2112/4 POLICE REPORT
PCSO Meaker reported as follows: -
a) Crime: -
(i) 2 crimes had been reported in the parish since the last meeting, namely, criminal damage to a vehicle and burglary and theft. (Noted)
(ii) In answer to a question from Cllr Crombie, PCSO Maker agreed that the burglary and theft referred to above was at the North Devon Cricket Club; a discussion ensued. (Noted)
b) Other Matters: -
2 other incidents had been made the subject of an incident log since the last meeting, namely, Public Safety/Suspicious Circumstances/Insecure Premises/Vehicle (x1) and Public Safety/Missing person (x1). (Noted)

2112/5 PARISHIONERS
Timing of Parishioner Speaking Time: -
A parishioner enquired why parishioner’s speaking time was at the beginning of the meeting as she felt it would be better at the end. The Chairman advised her that a parishioner could speak at any time during the meeting, with his permission and that in any case, many decisions would have been taken by the time at which parishioners could speak. (Noted)

2112/6 REPORT COUNTY COUNCILLOR R CANN
(i) General: -
Cllr Cann spoke of “Weeds on Highway” (investigating use of locality budget to provide funding supervision to enable the probation service to undertake a week’s weed pulling in Fremington Rural), “Management of Sand” (all members of the Invest2Save panel have approved the scheme as detailed in the costings; the budget is available until the end of the financial year - £10,000 has been made available), “Fremington Quay” (a desk calendar has been produced to mark the 20th anniversary of this project & some funding has been secured from the Heritage Lottery Fund, a proportion of which is to be spent on this site - the remainder on the Tarka Trail), “Westleigh Junction” (work is now complete; lights were switched on yesterday – exceeded expectation), “Marine Parade” (this road has been included in the list of potential sites for non principal road recovery programme and will be assessed for priority against the other schemes when the budget is set next year) (Noted)
(ii) Road Signs: -
Cllr Cook said he had been asked by a parishioner to enquire why, in this age of austerity, DCC were erecting new road signs when it appeared that the current signs were more than adequate. Cllr Cann said he would have to enquire and report back. (Action: Cllr Cann)
(iii) Quay Car Park – No Parking Signs: -
Cllr Cann was asked why “No Parking” signs had been erected on the boat park barriers thereby precluding car parking on the only remaining part of the car park and in total contrast to previous years. Cllr Cann said he was unaware of the reason and would have to report back. (Action: Cllr Cann)
(iv) Signs Blocking Pavements: -
A discussion then ensued on the blocking of the pavement by advertising signs in the vicinity of the shops. Cllr Cann said this was illegal although he was sure it was only a short term problem leading up to the Xmas period. (Noted)

2112/7 REPORT OF DISTRICT COUNCILLOR B MOORES
Cllr Moores spoke of”The Sands” (no new developments), “1-4 Kiln Close Lane – Application 50588” (No new developments), “Winter Help for the Homeless” (arrangements in hand for emergency accommodation/food; last year 37 individuals made use of this service), “Get Help to Insulate your Home this Winter” (contact Energy Saving Trust for advise on 0800 512012/ask about CosyDevon or visit www.cosydevon.co.uk), “Council Concern over Funding for Rural Services” (concern over recent government report which shows that local government budget cuts will hit rural communities hard and disadvantage many residents), ”Parking Boost for North Devon Shoppers this Christmas” (free parking in some of North Devon’s car parks will be offered in the run up to Xmas; charges will be suspended between 2pm and 6pm from Thursday 15th December to Saturday 17th December and again from Thursday 22nd December to Saturday 24th December), “Residents asked to Help Clean Up Foul Practices” (NDC is asking local people to help identify those responsible for dog fouling and to provide descriptions, names or addresses of culprits so that action can be taken against them) and “Working Together – Shared Services” (NDC/TDC are working together and sharing services for the future). (Noted)

