2504/3 POLICE REPORT
a) Crime: - (i) Constable Parker told Council that only 1 crime had been
reported within the parish between the 28th March and the 18th April and
that this involved the entering of a shed at the allotments in Anstey
Way and the theft of some tools from within. (Noted)
(ii) He added, however, that a spate of burglaries had recently taken
place within the Bideford and Fremington areas and that householders
within the parish should take care when leaving their properties
unattended. (Noted)
b) Other Matters: - (i) Constable Parker said he had received a
complaint about youths firing a paintball gun from a bridge within the
village at pedestrians using the Tarka Trail below; he said enquiries
were continuing. (Noted)
(ii) He said that the sponsored vehicle, used by the Neighbourhood Beat
Managers in the area, had recently been returned to the donor who was to
replace it in due course with an alternative vehicle. (Noted)

Taw and Torridge Estuary Forum Matters: - Mrs Rose Day (Chairman of
TTEF) addressed the meeting on current TTEF matters including Braunton
Burrows, South West Climate Change and Tourism Event, Northern Devon
Interpretive Plan, Fast Leisure Craft Joint Working Party, North Devon
AONB, Beach Lifeguards, Environment Agency Catchment Abstraction
Management Strategy Stakeholders Group, Appledore Quay Wall, Permanent
Mooring in the Fairway, Bathing Water Quality (Westward Ho! and Instow),
Planning Matters (Knapp Park Community Centre and Residential
Development and Richmond Dock, Appledore), RSPB Reserve at Isley Marsh
and Date of Next TTEF Meeting - 7 pm on the 18th July 2005 at Bideford
Town Hall. Cllrs were provided with a copy of the full paper Mrs Day

2504/5 REPORT COUNTY COUNCILLOR R CANN
a) General: - Cllr Cann spoke about the Proposed Instow Facilities (see
item 2504/8 (b)), Marine Parade Street Signs (new signs had been ordered
and are expected imminently - their erection will be prioritised),
“Calling In” of Planning Applications (Various i.e. 39404 (The Meadows),
39545 (Land at Lane End Close) and 39590 (5 Chichester Close)), New
Charter Toilets - Sandhills/Marine Parade (complete but awaiting the
completion of the footpath), Toilet Signage (has been requested) and
Greensweep - An Update. (Noted)
b) Various: - (i) Cllr White asked for an update of relevance to the
proposed Charter Toilets on the Quay Car Park. Cllr Cann said NDDC was
still deliberating over the current planning consent for flats on the
site and of its worth to the Council. (Noted)
(ii) Cllr Harper (Chairman) asked Cllr Cann whether the legislation
appertaining to Planning Enforcement was “ineffective” and referred in
particular to Plot 4, Lane End Close, Lane End Road, Instow (Planning
reference No 39723 - see item 2504/11(c)). Cllr Cann said each
application had to be treated on its own merit and it was not possible
to provide a conclusive answer to the question posed. (Noted)

