2701/3 POLICE REPORT
a) Crime: -
PCSO Charles (Off Duty) said he was pleased to report that no crimes had been
reported within the parish since the last meeting. (Noted)
b) Neighbourhood Policing: -
PCSO 30093 Charles said that Constable Cobb was transferring to another
department and that her NBO role within the Longbridge/Fremington/Instow
parishes had been advertised. He agreed to keep IPC informed of progress as
regards her replacement. He confirmed that Constable Napier was still
responsible for the patch and that the force was hoping to have a further PCSO
allocated to the area in April/May. PCSO Charles said all members of the
Neighbourhood Beat Team (NBT) could be contacted via 08452 777 444 (ask for
NBT Office at Barnstaple; this is for non emergency matters only). Cllr Scott
agreed to publish this information in the parish magazine. (Action: Cllr

c) Neighbourhood Watch: -
PCSO Charles said he would like to recruit more neighbourhood watch
coordinators within the parish; Instow currently only has one (New Road). Cllr
Scott agreed to publish this plea in the parish magazine; anybody interested
should contact PCSO Charles. (Action: Cllr Scott)
d) Illegal Parking – Marine Parade (Signal Box – Quay): -
PCSO Charles said he had leafleted all residents within this area informing
them of the parking restrictions adding that repeat offenders may well be
given fixed penalty tickets. He said the area would continue to be patrolled
by police officers and traffic wardens. (Noted)

e) Future IPC Meetings: -
PCSO Charles said he would be unable to make the next 3 IPC Meetings –
February (Attending an award ceremony at Exeter), March (Attending a course at
Exeter) and April (On honeymoon). He apologised but added that a Newsletter
would be provided on each occasion to the Clerk and that PC Napier might
attend if he was available. (Noted)
f) Speed Gun: -
PCSO Charles said he would be attending the parish in the next week or so to
operate a mobile speed gun to deal with the council’s concern about excess
speeds within the village by motorists. (Noted)
g) Police Surgery – Fremington: -
PCSO Charles said Constable Napier held a police surgery at the Fremington
Parish Council Offices between 10.30 am and 11.30 am on the 3rd Thursday of
each month and that Instow parishioners would be welcome to attend. Cllr Scott
agreed to make a reference to this in the forthcoming parish magazine.

h) Compliment to PCSO Charles: -
The Chairman and Clerk complimented PCSO Charles on his commitment and
enthusiasm for working within the parish and thanked him for attending the

2701/4 PARISHIONERS
a) Alleged Illegal Signs: -
A parishioner reported that some of the alleged “illegal” signage on the Tarka
Trail had been moved to another location within the same locality. Cllr Cann
said DCC and NDDC were in the throes of communicating with the alleged “offender(s)”
and that in due course a review would materialise as regards a prosecution.

b) Taw and Torridge Estuary Forum (TTEF) Report: -
Mrs Rose Day (Chairman of TTEF) provided a verbal a report to Council and gave
each Cllr a file of papers for their information/perusal. She spoke on items
of relevance to TTEF Management Study for Braunton Burrow, TTEF Annual
Subscription 2007, TTEF Receipts and Payments Account for Year End 2006,
Bideford Harbourmasters Report (copy provided), UNESCO International Biosphere
Reserve Strategy, Braunton Burrows Report (copy provided), Devon Estuary
Officer Group, North Devon Area of Outstanding Natural Beauty, Knapp House,
Moorings Code of Conduct, Appledore Slipway, Civilian Launching from RMB

2701/5 REPORT COUNTY COUNCILLOR R CANN
a) North Devon Link and A39 – Various: -
Cllr Cann reported that DCC proposed to reduce the maintenance standard of
these highways, remove emergency telephones and two picnic areas adding this
was due to a general reduction in funding of highway maintenance and road
saltings. After a discussion IPC RESOLVED to write to DCC (copy to Nick Harvey
MP) to express its dismay at such a decision. IPC noted that the North Devon
Link/A39 was the main arterial road into/out of North Devon and that it could
ill afford to have its maintenance standard reduced without seriously
affecting the health and safety of road users. (Action: The Clerk)
b) North Devon Coast and Countryside Service (NDCCS): -
Cllr Cann reported that DCC was proposing to cut 40% from the budget of NDCCS
and that he felt this was appalling. After a discussion IPC RESOLVED to write
to DCC (copy to Nick Harvey MP) to express its dismay at such a decision. IPC
noted that the NDCCS provided an excellent service to North Devon
(particularly within the parish of Instow) and was the main driving force
behind the Braunton UNESCO Biosphere that was a site of worldwide importance.

