MINUTES OF THE  JUNE 2009 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON
THURSDAY 18th JUNE 2009 AT 7.30 PM

(please note IPC minutes are not released to the public until approved at the following meeting)

 

Present: - Councillors P Cook, Mrs T Dipper, M Green (Vice Chairman), B Thomas, S White (Chairman) and Mr R Jacob (Parish Clerk).

In Attendance: Cllr R Cann (DCC), Cllr B Moores (NDC) and 4 parishioners.

2906/1 PRAYER
The Clerk led the Council in prayer.

2906/2 APOLOGIES
Cllrs N Crombie, C Harper, A Johns, G May and PC Hodgson.

2906/3 POLICE REPORT
a) Crime: -
PCSO Cornish said that 3 crimes had been reported in the parish since the last meeting, namely, a burglary (beach kiosk), theft of a handbag (on the beach) and a domestic (non crime specific). (Noted)
b) Other Matters: -
PCSO Cornish said that 5 incidents had been reported in the parish since the last meeting, namely, x2 assist ambulance with a patient, x1 welfare, x1 false alarm and x1 vehicle obstruction. (Noted)
c) Neighbourhood Watch Update: -
PCSO Cornish said he would do all he could to assist the parish council with its “messaging” initiative (see item 2906/9 (i) (b)). (Noted)
d) Marine Watch: -
PCSO Cornish said he was, in liaison with the Home Office, considering the introduction of such an initiative in Instow and was currently seeking suitable funding to support it. (Noted)

2906/4 PARISHIONERS
a) Instow Verges/Pavements and Hedgerow: -
(i) A parishioner said the hedgerows and associated verges/pavements throughout the parish were poorly maintained and that it was time they were attended to. He referred in particular to the hedge/verge/pavement between Atturm and the Tarka Trail Bridge (Marine Parade – Seaward side), Atturm towards West Yelland on Anstey Way (Slip road etc), Anstey Way/Junction of Marine Parade (Atturm) towards Bideford and from Anstey Way towards the parish church. (Noted)
(ii) The Clerk advised IPC he had endeavoured to draw these pressing issues to the attention of DCC’s Highways Superintendent but to no avail. (Noted)
(iii) The Clerk advised Council he had also received complaints about the unkempt verge adjacent to the Charter toilets opposite the Sand Dunes car park entrance which appeared to be privately owned. (Noted)
(iv) A discussion then ensued at the conclusion of which Cllr Cann (DCC) said he would liaise immediately with DCC Highways and get all matters, as at (ii) and (iii) above, sorted as a matter of some priority. IPC thanked Cllr Cann for his valuable assistance. (Action: Cllr Cann)
b) Footpath Number 3 – Venn Cross to Tarka Trail: -
(i) A parishioner said he still believed that where this footpath crossed the Tarka Trail (near the Picnic Area) was badly signed. The Clerk reminded Council that both gates had waymarkers fitted that indicated the direction of travel for walkers. (Noted)
(ii) The parishioner said on two occasions recently he had found these gates tied by binder twine and wire and felt that the authorities should be advised. IPC RESOLVED to advise DCC’s Footpath Warden. (Action: The Clerk)


c) Armed Forces Veterans Day/65th Anniversary D Day Landings: -
A parishioner provided information of relevance to the above and thanked all persons concerned for the organisation of an excellent service at Instow Church to mark the 65th Anniversary of the Day Landings. The Chairman thanked Cllr Dipper for her valuable contribution in this respect. (Noted)

2906/5 REPORT COUNTY COUNCILLOR R CANN
a) DCC Elections: -
Cllr Cann thanked everybody who had supported him and said he was delighted to still be in a position to provide a service to Instow. He added that his re-election had re-invigorated him although he felt some regret he was not in a position to sit as a member of the Executive; he was, however, leader of the non-aligned group. (Noted)
b) DCC Council Meeting (25th June): -
Cllr Cann said he had tabled two questions as regards “Members Allowances” (he had suggested that allowances be reduced to the 2005 level adjusted to the 2009 rate) and “Westleigh Junction off A39/Fremington Rural” (this junction had long been the source of concern to him and residents and the advice he had been given was that the only real solution was a roundabout – portfolio holder to give this serious consideration for implementation at earliest opportunity). c) Instow New School: -
Cllr Cann said DCC were still awaiting a reply from a landowner. (Noted)
d) Instow – Traffic Issues (see also item 2906/8 (e) (iii)): -
(i) Cllr Cann said he had hoped to meet up with a senior DCC Highways Officer, on site at Instow, prior to the meeting but that he could not coordinate the time/date of the meeting with the availability of the Clerk or an IPC Cllr representative. He said he hoped to re-arrange it prior to the July meeting of IPC. (Noted)
(ii) IPC RESOLVED to support such a meeting with the Clerk and a Cllr representative to attend if available. (Action: Cllr Cann & The Clerk)
e) Instow – Signage Problems: -
Cllr Cann said there was still an issue within Instow of the misplacement of signs on the highway and that because of complaints he had received he was going to pursue the matter soonest. (Action: Cllr Cann)
f) General: -
Cllr Cann spoke of “Food Waste Collection” (successful to date – 3.2 tonnes per week) and “Dry Recycling Collections/In House Savings” (successful to date – 3.2 tonnes per week). (Noted)

