MINUTES OF THE MARCH 2008 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 13th MARCH 2008 - 7.30pm

(please note IPC minutes are not released to the public until approved at the following meeting)

 

Present: - Councillors P Cook, N Crombie, M Green, C Harper, G May (part), B Moores (Also NDDC), S White (Vice Chairman) and Mr R Jacob (Parish Clerk). In the absence of Cllr Johns (Chairman), Cllr White (Vice Chairman) chaired the meeting.

In Attendance: Cllr Cann (DCC) and 4 parishioners

2803/1 PRAYER
The Clerk led the Council in prayer.

2803/2 APOLOGIES
Cllr Johns (Chairman), PC Hodgson and PCSO Cornish.

2803/3 POLICE REPORT
a) General: - In the absence of the police there was no report. (Noted)
b) Police Surgeries: -
The Clerk told IPC he was aware that PCSO Cornish was in the throes of putting together a plan for police surgeries in Instow and that he was considering it taking place on the fourth Thursday of each month in the parish hall between the hours of 6pm and 7pm. He added that PCSO Cornish had enquired whether Cllrs might like to join him on this venture and make it a partnership initiative. A discussion ensued at the conclusion of which IPC RESOLVED to suggest to PCSO Cornish that such police surgeries take place on the third Thursday of each month and that it precede the parish council meeting; the Clerk was asked to get back to PCSO Cornish and discuss this alternative option. (Action: The Clerk)

2803/4 PARISHIONERS
a) Planning Application – Marsden, Rectory Lane, Instow (Reference No 46220) – see item 2803/11 (b): -
A parishioner spoke of this planning application in that if granted there would be, in his opinion and that of his wife, implications as regards loss of privacy and light to an adjoining property because of its close proximity. (Noted)

2803/5 REPORT COUNTY COUNCILLOR R CANN
Cllr Cann spoke of “Link Road Litter Cleaning” (£6,000 being spent by NDDC on this initiative – 336 bags of rubbish collected to date), “Highways Issues – Recent Storms” (Thanks of IPC passed on to relevant DCC Officers), “Weight Restriction – Holmacott” (recent meeting with Police, Westleigh PC and DCC), “Solar Power Lighting – Venn Cross Bus Shelter” (see item 2803/8 (b)), “Motor Homes – Instow Seafront” (DCC Highways have been asked to investigate banning), “Civic Amenity Provision – Food/Putrescible Waste Collection NDDC Residents” (Waste Drop Off Point – Recycling Centre) and “Civil Parking Enforcement” (Transfer of powers from Police to Local Authority). (Noted)

2803/6 REPORT OF DISTRICT COUNCILLOR B MOORES
a) General: -
Cllr Moores spoke of “NDDC Capital Programme 2008/9” (Instow’s Quay Car Park Toilets included as well as Instow/Appledore DUKW), “Decks Planning Application Appeal” (dismissed by Planning Inspector – see item 2803/11 (e)), “Ransom Strip – Instow” (liaising with Cllr Cann etc – see item 2803/9 (i) (e)) and “Instow Beach Cleaning” (NDDCS have offered to give a talk to IPC). (Noted)
b) Instow – Traffic Management Issues: -
Cllr Moores said he wished to place on record that he had been taken back by the number of people who had signed the recent petition to retain two-way traffic along Marie Marine (including the bus service) and that he wished Council to know that this issue had not been a personal crusade of his but that he had been acting, in good faith, on behalf of a number of parishioners who had approached him about the matter. He added that he had put up for IPC and NDDC in order to serve the parish and that he did not have any personal interest in the subject whatsoever. The Chairman thanked Cllr Moores for his candour. (Noted)

2803/7 MINUTES
It was RESOLVED that the February 2008 minutes of Instow Parish Council be approved and signed. (Noted)

2803/8 MATTERS ARISING FROM THE MINUTES
a) Item 2802/9 (d) – New Charter Toilets/ Quay Car Park
The Clerk provided IPC with an update having recently spoken to Cllr Cann; subject to the legal issues being resolved the toilets would hopefully be built in the financial year 2008/9. (Noted)
b) Item 2802/9 (f) – Venn Cross Bus Shelter/Lighting: -
The Clerk updated IPC as to progress; the solar panel and lighting system had been installed (4.3.08) and was now operational during the hours of darkness. IPC tabled a vote of thanks to Cllr Cann for the grant that had paid for it. (Noted)
c) Item 2802/10 (i) (a) – Research: Role and Functions of Parish Councils: -
The Clerk reported receipt of a number of questionnaires for completion by him and Cllrs; he said he had circulated them to Cllrs by post (27.2.08) and that they had to be sent back, en bloc, to University of Plymouth (UOP). Cllrs handed their completed questionnaires to Cllr Moores who agreed to forward them to UOP.