2504/7 MINUTES
It was RESOLVED that the March Minutes of Instow Parish Council be
approved and signed. (Noted)
2504/8 MATTERS ARISING FROM THE MINUTES
(a) Item 2503/8 (a) - Instow Beach/Crown Estates Lease - Lifeguards: -
(i) The Clerk reported upon the actions taken since the last meeting; he
produced a draft beach sign that IPC RESOLVED to adopt (subject to one
or two minor changes) on the proviso it was inexpensive, amended as
agreed and sited at a location(s) subject to the satisfaction of Cllrs
Crombie/Johns. (Action: Cllrs Crombie/Johns/Clerk)
(ii) The Clerk explained that a specific draft risk assessment document
as regards the beach had yet to be produced although he did remind Cllrs
it was already included in IPC’s “all embracing” risk assessment
document. He said this was still in the hands of Cllr Crombie who hoped
to have it by the next meeting. (Action: Cllr Crombie)
(iii) The Clerk said the beach cleaner was now checking the “Crown
Estate” sands at least three times per week and recording it in written
form. (Noted)
(iv) No discussion ensued as regards beach lease re-assignment. IPC
RESOLVED to defer this for further debate at the next meeting. (Action: IPC)
(v) The Clerk advised IPC the Allianz Cornhill had confirmed (email of
16.3.05 refers) that it would require an additional premium to cover the
beach of £225.26 - this was noted by Council. (Noted)
(b) Item 2503/8 (b) - Sandhills Ransom Strip: - (i) IPC’s Ransom Strip
Sub Committee (Cllrs Harper, Scott and White) gave a brief report of a
recent meeting of the Ransom Strip Steering Group that was held on
Thursday 7th April at The Civic Centre, Barnstaple. The Clerk drew the
meeting’s attention to a letter (dd 11.4.05) from Cllr Cann reference
“Proposed Facilities Instow” together with a report entitled “Proposed
Instow Facilities” that he had copied to Cllrs with their agenda papers
(13.4.05). After discussion it was RESOLVED (Cllr Harper abstained) to
await the conclusion of the feasibility study, currently being
undertaken (at the behest of the Steering Group) by Brian Holme (NDDC),
in connection with a proposal for a recreation field/all weather sports
facilities at the new Instow School and then to deliberate whether
further consultation with the community was appropriate. (Noted)
(c) Item 2503/8 (c) - Parish Emergency Plan Update: - The Chairman
updated IPC as to progress - i.e. a meeting is being arranged between
IPC’s EPSC and DCC Emergency Planning Officer Matthew Hoy. (Noted)
d) Item 2503/9 (i) (g) - IPC Traffic Management Sub Committee/Refuge at
Anstey Way/Rectory Lane: - The Clerk updated IPC as regards his liaison
with DCC Local Services, Barnstaple; he referred to email reply (dd
5.4.05) that stated it would receive consideration by DCC but that it
might not become a reality during the current financial year. The Clerk
added that Cllr Cann had informed him he would do all he could to
establish this scheme during the current financial year. (Noted)

(i) The Clerk reminded Cllrs he had circulated an updated copy (1st
April 2005) of IPC’s Meeting Dates 2005 with their agenda papers
(14.4.05) and confirmed that further copies had been published
throughout the parish. (Noted)
(ii) The Clerk circulated updated copies of IPC Cllr Details (April
2005) to Cllrs at the meeting and confirmed that publication throughout
the parish would be done by him asap. (Noted)
b) (i) Letter (dd March 2005 - received 18.3.05) from NDDC (Don Pratt
Deputy Returning Officer) concerning “5th May 2005 - Devon County
Council Elections”: The Clerk said this letter requested that copies of
“Notice of Election” be put up within the parish asap and that this had
been done by him on 18.3.05. (NB: - See also item (iii) (p) below

(ii) Letter (dd April 2005 - received 9.4.05) from NDDC (Don Pratt
Deputy Returning Officer) concerning “5th May 2005 - Devon County
Council Elections”: - The Clerk said this letter requested that copies
of the “Statement of Persons Nominated” and “Notice of Election Agents”
for the County Council Election (5th May) be placed throughout the
parish; this had been done by him (13.4.05) and that previous notices as
at b) (i) above were removed as requested. (Noted)
(iii) Letter (dd April 2005 - received 19.4.05) from NDDC (Don Pratt
Deputy Returning Officer) concerning “5th May 2005 - Devon County
Council Elections”:-The Clerk said this was yet another notice - “Notice
of Poll” - that had been placed on all parish notice boards by him

