2402/4 PARISHIONERS
a) Instow in Bloom (IIB) Activities: - Mr Peter Yeo (Chairman of IIB) provided
Council with a resume of a number of activities planned by IIB for one week
commencing on Friday 20th February with the burning/re-weave of the Heron
Sculpture on the Anstey Way grass verge - see also item 2402/9 (l). (Noted)
b) Wheelie Bins: - A parishioner reported she had recently been visited by a
member of NDDC’s Environmental Health Department (following a telephone call
she had made to that department about wheelie bins) and had been advised she
would not be “required” to have a wheelie bin following their introduction.
The parishioner enquired as to whether this could be made the subject of an
entry in a forthcoming Parish Magazine. Cllr Cann said all households would be
provided with such information prior to the introduction of wheelie bins in
Instow and would be able to exercise similar options. Cllr Scott (Editor
Parish Magazine) said he would consider writing a suitable article at an
appropriate time. (Noted)
c) Missing Speed Limit Signs -Anstey Way: - A parishioner reported that at
least 2 signs had been recently removed and not replaced. It was RESOLVED the
Clerk should contact DCC Highways and report it. (Action: The Clerk)
d) Taw and Torridge Estuary Forum (TTEF) Issues: - Mrs R M E Day provided a
brief resume of current TTEF issues (see items 2402/9 (i) (a) to (h)
inclusive) focusing primarily on the proposed shellfish regulations for the
Taw and Torridge, Appledore Quay Wall, TTEF Meeting of 19th January and
Personal Watercraft Meeting of 26th January. She sought the support of IPC to
have the subject of watercraft discussed on the forthcoming Beach Owners
Meeting (see item 2402/9 (ii) (a)) and at other relevant NDDC forum. IPC
RESOLVED to support this request; Clerk to advise John Turner (NDDC). (Action:
The Clerk)
2402/5 REPORT COUNTY COUNCILLOR R CANN
Cllr Cann reported upon surface water problems on Marine Drive that were being
attended to by DCC Highways, DCC Budget 2004/5 (set at 5.25% and requiring
£11m of cuts and 60 staff redundancies), and the New Instow School site. He
said a decision had been taken and would be announced after Instow School has
been informed on Monday 23rd February. He added that the site would have to be
acquired and planning permission sought before any further progress was made.
Finally he said that the funding for the new school was not as yet in the
programme (but having a site ready to go would enable taking advantage of any
slippage in the existing programme) and once the formalities were complete it
was hoped to provide sports facilities at an early stage in advance of the
school building programme. (Noted)
2402/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
Cllr Mrs L Brown spoke of NDDC’s Budget 2004/5 (recommendation from the
controlling group was for a 4.8% increase), the provision of Charter Toilets
at Instow by Easter 2005 (executive had formally approved the decision to
provide two blocks of toilets instead of the original proposal for one block),
and of the necessity for Councillors, who are Freemasons, to declare their
membership under the LGA Code of Conduct; this, she added, was a ruling from
the Standards Board for England. Cllr Mrs L Brown said Councillors to whom
this ruling applied may now wish to update their “Declaration”. (Noted)
2402/7 MINUTES
It was RESOLVED that the January 2004 minutes of Instow Parish Council be
approved and signed. (Noted)
2402/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2401/3 (e) etc - Traffic Issues i.e. (i) Boathouse Loading Bay and
(ii) New Road Layout at junction Marine Parade/Anstey Way: - (i) Boathouse: -
The Clerk reported that Constable Parker had been updated by him by way of a
memorandum (19.1.04) and that to date he had not come back to him. The Clerk
agreed to chase up Constable Parker. (Action: The Clerk)
(ii) New Road Layout/Anstey Way - Cllr Cann said there were still a number of
“teething problems” although it was hoped to have them all sorted in the very
near future. DCC was monitoring the junction. (Noted)
(b) Item 2401/8 (c) - Charter Toilets/Marine Parade/Sand Dunes & Quay Car
Park: - (i) Cllr Mrs L Brown (NDDC), whilst addressing IPC as at item 2402/6,
confirmed that NDDC was reviewing its decision to place the new charter
toilets on the Quay Car Park in the centre/behind the bus shelter and were
considering the option of erecting it on the site of the current toilets.
After discussion IPC RESOLVED to support this particular “consideration” of
NDDC (i.e. utilising the current site) adding that it would be its preferred
site of choice. (Noted)
(ii) The Clerk reminded Cllrs of a copy email (dd 8.2.02) forwarded to them
with their agenda papers from Cllr Ms A Mayoh. A discussion ensued, involving
Cllr Cann. Cllr Cann said the charter toilet on the Quay Car Park were going
to be far more cost effective to operate in the long term than refurbishing
the current toilets that were proving very expensive to service by NDDC in
their current form. (Noted)
(c) Item 2401/8 (e) - IPC - Training Needs: - (i) The Clerk reported receipt
of a letter (dd 16.1.04) that set out details of NDDC’s training sessions on
the “Code of Conduct/Declaration of Interest” and which he had immediately
circulated to Cllrs. The Clerk reported that 6 Cllrs in all had agreed to
attend and that he had briefed NDDC by email on 2.2.04 of their attendance.
Cllrs who had attended the training provided an overview of the training.

