2607/3 POLICE REPORT
(a) Neighbourhood Beat Manager – Instow: - PCSO Tony Charles advised IPC that
Constable Benbow had recently retired and that interviews were to take place
in the very near future to establish his replacement. He said the Clerk would
be advised of Constable Benbow’s successor when this was known. (Noted)
(b) Crime: - PCSO Charles advised Council that 7 offences of a criminal nature
had occurred within the parish since the last meeting, namely, one offence of
criminal damage (bus window), 5 offences of theft (handbag, audio equipment,
cycles etc) and
one offence of an attempted “distraction burglary”. He told Council there were
suspects for some of these offences. (Noted)
(c) Criminal Damage – Boathouse Bus Shelter IPC Notice Board”: - The Clerk
advised PCSO Charles that this notice board had been vandalised by three
youths at approximately 6.15 pm on Monday 17th July and that the offenders
were then seen to get on to a bus to Barnstaple. He advised PCSO Charles he
had sent him an email about it (18.7.06); PCSO Charles said he had not
received said email but would investigate the matter following liaison with
the Clerk. (Action: PCSO Charles)
2607/4 PARISHIONERS
(a) Instow Beach – RNLI Training: - A parishioner said he believed that DCE
had banned the RNLI from training on Instow Beach. The Clerk advised IPC that
as this issue was an allegation and one of a private nature between the RNLI
and DCE it should merely be noted. IPC RESOLVED to agree. (Noted)

(b) Street Light – Anstey Way: - A parishioner reported there was a missing
street light close to Two Rivers and Ulmrosa on Anstey Way, Instow. IPC
RESOLVED that the Clerk should contact the appropriate authority. (Action: The

(c) Instow –Lack of Amenities: - A parishioner suggested that to counter
complaints in the past as regards a lack of amenities within the parish that a
nature area be constituted behind Marshfield. The Chairman advised the meeting
that a flyer was to be distributed to all parishioners with the forthcoming
parish magazine asking for suggestions as to how a substantial sum of money,
pledged by NDDC (Ransom Strip), could be spent on a project within the parish.
This particular suggestion, he said, could be one such idea. (Noted)
(d) Bonfire By Laws: - A parishioner enquired where she could find out more
about by laws appertaining to bonfires. The Clerk advised her to contact
NDDC’s Environmental Health Department. (Noted)
(e) TTEF Report: - (i) Mrs R Day provided a report of recent TTEF activities
namely, Marine Bill Consultation, Devon Area Officers Group, Hovercraft
Service, Incident in the Torridge Estuary (14.7.06), EA’s prosecution of SWW/Sewage
Discharge (Instow), Appledore Quay Wall, Dredging at Appledore Shipbuilders,
Richmond Dock/150th Anniversary Celebration, Biosphere Reserve Discovery Day
(8.7.06), Biosphere Reserve Initiative, Management Study for Braunton Marsh,
North Devon AONB, Appledore Slipway Warden, Moorings in the Fairway/Trinity
House Survey, Shoreline Management Plan 11, Mussel Harvesting in Taw/Torridge
Estuary, Local Strategic Partnership, Bathing Water Quality, Integrated
Coastal Zone Management Consultation and Consultation responses on TDC

from the Clerk, Mrs Day said the appropriate authorities (Harbourmaster etc)

2607/5 REPORT COUNTY COUNCILLOR R CANN
In the absence of Cllr Cann, the Clerk read out a report that referred to
issues of relevance to Cedars Roundabout (anti skid surface recently laid),
Holmacott Landfill Site/Retrospective Application for Existing Lighting Scheme
(application been withdrawn – operator reminded of prescribed route to the
tip), Improvement to Recycling in Rural Areas (composting kits, brown bags for
cardboard etc), Stop Junk Mail (write to Mailing Preference Service, Freepost
22, London W1E 7EZ), Local Service Group (Highways) (consultation commenced
about restructuring), County Councillor Ward Fund (£6,000 available to spend
in their wards), In Vessel Compositing (DCC has recently gone out to tender at
Deepmoor) and Sign to Advertise Toilets/Beach/Shops – Instow (a request has
been made to the appropriate authority). (Noted)
2607/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
(a) General: - Cllr Mrs L Brown spoke on NDDC – Summer with Supersports
(offers 5 weeks of activities encompassing 20 sports), Barnstaple Museum
Exhibition is POO! (Self explanatory!), Barnstaple Museum – Major
Improvements, Gambling Policy – Have Your Say (public opinion is sought), NDDC
Renewable Energy Action Plan, and Local Government Review (government paper
expected September/October 2006). (Noted)
(b) Complaint re Dogs/Instow Beach: - (i) Cllr Mrs Brown spoke of having
received a complaint that she passed to NDDC and IPC’s Clerk. She went on to
speak of NDDC’s legal position that is currently being researched/reviewed by
NDDC’s Solicitors who will be contacting Defra as part of their enquiries.