(c) Letters x3 (dd April 2005 - received 13.4.05. 19.4.05 & 20.4.05)
concerning “Parliamentary Election 5th May 2005: - The Clerk said these
letters referred to various notices (Notice of Election, Notice of
Statement of Persons Nominated/Notice of Poll and Notice of Election of
Election Agents) that he had placed on parish notice boards (13.4.05 &
20.4.05). (Noted)
d) Telephone call from a former parishioner of Instow reference VE/VJ
Day (60th Anniversary): -The Clerk said this person enquired as to
whether Instow was to celebrate this day. He added that the enquirer was
born in Instow on 15.8.1945 and would like to attend any proposed
celebrations. The Clerk said he had spoken to the Instow Church Warden
and that as far as he was aware nothing was planned. Cllrs were
similarly unaware of any impending celebrations. (Noted)
e) Letter (dd 21.3.05) from Defra concerning “QUALITY Parishes and
Parish Planning”: - The Clerk said this letter had been copied to Cllrs
with their agenda papers (14.4.05) and was for noting. The Clerk advised
Council that he was about to put together the necessary paperwork for
IPC’s application for QP status. (Noted)
f) Letter (dd March 2005) from Community Council for Devon reference
“Devon Calor Village of the Year Competition”: - The Clerk said this
letter had been copied to Cllrs with their agenda papers (14.4.05).
After discussion it was RESOLVED that ex IPC Cllr Mrs C Grant would
complete the necessary paperwork on behalf of the parish. (Noted)
g) Draft IPC Annual Report for Municipal Year 2004/5: - The Clerk
reminded Cllrs he had circulated a copy of this to them with their
agenda papers (13.4.05). After discussion it was RESOLVED to adopt the
report as written and to suitably circulate it throughout the parish.

h) (i) Email (dd 12.4.05) from a parishioner concerning “Instow Beach”
and (ii) Email (dd 12.4.05) from Barnstaple Residents via IIB concerning
“Beach Cleaning - Instow Beach”: - (i) The Clerk advised IPC of the
content on the emails and update them on current practice/progress for
the 2005 season. After discussion it was RESOLVED to work closely with
Instow In Bloom (IIB) and The North Devon Coast and Countryside Service
(NDCCS) so as to establish a revised and considered strategy for beach
cleaning which it was agreed would need to be within the current rigid
budgetary constraints. The Clerk was asked to liaise with IIB and NDCCS
and report back to IPC. (Action: The Clerk)
(ii) It was further RESOLVED that Cllrs Johns and Ms A Mayoh would
attend the next “Adopt a Beach” meeting with a view to explaining IPC’s
current beach strategy/budgetary constraints and to consider other
options/views as a consequence that might be deemed as commensurate and
inclusive with the views of IIB and NDCCS (see (i) immediately above).

(iii) It was further RESOLVED that to alleviate some of the litter
problems on the beach that a sentence be added to IPC’s beach signs (as
at item 2404/8 (a)) requesting that litter be taken home or placed in
the rubbish bins as provided at or near the beach. (Action: The Clerk)
(iv) It was further RESOLVED the Clerk should liaise with Cllr Cann to
ascertain whether NDDC/South Molton Recycling might be disposed to
assist IPC with the disposal of rubbish cleared off the beach. (Action:
The Clerk)
(v) It was further RESOLVED the Clerk should contact South West Water to
establish information as regards its Pennon Fund (Grant). (Action: The
Clerk)

i) Letter (undated - received 19.4.05) from NDDC reference “The New
Licensing Arrangements”: - The Clerk said he had provided a copy of the
letter for Cllrs at the meeting; he also drew the attention of Cllrs to

(j) Letter (dd 13.4.05) from parishioner reference “Traffic Congestion
in the Village of Instow”: - (i) The Clerk read the letter to Council at
the conclusion of which a discussion ensued. It was RESOLVED the Clerk
should contact the Police and request frequent visits by police and
traffic wardens to deal with selfish motorists who continually abused
the no waiting/limited waiting orders along the seafront and thus
causing traffic congestion. (Action: The Clerk)
(ii) It was further RESOLVED the Clerk should write to the parishioner,
thank him for his interest, point out that no other complaints of a
similar nature had been received (in fact to the contrary), that IPC was
not in favour of a one-way system throughout the village (elderly
residents living at or near Marine Parade cannot walk up to Anstey Way
for example to catch a bus/a one way system along the seafront could
encourage speeding) and that IPC, together with Cllr Cann, would monitor
the situation throughout the summer. (Action: The Clerk)

