MINUTES OF THE DECEMBER 2006 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 14th DECEMBER 2006 - 7.30pm

 

 
Present: - Councillors Cllrs P Cook, N Crombie, C Harper, M Green, A Johns (Chairman), G May, Cllr Ms A Mayoh, M F Scott, S White and Mr R Jacob (Parish Clerk).

2612/1 PRAYER

2612/3 POLICE REPORT
a) Crime: -
In the absence of PCSO Charles, the Clerk read from a report that had been sent to him by PCSO Charles. It stated that two crimes had been reported in the parish since the last meeting, namely, two offences of criminal damage to a motor vehicle and bus shelter (see item 2612/9 (i) (i)) respectively. (Noted)
b) Neighbourhood Policing: - The Clerk provided Cllrs with a copy of two paper cuttings from the Western Morning News (29.11.06) and Telegraph (4.12.06) concerning “Government Funding Cut Backs in PCSOs” i.e. a cut back nationally from 24,000 to 16,000. IPC discussed the implications to Instow and RESOLVED to write to the Chief Inspector at Barnstaple Police Station to seek clarification of a former pledge (see item 2610/3 (b)) that two regular police officers would be covering the parish (with Fremington and Sticklepath) following the retirement of PC Benbow supported by PCSO Charles and probably two other PCSOs’ being made available by the relevant additional government funding. Cllrs were of a mind that Instow currently received relatively little cover, particularly from a traffic management/enforcement and high visibility patrolling (to counteract the fear of crime) point of view, and that this needed to drastically improve if the parish was to receive “value for money” from the Constabulary. (Action: The Clerk)

2612/4 PARISHIONERS
Instow In Bloom (IIB): - Peter Yeo (Chairman of IIB) reported that IIB had been selected to represent the South West in next year’s Britain in Bloom Competition. He also spoke of the Community Show 2007 coupled with a Village Garden Trail that would also feature as part of the North Devon Festival. The Chairman, Cllr Johns, congratulated IIB on being selected to take part in the Britain In Bloom competition 2007. (Noted)

2612/5 REPORT COUNTY COUNCILLOR R CANN
General: - In the absence of Cllr Cann the Clerk read out a report that had been provided by Cllr Cann. It referred to issues of relevance to Devon and Somerset Fire and Rescue Fire Authority (amalgamation now sanctioned), NDDC – Ward Member Fund (considering as per DCC; up to £6,000), Renewable Energy 4 Devon (free independent advice and support – helpline 0800 512 012 or energy@re4d.org), Litter Bin Sponsorship (businesses being given the opportunity to advertise), NDDC Stand By Service (Direct Labour Unit Out of Hours calls that require action), Oil Contingency Planning (see item 2612/8 (h)), Revenue Support Grant DCC (no change to the amount of formula grant anticipated i.e. an increase of 4%), NDDC – Tree for Cans Scheme (scheme run by Alupro who have pledged 125 trees for use in community woodland project & 14 to be sent to Africa), Visit to Civic Centre by Instow Primary School Children (25th January 2007 – objective to learn about the work of a local council), Alleged Unauthorised Signage Issues (see item 2612/8 (a)), Charter Toilets – Quay Car Park (a meeting will be arranged with parish representative in the near future); Boathouse to Charter Toilets (Lane End) Pinch Point – Poor Visibility (see item 2612/8 (b)), Slee’s Corner – Markings (see item 2612/8 (c), Rumble Strips – Village Gateway Feature (see item 2612/8 (d)) and Proposed Removal of Emergency Telephones – A361 North Devon Link/A39 Atlantic Highway (see item 2612/9 (i) (k)) (Noted)

It was RESOLVED that the November 2006 minutes of Instow Parish Council be approved and signed. (Noted)