(ii) The Clerk reminded Council he had been in dialogue with NDDC for quite
some time about the intricacies of the current by laws/new legislation, that
is, the Clean Neighbourhood and Environment Act 2005 – Section 55 etc. (Noted)
(c) Ransom Strip Steering Group Meetings: - Cllr Mrs Lynn Brown confirmed she
had attended the two recent meetings of this group and reminded council that a
sum of somewhere in the region on £75,000 was “on the table”. (Noted)
(d) Village Toilets – Cleanliness: - Cllr Mrs Brown said she had followed this
complaint up and she had satisfied herself that the cleaning regime would be
closely monitored for the future. (Noted)
2607/7 MINUTES
It was RESOLVED that the June 2006 minutes of Instow Parish Council be

2607/8 MATTERS ARISING FROM THE MINUTES
a) Item 2606/5 (b) – Visitor Information Signs: - The Clerk advised Council
that Cllr Cann had been in liaison with the appropriate authority and
requested that consideration be given to providing such signs – see item
2607/5. (Noted)
b) Item 2606/5 (c) - Charter Toilets/Quay Car Park: - (i) The Clerk confirmed
he had written as requested at the last meeting to the Chief Executive NDDC
(16.6.06) and copied it to Cllrs Cann and Mrs L Brown. (Noted)
(ii) The Clerk said he had received an acknowledgement letter (dd 21.6.06)
from NDDC. (Noted)
(iii) The Clerk reported receipt of a further letter (dd 3.7.06) from NDDC’s
Chief Executive’s Office advising IPC that a report was being prepared for the
Council’s Executive by the Head of NDDC’s Property and Technical Services and
he would ensure IPC’s letter was before the Executive Committee when they
consider the report. (Noted)

d) Item 2606/8 (a) – Sandhills Ransom Strip: - (i) The Chairman briefed IPC of
the outcome of two meetings of the Steering Group Committee that had been held
on Thursday 29th June/Monday 17th July, both at the Commodore Hotel and what
has transpired since then i.e. a draft of a final “proof” flyer had been
produced by the group and had been brought to the meeting for
discussion/approval. (Noted)
(ii) The Clerk reported upon his various discussions with Brian Holme (BH) (NDDC)
since the last meeting, a letter (dd 10.7.06) received by him from BH and a
telephone conversation (20.7.06) where BH had “approved” the draft of the
final “proof” ransom strip flyer to be sent out to parishioners in the
forthcoming parish magazine – a copy was provided to Cllrs for perusal at the
meeting. (Noted)
(iii) After discussion IPC RESOLVED to approve the “proof” flyer and the
printing arrangements as outlined by Cllr Scott who advised on costs etc. The
Clerk told Council that BH (NDDC) had agreed to cover the costs. (Noted)
e) Item 2606/8 (b) - Instow, Westleigh and West Yelland Village Show 2006: - (i)
The Clerk, on behalf of Cllr Crombie, reported to IPC on their findings as
regards insurance cover for the events to be held on the parts of Instow beach
as “leased” by IPC from Crown Commissioners having liaised, in depth, with the
show committee chairman and the Allianz Cornhill (AC) (IPC Insurers). The
Clerk read out the content of email of 27.6.06 from the AC. IPC RESOLVED to
note this and take no further action. The Clerk thanked the show committee
chairman, who was present, for her cooperation and wished both her and the
committee all the best for the event that was to take place over the coming
weekend. (Noted)
f) Item 2606/8 (c) – Alleged “Illegal” Signage/The Bar: - (i) The Clerk
reported receipt of a “blind” email (20.6.06) from Mr R Coldwell (RC) (DCE)
(originally dated 23/5/06 and sent from RC to Andy Bell NDCCS) concerning
“Advertisement Issues – The Bar”; the Clerk read a précis of it to IPC.

