked effect on speeding. IPC
RESOLVED to have this sign within the parish as often as possible and Cllr
Cann said he would do all he could to achieve this objective. (Action: Cllr

2403/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
In the absence of Cllr Mrs L Brown, Cllr Cann read a report which set out Cllr
Mrs L Brown’s apologies and referred to the Political Balance of NDDC (almost
evenly balanced - referred to the apparent benefits) and confirmed that the
Executive of NDDC had formally agreed to Instow being provided with two mini
Charter toilet blocks in 2005. (Noted)
2403/7 MINUTES
It was RESOLVED that the February 2004 minutes of Instow Parish Council be
approved and signed. (Noted)
2403/8 MATTERS ARISING FROM THE MINUTES
a) Item 2402/8 (a) (i) - Traffic Issues - Boathouse Loading Bay: - The Clerk
confirmed he had written to PC Parker (20.2.04) in order to seek a response to
previous unanswered correspondence concerning this matter and that a reply
letter (dd 27.2.04) had subsequently been received. He said PC Parker had
reported he did not deal with "traffic issues" but had passed it to the North
Devon Police Road Safety Officer (PC John Benson) for his attention. The Clerk
said this issue could now be dealt with as part of the brief of IPC’s TMSC
(see item (g) below). (Noted)
b) (Item 2402/8 (b)) - Charter Toilets - Instow: - (i) The Clerk informed IPC
of his recent communication (email - 10/3/04) with Geoff Barclay (GB) (NDDC)
as regards the current site status of the Quay Car Park Charter toilet. He
said a feasibility study of the options was planned with discussions between
NDDC’s Car Parks Manager and Planners for example; a decision would then be
made with IPC being kept informed. The Clerk said he had reminded GB of IPC’s
wishes, that is, to erect the new toilets on the current site and not in the
centre of the car park. (Noted)
(ii) Sand Hills Toilets: - Cllr Harper expressed concern that these toilets
had yet to receive the deep clean promised by NDDC during the summer of 2003
and that the electricity supply was still faulty. IPC RESOLVED to report this
to NDDC; Cllr Cann said he would do so also. (Action: The Clerk and Cllr Cann)
c) Item 2402/8 (d) - NDDC - Future of Lifeguard Provision: - (i) The Clerk
confirmed he had written (20.2.04) to The Crown Commissioners as regards IPC’s
Beach Lease but to date had not received a reply. (Noted)
(ii) The Clerk advised IPC of a recent letter he had received from The
Cornhill Allianz enquiring what action IPC had taken about the beach. The
Clerk said he had replied to the effect the issue was still under
consideration. IPC RESOLVED to continue to appraise & consider the
implications of this matter with Cllr Crombie and the Clerk taking the lead.

