2810/3 POLICE REPORT
a) Crime: -
PCSO Cornish said there had been 6 reported crimes in the parish since the
last meeting, namely, an assault occasioning actual bodily harm (ABH), common
assault and battery (x2), non-crime vulnerable adult, drive/attempt to drive
with excess alcohol and theft of a motor vehicle and trailer. He added that
the offence of ABH was associated with one of the offences of common assault
and had received considerable local publicity with an appeal for witnesses.

b) Other Matters: -
PCSO Cornish said there had also been 8 incident logs created for the same
period namely, neighbourhood dispute, report of an incident that turned out
not to be an incident (x2), neighbourhood dispute/assault, incident with a
cyclist/dog (Tarka Trail), abandoned boat, information and dispute reference
parking. (Noted)
c) Crime Prevention: -
PCSO Cornish said he was still continuing to issue vulnerable vehicle forms
with the intention of alleviating thefts from unattended vehicles. (Noted)
d) Campaigns: -
PCSO Cornish said both he and PC Hodgson had been involved in a “Not in My
Neighbourhood Week” campaign that involved initiatives such as speed traps,
road safety talks, new safe place scheme, reassurance visits and warrants.

e) Warrant: -
PCSO Cornish said a warrant had been carried out recently in the West Yelland
area with items seized; these items and persons were now under investigation.

2810/4 PARISHIONERS
a) Bat Preservation Trust: -
A parishioner said he had recently found a dead bat and as a result had
contacted the Bat Preservation Society (08451 300228). He provided Council
with a resume of the issues he had encountered as a result of his unusual
find. (Noted)
b) Street Lighting: -
A parishioner enquired whether DCC had reconsidered its policy as regards
street lighting at night. Cllr Cann said DCC was currently in the throes of
reviewing its policy and had to consider such issues as accident black spots,
crime/fear of crime for example. (Noted)
c) Quay Lane – Potholes: -
A parishioner complained about the poor state of this road; IPC RESOLVED to
pass this on to DCC Local Services. (Action: The Clerk)
2810/5 REPORT COUNTY COUNCILLOR R CANN
Cllr Cann reported on “Downs Road – Surface Water Flooding Problems” (a
£25,000 funding bid has been submitted), Speed Limit Extension – Bideford
Direction” (now formally advertised – see item 2810/9 (i) (b)), “Village
Gateway Project Design” (there had been a poor response from the parish – Cllr
Cann to liaise with Instow School),”Instow New School Update” (School
Governors have provided 100 slips from parents supporting the lay-by site –
there is to be a meeting at County Hall on the 20th October), “Westleigh
Cricket Club – Rescue Scheme” (a £5,000 bid from ward funds is to be submitted
– will also benefit North Devon Cricket Club), “County Debt” (as of 31st March
2008 - £613.8m; assets (land and building) = £1.433m and cash/short term
investments of £255m – asset base far exceeds the value of the outstanding
debt), “Wind Turbines – Bickleton Farm, Yelland” (Fremington Parish Council
has been consulted as had NDC Planning – information limited at this stage)
and “Charter Toilets – Quay Car Park ” (NDC is considering two options – Land
Tribunal or Executive Decision). (Noted)
2810/6 REPORT OF DISTRICT COUNCILLOR B MOORES
Cllr Moores reported upon “Decrepit Doggy Bin - Tarka Trail” (in hand) and
“Retirement of NDC’s Chief Executive/John Sunderland” (interim arrangements
for replacement in hand – Unitary Authority considerations). (Noted)
2810/7 MINUTES
It was RESOLVED that the September 2008 minutes of Instow Parish Council be
approved and signed. (Noted)
2810/8 MATTERS ARISING FROM THE MINUTES
a) Item 2809/5 (d) (iii) – Loose Boat Trailer/Instow Beach: -
(i) The Clerk advised IPC that as this trailer was on part of Instow sands
“owned” by DCE there was little legally that IPC could do about it. The Clerk
added that this course of action had been confirmed when he and the Chairman
had met up with the Crown Estate Agent on 23.9.08. (Noted)
(ii) Cllr Harper reported that the Receiver of Wrecks (MCA) was now
considering this matter. (Noted)
b) Item 2809/8 (d) – IPC’s Self Help Emergency Plan Update: -
(i) Cllr Harper reported on progress of the updated plan and of his research
as regards insurance cover for parish volunteers other than parish
councillors. (Noted)
(ii) Cllr Harper referred to an article from the Resuscitation Council (UK)
that he had traced on the internet (email of 21.9.08 refers). (Noted)
(iii) The Clerk told IPC he had forwarded (22.9.08 and 7.10.08) this article
to DCC’s Emergency Planning Officer (EPO) who initially appeared most
interested and said she would investigate and report back. (Noted)
(iv) The Clerk reported on a response he had subsequently received from DCC’s
EPO (14.10.08) – she said this article did not appear to cater for third party
participation in an emergency situation and confirmed she was still in liaison
with government to establish a “third party” insurance position. (Noted)
(v) Cllr Harper suggested this third party insurance issue be placed on the
“back burner” until some positive response was received from EPO/Government.
IPC RESOLVED to support this course of action. (Noted)
(vi) Cllr Harper confirmed he would bring an amended plan back before IPC when
completed for ratification. (Action: Cllr Harper)
c) Item 2809/9 (i) (d) – Appledore Shipyard/Dredging: -
(i) The Clerk advised IPC of the current situation (email {dd 13.10.08} from
the Chairman of TTEF refers) – i.e. Natural England (NE) and the Environment
Agency (EA) had met with Appledore Shipyard representatives (on 1st September)
to discuss their concerns that dredging had been occurring without the
necessary consultation with NE and EA. The meeting was generally very positive
and NE and the EA were developing a protocol with the shipyard for future
dredging activities to ensure they avoid a repeat situation occurring. (Noted)
(ii) The Clerk reported receipt of a supplementary email (dd 14.10.08) from
the Chairman of TTEF stating that NE had agreed that some dredging work to
maintain a “level profile” directly in front of the shipyard gates within the
shipyard entrance could occur without further consultation; but only by
redistributing sediment within the shipyard channel area itself. If material
was being dredged out from the shipyard entrance channel and dropped out in
the main channel, as was the case before, then this had not been agreed.