(ii) The Clerk reported receipt of a letter (dd 20.6.06) from RC (DCE) noting
IPC’s, quote, “increasing concern about the presence of unauthorised
advertisements in the vicinity of Instow particularly The Bar public house
which is leased from the Trustees of the 1978 Tapeley Park Trust”. The Clerk
said the letter went on to itemise seven examples of, quote, “unauthorised
advertisements which should be reported to the authorities in the requisite
manner” and “expressed surprise that these various issues have not been
reported to NDDC as it is quite evident that there is a degree of
inconsistency regarding the enforcement of the advertisement regulations”. The
Clerk reminded Cllrs he had copied the letter to them with their agenda papers
(13.7.06). (Noted)
(iii) The Clerk advised IPC that he immediately passed on a copy of said
letter to DCC/NDDC for them to act as they saw fit as regards the allegations
of unauthorised signs. IPC RESOLVED to support this course of action. (Noted)
(iv) The Clerk told Council that he had replied to RC in a letter (dd 22.7.06)
to advise him he had passed on his complaints to DCC/NDDC and asked for
additional information as regards one of the alleged unauthorised signs which
belonged to IPC, that was, its public notice board within the Boathouse bus
shelter and for which it had a licence from DCC to permit the bus shelter to
be at said location. The Clerk also told IPC that he reminded RC that IPC, and
the Clerk had no powers of “policing” or “enforcement” and it was most
certainly not within their remit to seek out breaches of legislation just
because complaints were received of an identical or similar nature. The Clerk
reminded Cllrs he had copied this letter to them with their agenda papers
(13.7.06). (Noted)
(v) IPC unanimously RESOLVED to ratify the tenor of the Clerk’s letter of 22nd
June. (Noted)
(vi) The Clerk reported receipt of a further letter (dd 27.6.06) from RC
advising the Clerk that three of the alleged unauthorised signs referred to in
his letter of 20.6.06 related to IPC and that he had brought the matters to
IPC’s attention as, quote, “there appeared to be inconsistencies in the manner
in which issues relating to signage have been addressed by IPC” and that his
client requested “a written explanation as to why previously reported
incidents of illicit signs have not been pursued with anything like the vigour
that is evident in the case relating to one of their lessees”. The Clerk added
that RC had forwarded a map with his letter to indicate that the Boathouse bus
shelter, quote, “is present upon our “Corporeal Hereditament” and that “any
signage present upon our land would require consent, as part of the provisions
stipulated by the Statutory Regulations for advertisements” adding that “he
could not comment as to why IPC would have a licence from DCC in such
circumstances”. The Clerk reminded Cllrs he had copied this letter to them
with their agenda papers (13.7.06). (Noted)
(vii) The Clerk advised IPC he had replied to RC’s (letter dated 3.7.06
refers) to the effect that it would be appreciated if further information
could be provided as regards the “other two” IPC signs (other than the
Boathouse Notice Board), evidence to substantiate his various allegations that
IPC had been “inconsistent/there had been discrepancies/lack of vigour in the
way signage issues had been progressed by IPC”, together with a copy of the
original agreement between IPC and DCE in respect of the original siting of
the Boathouse bus shelter; he told IPC that the DCC licence, for example,
permitted IPC to place advertisement within the shelter in an “interior
frame”. The Clerk reminded Cllrs he had copied this letter to them with their
agenda papers (13.7.06). (Noted)
(viii) IPC unanimously RESOLVED to ratify the tenor of the Clerk’s letter of
3rd July. (Noted)
(ix) The Clerk reported receipt of an email (dd 5.7.06) from RC together with
a number of photographic attachments reference “Instow Signage – Examples
Evident Contrary Statutory Regulations”. The Clerk advised IPC of the content
which included IPC’s notice board outside of the post office. (Noted)
(x) The Clerk reported receipt of a further letter (dd 7.7.06) from RC
referring to the email/photos of 5.7.06 (see (ix) above) and reminding the
Clerk that although the DCC Licence permits IPC to place a notice board within
the Boathouse bus shelter, quote, “this does not have the consent of the
landowner and as such is an illicit advertisement by virtue of the
advertisement regulations as laid out in Stature”. The Clerk then said that RC
went on to request, quote, “evidence of a legal agreement entitling IPC to
place the Boathouse bus shelter upon my clients property together with
reference to the display of advertisements” and pointed out that, quote, “it
is noted that in relation to my clients affairs, these (signage issues) have
not been brought forward consistently in the agenda/other references to
illicit signs have not been so frequently addressed or indeed pursued by NDDC”,
suggesting that this, quote, “does lead to a concern as to whether or not
there have been vested interest involved/arbitrary assessments have been made
with regard to the manner in which affairs (signage) have been assessed
previously”. The Clerk reminded Cllrs he had copied this letter to them with
their agenda papers (13th July 2006). (Noted)
(xii) The Clerk advised IPC he had replied to RC in a letter (dd 10.7.06) and
that he had requested RC to provide him with evidence of an agreement between
IPC/DCE as regards the siting of the Boathouse bus shelter as to date, he had
been unable to find one. The Clerk also said he had asked RC, in a
hypothetical sense, as to whether Christie Estates would grant retrospective
permission to IPC to place a public notice board within said shelter if on the
mistaken belief such permission had not already been granted and was expected
by virtue of a former written agreement. The Clerk said he had also assured
RC, without going into specifics (as there was an ongoing “signage” enquiry in
hand by DCC/NDDC), that on behalf of IPC he categorically refuted/assured him
that his concern that any vested interest/hidden agenda existed between IPC/DCE
and that ongoing issues, appearing regularly on agendas/minutes of parish
council meetings, was merely a matter of administration and due process. The
Clerk said he had finalised his letter by sincerely hoping that this ongoing
issue would soon be brought to a satisfactory and amicable conclusion and that
IPC/DCE could move on and deal with their respective responsibilities without
further distraction by this emotive and controversial issue. The Clerk
reminded Cllrs he had copied this letter to them with their agenda papers
(13.7.06). (Noted)
(xiii) IPC unanimously RESOLVED to ratify the tenor of the Clerk’s letter of
3rd July. (Noted)
(xiv) A general discussion then ensued between Cllrs and it was RESOLVED to
further research the parish records to endeavour to ascertain whether there
ever had been a written agreement between DCE/IPC as regards the Boathouse bus
shelter and to note that the allegation of an illicit sign of relevance to
IPC’s notice board outside the post office was a civil matter between the
lessee and the landlord of the property. IPC was unable to identity any other
“sign” that belonged to it and that had been alleged as being “illegal”.