d) Item 2402/8 (e) - IPC Website Domain: - Cllr Harper and the Clerk provided
a briefing of their recent meeting with the facilitators of the Instow website
adding there was no need, in their view, for IPC to apply for and pay an
annual website domain fee as they had been reassured that interested persons
interrogating the web under the name of "Instow Parish Council" would
automatically be directed to the current site. IPC RESOLVED to adopt this
suggestion. (Noted)
e) Item 2402/8 (g) - IPC - Siting of Xmas Tree/Signal Box Agreement: - (i) The
Clerk confirmed he had written to The Allianz Cornhill Insurance Company
(20.2.04); both he and Cllr Crombie appraised IPC of its response (email of
15.3.04 refers). After discussion it was RESOLVED that Cllr Crombie and The
Clerk would consider the overall implications, liaise with Andy Bell (NDCCS)
and report back to IPC once such enquiries were complete. (Action: Cllr
Crombie and The Clerk)
(ii) In discussing the arrangements for the Parish Carol Singing event 2004,
IPC RESOLVED to consider all the health and safety and insurance implications
for such an event before finalising the arrangements. The Clerk agreed to
approach the proprietor of The Commodore Hotel to ascertain if the annual
carol-singing event might be held around its tree. Cllr May said he knew of
some local musical talent that might be in a position to play at the event
(see item 2403/9 (iii) (e)). (Action: The Clerk)
f) Item 2402/9 (ii) (b) (ii) - Bathing Water Compliance/Dog Ban: -(i) The
Clerk advised IPC of the stance taken by NDDC following a communication (email
10-11/4/04) he had recently had with Geoff Barclay (GB) (NDDC Environmental
Health Dept). The Clerk read a copy letter (dd 24.2.04) from NDDC to The
Environment Agency. (Noted)
(ii) Email (dd 27.2.04) from Chairman (TTEF) concerning "Instow Beach - Dogs":
- The Clerk told IPC that this concerned recent national publicity as regards
an incident between a NDDC dog warden, a member of the public (with dog) and
the police. The Clerk appraised IPC of the detail. (Noted)
g) Item 2402/9 (iii) (b) (iii) - IPC Traffic Management Sub Committee: - The
Clerk reported this meeting had provisionally been agreed for Friday 23rd
April and that Constable Benson (ND Area Road Safety Officer), Dave Netherway/John
Beardsley (DCC), and Cllrs Cann, Scott, Harper and Johns were in a position to
attend. He said that Cllr White (Chairman) was unable to commit himself at
this stage because of work commitments. IPC RESOLVED to confirm the date of
the meeting (23rd April) and to meet at 10.30 am at The Commodore Hotel. The
Clerk agreed to confirm these arrangements to all persons involved and to
prepare a full agenda by the next meeting of IPC. (Action: The Clerk)
h) Item 2409/iii) (o) - IPC Meetings 2004 (Update): - The Clerk referred to an
amended list, which he had circulated to all Cllrs with their agenda papers
(11.3.04). He said a copy had been placed at the Post Office/Parish Hall.

i) Item 2402/9 (iii) (q) - Devon Structure Plan 2001-2016 - Modification: -
The Clerk asked if IPC wished to make a response, the closing date for
responses being the 25th March 2004. Cllr Cann said NDDC had expressed a view
that wave energy power was more preferable in North Devon that wind power
(that could provide a blot on the landscape). IPC RESOLVED to support this
view and also seek the guidance of Mrs R M E Day (Chairman TTEF) before
responding. (Action: The Clerk)
j) Item 2402/12 (a) - Venn Cross/Rectory Lane Bus Shelter (Lighting): - The
Clerk said he had spoken to Mr Terry Shilvock (Builder) and the parish
handyman, Mel Harris, and that there was no apparent simple or cost effective
solution to getting light into this shelter at night. IPC RESOLVED to take no

had been transferred into the DCF. (Noted)
(b) Reclaiming of VAT: Not Registered: - The Clerk reported he was to liaise
with Mr G Day (IPC’s IA) when the draft accounts for the year 2003/4 are
prepared and ascertain, at that time, how much VAT could be reclaimed. He said
an application would then be made to the Customs and Excise for a refund; he
estimated that something in excess of £100 is reclaimable. (Noted)
(c) Draft Contract of Employment - Beach Cleaner 2004/5: - The Clerk reported
he had received (17.4.04) a response as regards the draft contract of
employment for the beach cleaner for 2004/5 from a local solicitor; he
recommended that the final draft, a copy of which he had placed before IPC,
was ratified. After discussion resulting in some minor amendments IPC RESOLVED
to adopt the draft contract. The Clerk said he would meet up with Mr Cook, as
soon as possible, and get the contract signed. (Action: The Clerk)