2612/8 MATTERS ARISING FROM THE MINUTES
a) Item 2611/4 (a) - Alleged Unauthorised Signs: -
Cllr Cann, in a written report, provided IPC with an update of action taken/being contemplated by DCC/NDDC adding that matters were ongoing. (Noted)

b) Item 2611/4 (c) - Pinch Point Passing Bay Boathouse to Charter Toilets/Sand Hills: -
Cllr Cann, in a written report, agreed to include this issue on an agenda for a DCC LSG site meeting to be arranged by him in January 2007. It was RESOLVED that the Chairman and Vice Chairman would represent IPC together with other Cllrs as available on the day in question (Noted)
c) Item 2611l/5 (b) – Slee’s Corner/Road Markings: -
Cllr Cann, in a written report, agreed to include this issue on the agenda for a DCC LSG site meeting to be arranged by him in January 2007. (Noted)
d) Item 2611/8 (b) and 2610/8 (a) (i) – Traffic Congestion/Speeding –Instow: -
(i) Cllr Cann, in a written report, advised IPC that the placement of proposed “speed bumps” in the vicinity of the Signal Box (Marine Parade) would cost £2,400 a pair with signing costing an additional £450. (Noted)
(ii) Cllr Cann further reported that reactive (speeding) signs would cost £4,800; therefore, £9.600 for each end of the village. (Noted)
(iii) Cllr Cann also advised that Gateway Enhancement Features vary considerably in cost; enhanced lining would ballpark £700 per gateway but if features to the side, such as road like fencing, stone walls etc it might cost £1000 upwards. (Noted)
(iv) After discussion IPC RESOLVED to defer any decision on these issues until the DCC LSG site meeting as at item 2612/8 (b) above. (Noted)
e) Item 2611/8 (b) - Charter Toilets/Quay Car Park: -
Cllr Cann, in a written report, said a meeting would be arranged with parish representation in the near future. (Noted)
f) Item 2611/8 (c) - Sandhills Ransom Strip/Questionnaire: -
(i) IPC’s Ransom Strip Cllrs, led by Cllr Johns (Chairman), provided IPC with a briefing as to their united views following their meeting of 27.11.06. Cllr Johns said that IPC’s sub committee felt that everyone in the parish needed to have access to the “proposed/successful” project(s) and that any project(s) needed to have a long term benefit to the parish as a whole. He added that from the ideas put forward on the questionnaires nothing stood out on its’ own merit but that there were many projects that the sub committee felt IPC should support. (Noted)
(ii) Cllr Harper then referred to a synopsis report, prepared by him, and agreed to by all members of the sub committee following their meeting of the 27th November – it had been copied to Cllrs with their agenda papers (7.12.06) and to Cllrs Cann (DCC/NDDC) and Brown (NDDC) and Brian Holme (NDDC). Cllr Harper was complimented by the Chairman and IPC for the excellent manner in which he had put the report together that was both lucid and unambiguous. (Noted)
(iii) After discussion IPC RESOLVED unanimously to support the findings of the sub group, as outlined in Cllr Harper’s report. (Noted)
(iv) The Clerk advised IPC that a full Ransom Strip Steering Group Committee Meeting was to take place at the Civic Centre on Friday 5th January 2007 at 3pm and that as of the date of the meeting all IPC members were available. (Noted)

g) Item 2611/8 (f)- Instow Water Quality Tests 2006/Publicity: -
(i) The Clerk told IPC of the excellent publicity in the North Devon Journal (23.11.06) of relevance to Instow and its successful water quality results for the 2006 summer season; a copy had been provided to Cllrs with their agenda papers (7.1.2.06). (Noted)
(ii) The Clerk similarly advised IPC of an excellent article in the Western Morning News (1.12.06); a copy had been provided to Cllrs with their agenda papers. (Noted)
(iii) IPC then discussed a possible Blue Flag application for 2007 at the conclusion of which it was RESOLVED not to do so on the grounds that any application, apart from unquestionably being costly, would involve other types of criteria (other than water quality), many of which would be outside of the remit of IPC. (Noted)

