MINUTES OF THE SEPTEMBER 2006 MEETING OF INSTOW PARISH COUNCIL


HELD AT INSTOW PARISH HALL ON THURSDAY 19th SEPTEMBER 2006 - 7.30pm

Present: - Councillors P Cook, N Crombie, M Green, C Harper, A Johns (Chairman), G May, Ms A Mayoh, F Scott, S White and Mr R Jacob (Parish Clerk).

In Attendance: - Cllr R Cann (DDC) and 15 parishioners.

2609/1 PRAYER

2609/2 APOLOGIES

2609/3 POLICE REPORT
a) General Matters: - Sgt Trevor Hartson introduced himself and asked if there were any questions he could answer: -
(i) Cllr White asked what the police were doing about continual traffic congestion/illegal parking within the village. Sgt Hartson said he would speak to the Traffic Warden supervisor albeit they did not work other than during the daytime. Cllr White said this was not satisfactory and asked why police officers patrolling the area didn’t enforce the regulations. Sgt Hartson said policing had changed a great deal in his time and that regular officers had to prioritise their work; traffic enforcement was not of a high priority. (Noted)
(ii) The Clerk asked when PC Benbow’s replacement was to be announced as Inspector Toby Davies had assured him this would be resolved by mid/late September. Sgt Hartson said there were two regular police officers that worked within the Sticklepath/Fremington area and that these would cover Instow as necessary. The Clerk said that in light of this unsatisfactory answer he would contact Inspector Davies soonest. (Action: The Clerk)
(iii) (a) A parishioner said she was concerned at the speed vehicles were being driven along the seafront ; Cllr Johns made a similar statement as regards vehicles using Anstey Way particularly late at night. After discussion it was RESOLVED the Clerk would contact the police and ask them to give this issue their attention. Cllr Cann said he would raise it through DCC as well. (Action: Cllr Cann & The Clerk)
(b) Cllr Scott asked Cllr Cann if “silent” painted rumble strips might be used in the village to slow down vehicular speeds on the basis it was undoubtedly cheap by comparison to other methods. He said it could be used for example along the seafront and Anstey Way. Cllr Cann said he would give it some consideration and liaise with DCC Local Services. (Action: Cllr Cann)
b) Policing Issues: - PCSO Charles introduced himself and said that one burglary (store), seven thefts and an offence of criminal damage had occurred in the parish since the July meeting and all remained undetected. He also referred to an incident at the picnic site on the Tarka Trail where the Cob House and a picnic table had been damaged. (Noted)
c) PCSO Powers: - Sgt Hartson told IPC that more PCSO were to be appointed for the area in 2007 and that their current limited powers of “policing” were to be increased up to about 42 in number; this could well include traffic enforcement and matters akin. (Noted)

2609/4 PARISHIONERS
a) Instow in Bloom/SW In Bloom 2006: - Dolores Harper (Committee Member IIB) outlined the number of awards that had been won by the village at the recent South West in Bloom 2006 Competition (full copy of report attached to minutes) and produced the trophies for Cllrs and parishioners to view. Cllr Johns (Chairman), on behalf of IPC, congratulated IIB on its great success adding that the Committee’s hard work and endeavour had brought much credit upon the village and for this they should be extremely proud of themselves. (Noted)
b) Community Show – Wishing Tree Synopsis: - Dolores Harper also handed in this document for the information and attention of IPC. The Clerk thanked her and said it would be included with the completed ransom strip questionnaires that had been returned by parishioners and would be considered by Cllrs later in the meeting – see item 2609/8 (b). (Noted)
c) Planning Issues/Applicant: - A parishioner expressed some concern that he had not been consulted, as an applicant, by IPC’s Planning Sub Committee when they had deliberated over a recent planning application. Cllr Johns thanked the parishioner for his comments and said it would be considered by IPC for the future. (Noted)
d) Traffic Congestion/Rerouting of Traffic/Buses: - (i) A parishioner, who said he had previously raised this matter with IPC and had been told that Council would be monitoring the situation, said he wished to bring the matter back for consideration again. He expressed concern about the amount of traffic congestion that occurred along Marine Parade and suggested that one simple solution to alleviate this was to make the bus routes circuitous, that is, one way along Marine Parade and the other way along Anstey Way. Cllr White said this had been discussed before and had not found favour with elderly parishioners who were unable to walk up to Anstey Way to catch a bus; this was, he said, a view unanimously shared by Council. After discussion it was RESOLVED to defer the matter to the next meeting for further deliberation by Cllrs. (Action: IPC)
(ii) A parishioner said she would not be in favour of this suggestion, as would many of her friends and associates, and that in her experience there were not many “appropriate” sites for bus stops along Anstey Way. (Noted)