g) Item 2606/9 (i) (c) – Instow Water Quality Tests/Unfavourable Publicity: -
(i) The Clerk referred to a letter/information sheet (dd 21.6.06) from NDDC
(Senior Food Safety Officer) reference “Bathing Water Quality Data” that had
been sent in response to an email (dd 16.6.06) from the Clerk to NDDC as
regards this issue, that is unfavourable publicity. The Clerk said it would
seem that the relevant “water quality” information was readily available on
the internet and that this is most probably where the press get the
information from. The Clerk reminded Cllrs that a copy of the
letter/information sheet had been copied to them with their agenda papers
(13.7.06). (Noted)
(ii) The Clerk said that IPC should note that a recent EU water directive
regulation, which came into effect on 24th March 2004, will be transposed into
UK legislation within 2 years and this will have the effect that water quality
will need to be readily available to the public at beaches; there will be a
requirement by 2012 that such information will be required to be predictive of
the bathing water quality expected. In cases such as Instow, unless
improvements to the water quality is experienced in the future, it will
necessitate the displaying of signs advising or prohibiting bathing. A
discussion ensued. (Noted)
(iii) Email (dd 6.7.06) from Environment Agency (via NDDC) reference “Water
Quality Tests”: - The Clerk said this stated that the water quality tests at
Instow for 18.6.06 and 26.6.06 were “Excellent” and “Good” respectively.

quality tests at Instow for 3.7.06 and 12.7.06 were “Excellent”. (Noted)
(v) Email (dd 14.7.06) from Chairman of TTEF reference “TTEF – Instow Pumping
Station “A”/SWW Prosecution”: - The Clerk read it to Cllrs. (Noted)

h) Item 2606/9 (i) (o) – Code of Conduct/Presentation by NDDC’s Monitoring
Officer: - (i) The Clerk advised IPC that Don Pratt (NDDC’s Monitoring
Officer) would be attending the IPC Meeting of Thursday 19th October at 7 pm
to give a short presentation on this subject and that an offer had been
extended to Westleigh Cllrs to also attend. (Noted)
(ii) Letter (dd 14.6.06) from Don Pratt reference “Section 106 of The Local
Government Finance Act 1992”: -The Clerk reminded Cllrs he had copied this
letter to them with their agenda papers (13.7.06) for information. (Noted)
(iii) Letter (dd 7.7.06) from J Grigg (Members Services Coordinator NDDC)
reference “Training Upon The Code of Conduct”: - The Clerk said this letter
stated that Don Pratt was to provide a training session on the code of conduct
at the Civic Centre (Taw Room), Barnstaple at 7 pm on Tuesday 5th September
2006 and that parish Cllrs were welcome to attend. The Clerk asked that names
of attendees be given to him asap so that NDDC could be advised; a copy of the
letter was provided to Cllrs at the meeting. (Noted)

