2312/1 PRAYER

2312/3 POLICE REPORT
(a) Crime: - Constable Johnson reported that since the last meeting there had been 2 offences of theft of diesel from a storage tank at the Holmacott Landfill site. He also reported that his enquiries concerning the recent and minor criminal damage to the Venn Cross bus shelters was progressing well and that he hoped to report further to Council at the next meeting. (Noted)
(b) Traffic Issues ((i) Boathouse Loading bay & (ii) new road layout at junction Marine Parade/Anstey Way) – (i) Constable Johnson said he had spoken to John Beardsley (DCC Highways) about the Boathouse Loading Bay (as a consequence of 2311/9 (w)) and that he would come back to IPC in due course with recommendations. (ii) He said he had also spoken to DCC Highways about the new junction layout at Anstey Way/Marine Parade with particular regard to its approach from the Bideford direction; he had been reassured it would be appropriately sign posted and “narrowed” so as to reduce speed. (Noted)

2312/4 PARISHIONERS
(a) Wheelie Bins – Instow: - A parishioner expressed concern about the “impending” provision of wheelie bins by NDDC and outlined her anxiety as to how they might be stored and moved especially by the elderly. She cited problems that had been experienced by friends at Braunton. Cllr Cann said NDDC did have plans to extend this initiative to Instow in due course but that he was prepared to listen to any parishioner(s) who anticipated/experienced problems and then do all he could to overcome them. After discussion it was RESOLVED that the Clerk should write to Braunton Parish Council and ascertain what problems had been experienced in their area. (Action: The Clerk)
(b) Instow Welfare Trust: - A parishioner expressed her concern at the manner in which the Trustees of The Instow Welfare Trust had arbitrarily resolved to close said trust fund and transfer its assets to The Devon Community Foundation. She added it had been discourteous of them not to open up a dialogue with the parishioners of Instow and that there were concerns that potential beneficiaries might lose out. The Clerk reminded the parishioner that he had kept her continuously appraised since IPC had been advised, on learned advice from its Independent Auditor, it was incorrect to give the annual interest on said account to the Instow Parish Hall Committee (since confirmed in written guidance from The Charities Commissioners). He added he had also advised the parishioner she could directly approach the Trustees of the Welfare Trust when they were re-constituted in August 2003. The Clerk finalised by saying the Trustees had placed statutory notices throughout the village and that “concerned” parishioners should follow the guidance thereon and if necessary correspond with the Charities Commissioners. 2312/5 REPORT COUNTY COUNCILLOR R CANN
(a) General Report: - Cllr Cann spoke of the new junction layout at Anstey Way/Marine Drive (he said this “pedestrian crossing” scheme had generally been welcomed), Community Alliance (Lovacott, Newton Tracey and Westleigh Parish Councils have agreed to form a rural village’s alliance), Sand on Seafront (he had made a site visit with Joe Deasy (DCC) to discuss the problems and that more attention would be paid in the future to clearing sand, particularly from the footway), Westleigh Junction A39 (the new signs, to encourage continuous flows of traffic on and off the A39, were in place), Unofficial use of The Tarka Trail – Vicinity of entrance to Tapeley Park (DCC to fence off these openings on public safety grounds), and Power Station Proposed Footpath (land has been dedicated for a footpath from the main road down to the Tarka Trail along the length of the existing road to the former Power Station – DCC appeared unwilling to include the creation of this footpath in their future programme) – After discussion IPC RESOLVED to write to DCC to express support for such a footpath on the grounds it would link up with the Coastal footpath that runs to/from Instow and that the current road, because of heavy traffic and deposits thereon, made it unsafe for pedestrians. The Clerk was asked to write to Joe Deasy (DCC) (Action: The Clerk)
(b) Power Station – Heavy Lorries Access/Egress: - Cllr Ms A Mayoh said she had received complaints about the widespread use of this site by heavy lorries all coming to and from the Instow direction. She said rubble was falling off these vehicles onto the roadway and that mud was being left on the highway thus making it unsafe for other motorists. Cllr Cann agreed it was illegal for the exportation of waste, of whatever nature, from the Power Station site and that if evidence (e.g. registration numbers, photos) of such exportation were available he would like to be informed as soon as possible. He said he would liaise with DCC in any event. (Noted)

231/7 MINUTES
It was RESOLVED that the November 2003 minutes of Instow Parish Council be approved and signed. (Noted)