d) Item 2809/9 (i) (g) – Instow Bathing Water Data 2008: -
The Clerk advised IPC of the current situation (email of 13.10.08 from
Chairman of TTEF refers) – i.e. matters are still inconclusive; definitive
results are still awaited at which time it should be known whether a wet
weather waiver has been granted.(Noted)
e) Item 2809/9 (i) (i) – Cllr Code of Conduct/Indemnity: -
(i) The Clerk reported he had contacted the Allianz Cornhill (AC) Insurance
Company to ascertain whether any cover existed as regards breaches of the code
of conduct by Cllrs; the Clerk summarise the reply – email of 10.10.08 refers.

(ii) The Clerk then referred to the remaining information gleaned from the AC
as regards “Public Liability” and “Employers (including volunteers)
Liability”; he confirmed that no cover existed for libel and slander. (Noted)
(iii) After a discussion IPC RESOLVED to have the FSC consider the
implications of (i) and (ii) above when it meets on Monday 27th October 2008 –
see item 2810/10 (5) (g). (Action: IPC’s FSC)
f) Item 2809/9 (i) j) – Instow Beach – Dogs etc: -
(i) The Clerk reported he still awaited information from NDC’s Environmental
Health Department and the Crown Estate (as regards beach ownership/legislation
issues) and that when such information was received he would bring it back to
Council under correspondence for further discussion. (Noted) (ii) The Clerk
summarised the content of an informal meeting both he and the Chairman had had
with the Agent of the Crown Commissioners on 23.9.08 particularly as regards
IPC lease of the beach post 2009. (Noted) (iii) The Clerk reported that the
Dog Warden had advised him (14.10.08) that a fixed penalty ticket had been
issued (13.10.08) to a dog owner for allowing its dog to foul the beach and
not taking appropriate action to remove it. The Clerk said he had
congratulated the dog warden for her diligence and commitment. IPC RESOLVED to
concur with these sentiments. (Noted)