(i) Matters for discussion/resolution or noting: -
a) Traffic Management Issues: - (i) (a) Letter (dd 20.6.06) from parishioner
reference “Parking Outside of Old Post Office, Instow/Resident Parking?”: -
The Clerk told IPC he had advised the parishioner (23.6.06) that this was a
matter for DCC Local Services and that he might like to direct his request to
that department, adding, however, that resident parking permits for Instow had
been considered in the past by IPC/DCC Local Services but had not been thought
relevant to Instow.(Noted)
(b) The Clerk reported receipt of a copy letter by email (dd 18.7.06) from DCC
Local Services to said parishioner reference “Parking on Marine Parade,
Instow”. The Clerk read it to IPC. (Noted)
(ii) Copy letter (dd 15.6.06) from parishioner to Instow Community Police
Officer reference “Traffic Congestion – Junction New Road with Anstey Way”: -
The Clerk appraised IPC of the essence of the letter content. After discussion
IPC RESOLVED to contact DCC Local Services and ask them to review this
situation that did present a traffic hazard to pedestrians and motorists.

(iii) (a) Copy letter (dd 1.7.06) from parishioner to Chief Superintendent,
Barnstaple Police Station (copy to DCC Local Services) reference “Obstruction
of Lane End, Instow by Delivery Lorries/Vans”: - The Clerk advised IPC of the
details of the complaint. (Noted)
(b) The Clerk then referred to a copy letter (dd 18.7.06) from DCC Local
Services to said parishioner reference “Loading and Parking at Lane End,
Instow”. The Clerk read it to IPC. (Noted)
b) Email (dd 20.6.06) from Mr Coldwell (RC) (DCE) reference “Environment
Agency Matters (EA) – Instow”: - (i) The Clerk said this had been sent to IPC
for information; it referred to SWW’s activity near Holmacott tip that was
affecting a foot and mouth burial site (possible pollution issues?) and
pending plans to decommission the Chevron/Texaco Oil Jetty, again,
environmental issues. The Clerk said it also referred to the fact that SWW was
being prosecuted by the EA for the pollution of Christie Estate’s Instow
foreshore, proximity of Quay jetty, and would be in court on 22nd June. The
Clerk said he had acknowledged receipt of the email and thanked RC for the
information. (Noted)
(ii) Copy email (dd 5.7.06) from Mr Coldwell (RC) (DCE) and 4 photograph
attachments to “various” recipients (e.g. Environment Agency/NDCCS) regarding
“Chevron Texaco-Foreshore activity – Yelland/Instow”: - The Clerk said this
referred to the removal of the mooring anchors at this location without the
submission of any risk assessment/public liability insurance evidence or the
consent of respective parties. It went on to suggest that a pre requisite for
the site’s previous safety approved status was the reinstatement of the
anchors. The Clerk said he had acknowledged receipt of the email and thanked
RC for the information. (Noted)
c) Letter (dd 20.6.06) and CD Rom from Briggs Environmental Services Limited
of Aberdeen reference “NDDC’s Oil Spill Contingency Plan Update”: - (i) The
Clerk said he had returned a receipt acknowledging receipt of the CD Rom, as
requested, and had retained it for future use. (Noted)
(ii) The Clerk then referred to a further letter (dd 27.6.06) from Briggs
Environmental Services Limited of Aberdeen reference “NDDC’s Oil Spill
Contingency Plan Update” asking for return of CD Rom that had been sent out in
error; this he had done. (Noted)
d) Letter (dd 9.6.06) from University of Aberystwyth reference “Quality Parish
Council Survey”: - The Clerk confirmed that the survey pack had been completed
and returned as requested. (Noted)
e) Email (dd 23.6.06) from Environment Agency (EA) reference ”Instow:
Benches/Dinghies”: - (i) The Clerk advised IPC of the content of the email and
the alleged synopsis of a meeting that had subsequently been held between DCE
and the EA although it had not been confirmed in writing as of date if
meeting. (Noted)
(ii) The Clerk confirmed receipt of an email (dd 1.7.06) from Cllr Harper
reference “Parishioner complaints reference Tables from The Bar being left on
the Public Highway”. The Clerk said he had ascertained that the tables were in
situ in Old Quay Lane which, as far as he was aware, was an un-adopted highway
and for which DCC Local Services would have no jurisdiction; he said he had
later confirmed this to be the case. The Clerk told IPC that Cllr Harper had
been advised of this and of the alleged outcome of the meeting between DCE/EA
as at (e) (i) above, adding that his reply email to Cllr Harper had been
copied to all IPC Cllrs so that each would be briefed of the current
situation. (Noted)
f) Instow Community Primary School – Ofsted Inspection Report/Press Release: -
The Clerk reported receipt of this from the school’s head teacher, Peter Kent
and reminded Cllrs he had copied the press release to them with their agenda
papers (13.7.06). After discussion it was RESOLVED that IPC should write to
Peter Kent and offer its sincere congratulations to all concerned on achieving
such an excellent report. (Action: The Clerk)
g) Letter (dd 30.6.06) from NDDC Electoral Services reference “Electoral
Registration”: - The Clerk said this sought the support of the Clerk/another
in capturing details of parishioners who did not respond to electoral
registration canvas forms in the light of new legislation currently under
debate. After discussion it was RESOLVED to answer in the negative to NDDC.