2312/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2311/8 (b) - Toilets – Marine Parade/Sand Dunes & Quay Car Park: - The Clerk reported he had emailed (21.11.03) IPC’s resolution of 20.11.03 (i.e. await draft plans of the two mini loos from NDDC before responding further – however, would prefer 2 unisex cubicles in each as opposed to only one) to Geoff Barclay (EH) and as of 11.12.03 was still awaiting a response despite re-sending the email (25.11.03) and posting a copy (1.12.03). Cllr Cann said he would chase a response up by the next meeting. (Action: Cllr Cann)
(b) Item 2311/8 (i) – Doggy Bin Atturm/Anstey Way: - (i) The Clerk reported he had emailed (21.11.03) IPC’s resolution (i.e. place removed bin from sand dunes car park to Atturm/Anstey Way footpath) to Martin Coles (EH). The Clerk further reported he received an answer phone message (1432 hours 2.12.03) from Martin Coles to the effect that the removed “doggy” bin from the Sand Dunes Car Park had been placed by the gap in the Marine Parade wall and that there was no money in the budget for the current financial year to fund the servicing of a new bin. IPC RESOLVED to ask NDDC for a doggy bin at the Atturm/Anstey Way footpath in the financial year 2004/5. (Action: The Clerk)
(c) IPC – Training Needs: - The Clerk reported he had provisionally arranged for a Planning Officer to attend IPC in February and a Planning Enforcement Officer later in the year. The Clerk suggested that he sought the attendance of NDDC’s Monitoring Officer for the March meeting for a training session on “Code of Conduct/Declaration of Interest” The Clerk then referred to a letter (dd. 5.12.03) from NDDC reference “Code of Conduct and Declaration of Interests” and which he copied to Cllrs for perusal at the meeting. After a discussion it was RESOLVED to adopt the Clerk’s suggestion. (Action: The Clerk)
(d) Beach - Sand/Wall (Marine Drive): - (i) The Clerk reported he had emailed IPC’s resolution (i.e. DCC’s strategy for the removal of the built up sand against the seawall) to Cllr Cann (24.11.03) and that as a result had received a reply from him (dd 3.12.03). The Clerk read it to Council and Cllr Cann reaffirmed the content. (ii) The Clerk also referred to an email (dd 5.12.03) and telephone call (10.12.03) he had received/had with John Beardsley (DCC) as regards the same matter. He said John Beardsley had advised him that a digger was on order to remove some of the sand but that a date for the start of the work had not been finalised. . (Noted)

(c) Email (dd 11.12.03) from Chairman TTEF concerning “Response to AONB Plan – Draft Letter”: - The Clerk provided each Cllr with a copy for their consideration. (a) Letters (dd 24.11.03) from NDDC reference the death of Mr (K) Barry Morgan (Former Assistant Chief Executive of NDDC) together with the details of his funeral: - Noted by IPC. (Noted) (b) Email (dd 21.11.03) from Nadeem Rehman of India requesting to join North Devon Cricket Club (NDCC): - The Clerk reported this was the third such email he had now received from Nadeem, on both occasions of which he had replied to the effect that IPC had no connection whatsoever with NDCC but that he had passed his details to the Club Treasurer, David Lea. The Clerk said he had reminded Nadeem of this again and suggested he write directly to the club. (Noted)
(c) Letter (dd 24.11.03) from Robert Crabb (Sports & Recreation Manager NDDC) reference “Future Beach Lifeguard Provision”: - The Clerk outlined the letter (IPC to “risk assess” its liability as regards the parts of Instow beach leased by them from the Crown Estates). The Clerk provided Cllrs with a copy together with a plan of Instow beach. The Clerk said Mr Crabb had offered to come along to the IPC Meeting of 15.1.04 to address Council (before the meeting in chief) and answer any questions. It was RESOLVED to accept Mr Crabb’s offer. (d) Letter (received 28.11.03), together with leaflets, from Environment Agency (EA) reference “Community Flood Archive Project”: -The Clerk reminded Cllrs he had copied this to them with their agenda papers (1.12.03) and that a leaflet had been placed in the Post Office for the information of parishioners .He said the EA is asking local historians, archivists and record keepers if they have any detailed information on flooding in their local area. The EA is keen to add local knowledge to its own records of river, tidal and groundwater flooding and that further information on this project can be obtained by speaking to Helen Simpson in the Flood Defence team at the Agency’s’ Exminster office on 01392 316209 or email Helen.simpson@environment-agency.gov.uk (Noted)
(e) (i) Email request (24.11.03) from Chairman of Instow and Bideford Railway Group seeking volunteers to man Signal Box on a Sunday: - The Clerk said that volunteers names should be passed to the group’s Chairman, Mr Lewis Andrews c/o Planning Department of NDDC. (Noted)
(ii) Verbal request from Mr Rob Dart (Instow and Bideford Railway Group) requesting that IIB might consider “caring” for the embankment adjacent to The Signal Box: - The Clerk said he had passed this to Peter Yeo (Chairman of IIB) by email (27.11.03) and that Mr Dart had been advised. (Noted)
(iii) Email (dd 7.1.2.03) from Felton Vowler (Bideford and Instow Railway Group) concerning Award for Signal Box, Instow: - The Clerk provided Cllrs with a copy for their information. See (iv) below. (Noted)

