2603/3 POLICE REPORT
a) Crime: - Constable Benbow said that only one crime had been reported in the
parish since the last meeting, namely a burglary that had occurred during the
period 5/6th March 2006. He added that two similar offences had occurred at
Fremington and that the common feature was entry through an open window. He
urged all parishioners to take simple crime prevention precautions and to
report suspicious behaviour. (Noted)
b) Business Watch: - PC Benbow said he was encouraged by the response he had
received so far from local businesses but that progress had been somewhat
thwarted by the very recent resignation of the local Neighbourhood/Crime
Prevention Manager who was responsible for setting up such an initiative. He
said he would do all he could to get the scheme up and running without undue
delay. (Action: PC Benbow)

2603/5 REPORT COUNTY COUNCILLOR R CANN
(a) General: - Cllr Cann reported upon the Closure of Lynton House (Cashier’s
Service NDDC) (due to falling number of customers – can be contacted by
telephone 01271 388361 or email at counciltax@northdevon.gov.uk for direct
debit queries and 01271 329539 for online payment service), Downstream Bridge
(Project on target to finish May 2007), Marine Parade Footpath Condition (no
safety defects found but pavement will be patched), Free Bus Travel for
Devonwide Pass Holders (from 1st April 2006 those residents who are currently
eligible for half price bus travel across the county will be able to claim
free journeys – new applicants living in the area should contact Devonwide
Office on 01392 383688 or 01271 383688), Devon In Touch (requests for
attendance at local events can be made on 01392 383444), Winter Highway Pre
Salting (£ ¼ million spent already this winter), DCC Customer Service Centre
Update (is to be based at Tiverton and open in May and fully operational by
February 2007), Parking in Boathouse Loading Bay (it has been agreed to change
double yellow lines to single to allow parking after 6 pm except by emergency
access gate) and Demount Body Vehicle Test (NDDC is to test a new system of
refuse collection that will enable greater mobility/flexibility). (Noted)
(b) Instow New School: - Cllr Cann reported that a written response had not
been received from the landowner although he had intimated, verbally, that he
would not willingly dispose of it. (Noted)
(c) Unitary Authorities in Devon: - Cllr White asked whether Torbay or
Plymouth Unitary Authorities contributed towards the upkeep of Devon’s roads.
Cllr Cann answered in the negative. (Noted)
(d) Ditto – Council Tax to DCC: - Cllr White asked if Torbay or Plymouth
Unitary Authorities contributed any monies at all to DCC. Cllr Cann reported
that they did so for the provision of the Devon and Cornwall Police/Devon Fire
and Rescue. (Noted)
(e) Leader of DCC – Pay Rise: - Cllr White asked why the Leader of DCC had
received such a substantial pay rise and queried the authority of the
Independent Body in recommending it. Cllr Cann said he did not agree with it
and spoke in such terms at the time. (Noted)
2603/6 REPORT OF DISTRICT COUNCILLOR Mrs L BROWN
Cllr Brown reported upon External Communications (a NDDC Review), North Devon
College (discussions have taken place regarding its ambition to rebuild on a
new site in Barnstaple), New “Keep Britain Tidy” Survey (all districts in
England will be scrutinised on everything from the number of weed-ridden and
litter-strewn streets to the quality of litter bin collection), Fly Tipping,
Licensing Act Prosecutions (NDDC has prosecuted three persons to date), NDDC
Budget (proposed council tax rise was 5% but has been set at 4 ½% ) and
Executive Agenda (any member of the public can attend NDDC Committee Meetings,
including the Executive Committee). (Noted)
2603/7 MINUTES
It was RESOLVED that the February 2006 minutes of Instow Parish Council be
approved and signed with the exception of item 2602/8 (c) (a) (iii) where Cllr
Harper asked that his comments, as recorded, i.e. “he added that the analysis
of the 2001 consultation process was flawed” should be qualified by adding the
words “Cllr Harper said he was not referring to the 1998 Village Appraisal”.
IPC RESOLVED to adopt this amendment. (Noted)
2603/8 MATTERS ARISING FROM THE MINUTES
a) Item 2602/5 and 2602/8 (b) – Marine Parade/Footpath Condition: - The Clerk
referred to an email (dd 17.2.06) from Cllr Cann stating that DCC Local
Services had inspected the footpath and no safety defects had been found i.e.
the technician found some areas where the existing surfacing had broken away
but the potential trip was significantly less than the 20mm DCC criteria for
taking action. However, DCC did agree that the footpath looked unsightly and