(ii) The Clerk reminded Cllrs that a Planning Enforcement Officer would be in
attendance at IPC’s meeting of the 18th March - 7 pm. (Noted)
(d) Item 2401/8 (f) - NDDC/Future of Lifeguard Provision - (i) The Clerk said
Council needed to consider its stance in the light of an email received (dd
17.2.04) from The Allianz Cornhill Insurance Company (copied to Cllrs for
perusal at the meeting) in response to a letter from him (dd 16.1.04). Cllr
Crombie (Risk Assessment Cllr) led a discussion at the conclusion of which it
was RESOLVED to await further discussion/feedback from NDDC (NDDC are, in any
event, only engaged in “preliminary discussions” and will be providing a
lifeguard service at Instow for the current season) and to enquire of The
Crown Commissioners as to what type of penalty might be imposed if IPC were to
withdraw from its current leasing arrangement with them as regards Instow
beach. (Action: The Clerk)
(ii) The Clerk asked Council to note an email (received 27.1.04) from the
Chairman of the TTEF to Jen Farrow Course Coordinator - Lifeguard Training,
RNLI Training Centre, Poole, Dorset reference proposed “Lifeguard Training -
Instow Beach” Noted by IPC. (Noted)
(e) Item 2401/8 (g) etc - IPC/Website Domain: - Cllr Harper reported upon a
meeting he had had with Andy Cameron (“facilitator” of the Instow Website). At
the conclusion, followed by a short discussion, it was RESOLVED that Cllr
Harper and the Clerk should continue to explore the possibility of IPC having
its own domain and that it be linked with the current Instow website. (Action:
Cllr Harper/Clerk)
(f) Item 2401/9 (i) (a) - Proposed Shellfish Regulating Order Taw/Torridge: -
The Clerk advised IPC of a positive response from the Chairman of the TTEF
following a meeting of the TTEF in January and at which this matter had been
discussed. After discussion it was RESOLVED to support the proposed shellfish
regulating order and to notify the Devon Sea Fisheries Committee accordingly.

(g) Item 2401/9 (c) - IPC / Siting of Xmas Tree-Signal Box Agreement: - The
Clerk updated IPC on progress, that is, he had received a letter (dd 30.1.04)
from NDCCS (Andy Bell) setting out a “Draft 15-year Agreement”; the Clerk read
it to Council. The Clerk recommended he write to The Cornhill Allianz
Insurance Company so as to seek confirmation the terms of the lease were in
sync with IPC Public Liability insurance. IPC RESOLVED to adopt this

(Jon Turner) for Beach Owner’s Meeting on 20.2.04: - The Clerk said he had
copied this to Cllrs Crombie and Cook with their agenda papers (12.2.04). Both

(Environmental Health Department) concerning “Bathing Waters Compliance and
Dog Bans at Instow”: - The Clerk reminded Cllrs he had circulated a copy of
this to them with their agenda papers together with a copy letter he had sent
to NDDC in support of the initiative taken by the EA. The Clerk confirmed he
had copied same correspondence to Chairman of TTEF for information. After
discussion it was RESOLVED that IPC was in support of the EA’s proposals (to
extend the current dog banning order) and that the Clerk should facilitate a
response from NDDC as to what action it proposed. (Action: The Clerk)