2609/5 REPORT COUNTY COUNCILLOR R CANN
a) IIB/ Community on Show Committee 2006: - Cllr Cann began his report by congratulating IIB on its recent successes and The Community on Show Committee for putting on such an excellent event back in the summer. (Noted)
b) General: - Cllr Cann spoke of North Devon Recycling (42% of household waste recycled – government target is 30%), Instow New School Update (landowner had been asked (May 2006) to provide details of other sites offered by it for the school – DCC had set a deadline of 29th September for a reply that has not materialised to date); Traffic Speed Radar Survey – Marine Parade (Signal Box to Car Park) (highest speed 33 mph; lowest speed 13 mph and average speed 21 mph); £3 Million Road Maintenance Scheme - North Devon (A39 between Portmore and the Roundswell Roundabout); DCC Public Liability Claims (£2.2 million over 9 years) and Urban Search and Rescue Vehicle Unit - Devon Fire and Rescue Service (one of 19 units across the country to deal with the potential threat of terrorism). 2609/7 MINUTES
It was RESOLVED that the July 2006 minutes of Instow Parish Council be approved and signed. (Noted)

2609/8 MATTERS ARISING FROM THE MINUTES
a) Item 2607/8 (b) – Charter Toilets/Quay Car Park: - (i) Cllrs Rodney Cann provided IPC with an update report. He said NDDC’s Executive was still considering all possibilities for this site that included the building of flats (as already approved) incorporated with charter toilets with the provision of alterative parking within the parish. He said a site meeting was to be held in due course by the Executive Committee and that representatives of IPC would be invited to attend. He said he would do all he could personally to resist such a proposal and would keep IPC informed of developments. (Noted)
(ii) After discussion IPC RESOLVED to do all it could to retain the current car park site as it stood but with the provision of the agreed charter toilets that were now long overdo. (Noted)
(iii) IPC noted that NDDC’s stance, as per its current Local Plan (Item 14: Instow Action Plan), was, quote: - “The Quay Car Park is of strategic importance and will be safeguarded from redevelopment (in accordance with Policy TRA8A) unless alternative provision is made available (see item 14.19)” (Noted)