(h) (a) Letter (dd 22.6.06 – received 30.6.06) from Mr Coldwell (RC) (DCE)
reference “Boathouse Bus Shelter – Public Health Hazard”: - (i) The Clerk said
this letter stated that RC’s clients had instructed him to write to IPC
regarding the “appalling interior condition” of this bus shelter, erected upon
DCE property. The Clerk said the letter went on to add that on the advice of
DCE’s insurers, the bus shelter has, quote “been constituting a public health
hazard with it being quite evident it has been used effectively as a public
toilet” adding that “in the event this state of affairs not being rectified,
environmental concerns will result in the building having to be removed from
the current location on the Christie Estate”. The Clerk said that RC had added
that this is a most serious matter which he was certain was not favoured by
either IPC or the Trustees of the Christie Estates; he finalised by saying
that the situation was to be monitored over the next 40 days and quote “in the
event of there being evidence that it still constitutes a public health hazard
then for environmental reasons a contractor will be instructed to remove the
shelter from our Corporeal Hereditament”. The Clerk reminded Cllrs that a copy
of the letter had been circulated to them with their agenda papers. (Noted)
(ii) The Clerk advised IPC he had replied to RC’s (dd 3.7.06) letter to the
effect that following a complaint from a parishioner (Item 2605/6) the bus
shelter had been cleaned out with water/disinfectant within 48 hours by the
parish handyman and that since that date, it had been brushed out nearly every
day by the handyman and washed out twice with water/disinfectant despite the
fact there had been no evidence of the shelter being used as a toilet. The
Clerk further advised IPC that he had asked RC to provide him with the
evidence in support of his statement that the shelter was in an “appalling
condition – a public health hazard” and on what grounds he had to remove the
shelter from DCE land adding that in his view such action would be ultra vires.
The Clerk reminded Cllrs he had copied this letter to them with their agenda
papers (13.7.06). (Noted)
(iii) IPC unanimously RESOLVED to ratify the tenor of the Clerk’s letter of
3rd July 2006. (Noted)
(iv) (a) The Clerk advised IPC he had immediately liaised with NDDC’s
Environmental Health Department (EHD) and it had been agreed to inspect and
monitor the shelter and provide IPC with a professional report on its
findings; he said he had received an acknowledgment letter (dd 7.7.06).

(b) The Clerk reported he had received a telephone call (17.7.06) from NDDC
EHD reporting that the shelter had been visited on 4 occasions recently (i.e.
twice in the morning, once in the afternoon and the other occasion at 11 pm at
night) and found the shelter to be clean with no evidence of it being used as
a toilet. It was further said that the shelter was in an excellent condition
having recently been painted. The Clerk said he had thanked NDDC for their
cooperation; the EHD agreed to place the evidence of its visits on file for
future reference. (Noted)
(v) The Clerk told IPC that the parish handyman possessed a written work
schedule for completion when he visits the shelter daily and that he himself
would monitor the situation on a regular basis. (Noted)
(vi) IPC unanimously RESOLVED to support the action taken by the Clerk.