(c) Sand on Highway - Marine Parade, Instow particularly near Bus Stop
opposite Boathouse: - The Clerk reported he had contacted Julian Roskilly (JR)
(DCC Highways Foreman) on 11.2.04 to report this and was advised suitable
action was being taken on the 13th February. The Clerk said he had later met
up with JR personally (13.2.04) and discussed future relationships between him
and IPC. Cllr Cann asked to be kept informed of the sand on the highway
situation. (Noted)

(d) Email (dd 8.2.02) from Cllr Ms A Mayoh concerning “Truck Traffic - Yelland
Power Station”: - The Clerk reminded Cllrs he had copied this to them with
their agenda papers (12.2.02) - a discussion ensued. Cllr Cann reported that a
planning application was imminent at this site and that this might well be an
appropriate time at which to make any comment about excess vehicular traffic
both to and from the site and passing through Instow. IPC RESOLVED to adopt
this proposal. (Noted)

(a) Received telephone call (21.1.04) from Community Department of NDDC (Jo
Ash -388426) concerning “Community Alliance (CA)”: - (i) The Chairman and
Clerk reported upon a meeting that had taken place at Tawstock Village Hall at
7pm on Thursday 5th February. It had been chaired by Cllr Cann and was led by
Brian Holme (NDDC) and Ian Hobbs (DCC). The Clerk reminded Cllrs he had sent
them a resume of the meeting (as prepared by him) with their agenda papers,
and had provided them, for perusal at the meeting, a paper scripted by Ian
Hobbs (DCC). The Chairman and Clerk reported that the next meeting was to be
held at Instow Village Hall at 7 pm on Thursday 6th May (as arranged by DCC/NDDC)
and that Cllrs and local Community Groups would be invited to attend. (Noted)
(b) (i) Letter (undated - received by Chairman on 19.1.04 and passed to Clerk)
from parishioner concerning “Parish Traffic Issues- Various”: - (i) The Clerk
advised IPC he had spoken to writer (21.1.04) and told her that some of the
issues raised were already being attended to and that all issues were the
responsibility of DCC and to whom she had also copied her letter (Clerk’s
note: Cllr Cann had previously confirmed to the Clerk that he had received a
copy and spoken to DCC Highways at Barnstaple). The Clerk reminded Cllrs he
had forwarded a copy of the letter to them with their agenda papers. (Noted)
(ii) Clerk reported receipt of an email (dd 9.2.04) from a parishioner
recommending that a Pedestrian Traffic Island be installed at Anstey
Way/Rectory Lane: - see (iii) below. (Noted)
(iii) IPC Traffic Management Sub Committee: - The Clerk suggested that IPC
form a Traffic Management Sub Committee (TMSC) and that he arrange a site
meeting at Instow, in the very near future, with John Beardsley (JB) and Dave
Netherway (DN), both of DCC Highways, so as to consider/find solutions to all
“traffic” issues raised as at items (i) and (ii) above and any other that
IPC’s TMSC might deem appropriate. He said DN and JB were agreeable to such a
meeting. IPC RESOLVED to support such an initiative and Cllrs White
(Chairman), Johns (Vice Chairman), Harper and Scott were appointed. The
Chairman told Cllr Cann he would like his support for such an initiative
coupled with his attendance at the site meeting. The Clerk was asked to set up
the meeting as soon as possible. (Action: The Clerk)
(c) Letter (dd 20.1.04) from Devon and Cornwall Police Authority concerning
“North Devon Police Liaison Meeting at The Sports Hall, North Devon Leisure
Centre, Barnstaple at 7.30 pm on Thursday 12th February 2004”: - The Clerk
said he had placed the poster at the Post Office with a copy letter and had
copied all correspondence to Cllr Ms A Mayoh (IPC’s Police Liaison Cllr) and
the Chairman in the event he, or another IPC Cllr, might wish to attend. There
was no report of the meeting available. (Noted)
(d) Letter (dd 15.1.04) from Nick Harvey MP concerning “Council Tax 2004/5”: -
The Clerk said he had copied this to all Cllrs with their agenda papers on
12th February for information. (Noted)
(e) Telephone message from Chairman (22.1.04) reference complaint from
parishioner concerning” Sunken area of tarmacadam in Quay Car Park, Instow -
Danger to Pedestrians” - (i) The Clerk confirmed he had mailed (22.1.04)
NDDC’s Car Parks Department who had replied (email 23.1.04) to the effect that