2906/6 REPORT OF DISTRICT COUNCILLOR B MOORES
a) DCC Elections: -
Cllr Moores congratulated Cllr Cann on his success in the recent DCC Elections and said he would be very happy to continue to work with him. (Noted)
b) Instow New School: -
Cllr Moores said he had finally received a response from DCC and that it merely confirmed everything that Cllr Cann had advised IPC of late. (Noted)

2906/7 MINUTES
It was RESOLVED that the May 2009 minutes of Instow Parish Council be approved and signed. (Noted)

2906/8 MATTERS ARISING FROM THE MINUTES
a) Item 2905/10 (b) – Village Gateway Initiative: -
The Chairman provided IPC with an update; he said DCC Highways had failed the project during its “safety audit” process but that he was soon to meet up with an Officer and endeavour to resolve DCC’s concerns by tweaking the project wherever necessary. Cllr Cann said he would assist in this process.

b) Item 2905/10 (d) - DCC Commons Act 2006/IPC Actions: -
(i) In the absence of Cllr Harper, the Clerk provided IPC with an update on Cllr Harper’s action(s) to register the land (beach) between the mean high tide mark and the seawall along Marine Parade between the Commodore Slipway and Boathouse Flood Defence Gate as common land. (Noted)
(ii) The Clerk advised IPC what information he had gleaned from the Crown Estate as regards the ownership of this land; email (dd 17.6.09) refers. (Noted)
(iii) The Clerk told IPC of his enquiries with DCC’s Land Charges Manager reference “Instow’s Village Green – Recreation Ground” and whether to de-register or de-register/re-register in IPC’s name; he referred to an email (dd 17.6.09) from DCC’s Land Charges Manager. In a nutshell it was recommended that IPC should take no further action as the Recreation Ground, whilst registered as a “Village Green” was fully protected from development. (Noted)
(iv) After a discussion IPC RESOLVED to take no further action and to accept the guidance as at (iii) above. (Noted)
e) Item 2905/10 (e) – Marine Parade/One Way Bus Service Proposal (see also item 2906/5 (d)): -
(i) The Clerk advised IPC he had liaised with Cllr Cann (DCC) by email (22.5.09) reference this matter and asked him to liaise with DCC Highways at the Civic Centre to establish an appropriate course of action. (Noted)
(ii) The Clerk referred to a telephone conversation (28.5.09) and an email (dd 29.5.09) from DCC’s Chief Assistant Engineer reference “Instow Traffic Issues – Instow Seafront”; the Clerk outlined DCC’s recommendation, that was, a DCC Traffic Team review the seafront parking/traffic flow with a parish working group in the autumn 2009. The Clerk suggested that this also ought to include a meeting with the bus companies. (Noted)
(iii) Cllr Cann then said he was to arrange a site meeting in Instow during the next couple of weeks with a senior DCC Highways Officer and that he would liaise with the Clerk when the details were known; it was RESOLVED that the Chairman and/or another Cllr ought to be present. (Action: Cllr Cann/The Clerk)
d) Item 2905/11 (i) (e) – Parish Council Workshop/Local Development Framework: -
(i) The Clerk reported that Cllr Mrs Dipper had attended the Braunton event (28.5.09) and was to give a report. (Noted)
(ii) Cllr Mrs Dipper then spoke to a report that had been circulated; a discussion ensued. (Noted)
e) Item 2905/11 (i) (k) – Quality Parish Council Reaccreditation Update: -
(i) The Clerk told IPC that before re-accreditation could be applied for IPC needed to put in place: -
a) A “Community Engagement Strategy”
b) Adopt (as a minimum) a “NALC/SLCC Terms and Conditions” agreement for salaried staff.
c) Adopt a “Training Statement of Intent” to include Clerk and Cllrs. (Noted)
(ii) The Clerk outlined each point in greater detail and a discussion ensued. (Noted)
(iii) The Clerk reported receipt of a letter (dd 8.6.09) from NALC (Taunton Office) reference “Submission of Section 7 – The Power of Well-Being”; he said this confirmed receipt of the Clerk’s submission paper for his personal local government qualification including the fact it had been sent to a verifier. (Noted)

