MINUTES OF THE FEBRUARY 2012 MEETING OF INSTOW PARISH COUNCIL

Present: - Councillors P Cook, N Crombie, A Johns, C Harper, B Moores, E Renshaw, B Thomas, S White (Chairman) and the Clerk

In Attendance: Cllr R Cann (DCC), Cllr B Moores (NDC) and 1 parishioner.

PRAYER
Prior to the commencement of the meeting the Clerk led Council in Prayer; it was stressed that to participate was purely optional. All persons present remained.

2202/1 OPENING OF THE MEETING
The meeting was declared open by the Clerk

2202/2 APOLOGIES

2202/3 COUNCILLOR DECLARATION OF INTERESTS
(i) Cllr Cook declared a pecuniary interest on item 2202/5 (ii)) – Cleaning of the Beach”. (Noted)

2202/4 POLICE REPORT
In the absence of the police the Clerk read from a report that had been provided: -
a) Crime: -
(i) 2 crimes had been reported in the parish since the last meeting, namely, “Common Assault and Battery” (x 1) and “Theft – Non Specific” (x 1). (Noted)
b) Other Matters: -
5 other incidents had been made the subject of an incident log since the last meeting, namely, “Public Safety/Animal/Wildlife” (x 1), “Public Safety/Suspicious Circumstances/Insecure Premises” (x 1), “Anti Social Behaviour/ASB Environmental/Civil Dispute” (x 1), Anti Social Behaviour/ASB Nuisance/Domestic Related” (x 1) and “Public Safety/Domestic Incident” (x 1). 2202/5 PARISHIONERS
(i) Parishioner Speaking Time: -
(a) A parishioner enquired whether questions could be asked or points made by parishioners other than at this point in the meeting. (Noted)
(b) The Chairman explained that the Council’s Standing Orders allowed for parishioners to speak at any time during the meeting at his discretion. (Noted)
(ii) Beach Cleaning: -
(i) A parishioner enquired why IPC, as a Quality Parish Council, did not remove waste material from the beach during the summer season; she said the current strategy did not appear to be a process that provided “value for money”. She spoke of plastic waste being left in and around the Quay that she had noted during a beach clean by the local “Adopt a Beach” (ABG) group and of waste being dragged to the other end of the beach and then being washed back again on the next tide. (Noted)
(ii) The Clerk explained that in the past the ABG had asked that the beach not be cleaned between the Quay and the Commodore prior to its visit to ensure “rubbish”, hopefully identifiable, could be found and that it had not been practical, primarily for expense reasons, to collect and dispose of all the waste. (Noted)
(iii) After a discussion it was RESOLVED that the Clerk would confer with other private beach owners in the area and organisations with an interest, such as the NDCCS, and report back to the next meeting. (Action: The Clerk)

2202/6 REPORT COUNTY COUNCILLOR R CANN
(i) General: -
Cllr Cann spoke of “Marine Parade – Weeds” (he was endeavouring to identify a contractor and funds to deal with this long standing issue – see item 2202/10 (i) (h)), “Environment Seminar” (he recently chaired a seminar attended by more than 60 Cllrs, business leaders and environment experts to address the environmental issues facing North Devon), “Atlantic Array” (DCC has set up a Joint Member Steering Group with three members from TDC, NDC and DCC to review the proposal/impact on the area – he had been appointed to the committee), “ “Westleigh Junction” (favourable comments were still being received), “Tews Lane Sports Field – Fremington” (NDC, who own this site, has dedicated it in celebration of the Queen’s Diamond Jubilee – it will now be called “The Queen Elizabeth II Playing Fields, Tews Lane), “DCC Council Tax – Zero Increase” (he ran through the additions to the DCC base budget that could well include funds for limited weed control and £10,000 for his ward”, “Instow Marine Car Park – IPC) (this has now been formalised by a 99 year lease etc – see item 2202/9 (c)) and “Instow Dunes Management” (this £10,000 DCC scheme was to reduce the amount of sand building up on the beach and spilling on the highway; a good example of “Biosphere Thinking - Good for us and good for the Environment). (Noted)
(ii) Instow Marine Car Park: -
The Chairman thanked Cllr Cann for all he had done in securing this excellent deal for Instow. (Noted)

