2210/4 POLICE REPORT
a) Crime: -
PCSO Meaker reported that four crimes had been reported in the parish since
the last meeting, namely, theft of cash/mobile phone, theft of an off-road
motor cycle, criminal damage to a vehicle and burglary and theft of an
outboard motor. (Noted)
b) Other Matters: -
PCSO Meaker said no incident logs had been created in the parish since the
last meeting. (Noted)
e) “Rave Party at Picnic Site, Tarka Trail” (Item 2209/10 (i) (m)): -
The Clerk advised IPC of the excellent proactive work carried out by the
police since the last meeting in breaking up a further rave at this site; he
elaborated. The Chairman thanked PCSO Meaker and asked her to pass on the
compliments of IPC to her colleague, PC Preston, who had been personally
involved. (Noted)
2210/5 PARISHIONERS
a) Commodore Slipway – Boats Tied to Railings: -
(i) A parishioner enquired what was happening about the dinghy’s that were
moored to the railings on the Commodore slipway as with the onset of winter
they were liable to be “pulled” from their ties, smashed up with the resultant
debris ending up on the beach. (Noted)
(ii) The Clerk reminded Council that the railings in question were the
property of the EA and the beach on which the dinghy’s were resting was not
within the ownership of Instow Parish Council. (Noted)
(iii) After a discussion IPC RESOLVED to contact the EA and enquire what its
policy on the matter was. (Action: The Clerk) b) Complaint against IPC: -
(i) A parishioner said she wished to state she did not complain about the
“appalling behaviour” of Cllrs at the July meeting but that in May she had
complained about the behaviour of Cllr Cook at the Annual Parish meeting and
following parish meeting and Cllr Thomas at the March and April parish
meetings; she also noted the lack of control of this behaviour by the Chair
and Clerk. This she said was wrongly reported in the May minutes and should
have been picked up in the June meeting. She said the Clerk advised Cllrs not
to make any comment but they were within their rights to do so as the
recording of May’s minutes was not subject to a complaint. She said the
Clerk’s comments re Andy Bell’s strategy about the tractor not going anywhere
near the dunes failed to point out that the strategy was about removing the
strandline from in front of the dunes but it did not prevent Cllr Cook
travelling down the beach to pick up all non-bio-gradable which he had failed
to do throughout the summer. She then referred to a series of letters she had
received from IPC, and her replies; she said she had been prepared to meet
with any Cllr sufficiently interested in realising value for money and who was
prepared to enforce the strategy as stated by Andy Bell and agreed by the
council earlier this year. She then questioned the validity of other letters
sent to her by the Clerk and gave her reasons. She added she had spoken to
Andy Bell since about the rubbish throughout the dunes and on the beach during
the summer and he stated photographic evidence cannot be refuted. She then
produced a number of photographs of rubbish she had witnessed and showed them
to Cllrs; she said she had many more. The parishioner than added that to
suggest (in one of IPC’s letters) that her views were at odds with the
majority of parishioners was unbecoming by a supposedly Quality Parish council
and “challenged” IPC to prove it. She then referred to the beach cleaner’s
time sheets that should be available for public scrutiny adding that as they
had not been provided on two separate occasion she had been advised to inform
the Information Commissioner’s Officer. She then referred to a conversation
she had had with Cllr Moores (Vice Chairman) who was unaware the dune cleaning
was the responsibility of the beach cleaner and mentioned a conversation with
Cllr Johns as regards rubbish she had collected from the beach alongside
tractor tracks and wondered if he had reported it. The parishioner finalised
by saying the recent Marine Conservation Beach Survey and clean was conducted
after the beach cleaner had left and it resulted in 19 kilos of rubbish being
collected just between the Quay and the Commodore. (Noted)
(ii) At the request of the Chairman the Clerk provided advice to Cllrs,
namely, it would not be appropriate, in view of the “complaint(s)” to make any
comment; he reminded Cllrs of the legal guidance council had been provided
with and upon which it had recently acted adding that it was still open to the
parishioner to make a formal complaint to NDC. The Clerk added, however, that
in view of endeavouring to resolve this long standing impasse it might be
appropriate to put on the table a recommendation that he believed some Cllrs
were in favour of namely, to review, over the forthcoming winter months, IPC’s
beach cleaning strategy. Cllr Moores proposed this as a course of action.