2906/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 20.5.09) from NDC (Technical Support Administrator) reference “Street Collection Permit – ND Mini Register on behalf of Children’s Hospice SW”: -
(i) The Clerk said this stated that this collection was to take place in the parish of Instow between the hours of 8 am and 6 pm on Monday 31st August 2009. (Noted)
(ii) The Clerk advised IPC that in view of the fact this was a bone fide charity and an annual collection he had told NDC (email of 28.5.09 refers) that IPC would have no objection. (Noted)
(iii) IPC RESOLVED to ratify this decision. (Noted)
b) Neighbourhood Watch – Messaging (Item 2905/10 (a) (iii and iv)): -
(i) Cllr Mrs Dipper advised IPC of her enquiries of relevance to this matter since the last meeting; email (dd 9.6.09) to Clerk refers. She said she was in a position to receive copies of relevant email messages on a regular basis and could vet those that were not relevant to Instow. (Noted)
(ii) IPC then discussed the implications at the conclusion of which it was RESOLVED that the Clerk should contact the Instow Website webmaster to ascertain if it was possible to have a “Neighbourhood Watch” web page onto which relevant messages could be posted. (Action: The Clerk)
c) All Saints Chapel Grounds – Play Area: -
(i) The Clerk advised IPC of his enquiries of Reverend Calway and members of the PCC as regards the possible use of the Chapel’s grounds as a form of children’s play area bearing in mind that the chapel was also going to be made use of as a community resource. (Noted)
(ii) IPC then discussed the implications at the conclusion of which it was RESOLVED to support such an initiative in principle subject to the agreement of the Instow PCC; Clerk to speak to the Reverend Calway. IPC recognised that if this project was to succeed both IPC and the PCC would need to work in harmony and that much professional advice and guidance would be necessary. (Action: The Clerk)

d) North Devon Cricket Club (NDCC) – Licensing Application: -
(i) The Clerk told IPC that NDCC was applying for the grant of a premises licence to enable it to:
(a) Sell alcohol on and off the premises on Thursday 30th July 2009 from 10.30 hrs to 21.00 hrs, Friday 31st July 2009 from 12.00 hrs to 0200 hrs and Saturday 1st August 2009 from 12.00 hrs to 01.00 hrs.
(b) To enable regulated entertainment on the 31st July and 1st August 2009 from 19.00 hrs to 01.00 hrs
(c) To enable late night refreshment on 31st July and 1st August 2009 from 23.00 hrs to 03.00 hrs.
(ii) After a discussion IPC RESOLVED to offer no objection to this application but to express concern about the possible impact on neighbouring properties with rowdyism and noise. (Action: The Clerk)
e) Letter (dd 11.6.09) from NDC (Technical Support Administrator) reference “House to House Act 1939: PDSA and Cats Protection League”: -
(i) The Clerk said this stated that this collection was to take place in the parish of Instow between Monday 19th October and Saturday 24th October (inclusive). (Noted)
(ii) The Clerk advised IPC that in view of the fact this was a bone fide charity and an annual collection he had told NDC (email of 16.6.09 refers) that IPC would have no objection. (Noted)

The Clerk said this letter sought permission from IPC to use part of Instow Sands (as leased by IPC from the Crown Estates) on which to hold a BBQ; all rubbish would be removed and the beach left as found. IPC RESOLVED to approve this event; Clerk to liaise with writer. (Action: The Clerk)

The Clerk reported receipt of a letter (dd 26.5.09) from The Royal British Legion confirming receipt of the donation payment (see May meeting); filed by Clerk. (Noted)