2202/7 REPORT OF DISTRICT COUNCILLOR B MOORES
(i) General: -
Cllr Moores spoke of “The Sands Development” (he was continuing to press NDC Planning to resolve this issue soonest), “1-4 Kiln Close, Lane, Instow” (work was still in progress), “North Devon Council Tax” ( there would be no increase in 2012/13 – all other charges, such as car parking, would remain the same) and “Agents Shortlisted to Develop Barnstaple Key Sites” (namely Queen Street, Bear Street and Seven Brethren – revitalise shopping, leisure and culture facilities). (Noted)
(ii) 1-4 Kiln Close, Lane, Instow”: -
The Clerk advised Cllr Moores that IPC had yet to be advised officially by NDC Planning as to whether this planning application had been granted or not; Cllr Moores said he would chase this up as he believed a decision had been made.

2202/8 MINUTES
(i) It was RESOLVED that the January 2012 minutes of Instow Parish Council be approved and signed. (Noted)
2202/9 MATTERS ARISING FROM THE MINUTES
a) Item 2201/6 (ii) - Residents Parking:-
(i) The Clerk provided an update, namely, an article was to appear in a forthcoming parish magazine (copy of article provided to Cllrs with their agenda papers {16.2.12}) and there was to be an exhibition at All Saints Community Centre between 1pm and 9pm on Friday {Good Friday} 6th April 2012. (Noted)
(ii) The Clerk confirmed that the booking of All Saints Community Centre had been dealt with. (Noted)
(iii) Cllr Cann said this scheme would not be implemented without the “will of the parishioners”. (Noted)
b) Item 2201/9 (c) – “Instow “Grot Spots” – S 215 Town and Country Planning Act 1990”:-
(i) Cllr Moores reported on: -
(a) Items 8 and 9 (Methodist Chapel and old Gas Gateway): -
(i) He said liaison was still taking place with NDC Planning and DCE, there being an ongoing issue as regards ownership of the old Gas Gateway – NDC Planning were pursuing. (Noted)
(ii) He said NDC Planning had now finalised its deliberations on the Methodist Chapel and that no further action was to be taken; the Clerk said that IPC still awaited an official communication to this effect. (Action: Cllr Moores)
(b) Items 3 (Victorian Lamppost): -
Cllr Moores said he was still pursuing this matter and would hope to report progress by the next meeting adding that DCE had agreed for the Ferry group to refurbish the lamp but that detail in this regard was still sketchy. (Action: Cllr Moores)
(c) NDH Garages – Venn Close/Rectory Lane: -
(i) The Clerk reported receipt of an email (dd 7.2.12) from Cllr Thomas reference “Rectory Lane Grot Spot – Venn Close Garages”; Cllr Thomas elaborated – he said discarded building material and general rubbish had been dumped to the side of garage No 1 and that he had, as a result, liaised with neighbours and approached North Devon Homes in order to seek permission to clean up the site and tidy it with planted wild flowers. (Noted)
(ii) The Clerk reported receipt of an email (dd 14.2.12) from Cllr Harper together with photographs of site in question. (Noted)
(iii) Cllr Thomas then updated Council and explained that NDH would require IPC to enter into a licence agreement with them to tidy up the site and plant flowers albeit there was a current licence in place for Instow in Bloom (IIB). (Noted)
(iv) Cllrs Thomas and Harper then explained why IIB had let its licence lapse; a discussion ensued. (Noted)
(v) After the discussion (as at (iv) above) IPC RESOLVED not to seek a licence from NDH (on the basis it could set a precedence for similar areas in the parish) but to provide what support it could to assist Cllr Thomas in his quest. Cllrs White, Harper and Moores offered their services. (Noted)
(vi) The Chairman complimented Cllr Thomas on his public spiritedness and leadership. (Noted) c) Item 2201/9 (d) – “Management of Quay Car Park/Refurbishment of Toilets”: -