b) Item 2607/8 (c) - Sandhills Ransom Strip Questionnaire: - (i) The Clerk confirmed that the agreed flyer had been sent out to parishioners with the August Parish Magazine and then provided feedback on the number of questionnaires returned to IPC by parishioners, that is, approx 83 parishioners responded on 74 completed forms. (Noted)
(ii) IPC then discussed future action(s); The Clerk said he had liaised with Brian Holme (BH) (NDDC) and BH had (a) agreed to draw up a synopsis of the responses for subsequent discussion by IPC’s Ransom Strip Steering Group and (b) have all proforma copied for each member of IPC’s Ransom Strip Steering Group (Cllrs Johns, White, Ms Mayoh and Scott) so that said group might liaise independently of NDDC and draw up its synopsis. IPC RESOLVED to agree to this recommendation and the Clerk was asked to act accordingly. (Action: The Clerk)
c) Item 2607/8 (f) – Alleged “Illegal” Signage (Various): - The Clerk reported that as of the date of the meeting nothing further had materialised on this issue either from DCE, NDDC or DCC; he recommended NFA - IPC RESOLVED to support this recommendation. (Noted)
d) Item 2607/9 (i) (a) (ii) – Traffic Congestion/New Road: - (i) The Clerk confirmed he had written to DCC Local Services (21.7.06) and passed on a copy of the parishioner’s letter adding IPC’s support to his concerns. (Noted)
(ii) The Clerk advised IPC that a response was received from DCC Local Services (letter dd 1.8.06 refers) and which he had copied to Cllrs with their Summer Update Memorandum. He said that in a nut shell it was felt there was no positive/long term action it could take to alleviate the perceived issues. (Noted)
(iii) The Clerk confirmed that he had sent a copy of DCC Local Services letter (dd 1.8.06) to the parishioner for his information and later spoke to him. (Noted)
e) Item 2607/9 (i) (h) – Boathouse Bus Shelter (Various): - (i) Cllr Harper reported upon his enquiries within IPC’s archives and elsewhere as regards the “arrangement” for the siting of this shelter. He said he had not, as yet, completed his research and would report back to IPC as and when. (Noted)
(ii) The Clerk reported that as of the date of the meeting nothing further had materialised on this issue from DCE; he suggest NFA other than to continue to pursue evidence of “ownership” of site as at (i) above. IPC RESOLVED to agree with this suggestion. (Noted)
f) Item 2607/9 (i) (n) – NDDC Draft Brief Education Contribution COC: - (i) The Clerk advised IPC that following deliberations by Cllrs Scott and Crombie, together with the Clerk (who consulted with NDDC Planning Policy Officer), it was decided to write to NDDC and offer support for this initiative which basically meant that if further educational resources, such as classrooms for example, were required as a consequence of a new housing development then there would be an “agreement” that the housing developer would pay for the new resources. IPC RESOLVED to ratify this decision. (Noted)
(ii) The Clerk reported receipt of an acknowledgement postcard (received 16.8.06) from NDDC Planning Policy Team confirming receipt of IPC’s response as at (f) (i) above. (Noted)
g) Item 2607/9 (i) (o) – Instow Beach/Dog Restrictions: - The Clerk reported that as of the date of the meeting nothing further had materialised on this issue from DCE or NDDC; the Clerk suggested NFA. IPC RESOLVED to agree with this suggestion. (Noted)
2609/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 13.7.06) from NDDC reference “Adoption of North Devon Local Plan 1995 – 2011: - The Clerk said this stated that this plan had been formally adopted on the 6th July 2006 and would now form part of the development plan for the whole district outside Exmoor National Park and would form the basis for decisions on land use planning within this area; copies of the plan, he said, could be viewed on www.northdevon.gov.uk/localplan (coloured maps available later) or at the Planning Reception, Civic Centre, Barnstaple as well as at the Ilfracombe and South Molton Community Offices. He reminded Cllrs he had forwarded a copy of the letter to them with their Summer Update memorandum (17.8.06). (Noted)
b) Complaints (25.7.06) from parishioners reference “Sewage Smell in vicinity of Instow Quay”: - The Clerk reported he had contacted the Environment Agency who had immediately investigated the compliant and found nothing untoward i.e. no evidence of sewage in the immediate vicinity. It was suggested that the smell could well have been emanating from drains, vents and possibly the well at the pumping station (on Marine Parade) due to the very hot weather. The EA had assured the Clerk that it would continue to monitor the situation and encouraged further complaints to be passed to it by free phone 0800 807060 – each complaint would be investigated. The Clerk said the parishioners had been informed of the outcome and the telephone number had been passed to the post office so that any enquiring parishioner could be advised to use it. The Clerk confirmed he had advised the Chairman of TTEF for information. (Noted)
c) Letter (dd 26.7.06) from Chief Inspector Paul Davies (Geographic Chief Inspector for Northern Devon Sector of the Devon and Cornwall Police) reference “Promotion and Commitment to Policing in North Devon”: - (i) The Clerk advised IPC of the content of Chief Inspector Davies’s letter. (Noted)
(ii) The Clerk told IPC he had written to Chief Inspector Davies to congratulate him on his promotion and welcomed his assurance that he was fully committed to strengthen and improve the professional service provided by his service in North Devon. In doing so the Clerk enquired when it was proposed to replace Constable Benbow as Instow’s Neighbourhood Beat Manager as Instow felt yet again, somewhat sidelined and ostracised from the force’s commitment to community policing and for which the force prided itself on. (Noted)