the technician has been asked to look at patching the “damaged” areas so it
would look a little better. (Noted)
b) Item 2602/8 (c) – Sandhills Ransom Strip: - (i) Cllr Cann and the Clerk
provided an update to IPC i.e. the Clerk is to meet up with Brian Holme (NDDC)
on Monday 20th March to carry out some preparatory work prior to a meeting of
the Steering Group. (Noted)
(ii) Cllr Harper said he wished, as a point of clarification, to point out the
following: - (a) The 1998 Instow Community Appraisal excluded the villagers
from input on a new primary school, (b) The 1999 Instow School and Community
Facilities Appraisal was not limited to residents of Instow, but included
residents of Westleigh and West Yelland and (c) The 2001 Consultation on
possible community facilities at Instow new school also included residents of
Westleigh and West Yelland. Cllr Harper said that in his opinion the residents
of Instow had not previously been given the opportunity to address issues
relevant to the school adding that the 1999 Appraisal and 2001 Consultation,
were, in his opinion, biased in that they were not limited to just the
residents of Instow. He said the results did not reflect breakdowns of how
many were Instow residents and how they answered the questions. (Noted) (iii)
Cllr Cann assured Cllr Harper that any proposed survey questionnaire of
relevance to the Ransom Strip monies would be distributed amongst Instow
parishioners only. (Noted)
c) Item 2602/8 (d) – Instow Beach/Water Quality: - (i) The Clerk reported upon
a site meeting (10.3.06) he had attended with SWW (May Gurney) reference the
“suspect” outfall on the beach between the oil jetty and the old power
station. He said the outlet (not previously known of by SWW) had been
inspected and algae found in the immediate vicinity suggested that sewage was
not being discharged at that point. However, a further inspection was to take
place and samples taken for further examination; SWW has agreed to keep the
Clerk appraised. (Noted)
2603/9 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
(a) Email (dd 23.2.06) from Fundraising Initiatives Ltd reference “House to
House Charitable Collection – NDDC Area (6th March – 1st April)”: - The Clerk
said he had replied to the writer and advised her that IPC was “not in favour”
of this form of collection (direct debit) and asked her to tell him of any
intended visits to Instow during the period in question. IPC RESOLVED to
support the Clerk’s course of action. (Noted)
(b) Email (dd 24.2.06) from Wings reference “Cob House – Picnic Area/Tarka
Trail”: - The Clerk said this email advised IPC that a thatcher had now been
found and would be starting to thatch the cob house in the next few weeks; the
Clerk read it to Council. IPC RESOLVED to advise Wings of its continued
concern as to the inordinate time this project was taking. (Action: The Clerk)
(c) Letter (dd Feb/March 2006) from Mole Valley Farmers reference “CPRE and
MVF’s Best Kept Village in Devon Competition 2006”: - The Clerk reported that
this letter had been “personalised” to IPC and perhaps Council should consider
entering said competition; the Clerk provided a copy of the letter to Cllrs to
peruse. After discussion IPC RESOLVED not to support this invitation. (Noted)
(d) Letter (dd 9.3.06) from Chair of Governors of Bideford College reference
“Likelihood of New College in Bideford”: - The Clerk said this letter invited
a representative of IPC to a meeting at 6 pm on Friday 17th March in the
College theatre and that a copy letter had been given to Cllr Crombie (Instow
School Governor) who was to liaise with Cllr Scott (Also Instow School
Governor). Cllrs Crombie and Scott agreed to attend the meeting and represent
IPC. (Noted)
(e) IPC’s Emergency Plan (Website): - Cllr Harper told Council that this plan
was now published on the Instow Website with particular items (data protected)
only available by way of a password. Cllr Harper advised Cllrs of this
password for their information IN CONFIDENCE. IPC RESOLVED to thank the
webmaster for his cooperation; Cllr Harper was thanked personally for his
leadership on this excellent initiative. (Action: The Clerk)
(f) Letter from Barnstaple Town Council reference “Invitation to Climate
Change Evening” on Wednesday 5th April 2006 at the Castle Centre, The Strand,
Barnstaple at 7 pm: - After discussion IPC RESOLVED to enquire whether Mrs
Rose Day (IPC’s Environment Consultant) might like to attend and represent IPC
and to advise Barnstaple Town Council as appropriate. (Action: The Clerk)
(g) Email (dd 14.3.06) from parishioner reference “Shooting Safety”: - (i) The
Clerk said this email referred to an incident, witnessed by the parishioner’s
wife, on 14th March in one of “Mays” fields on the seaward side of Anstey Way.