(i) Cllr Cann provided IPC with an update following the February meeting of NDC’s Executive. He said NDC’s Executive (later supported by full Council of NDC) was willing to provide IPC with a 99 year lease (preferred to the transfer of the freehold that would not protect all required rights of NDC) together with the transfer of £64K to go towards maintenance of the car park. He added that part of the agreement was that IPC would contribute £5,000 pa towards the running costs of the toilets (that NDC would retain the responsibility for) and half the cost of their refurbishment. (Noted)
(ii) A discussion then ensued at the conclusion of which Cllr Cann was thanked for his support. (Noted)
(iii) The Clerk told IPC that he had advised NDC that Mr Ian Budge (Solicitor) was to act on IPC’s behalf. (Noted)
d) Item 2201/9 (e) – “Revised Bathing Water Directives”: -
The Clerk advised that the following matters were still outstanding: -
(a) EU Directive Signs – Bathing Water Season 2012: -
(i) The Clerk told IPC of his liaison with Defra regarding the combination of both beach signs (obligatory and advisory) and of his subsequent discussions with Cllrs Green and Harper. (Noted)
(ii) The Clerk then referred to a discussion he had with SW Signs as regards combining both signs (obligatory and advisory) with the decision being that it was not practical to do so. IPC RESOLVED to support this view. (Noted)
(iii) The Clerk said that following liaison with Cllrs Harper and Green, he suggested that the obligatory sign (draft copy provided to Cllrs with their agenda papers 16.2.12) be approved, ordered and affixed; IPC RESOLVED to support this view. (Noted) (iv) IPC then discussed the best location for this sign and it was RESOLVED to affix it to the flood defence gate opposite the Boathouse.
(Action: The Clerk)
(v) The Clerk said that IPC should note that Defra would be paying for this sign on the following terms; £390 per bathing water for a sign, and for parish and town councils there would be a payment of £175.40 for staff time. He added that Defra were aiming to release the funding before the end of the current financial year and that payment by cheque had been requested.(Noted)
(vi) The Clerk then referred to an email (dd 13.2.12) from Defra entitled “Update Guide to Signage at Bathing Waters”; he said this set out a website address to which was attached the relevant guidance. (Noted)
(vii) The Clerk said that the email (as at (vi) above) and relevant guidance had been forwarded to Cllrs Harper and Green for their information. (Noted)
(viii) The Clerk also provided a copy of the email (as at (vi) above) and guidance to Cllrs at the meeting for their information. (Noted)
(b) IPC - Publication of” Marketing Flier - Beach”: -
(i) The Clerk reported he had made contact with a local printer and she had agreed to construct a draft flier provided she was provided with a form of words; he said it was believed she would deal with the photographs. (Noted)
(ii) The Clerk said that Cllrs Green and Harper had been contacted by him and asked to provide a draft article for consideration of IPC. (Noted)
(iii) The Clerk reminded Cllrs he had forwarded a series of email (dd 23.1.12 – 7.2.12 inclusive) to them with their agenda papers (16.2.12) setting out some “article” suggestions as provided by Cllr Harper with general comments from Cllr Green. (Noted)
(iv) The Clerk advised that IIB had also been approached for its comments in view of the fact it had already developed a similar flier; Cllr Harper said at a recent meeting, IIB were not in favour of such an initiative. (Noted)
(v) The Clerk reported it was believed that Cllr Cann (DCC) might consider funding this initiative that had originally been suggested by the EA who were also of a mind to assist in its production and provide some finance. (Noted)
(vi) After a discussion IPC RESOLVED not to proceed with this initiative.

