MINUTES OF THE SEPTEMBER 2005 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 15th SEPTEMBER 2005 - 7.30

Present: - Councillors P Cook, N Crombie, M Green, C Harper, A Johns (Chairman), S White and Mr R Jacob (Parish Clerk).

2509/3 INSTOW PARISH COUNCIL – QUALITY PARISH STATUS

The Chairman, Cllr Johns, said he was delighted to report that Instow Parish Council had recently been awarded Quality Parish Status and that he wished to place on record his sincere and grateful thanks to the Clerk for all his hard work and commitment in putting the application together. He added that the parish council and parishioners of Instow could feel proud of this achievement, as IPC was only the second council in North Devon to receive the award and the 16th in Devon. Other Cllrs echoed the sentiments of the Chairman; the Clerk said the award was an indication that the Council was operating in a sound, effective and efficient fashion and that this augured well for the future. (Noted)

2509/4 POLICE REPORT

In the absence of Constable Benbow, who was sick, there was no report. (Noted)


2509/5 PARISHIONERS

a) Parish Bench – Damaged: - A parishioner reported she had noted some minor damage to a parish seat along Marine Parade; she identified the seat to the Clerk. IPC RESOLVED to have the seat repaired by the parish handyperson – Clerk to contact him. (Action: The Clerk)

b) Instow Recreation Field – Roundhouse Thatching: - A parishioner enquired when the roundhouse, under construction, was to be fitted with its thatched roof. The Clerk advised IPC, and the parishioner, that this was to take place during the weekend of 30th Sept/1st Oct 2005 and that all were welcome to attend and assist – see item 2509/10 (iii) (ll). (Noted)

c) Sewage Smells – Marine Parade: - A parishioner complained about the strong smell of sewage throughout Marine Parade and surrounding area. IPC RESOLVED to notify SWW and the Environment Agency. (Action: The Clerk)

d) IPC – Quality Parish Council Award: - A parishioner congratulated the Council and the Clerk for recently achieving Quality Parish status – she said she was proud of the Council’s achievement. The Chairman thanked the parishioner for her very kind words. (Noted)

2509/6 REPORT COUNTY COUNCILLOR R CANN

a) IPC – Quality Parish Council Status: - Cllr Cann tendered his sincere and heartfelt congratulations to the parish council and Clerk in achieving Quality Parish status. He said it was an achievement the council could feel very proud of. The Chairman thanked Cllr Cann for his very kind words. (Noted)

b) General Matters: - Cllr Cann spoke of information he had recently received from Cllr Harper reference Ragwort (he provided Cllr Harper with Defra Guidance on the subject), Flood Prevention Meeting (Anstey Way/Marine Parade junction near Silver Threads), Highways Issue/Estuary View (Unadopted), Licensing Applications (The Bar and The Decks – record number of objections), the provision of a Litter Bin at the Anstey Way Lay By site, Bus to Pilton Community College, Travel to Work Transport Policy, Barnstaple Traffic/The Strand, North Devon Showcase (Aller Cross, South Molton) and Junction of Marine Parade/Anstey Way – New Road Markings. (Noted)

c) Charter Toilets – Quay Car Park: - Cllr Cann said he had liaised with NDDC’s Chief Executive and expressed his concern at the time this project was taking to materialise particularly as planning permission had been given; he reassured IPC he would continue to raise the issue at every opportunity. (Noted)

d) Devon Fire and Rescue Safety Checks: - Cllr Cann provided IPC with an overview of this excellent initiative. He proved Cllrs with the contact details as follows: - Free phone 0800 7311 822, Text Line 078700002476 and website www.devfire.gov.uk. IPC RESOLVED to publicise these details throughout the parish and the Clerk was asked to prepare a suitable poster. (Action: The Clerk)

e) Licensing Applications: - Cllr White asked why NDDC had not liaised direct with IPC as regards the recent local licensing variation applications. Cllr Cann said the relevant legislation did not allow for this albeit that both he and NDDC had some sympathy for IPC’s predicament and recommendation. (Noted)

f) Greensweep: - Cllr White asked why the fortnightly green waste collection in the vicinity of Rectory Lane and Rectory Close did not always take place. He said it had apparently been alleged by the collection vehicle driver that cars had blocked its access although residents, so affected, disputed this. Cllr Cann said he would look into this complaint and report back. (Action: Cllr Cann)

g) Charter Toilets – Sand Dunes/Marine Parade: - (i) Cllr Harper asked whether NDDC had come to any conclusion as regards the disabled toilet being made available for general use particularly at times of high demand (see item 2506/6 (b)). Cllr Cann said it had been decided this was not a viable option and that as and when (and if) the Charter toilets on the Quay Car Park were built the situation of usage would hopefully be rectified. (Noted)

