PCSO Meaker reported as follows: -
a) Crime: -
(i) 4 crimes had been reported in the parish since the last meeting, namely,
possession of drugs (class B – cannabis) (x 2), non-crime/child protection
incident/physical (x 1) and assault occasioning actual bodily harm (x 1).

4 other incidents had been made the subject of an incident log since the last
meeting, namely, administration/information/intelligence (x 1), public
safety/concern/collapse/ill/trapped (x 1), transport incident/road traffic
collision (damage only) (x 1) and public safety/suspicious
circumstances/insecure premises/vehicle (x 1). (Noted)
c) Parking Matters: -
PCSO Meaker said she had recently booked two cars for obstruction of the flood
defence gates near the Boathouse; she was thanked by the Clerk and
Chairman.(Noted)
2203/5 PARISHIONERS
a) Illegal Parking – Marine Parade (By Slipway): -
(i) A parishioner reported that cars were parking on double yellow lines at
this location; PCSO Meaker said this was not a police matter. (Noted)
(ii) Cllr Cann said he was currently in liaison with NDC’s Civil Enforcement
Officers reference other breaches of parking regulations in Instow and would
deal with this at the same time. (Action: Cllr Cann)
b) Grot Spots – Dilapidated Chalets on Tarka Trail/Opposite Picnic Area: -
A parishioner enquired as to progress as regards these chalets; the Clerk and
Cllr Moores said they would be discussed under “matters arising” (see item
2203/9 (c) (iii)). (Noted)
c) Marine Parade – Weeds/Handyperson: -
A parishioner enquired why the parish handyperson was not dealing with the
weeds on Marine Parade as opposed to a private contractor (see item 2203/9
(h)). The Clerk advised her that the handyperson only operated for 4 hours per
week at this time of the year, did not possess the necessary tools/safety
equipment or have the means to dispose of the weeds once cleared. He added
that the handyperson was not employed by the Council but was self-employed and
although there was a “terms of agreement” in place between both parties the
handyperson could refuse any work offered to him; this he had done. (Noted)
d) Diamond Jubilee Celebrations: -
(i) A parishioner enquired as to the plans IPC had for celebrating the
forthcoming Queen’s Diamond Jubilee within the parish. The Chairman advised
the parishioner that no plans were in mind by IPC although it was believed
that the Instow Parish Hall Committee might have something in hand. (Noted)
(ii) After a discussion IPC RESOLVED to establish a small sub-committee to
consider what might be arranged; Cllrs Harper and Moores agreed to act as the
sub-committee and to report back at the next meeting. (Action: Cllrs Harper/Moores)
2203/6 REPORT COUNTY COUNCILLOR R CANN
(i) General: -
Cllr Cann spoke of “The Barnstaple Traffic Surveys” (start 15.3.12 until
22.3.12), “Residential Care Homes – Elderly” (DCC plans to invest over £10M
over 3 years making homes brighter, more airy and modern), “Sand Stabilisation
– Instow” (15 students will be working on the fencing commencing 17.3.12),
“Road Maintenance” (he elaborated) and “Funding for Weed Control” (limited and
mainly for main roads). (Noted)
(ii) Signpost – Huish Moor: -
Cllr Harper said this signpost had still not been replaced despite being
reported as defective back in June 2011; Cllr Cann agreed to deal. (Action:
Cllr Cann)
(iii) Overgrown Hedge/Trees - Rectory Lane/Road Safety Hazard”: -
Cllrs Cook and Thomas reported that this hedge was becoming a road safety
hazard to road users and needed urgent attention. The Clerk said it had been
reported to DCC on several occasions now and nothing had been done. Cllr Cann
agreed to look into it and deal asap. (Action: Cllr Cann)
2203/7 REPORT OF DISTRICT COUNCILLOR B MOORES
There was no report from Cllr Moores. (Noted)
2203/8 MINUTES
(i) It was RESOLVED that the February 2012 minutes of Instow Parish Council be
approved and signed. (Noted)
2203/9 MATTERS ARISING FROM THE MINUTES
a) Item 2202/5 (ii) – Beach Cleaning: -
(i) The Clerk reported he had made enquiries of Combe Martin Parish Council,
NDCCS and the Beach Cleaner and ascertained the following: -
a) Combe Martin PC hand picks small litter, removes excess seaweed with a rake
and uses a tractor for big flotsam/jetsam; the seaweed is taken away by
parishioners for their gardens and the remainder goes into wheelie bins for
re-cycling. This work is carried out by CMPC’s car park attendants and workmen
and it spends about £8K pa on said activity. (Noted)
b) NDCCS state that the scraping back of the sand in front of Marine Parade is
expected to continue, the reason being it’s the litter that traps and builds
up the sand. In front of the dunes it is hoped that handpicking for human
sourced non-biodegradable litter and leaving the seaweed and drift wood in
place to trap the sand there. Finally, as for disposal and by way of example,
in Kenya the locals have been making tourism gifts from the jetsam – food for
thought. (Noted)
c) The beach cleaner wishes to advise IPC that he is “contracted” by IPC (as a
self-employed person) to clean the beach and dunes and not the seabed (mud)
where the rubbish referred to by a parishioner at the last meeting was
situated (near to the Quay). The mud is not a safe environment for him to
operate in either on foot and especially with the tractor. The Beach cleaner
suggests that now he has a box fitted to the tractor (see items 2203/9 (e)
(ii) later) he will be in a position to remove any non-biodegradable waste
from the seaweed and dispose of it (i.e. plastic etc.) and he will leave any
wood above the high tide mark for removal by parishioners and akin who
regularly scavenge the beach for fuel. He suggests that the seaweed he
collects is not suitable for use as fertiliser and that when he has stockpiled
seaweed in the past he has received complaints about the smell. (Noted)
(ii) The Clerk advised IPC he had received many more plaudits about the
quality of beach cleaning than complaints in his term of office (12 years
plus) and that IPC and parishioners should be reminded of the enormous
commitment put in by the beach cleaner who operates on the beach every single
day from Easter to the end of September and in 2011 put in in excess of 150
hours “overtime”. (Noted)
(ii) After a discussion IPC RESOLVED to continue to clean the beach as normal
but to adopt the policy of collecting and removing plastics and akin
non-biodegradable material and suitably dispose of them and to liaise with the
NDCCS as regards the placement of seaweed and flotsam/jetsam in front of the
dunes to encourage the sand to remain in situ. (Action: The Clerk)