(iii) In answer to a question from Cllr Green, the Clerk said that this review
could be as far reaching as doing no beach cleaning at all, cleaning only
those parts of Instow beach leased by IPC from the Crown Estate (and ignoring
the remainder of the beach including the dunes), that is from the Commodore to
the Boathouse and cleaning the sands mechanically or by hand, maybe with
volunteers. (Noted)
(iv) Cllr White (Chairman) then seconded Cllr Moores proposal as at (ii) above
and enquired whether there were any alternative proposals; there were none. A
vote was then conducted and all Cllrs present, with the exception of Cllr
Harper (who had declared a personal interest) voted in favour. (Noted)
(v) The parishioner then added she had only ever wanted to support the parish
council with its beach cleaning strategy and that this had always been her
aim. (Noted)
(vi) Another parishioner present then said she had had cause in the past to
complain about the beach cleaning strategy but that she had not been so
dogmatic; she added that she now hoped a line could be drawn under this matter
and said it was a shame it had become political. (Noted)
**** Cllrs Cook and Thomas declared a pecuniary and personal interest
respectively, did not speak and left the room at the time the parishioner
began to speak. Cllr Harper declared a personal interest but did not leave the

c) Instow School: -
The Chairperson of Instow School Governors said that the school were looking
at going into partnership with Abbotsham School and whilst negotiations were
in train there was no intention to appoint a new head teacher. (Noted)
d) Parking Congestion – Old Rectory Close/Rectory Lane: -
(i) A parishioner said she wished to compliment Cllr Thomas for recently
taking the initiative in endeavouring to prevent a reoccurrence of parking
congestion at the junction of these two roads and that had caused NDC’s
recycling lorry to be unable to enter Old Rectory Close. She said if it
continued to occur it could cause more serious problems for an ambulance, fire
engine or delivery van and that it appeared the police hadn’t been made aware.

(ii) The Clerk said the police had been advised by him at the time it was
first discussed by IPC (July 2012) and that Constable Preston had asked that
any future similar occurrences were passed to the police immediately and they
would take appropriate action. The Clerk added that IPC had been advised of
this at its September meeting – see item 2209/9 (f). (Noted)
2210/6 REPORT COUNTY COUNCILLOR R CANN
General: -
Cllr Cann spoke of “Deep Moor Waste to Energy Generation” (two engines,
working 24/7 throughout the year provide a capacity of up to 2MW of
electricity per hour – in 2011 14,500,000kw of electricity was generated which
is the equivalent of meeting the electricity needs of about 4,000 homes); “DCC
Investing in Devon Fund” (would welcome expressions of interest for
consideration on the basis that not all funds as yet allocated); “Fremington
Quay” (to be extended with a grant from Entrust); “Fremington Camp” (reported
upon progress of current planning application) and “Local Plan” (this is being
expedited in light of all the recent development applications). (Noted)
2210/7 REPORT OF DISTRICT COUNCILLOR B MOORES
a) Meeting with CE of Devon Christie Estates (DCE) – 12th October 2012: -
(i) Cllr Moores spoke of a meeting he had recently had with the Chief
Executive of Devon Christie Estates and in which he had discussed matters such
as “Hut at the Entrance to Sandhills Car Park (Rubbish)”, “Planning
Application to re-develop Sandhills/Car Park”; “A Play Area”, “Water
Pollution”, “Boats Abandoned on Beach” and finally a “Meeting with IPC”; he
elaborated on each. (Noted)
(ii) After a discussion IPC RESOLVED to invite the CE of DCE to the December
meeting of IPC to address Council prior to the meeting proper by commencing at
7pm. The Clerk was asked to liaise with Cllr Moores to facilitate an
invitation.

