In a subsequent report received (10.12.10) from PCSO Meaker it was noted that
one crime (theft on Instow Beach) had been reported in the parish since the
last meeting and that 9 other matters had been the subject of an incident log
namely, public safety/concern for safety (x3), anti social behaviour (x1),
admin/lost and found (x1), transport/highways disruption (x2), pubic
safety/sudden death (x1) and crime related/violence (x1). (Noted)

2012/6 REPORT COUNTY COUNCILLOR R CANN
(a) Instow – Residents Parking Survey: -
Cllr Cann apologised for the delay in getting the appropriate paperwork to the
Editor of the parish magazine; he said the responsible DCC Officer had been on
leave but that it was now to hand and ready for delivery. Cllr Cann agreed to
deal with the necessary arrangements. (Action: Cllr Cann)
(b) General: -
Cllr Cann spoke of “Free Online Family History – DCC Records Office” (more
information can be found on www.devon.gov.uk/dro or by use of email address
devrec@devon.gov.uk), “DCC Biosphere Resurvey Grant” (£35K grant has been
awarded to ND Biosphere Reserve Foundation), “Rural Health and Wellbeing Plan”
(this is a NHS Devon strategy to improve the health and wellbeing of people
living in rural areas of Devon), “Surface Water Flooding Issues” (a scheme
will be prepared to deal with flooding issues in the Down Road area although
it is questionable as to its success in the current financial climate),
“Recycling – Don’t Let Devon go to Waste” (Devon has a recycling rate of
52.62%; this is the 2nd best county in England) and “Westleigh Junction”
(Bideford Town Council has been critical of the proposals; the light system is
the only proposal that is currently affordable. (Noted)
(c) Thanks to Cllr Cann (DCC): -
Cllr Cook complimented Cllr Cann on getting all the highways issues requested
at the last meeting done. (Noted)
2012/7 REPORT OF DISTRICT COUNCILLOR B MOORES
a) General: -
Cllr Moores spoke of “Charter Toilets – Quay Car Park” (an agenda item),
“Management of the Quay Car Park, Instow” (an agenda item), “Ransom Strip
Project – Children’s Play Area” (an agenda item), “Planning – The Sands” (this
was progressing very slowly), “Planning - 5 Chichester Close” (appeal hearing
on 7th November – dismissed), “Planning – Beehive Cottage” (site meeting held
with planning officer), “Comprehensive Spending Review” (NDC still awaiting
government announcement before budgets can be finalised) and “Help for Rough
Sleepers – Severe Weather” (NDC working in partnership with Freedom Social
Projects). (Noted)

It was RESOLVED that the November 2010 minutes of Instow Parish Council be

2012/9 MATTERS ARISING FROM THE MINUTES
a) Item 2011/6 (b) and 2011/9 (a) - Traffic Management Issues: -