(ii) Cllr Mrs L Brown said that if necessary the flush monitoring system installed in the toilets could be reviewed to establish, more or less, the amount of use each toilet was being put to. (Noted)

2509/7 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN

a) General Matters: - Cllr Mrs L Brown spoke of the Planning Application for Land at Lane End Close (Reference No 39545) – to be discussed at Planning Committee Meeting of 21st September 2005, Audit Commission Inspection – Affordable Housing (last inspection in June 2005 NDDC’s Housing Services was judged to be FAIR with promising prospects for the future), The Strand and Square Enhancement and Traffic Management Works (public consultation imminent), and Election – NDDC Forches and Whiddon Valley Ward. (Noted)

b) Charter Toilets – Quay Car Park: - (i) Cllr Mrs L Brown said a report was to go to The Executive in the autumn outlining the feasibility of the flat development proposal and that the toilets and alterative parking would be a consideration. (Noted)

(ii) Cllr White suggested that IPC ought to be part of the NDDC’s group considering this overall project - IPC RESOLVED to write to NDDC and ask whether this might be possible. (Action: The Clerk)

c) Instow Bathing Water Tests: - Cllr Harper provided details of an alleged stream effluent problem in the Little Torrington (LT) area that had been reported to him by a LT resident and which could be the source of the water quality test failures on Instow beach. After discussion it was RESOLVED that the Clerk would speak to the informant and suggest he contact his local MP; the Clerk to also notify Torridge District Council, The Environment Agency and Defra despite the fact the informant has been in dialogue with each for quite some time. (Action: The Clerk)

2509/8 MINUTES

It was RESOLVED that the July 2005 minutes of Instow Parish Council be approved and signed. (Noted)





2509/9 MATTERS ARISING FROM THE MINUTES

(a) Item 2507/4 (d) (ii) - Village Show 2005/Wishing Tree: - The Clerk referred to a copy of a comprehensive "wish list" that had been circulated to Cllrs with their summer recess update memorandum. After a brief discussion it was RESOLVED to form a Sub Committee, consisting of the Chairman/Vice Chairman and The Clerk, to review, consider and report back to IPC with a recommended action plan in due course. (Action: Chairman/Vice Chairman and The Clerk)

(b) Item 2507/4 (e) (ii) – Sewers/Instow: -(i) The Clerk reported that The Environment Agency was still investigating; the Clerk said he had been in contact with Phil Siddall (EA) and the Chairman of TTEF. The Clerk also referred to an email (dd 14.9.05) from Phil Siddall (EA) that he read to Council. (Noted)

(ii) A parishioner reported that sewage smells could still be smelt throughout Marine Parade ands that there was a rust coloured "effluent"/oily film on the beach which concerned her. IPC RESOLVED to notify the EA. (Action: The Clerk)

(c) Item 2507/4 (e) (iii) - Appledore Quay Wall: - (i) The Clerk reported that the Chairman and him had attended a meeting at Northam Town Council Offices, Windmill Lane, Northam on 1st September at 6 pm adding that a public meeting (it was publicised in the local press, and around Appledore) was also held on Monday 5th September 2005 at the Blue Lights Hall, Appledore, between 10.30 am and 7.30 pm. (Noted)

(ii)The Chairman and Clerk provided a brief resume of the meeting; the Chairman said that sample panels, showing optional treatments for the quay wall, had been on display at the meeting/exhibition, and feedback was encouraged. The Clerk reminded Cllrs they had been circulated with a copy letter from the EA together with a resume of the EA’s and Halcrow’s recommendations with their agenda papers (8.9.05). (Noted)

(iii) The Clerk advised IPC that Holcrow intended to put on a low key exhibition in the Instow parish hall during the next week or so and that it would be publicised. IPC RESOLVED to defer its final deliberation/resolution to the October meeting after Cllrs had had a chance to attend the local exhibition. (Action: IPC Cllrs)