e) Item 2201/9 (f) – “Salt/Grit Bins/Community Clusters”: -
(i) Cllr Thomas (IPC’s Lead Snow Warden) provided IPC with an update on actions(s) since last meeting. (Noted)
(ii) The Clerk reported receipt of weekly email weather updates from DCC (via Cllr Thomas) that he had passed on to Cllrs with email addresses (and “parishioner” snow wardens as necessary) namely, dd 30th January 2012, 6th February 2012, 9th February 2012 and 15th February 2012. (Noted)
(iii) The Clerk added that action(s) as recommended in the weekly email weather updates (i.e. check for water run-off from fields etc) had been taken by Cllr Thomas (IPC’s Lead Snow Warden); Cllr Thomas confirmed this to be the case and elaborated as necessary. (Noted)
(iv) The Clerk reported receipt of an email (dd 30.1.12) from DCC reference “Snow Clearance Liability”; he said he had copied it to Cllrs Thomas and Harper (IPC SW) together with the Chairman and Vice Chairman. (Noted)
(v) The Clerk also copied said email (as at (iv)) to Cllrs with their agenda papers (16.2.12); a discussion ensued. (Noted)
(vi) Cllr Cook told IPC he was still not in a position to advise Council of the cost of a box to affix to the tractor; his enquiries were continuing. (Action: Cllr Cook)
(vii) Cllr Renshaw told IPC he was not in a position to advise Council of his review/update of IPC’s Self Help Emergency Plan (SHEP). (Action: Cllr Renshaw)
f) Item 2201/9 (g) – “Sand on the Highway/Marine Parade, Instow”: -
(i) IPC noted that DCC had commenced its activity on the NDCCS’s proposal for Sand Dunes Management that had commenced on Monday 20th February 2012 with fencing to be carried out during the period 9th/12th March 2012. A discussion ensued. (Noted)
(ii) The Clerk reported upon the build up of sand (up to wall height) between the Boathouse Bus Shelter and the Car Park entrance (between wall and rear of dunes) that would soon blow over onto the highway unless removed. He said he had told Cllr Cann (DCC). (Noted)
(iii) The Clerk reported that the “damaged” wall (by the Boathouse Bus Shelter) was to be repaired by DCC starting Tuesday 22nd February 2012; Cllr Moores said the job had been satisfactorily completed. Cllr Cann (DCC) was thanked for his help in resolving this relatively long standing issue. (Noted)



g) Item 2201/10 (i) (c) (i) - Diamond Jubilee Mugs/Instow School: -
(i) The Clerk said that Council needed to review and discuss this matter in the light that Fremington PC may well now be “going it alone” and it would seem that the School Governors might also be considering a similar venture; Cllr Moores elaborated.(Noted)
(ii) IPC RESOLVED to establish exactly what the School Governors intended prior to discussing this issue any further. Cllr Moores to report back at the next meeting of IPC. (Action: Cllr Moores)
h) Item 2201/10 (i) (c) (ii) - Diamond Jubilee – Devon’s Celebratory Event 27th May 2012: -
(i) IPC discussed its nomination for this event having deferred it for further deliberation at its last meeting. (Noted)
(ii) IPC RESOLVED to nominate Mrs Pam Cantle as the parish’s nominee; Clerk to advise nominee and Lord Lieutenant’s Office. (Action: The Clerk)
i) Item 2201/13 (i) - Instow Beach – Dogs: -
(i) The Clerk reported on his liaison with NDC (Environmental Health Officer) – see email (dd 7.2.12). (Noted)
(ii) The Clerk reported that he had forwarded the email reply from NDC to Cllrs with email addresses (7.2.12) suggesting that IPC monitors Combe Martin’s plans to adopt a dog ban before taking any further steps. (Noted)
(iii) After a discussion (during which IPC noted the complexity of those legal choices available to it), it was RESOLVED to make contact with Combe Martin Parish Council and follow its progress as regards its intention to seek a dog ban from its beach. (Action: The Clerk)
(iv) The Clerk reported that the local Adopt a Beach (AAB) group were going to attend the beach towards the early part of the season to talk to and issue “Beach Dog Leaflets” to dog owners together with hopeful local publicity. IPC RESOLVED to note the AAB group’s initiative and wished to place, on record, its thanks. (Noted)