b) Item 2011/9 (b) – Management of Quay Car Park: -
(i) The Chairman reported on his attendance at a meeting of the “Ransom Strip
Steering Group” (NDC/DCC & IPC) that was held at 10 am on Wednesday 24th
November at the Civic Centre; the Clerk (sickness) and Cllrs Mrs Dipper/Thomas
(last minute unavailability) did not attend. (Noted)
(ii) The Chairman said he found the meeting to be most disappointing in that
certain NDC Cllrs present were obviously of a mind to renege on their
predecessors “ransom strip” agreement with IPC, stating that said monies had
already been used on the new charter toilets opposite the sand dunes car park
entrance; this, he said, was despite the fact NDC Cllrs and Officers had been
in regular liaison with IPC since the build of said toilets with a view to
identifying community projects to spend the “ransom strip” monies (£72,000)
on. He added that in his view little had been achieved as a result of the
meeting, in fact, the issue had regressed. (Noted)
(iii) Cllr Moores (NDC), in defending NDC’s stance. said he did not see it
this way adding that it was clearly minuted by NDC at the time that the
current charter toilets had been built with said (ransom strip) monies and the
money was not, therefore, still available to spend. (Noted)
(iv) Cllr Cann (DCC/NDC) said that he agreed, in hindsight, that the “ransom
strip” monies had been used on the charter toilet project but that this was
not “obvious” to him at that time and that in his view NDC had an obligation
to recompense IPC for this regrettable breakdown in communications. (Noted)
(v) The Clerk said he regretted not being at the meeting of the 24th November
because as far as he was concerned this “stance” of NDC was a total u-turn
from what had been agreed at the previous meeting; he read from the minutes of
the previous meeting that he said had been immediately circulated to all
attendees and not one person(s), Cllr or Officer, had come back to him to
state they were incorrect. (Noted)
(vi) Cllr Moores (NDC) refuted this by saying the interpretation of the
previous minutes depended on how they were read. (Noted) (vii) A lengthy
discussion then ensued following which it was RESOLVED that the Clerk should
communicate with the Chief Executive of NDC and through him express IPC’s
great displeasure at NDC’s current “ransom strip” stance that did not seem
particularly fair or rational as far as IPC was concerned. (Action: The Clerk)
c) Item 2011/9 (c) – Sand Dune Management/Sand on Highway : -
(i) The Clerk reported that the forwarding of a letter of thanks to the OC at
Atturm was still in hand; he explained the reasons for the delay. (Noted)
(ii) The Clerk reported that four responses had now been received to the Andy
Bell “Dunes – Research and Options” paper that had been published on the
Instow website and referred to in the parish magazine. They were as follows: -
a) TTEF: – Agree that the solution proposed looks to be the best way forward
(email dd 24.11.10 refers).
b) IIB: - Agrees that solution proposed makes sense but with provisos; the
Clerk elaborated (email dd 24.11.10) refers).
c) A Parishioner: - Provided a combined written response from residents
(details provided) who were directly affected albeit each had been encouraged
to respond independently. Copy of response provided to Cllrs at the meeting.
d) Email (dd 9.12.10) from Catherine St Ville BSc (Phys. Geog), MA (Ed),
NPQH,FRGS: - Concurs with view of parishioner as at c) above; copy of response
provided to Cllrs at the meeting. (Noted)
(iii) A discussion then ensued at the conclusion of which IPC RESOLVED to
re-affirm its previous view to support preferred option 2. (Noted)
(iv) The Clerk suggested that all responses to the public consultation now be
passed to Andy Bell (NDCCS) with a recommendation that a Steering Group was
formed to decide the way forward. The Clerk recommended that this group
consisted of DCC (Cllr Cann - Chairman), DCE, NDC (an appropriate Officer) and
EA with the Clerk representing IPC as an observer and interested party.

d) Item 2011/9 (d) - Village Gateway Initiative: -
(i) The Clerk reported he had forwarded (21.11.10) to DCC two copies of the
signed “Draft Agreement” and “Conditions” with a breakdown/invoice of the
costs incurred by IPC to date (£1,073.02) . (Noted)
(ii) The Clerk reported that payment of the invoice was still awaited. (Noted)
(iii) The Clerk reported receipt of an email (dd 7.12.10) from DCC stating
that the agreement had now been signed by DCC (copy will be forwarded asap –
in fact received 9.12.10) and that the DCC nominated Officer was Ali Boyd; it
added that the grant was payable following completion of the works. (Noted)
(iv) The Clerk advised IPC that he had replied to the effect that IPC would
appreciate payment now for its current expenditure irrespective of further
costs; he said he had copied it to Cllr Cann. (Noted)
(v) The Clerk reported receipt of a further email from DCC (dd 9.12.10)
stating it was prepared to pay £800 and that it would forward this soonest.