2210/8 MINUTES
It was RESOLVED that the September 2012 minutes of Instow Parish Council be
approved and signed. (Noted)
2210/9 MATTERS ARISING FROM THE MINUTES
a) Item 2209/6 (e) - Residents Parking: -
Cllr Cann told IPC he had not as yet obtained DCC’s Highways official views as
regards the future of this initiative but that he still had personal
misgivings that the majority of the parish were not in favour of it. He agreed
to look into it and report back in due course. (Noted)

Item 2209/9 (b) – “IPC’s Self Help Emergency Plan Update”: -
In the absence of Cllr Renshaw there was no update report but the Clerk
confirmed he had purchased a suitable “ballot” box for use in the collation of
the questionnaires at Johns’ once they were sent out. (Action: Cllr Renshaw)
c) Item 2209/9 (c) – New Code of Conduct/Registerable Interests Training: -
(i) The Clerk advised IPC that DAPC were not running any such training but
that NDC had arranged a training course (no charge) at All Saints Community
Centre, Instow for Thursday, 1st November 2012 at 6:30 pm and that to date
Cllrs Harper, Green, Johns, Crombie and the Clerk had intimated their
availability. (Noted)
(ii) Cllrs White, Cook and Thomas then expressed a willingness to attend; Cllr
Moores said he had already advised NDC he would be attending – Clerk to liaise
with Cllr Renshaw and update NDC. (Action: The Clerk)
d) Item 2209/9 (d) - IPC’s Complaints Procedure/Review: -
The Clerk reminded IPC it had previously been resolved to defer this matter to
a later date on the basis any review was somewhat premature and that it might
be best if the current complaint against IPC was finally resolved so that any
lessons learnt could be included. IPC RESOLVED to ratify this decision and
defer it once again. (Noted)
e) Item 2209/9 (e) – Dogs on the Beach: -
(i) The Clerk reported that a meeting of a sub-committee of IPC took place at
3pm on Wednesday 10th October (comprising Cllrs Harper, Moores and Green
together with the Clerk, Cllr Cann and a NDC Environmental Health Dept.
Officer) and that the following was what said sub-committee recommended as
IPC’s “dogs on the beach” strategy for 2013: -
a) Erect “advisory” signs at access points to the beach so as to advise of a
dog ban on that part of Instow Sands, namely, between the Quay and Boathouse
(Lobster Pot) during the months of April to September inclusive.
b) It is noted that this dog ban would not be enforceable and is reliant
entirely upon the good will/nature of law abiding citizens to comply.
c) It is intended to further advise that a dog exercise area will be permitted
In front of the dunes from the Boathouse (Lobster Pot) to the Cricket Club but
that dogs’ entering the dunes is illegal.
d) It is also intended to advise dog owners that there are no restrictions in
place on the 2nd sand dunes other than compliance, it is assumed, with the
Clean Neighbourhood and Environment Act, as regards owners clearing up after
their dog.
e) All the above actions are totally reliant upon the fullest of cooperation
of Christie Estates
f) This initiative will receive suitable local publicity and be followed up by
volunteers patrolling the beach and issuing dog advisory pamphlets that IPC
already has in its possession from a previous initative.
g) In this publicity members of the public should be encouraged to advise NDC
of “dog” incidents of concern and particularly provide evidence of any
illegality to NDC.
h) It is noted that Instow receives more than its fair share of dog warden
patrol and for this the parish council is most grateful. (Noted)
(ii) The Clerk advised IPC that NDC’s EH Dept. Officer (as at (i) above) was
supportive of the above “light touch” strategy (that has been adopted with
success in other areas of North Devon) but pointed out the following as a