2202/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
(a) Letter (dd 17.1.12) from NDC (Licensing) reference “House to House Act 1939: Little Treasures Children’s Trust “: -
(i) The Clerk said this stated that an application had been made for a house to house licence in Instow for the period 13th February 2012 to 30th November 2012. (Noted)
(ii) The Clerk advised IPC he had told NDC (Licensing – email dd 26.1.12) that IPC would have no objection to this application on the grounds it was being made by a bone fide applicant although it would have concerns it was for such a long and generally unspecific period of time. (Noted)
(iii) IPC RESOLVED to ratify the decision as at (ii) above. (Noted)
(b) (i) Letter (dd 23.1.12) from Barnstaple Town Council reference “Environment School (ES) -7th April 2012”: -
(i) The Clerk said this stated that an ES had been arranged for Saturday 7th April 2012 (Castle Centre, Barnstaple); two spaces per Council - £15 per head that would include refreshments and a buffet lunch. (Noted)
(ii) Letter (dd 3.2.12) from Barnstaple Town Council reference “Environment School (ES) - 28th April 2012”: -
The Clerk said this stated that the date (as at (i) above) had been changed to Saturday 28th April 2012; otherwise the details were the same. He added that the draft programme was to include “Flood Awareness and Emergency Planning”, “Allotments”, “Renewable Energy/Solar Panels/Energy Audits” and “Street Furniture/Tidy Up Our Town”. (Noted)
(ii) The Clerk said he had provided a copy of the letter (as at (ii) above) and an application form to Cllrs with their agenda papers (16.2.12). (Noted)
(iii) No Cllrs were available to attend; Clerk to advise BTC. (Action: The Clerk)
(c) Invitation (received 25.1.12) from Chairman of DCC to Chairman/Clerk (IPC) reference “Buffet Reception to Celebrate Contribution made by Parish Councils in the Life of Devon – County Hall on Friday 24th February 2012 at 6pm”: -
The Clerk said that the invitation had been accepted by the Chairman and Clerk and that County Hall had been informed. (Noted)
(d) Letter (dd 27.1.12) and attachment (“Feedback Document”) from RWE npower renewables reference “Atlantic Array Offshore Wind Farm – Public Consultation Summary Report”: -
(i) The Clerk said this provided an update on the public consultation that was run between 10th September 2011 and 10th November 2011 regarding the above. (Noted)
(ii) The Clerk said he had provided a copy of the letter to Cllrs with their agenda papers (16.2.12) adding that the Chairman and Vice Chairman had been provided with a copy of the Feedback Document. (Noted)
(iii) The Clerk reported receipt of a copy email (dd 22.2.12) from the Torridge Harbourmaster reference “Atlantic Array – Navigational Risks”; he provided copies to Cllrs at the meeting. (Noted)

(e) (A) Email (dd 1.2.12) from DCC/Somerset CC reference “Keep Up to Speed – Latest News from the Connecting Devon and Somerset Broadband Programme”: -
(i) The Clerk said this provided an update on this programme which was due to launch with a campaign of activity going live from Monday 6th February 2012. (Noted)
(ii) The Clerk said he had provided a copy of the email to Cllrs with their agenda papers (16.2.12). (Noted)
(B) Email (dd 10.2.12) from Cllr Cann reference “Broadband – Devon and Somerset/Survey”: -
(i) The Clerk said he had copied this to Cllrs with email addresses and also provided a copy to Cllrs with agenda papers (16.2.12) (Noted)