d) Item 2802/10 (i) (f) – Instow Pre School (IPS): Car Park Parent Helpers: -
(i) The Clerk advised IPC of his conversation (25.2.08) with the organiser of Instow Pre School (IPS); he said IPS was a business, was not operational for the month of August and a car park concession would only be required between the hours of 9am and 12 Noon Monday – Friday (between May and September). (Noted)
(ii) The Clerk suggested to IPC that a season ticket at a cost of £40 (half price) be agreed with two tickets (only one to be used at any one time) being issued and clearly marked as “IPS” and the hours of use defined clearly thereon; he added that the organiser of the IPS would be satisfied with this compromise. (Noted)
(iii) After a discussion IPC RESOLVED to support the recommendation of the Clerk (as at (ii) above); IPC added, however, that this decision was not to be seen as a precedent for future and similar applications; each application would be treated on its merit. (Action: The Clerk)
e) Item 2802/10 (i) j) – IPC’s Self Help Emergency Plan Update: -
Cllr Harper reported upon progress; the Clerk referred to an email (dd 6.3.08) from Cllr Harper to him reference “Parish Magazine – Update Entry”. A discussion ensued at the conclusion of which Cllr Harper agreed to continue with his research with a view to updating the plan. (Action: Cllr Harper)
f) Item 2802/10 (i) (k) – NDDC Consultation: On Site Renewable Technology: -
Cllr Green reported upon his research and advised IPC that in the circumstances he did not recommend that a response by IPC was necessary; he spoke to an email (dd 9.3.08) he had previously circulated to Cllrs and the Clerk. IPC RESOLVED to adopt his recommendation and to take no further action. (Noted)

2803/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 20.2.08) from DCC reference “Listening Events: Review of Local Government – Boundary Committee for England”: -
(i) The Clerk said this referred to the request of the Department of Communities and Local Government for the Boundary Committee for England to conduct an independent review of local government in Devon; DCC was arranging a series of meetings around the county to take soundings from town and parish councils on the future of local governance of Devon. (Noted)
(ii) The Clerk said the letter had been copied to Cllrs with their agenda papers (6.3.08) and there was a meeting at Fremington Church Hall on 26th March 2008 between 10 am and 12 Noon; the Leader of DCC, Cllr Greenslade, would be in attendance to listen to views and take questions. (Noted)
(iii) The Clerk added that any Cllrs attending should note they need to confirm attendance by contacting Sarah Mupinyuri on 01392 383095 or email sarah.mupinyuri@devon.gov.uk. (Noted)
(iv) The Clerk referred to a letter (dd 26.2.08) from NDDC (Chief Executive) reference “Review of Local Government – Boundary Committee for England” together with a Member Briefing Paper (dd 19.2.08) entitled “Local Government Review”. (Noted)
(v) The Clerk said he had circulated a copy of the letter to Cllrs with their agenda papers (6.3.08) and the report had been placed with papers as at 2803/9 (iii) (i) (a) & (b) below. (Noted)
(vi) The Clerk referred to an email (dd 7.3.08) from DAPC reference “Boundary Commission Review of Local Government in Devon”; he said he had provided a copy for to Cllrs at the meeting. (Noted)
(vii) The Clerk referred to an email (dd 13.3.08) from DAPC entitled “Timely Tips to Member Councils – March 2008”; copied to Cllrs at the meeting. (Noted)
(viii) The Clerk said there were similar communications as at item 2803/9 (iii) (i) (a) and (b) below). (Noted)
(ix) After a discussion IPC RESOLVED to form a Sub Committee to consider the implications of this review; Cllr Moores agreed to attend the meeting at Fremington (as at (ii) above) and report back at the next meeting. The Sub Committee could then be agreed and meet as necessary. (Action: Cllr Moores)
(b) Instow Parish Council – Amendment to Standing Orders/Parishioner Speaking Time: -
(i) The Clerk referred to a series of emails that had circulated (period 24.2.08 to 27.2.08) amongst Cllr and others as regards this matter and recommended that IPC adopt the guidance provided by Lesley Smith (Secretary of DAPC – email of 27.2.08 refers), namely, amend standing orders 14 (a) to read “public” instead of “parishioner”. (Noted)
(ii) The Clerk said that IPC might, however, wish to consider an alternative, namely, qualifying the word “public” in as much that non parishioners could only speak at the discretion of the Chairman (providing name, address and reason to speak) and with parishioners being given preference. The Clerk reported that the relevant standing orders currently said: -
After the first business has been completed, the order of the business, unless the Council otherwise decides on the grounds of urgency, shall be as follows: -
a. To hear representations from parishioners and for the Chairman and/or Clerk to answer questions from parishioners providing that this business shall not continue more than 15 minutes, unless a majority of members present and voting shall determine otherwise. (Noted)
(iii) After deliberation IPC RESOLVED to adopt the compromise as suggested by the Clerk (see (ii) above); it was noted that Standing Orders was due for review in May 2008 and that the success or otherwise of this amendment to item 14 (a) could be considered at that point. (Noted)
(c) Letter (dd 3.3.08) and attachment (graphs) from Stephen Otter (Chief Constable Devon and Cornwall Constabulary) reference “Progress: Improving Policing Service across Devon and Cornwall”: -
The Clerk read this letter to Council; a copy of the letter/attachment was also provided to Cllrs for their information. (Noted)
(d) Email (dd 6.3.08) from NDCCS reference “Strandline Launch Event – Fremington Quay 12th March 2008 (3pm to 5 pm)”: -
(i) The Clerk said this event was billed as an opportunity to learn more about beach strandlines, to discuss beach cleaning and in general raise awareness about strandlines on North Devon’s beaches. He said NDCCS had been told that Cllr Cook would attend if available. (Noted)
(ii) Cllr Cook reported he had been unable to attend due to another commitment. (Noted)