b) Item 2202/9 (a) – Residents Parking (RP): -
The Clerk reminded Cllrs that the RP exhibition was to be held at All Saints
Community Centre between 1pm and 8pm on Good Friday, 6th April 2012. (Noted)
c) Item 2202/9 (c) – “Instow “Grot Spots” – S 215 Town and Country Planning
Act 1990”:-
(i) Cllr Moores reported as follows: -
(a) Items 8 and 9 (Methodist Chapel and Old Gas Gateway): -
(i) Item 8 Methodist Chapel – see item 2203/12 (g) later. (Noted)
(ii) Item 9 Old Gas Gateway – DCE now accepts that it owns this building (it
had been let out on a long-term lease that has recently elapsed) and the CE is
considering his options. (Noted)
(b) Items 3 (Victorian Lamppost): -
The Instow Ferry Group has been given permission by DCE to restore this lamp
and is currently exploring grants to fund the project. (Noted)
(ii) Cllr Thomas reported as follows: -
Venn Close Garages: -
North Devon Homes has agreed to allocate a licence to Venn Close residents
(Secretary: Mr Andy Dipper) and also contribute towards the scheme. (Noted)
(iii) The Clerk reported receipt of an email (dd 7.3.12) from Cllr Harper
regarding: -
Grot Spots Progress – March 2012
The Clerk provided Cllrs with a copy at the meeting; Cllr Harper then
elaborated as necessary and the following additional locations were discussed:

a) Entrance to Cricket Club (Broken Barrier) – Cllr Moores said this was
included on a schedule of work drawn up by DCE. (Noted)
b) Derelict Chalets/Tarka Trail – Cllr Moores said DCE was considering its
options in their regard. (Noted)
c) Glen Cottage, Lane End – Cllr Moores said a letter was being sent to the
owner by NDC Planning. (Noted)
d) Southgate Chalet - Cllr Moores said that planning permission had recently
been given to “restore” this building. (Noted)
(iv) A general discussion then ensue at the conclusion of which it was
RESOLVED to remove this item from the agenda (Matters arising) at future
meetings and to review general progress at the end of the summer. (Noted) d)
Item 2202/9 (d) – “Management of Quay Car Park/Refurbishment of Toilets”: -
(i) The Clerk reported that nothing formal had, as yet, been received from NDC
as regards the offer of a 99 year lease to IPC (or licence to operate the car
park from 1.4.12); he confirmed he had advised IPC that Mr Ian Budge
(Solicitor) was acting for IPC and that any legal paperwork should be
forwarded to him. (Noted)
e) Item 2202/9 (f) – “Salt/Grit Bins/Community Clusters”: -
(i) Cllr Thomas (IPC’s Lead Snow Warden) provided IPC with an update on
action(s) since last meeting. (Noted)
(ii) Cllr Cook advised IPC he had negotiated a price for a box for the tractor
at £55; IPC RESOLVED to support this – see finance later vide 2203/11 (2).

(iii) Cllr Renshaw was not present to update IPC on his progress of
review/update of IPC’s Self Help Emergency Plan (SHEP). (Noted)
f) Item 2202/9 (g) - Diamond Jubilee Mugs: -
Cllr Moores reported he had yet to attend a School Governors’ meeting to
discuss this issue but that one was planned in the foreseeable future; he
would report back to the next meeting of IPC. (Noted)
g) Item 2202/9 (i) - Instow Beach – Dogs: -
(i) The Clerk reported on his enquiries of Combe Martin PC (CMPC) as regards
its intentions to adopt a dog ban order for its beach i.e. making use of the
Clean Neighbourhood and Environment Act 2005. He referred to the likely
substantial financial implications involved, training needs and requirement to
enforce, adding that as far as CMPC was concerned, it was very early days. The
Clerk suggested that IPC monitors CMPC’s progress and consider further actions
based on CMPC’s proven experience. IPC RESOLVED to adopt this strategy.

(ii) Cllr Thomas raised the issue of dog mess being deposited on the Tarka
Trail, immediately either side of the old Power Station entrance; Cllr Cann
said this was on Fremington PC’s patch and he would be grateful if the Clerk
could advise NDCCS who managed the Tarka Trail on behalf DCC. (Action: The
Clerk)
h) Item 2202/10 (i) (h) – Marine Parade/Weeds: -
(i) The Clerk reported he had liaised with Cllr Cann (DCC) and completed a
Locality Grant application form for £750 based on a “Clean-up” Campaign along
Marine Parade; he added that a decision was awaited. (Noted)
(ii) A discussion then ensued at the conclusion of which IPC RESOLVED to
allocate said work to the provider of the tender for £750 (as obtained at the
February meeting – see item 2202/10 (i) (h) (ii)) once the grant had been
approved, received and banked.
(Action: The Clerk)
(iii) For the matter of record, the Clerk reminded IPC that three other local
tradesmen had been approached to do this job and each had declined. (Noted)
(i) Item 2202/13 – IPC’s Fuel Tank/Storage: -
(i) The Clerk reported he had contacted IPC’s insurers (Aon – email dd 29.2.12
refers) and enquired about storing IPC’s diesel tank “indoors”, primarily for
security reasons; he was advised (Aon having spoken to Allianz) that a more
appropriate solution to any security issue would be to store the fuel tank in
a locked cage – they would not advise for the tank to be stored within any
premises and should be kept a distance away from any buildings. IPC was also
advised to obtain further guidance from health and safety professionals who
would be able to offer further assistance in the matter. (Noted)
(ii) After a discussion IPC RESOLVED to continue to use its bulk storage tank
(and leave it in situ) but to ensure all possible security measures were taken
to ensure the fuel’s safe keeping. (Noted)
2203/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
a) Letter (dd 6.3.12) from the Environment Agency (ED) reference “Revised
Bathing Waters Directive Seminars”: -
(i) The Clerk said this stated that these were to take place on either
Tuesday/Thursday (am) 17th/19th April 2012 at Plymouth and Taunton
respectively; the Clerk said he would be available to attend the Taunton event
– IPC RESOLVED to support the attendance of the Clerk. (Action: The Clerk)
(ii) The Clerk then referred to an email (dd 9.3.12) from the EA reference
“Revised Bathing Waters Directive Survey”; he said the survey had been
completed by him as necessary and returned. (Noted)
b) Request from a parishioner to “Trim Cherry Tree on Grass Verge, Anstey
Way/Marine Parade (Nr Signal Box) to Improve View of Estuary”: -
The Clerk advised IPC of the details of this “regular” request and of the fact
that DCC, particularly, (and IIB) have declined to deal. (Noted)
(ii) After a discussion IPC RESOLVED to take no further action on the basis it
did not “own” the relevant grass verge or tree and that to do so might well
set a precedent for the future; it acknowledged that no individual person(s)
were “entitled” to a view.