(C) Email (dd 23.2.12) from CCD reference “Devon and Somerset PCP (Green Boxes) – Extended Deadline (27.2.12)”
(i) The Clerk said he was unaware of any previous request but that in any event said email had been “withdrawn” by the sender almost immediately after its dispatch. (Noted)
(f) Email (dd 1.2.12) from DCC (Cllr Cann) reference “Countywide Disabled Bay Traffic Regulation Order”: -
(i) The Clerk said this included locations at Lyndale Terrace, Lime Grove and Elm Terrace, Instow and that Cllrs had been provided with a copy of the email (as of relevance to Instow locations) with their agenda papers (16.2.12). (Noted)
(ii) Cllr Cann provided IPC with an update. (Noted)
(g) Email (dd 6.2.12) from Instow PCC (Pam Cantle) reference “Village Calendar 2012”: -
(i) The Clerk said he had forwarded this to Cllrs with email addresses (16.2.12). (Noted)
(ii) He said Cllrs should note that the Village Carol Singing Event was to be held on Sunday 16th December 2012 at 6.30 pm and that the Commodore, IPHC and Two Rivers Wind Ensemble needed to be advised by him. (Noted)
(h) “Marine Parade - Weeds”: -
(i) The Clerk reported that Cllr Cann (DCC) was prepared to consider funding the removal of the weeds along Marine Parade but to date he had been unable to identify a local contractor who was prepared to do it; he said he had contacted three contractors and all had declined the job. (Noted)
(ii) Cllr Cook then reported that he was aware of one local contractor who was interested in doing the job and that he would do so for £750 that would include the disposal of the weeds. (Noted)
(iii) After a discussion IPC RESOLVED to have the Clerk liaise with Cllr Cann (DCC) in an endeavour to resolve this issue. Cllr Cann was thanked for his interest and proposed contribution. (Action: Cllr Cann/The Clerk)
(i) Email (dd 18.2.12) from Chairman of Parish Hall Committee reference “Recommended Diamond Jubilee Reception – Parish Hall/Friday 1st June 2012”: -
The Clerk elaborated on the proposal at the conclusion of which IPC RESOLVED not to support the event. (Action: The Clerk)
(j) Email (dd 21.2.12) from DCC reference “Devon Minerals Update No 8 – Consultation”: -
(i) The Clerk said this stated that this was in the public domain for the period 21.2.12 to 2.4.12 with any comments to DCC. (Noted)
(ii) The Clerk said he had forwarded a copy of the email to Cllrs with email addresses (21.2.12); a discussion ensued. (Noted)
(k) Copy email (dd 21.2.12) from DCC Highways to Cllr Cann reference “Marine Parade, Instow”: -
The Clerk said this stated that the full length of this road was currently being evaluated as a potential surface dressing scheme for 2013/4; Cllr Cann elaborated. (Noted)
(l) Email (dd 23.2.12) and attachment from NDC/TDC reference “Publication of Feedback Report for ND and Torridge Pre-Publication Joint Core Strategy”: -
(i) The Clerk provided a copy of this email and Newsletter attachment to Cllrs at the meeting; he said further information could be found vide www.northdevon.gov.uk/ldf and www.torridge.gov.uk/ldf (Noted)
(ii) A discussion ensued. (Noted)
(m) Emails (various – 21/22.2.12) from DALC reference “Prayers at Council Meetings/Freedom to Pray”: -
(i) The Clerk reported that both emails had been forwarded to Cllrs with email addresses and the format adopted at the beginning of the meeting as regards “Prayers” had been democratically “agreed” as a result i.e. a Prayer would be held before the official commencement of the meeting with it being made abundantly clear to all person present at the time (Cllrs and parishioners) that to remain was optional. (Noted)
(ii) IPC RESOLVED to ratify this procedure although it noted that Bideford Town Council was to appeal the decision and that the Governments’ Communities Secretary was to fast track part of the Localism Bill to permit prayers to again be said at the commencement of Council meetings. (Noted)
(n) Email (dd 23.2.12) from DCC reference “National Bus Pass Renewal – 2013: -
(i) The Clerk reported receipt of an email (dd 23.2.12) that set out the process by which bus pass renewals would be handled post 31st March 2013 when current passes would expire; he provided Cllrs with a copy. (Noted)
(ii) At the Clerk’s suggestion, IPC RESOLVED to pass this to the Editor of the parish magazine with a request it be published asap. (Action: The Clerk)
(o) Email (dd 23.2.12) from DCC (Footpath Warden) reference Footpath Closure (No 15 and Part 9) – Cricket Club to Power Station: -
(i) The Clerk said this stated that a section of this footpath was to be closed for a period of up to 6 months to allow the EA to carry out flood defence works. He added that it would seem that a small diversion was in place. (Noted)
(ii) Cllrs were provided with a copy of the email; it was RESOLVED to provide a copy to the editor of the parish magazine and place a notice/map on parish notice boards. (Action: The Clerk)