(d) Item 2507/8 (b) - Sandhills Ransom Strip: - Cllr Cann provided an update as regards the progress of the feasibility study by Brian Holme (NDDC). He said that because of recent internal reorganisation within NDDC the study had been delayed and he suggested the Clerk liaise direct with Brian Holme to establish a situation report. IPC RESOLVED to adopt this course of action. (Action: The Clerk)

(e) Item 2507/8 (c) - Parish Emergency Plan Update: - (i) Cllr Harper confirmed the proforma had been circulated with the Parish Magazine (July) and that some publicity had appeared in the North Devon Journal (11.8.05). Cllr Harper said that the return of responses had been slow and that he was generally disappointed with the result (16% rate of return), adding he was in the midst of reviewing them and would report back to IPC at the earliest opportunity having first discussed his findings with IPC’s EPSC. (Action: Cllr Harper)

(ii) Cllr Harper reported that the £35 cheque, requested by NDDC, to cover the cost of a lottery licence had eventually not been required – see Finance Income. (Noted)

(f) Item 2507/8 (d) (iii) and (v) - Instow Beach Cleaning: - (i) The Clerk referred to a letter (dd 16.8.05) from DCE reference "Dune and Beach Cleaning by IPC". IPC noted the content of the reply (i.e. DCE accepted that IPC cleaned the sand dunes and parts of Instow Sands owned by DCE as a "community spirited initiative" and that it did so "without prejudice"). IPC RESOLVED to send a copy to IPC’s insurance company – Allianz Cornhill. (Action: The Clerk)

(ii) The Clerk said he had asked the Beach Cleaner to deposit scraped seaweed to the Cricket Ground end of the beach (and not leave it near the Quay area) at the request of the Environment Agency as its decomposition could affect water quality tests that were taken at about that spot. (Noted)

(iii) The Clerk advised IPC that nothing had been received from NDCCS as regards its recommendation(s) for beach cleaning in future years. IPC RESOLVED to enquire as to the state of progress by the NDCCS. (Action: The Clerk)

(g) Item 2507/8 (f) - Community Policing - Instow: - The Chairman and Clerk reported that a very successful meeting had been held with Chief Inspector Nutt, Inspector Davies and Sergeant Sarsfield at The Commodore Hotel on Wednesday 31st August. The Chairman/Clerk provided full details of the meeting i.e. Constable Benbow was to continue to cover Instow (together with his prime patch of Lankey and Swimbridge) and that C/Insp Nutt was considering using members of parishes to appoint Neighbourhood Beat Managers in the future and might use Instow as part of that experiment in due course. (Noted)

(h) Item 2507/8 (g) - Instow Parish Council – Quality Parish Status (QPS) Application: - (i) The Clerk referred to a letter from DAPC (dd 26.7.05) confirming that IPC had been awarded QPS; he also referred to subsequent publicity in the North Devon Journal, North Devon Gazette and Advertiser, Western Morning News and Instow Website. He reminded Cllrs he had circulated a copy of the QPS certificate with their summer recess update memorandum together with a letter of congratulations from Cllr Haywood (Chairman of NDDC). (Noted)

(ii) The Clerk said that IPC now needed to consider an appropriate format for an official presentation of the QPS Certificate and where it should be placed. He suggested that IPC’s Xmas Social might be a suitable forum for the presentation and that ideas would be needed so as to decide what eminent person might be invited to present it. After discussion it was RESOLVED to hang the framed certificate at the parish hall (Cllr Harper to deal) and adopt the suggestion of the Clerk as regards the venue for presentation; Cllrs were asked to give some thought as to who might be invited to make the presentation. (Action: IPC Cllrs)

(i) Item 2507/9 (i) (h) (i) – Instow Beach/Water Quality Tests/Publicity: - The Clerk referred to a BBC Spotlight TV news report (22.8.05) upon the state of Instow Beach (i.e. had failed 2 water quality tests for the 2005 season) and of the various press reports dealt with by Chairman (WMN – 5.9.05) and Clerk (ND Journal 25.8.05). IPC RESOLVED to take no further action. (Noted)