2112/8 MINUTES
(i) It was RESOLVED that the November 2011 minutes of Instow Parish Council be approved and signed. (Noted)
2112/9 MATTERS ARISING FROM THE MINUTES
a) Items 2111/9 (b) – “Instow “Grot Spots” – S 215 Town and Country Planning Act 1990”:-
(i) Cllr Moores reported as follows: -
(a) Items 8 and 9 (Methodist Chapel and Old Gas Gateway); discussion are on-going with NDC Planning. (Action: Cllr Moores)
(b) Items 1 and 4 (Chalet opposite Picnic Area (Tarka Trail) and Gate Barrier at Sand Hills); the planned meeting with DCE was cancelled by its Chief Executive but it was hoped to have more information to report upon by the next meeting. (Action: Cllr Moores)
(c) Items 3 (Victorian Lamppost); following liaison with NDC’s Conservation Officer it had been established that no planning permission was required to repair this lamppost and local enquires were on-going. (Action: Cllr Moores)
(d) Item 6 and 7 (Guttering on Garages and Broken Wall in Quay Car Park); these matters had been noted by NDC Car Parks Dept and action was in hand to have them repaired and for external decoration of the garages. (Noted)
(ii) Cllr Green said the Clerk reported as follows: -
Item 10 (Signal Box Communication Post/Apparatus) i.e. further liaison had taken place with the Chairman of the BIRG (emails of 25.11.11 refers) who was seeking a grant(s) to enable the BIRG to get the signals painted (NDCCS has agreed to provide the paint) at which time it will be necessary to hire in a cherry picker which can then be used to tidy up the communications post/apparatus. (Noted)
b) Item 2111/9 (c) – “Management of Quay Car Park/Refurbishment of Toilets”: -
(i) Cllr Cann told IPC that NDC’s Executive was not now to discuss this matter until its January 2012 meeting adding that the offer had never gone to Executive at any time since the offer was originally made (it was made when the Executive was led by Conservative members – it is now led by the Liberal Democrats/Independents) and that it was quite natural, therefore, for the current incumbents to consider the offer from its perspective. He added that he would report further at the next meeting of IPC.
(Action: Cllr Cann)
(ii) Cllrs declared their displeasure at the on-going uncertainty and hoped that a satisfactory conclusion could be achieved without undue delay. (Noted)
c) Item 2111/9 (d) – “Revised Bathing Water Directives”: -
(i) Cllr Green said the Clerk advised that the matters outstanding were: -
(a) EU Directive Signs – Bathing Water Season 2012: -
Cllr Green said this matter was in hand and that he, together with Cllr Harper and the Clerk would be drawing up a draft proposal for consideration by IPC at its Meeting of 19th January 2012 based on the format recommended by Defra/EA.
(Action: Cllrs Green/Harper and The Clerk)
(b) IPC Publication (“Position Statement”) Article: -
(i) Cllr Green said a copy of a draft article (approved by EA and Cllrs Green/Harper) had been provided to Cllrs with their agenda papers; after a discussion IPC RESOLVED to support it. (Noted)
(ii) Cllr Green said that the EA had suggested that this document, referred to by it as a “Position Statement”, could be published in the Parish Magazine if IPC felt this would be useful; after a discussion IPC RESOLVED to agree to this although it was undecided when this should take place – for further discussion.
(Action: IPC)
(iii) Cllr Green said the EA’s current view on producing a “flier” as a separate piece of work (that they would co-author) was that it would be a different product from the “Position Statement” and that the EA would be able to find some funds to help with this process. However, the EA were planning a lot of media/public focused information about the revised bathing water directive that would be rolled out over the coming months. Cllr Green added that the EA felt that this was not quite the time for a pro-active “flier” type communication; it believed this would be more useful when the EA/IPC had something new to promote for the area, e.g. after the EA has done some cost benefit analysis work for Instow bathing water and had undertaken further engagement with the local community. (iv) Cllr Green said that finally, the EA suggested that if IPC felt the “Position Statement” was worthy of producing/distributing as a flier then IPC could do so in a manner that was going to “market” the positives of Instow as a recreational beach with a number of glossy photographs being included. After a discussion IPC RESOLVED to adopt this idea with a view to producing a leaflet by Easter 2012. (Action: IPC)
(ii) Cllr Green said the Clerk reported receipt of an email (dd 21.11.11) from Defra reference “Bathing Water Directive Results and Projected BWD Classifications”; it had been copied to Cllrs Green and Harper. (Noted)