“this “dip” has been looked into. It is ¾” and has been filled. To do a full
job we will need to cut out large chucks of concrete leading to further
complications in the future. The engineers will however have another look”.
The Clerk said he had emailed (26.1.04) the Chairman so he could advise the
parishioner. (Noted)
(ii) Received letter (5.2.04) from parishioner complaining about same “sunken
area”: - The Clerk read the letter to Council and reported he had liaised with
NDDC’s Car Parks Dept by email (5.2.04) and forwarded a copy of parishioner’s
letter to them in addition for its attention/action. He said he had advised
the parishioner of the action taken by him and, at the same time, suggested
that contact be made with NDDC Car Parks direct. (Noted)
(f) Spring 2004 Parish Paths Partnership Newsletter (received 24.1.04): - The
Clerk appraised Cllrs of its content. (Noted)
(g) Received letter (dd 27.1.04) and pamphlet from NDDC (Community Development
Administrator) reference “Nationwide Awards for Voluntary Endeavour in
Association with the NVCO and the Newspaper Society”: - The Clerk said that
the letter and pamphlet stated that the “Nationwide Building Society was
seeking nominations from the local community to propose people and/or groups
who it as felt had given outstanding service in voluntary and community work
for an award; everyone nominated will received a certificate to mark their
achievement. There are four categories: - (a) Young people under the age of 18
years, individual (b) Young people under the age of 18 years, group (c)
Adults, as individuals and (d) Adults as groups. Judging is to be done
regionally and nationally with the 4 final national winners receiving £500
plus a trophy together with a cheque for £2,500 to give to their choice of
charity or cause. Nominations must be submitted by Wednesday 30th April 2004”.
The Clerk said he had copied this to all Cllrs with their agenda papers on
12th February. After discussion it was RESOLVED to nominate the Instow Parish
Hall Committee and Instow in Bloom and Cllr Scott agreed to complete the
necessary nomination papers. (Action: Cllr Scott)
(h) Email (dd 28.1.04) from parishioner together with photograph of relevance
to “Hole in the Road (Drain Surround)- Anstey Way (near to Venn Cross)): - The
Clerk reported dispatch (2.2.04) of this email/photo to John Beardsley (DCC
Highways) and later, Julian Roskilly (DCC Road Foreman), for their attention;
he said he had advised the parishioner (Noted)
(i) Letter (dd 30.1.04) from NDDC concerning “House to House Act 1939: The
National Deaf Children’s Association: Mrs N Michael, 12 Resevoir Road,
Southgate, London N14 4BL: - The Clerk reported that as this was an
application by a bone fide charity he had already advised NDDC that IPC had no
objection. He explained that the application was to collect direct debit
pledges for one year in the parish. After discussion it was RESOLVED to ratify
the decision of the Clerk but to contact NDDC and express IPC’s grave concerns
about this type of collection particularly as a large number of Instow
parishioners were elderly and many might find this type of collection
“threatening” and open to abuse. The Clerk was asked to advise NDDC. (Action:

(j) Letter (dd 26.1.04) and poster from North Devon and Torridge Community
Safety Partnership entitled “Vehicle Crime Initiative”: - The Clerk confirmed
he had placed the poster at the Post Office. He said it encouraged
parishioners not to leave valuables in their cars whilst unattended. (Noted)
(k) Information (via NDDC - received 31.1.04)) of relevance to “Vital Villages
Newsletter (January 2004 - No 9) - Parish Plans, Community Services Grant and
Transport”: - The Clerk reported he had copied this to Cllr Harper (Grants
Cllr) to consider the implications for Instow, for example, a parish plan.
Cllr Harper addressed Council and said he would research the prospect of a
Parish Plan for Instow and report back. (Action: Cllr Harper)
(l) Email (dd 2.2.04) from Peter Yeo (Chairman of IIB) concerning “Re-weave of
Heron Sculpture - Anstey Way”: - The Clerk said this was part of a week-long
event that was to commence on Friday 20th February; he said a copy of the
email had been provided to Cllrs with their agenda papers for their