(c) Crown Estate (CE) Beach Lease 2010+ : -
(i) The Clerk confirmed that as of date of the meeting no “head of terms” has been forwarded by the CE for IPC’s perusal. (Noted)
(ii) The Clerk reminded IPC, however, he was to meet with CE’s agent at Instow on 26th June (Noon) and would discuss the renewal of the beach lease and ownership of the beach between the mean high tide mark and seawall (Commodore to Boathouse). (Noted)
(d) Audit Commission- Annual Return for the Year ended 31st March 2009: -
(i) The Clerk confirmed he had returned the signed Annual Return 2008/9 form to Mrs Mary Jane Scott (25.5.09) for final completion by her and onward transmission to the AC. (Noted)
(ii) The Clerk said that no requests, as of the date of the meeting, had been received by him as a result of the publication of the “Exercise of Electors Rights” form at the post office (“Inspection Days” being Monday to Friday {9 am to 5 pm} for the period 22nd May to the 19th June 2009 (i.e. 20 working days). (Noted)

2906/11 PLANNING
a) Erection of office accommodation to rear, conversion of existing offices to form 1 flat with new staircase together with formation of first floor outside decking area to provide seating and to the rear a lean-to and additional parking facilities at The Decks, Marine Parade, Instow (Reference No 48388): -
(i) The Clerk reported he had advised NDC Planning (email 22.5.09 refers) of IPC’s decision to recommend refusal of this application on the grounds of “over intensification of the site and privacy issues for neighbouring properties” and also made a request (email of 22.5.09 to NDC Planning copied to Cllr Moores) of Cllr Moores (NDC) to “call in” the application for consideration by NDC’s Planning Committee. (Noted)
(ii) The Clerk reported receipt of an email (dd 26.5.09) and attachments from a parishioner reference this application setting out his reasons for objection; the Clerk elaborated. The Clerk confirmed he had acknowledged receipt of the email. (Noted)
(iii) The Clerk reported receipt of two emails (dd 15.6.09) from Cllrs Cann and Moores together with an email (dd 15.6.09) from NDC Planning. The Clerk advised IPC that in summary, NDC Planning had, as a consequence of responses from DCC Highways and NDC Environmental Health (who had expressed concerns about “highway issues” and “decked area – the impact this would have on the amenity of the neighbouring property, which is semi detached”) decided to write to the agent outlining said concerns and to suggest that the parking and decked seating area were omitted from the scheme and the application resubmitted for further consideration; this would in theory mean that only the new office store would be applied for. (Noted)
b) Demolition of existing conservatory and erection of canopy at North Yeo, Marine Parade, Instow (Reference No 48462): -
i) The Clerk reported receipt (12.6.09) of this application and of having passed it immediately to the Chairman for the attention of IPC’s PSC; for response by 30th June 2009 or an extension would need to be applied for. (Noted)
(ii) The Clerk confirmed that details of the application had been placed on the Instow website for the information of parishioners. (Noted)

g)“Town and Country Planning General Regulations 1992 – Regulation 3/Construction of footway/cycleway on eastern verge on the private road between the B3233 and the Estuary Business Park, Yelland, Barnstaple (Reference No JR/DCC/2755/2008): -
(i) The Clerk referred to an email (dd 10.6.09) from DCC to Cllr Cann (copied on to IPC) stating that a bird nesting survey had been carried out on the site of this proposed cycleway and that as no birds were identified it had been agreed that clearance of the vegetation could be undertaken prior to the end of the bird nesting season (31st July) provided that a survey to identify nesting birds was undertaken immediately prior to the commencement of the clearance. If nesting birds were identified then the work would be immediately stopped until the nesting season has finished. (Noted)
(ii) The Clerk referred to an email (dd 12.6.09) from a parishioner to Cllr Cann (copied to IPC) in respect of this matter; he elaborated. (Noted)

2906/12 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
a) Dangerous Anchors/Moorings – Instow Beach: -
Cllr Mrs Dipper said she was concerned about a number of anchors/mooring drums on the beach near to the Commodore slipway that appeared dangerous and a health and safety hazard. During a discussion it was established these were the property of Instow Marine and a RESOLUTION was passed to ask it to move them or at least make them safe. (Action: Cllr Cook)
b) Unkempt Grass Verges – IIB Flower Beds: -
Cllr Cook said he had received several unfavourable comments about the apparent unkempt state of the IIB flower beds within the various grass verges throughout the village. He said the same situation had prevailed last year and he had hoped there would have been a marked improvement this year. IPC RESOLVED to have the Clerk advise the Chairman of IIB of the nature of the complaints and to seek an early solution to the problem. (Action: The Clerk)
c) Overgrown Hedge – Rectory lane, Instow: -
Cllr Cook said that although some work had been done on hedges within Rectory Lane by various landowners, one particular hedge on the left hand side (going up the road past Rectory Close) was in need of trimming on road safety grounds. IPC RESOLVED to notify DCC Highways. (Action: The Clerk)