(j) Item 2507/9 (i) (i) – Vandalism – Venn Cross Bus Shelters: - The Clerk reported upon the progress of PC Benbow’s enquiries, that is, some of the damage had been rectified (graffiti painted over) by the family of one of the culprits albeit that PC Benbow had further enquiries to make. (Noted)

(k) Item 2507/9 (i) (j) – Clean N/hood and Environment Act – Control of Dogs: - The Clerk said he had nothing further to report from NDDC as of the date of the meeting. NDDC was still considering the legislation much of which had yet to come into force. (Noted)


2509/10 CORRESPONDENCE

(i) Matters for discussion/resolution or noting

a) Letter (dd 29.7.05) from NDDC reference "NDDC Monitoring Officer": - The Clerk said this letter stated that as and from 20th July 2005, Mr D Pratt had been appointed Monitoring Officer for NDDC – contact by email address don.pratt@northdevon.gov.uk" or 01271 388251 and that he had copied it to Cllrs with their summer recess update memorandum for their information. (Noted)

b) Letter (dd 29.7.05) and enclosures (Notices, Summary Leaflets, Plan etc) from DCC entitled "DCC Waste Local Plan: Re-Deposit Version (Opportunity to comment on suggested policies and proposals": - (i) The Clerk confirmed that notices had been placed on IPC’s notice boards at Venn Cross and John’s Post Office (12.8.05) and that the plan and associated papers had been handed to the Chairman/Vice Chairman for perusal and circulation amongst Cllrs prior to IPC meeting of 15.9.05. He said the deadline for any comments was Monday 26th September 2005. After a discussion, lead by the Chairman, it was RESOLVED that the Chairman would respond as he saw fit in liaison with the Vice Chairman and Clerk. (Action: Chairman/Vice Chairman & Clerk)

(ii) Letter (dd 24.8.05) from DCC reference "DCC Waste Local Plan: Re-Deposit Version – Objections to the First Deposit Version (Copy of IPC’s Original Response)": - The Clerk said that when this document was first received by IPC a resolution had been passed to echo the response of the TTEF; DCC were now wishing to know if IPC’s comments still stood. The Clerk advised IPC he had spoken to the Chairman of the TTEF and that as far as she was concerned there were no reason(s) to amend the original response. IPC RESOLVED to stand by its original response - Clerk to notify DCC. (Action: The Clerk)

c) Email (dd 5.8.05) from DAPC reference "DAPC New Website – Username and Password": The Clerk said this notified IPC that the DAPC had launched a new look website with part of the website being password protected so only DAPC members could access the information; he said the email had been copied to Cllrs with their summer recess update memorandum. (Noted)

d) Letter (dd 5.8.05) from Andy Bell (NDCCS) reference "Restriction of Slipways": The Clerk said this letter stated that within a couple of weeks TDC would be imposing physical restrictions on the slipways at Bideford Bank End and Appledore Seagate; action being taken as a result of two members and a senior officer having witnessed some disarray at Appledore. The Clerk added that the full details of the physical barriers was provided with a letter adding that NDCCS was monitoring other launch points so that it could review them at the end of the season and that any information of relevance should be sent to Andy Bell. He reminded Cllrs he had copied the letter to them with their summer recess update memorandum. (Noted)

e) Variation of Premises Licence: Application by NDCI in respect of The Bar, Marine Parade, Instow and Others: - (a) The Bar – (i) The Clerk said he had noted, by perusal of NDDC’s Member Services Weekly Information Sheet (dd 12th August 2005), that NDCI was making an application to vary its licence for The Bar, Marine Parade, Instow to enable the sale of alcohol between 0930 hrs and 0100 hrs Monday to Sunday inclusive so as to enable the provision of hot food and drink after 2300 hrs until 0100 hrs Monday to Sunday inclusive. (Noted)

(ii) The Clerk reported receipt of 16 copy letters of objection from parishioners (plus an 80 signatory petition) (as of 31.8.05) to NDDC Licensing Department. (Noted)