(e) Email (dd 6.3.08) from Cllr Harper to Cllr Moores (NDDC) and copied to Cllr Cann (NDDC/DCC reference “Ransom Strip”: -
(i) Cllrs Moores said he would be bringing himself up to speed on this issue by the next meeting and would be liaising with Cllr Cann and appropriate Officers of NDDC; he said he would be taking into account the result of the recent “Ransom Strip” parish survey; Cllr Cann reminded the meeting that whatever initiative was decided upon had to be commensurate to NDDC’s policy aspirations. (Action: Cllr Moores)
(ii) Cllr Cann reminded IPC he would have £25,000 available in 2008/9 from his DCC budget for a suitable project. (Noted)
(f) Email (dd 9.3.08) from Churchwarden of Instow Church reference “Appointment of New Rector for St John’s Church, Instow”: -
The Clerk said this stated that the Rev Geoff Calway of Appledore had been appointed as the new Rector at St John’s Church, Instow and that he was to be inducted on Easter Sunday at 6.30 pm. The Clerk added that IPC was invited to send along a representative. (Noted)
(g) Recent Storms, High Tides and Winds: -
(i) The Clerk advised IPC that following a consultation with the Chairman of the TTEF he had communicated (emails of 12.3.08 refers) with Cllr Cann (on behalf of DCC Local Services and South West Highways) and the Environment Agency to thank them most sincerely for all the hard work and commitment put in by their staff over the recent period of extremely bad weather. (Noted)
(ii) The Clerk also referred to an email (dd 11.3.08) from the Chairman of the TTEF reference “Floods at Instow – Report of Various Problems”; the Clerk advised IPC of the relevant issues (floating dead sheep, damaged railings/dinghies, storm damage to shed etc) and of the action taken by him. (Noted)
(iii) The Clerk also referred to an email (dd 12.3.08) from DCC’s Local Services Superintendent thanking IPC for its very kind words and pointing out “clearing up” issues in respect of dinghies moored to the railings/lampposts (told that EA were dealing as regards railings/dinghies and suggested he contact parish magazine editor to request dinghy owners not fix them to lampposts along Marine Parade or enforcement action would be taken) and the action he intended to take reference the seawall and dog bins by Boathouse flood defence gate. 5. MISCELLANEOUS: -
(a) Mole Valley Farmers – IPC Account (February 2008): -
The Clerk advised IPC that this confirmed IPC was in balance. (Noted)
(b) (i) Tractor Service – Additional Work: -
The Clerk provided IPC with an update; see payment as at 2 above (Thorne). (Noted)
(ii) Tax Disc Application – 1st April 2008: -
The Clerk confirmed that a reminder had been received (10.3.08) from DVLA and that the tax disc had been applied for via DVLA website; received 12.3.08 and handed to IPC’s beach cleaner. (Noted)
(c) Use of Instow Sands – Atturm: -
The Clerk reported to IPC he had not received any further correspondence on this matter since the last meeting; he anticipated a response by the next meeting. (Noted)
(d) Beach Cleaning Grant 2008: -
(i) The Clerk advised IPC he had liaised with Cllr Cann who agreed to establish in what format IPC was to apply for this grant. (Noted)
(ii) The Clerk reported receipt of a letter (dd 11.3.08) from NDDC reference this grant = £1,800.00. The Clerk advised IPC that this would be dealt with when accounts for current financial year had been finalised as this was one part of the administrative trail that has to be completed by him when applying for the grant. (Noted)