c) General: - Cllr Cann spoke of Devon Recycling Figures (rates have jumped
again to 45.7% from 40.6% six months ago), Proposed Reorganisation of Local
Government in Devon (Exeter City Council has bid to become a Unitary
Authority), School Closure – Chawleigh, Northcott Theatre – Grant by DCC
(£200,000 in addition to a previous substantial grant), Instow New School
Update (Legal situation being reviewed 19th January – planning process could
possibly commence within 3 weeks), Demolition of Barnstaple Civic Centre (a
political stunt?), Improving Devon’s Environmental Sustainability in Street
Lighting Equipment (DCC has adopted a strategy to reduce energy (street
lighting) consumption with a view to becoming England’s greenest County
without compromising safety and crime prevention aspects). The Clerk reminded
IPC and Cllr Cann that IPC had raised this particular issue (April 2006) as a
consequence of an interest expressed by a parishioner and that he had liaised
with DCC at that time; IPC may well, therefore, have prompted this debate.

2701/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
Cllr Mrs L Brown said that for the last 8 years she had been the Conservative
District Cllr for the area but that she was now considering standing down to
allow someone else to have the opportunity to serve the parish and provide a
fresh approach; she offered advice and guidance as necessary. (Noted)
2701/7 MINUTES
It was RESOLVED that the December 2006 minutes of Instow Parish Council be
approved and signed. (Noted)
2701/8 MATTERS ARISING FROM THE MINUTES
a) Item 2612/3 (b) - Neighbourhood Policing: -
(i) The Clerk confirmed he had written to Chief Inspector Davies (21.12.06)
asking for an update on neighbourhood policing in Instow in the light the
government was to cut the number of pledged additional PCSO’s; he said he had
forwarded a copy of the letter to them with their agenda papers (11.1.07).

(ii) The Clerk then referred to an email (dd 4.1.07) from Inspector Toby
Davies stating that his aspiration was still to have at least 2 PCSO’s on the
Instow side of the River Taw with the two current Neighbourhood Beat Managers
(NBM’s), Constable’s Napier and Cobb, and he was happy for NBM’s to target
persistent traffic management issues as and when necessary. The Clerk said he
had copied this email to Cllrs with their agenda papers (11.1.07). (Noted)
(iii) IPC RESOLVED to take no further action other than to note that the
situation was far from acceptable and that policing in Instow should be
monitored and police integration/activity scrutinised. (Noted)
b) Item 2612/8 (b), (c) and (d) and 2612/9 (i) (l) - Traffic Management Issues
(Slee’s Corner, Pinch Point Boathouse to Sand Dunes, Traffic
Congestion/Speeding and Parking on Marine Parade/Inconsiderate Use of Parking
Bays): -
(i) Cllr Cann/Chairman and Vice Chairman provided details of a number of site
visits they had attended (16.1.07) together with a representative of DCC Local
Services. It was said appropriate road markings would be added to Slee’s
Corner junction to make it perfectly clear to motorists as to which lane(s)
they should exit/enter, it would not be practical/cost effective to move the
Boathouse Pinch Point as visibility was not overtly affected and that plans
and exact costings would be put together as regards the Speed Humps/Village
Gateway Initiative that had previously been discussed. (Noted)
(ii) IPC RESOLVED to agree, in principle, that it would be prepared to fund
some of the costs for the Speed Humps/Village Gateway road safety initiative
subject to it agreeing, as a council (following sight of the definitive plans/costings)
that it would be beneficial to the community at large, particularly from a
health and safety perspective, and be value for money. Cllr Cann said he would
be prepared to earmark up to £3,500 towards this initiative from his DCC Cllr
allowance. (Noted)
(iii) Cllr Cook wished it to be recorded in the minutes that he was not in
favour of IPC using its monies towards such a project as he felt it was the
duty of DCC to provide it. (Noted)
c) Item 2612/8 (e) - Charter Toilets/Quay Car Park: -
(i) Cllrs Cann provide IPC with an update; no change sine last meeting.
(Noted)
(ii) The Clerk suggested he write to the Chief Executive NDDC and ask for
details of the intended site visit bearing in mind that IPC was to be invited
to send along a representative. IPC RESOLVED to adopt this suggestion.