5. MISCELLANEOUS: -
(a) Beach Grant 2004: - (i) The Clerk reported on progress since the
last meeting, that is, no cheque received as of 21st April 2005 despite
the fact that NDDC (Community Grants Department) had “inferred” it was
imminent. (Noted)
(ii) The Clerk said that any grant monies received hereafter would now
appear in IPC’s 2005/6 accounts. (Noted)
(b) War Memorial - Insurance: - (i) The Clerk advised Council he had
written to the Allianz Cornhill (AC) and requested a quotation to add
the War memorial to IPC’s current public liability insurance policy.
(Noted)
(ii) The Clerk then referred to an email (dd 11.4.05) from the AC that
stated it would cost IPC the sum of £175.44 plus IPT = £184.21 for
Impact cover and £265.74 plus IPT = £279.03 for All Risk cover; the
property damage excess of £125 applied. After discussion it was RESOLVED
to put this matter on hold until a response had been received from the
alterative insurance company as at (c) below. (Noted)
(c) Public Liability Insurance Cover 2005/6: - (i) The Clerk reported
receipt of a renewal notice for this policy = £600.93 (approx £100 more
than 2003/4); he reminded Council this did not include cover for the war
memorial (as at (b) above) or the necessary cover for the beach that had
already been quoted at £225.26 (see item 2404/8 (a) (v)) (Noted)
(ii) The Clerk then suggested that he and Cllrs Crombie and Scott (as
for 2004/5) reviewed the policy renewal and its cover and in addition
seek out an alternative company. The Clerk said he had recently received
a letter from the DAPC (dd 22.3.05) “recommending” an alterative
insurance company known as the Zurich Municipal (operated through
“Community First” {the Rural Community Council for Swindon and
Wiltshire}) and who offered discounted insurance schemes for smaller
parish councils in Devon. IPC unanimously RESOLVED to support this
suggestion and the Clerk together with Cllrs Crombie and Scott were
asked to act accordingly and with due diligence. (Action: Cllr

(d) Reclaiming of Vat: Not Registered: - The Clerk reported that a claim
for £90.11 had been sent by him to HM Customs and Excise on 1.4.05 and
that said sum had already been received via BACS; see item “Income”

(e) Draft Annual Accounts 2004/2005: Councillors were provided with a
copy for their perusal. Cllr White said it had been checked by him
(14.4.05) with the financial records and found to be in order. (Noted)

Clerk referred to a copy of this paper that had been circulated to Cllrs
at the meeting. Cllr White said it had been checked by him (14.4.05)
with the financial records and found to be in order. (Noted)
(i) Inland Revenue - End of Year (2004/2005) Returns (P35 and P14s’): -
The Clerk confirmed that this had been completed and sent to Inland
Revenue. (Noted)
(j) Letter (undated - received 14th April 2005) from Audit Commission
(AC) together with Annual Return for the Year ended 31st March 2005 and
associated papers: - The Clerk confirmed he was to meet up with Mr G Day
(IPC’s IA) asap and take the necessary action. He said the appropriate
paperwork needed to be completed and returned to the AC by the 18th July

(k) Letter (dd 18.4.05) from Instow-Arromanches Twining Association (Mrs
E M Booth - Hon Secretary) reference grant 2005/6: - The Clerk said this
letter asked that IPC consider a request for a donation to the Twinning
Association. After discussion it was RESOLVED the Clerk should write to
Mrs Booth and enquire as to what sort of project any grant might be put
towards and how much this might cost. (Action: The Clerk)
(l) Letter (dd 12.4.05) from DCC (County Environment Director) regarding
Parish Paths Partnership Scheme 2005/6: - The Clerk said this letter
confirmed that Instow had been awarded £285.00 for the P3 Grant 2005/6
(already received - February IPC Meeting 2005) made up as follows: -
£160.00 Mileage Rate, £100.00 Special Projects and £25 Administration.