i.e. IPC’s tractor qualifies for an exempt licence (agricultural usage) which

carried this out with Cllr Crombie (H and Safety Cllr) and the handyperson on

(d) Beach Cleaner 2006: - (i) The Clerk recommended that the agreed sum for
beach cleaning 2006 was as per budget (i.e. £2,400.00) but that a proportion
was earmarked for the Xmas clean and Tractor Service. He said that if IPC
agreed to this recommendation he further suggested that £2,190 be paid in
equal sums for the months of April – September inclusive (i.e. £365.00 per
month) and that the remaining £210.00 be paid in December. After discussion
IPC RESOLVED to approve it. (Action: The Clerk)
(ii) The Clerk told IPC he had taken advice from Mr G Day (IPC’s IA) and as a
result, tabled a draft Beach Cleaner’s “Terms of Reference” for approval.

(e)Car Park/Bottle Bank and Bus Shelter Licences 2006/7: - (i) The Clerk
reported he had, on behalf of IPC, asked for the Car Park Licence to be
renewed (letter from NDDC 20.2.06 refers) for the period 1.5.06 to 30.9.06 –
total cost of £1532.20 (£1304.00 + Vat) – NB: - an increase of £72.85 on 2005.
IPC RESOLVED to support this decision. (Noted) (ii) The Clerk further advised
that a similar request (and acceptance by him on behalf of IPC) had been made
(letters from NDDC 20.2.06 refers) to renew the Bottle Bank Licence (no fee)
and Bus Shelter (Quay Car Park) – cost £12 plus VAT = £14.10. The Clerk said
that the relevant invoices were still awaited. IPC RESOLVED to support these

(f) TTEF Subscription 2006/7: - The Clerk reported receipt of an email (dd
21.2.06) from the Secretary of TTEF acknowledging receipt of IPC’s

guidance; he suggested, as a consequence, that IPC be made aware and consider

(iii) The Clerk told IPC it would need to consider this issue and come to a
decision prior to the end of the current tax year, that is, 5th April 2006. He
said the NALC document recommended that to avoid the imposition of income tax
on a future gratuity payment Councils should (a) consider (before 5th April
2006) whether it is appropriate to formally exercise their discretion to pay a
lump sum gratuity on the future retirement of the present staff, (b) if a
decision to exercise the discretion is taken then the Inland Revenue should be
informed so that the existing rights (time served to 5th April 2006) will be
subject to protection and that part of the lump sum can be paid tax free and,
(c) If the existing contract, or other arrangement, includes provision for the
right to a pension commencement lump sum or gratuity then the Inland Revenue
should be informed so that the existing rights (time served 5th April 2006)
will be subject to protection and that part of the lump sum can be paid in
full and tax free. (Noted)
(iv) After debate, in the absence of the Clerk, IPC RESOLVED to exercise its
discretion to pay a lump sum gratuity on the future retirement of the present
staff, and to advise the Inland Revenue accordingly, so that the existing
rights (time served to 5th April 2006) would be subject to protection and that

39545): - Cllr Mrs L Brown was not in a position to update IPC on the progress

(Reference No 41244): - The Clerk said this letter stated that NDDC had
GRANTED this application with conditions as listed. (Noted)

access and visibility works on to Quay Lane, Mollands Garage, Quay lane,
Instow (Reference No AKB/MS/41172/41173): - (i) The Clerk said this
application had been received by him (6.3.06) and passed immediately to the
Vice Chairman for the attention of IPC’s PSC; for response by 22nd March 2006

way of the letter, why the decision has been taken. Cllrs were provided with a

Parade, Instow (Reference No 41334): - The Clerk said this letter stated that
this application had been REFUSED for reasons as listed. Cllrs were provided
with a copy for their information. (Noted)
f) Handling Planning Applications – Guidance from DAPC: - (i) The Clerk
referred to the recent DAPC Newsletter (March/April 2006), copies of which
were provided to Cllrs prior to the meeting, and in which advice was given as
regards the response to planning applications in a very tight time scale. The
Clerk said that in the light of this guidance he recommended that IPC adopt
the following policy: -
(a) Where possible, and in consultation with NDDC Planning (when extensions
might need to be applied for) IPC endeavours to bring each planning
application before a full Council meeting and make a decision at that forum.
(b) If this was not possible, have the planning application dealt with by
IPC’s Planning Sub Committee (as at present – 4 Cllrs) and delegate the power
of decision making, after deliberation by IPC’s PSC, to the Clerk (Proper
Officer of the Council). This, the Clerk said, would then be lawful.
(c) Bring such applications (i.e. (b) above) before the next parish council
meeting and have this decision ratified by full Council (as at present) and in
public.