(vii) The Clerk reported receipt of a further letter (dd 7.7.06) from RC (DCE)
reference “Boathouse Bus Shelter”. He said the letter stated that IPC was not
criticised for its endeavours to keep Instow tidy and to maintain standards,
it commended the parish handyman for his considerable hard work and added that
RC intended to relay to his clients the very professional steps that Instow
Parish Council had taken to counter the types of criticism and complaints that
he had received. The Clerk reported that the letter went on to state that RC
was prepared to work with IPC/parishioners so as to enhance the quality of
life of those in the village and would be passing on complaints received by
DCE in the future so that IPC was fully briefed. The Clerk said that RC still
insisted there was a right in law to remove any structure if it was
potentially giving rise to a claimable incident against the landowner although
naturally such action would be as a last resort. The Clerk reminded Cllrs he
had copied this letter to them with their agenda papers (13.7.06). (Noted)
(viii) The Clerk advised IPC he had replied to RC (letter dd 10.7.06) thanking
him for the receipt of such an “encouraging” letter and welcoming his
preparedness to work with Instow Parish Council/parishioners for the benefit
of Instow and its parishioners adding that working in partnership would be
more rewarding and productive. The Clerk further reported that he had also
enquired, out of interest and for future reference, what particular act of
legislation RC would use in the event of “moving” property from his clients
land and that a reply was awaited. The Clerk reminded Cllrs he had copied this

Inspector’s Report and Adoption of Plan”: - The Clerk said this letter stated
that the Inspector’s report had been received, following the public enquiry (IPC
submitted a representation/resolved to adopt the recommendations of TTEF) and
that following amendment, the plan was adopted on 30th June 2006; the adopted
plan could be viewed on DCC’s website. The Clerk reminded Cllrs he had copied
the letter to them with their agenda papers (13.7.06) and that a copy of the

(j) Email (dd 12.7.06) and photograph attachments from parishioner reference
“Instow Beach – Atturm Slipway/Cricket Club”: - The Clerk said this expressed
concern at the “grot and mess” (i.e. green weed/sticks, piles of sand, tree
trunks, a gas cylinder etc) at this location and of the effect it would have
on tourism. The Clerk said he had spoken to the beach cleaner who agreed to
give this area his urgent and undivided attention advising the parishioner of
the action to be taken and thanked him for his “concern”. (Noted)

(ii) Invitation letter (dd 13.7.06) from Wings reference “Opening of The
Roundhouse, Instow – Sunday 23rd July 2006”: - The Clerk said this invited all
members of IPC to this event that was to commence at 2 pm. He said the
Chairman had subsequently been asked to officiate at the ribbon cutting
ceremony but was unavailable as was the Vice Chairman. It was RESOLVED that
Cllr Harper would attend and represent IPC. (Action: The Clerk)
(n) Letter (dd July 2006) from NDDC reference “Draft Brief for Education
Contributions Code of Practice”: - The Clerk said that IPC was invited to
comment on this draft; a six week consultation period had commenced on Monday
17th July; comments should arrive by no later than 5 pm on Monday 28.8.06.
After discussion IPC RESOLVED that Cllrs Crombie/Scott (School Governors)

(o) Letter (dd 14.7.06) from Mr Coldwell (RC) (DCE) reference “Instow Beach –
Dog Restrictions”: - (i) The Clerk read the letter to Council; in summary it
stated it was not acceptable for NDDC to pass on complaints with regard to dog
restrictions to the Christie Estates Office particularly as the Christie
Estates did not initiate or participate in the creation of the restrictions.
The letter finalised by stating that unless an undertaking was given that DCE
would not be “troubled” in the future, all respective signage would be removed
by 1st August with all costs incurred being sought from the parties
(presumably NDDC/IPC) who had instigated the “creation of restrictions to
visitors to our (DCE) property”. The Clerk provided a copy of the letter to
Cllrs at the meeting. (Noted)
(ii) The Clerk told IPC he had spoke to NDDC’s Environmental Health Department
(EHD) (17.7.06) who had accepted it was for NDDC to respond to this letter
albeit it was not aware of any “dog” incidents/complaints that had been
channelled by its staff to DCE. The Clerk reported that a similar situation
prevailed as far as IPC was concerned. (Noted)