h) Item 2611/12 (c) – Chemical and/or Oil Spillage: -
(i) Cllr Cann, in a written report and email (20.11.06) to the Clerk set out in succinct terms the implications (including financial) and responsibilities of an oil spill onto Instow sands as far as IPC was concerned; the Clerk reminded Cllrs he had copied Cllr Cann’s email to them with their agenda papers. (Noted)
(ii) After discussion it was (a) RESOLVED to take advice from the Allianz Cornhill Insurance Company (IPC’s insurers) to ascertain whether IPC was covered for such an eventuality (b) confer with other parish/town councils in the locality (and DAPC) to ascertain what action they have taken and then (c) in the light of responses received discuss IPC’s liability and consider an appropriate course of action that would include updating IPC’s Beach Risk Assessment policy. (Action: The Clerk)
i) Item 2611/12 (d) – Moored Tanker/Oil Jetty: -
(i) The Clerk advised IPC of his liaison with the Chairman of TTEF and the response received. (Noted)
(ii) The Clerk then referred to an email (dd 20.11.06) from the Chairman of the TTEF reference “Update of Shipping in the Estuary”; it had been copied to Cllrs with their agenda papers (7.12.06). (Noted)
(iii) The Clerk referred to a further email (dd 9.12.06) from the Chairman of the TTEF reference “Updating for Shipping Website”; this had similarly been copied to Cllrs. It referred to a website, namely “www.boat-trips.org” that sets out the movement of all shipping in the Taw/Torridge estuary within the remit of the Bideford Harbourmaster. (Noted)