d) Item 2612/8 (f) - Sandhills Ransom Strip/Questionnaire: -
(i) Cllr Cann and the Vice Chairman provided IPC with an outline of the
outcome of the full Ransom Strip Steering Group Committee Meeting that had
taken place at the Civic Centre on Friday 5th January 2007 at 3pm; Cllrs White
(Vice Chairman), Ms Mayoh and Scott attended together with Cllr Cann, Roger
Jacob (Clerk) and Brian Holme (NDDC). (Noted)
(ii) In summary it was said that Cllr Cann and Brian Holme were to take
forward, to the next meeting of NDDC’s Executive Meeting, initiatives of
relevance to a Nature Reserve, Play Area and Sporting Facilities. IPC fully
RESOLVED to support this decision. (Noted)
(iii) It was said that other initiatives, although having much merit, could be
funded by specific grants i.e. Parish Hall/Solar Panels (Source: NDDC Grants
Officer), Rock Walkway (Source: AONB Grants Officer) and that other
highlighted issues were the direct responsibility of specific agencies/bodies
i.e. car parking/illegal parking (NDDC/Police), Speeding/Traffic Calming (DCC/Police),
Instow Church/Uneven Paths/War Memorial (PCC), Affordable Housing (NDDC), Dogs
on beach (NDDC – by laws currently under review) and Litter Bins (rubbish and
dogs) (NDDC)). IPC RESOLVED to bring this to the attention of the appropriate
body/agencies so as to enable it to action as necessary. It was noted that
much of the road safety/parking issues were already being attended to vide
item 2701/8 (b). (Action: The Clerk)
(iv) IPC noted that other projects raised as a result of the survey had
received minimal support/would not be of benefit to the community at large;
IPC RESOLVED to leave these on the file. (Noted)
e) Item 2612/8 (h) – Chemical and/or Oil Spillage: -
(i) The Clerk advised IPC of his liaison with the Allianz Cornhill (AC)
(emails between 18.12.06 and 3.1.07 refer) – i.e. AC was unable to offer cover
for such an eventuality and suggested only a specialist insurer/broker could
assist. (Noted)
(ii) The Clerk confirmed he had sent an email (3.1.07) to DAPC for circulation
throughout the County to establish what other similarly placed town/parish
councils might have done in the circumstances but that no response had been
received as of the date of the meeting. (Noted)
(iii) After a discussion IPC RESOLVED to seek some guidance from the Maritime
and Coastguard Agency. (Action: The Clerk)

a) (i) Letter (dd 19.12.06) from Chairman NDDC reference “Networking Session –
Friday 26th January 2007”: -
(a) The Clerk said this invited the Chairman and Clerk to this networking
session at which both the Chairman NDDC, Leader/Resources Portfolio Holder
NDDC, Chief Executive NDDC and Chief Financial Officer NDDC would be in
attendance; to discuss NDDC’s priorities and budget 2007/8. (Noted)
(b) The Clerk reported that the Vice Chairman was to represent the Chairman
who was unavailable together with the Clerk – NDDC had been advised. (Noted)

(a) The Clerk said this letter sought nominations from IPC of community
stalwarts so they could be invited to a forthcoming reception and presented
with an appropriate certificate. He reminded Cllrs he had provided a copy of

(b) After discussion IPC RESOLVED to bring this issue back to the next meeting
so that Cllrs could consider suitable nominations in the meantime. (Action:

“New College”: -
(i) The Clerk said this invited IPC to be represented at a meeting to be held
at the college at 5.30 pm on 10th January 2007. (Noted)
(ii) Cllr Crombie, who had attended a previous meeting on behalf of IPC,
reported he had attended and represented IPC; he provided a brief report to
IPC of the outcome i.e. project to commence March 2007, for completion by
September 2009, would cost 42 million and would house 1800 students. (Noted)
c) Award of MBE to Lesley Smith Secretary of Devon Association of Parish
Councils (DAPC) in New Year’s Honours List: -
The Clerk advised IPC he had communicated with Lesley Smith (email of 2.1.07
refers) on behalf of IPC and its parishioners and offered its sincere
congratulations on receiving this prestigious award that was richly deserved.