(iii) Cllr Cann said he was disappointed that the grant had not been increased by inflation as he had recommended; the Clerk said IPC had received £1,800 pa for at least the last 7 years. (Noted)
(e) TTEF Subscription 2008/9: -
The Clerk reported receipt of an email (dd 27.2.08) from Secretary of TTEF acknowledging receipt of IPC’s subscription cheque 2008/9. (Noted)
(f) (i) Email (dd 26.2.08) from National Council for Voluntary Organisations (NCVO) Membership Team reference “Free NCVO Membership – Instow Recreation Ground”: -
The Clerk said this invited IPC to become a NCVO member for free; the Clerk questioned what benefit this might afford IPC when said account was virtually dormant. IPC RESOLVED to take no further action. (Noted)
(ii) Email (dd 4.3.08) from Tricycle Media reference “Website – Registered Charities”: -
The Clerk said this similarly invited IPC to become a Tricycle Media member who would develop a website free; the Clerk again questioned what benefit this might afford IPC when said account was virtually dormant. . IPC RESOLVED to take no further action. (Noted)
(g) Trustee Voices Magazine – March 2208/Instow Recreation Ground: -
The Clerk said this would be filed for future reference and would be available to the Trustees of the account if they wished to see it. (Noted)
(h) Grass Cut – Pre Easter 2008: -
The Clerk advised IPC he had asked the handyperson to cut the grass prior to Easter; this, he said, was covered in the budget 2007/8 on the basis a Xmas cut did not get done. IPC RESOLVED to ratify this decision. (Noted)
(i) Letter (dd 29.2.08) from NDDC (Deputy Returning Officer) reference “Parish Council Elections 3rd May 2007 – Uncontested Elections”: -
(i) The Clerk said this stated that following a full meeting of NDDC on 20th February 2008 it had been resolved that (a) those costs incurred by NDDC in respect of the May 2007 ordinary election of parish councillors from those parish councils where the election did not result in a ballot be not recovered and those who have paid the bill be refunded; (b) that a policy for the recovery of NDDC costs for future such elections be considered by NDDC and (c) that a meeting be arranged with parish councils to explain the costs incurred by NDDC even though an election did not result in a ballot. (Noted)
(ii) The Clerk also referred to a credit note received from NDDC (received 1.3.08) for refund of £235.68 that had not been paid; the Clerk suggested NFA. IPC RESOLVED to ratify this decision. (Noted)
(j) Handyperson’s Public Liability Insurance 2008/9: -
The Clerk confirmed he had received a copy of this for the period 5.3.08 – 5.3.09; limit of liability £5 million and that it had been filed for future reference. (Noted)
(k) VAT Claim 2007/8: -
The Clerk reported he had submitted a VAT reclaim (13.3.08) for a £832.23. (Noted)

2803/11 PLANNING
a) (i) Town and Country Planning General Regulations 1992 – Regulation 3: Change of use of land from agricultural to education purposes, construction of grass playing pitch with land drainage, access road and turning head. Construction of temporary path from existing school to proposed playing field at land to south of B3233, adjacent to Venn, Instow (Reference No ACB/DCC/2566/2007) AND: -
(ii) Town and Country Planning General Regulations 1992 – Regulation 3: single storey 5 class primary school at land to south of B3233 adjacent to property known as Venn, Instow (Reference Number ACB/DCC/2602/2008): -