(v) The Clerk advised IPC he had now obtained a number of pictures of a DUKW
and was in liaison with SW Signs with a view to it preparing a transfer to
replace the existing ones on the current Instow signs on Anstey Way. (Noted)
e) Item 2011/9 (e) – Ransom Strip Projects Children’s Play Area etc): -
(i) Cllr Cann advised IPC that he had liaised with NDC’s Planning Dept as
regards planning requirements; he said it all depended upon the exact
dimensions of any play area concept as to whether planning permission was
required or not. (Noted)
(ii) The Clerk confirmed that the agreed “parishioner consultation” Play Area
article had been forwarded to the Editor of the parish magazine and should now
appear in the next edition. (Noted)
f) Item 2011/9 (f) – Revised Bathing Water Directives: -
(i) The Clerk confirmed that as a result of an email (dd 22.11.10) from Cllr
Green reference “Beach Controller Obligations – Signs” he had forwarded an
email (dd 23.11.10) to Defra requesting that it clarify IPC’s concerns as
regards signage. (Noted)
(ii) The Clerk reported receipt of a reply email (dd 23.11.10) from Defra that
he said he had passed to Cllr Green; Cllr Green addressed IPC. (Noted)
(iii) The Clerk advised IPC that Cllr Green had prepared a draft article for
inclusion in the parish magazine; a copy was circulated to Cllrs to peruse at
the conclusion of which, apart from a few minor amendments, IPC RESOLVED to
approve it.

(iv) The Clerk then referred to an article in The Journal (25.11.10) reference
“Instow Fails over Bathing Waters”; he said he had provided a copy to Cllrs

g) Item 2011/9 (g) – New Charter Toilets/Quay Car Park: -
(i) The Chairman reported on his attendance at a meeting of the “Ransom Strip
Steering Group” (NDC/DCC & IPC) that was held at 10 am on Wednesday 24th
November at the Civic Centre; the Clerk (sickness) and Cllrs Mrs Dipper/Thomas

h) Item 2011/10 (i) (f) - Flooding – Marine Parade and Anstey Way/Down Road:-
(i) The Clerk advised IPC that he was aware that DCC (Local Services Supt) was
fully exploring the drainage system that deals with Down Road (across Tarka
Trail) but that any draft report would not be ready for a week or so; see also
item 2012/6 (b) (Noted)
(ii) The Clerk also advised IPC that he had been told by DCC (Local Services
Supt) that he had been authorised to clear out the drain culverts on the beach
so as to improve drainage from Marine Parade especially by the Boathouse Bus
Shelter. It was said that this had been done. (Noted)
(iii) The Clerk then referred to an email (dd 7.12.10) from parishioners
reference “Instow Beach – Blocked Drains”; the Clerk advised IPC that he had
passed this matter on for the attention of Cllr Cann (DCC) and the DCC Local
Services Supt and that the parishioners had been updated. He added that Cllr
Cann had agreed to speak to the parishioners. (Action: Cllr Cann)
i) Item 2011/10 (i) (g) - Parish Carol Singing Event 12th December 2010: -
(i) The Clerk reported he had done all appropriate liaison with the Commodore,
Parish Hall, WI and PCC as regards this event and that all was in hand.

(ii) IPC then discussed the provision of mince pies, preparation of mulled
wine, hospitality, collectors etc. (Noted)
j) Presentation prior to IPC Meeting of 18.11.10 - Affordable Housing in
Parish: -
The Clerk advised IPC that Cllr Harper had met with Colin Savage (Rural
Housing Enabler – Exmoor, North Devon and West Somerset) as arranged on Friday
26th November and that various sites within the village had been visited; the
Clerk elaborated. (Noted)
2012/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (received 25.11.10) and “Democracy Pack” from South West Conference
of Local Councils Associations (SWCLCA) : -
(i) The Clerk said that with the impending local elections (May 2011) in mind
SWCLCA had provided this pack with a view that IPC might wish to raise
awareness (through the local media, advertisements etc) of everyone in the
community as to the importance of voting and in turn encourage many to stand
as Cllrs. (Noted)
(ii) After a discussion IPC RESOLVED to have Cllr Green examine the pack and
come back to the next meeting with recommendations. (Action: Cllr Green)