matter of clarity: -
1. Whilst technically the bye law remains which bans dogs from the dunes
during the summer months only (dates to be checked), the absence of signage
means that enforcement would be difficult if not precluded.
2. Whilst the general public should be encouraged to contact NDC with regard
to dog related incidents within the Parish of Instow, but, most particularly
those occurring on the beach (the Customer Call Centre telephone number is
01271 388870), please ask all concerned to :-
2.1 Provide as much information as possible e.g. name and address of the
offender if known, but, failing that the time, location, and a good
description of both the owner and dog.
2.2 Note my comment yesterday about the difference between boisterous and
uncontrolled behaviour, and a dog which is dangerous within the meaning of the
act. I have every sympathy with those affected when a dog runs over sun
bathers or pinches a child's ice cream, but, such actions although
inconsiderate and demonstrating a lack of control on the part of the owner are
a nuisance. It doesn't mean that the dog can be classed as dangerous, nor
would such behaviour be covered by any legal control.
3. If you are going down the route of a ban I would suggest that you consider
the creation of very clear maps/plans that utilise significant landmarks at
both Instow and on the other side of the river to define boundaries as
straight lines that are readily recognised. Our experience with the 1st bylaws
(superseded by subsequent legal controls) was that even with defined
boundaries there remained a zone of ambiguity, when one use type changed to
another.
4. Subject to receipt of 'appropriate evidence' from a 'credible' witness who
was prepared to provide both a witness statement (Sec 9) and give evidence in
Court if required, I would be prepared to consider the retrospective service
of a Fixed Penalty Ticket for the offence of failing to pick up after a dog
has fouled. NB: - To do so we would need irrefutable evidence that the witness
saw the actual act of fouling and that the owner was not present or having
been present failed to pick up. It goes without saying that in each case we
must also be certain of ownership. (Noted)
(iii) Cllr Moores said he had spoken to the CE of DCE and that he had agreed
to support this initiative of IPC. (Noted)
(iii) After a discussion IPC RESOLVED unanimously to adopt the above “light
touch” strategy for 2013. (Noted)
f) Item 2209/9 (i) (f) - IPC’s Standing Orders Review: -
The Clerk reminded Council it had previously been resolved to defer this
review until all Cllrs had attended the New Code of Conduct/Registerable
Interests Training; see item (c) above. IPC RESOLVED to ratify this decision
and defer it once again.(Noted)
g) Item 2209/9 (i) (g) - Atlantic Array: -
(i) The Clerk referred to a letter (dd 21.9.12) from Nick Harvey MP reference
this matter; he said the letter had been copied to Cllrs with their agenda
papers (11.10.12) – he elaborated. (Noted)
(ii) IPC RESOLVED to take no further action. (Noted)
h) Item 2209/9 (i) (l) - Active Village Initiative: -
Cllr Harper updated IPC on his endeavours to set up a meeting between the
Instow Parish Hall Committee/Instow School and other interested
Individuals/Groups and the Active Village Coordinator; he said it was to take
place on Friday 19th October.(Noted)
i) Item 2209/9 (i) (m) - Picnic Site, Tarka Trail (Rave Parties): -
(i) The Clerk reported he had received an email (dd 2.10.12) from PCSO Meaker
reference another “rave” at this site but that it had been successfully broken
up at an early stage and all attendees dispersed by the police. The Clerk
confirmed he had thanked the police for their prompt and efficient work.