d) Item 2111/9 (e) – “Salt/Grit Bins/Community Clusters”: -
(i) Cllr Thomas (now IPC’s Lead Snow Warden) reported that he and Cllrs Cook/Harper had attended a Snow Warden training day (24.11.11). (Noted)
(ii) Cllr Green said the Clerk reported receipt of a series of emails (24/25.11.11) from Cllrs Harper, Thomas and Cann (DCC) reference “Snow Warden Training/Activity” and that it would seem that the following issues required clarification/explanation/noting: -
(a) How much sand/grit does IPC wish to have delivered?
Cllr Green said the Clerk had advised that 5 tonnes in 25kg bags had been ordered by Cllr Thomas for delivery to Barton Farm, Instow. (Noted)
(b) Clarification as regards insurance should snow wardens have an accident in their vehicle or incur injuries or damage property owned by a third party.
(i) Cllr Green said the Clerk advised that this has now more or less been resolved in an email (dd 29.11.11) from County Hall that had been copied on to Cllrs Thomas and Harper. (Noted)
(ii) Cllr Green said the Clerk reported that SWs’ should be advised to contact their own insurance company with regard to their SW activity if they decided to use their own motor vehicles. IPC RESOLVED to support this recommendation. (Noted)
(iii) Following discussion it was RESOLVED that the most expedient way of distributing salt/grit around the village was for Cllr Cook to do so using IPC’s tractor and then SWs’ and volunteers could spread it as necessary. (Noted) (iv) After a discussion IPC RESOLVED in principle to the provision and funding of a suitable box to affix to IPC’s tractor so as to enable the transhipment of bags of salt/grit around the village; Cllr Cook was asked to obtain a quote for a box. (Action: Cllr Cook)
(c) Informing Parishioners.
Cllr Thomas agreed to draft an article for the parish magazine to explain the SW arrangement and offered to respond to queries from parishioners. IPC RESOLVED to support this recommendation. (Action: Cllr Thomas)
(d) Does IPC wish to buy any sand/grit boxes (each cost £300 including a fill of salt/grit) and if so where does it wish them to be positioned?
Cllr Green said the Clerk had advised that DCC would need to give permission for the location(s) of any bins. IPC RESOLVED not to seek to buy any additional salt/grit bins. (Noted)
(e) Use of Red Diesel
Cllr Green said that the Clerk had advised that no vehicle used must be filled with red diesel albeit that a further explanation had been given in this regard (see email (dd 29.11.11) although it appeared somewhat ambiguous. It was noted that IPC’s tractor does not use red diesel. (Noted)
(f) Should IPC seek other “street” snow wardens by current SW and Cllrs “knocking on doors” and recruiting them?
IPC RESOLVED not to adopt this course of action. (Noted)
(iii) Cllr Green said that Cllr Harper had advised the Clerk that in view of the SW initiative IPC’s Self Help Emergency Plan needed updating. IPC RESOLVED to adopt this course of action. (Action: Cllr Harper)
(iv) Cllr Green said the Clerk reported receipt of an email (dd 7.12.11) from DCC (Emergency Planning Officer) reference “Emergency Planning Newsletter – December 2011” and attachment (DCC Leaflet entitled “Travelling in Winter 2011/2012”); it had been copied to Cllrs with email addresses and a copy of the leaflet had been provided to Cllr Thomas (IPC’s Lead Snow Warden). e) Item 2111/9 (h) – “Sand on the Highway/Marine Parade, Instow”: -
(i) Cllr Green said the Clerk reported receipt of an email (dd 23.11.11) and attachment from NDCCS reference “Beach Management Proposals – Instow”; this stated that the attached document brief was regarding the beach and dune stabilisation at Instow for which DCC had funds available but required that IPC (together with DCE, NDC and Natural England) agreed with the proposed work. (Noted)
(ii) Cllr Green added that the Clerk also reported that said email and attachment had been forwarded by him to all Cllrs with email addresses (24.11.11) with a view to each advising him of their view so that a democratic response could be made on behalf of IPC by 29th November. (Noted)
(iii) Cllr Green said the Clerk reported that in view of the fact 7 Cllrs had got back to him in support of the proposal he emailed Andy Bell (dd 29.11.11) and advised him accordingly. (Noted)
(iv) Cllr Green said the Clerk further reported receipt of an email (dd 29.11.11) from Cllr Moores (NDC/IPC) stating that he was now in agreement with the “slightly amended proposal” i.e. “to promote the dunes westward and not southward thus reducing the build up of sand on the end of the dunes and above the wall”. (iv) Cllr Green told IPC that the Clerk advised Council he had not been advised of any amendments by Andy Bell. (Noted)
(v) After a discussion IPC RESOLVED to ratify the decision as at item (iii) above.