(m) (i) Received information (4.2.04) from a parishioner (Mrs Rose Day) that a
sheep’s carcass had been washed up on the beach: - The Clerk said he had
contacted Cllr G May and requested him to deal as necessary; the carcass was
on one of the parts of the beach leased by IPC from The Crown Commissioners.
The Clerk advised Council that a charge might follow for its disposal. (Noted)
(ii) Report (8.2.04) of a sheep’s carcass (Clerk) on Instow beach/Bottom
Sandhills: - The Clerk reported he had emailed NDDC’s Environmental Health
Dept on 9.2.04 and reported this. He added that NDDC had subsequently replied
(email 9.2.04) to the effect it would advise Devon Christie Estates. (Noted)
(n) DCC Monthly News Round-Up (February 2004): - The Clerk said he had copied
this to Cllrs with their agenda papers and placed a copy at the Post Office

(o) Email (dd 4.2.04) from Alison Mayoh reference “IPC Meetings 2004 - Parish
Hall Bookings”: - The Clerk briefed Council and provided Cllrs with a draft
amended list of meetings. After discussion IPC RESOLVED to hold its December
meeting on the 3rd Thursday of the month (16th) and the 2nd Thursday of the
month for November (11th). The Clerk said he would prepare an amended list of

5. MISCELLANEOUS: -
(a) Instow Welfare Trust (IWT): - (i) The Clerk confirmed he had written to
CCLA Investment Management Ltd (dd 16.1.04) concerning their recent letter/40p
cheque (see item 2401/10 (5) (a)) and as a consequence had subsequently
received a compliment slip together with a cheque to the value of 40p made
payable to “Devon Community Foundation”. The Clerk said he had liaised with
the Trustees of Instow Welfare Trust (Mark Kidson) and forwarded him said
cheque. Noted by IPC. (Noted)
(ii) The Clerk said he had received information from the IWT Trustees (Mark
Kidson) that the Charity Commissioners, following the statutory period of
public consultation, had no objection to the Welfare Trust being absorbed into
The Devon Community Foundation and that this was to be affected in the very
near future. IPC would be advised when it had been done. (Noted)
(b) IPC Finance Sub Committee Meeting - Budget 2004/5: -
(i) Bus Shelter - Marine Parade-Atturm: -
The Clerk reported that draft plans had been prepared by Mark Kidson and were
available for ratification by IPC. He added that a copy had been sent to Mr
Terry Shilvock (Builder) for his information and that Mr Shilvock had already
commenced preliminary work on the shelter (w/c 16.2.04). After discussion IPC
RESOLVED to adopt the plans as drafted - Clerk to advise Mr Shilvock. (Action:
The Clerk)
(c) (i) Inland Revenue - Electronic (Internet) Filing Presentation (See
2311/10 (5) (f)): -The Clerk reported he had received an invitation (28.1.04)
to attend a presentation on this at Queen House, Boutport Street, Barnstaple
at 10 am on Friday 26th March. Noted by IPC. (Noted)
(ii) The Clerk said he had received the Inland Revenue “P35 - Employers Annual
Return etc 6th April 2003 to 5th April 2004” form: (5.2.04) and that it would
be attended to at the appropriate time. Noted by IPC. (Noted)
(iii) Inland Revenue Payments (January and February 2004): - the Clerk
confirmed he had sent a “Nil Return” in respect of both months. Noted by IPC.

(d) Reclaiming of Vat: Not Registered: - The Clerk said he had received
unconfirmed information to the effect that IPC might be able to recover some
Vat from HM Customs and Excise (HMCE) even though not Vat registered. He said
he had spoken to Mr G Day (IPC’s IA) and as a result contacted HMCE (30.1.04)
and requested guidance. He said he had subsequently received a booklet,
entitled “Local Authorities and Similar Bodies - Vat” and which he had then
passed to Mr G Day to peruse/advise IPC. This guidance was still awaited.