(iii) The Clerk referred to a subsequent telephone call from Inspector Toby Davis who said that because of current “uncertainly” within the force (since the retirement of the Chief Constable) he could not advise IPC of PC Benbow’s replacement but that this issue would become clearer during September following agreement of neighbourhood beat reorganisation that was currently being discussed. He did, however, reassure the Clerk that a neighbourhood beat officer would eventually be assigned to Instow to work in conjunction with PCSO Charles who would continue to patrol the area in the meantime. (iv) IPC RESOLVED to have the Clerk communicate with Chief Inspector Davies/Inspector Toby Davies so as to be provided with an update on PC Benbow’s replacement. (Action: The Clerk)
d) Report of Theft of Engine Oil Drum and contents – IPC: - (i) The Clerk advised IPC that between 6 am on Sunday 23.7.06 and 6 am on Sunday 30.7.06 the parish council’s oil drum and contents (approx 18 litres tractor engine oil – value approx £25) was stolen from The Barton by person(s) unknown. The Clerk told IPC he had reported the crime to the police (31.7.06) – Crime Number CB-06-3618. (Noted)
(iii) The Clerk advised IPC of a letter (dd 1.8.06) received by him from The Crime Manager, Crime Standards Unit, Exeter stating that because of “insufficient evidence to provide viable lines of enquiry a decision has been made not to continue with the investigation etc”. (Noted)
(iv) The Clerk reported that he had written to The Crime Manager (letter dated 3.8.06) expressing his grievance as to the tenor of the letter and of the decision to decide not to investigate the theft, albeit minor in nature. He reminded Cllrs they had been provided with a copy of both letters with their Summer Update Memorandum. IPC RESOLVED to support the action taken by the Clerk; Cllr Scott complimented him on the tenor of his letter. (Noted)
e) Letter (dd 7.8.06) from Admin Officer of Steering Committee of Community on Show reference “Community on Show 2006”: - The Clerk said this thanked IPC for its support in making the event such a success; the Clerk read it to Council and confirmed he had replied complimenting the Committee on their hard work. (Noted)
f) Email (dd 15.8.06) from National Association of Local Councils (NALC) and letter (dd 14.8.06) reference “Local Democracy Campaign”: - (i) The Clerk said this invited all Quality Parish and Town Councils to take part in this year’s Local Democracy Campaign which culminated with Local Democracy Week which takes place between 16-20th October 2006; in a nutshell the campaign is all about getting young people, councils and other groups to work together to change their communities for the better. The Clerk reminded Cllrs he had copied the email to them with their summer update memorandum so that each might consider the invitation prior to this meeting when a discussion might ensue. (Noted)
(ii) After a discussion it was RESOLVED to take no further action. (Noted)
g) Telephone call (29.8.06) from Constable Ashford reference “Arson to Round (Cob) House at Picnic Site –Tarka Trail”:- (i) The Clerk advised IPC that Constable Ashford had notified him that the police had received information to the effect the cob house had been set alight and sought an up to date report. The Clerk said he had told PC Ashford that DCC (NDCCS) leased the site from IPC and that Wings had constructed the thatched round (cob) house which had only recently been finished and officially opened; the Clerk immediately advised the Chairman. (Noted)
(ii) A discussion then ensued during which it was confirmed that little or no damage had been caused to the thatched cob house albeit a picnic table had been damaged by fire; it was also confirmed that NDDCS/Wings had the matter in hand. IPC RESOLVED, however, to have the Clerk liaise with NDDCS/Wings just to ensure all was in hand. (Action: The Clerk)
h) Email (dd 9.9.06) from Cllr Harper reference “South West in Bloom Awards 2006”: - The Clerk said this stated that Instow (IIB) had been awarded the following awards: - Gold Medal & Mary Mortimer Trophy (best small village), South West Tourism Salver (best portfolio), Monk Trophy (best use of native flora), RHS Biodiversity Award and Sponsors Award (most meritorious entry). (Noted)
(ii) The Clerk confirmed he had communicated with IIB to sincerely congratulate it on behalf of IPC. (Noted)
i) Complaint (13.9.06) from parishioner reference IPC’s Bus Shelter at junction of Marine Parade/Anstey Way (near Signal Box): - (i) The Clerk said the parishioner had alleged that the interior of this shelter was in a disgusting state and required painting with emulsion and that the view from the small window to the side was blocked by willow branches. (Noted)
(ii) The Clerk said he had immediately requested the handyman to investigate the complaint as a matter of some urgency. (Noted) (iii) The Clerk said the handyman had advised him (13.9.06) that the willow branches were quite some distance from the window and were the property of IIB and that the interior wall surface was of the pebbledash type/grey in colour. (Noted)
(iv) After discussion IPC RESOLVED not to paint the wall (for the reason that once it was painted this would become a high maintenance issue) but to have it jet washed by the handyman asap; Clerk to advise parishioner. (Action: The Clerk)
j) Instow pre School Group – Ofsted Assessment: - The Clerk reported that as a result of information received (Email Cllr Harper – 14.9.06) he had sent an email to Amanda Speed (Pre School Group Leader) congratulating her on behalf of IPC for achieving top marks in all grades at the recent pre school’s Ofsted Assessment. (Noted)
k) Letter (dd 12.9.06) from Campaign to Protect Rural England (CPRE) reference “Planning/Offer to Join CPRE”: - The Clerk advised IPC of the content of the letter that was, in effect, an invitation to join the organisation. After a discussion IPC RESOLVED to take no further action. (Noted)
l) Memorandum from NDDC (Culture and Regeneration Manager) reference “North Devon Community Strategy – Draft Revision Document/Appendices”: - (i) The Clerk said this stated that the document updated the 2002 document entitled “North Devon First” and focused the Local Strategic Partnership (LSP) on the delivery of a number of specific projects. He said any comments/responses should be forwarded to NDDC by the end of September 2006. (Noted)
(ii) After discussion IPC RESOLVED to accept Cllrs Ms A Mayoh’s offer to peruse the document and liaise with Cllr Johns (Chairman) prior to the end of September so as to determine if a response by IPC was appropriate. (Action: Cllr Ms Mayoh/Cllr Johns)