2612/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter from DCC (dd 16.11.06) reference “Launch of My Devon Customer Service Centre”: - The Clerk said this letter stated that this service commenced on 26.9.06 and that in future all calls for Barnstaple Local Services Group (Highways) should be directed to 0845 155 1004. He confirmed this had been noted by him and that the letter had been copied to Cllrs for their information with their agenda papers (7.12.06). (Noted)
b) Note in NDDC’s Members Services Weekly Information Sheet (dd 24.11.06) reference “Application for the Grant of a Premise Licence by Mr R J Dennis in respect of The Wayfarer Inn, Lane End Road, Instow”: - (i) The Clerk advised IPC that this application was to enable the sale of alcohol on and off the premises between 1000hrs and 0000hrs Monday to Sunday and for persons resident on the premises for 24 hours a day, to enable late night refreshment between 2300hrs and 0000hrs Monday to Sunday, to enable live music between 1800hrs and 2330hrs Friday to Saturday and on Bank Holiday Mondays and Bank Holiday Sundays, to enable all of the above from the end of permitted hours on New Year’s Eve to the start of permitted hours on New Year’s Day; the closing date for any representation was 20th December 2006. The Clerk reminded Cllrs he had copied the details of this application to them with their agenda papers (7.12.06). (Noted)
(ii) After a discussion it was RESOLVED to make no representation. (Noted) c) (i) Letter (dd 27.11.06) from Department of Trade and Industry (Dti) reference “Future of Post Office Network”: - The Clerk advised IPC that this letter was in response to one sent by the Clerk (see item 2611/9 (i) (b)) and that a copy had been provided to Cllrs with their agenda papers (7.12.06) together with a copy of the letter sent by the Clerk. (ii) Letter (dd 30.11.06) and note/pamphlet from Nick Harvey MP reference “Rural Post Offices”: - The Clerk said letter and note/pamphlet had been copied to Cllrs with their agenda papers (7.12.06). (Noted)
d) Arctic Emblem – Presentation to Parishioner (Mr Harold John Short): -
The Clerk reported receipt of a letter (dd 26.11.06) from Mr Short thanking IPC for its letter of congratulations; he reminded Cllrs he had copied said letter to them with their agenda papers (7.12.06) together with a copy of the original letter of congratulations sent by the Clerk. (Noted)
e) (i) Letter (dd December 2006) from NDDC (Deputy Returning Officer) reference “Register of Electors 2006/7 together with copy of Register of Electors 2007 (in force from 1.12.06)”: - The Clerk pointed out to IPC that Instow’s registered electors had reduced from 671 to 659 (a reduction of 12 electors on the current year 2005/6) and that this would result in a reduction of £24 on the grant application to NDDC for 2007/8 based on £2 per head of population as per electoral roll (see item 2611/10 (5) (c)). The Clerk confirmed that the necessary public notice had been placed on the post office notice board and that a copy of the letter was circulated to them with their agenda papers (7.12.06). (Noted)
(ii) Letter (dd 1.12.06) from NDDC (Deputy Returning Officer) reference “Register of Electors 2006/7” and “List of Properties that have failed to return their Electoral Registration Forms”: -
The Clerk confirmed that a copy of the letter/list had been provided to Cllrs with their agenda papers (7.12.06) and that if any Cllr could assist in providing relevant information they might like to consider contacting NDDC. (Noted)
f) Copy letter (dd 1.12.06) from The 1991 Tapeley Life Interest Trust to DCC Highways reference “Instow Marine Parade – Inadequate Servicing of Surface Water Drainage in Highways”: -
The Clerk reminded Cllrs he had copied this letter to them for information with their agenda papers (7.12.06). (Noted) g) Copy of North Devon Local Plan 1995 – 2011 entitled “Developing and Protecting our Area”:-
The Clerk suggested this be circulated amongst Cllrs for perusal and subsequent return to Clerk for retention/future reference. (Noted)
h) Copy letter (dd 5.12.06) from parishioner to DCC Environment Director Reference “Erection of 3’ High Retaining Wall/Adjoining Road (Rectory Lane)”: -
The Clerk said this letter stated that the writer was to erect this wall to improve the aesthetic look of the frontage of his property and to prevent soil from coming down on the road. (Noted)
i) Damage to Boathouse Bus Shelter: -
(i) The Clerk reported he had noticed, on a visit to this shelter (30.11.06), that one plastic window had been forced out completely and the other partly damaged by having been forced from the inside; the window beading was recovered from the beach immediately outside. The Clerk added he had contacted the handyman who carried out a full repair (1.12.06). (Noted)
(ii) The Clerk reported receipt of an email (30.11.06) from a parishioner reporting said damage; he said the parishioner had been thanked for the information and told of the action taken. (Noted)
(iii) The Clerk reported that PCSO Charles had been notified by email (1.12.06) and that the incident was now the subject of crime number CB/06/5987; enquiries being made by PCSO Charles. (Noted)
(j) Email (dd 6.12.06) from DCC Local Services reference “IPC - Street Furniture”: -
(i) The Clerk said this requested confirmation that IPC had no interest in the single table with attached seating immediately outside of the Bar Public House on Marine Parade, Instow. (Noted)
(ii) The Clerk then referred to a reply email (dd 7.12.06) sent by him to DCC Local Services confirming that said seat did not belong to IPC. (Noted)
(iii) The Clerk also referred to an email (dd 6.12.06) sent by him to DCC Local Services reference “IPC Seat Inventory (November 2006)” together with an up to date list of IPC’s street furniture (November 2006) and which were in situ with DCC’s permission. (Noted)
k) Letter from DCC (Head of Highway Management) reference “A361 North Devon Link and A39 North Atlantic Highway: Removal of Emergency Telephones”: -
The Clerk said this stated that DCC was minded to terminate the contract with BT and remove the emergency telephones from this route and provided the reason(s) for doing so; a copy of the letter was provided to Cllrs. After discussion it was RESOLVED to take no further action albeit that IPC questioned the efficacy of DCC’s decision. (Noted)
l) Email (dd 13.12.06) from parishioner reference “Parking on Marine Parade – Inconsiderate Use of Parking Bays”: -
The Clerk outlined the content of the email and suggested that an entry be placed in the parish magazine asking parishioners to abide by the parking regulations and thereby allow general access to the various businesses in the vicinity by all motorists without them having to contravene traffic laws by parking on the pavement etc. IPC RESOLVED to adopt this recommendation. The Clerk advised IPC he had asked the question of NDDC (Car Parks Manager) as to whether IPC was covered by NDDC’s insurance when leasing the car park and was awaiting a response. (Noted)

(i) The Clerk reported that the service had been completed; see payment to Mr P Cook/Mr B Thorne as at 2 above. (Noted)
(ii) The Clerk updated IPC on the progress of his negotiations with Major Slack OC – 11 ATT Squadron RM (Instow) (Atturm) (27.10.06) reference the tractor scrape refurbishment; all in hand for January 2007. (Noted)