d) Elections 2007 – “Democracy Pack”: -
(i) The Clerk said this pack contained a number of resources that were
designed to encourage people within communities to find out more about what
“their” council did and hopefully encourage them to consider standing as a
councillor at the next election in May 2007. It also contained posters to
advertise, if arranged, such events as information evenings/sessions, handouts
on what Cllrs do, proforma press releases, how to plan for a radio/TV
interview and information on the election process; this year, for the first
time, 18 year olds can stand as Cllrs. There was also a CD to enable text to
be copied and pasted onto newsletter articles or personalised for a particular
council. (Noted)
(ii) After discussion IPC RESOLVED to put together a flyer for the February
Parish Magazine to promote the May elections; Cllr Harper offered to construct
a draft flyer and bring it back to the February meeting of IPC for
approval.(Action: Cllr Harper)
(iii) The Clerk also agreed to review the package and bring back any further
recommendations/.initiatives to the IPC February meeting. (Action: The Clerk)
e) DAPC Newsletter (Jan/Feb 2007) – “The Disability Discrimination Act (DDA)
1995” : -
(i) The Clerk said this stated that the DDA 1995 had been amended by the DDA
2005 and placed a duty on all public sector authorities to promote disability
equality, and as far as parish and town councils were concerned would have
come into force on the 4th December 2006. The Clerk added that Parish Councils
now had a general duty to eliminate discrimination, eliminate harassment of
disabled persons, promote equality of opportunity between disabled persons and
other persons and to encourage participation by disabled persons in public
life. There was no duty placed on town/parish councils to produce a Disability
Equality Scheme, as there was on other authorities, but in the spirit of
serving all members of the community parish/town councils might find it useful
to bear in mind the general duty placed on them by the DDA 2005. (Noted)
(ii) After discussion IPC RESOLVED to adopt the principle of the act and to
remind parishioners, who were disabled, there was a disabled person access
(ramp) to the parish hall and they would be very welcome to attend parish
council meetings; Cllr Scott to include in a forthcoming parish magazine.

f) Instow Parish Council Meetings 2007: -
The Clerk reminded Cllrs he had distributed a list to each with their agenda
papers (11.1.07) and that he had placed copies on all parish council notice
boards together with the Instow website; a copy had also been provided to the
booking officer of the parish hall committee who had confirmed that all dates

The Clerk said this stated that the DCAF was currently seeking new members and

(a) IPC Beach Lease - Crown Commissioners (CC): -
(i) The Clerk referred to a letter (dd 14.12.06) from Knight Frank on behalf
of the Crown Estate (CE) stating that the CE would be prepared to enter into a
new lease with the parish council; however, it is probably a little early at
the moment to start such negotiations and it was recommended these should
commence early in the year 2009. If, however, IPC wished to secure a longer
term the CE could, subject to costs, bring the current agreement to an end and
negotiate a new term. (Noted)
(ii) After deliberation IPC RESOLVED to wait until 2009 and then seek to renew

(b) IPC – Risk Assessment/Car Park: -
The Clerk advised IPC he still awaited an answer to the question he had asked
of NDDC (Car Parks Manager) as to whether IPC was covered by NDDC’s insurance
when leasing the car park. He said he would do all he could to obtain a
definitive answer by the next meeting. (Action: The Clerk)
(c) DCC P3 Footpath Inspection 2006-7/P3 Claim for 2007/8: -
The Clerk confirmed that the necessary paperwork had been returned to DCC
(21.12.06) and that a claim of £335 had been made to cover the cost of
anticipated P3 activity for the year 2007/8. (Noted)
(d) Email (dd 4.9.06) from DAPC reference “VAT – Car Park Charges”: -
The Clerk said he still awaited a response as to the outcome of the Isle of
Wight Council’s appeal against judgement of the High Court Tribunal in favour
of HMR and C; it had been earmarked to be held on 27th – 30th November 2006.
He said he would chase up a reply through the DAPC. (Action: The Clerk)
(e) Xmas Carol Singing Charitable Collection 2006 – Letters of Thanks: -
The Clerk confirmed that letters of thanks had been received from the North
Devon Hospice (dd 20.12.06), Northam Lodge (dd 19.12.06), RNLI Appledore
Branch (dd 18.12.06) and Children’s Hospice South West (dd 4.1.07). (Noted)
(f) Instow Twinning Association (ITA) – Constitution: -
(i) The Clerk advised IPC of an email and attachment (dd 18.12.06) from the
Chairman of the ITA reference the ITA’s revised constitution. He added that in
paragraph 12, in the event of dissolution, the disposal of the funds was
clarified in as much that “any funds, chattels and possessions standing to the
credit of the Association after meeting all obligations shall be handed over
to the Instow Parish Council to be held in trust for a period of 5 years
before disposal”. The Clerk said that the ITW was asking IPC’s consent for
this arrangement. The Clerk reminded Cllrs he had forwarded a copy of the
paperwork to them with their agenda papers (11.1.07). (Noted)
(ii) The Clerk told IPC he had passed this request “across” IPC’s IA, Mr G
Day, and he saw no problems in doing as set out. (Noted)
(iii) Following discussion IPC RESOLVED to support and agree to the relevant