(e) Car Park Licence inc Bottle Bank and Bus Shelter 2004/5: - The Clerk
reported that he had, on behalf of IPC, asked for the Car Park licence to be
renewed (letter from NDDC 2.2.04 refers) for the period 1.5.04 to 30.9.04 and
at a total cost of £1390.03 (£1,183.00 + Vat); he said this was an increase of
£46 on 2003. The Clerk added that in addition, a similar request had been made
(letters from NDDC 2.2.04 refers) to renew the bottle bank licence (no fee)
and bus shelter (£11.75 i.e. £10 + Vat - same as 2003) for the period 1.4.04
to 31.3.05.The Clerk said the relevant invoices were still awaited. IPC
RESOLVED to ratify the Clerk’s actions. (Noted)
(f) Instow Parish Council’s Financial Regulations (FR) - Amendments: - The
Clerk reported that in the light of his AQA Quality Council Portfolio (QCP)
“activity” he had found it necessary to amend/add to IPC’s FR’s that had only
been reviewed and “approved” at the December 2003 meeting of IPC (see item
2312/10 (5) (c)) (i)). He reminded Cllrs he had circulated a draft copy to
them with their agenda papers. The Clerk added he had discussed the necessity
of the relevant amendments/additions with Cllr Crombie who then spoke in
support. After a discussion IPC RESOLVED to approve the amended/update FR’s
and the Chairman and Clerk signed a copy. (Noted)
(g) Bank Reconciliation - 1st October 2003 to 31st December 2003: - The Clerk
reported that in the light of his AQA QCP “activity” and in accordance with
IPC’s amended/updated FR’s (see item (f) above) he had successfully carried
out this task as a “dry run” for 1st January to 31st March 2004 and that the
figures had been checked and confirmed by Cllr Crombie who agreed. (Noted)
(h) Letter (dd 9.2.04) from Information Commission (Data Protection)
confirming receipt of cheque for renewal (2004/5) - Register Entry Z7243282
and expiry date 18th February 2005: - Noted by IPC. (Noted)
(i) Draft Contract of Employment - Beach Cleaner 2004/5: - The Clerk reported
he had prepared and forwarded a draft contract of employment for IPC’s beach
cleaner 2004/5 to a local solicitor for vetting/approval. Noted by IPC.

(a) Extension and Alterations to Dwelling (Renewal of Unimplemented Permission
26220) at The Old Dairy, Marsh Lane, Instow (Reference No 36857) - see also
Item 2401/11 (d): - The Clerk reported receipt of this application (on
21.1.03) from the Chairman who confirmed that IPC’s Planning Sub Committee had
recommended approval; the Clerk said he had advised NDDC forthwith. IPC

(b) 18/84 Procedure - Circular 18/84 application by the MOD in respect of

Chairman for attention of IPC’s Planning Officers/Sub Committee; a reply was

(g) Erection of Replacement Garage with Dependant Relatives Accommodation Over
at Gorse Hill, Instow (Reference No. 37026): - (i) The Clerk reported receipt
of this application (7.2.04) and of having passed it to the Chairman for the
attention of IPC’s Planning Officers/Sub Committee; a reply was required by
26th February. After discussion IPC RESOLVED to recommend approval of this
application; Cllrs Green, May and White abstained from voting. (Action: The

Gorse Hill reference “Street Lighting” The Clerk read the email to Council and
recommended that sender be advised to contact the Technical Services of both

to support this recommendation of the Clerk. (Action: The Clerk)
(h) Copy letter (dd 11.2.04) from Planning Inspectorate (via NDDC) in respect
of “Planning Appeal - Extension to 7 Lane End Close, Instow (Reference No.
35506): - The Clerk briefed Council as to the contents of the letter. (Noted)
2402/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
(a) Venn Cross/Rectory Lane Bus Shelter: - Cllr Cook expressed concern that
this shelter was poorly lit during the hours of darkness by the surrounding
street lighting and that this deterred parishioners from using it. After
discussion it was RESOLVED that alterative sources of lighting be researched
and brought back to IPC for consideration. The Clerk was asked to liaise with
Mel Harris (Handyman) and Builder (Terry Shilvock) and explore options
available. (Action: The Clerk)