(p) Letter (dd 6.7.06 – received 15.7.06) from Mr Coldwell (RC) (DCE)
reference “Instow Beach – Railings adjacent to Southern Slipway/Opposite
Commodore Hotel”: - (i) The Clerk read it to Council; in summary it stated
that the Environment Agency had raised concerns about person(s) attaching
their boats to the side railings of this slipway and were concerned that the
integrity of said railings was being undermined and this was not conducive to
the well-being of the fabric of the slipway furniture or indeed the aesthetics
of the sea-front. It requested that the parish council was made aware of the
problem and sought assistance in helping to identify the owners of the craft
so that they could be notified accordingly. The Clerk provided a copy of the
letter to Cllrs at the meeting. (Noted)
(ii) The Clerk advised Council that both he and Council were already aware of
this issue (see item 2606/9 (iii) (m)) and that he had replied to RC
accordingly advising him, in addition, that any information as regards

Sandhills (SS4731SW), Instow (Reference No 41727”: - (i) The Clerk said this
letter stated that NDDC had received a notice of appeal and that as IPC was
originally consulted at the application stage it might wish to make further
observations/amend its original response – must do so by 20th July 2006.

recommend APPROVAL of this application at its meeting of 16th February 2006.

at Oaktree, Anstey Way, Instow (Reference No 42438): - (i) The Clerk reported
receipt of this application (28.6.06) and of having passed it immediately to
the Vice Chairman for the attention of IPC’s PSC; for response by 17th July or

(ii) The Clerk confirmed that the details of the application had been placed
on Instow’s website for the information of parishioners. (Noted)
(iii) The Clerk reported that as the decision of IPC’s PSC had been
“inconclusive” and following a meeting between him and the Vice Chairman
(10.7.06), an extension was sought from NDDC Planning until 21st July so that
application could be considered by full council (20.7.06). (Noted)
(iv) The Clerk reported receipt of a copy letter (dd 14.7.06) from a
parishioner to NDDC’s Planning Manager reference this application; he read it

(vi) After discussion, lead by IPC’s PSC, Council RESOLVED to recommend
REFUSAL of this application on the grounds of “light and privacy issues to
neighbours, not in keeping with buildings in the vicinity and would dominate
and be over-intrusive”. Cllr Mrs L Brown was also asked to “call the
application in” so that it might be considered by NDDC’s Planning Committee.

Marine Parade, Instow (Reference No 42315): - (i) The Clerk reported receipt
of this application (3.7.06) and of having retained it in view of the fact it
had originally been made by IPC (on behalf of Instow WI) and that in the
circumstances IPC was precluded from making a recommendation on the grounds it
“had an interest”. IPC RESOLVED to ratify this recommendation. (Action: The
Clerk)
k) Letter from NDDC reference “Erection of Stable Block at Springfield, New
Road, Instow (Reference No 42205): - The Clerk advised IPC that NDDC Planning
had GRANTED this application with conditions as listed. (Noted)
l) DAPC Newsletter (July/August) 2006 – Making Planning Decisions: - (i) The
Clerk said this excellent article was a synopsis of an original paper produced
by Mike Kelly (Planning Manager NDDC) and set out information of relevance to
“Background of Making Planning Decisions”, “Material Planning Considerations”,
“Non-Material Considerations” and a “Conclusion”. He reminded Cllrs he had
copied it to them with their agenda papers (13.7.06) for their information and
consideration when acting as a member of IPC’s PSC or in full council when
considering planning applications. (Noted)
(ii) The Vice Chairman reminded Council that it was extremely important for
each and every planning application to be considered by IPC’s PSC in a timely
and orderly fashion particularly if the Clerk was going to get responses back
to NDDC within the time limits available or seek a suitable extension for
further discussion at Council. The Clerk added that in addition strict legal
procedures needed to be adhered to if decisions taken by IPC’s PSC
particularly were not to be ultra vires. (Noted)

works to trees in a conservation area in respect of removal of 1 bay and 1
pittosporum at Quay House Cottage, Instow (Reference No 42608): - (i) The
Clerk said this application had been received 17.7.06 and had been passed
immediately to the Vice Chairman for the attention of IPC’s PSC; for
discussion at IPC meeting of 20th July. (Noted)

It was RESOLVED that the Chairman, Vice Chairman and Clerk take any necessary

should the need arise, and should the situation demand it to convene a special