(ii) The Clerk further advised IPC that the police had asked that should this
activity continue how would Instow Parish Council like to handle it. For
example, signage could be put in place warning people of civil action to be
taken with regards to trespassing. (Noted)
(iii) The Clerk told IPC that he had, as a result, been in touch with NDCCS
(who lease the picnic site from IPC) and it had said that: -
“Erecting any provocative signage might end up being vandalised; however some
interpretation reference the wildlife value of the site and the local history
attached would be useful and this could incorporate the information required,
i.e. ownership, any by-laws, do's and don'ts etc. If putting up a sign causes
a problem (ownership?) any sign could be put up on DCC land where the ramp
drops down to the picnic site”.

appropriate signage; IPC RESOLVED to support this initiative. (Noted)
2210/10 CORRESPONDENCE

a) “Bathing Water Quality Issues; -
(i) Telephone call (18.9.12) from the EA’s Community Engagement Officer (CEO)
reference “Community Engagement – Instow”: -
(a) The Clerk advised IPC he had acquainted the caller with details of IPC’s
historical engagement with the community, particularly in 2011 at the time of
considering an application to Defra to de-designate Instow as a Bathing Water
Beach, and queried, therefore, what further assistance could be provided. At
the conclusion of the conversation the caller agreed to forward an email
providing IPC with any further guidance that was felt to be relevant or
helpful; the Clerk said nothing had been received at the time of the meeting.

and seek further information so that it might determine whether the support

b) Letter (dd 28.9.12) from NDC (Electoral Registration Officer) and
attachment reference “Register of Electors – Non-responding Properties”: -
(i) The Clerk said this letter enclosed a list of non-responding properties in
Instow from the current year’s electoral registration canvass and NDC were
seeking assistance such as whether any electors still live at said properties
or they are empty. NDC asked for a reply date of 10th October as it has to
publish the electoral register early this year (16th October) due to the
Police Commissioner Elections which are taking place on 15th November. (Noted)
(ii) The Clerk said the list of non-responding properties had been forwarded
to Cllrs with email addresses (5.10.12) for reply to the Clerk by 10th
October. (Noted)
(iii) The Clerk reported that as a result of information received from Cllrs
Harper and Moores he had forwarded an appropriate response to NDC (10.10.12).

(iv) The Clerk reported receipt of a letter (dd 15.10.12) from NDC (Electoral
Registration Officer) and attachment, namely, “Register of Electors 2012/13”
and posters for distribution on parish notice boards; the Clerk said Instow
now has 637 electors registered (was 625 in 2011/12). (Noted)
c) Email (dd 27.9.12) from DALC reference “Update on Quality Parish Status”: -
(i) The Clerk said this stated that “As a result of earlier discussions, NALC
has advised the QPS steering group, which is formed of national stakeholders
from our sector, the LGA and central government, to review the Quality Parish
Scheme with a view to re-launching an updated standards scheme in 2013. The
review will be based upon a wide-ranging consultation, taking views from
across the town and parish sector, as well as engaging with principal
authorities on their views of the scheme as it stands and of how it might
develop in the future. NALC will be in touch in due course to ask you both for
your views and to ask you to encourage councils, both those with quality
status and those without, County Accreditation Panel members, and any others
who you feel might have an interest, to contribute to the review of the
scheme. Their insight and experience will be of vital importance in ensuring
that this consultation is comprehensive and constructive”. (Noted) (ii) A

(following up information received from a parishioner) reference “Dead
Porpoise/Dolphin on Instow Beach”:-
(i) The Clerk advised IPC that following advice from NDC’s Environmental
Health Dept. he spoke, variously, to the EA and the National History Museum
who in turn liaised with London Zoo as a result of which it was decided
(19.9.12) that the carcass (identified by a photograph taken by Cllr Harper as
most likely to be a Harbour Porpoise) could be suitably disposed of locally.
The Clerk added that following a number of other telephone calls (NDC, Crown
Estate etc.) as regards the ownership of the beach on which the carcass was
situated (not IPC’s), NDC (prompted by Cllr Cann) took it upon itself to
arrange disposal. (Noted)
(ii) IPC RESOLVED to thank Cllr Cann for his positive intervention. (Noted)
e) Emails (various between 26.9.12 and 1.10.12) from SW Highways reference
“Marine Parade Footpath – Resurfacing/Parish Seats”: -
(i) The Clerk reported that he met on site with the contractors and parish
handyperson (1.10.12) and discussed the effect of the parish seats on this
long awaited and due project and it was agreed the contractor would remove and
replace each seat as found (at their cost); the Clerk added that he provided
the contractor with a copy of the seat layout to ensure they went back in the
same place. (Noted)
(ii) IPC RESOLVED to thank Cllr Cann (DCC) for ensuring this long awaited and
due project was finally instigated. (Noted)
f) Email (dd 27.9.12) and attachment from DCC Highways reference “Temporary
Traffic Order – New Road, Instow”: -
(i) The Clerk said this stated that New Road (outside Summerfield House to
outside Southerly) would be closed for the period 20th to 22nd November 2012
for utility work (new water connection) with an alternative route outlined.