f) Item 2111/10 (i) (a) – “Parish Carol Singing Event - 11th December 2011”: -
A discussion ensued as regards the arrangements for this event i.e. minces pies, mulled wine, collection etc. (Noted)

(i) Cllr Green said this stated that an application had been made to collect in the parish of Instow, one day a month from 1st January 2012 to 15th November 2012. (Noted)
(ii) Cllr Green said the Clerk advised Council that he had replied to NDC to the effect that IPC would not be in favour of granting this licence on the basis it would seem that not all monies collected would go to the registered charity (Cancer Recovery Foundation UK) in that another organisation (UK Export Trade Ltd) was doing the collecting for them and would undoubtedly be taking part of the monies so collected by way of a commercial agreement and that the day per month was not defined; Cllr Green said NDC had been advised by email 25.11.11. (b) “Marine Car Park, Instow – Alteration to Signage/New Machine”: -
(i) Cllr Green said the Clerk advised he was still chasing this information; new signs not required until at least 1.4.12. (Noted)
(ii) Cllr Green said the Clerk advised that the new car park machine was still awaited from Metric. (Noted)
(c) Letter (dd 24.10.11) from Leader of NDC reference “Parish Grants Review Consultation” : -
(i) Cllr Green said the Clerk confirmed he had written, as instructed, a letter (dd 20.11.11) to the Leader of NDC objecting to this review; a copy of the letter was provided to Cllrs with their agenda papers. A discussion ensued (Noted)
(ii) Cllr Cann said it was hoped to introduce a “de minimus” system that would be fairer to all regardless of size of population. (Noted)
(d) IPC’s Child Protection Policy: -
Cllr Green said the Clerk confirmed that a copy of this document had been provided to the new handypersons, Brian Keane, and grass cutting contractor, Dave Budd. (Noted)
(e) Use of Quay Car Park Post Transfer of Freehold by NDC: -
(i) Cllr Green said this issue had been brought forward from the previous meeting at the instigation of Cllr Johns. (Noted)
(ii) A discussion then ensued during which Cllr Johns proposed that following the transfer of ownership, a sub committee should be formed to meet Instow Marine and to consider the use of the car park in the winter months in the light of their requirements. It was RESOLVED to defer the matter again to the January 2012 meeting. (Noted)
(iii) Clerk’s Note: - currently it has been agreed by IPC to open the Quay Car Park as of 1.4.12 subject to the transfer of the freehold by NDC having been completed by then. (Noted)
(iv) Clerk’s Note: - currently IPC has resolved to open the car park for a 6 month period (from 1.4.12 – 30.9.12) and to offer the period 1.10.12 to 31.3.13 to Instow Marine to use part of the car park as a boat park at a fee of at least £1,500; obviously now subject to discussions as at item (i) and (ii) above. (Noted)
(f) Parish Handypersons and Beach Cleaner Terms of Reference 2012/13: -
(i) Cllr Green said the Clerk advised that these would be served at a suitable time in the New Year. (Noted)
(ii) Cllr Green said the Clerk confirmed that Brian Keane (Handyperson) was now responsible for the P3 works (footpaths). (Noted) (g) Draft Budget 2012/2013: -
(i) Cllr Green said the Clerk advised IPC he had added, as was agreed at the last meeting, £1,200.00 additional income to the Car Park Takings for 2012/13 (making it a total of £15,700.00) and to balance “Income over Expenditure” had added £6 to “Local Elections” within Expenditure (Now £106); Cllr Green said the budget now balanced - £31,818 income and £31,818 expenditure. (Noted)
(ii) Cllr Green said a copy of the amended budget had been provided to Cllrs with their agenda papers. (Noted)
(iii) After a formal discussion IPC RESOLVED to approve the amended budget a copy of which is attached to these minutes as at appendix “A”. (Noted)
(h) Grass Cutting Contract 2012-2015: -

(m) Outgoing Handyperson – Mr Mel Harris “Parish Collection”: -
(i) Cllr Green said the Clerk advised IPC that £50.24 had been collected in the collecting box left at John’s Shop and that this had been converted into a £50 gift voucher at Screwfix with the odd 24p being placed in a charity box. (Noted) (ii) Cllr Green advised IPC that the Clerk was to ensure that a letter of thanks was placed in a forthcoming parish magazine either by him or Mel Harris. (Noted)

b) Residential development of 277 dwellings with associated public space, affordable housing, recreational facilities, landscaping and access following the demolition of existing buildings and the refurbishment of 2 former military buildings for community uses at Former Fremington Army camp, Fremington, Barnstaple (Reference No 53147) : -
(i) Cllr Green reported receipt (dd 30.11.11) of this application and of it having been posted (30.11.11) to the Chairman for the attention of IPC’s PSC; for response by 19.12.11 or an extension to be applied for. (Noted)
(ii) Cllr Green confirmed that an entry had been placed on the Instow website for the information of parishioners. (Noted)
(iii) After a discussion IPC RESOLVED to respond as follows: -
“Instow Parish Council discussed this application at its meeting of Thursday 8th December and whilst there was a general consensus to recommend approval there were concerns about: -
 Increase in traffic along Anstey Way, Instow
 Potential use of illegal access to Holmacott Tip by way of New Road, Instow
 Traffic congestion brought about by the use of Traffic Lights at the entrance to the site
 Access to the site very narrow and unsuitable for heavy traffic usage”.