(f) Letter (dd 3.12.03) from NDDC reference “Application for the grant of an outdoor public entertainment licence – The Old Show Ground, Westleigh Straight, Instow, Bideford” – applicant Hector Christie and Ian Godfrey: - The Clerk appraised Council of this application which had been forwarded to IPC for information only; the site of the event is within the parish of Westleigh. (g) Letter (dd 3.12.03) from DCC reference “Interactive Speed Warning Signs in North Devon”: - The Clerk explain the tenor of the letter and completed the questionnaire attached as advised by Cllrs. (Action: The Clerk)

(o) DCC Parish Paths Partnership (PP3) Christmas Workshop, High Bullen Hotel, Chittlehamholt (10.12.03): - The Clerk confirmed he had attended with Melvyn Harris and provided a brief overview of the event. (Noted)
(p) Instow Parish Council -Website Domain & Broadband: - The Clerk spoke of IPC having its own registered website domain (i.e. “www.Instowparishcouncil.gov.uk”) and enquired if it was worthwhile him finding out more as regards annual cost for example. He also suggested that it might be worthwhile if the parish telephone line (01271 372408) was connected to “Broadband” as he had, more and more of late, to make use of the Internet to download documents/send emails. IPC RESOLVED to have the Clerk obtain more information on this and report back in due course. (Action: The Clerk)

5. MISCELLANEOUS: -
(a) Instow Welfare Trust: - The Clerk confirmed he had taken the necessary steps to close The Welfare Trust (on 21.11.03) and that he had taken possession of a cheque to the total value of £2,994.44 (included £63.10 additional interest since account’s balance last checked - £2,931.34 on 11.11.03). The Clerk further notified IPC he had forwarded the cheque, together with a photocopy of the final page of the passbook, to Mark Kidson (Trustee) for onward transmission to the “Devon Community Foundation” as soon as the expiration of the “statutory” notices the Trustees have displayed throughout the parish and provided there are no relevant objections as a result of the public “consultation”. The Clerk said he would retain the original passbook for audit purposes. (Noted)
(b) Recreation Ground: - The Clerk informed IPC he had sent an Invoice, for the payment of £25 (£1 peppercorn rent per annum for 25 years – duration of the lease), to the NDCCS (on behalf of DCC) and that he now awaited payment. (Noted)
(c) IPC Finance Sub Committee Meeting – Budget 2004/5: -
(i) IPC’s Financial/Risk Assessment Regulations: - The Clerk notified Cllrs he had circulated a copy of the amended “Financial Regulations” to them with their agenda papers (1.12.03) for perusal and that it now required ratification It was RESOLVED to adopt them and the Chairman/Clerk signed a copy. (Noted)
(ii) Car Park: - The Clerk advised IPC he had liaised with NDDC and confirmed the car park lease for 2004 to be from 1st May to end of September. He said NDDC would assist the Clerk/Handyman with the installation of the “new” machine in April 2004 once it became available. In answer to a question posed by Cllr Johns, the Clerk reassured IPC that any work carried out by NDDC on behalf of IPC would be “official” and that NDDC would be covered by their own public liability insurance. He added that any electrical work would need to be carried out by SWEB. (Noted)
(iii) New Stone Bus Shelter – Marine Parade-Atturm: - The Clerk confirmed he had liaised with John Beardsley (DCC) and Jon Turner (NDDC) and informed them that IPC was to build said shelter by the end of March 2004.He added that Mr Beardsley had been told about the “alleged” fence encroachment onto the grass verge in the vicinity of the current wooden bus shelter and, having subsequently investigated same, was to take no further action. The Clerk verified he had also told Mr Shilvock who will require plans in due course. The Chairman agreed to speak to ex Cllr Kidson. (Action: The Chairman)
(iv) Instow Website – Grant for 2003/4 and 2004/5: - The Clerk advised IPC he awaited details of the person(s) to whom this grant should be sent. He added Cllr Harper (IPC’s Webmaster) was dealing but was currently on holiday. (Noted)
(v) Xmas Charity Nominee 2003/4: - The Clerk updated IPC as to the amount of collection taken at the carol-singing event of 7.11.03. (See cheques (as at item 2) for North Devon Hospice & Children’s Hospice (South West). (Noted)
(vi) IPC – Use of Reserves: - The Clerk reminded Cllrs of this. (Noted)
(vii) Draft Budget 2004/5: - The Clerk reminded IPC that the precept for 2004/5 was not strictly the same as for current year (2003/4). Although the recorded budget for 2003/4 showed it as £5600 it had been “raised”, by resolution, at the December 2002 meeting to allow for a shortfall in the applied grants from NDDC (See item 2212/10 (5) (g)). (Noted)
(d) Parish Council Expenditure 2004/2005: - The Clerk confirmed he could now forward the appropriate return to NDDC in respect of Instow’s “Parish Grant and Precepted Expenditure 2004/2005” However, the Clerk said he wished to enquire as to whether IPC wanted to “raise” its budget 2004/5 grant application (£2 per head of population) now that the most up to date electoral roll (see item 2312/9 (iii) (j)) indicates that Instow has 718 parishioners (and not 709 as per previous electoral roll). He said this would involve a total grant request of £1436 (as opposed to £1418) made up of Burial Ground (£500), Parish Hall (£400 – maximum payment) and “Parks and Open Spaces” (£536) – Total £1436. IPC RESOLVED to raise its grant application bid as advised by the Clerk. (Action: The Clerk)
(e) Email (28.11.03) from Charity Commissioners reference “Charity Commissioners News –Issue 19” (in respect of both The Welfare and Recreation Ground Accounts: - The Clerk said he had copied this (by email) to Mr G Day (IPC’s IA) and the Trustees of The Welfare Trust. (Noted)
(f) Letter (dd 4.12.03) from NDDC reference “Supplier Payment System – Operative April 2004”: - The Clerk advised IPC of the implications of this letter – e.g. BACS payments and details of IPC’s Lloyds Business a/c provided. (Noted)
(g) Xmas 2004 Beach Clean: -The Clerk enquired as to whether IPC wished Peter Cook to give the beach a general clean-up prior to Xmas, that is, week commencing Monday 22nd December; he suggested for 6 hours. IPC RESOLVED to adopt this suggestion of the Clerk. (Action: The Clerk)