(ii) The Clerk said the email had been copied to Cllrs with email addresses
(29.9.12) and the editor of the parish magazine (8.110.12). (Noted) g) Letter
(dd 5.10.12) and attachment (poster) from NDC reference “Police Commissioner
Election – 15th November 2012”: -
The Clerk said this requested that the posters (Notice of Election) were
exhibited throughout the parish to gain maximum attention of the electorate;
this had been done by the Clerk (11.10.12). (Noted)
h) Letter (dd 3.10.12) from a parishioner reference “Bus Route - Anstey
Way/Bus Shelters etc.”: -
(i) The Clerk said this requested that now Stagecoach had established a
permanent route through Anstey Way that the parish council, or whoever,
considered placing bus shelters and hard standing particularly outside of All
Saints Chapel. (Noted)
(ii) The Clerk reported he had spoken to the parishioner (9.10.12) and she
appeared to be of a view that 5 bus shelters would be necessary and one
hard-standing opposite All Saints where the bus stop is currently situated at
a grass (muddy) verge. (Noted)
(iii) After a discussion IPC RESOLVED to obtain an estimate to build a stone
bus shelter similar to the others in the parish and Cllr Cann (DCC) agreed to
look at a hard standing facility opposite All Saints Community Centre.

i) Email (dd 15.10.12) from Pearce Construction Ltd reference “Road Closure
Request Kiln Close Lane/Drainage Connection – 7th/28th January 2013”: -
The Clerk advised IPC he had told Pearce Construction that this should not
present any major problems on the basis all householders therein would be able
to access their properties at all times; it would just not be a through road.
IPC RESOLVED to support this decision of the Clerk. (Noted)
j) Remembrance Service 2012: -
The Clerk said this was to take place on Sunday 11th November (10.50 am) at
Instow Parish Church and that the parish council’s wreath was currently with
Cllr Thomas. IPC RESOLVED that Cllr Thomas would lay the wreath on its behalf
and as many Cllrs as possible were encouraged to attend. (Action: Cllr Thomas/IPC

k) Telephone call (15.10.12) from a parishioner reference “Incorrect Naming of
Lane End to Lane End Road”: -
The Clerk said that apparently new signs had been erected in the last 6 weeks
indicating Lane End as Lane End Road; he added that Cllr Cann (DCC) had been
advised and was investigating. Cllr Cann provided an update and said this was
the “doing” of NDC and not DCC. (Action: Cllr Cann)
l) Email (dd 18.10.12) from Cllr Harper reference “Parishioner Complaint –
Vehicle Obstructing Pavement/Marine Parade”: -
The Clerk said this had been passed to the police (Constable Preston/PCSO
Meaker) for attention and they were dealing. (Noted) m) Discussion regarding
Effect of High Tide during evening of Wednesday 17th October 2012: -
(i) A discussion then ensued as regards the drastic effect the tide surge had
had on the Boathouse “Flood Defence Gates” at high tide during the evening of

The Clerk provided an update; he said NDC were still to provide IPC’s

(ii) Refurbishment of Toilets: -
The Clerk reported that a site meeting between NDC and an IPC Sub Committee,
namely, Cllrs Harper/Moores and the Clerk, had still to be convened. The Clerk
said he was to liaise with Cllr Cann and that the meeting would possibly be
early in November 2012. (Action: The Clerk)
(iii) Winter 2012/13 – Parking (OSPO Amendment)/1st October 2012 onwards: -
(a) The Clerk advised IPC that the relevant OSPO had subsequently been
approved and the car park re-opened for payment on Friday 12th October (having