(g) Internal Audit – October to December 2006: -
The Clerk reported that Cllr Crombie had carried out this internal audit on
17th January 2007 and found all to be in order. Cllr Crombie confirmed this to
be the case. (Noted)
(h) Bank Reconciliation – 1st October 2006 to 31st December 2006: -
The Clerk circulated a copy of this to Cllrs at the meeting; he said the
figures had been checked and confirmed by Cllr Crombie (17th January 2007).

(i) Email (dd 5.1.07) from DAPC reference “Reporting Requirements In Council
Tax Demands”: -
The Clerk said this stated that due to an amendment to the Council Tax Billing
Regulations the threshold above which a parish must supply a summary budget
for inclusion in the billing paperwork had been raised to a precept of
£140,000 – previously £100,000; comes into force on 31st January 2007. The
Clerk confirmed he had copied this to IPC’s IA, Mr G Day. (Noted)

The Clerk said this stated that the Parish News Committee expressed its
appreciative thanks for the recent grant. (Noted)
(k) Email (dd 8.1.07) from Instow Church Warden reference “Graveyard Boundary
Wall – Grant from IPC”: -
(i) The Clerk said this stated that this wall was showing increasingly serious
cracks due to the pressure of water in the ground; there was a danger the wall
would fall down unless part of the earth was removed to relieve the pressure.
The Clerk said an estimate of £1,500 had been obtained from a local contractor
to carry out this work and that IPC was being asked to provide a grant.

(ii) After discussion IPC RESOLVED not to provide a grant on the basis it had
recently given the PCC a grant of £800 towards graveyard maintenance. (Noted)
(l) Beach Cleaner – Terms of Agreement 2007/8: -
The Clerk confirmed that the beach cleaner and he, on behalf of IPC, had
signed a “terms of agreement” for the forthcoming 2007 season. (Noted)
(m) Email (dd 9.1.07) from Charity Commissioners reference “Instow Recreation
Ground (IRG)– Fundraising Standards Board (FSB)”: -
(i) The Clerk said this stated that the FSB had been set up as an independent
body to deliver the self regulation of charity and voluntary sector
fundraising as recommended in the Government’s 2002 Strategy Unit Report. The
FSB had opened to all members and would be launching to the public on 12th
February 2007; for an annual fee charities that join would be able to display
the FSB scheme logo to show they are committed to best practice in fundraising
to help the public give with confidence. (Noted)
(ii) The Clerk added that this was not a compulsory initiative and that he,
together with IPC’s Internal Auditor, Mr G Day, recommended that no action be
taken by IPC as regards the IRG which, to all intents and purposes, was a
dormant account and the cost of joining the FSB (together with annual
payments) would seriously eat into the annual interest accrued by the IRG
account of approximately £150. (Noted)
(iii) After discussion IPC RESOLVED not to join this scheme on the basis it
agreed with the recommendation of the Clerk and IPC’s IA as at item (ii)
above. (Noted)
(n) Instow Allotment and Recreation Field a/c – Portman Building Society: -
The Clerk reported receipt of a statement (dd 1.1.07) from the Portman
Building Society confirming that the sum of £141.41 had been added to this
account as interest for the year 2006. IPC RESOLVED to have this sum drawn as
a cheque made payable to “Instow Parish Hall Committee” as in previous

a) Potholes –
Cllr Cook said attention was necessary to some potholes at/near the junction
of the main Instow – Bideford road with the Huish turning. IPC RESOLVED to
have this brought to the attention of DCC Local Services. (Action: The Clerk)
b) Beach - Sand Build Up (Boathouse Bus Shelter): - Cllr Cook said the sand
had build up against the wall at this location so high that it was constantly
blowing into the road when windy. IPC RESOLVED to bring this to the attention
of DCC Local Services Manager for attention. (Action: The Clerk)