(iii) The Clerk said he had liaised with Cllrs by memorandum (dd 14.8.05) and as a result wrote to NDDC Licensing Department (dd 17.8.05) objecting to the licence variation on the grounds that if granted, daily late night excess noise (pedestrian and traffic) would unquestionably ensue, the pub was situated within a close knit residential area where many elderly and vulnerable residents resided and public order would undoubtedly occur due to excess alcohol and high spirits emanating from within the premises and outside. The Clerk said he did point out, however, that Instow Parish Council had asked him to inform NDDC that if this form of licence variation (until 0100 hrs) was just for "special occasions" then such an arrangement might well be acceptable adding that IPC was fully appreciative of the fact that Instow was a very popular and admired tourist area and that businesses had to be innovative and original in the manner it attracts its customers and provide them with a high-quality service. IPC RESOLVED to ratify the content and dispatch of the letter to NDDC, Cllrs having been forwarded a copy by the Clerk with their agenda papers (8.9.05). (Noted)

(b) The Decks – (i) The Clerk reported a similar state of affairs as for The Bar except this application was to remain open until 3 am with the service of alcohol until 2 am etc. He confirmed that a similar letter (as that for The Bar) had been sent to NDDC Licensing Dept (dd 25.8.05) following liaison with Cllrs. IPC RESOLVED to ratify the content and dispatch of the letter to NDDC, Cllrs having been forwarded a copy by the Clerk with their agenda papers (8.9.05). (Noted)

(ii) The Clerk reported receipt of 7 copy letters of objection from parishioners to NDDC plus a copy petition with 86 signatories thereon (as of 31.8.05). (Noted)

(c) Licence Variations: The Boathouse and General: - (i) The Clerk reported that on 24.8.05 he had ascertained that The Boathouse had applied for a licence variation until Midnight daily Monday to Sunday but that the period for consultation had finished as of the 23rd August. He said that as a consequence he had liaised with the Chairman and Vice Chairman and subsequently written a general letter to NDDC Licensing (dd 25.8.05) complaining about the manner in which IPC was being consulted and making suggestions for improvement i.e. as for planning applications. IPC RESOLVED to ratify the content and dispatch of the letter to NDDC, Cllrs having been forwarded a copy by the Clerk with their agenda papers (8.9.05).(Noted)

(ii) The Clerk reported receipt of a telephone acknowledgement to his general letter (as at (c) above) from Mark Curgenven (Principal Licensing Officer) stating that the new Licensing Act legislation did not include parish councils as consultees and offered to provide some familiarisation training to IPC in the near future. IPC discussed this offer and RESOLVED to invite Mr Curgenven to the next meeting of IPC – Clerk to arrange. (Action: The Clerk)

(iii) The Clerk reported receipt of letters (dd 5.9.05) from NDDC reference The Bar and The Decks; they acknowledged IPC’s letters of objection and gave notice of a forthcoming licensing hearings viz The Bar – 9.30 am on Monday 26th September and The Decks – approx 11am on 26th September; both at Civic Centre, Barnstaple. IPC then discussed this issue and a RESOLUTION was passed that IPC should be represented at the hearings by Cllr Scott who had previously expressed a willingness to attend. (Action: Cllr Scott)

f) Letter (dd 16.8.05) from NDDC (Deputy Returning Officer) concerning "Parish Councillor Details": - The Clerk reported that the necessary details had been provided; telephone numbers not included. (Noted)

g) Letter (received 20.8.05) from "Local Works" concerning "Campaign of the Sustainable Communities Bill": - The Clerk said that IPC was requested to support this campaign and the Bill that "Local Works" was trying to get through parliament. He said he had passed all the relevant papers to the Chairman for perusal before the meeting. The Chairman then briefed Council; Cllrs had been provided with a copy of the letter with their agenda papers 8.9.05. After debate IPC RESOLVED not to support this initiative. (Noted)

h) DAPC AGM 2005: - (i) The Clerk reminded IPC he was to attend this meeting at Exeter on Saturday 1st October and would report on the content at the October meeting. (Noted)