(i) The Clerk said this stated that DCC’s new PTL policy (that it consulted on
in June 2010) was implemented on the 3rd December and if further comments were

(ii) The Clerk said he had forwarded a copy of the letter to Cllrs (2.12.10)
with their agenda papers. (Noted)

The Clerk advised IPC that the number of parishioners had risen to 650 (734 in

both applicants on the basis that although the flood defence gates were the
property of IPC, the access and beach within were the property of DCE and that
it was really up to it as to who had or did not have keys and therefore access

(ii) After a discussion IPC RESOLVED to re-affirm its decision to invest
£10,000 from its business account into a Lloyds TSB High Interest Account for
a 2-year period; it noted that the interest rates were still 2.6%. (Action:

(i) The Clerk confirmed that the agreed figures (£1,264.00 Grant and £8,748.00

(ii) The Clerk advised IPC that the current electoral roll (see correspondence
– item 2012/10 (i) (d)) stated that Instow now had an ”electoral” population
of 650 but that the annual (2011/12) grant request (as above - i.e. £2 per
head of population) had been based on the previous electoral roll that stated

(iii) The Clerk suggested that he make an amended request of NDC to raise the
applied grant of £1264.00 to £1300.00. After a discussion IPC RESOLVED to
support this suggestion. (Action: The Clerk)
(e) DCC P3 Footpath Inspection 2010/11 - P3 Claim for 2011/12:-
(i) The Clerk reported that the necessary forms had been received and he would
attend to them as soon as possible together with the handyman. (Noted)
(ii) The Clerk reported that he was to attend a P3 Xmas Workshop at Merton on
10.12.10 with the handyman and that he would provide a report at the January
2011 meeting. (Noted)
(f) Letter (dd 12.11.10) from O J Williams reference “New EU Legislation:
Composition of Gasoil”: -
(i) The Clerk said this stated that from 1.1.11 a new European directive would
apply to the grade of gasoil that could be used in off-road vehicles. (Noted)
(ii) The Clerk advised IPC that the beach cleaner had checked with O J
Williams and the only effect on IPC would be that its fuel would cost an extra
1p per litre. (Noted)
(g) Letter (dd 22.11.10) from NDC reference “North Devon Off-Street Parking
Places Order”: -
The Clerk said this stated that in view of the fact IPC had not advised NDC of
car parking regulation changes and/or tariff increases/decreases it was now
not possible to implement any such changes; he said it referred to a previous
letter sent by NDC (dd 19.3.10). (Noted)
(h) Letter (dd November 2010) from HM Revenue and Customs reference “Notice to
File Online”:-
The Clerk said this stated that as IPC had less than 50 employees it would be
necessary for the 2010/2011 tax year to file the Employers Annual Return (P35
and P14’s) online by the 19th May and that penalties may be charged if this
was not done. The Clerk said he had noted this and would deal accordingly.

- The Clerk reported that following telephone calls to the Barnstaple and
Exeter Offices of SWH Ltd (8.12.10) he had ascertained that the original
cheque number 000585 – issued October 2010 had been received by the Barnstaple
Office (on or about 22.10.10) and had been forwarded to Exeter and somehow, in
between, gone astray. He added that the relevant cheque had been cancelled

(ii) Following a discussion it was RESOLVED that although this site was not
within the parish of Instow, it would be overlooked by part of the parish and
that Council would wish, therefore, to attend a site meeting; Clerk to

2012/13 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
The Heron/Egret Statuette – Grass Verge, Anstey Way: -
The Chairman said he had attended the recent WI tree planting ceremony (Grass
Verge, Anstey Way) and had learnt that the Heron/Egret Statuette at that
location was to be removed and not replaced. He said many of the WI members
present were keen to see the statue replaced and he asked whether IPC might be
in a position to support this view. After a discussion it was RESOLVED to
enquire of IIB, who had placed the statue there, what were their intentions
and had they any idea what it might cost to replace it. (Action: The Clerk)