2504/11 PLANNING
a) Extension to dwelling together with a balcony at 10 White House
Close, Instow (Reference No. 39662): - (i) The Clerk reported original
receipt (14.3.05) and of having posted it to the Chairman (14.3.05) for
the attention of IPC’s PSC, for hopeful deliberation at IPC on 17.3.05
(deadline date for a response 1st April 3005). However, the Clerk
reminded Council that said application had gone astray in the post and
had not arrived by 17.3.05, the date of the last meeting. (Noted)
(ii) The Clerk reported that a second copy of the application was
eventually received by the Chairman (19.3.05) who had then passed it on
to IPC’s PSC. (Noted)
(iii) The Clerk said that in the light no contact had been made by IPC’s
PSC to him on the 1st April, he had applied for an extension from NDDC
Planning (Mr Heard - 1.4.05) and the deadline had been extended to
22.4.05. (Noted)
(iv) After deliberation, led by IPC’s PSC, Council unanimously RESOLVED
to recommend approval of this application. (Action: The Clerk)
b) Erection of a dwelling on land at Lane End Close, Instow (Reference

IPC he had spoke to the writer (23.3.05) and confirmed the letter was in

c) Repositioning of approved dwelling (amendment to planning permission
35529) at Plot 4, Lane End Close, Lane End Road, Instow (Reference No
39723): - (i) The Clerk reported receipt (26.3.05) of this application
and of having posted it to the Chairman (26.3.05) for the attention of
IPC’s PSC - for response by 13.4.05 or an extension to be applied for.

(ii) The Clerk said that in the light no contact had been made by IPC’s
PSC to him on the 12th April, he had applied for an extension from NDDC
Planning (Mr Heard - 12th April) and the deadline had been extended to
22.4.05. (Noted) (iii) The Clerk advised IPC he had received a telephone
call from Mr David Heard (Planning Officer NDDC) on 20.4.05 to explain
that the building in question was only 0.5 metres out of alignment (i.e.
approx 1’6”) from that which had been previously approved and that a
Planning Enforcement Officer had advised the builder several times of
this fact prior to (and whilst) the building being completed. He added,
for information that IPC should note that Planning Enforcement Officers
powers are often inconclusive/subject to interpretation/flexible
particularly when it was believed that to strictly enforce them would be
overturned on appeal. (Noted)
(iv) After debate, led by IPC’s PSC, it was RESOLVED to recommend
refusal of the application on the grounds it had “knowingly” been built
in the incorrect location - 2 Cllrs abstained. (Action: The Clerk)
d) Conversion of Dwelling and Post Office to form 2 Dwellings at 1 South
View, Marine Parade, Instow (Reference No. 39766): - (i) The Clerk
reported receipt (4.4.05) of this application and of having posted it to
the Chairman (4.4.05) for the attention of IPC’s PSC; for response by
22.4.05 or an extension applied for. (Noted)
(ii) The Clerk read out a copy of a letter (dd 20.4.05) from a

(4.4.05) for the attention of IPC’s PSC, for response by 22.4.05. (Noted)
(ii) Cllr Johns provided IPC with a resume of the letter and recommended
that the proforma attached be completed along the lines that IPC be
consulted at all times on relevant issues to the parish and adjoining
areas. IPC RESOLVED to adopt this recommendation; Cllr Johns to complete

f) Letter (received 9.4.05) from NDDC reference “Extension to dwelling
together with formation of terrace and associated works at Sandpipers,
Anstey Way, Instow (Reference No 39451): - (i) The Clerk said this
letter stated that NDDC had GRANTED permission for this application with
conditions as listed. He said a copy of the letter had been given to
Cllrs with their agenda papers (14.4.05). (Noted)
(ii) The Clerk read out a copy of a letter (undated) from a parishioner
to NDDC Planning concerning this application. (Noted)
(iii) After deliberation IPC RESOLVED to write to NDDC’s Planning
Department and express its support to the writer of the letter and make
a request that it be associated with the concerns and apprehension of
the writer in respect of the future use of the property. (Action: The