(ii) The Clerk said there were vacancies (x2) on the DAPC County Committee for North Devon Cllrs – there were no nominations from IPC. (Noted)

i) Parish Seats - Marine Parade and Elsewhere: - The Clerk advised IPC of a telephone conversation he had had with John Netherway (DCC Local Services) on 25.8.05. He reported that IPC needed to be allocated a licence from DCC to place its parish seats on the highway and that the necessary paperwork had been received by him and was in hand. (Noted)

j) Letter (dd 26.8.05) from NDDC (Assistant Environmental Health Manager) reference "NDDC: Oil Spill Contingency Plan Update": - The Clerk confirmed that the necessary amendment information had been provided and returned to NDDC (31.8.05). (Noted)

k) Complaints from parishioners (to Vice Chairman and Clerk) reference "Use of Flood Defence Wall for Benches & Service of Food and Alcohol from The Bar Public House": - (i) The Clerk said he had spoken to Phil Monk (Environment Agency – 10.8.05) who confirmed the flood defence wall was the property of the EA and that his enforcement team would deal w/c 15.8.05. (Noted)

(ii) Email (dd 18.8.05) from EA: - The Clerk said this stated that the matter had been referred to the EA’s Legal and Estates Dept. (Noted)

(iii) The Clerk referred to a letter (dd 30.8.05) from Mr Coldwell (and a previous telephone call) of The 1991 Tapeley Life Interest Trust (TLIT) reference "IPC – Policy towards enhancing the Village". The Clerk reminded Cllrs he had copied this letter to them with their agenda papers (8.9.05) together with a copy of an interim reply he had sent to TLIT (dd 1.9.05). A discussion then ensured at the conclusion of which a RESOLUTION was passed to unanimously support the original action taken by the Clerk as regards his liaison with the EA and for the content of his response letter to Mr Coldwell. (Noted)

(iv) The Clerk then referred to a further letter (dd 22.8.05) received from Hector Christie (HC) (Tapeley Park) reference "Instow Village – Public Seating". The Clerk reminded Cllrs he had copied this letter to them with their agenda papers (8.9.05) together with a copy of an interim reply he had sent to HC (dd 8.9.05). After a discussion it was RESOLVED to write to Mr Christie and advise him that IPC took a neutral stance as regards the placement of the benches on the flood defence wall and that the EA had merely been advised of complaints received – whatever action they subsequently took was at their discretion. (Action: The Clerk)

(v) The Clerk reported there was now a sign affixed to the flood defence wall, opposite The Bar public house, stating the benches had been removed and that they had been so removed because of action taken by The Clerk to IPC/EA; persons who objected to their removal were invited to contact the Clerk to IPC and make their views known. He reported that no person(s) had been in touch with him as of the date of the meeting. (Noted) ** The Chairman Cllr Johns, and Cllr Crombie, declared an interest and left the room. l) Copy letter (dd 30.8.05) from Mr Coldwell of The 1978 Tapeley Park Trust (T.P.C.) to The Commodore of The North Devon Yacht Club reference "17th August 2005 – Firework Display": - The Clerk reminded Cllrs he had sent a copy of this letter to them with their agenda papers (8/9.05). (Noted)

m) IPC Standing Orders – Amendment: - The Clerk referred to an email (dd 26.7.05) from Cllr Harper reference a minor amendment to Standing Orders i.e. change PROPER OFFICE to PROPER OFFICER on Page 1. He said he had circulated an amended page 1 to Cllrs with their agenda papers (8.9.05). IPC RESOLVED to ratify this amendment. (Noted)

n) Death of Bruce Woolaway – The Commodore Hotel, Instow: - The Clerk advised IPC that following a discussion with the Chairman and Vice Chairman he had sent a letter of condolence (2.9.05) to Mrs Woolaway and her family and that he had copied the letter to Cllrs with their agenda papers (8.9.05). (Noted)

o) Letter (dd 9.9.05) from NDDC reference "Street Collection Permit – RBL Poppy Appeal – 11th/12th November 2005": - After a discussion IPC RESOLVED to offer no objection to this collection; it was a bone fide charity. (Action: The Clerk)

p) Email (dd 12.9.05) from Secretary of IIB (Dolores Harper) reference (i) "Village Message Board" and (ii) "IIB Awards – 2005": - (i) The Clerk read out a letter (dd 13.9.05) from the Chairman of IIB requesting that IPC note that IIB was in favour of a communal notice board on the side wall to the garages in the Quay Car Park (where IIB currently had a notice board). After discussion IPC RESOLVED to respond by advising the Chairman of IIB that it supported his proposal although it did not wish to be part of such an initiative having to spread its messages throughout the parish – currently at 4 sites - and to advise him that permission would undoubtedly have to be sought from NDDC who owned the garages. (ii) The Clerk said that IPC was to note that IIB, for the second year running, had been awarded a gold in the SW in Bloom Competition 2005. In addition IIB had retained The Monk Trophy, the judges discretionary prize for the best use of native flora in the region. The Clerk added that IIB’s Chairman, Peter Yeo, had also been singled out as being in the forefront as well as an authority on sustainability and the environment and that finally, this year, both the pre-school and primary school of Instow had entered the art competition on the environment and sustainability and primary student, Jessica Guymer, had won third place in the 7 – 11 year category. IPC passed a RESOLUTION to congratulate IIB, its Chairman and Jessica Guymer on their achievements. (Action: The Clerk)