2312/11 PLANNING
(a) Letter (dd 19.11.03) from DCC reference “Town and Country Planning General Regulations – Regulation 3 – Proposed renewal of an expired consent to allow three temporary mobile classrooms to remain on site for a period of a further 5 years, at Instow Community Primary School, Instow” (Reference no. NW.02/35/36582/03): - The Clerk reported receipt on 22.11.03 and of having passed it immediately to the Chairman for the attention of the Planning Officers/Planning Sub Committee. The Clerk further reported that the application had been handed back to him by the Chairman (28.11.03) with a unanimous recommendation to approve; he said DCC had been notified by email (28.11.03). IPC RESOLVED to ratify this recommendation. (Noted)
(b) Erection of a Pergola at 6 Lane End Close, Instow (Reference no. 36506): - The Clerk reported receipt on 22.11.03 and of having passed it immediately to the Chairman for the attention of the Planning Officers/Planning Sub Committee. The Clerk further reported that the application had been handed back to him by the Chairman (28.11.03)) with a unanimous recommendation to approve; he said NDDC’s Planning Dept. had been notified (28.11.03). IPC RESOLVED to ratify this recommendation. (Noted)
(c) Extension to Dwelling and Erection of Conservatory at Gorse Hill, Instow (Reference no 36494): - The Clerk reported receipt on 22.11.03 and of having passed it immediately to the Chairman for the attention of the Planning Officers/Planning Sub Committee. (f) Extension to Dwelling at 10 Lane End Close, Instow (Reference no. 36642): - The Clerk reported receipt of this application on 1.12.03 and of having passed it immediately to the Chairman for the attention of IPC’s Planning Officers/Planning Sub Committee. The Chairman and a Planning Officer then led IPC in a discussion at the conclusion of which it was unanimously RESOLVED to recommend approval – Clerk to advise NDDC. (Action: The Clerk)

(h) Outline application for Erection of Bungalow at All Saints Chapel, Anstey Way, Instow (Reference no. 36690): - The Clerk reported receipt of this application on 8.12.03 and of having passed it immediately to the Chairman for the attention of IPC’s Planning Officers/Planning Sub Committee. After discussion led by the Chairman and a Planning Officer IPC RESOLVED unanimously to recommend approval – Clerk to advise NDDC. (Action: The Clerk)