(p) Miscellaneous Correspondence (see (ii) and (iii) below): -
After a discussion IPC RESOLVED not to print off miscellaneous correspondence and place it in a folder for subsequent perusal by Cllrs on the basis the majority had already been forwarded to Cllrs with email addresses and that in any event, Cllrs, who received a list of said correspondence at each meeting could enquire of the Clerk and request further information on a needs basis. It was felt that this would be a cost saving exercise in the long term. (Noted)

(b) “Marine Car Park, Instow – New Signs/Machine”: -
(i) The Clerk advised IPC of his liaison with SW Signs and of the cost to erect a new set of signs that would be fully compliant with off-street parking legislation etc; he said the cost was £544 plus VAT (includes erection) and needed to be installed prior to car park opening on 1.4.12. IPC RESOLVED to agree to this. (Action: The Clerk)
(ii) The Clerk said the new car park machine had been delivered to his address on 21.2.12 and, like the signs ((i) above), would need to be installed prior to the car park opening on 1.4.12. (Action: The Clerk)



(c) Use of Marine (Quay) Car Park - Transfer of Freehold (now Lease) by NDC: -
(i) The Clerk said now that NDC had agreed to grant IPC a 99 year lease for the Marine Car Park (see matters arising – item 2201/9 (c))) it remained for the following to be noted/actioned: -
(a) IPC had already RESOLVED to open the car park on 1st April 2012 (with a licence from NDC until such time as the legal niceties as regards the lease could be finalised) with the charges being £1 for 1 hour, £2 for 3 hours and £4 for 24 hours (all day); charges to end as usual 30th September 2012. The Clerk added that Instow Marine’s current “Boat Park” licence ended 31.3.12. (Noted)
(b) IPC had previously RESOLVED that a season ticket would cost £100 (for 6 months i.e. April – Sept 2012) and a weekly ticket £15. (Noted)
(c) IPC RESOLVED that the Clerk should place an article in a forthcoming parish magazine setting out the period the car park would be open for payment (1.4.1to 30.9.12) and of the charges (daily, season and weekly ticket). (Action: The Clerk)
(d) IPC had already RESOLVED that IPC would set up a Sub Committee to discuss the way forward for the car park (once the freehold {now lease} was granted) to initially liaise with Instow Marine and consider the use of the car park in subsequent winter months in the light of their requirements (and the removal of boats from the car park prior to 1.4.12). (Noted)
(e) After a discussion it was RESOLVED that said sub committee would consist of the Chairman, Vice Chairman and Cllrs Thomas, Moores and Renshaw supported by the Clerk who was to endeavour to arrange a meeting asap.

(f) Currently IPC has resolved to offer the period 1.10.12 to 31.3.13 to Instow Marine to use part of the car park as a boat park at a fee of at least £1,500. (Noted)

(i) The Clerk said this stated that this guide looked in far greater depth at the new powers that were becoming available though the introduction of neighbourhood planning; it provided a step by step approach to getting a plan up and running. (Noted)

(i) The Clerk advised IPC that following discussions at the January meeting he contacted NDC Planning (email dd 20.1.12) to enquire why this application had not been sent to IPC for a recommendation; he said his email had been acknowledged (20.1.12). (Noted)
(ii) The Clerk then reported receipt of an email (dd 24.1.12) from NDC Planning that provided an explanation as follows: -
“We receive two sorts of certificate of lawfulness applications - one type covers existing situations and the other covers proposed situations. The system of ‘lawful development certificates’ enables local planning authorities, when the appropriate conditions are satisfied in each case, to grant a certificate saying that: -
(a) An existing use of land, or some operational development, or some activity in breach of a planning condition, is lawful; or
(b) A proposed use of buildings or other land, or some operations proposed to be carried out in, on, over or under land, would be lawful.
We do not consult anyone on either type of application as the decision making process is based on the question of the lawfulness of the proposal covered by the application”.