(b) The Clerk advised IPC that SW Signs had provided appropriate stickers to
ensure the necessary amendments/additions were made to the existing car park

(b) Tarka Trail Recreational Field – Lease between IPC and DCC (2012 onwards):
- The Clerk updated IPC on progress since the last meeting i.e. it was
progressing satisfactorily and just the fine detail had to be sorted. (Noted)
(c) (i) “Parish Grants” and (ii) “DCC Tap Fund”: -
(i) Parish Grants: - The Clerk reported that Cllrs White (Chairman) and Moores
(NDC) had attended a “NDC Parish Grants” meeting on Wednesday 19th September
2012 at 7pm/Civic Centre; both provided a short verbal report. (Noted)
(i) The Clerk said he was in possession of an agenda for the meeting as at (i)
above plus minutes of the previous meeting of Thursday 5th July 2012 and
minutes of the meeting of the 19th September that are hotly disputed by a
number of delegates who attended – Cllrs White agreed this to be the case.

(iii) The Clerk reported that another NDC meeting was soon to take place when
it was hoped a final decision would be taken as regards the future of parish

(ii) DCC TAP Fund: -
(a) The Clerk reported receipt of an email (dd 24.9.12) and attachments (TAP
Fund Criteria, Application Form etc.) from NDC (Grants and Community
Development Coordinator) reference “TAP Fund Application 2012/13”; the Clerk
elaborated i.e. it set out conditions by which Parishes within County Ward of
Fremington (including Instow) Rural needed to agree to facilitate the
necessary grants(s). (Noted)
(b) The Clerk reported he had responded to the email as at (a) above (email dd
2.10.12 refers) by agreeing to the following: -
• To the collectivisation of its indicative TAP budget, with the understanding
that not every parish will be able to draw down all of their own indicative
budget
• Each project will need to submit a separate application form, to draw down
funds from the collective total.
• Each project will still need to demonstrate that it is of shared interest
and concern to two or more parishes. (Noted)
(c) The Clerk advised IPC that it would seem that the over-complicated process
that NDC was using to administer this TAP fund was being challenged by Cllr
Cann/Fremington PC (who are coordinating the joint bid as at (a) above) and
that a result was awaited. (Noted)
(d) A discussion then ensued, led by Cllrs Cann/Moores, as regards a possible
“Children’s Play Area at All Saints Community Centre”; they provided IPC with
an update of their action to date. (Action: Cllrs Cann/Moores)
(d) (i) Mooring Fees 2011/12: -
The Clerk advised IPC that a cheque in the sum of £1,500 from Instow Marine
Services Ltd had been received and banked (29.9.12); see payments as at 1

(ii) Mooring Fees Tender - 2013-2015: -
(a) The Clerk reported receipt of a letter from Instow Marine Services (IMS)
tendering for this at the agreed cost pa of £1,750.00 pa. (Noted)

(e) IPC’s Finance Sub Committee Budget 2012/2013 Meeting: -

deals with all P3 activity, was unable to attend but that he would do so if
available on the day (i.e. Wednesday 24th October 2012). (Noted)
(ii) The Clerk reported receipt of the “P3 Autumn Newsletter 2012” and
associated correspondence regarding “P3 Annual Finance Form 2013” and “Annual
Parish Paths Survey Forms 2013” that he said he would complete at the
appropriate time; he said it needed to be at County Hall by Wednesday 13th

(k) DALC Subscription 2013/14: -
The Clerk advised IPC that members (at the recent DALC AGM 2012) had agreed a
3% increase in subscriptions for 2013/14 which equated to a figure of £151 for
Instow.