d) Email (dd 4.9.06) from DAPC reference “Vat – Car Park Charges”: - The Clerk advised Cllrs this did not appear to affect IPC’s current parking charges (where Vat was not relevant) although he had liaised with Mr G Day (IPC’s IA) just to have all possibly implications considered bearing in mind that IPC was registered for VAT pre 2003 and that a six year time limit for claims might be relevant. The Clerk suggested that this be taken into consideration by IPC’s Finance Sub Committee when it meets to consider IPC’s Budget for 2007/8 in Oct/November 2006. (ii) The Clerk said he had checked with Mr G Day (IPC’s IA) who was similarly unaware of the origin of this account and was supportive to a view that the account should be closed and paid into Parish Hall account. (Noted)

h) Audit Commission - Annual Return for the Year ended 31st March 2006: - (i) The Clerk reported receipt of a letter (dd 29.8.06 – received 6.9.06) from the Audit Commission together with the Certified Annual Return for the financial year ending 31st March 2006. He advised Cllrs that the External Auditors Certificate and Opinion (Section 3) stated, “on the basis of our review, in our opinion the information contained in the annual return is in accordance with the Audit Commissioner’s requirements and no matters have come to our attention giving cause for concern that relevant legislation and regulatory requirements have not been met”. The Clerk further reported that no other matters, not affecting the opinion of the Audit Commission, had been drawn to the attention of Council and that he had copied all correspondence to Mr G Day (IPC’s IA) and thanked him for his work and support in performing the internal audit process. (iii) The Clerk confirmed that the “Notice of Conclusion of Audit and Right to Inspect the Annual Return for the year ending 31st March 2006” form had been displayed on IPC’s notice board at John’s Post Office on Wednesday 13th August for a 14 day period (to end on 27th September); he said that as of the date of the meeting no parishioner had requested to see the return. (b) The Clerk told IPC he had authorised the beach cleaner to continue to clean the beach up to and including Sunday 24th September because of the excellent weather currently being experienced, coupled with high usage of the beach. After discussion it was RESOLVED to reply to the effect that weekday evening meetings would be more appropriate especially as many Cllrs were committee during the daytime. (Action: The Clerk)

a) Doggy Bins – Instow: - Cllr Cook said that NDDC should provide bigger doggy bins or empty them more regularly as this season many had been filled to the brim thus creating a health hazard/unsightly. IPC RESOLVED to liaise with NDDC to see if this state of affairs could be rectified for the future. (Action: The Clerk)
b) Footpath Gate – Venn Cross to Tarka Trail: - Cllr May said there was a gate on this footpath that required replacing; the Clerk said it had already been reported to the DCC Footpath Warden and that it was in hand – he said he would, however, chase it up. (Action: The Clerk)
c) Code of Conduct/Declaration of Interest Presentation: - The Clerk reminded Cllrs that the next IPC meeting in October (19th) would be preceded at 7pm by a talk to be given by Don Pratt (NDDC Monitoring Officer) and it was hoped that a good attendance would prevail.