from North Devon to Plymouth (and which passed Derriford Hospital) at
Tavistock without any apparent prior consultation. (Noted)

it was unaware of any parishioners being inconvenienced by this alteration it
would undoubtedly do so in time to come and that no consultation had been

him (14.10.08) by DE with a number of small amendments to initial; the Clerk
explained the reasoning and said that once they had been initialled by Cllr

(c) Beach Cleaning Grant 2008: -
(i) The Clerk advised IPC he had applied for the remaining 20% (£360) of the

The Clerk confirmed that a “Notice of Conclusion of Audit and Right to Inspect

IPC’s notice board at the Post Office for a 14 day period (commencing 19.9.08)
together with a copy of the audit report. He added that as of the date of the
meeting no parishioner(s) had asked to view the financial/audit papers.

The Clerk reported that IPC’s FSC was to meet on Monday 27th October 2008 to

The Clerk reported that Cllr Crombie had carried out this internal audit on
10.10.08 and found all to be in order. (Noted)

The Clerk circulated a copy of this to Cllrs at the meeting adding that the
figures had been checked and confirmed by Cllr Crombie (10.10.08). (Noted)

The Clerk circulated and spoke to a copy of this report adding it had been

a) TDC Planning Application 1/0555/2008/FUL – “Time and Tide Bell” at
Appledore Slipway: -
(i) The Clerk reported he had contacted TDC (email 19.9.08) to enquire the
position as regards this application and was told, by return, that said
application was due to appear before committee on Friday 3rd October and that
as a contributor IPC would be given the opportunity to make a verbal
representation to committee. (Noted)
(ii) The Clerk reported receipt of a letter (dd 24.9.08) from TDC advising IPC
that this application was to be presented at the next TDC Planning Committee
meeting of 3rd October 2008. (Noted)
(iii) The Clerk reported receipt of 2 letters (dd 7.10.08) from TDC stating
that this application had been GRANTED. (Noted)
b) Letter (dd 19.9.08) and Devon Mineral Update No 6 reference “Devon County
Mineral’s Core Strategy”:-
The Clerk advised IPC that this outlined the changes that had occurred since
the County Council consulted on the Issues and Options for the Mineral Core
Strategy at the start of 2008 including government guidance on the content of
core strategies. It also stated that DCC was carrying out an informal
consultation on “Refreshing the Vision and Objectives” seeking views on the
revised vision and objectives for the Mineral Core Strategy and changes to the
scope of the strategy; the consultation paper could be viewed on DCC’s website
and responses are required by 31.10.08. (Noted)
c) Erection of Garage at Morsden, Rectory Lane, Instow (Reference 47326): -
(i) The Clerk reported receipt (22.9.08) of this application and of having
passed it immediately to the Chairman for the attention of IPC’s PSC; for
response by 7th October or an extension to be applied for. (Noted)
(ii) The Clerk confirmed that an entry had been placed on the Instow website
for the information of parishioners. (Noted)
(iii) The Clerk added that in light of a response from IPC’s PSC (6.10.08), he
had applied to NDC’s Planning Department for an extension for this application
until IPC’s Meeting of 16th October (to respond by 17th October). (Noted)
(iv) The Clerk advised IPC he had been contacted by DCC’s Local Services
Superintendent in that the owner/developer of this site had been in contact
with him to request that some trees be cut down/trimmed in Venn lay-by
(outside of Morsden) and he would like to know the views of IPC. (Noted)
(v) The Clerk then referred to an email (dd 15.10.08) from the Chairman of IIB
reference the trees in question; the Clerk read it to Council. (Noted)
(vi) A discussion then ensued, led by IPC’s PSC, at the conclusion of which it
was RESOLVED that IPC recommended REFUSAL of this application on the grounds
that: -
a) “The construction of a garage on this relatively small plot would represent
an over intensification of that site.
b) It may well create privacy and loss of light issues on the property to the
rear.
c) The current “right of access “ across the grass verge to the front of the
property is in direct line to the original garage to the former bungalow; it
would seem, however, that this “right of access” has now been widened
(presumably with the permission of the landowner – DCC?) although IPC still
has doubts that this new widened “access line” will provide ease of access to
the proposed new garage. This action would seem to be contrary to statements
made in the planning application form by the owner/developer as regards access
and parking (see items 5 and 8).
d) IPC is aware that the owner/developer of this property is currently in
liaison with DCC Highways as regards the trees situated on the grass verge
outside of the property. It would appear (contrary to the application form for
this planning application – see item 7) that some pruning (even removal) of
these trees is being requested presumably to improve the view from the new
property and to gain improved access across the grass verge to the proposed
new garage.
IPC is not in favour of any work being carried out on the trees, particularly
their removal, other than necessary pruning under the guidance and supervision
of a tree surgeon. IPC notes that these trees are part of a line of trees
which begin and end to either side of Morsden and as such any major pruning or
removal would seriously affect the overall appearance of the area in
question”. (Action: The Clerk)
d) Demolition of Existing Accommodation and Catering Blocks and Erection of
New Accommodation and Catering Facility and Water Tank at RM (Atturm), Instow
(Reference No 47433): -
(i) The Clerk reported receipt (3.10.08) of this application and of having
passed it immediately to IPC’s PSC for attention; for response by 15th October
or an extension to be applied for. (Noted)