The Clerk reported that this would be done asap by himself, Cllr Crombie and
the parish handyperson now that the footpath had been completed and all seats

(n) Dune Fencing – Repairs: -
(i) The Clerk said this fencing was almost totally destroyed in the high tide
of the evening of Wednesday 17th October and was being collected and removed
from the beach by NDCCS who are to review its replacement. (Noted)
(i) The Clerk reported that prior to the events of the evening of Wednesday
17th October (as at (i) above) he had received an estimate cost of
repair/replacement of this fencing from the parish handyperson of £270.00 i.e.
30 hours at £9 per hour adding there would be no additional cost for
materials, namely, posts, as NDCCS still held a surplus from when the job was
originally done. (Noted)
(ii) The Clerk advised IPC there was a £200 surplus of monies from the
“scraping the sand back from the wall (Boathouse Bus Shelter) project”, and
which originally came from DCC/NDCCS – Total £800, in that £600 had been paid
out to the contractor for said project, with £100 eventually recoverable from
the VAT element - see IPC June 2012 – 2206/11 (2). IPC RESOLVED to note this
for future reference. (Noted)
(iii) The Clerk advised IPC that should it ever agree to carry out such
repairs by way of its handyperson that it makes it perfectly clear to NDCCS,
or whoever, that it does so on the provision it is not accepting liability for
the fencing that is erected on land (the dunes) over which it has no control
or jurisdiction. IPC RESOLVED to adopt this advice. (Noted)

Planning was pursuing by way of correspondence with the owner.
“Sign pollution along the footpath at the bottom of May's Field advertising
Car Boot Sale”; Cllr Moores said this was still being considered by NDC
Planning.
“Methodist Chapel along Anstey Way, Instow – General Untidiness”; Cllrs
Moores said this was still being considered by NDC Planning
“Pumping Station - Anstey Way, Instow”; Cllr Moores said this was still
being considered by NDC Planning.
“Chalet opposite Picnic Area – Tarka Trail”; Cllr Moores said he had spoken
to the CE of DCE in this regard.
“Glyn Cottage, Lane End, Instow”; Cllr Moores said this was still being

“Southgate Chalet, Instow”; the Clerk reported receipt of an email (dd
11.10.12) from Cllr Moores reference this matter and in which it stated that a
letter (dd 8.10.12) had been sent to the owners by NDC Planning requesting a
proposed timetable for either developing the site or tidying up its condition.
Cllr Moores confirmed this to be the case.
“Galsworthy House, Instow - A listed property”; Cllr Moores said this was
still being considered by NDC Planning.
“Signal Box/Exposed Wiring on Lamppost”; The Clerk reported that the Signal
Box Group had said that because of health and safety implications they would
have to hire scaffolding (“offending” wires are above 10’ and a ladder cannot
be used) to be in a position to trim the wires and that this would cost up to
£150. The Clerk added that Cllr Moores (NDC) had agreed to provide a Cllr
Grant for the purpose and the Signal Box Group had been put in touch with Cllr
Moores.
“Glen Cottage, Lane End, Instow”; Cllr Moores said this was still being
considered by NDC Planning. (Noted)

a) Marine Parade/Kiln Close Lane: -
Cllr Cook said he had noticed how difficult it was for cyclists to exit Kiln
Close Lane onto Marine Parade in safety and wondered whether a mirror could be
placed opposite the junction. Cllr Cann (DCC) said this was not DCC policy.

b) Commodore Slipway – Lockable Bollard Trip Hazard: -
Cllr Moores said this faulty lockable bollard had yet to be made safe and was
still a trip hazard to pedestrians going on to the beach. IPC RESOLVED to
liaise with NDCCS/EA who had previously agreed to sort it. (Action: The Clerk)
c) Suspect Unlawful Access onto Marine Parade from White House Close: -
Cllr Johns said he had been told that some stones had been removed from a wall
at this location that possibly gave direct access onto Marine Parade. IPC
RESOLVED to look into this – Cllr Moores agreed to check it out and act as
necessary in conjunction with the Clerk. (Action: Cllr Moores)