5. MISCELLANEOUS: -

(a) Beach Grant 2005: - (i) The Clerk reported that nothing officially had been heard of this grant application although he had noted, by perusal of NDDC meeting papers, that IPC’s application did not fit the appropriate grant criteria but there was a recommendation it be considered by NDDC Executive. It was RESOLVED the Clerk should chase this grant up though Cllr Cann. (Action: The Clerk)

(ii) Landfill Tax Credit Scheme (see item 2507/8 (d) (iii:) – The Clerk reported he had downloaded information of relevance to this scheme from the Internet i.e. Sweet-UK and Entrust and suggested that IPC’s Finance Sub Committee consider its worthiness at its forthcoming Budget Meeting (Oct/Nov 2005). IPC RESOLVED to adopt this recommendation. (Action: The Clerk)

(b) Audit Commission - Annual Return for the Year ended 31st March 2005: - (i) The Clerk reported that no parishioners had requested to view the Council’s financial records/audit papers ("Inspection Days" Monday to Friday (9 am to 5 pm) for period 20.6.05 to 25.7.05). (Noted)

(ii) The Clerk further reported receipt of a letter (dd 8.8.05) from the Audit Commission together with the Certified Annual Return for the financial year ending 31st March 2005. He said the External Auditors Certificate and Opinion (Section 3) stated, "on the basis of our review, in our opinion the information contained in the annual return is in accordance with the Audit Commissioner’s requirements and no matters have come to our attention giving cause for concern that relevant legislation and regulatory requirements have not been met". The Clerk also reported that no other matters, not affecting the opinion of the Audit Commission, had been drawn to the attention of Council and that he had copied all correspondence to Mr G Day (IPC’s IA) and thanked him for his work and support in performing the internal audit process. (Noted)

(iii) The Clerk confirmed that the "Notice of Conclusion of Audit and Right to Inspect the Annual Return" form had been displayed on IPC’s notice board at Johns’ Post Office on Friday 12th August for a 14 day period ending on 26.8.05. The Clerk said that no parishioners had contacted him as a result of this notice. (Noted) (c) Instow Allotment & Recreation Field Account/Instow Welfare Account (Allotments): - (i) The Clerk updated Council on the progress of Cllr Harper’s request at the last meeting; see item 2507/10 (5) (c) (ii). The Clerk advised IPC that The Charity Commission had confirmed (letter of 12.9.05 refers) that The Instow Allotment Charity had been registered with them under charitable number 230996 but had been wound up and removed from the register on 29th February 1996. He said he had advised Cllr Harper of this fact. (Noted)

(ii) Cllr Harper said he had checked IPC’s minute books for the period in question but had been unable to come up with any tangible evidence that might resolve his issue. He recommended that no further action be taken – IPC RESOLVED unanimously to adopt this course of action. (Noted)

(iii) The Clerk advised IPC of the legal obligations placed on them as a result of The Smallholdings and Allotment Act 1908 Section 23. IPC RESOLVED to note this enactment for the future in the event a formal request by parishioners was made for the provision of allotments. (Noted)

(iv) Cllr White suggested that the provision of allotments at the new Instow School site might be beneficial both to the students attending and the community at large. IPC RESOLVED to support this suggestion and the Clerk was asked to advise NDDC (see ransom strip strategy- item 2509/9 (i) (d)) (Action: The Clerk)

(d) Lloyds Bank Business Account – Tax on Interest/Inland Revenue: - The Clerk advised IPC he had liaised with Lloyds TSB and hopefully resolved the double payment of tax relief refunds. He said he would report confirmation in due course, hopefully by the next meeting. (Noted)