c) Email (dd 12.3.12) from Petroc (North Devon College) reference “Fitness
Class – Instow Beach”: -
(i) The Clerk said this was a request to use part of Instow beach (as leased
by IPC from CE) as a regular Saturday morning (10am - 11am) fitness class for
about 20 people; it would require an area about the size of a tennis court and
little equipment would be involved with exercise being taken “on the spot”.
The Clerk said the applicant had public liability insurance and would ensure
the enjoyment of the beach by other users was not hampered. (Noted)
(ii) After a discussion IPC RESOLVED to agree to the request on the following
conditions: -
a) The applicant supplies IPC with some form of confirmation of public
liability insurance cover
b) The applicant provides a guide as to what date(s) it is intended to carry
out said activity
c) The applicant agrees not to spoil the enjoyment of Instow’s beach by other
users (It is suggested that said activity is not set-up too close to the
Commodore slipway or Boathouse flood defence gates)
d) The applicant collects any litter on completion of each day’s activity and
leaves the beach as it was found. (Action: The Clerk)

(b) “Marine Car Park, Instow – New Signs/Machine”: -
(i) The Clerk advised IPC that SW Signs were to fix the new set of car park
signs prior to the opening of the car park (1.4.12); probably Wednesday 28th
March 2012. (Noted)
(ii) The Clerk told IPC that the new car park machine was to be installed on
Wednesday 28th March 2012 and that a supply of new tickets has been purchased
(see above – item 2). (Noted)
(c) Use of Marine (Quay) Car Park - Transfer of Freehold (now Lease) by NDC: -
(i) The Clerk advised Council that IPC’s Car Park Sub Committee had met on
Friday 9th March at the Commodore, namely Cllrs White, Crombie (in lieu of
Cllr Green), Thomas, Renshaw and Moores and that its “thoughts” to date were
as follows: -
a) (i) Instow Marine (IM) should be approached to determine its long term
“needs” to use the car park in the winter months (October 2012 – March 2013)
as a boat park; to be discussed with IM.
(ii) The Clerk said it was believed IM would require at least part of the car
park for the following winter 2012/13.
b) (i) IPC should consider charging (winter months 2012/13) for parking in
that part of the car park that remained free (assuming IM would require the
other half) albeit a public consultation should ensue in the meanwhile.
(ii) The Clerk said he had forwarded a short article to the editor of the
parish magazine for publication in the next edition but that a follow-up piece
could well be necessary.
c) (i) IPC would need to consider the cost for winter parking if it was
subsequently agreed to charge.
(ii) The Clerk said if different charges to this coming summer were agreed, a
new computer chip would be required for the car park machine.
d) Car Park resurfacing should be considered for the winter months 2013/14
e) An agreement should be drawn up between IPC and IM to ensure any surface
damage was repaired after vacation of the car park; to be discussed with IM.
f) (i) The Clerk said IPC had previously “agreed” to charge IM £1,500 for
winter parking 2012/13 on the assumption all the car park would be used. This,
he said, would need to be reconsidered and negotiated if only half of the car
park was to be used; to be discussed with IM.
(ii) In the long term IM should be “encouraged” to have its boat park
elsewhere in the winter so as to leave the car park free for parking; to be
discussed with IM.
g) The Clerk said that if IPC was to charge for the winter months 2012/13 the
off- street parking order would need to be amended.
h) The Clerk said that further meetings of the Car Park Sub Committee were
planned.
(ii) After a discussion IPC RESOLVED to have the Clerk deal with all items of
relevance to Instow Marine, namely, items (i) (a) (i), (i) (e) and (i) (f) (i)
and (ii) and to report back at the next meeting. (Action: The Clerk)

between 10am and “lunchtime” on Thursday 12th April 2012 to discuss the future
of this grant.