(d) Car Park Machine 2004: (i) The Clerk reported that DCC had very kindly
donated (free) two second-hand car park machines (Make: Metric Accent) to IPC;
the best one for use is only about 4 years and the other, a little older,
could be used for spares. The Clerk said they were currently stored in IPC’s
tractor garage and that it would be necessary to have the old machine removed
(including changing over of the electricity supply), have the new machine
installed and take out a maintenance contract with Metric with whom he had
already made contact. The Clerk added that IPC needed to discuss the cost
implications in the light the "new" machine would need to be up and running by
1st May. The Clerk said he had made contact with a professional installer (who
lived at Bideford) on the advice of DCC and that he was willing to do the job
at an approximate cost of £400 (this included a £140 charge by Southern
Electric for the electricity changeover) The Clerk finalised by saying it
would also be necessary to purchase/acquire a new set of tickets and dispose
of the current machine and tickets. After discussion it was unanimously
RESOLVED to adopt the recommendation of the Clerk as regards the installation
of the "new" machine; the Clerk was asked to thank DCC for its generosity.

(ii) Letter (dd 5.3.04) from Blick Alfia: - The Clerk said this notified IPC
that Blick plc and its subsidiary operations had been acquired by The Stanley
Works, a US Corporation and a worldwide supplier of tools, hardware and door
systems for professional, industrial and consumer use. It confirmed it would
still provide the same service as regards car parks. It was said by the Clerk
that it would no longer be necessary for IPC to use Blick Alfia in the light
of decisions taken as at item 2403/10 (d) (i). (Noted)
2403/11 PLANNING
a) Letter (received 21.2.04) from NDDC reference Extension and Alterations to
Dwelling (Renewal of Unimplemented Permission 26220) at The Old Dairy, Marsh
Lane, Instow (Reference No 36857) -The Clerk advised IPC that NDDC had GRANTED
permission for this application with conditions as listed. (Noted)
b) Letter (dd 16.2.04 - received 21.2.04) from NDDC reference "Town and
Country Planning Act 1990 - Section 211 Notice: Trees in Conservation Area -
Notification for works to trees in a conservation area in respect of felling
of 2 willows at land in front of 23-27 White House Close, Instow (Reference no
36813): - The Clerk advised IPC that NDDC had GRANTED permission for this
application with conditions as listed. (Noted)
c) Copy letter (dd 26.2.04) from NDDC Planning Manager to DCC’s County
Environment Director reference "County Matters Application in respect of
Transfer Station and Recycling Centre at Holmacott Landfill Site, Holmacott,
Instow (Reference 36987): - The Clerk told IPC that the letter stated that the
Local Planning Authority had resolved to INDICATE APPROVAL to this application
with no conditions. (Noted)
d) Email (dd 5.3.04) from parishioner - General Enquiry reference "Tree
Preservation Orders": - The Clerk said he had advised the parishioner to
contact Andy Tucker (NDDC’s Planning Dept) for definitive information or Cllr
Harper who held what NDDC Planning Department had previously provided to IPC.

e) Tree Preservation Orders (TPOs’) - Update of Instow Records: - Cllr Harper
said the TPO records, as previously supplied by NDDC, needed updating. After
discussion it was RESOLVED that the Clerk should set up a meeting between Cllr
Harper and Mr Tucker (see (d) above) either at the Civic Centre or preferably
on site at Instow. (Action: The Clerk)
2403/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
a) Parish Plan: - Cllr Harper said he had begun to research Parish Plans; he
gave IPC a brief overview of his enquiries to date. (Noted)
b) Sandhills (Marine Parade/Entrance to Sandhills Car Park): - Cllr May
expressed concern as regards the poor state of repair of the willow fencing
that had been placed at this location to slow down the movement of the sand in
the dunes at this location. It was RESOLVED that the Clerk should contact Andy
Bell (NDCCS) to ascertain what action could be taken. (Action: The Clerk)
c) Plastic Bottles - Recycling: - Cllr May said he had received complaints
about the spillage of plastic recycled material falling off the recycling
lorry that visited the parish once per week. It was RESOLVED that the Clerk
should contact the proprietors of the firm in question and advise them. Cllr
May agreed to be contacted by the firm in question if necessary. (Action: The
Clerk)
d) Chairmanship: - The Clerk congratulated Cllr Johns on the excellent manner
in which he had chaired the meeting. (Noted)