The Clerk said this stated that NDC Planning had GRANTED outline planning
permission for this application with conditions as listed; this permission
shall be read in conjunction with the Section 106 Agreement (dd 7.11.07) (Town
and Country Planning Act 1990) which is applicable to this application in
terms of restrictions, regulations or provisions. The Clerk provided a copy of

a) Instow Parish Hall (IPH) – Hallmark Status: -
Cllr Harper reported that IPH had been awarded a “Hallmark Status”; IPC
RESOLVED to offer its congratulations to the committee. (Action: The Clerk)
b) Road Signs (Various): -
Cllr Harper said a number of road signs in and around the village needed
repainting; he agreed to provide the Clerk with a list/photographs as
necessary, IPC RESOLVED to pass this to DCC Local Services/NDC as necessary.

c) Anstey Way – Untidy Grass Verge rear of Lane End Close: -
Cllr Johns said this area needed tidying up; after a discussion it was
RESOLVED that as said land was undoubtedly privately owned that IPC should
advise DCC Local Services so that it might take appropriate action with the
owner(s).(Action: The Clerk)
d) Worlington Hill - Drains Blocked: -
Cllr May said the drains were blocked at this location causing flooding of the
road surface and the tarmac to lift. IPC RESOLVED to pass this on to DCC’s
Local Services. (Action: The Clerk)
e) Defective Road Sign – Holmacott/Huish T Junction: -
Cllr May said this sign needed repairing; IPC RESOLVED to pass this on to
DCC’s Local Services. (Action: The Clerk)
f) Poor Road Surface – Marine Parade between Atturm and Bridge: -
Cllr White said this road surface needed urgent attention; IPC RESOLVED to
pass this on to DCC Local Services. (Action: The Clerk)
g) Ransom Strip – Allotments at New School: -
Cllr May suggested this ought to be a ransom strip project when the new school
was built. The Clerk reminded Council that this idea had been highlighted at
the time of the parish “ransom strip” consultation exercise. (Noted)
h) New Instow School: -
Cllr Green suggested it was timely to write to DCC and enquire as to the
current situation as regards the new school’s progress now that the Exeter
University study on “Overhead Power Lines” had been completed. IPC RESOLVED to
support this course of action. (Action: The Clerk)

i) Council Meeting Dates 2009: -
The Clerk said he would soon be preparing a list of Council Meeting dates for

week before, namely, Thursday 12th February 2009. IPC RESOLVED to support this