(f) Letter (dd February/March 2012)) from HM Revenue and Customs reference
“Important Notice for All Employers”: -
The Clerk said this stated that Employers Annual Return (P 14’s and P 35) for
the tax year 2011/12 must be filed online and by the 19th May following the
end of the tax year 2011-12. The Clerk said he would action this as necessary
in liaison with IPC’s IA. (Action: The Clerk)
(g) Tractor Tax Disc Application – From 1st April 2012: -
(i) The Clerk advised IPC he had received the relevant paperwork from DVLA
(10.3.12) and by way of the internet (email dd 10.3.12 refers) had ordered the
new tax disc. (Noted)
(ii) The Clerk then reported receipt of the tax disc (15.3.12) that he had
handed to Cllr Cook (Noted)
(h) Beach Cleaner’s Public Liability Insurance: -
The Clerk reported he was in possession of a copy of the beach cleaner’s

(i) The Clerk reported receipt (8.3.12) of this application and of having
passed it immediately to the Chairman for the attention of IPC’s PSC; for
reply by 26.3.12 or an extension to be applied for. (Noted)
(ii) The Clerk confirmed that an entry had been placed on the Instow website
for the information of parishioners. (Noted)
(iii) After a discussion, led by IPC’s PSC, IPC RESOLVED to recommend APPROVAL
of this application but to advise NDC Planning there was no mention in the
papers of a new door to be fitted adjacent to the wet room (as shown on the
plans).

The Clerk said this stated that NDC Planning had GRANTED permission for this

reference “Linwood, The Quay, Instow”(Reference No 53338): -
The Clerk said this referred to item 2202/12 (b) at the February meeting.

f) Email (dd 13.3.12) from Secretary of TTEF reference “Knapp House Marina
Plan”: -
(i) The Clerk said this stated the TTEF had just received notification that
the plans for this development (Marina and Housing) had been re-submitted to
TDC, the reference being 1/0138/2012/OUTM, and that the closing date for
comments was the 29th March 2012. He added that the TTEF (Planning and
Consultation Committee) would be discussing this matter at its meeting of 23rd
March and that any views would be appreciated. (Noted)
(ii) The Clerk reminded IPC it had discussed the former plans (IPC Meeting -
January 2010) and that the decision taken at that time was: -
“The Clerk advised IPC that as a result of various responses received from
Cllrs he had told TDC (3.1.10 – Planning Officers answer phone) that IPC had
some concerns reference silt deposits that may or may not end up on Instow
Beach if and when said development commenced”. He said this was ratified by
IPC. (Noted)
(iii) After a discussion IPC RESOLVED to forward the following “issues of
concern” to TTEF:-
• Increase in traffic in Northam
• Impact on the Environment
• Visual Impact (and change of character) as viewed from Instow’s side of the
estuary
• Possible mud deposits on Instow beach from building activity. (Noted)
(iv) IPC also RESOLVED to express its concerns (as above) to NDC and Cllr
Moores (NDC Instow) agreed to follow this up on its behalf. (Action: Cllr
Moores)
g) Email (dd 13.3.12) from NDC Planning reference “Methodist Chapel – Anstey
Way, Instow”: -
(i) The Clerk said this stated as follows: -
“Following concerns regarding the possible use of these premises for a
residential unit a site inspection was carried out; this showed that repairs
had been undertaken to a shower in the building, but there was no evidence of
occupation. Subsequently the Agents for the owners confirmed that the site was
being used for residential occupation, but that this had always been on site
as a consequence of occupation by The Minister. The building has not
previously been the subject of any planning applications, but has been
designated as a Listed Building. The listing description is silent in respect
of the internal layout of the building, other than referring to the first
floor Chapel. Given this circumstance there is no evidence to establish
whether this is correct or not. The Parish Council may have first-hand
knowledge as to the historic uses of the building. Notwithstanding this it
would be helpful if the Parish were able identify the harm that is being
caused, or has been caused by any residential occupation of the building given
that it is located within the village”.