(i) The Clerk reported he had received a letter (dd 11.12.06) from NDDC setting out a statement of IPC’s proposed Parish Council Tax for 2007/8 i.e. Precept of £6,024 – Band D Council Tax required to produce £6,024 = £14.37 (Estimated based on year 2006/7 properties). He added that NDDC required confirmation from IPC that these figures are (a) acceptable and (b) whether IPC wished to have subscription to DAPC deducted from IPC’s first precept payment? (Noted)
(ii) The Clerk added that the parish precept figure was £24 more than requested because IPC’s maximum grant request (i.e. £2 per head of population) was only £1,318 based on 659 head of population – Source: - Electoral Roll 2007 – see item 2612/9 (i) (e).. This, he said, was a shortfall of 12 parishioners on the current (2006) electoral roll (671). (Noted)
(iii) The Clerk recommended that IPC reduce its grant request to £1,318 (from £1342) that would have the effect of also reducing the precept back to what was originally requested i.e. £6,000.00. After a discussion IPC RESOLVED to adopt the advice of the Clerk and agreed to have the subscription to DAPC taken from the first precept payment. (Action: The Clerk)
(e) DCC P3 Footpath Inspection 2005/P3 Claim for 2007:-
(i) The Clerk reported that a full footpath inspection had been completed on the 13th December 2006 (by the Clerk) and that the necessary paperwork would be returned to DCC soonest, that is, footpath status reports and P3 expenditure claim for 2007/8.

(ii) The Clerk reported that he and the parish handyman had attended a P3 Xmas Workshop at Merton on 29th November; he provided a report to Council. (Noted)
(f) Email (dd 4.9.06) from DAPC reference “Vat – Car Park Charges”: -
The Clerk updated IPC as to progress i.e. outcome of Isle of Wight Council’s appeal against judgement of High Court Tribunal in favour of HMR and C was still awaited; hearing earmarked for 27th – 30th November 2006. (Noted)
(g) Email (dd 12.1.06) from DAPC reference “Charitable Donations”: -
(i) The Clerk outlined the substance of the email and suggested that IPC consider drawing up a policy for the future if only in general terms. He suggested that IPC only considered providing donations to locally based charities and with whom all parishioners could relate. (Noted)
(ii) After a discussion IPC RESOLVED to adopt the recommendation of the Clerk and to adopt this as Council policy. (Noted) (h) Email (dd 20.11.06) from DAPC reference “Free Travel Scheme”: -
The Clerk outlined the substance of the email and advised IPC that Cllr Cann had told him this would have no bearing on IPC whatsoever and that IPC would not be expected to make up any shortfall on this initiative. . (Noted)
(i) Letter (dd November/December 2006) from HM Revenue and Customs reference “Employer Annual Return Online 2007-8”: -
The Clerk confirmed this had been noted and filed. (Noted)
(j) Email (dd 6.12.06) from Charity Commissioner’s reference “Charity Commission News” – Instow Recreation Ground”: -
The Clerk said the email had been copied on to Cllrs Johns, White, Crombie and Green (IPC’s Cheque Signatories and named Trustees) and Mr G Day (IPC’s Internal Auditor). (Noted)
(k) Beach Cleaner – Hourly Rate (see item 2611/10 (5) (b) (viii) (c)): -
The Clerk pointed out to IPC, as a means of putting the record straight, that it had not been necessary to formulate an hourly rate for the beach cleaner 2007 as he was now a self employed contractor and that payment for his services would be in accordance with his terms of agreement as per item 2611/10 (5) (b) (viii) (b). (Noted)

a) Letter from NDDC reference “Listed building application for alterations & repairs to dwelling at the Anchorage, Marine Parade, Instow (Reference No 43039): - The Clerk reported that this stated that NDDC Planning had GRANTED planning permission for this application with conditions as listed. (Noted)
b) Copy Appeal Decision from The Planning Inspectorate reference “Land at Sandhills, Instow” (Reference APP/X1118/A/06/2016612): - The Clerk reported that this stated that the appeal had been dismissed for reasons as stated; he provided a copy letter to Cllrs for their information. (Noted)