(e) IPC – Chairman’s Chain of Office: - (i) The Clerk reported he had made further enquiries and Hill’s Jewellers of Joy Street, Barnstaple would charge less than £100 to engrave and fit four badges and provide an estimation of value. IPC RESOLVED to adopt this course of action. (Action: The Clerk)

f) Grass Cutting Contract 2006-2008: - (i) The Clerk provided IPC with the details of those contractors who had applied for this contract; it was RESOLVED the tenders should initially be considered by IPC’s FSC at its forthcoming Budget Meeting (Oct/Nov). . (Action: The Clerk)

k) Charity Commission (CC) Annual Information Update 2005 Return: - The Clerk reported receipt (20.8.05) and of having completed it as necessary/returned it to the CC. (Noted)

l) Instow Church Room - "Owned" by IPC? - (i) The Clerk advised IPC of an email (dd 30.7.05) from Cllr Harper concerning this matter that had come to light when Cllr Harper was researching IPC’s archived records; he said he had copied it to the Chairman and Vice Chairman at the time. (Noted)

(ii) Cllr Harper elaborated on his findings. (Noted)

(iii) The Clerk advised IPC he had spoken to John Edwards (JE) (Church Warden) and copied him on the relevant email (15.8.05); he added that JE had agreed to investigate with the Instow PCC and report back. (Noted)

(iv) The Clerk reported receipt of a response from JE (dd 30.8.05) enclosing a copy letter (dd 25.5.1971 - from The Clerk to IPC to Hon Secretary Instow PC) stating that "at annual parish meeting of 13.3.1970 it was resolved, that subject to it being legally possible, the parish council relinquish all interests in the vestry room in favour of the Instow Church Council and Wardens; 24 voted in favour of this, no one voted against and the remainder abstained" The Clerk said he had updated Cllr Harper and the Chairman/Vice Chairman. (Noted)

(v) Cllr Harper said he had been unable to find any other relevant information in the minutes and it now had to be assumed that the Instow PCC owned the premises in question. The Clerk confirmed he was unaware of any deeds for the property being in the possession of IPC. After debate it was RESOLVED to take no further action on this matter other than to note it within the minutes as to do otherwise could involve a great deal of legal expenses. (Noted)

m) Letter (dd 1.9.05) from Metric Parking reference "Relocation to New Premises Near Swindon": - The Clerk confirmed he had made a note of the relevant details for his records. (Noted)

n) Parish Tractor - Maintenance and Replacement: - (i) The Clerk advised IPC it would be necessary for the beach cleaner to carry out approx 5 hours of labour (Cost £25) to clean down and generally tidy up the tractor before putting it away for the winter. IPC RESOLVED to approve this. (Noted)

(ii) The Clerk also said it was the view of the beach cleaner and himself that IPC should start the process of looking for a replacement tractor for the 2006 season. IPC RESOLVED to approve the process and it was agreed that the Clerk together with Cllrs Cook and May should refer their research/recommendations to IPC’s FSC at its forthcoming Budget 2006/7 meeting. 2509/12 PLANNING

d) Erection of dwelling (additional drawings) at land at Lane End Close, Instow (Reference 39545): - (i) The Clerk notified IPC of a letter (dd 8.8.05), received from NDDC, advising that this planning application was due to be considered by the NDDC Planning Committee at their meeting of Wednesday 17th August 2005 at 2 pm and that Cllr White had attended and represented IPC. Cllr White provided an update; i.e. the application had been adjourned. (Noted)

(ii) The Clerk then referred to a further letter (dd 12.9.05) from NDDC stating that this planning application was now due to be considered by NDDC’s Planning Committee at their meeting of Wednesday 21st September 2005 at 2 pm at the Civic Centre. (Noted)

(iii) After debate it was RESOLVED to advise NDDC Planning that IPC was concerned about the anticipated disturbance to residents due to the 24-hour a day usage of the BT building at the cul-de-sac end of the road by virtue of the placement of the proposed traffic calming measures. (Item 2507/4 (a)): - The Clerk advised IPC he had liaised with NDDC Planning; The Bar was not a listed building and the removal of the railings was only a conservation area issue if they were more than I metre in height - NDDC Planning believe they were most probably not. He added that NDDC Planning were still investigating but anticipate NFA. (Noted)
