a presentation given by David Barrett (Acting Head of NDC Licensing) and
Trevor Blatchford (NDC - Contentious Law) on “Street Trading”. A handout
(attached to these minutes) was distributed and referred to.

PC Hodgson reported as follows: -
a) Crime: -
No crime has been reported in the parish since the last meeting. (Noted)

2 incident logs had been created since the last meeting namely, public
safety/domestic incident non-crime (x1) and public safety/suspicious
circumstances/insecure premises/vehicle – welfare check (x1) (Noted)
c) Scam Emails/Telephone Calls: -
Arising from various questions from the floor PC Hodgson gave advice and
guidance on how to deal with these matters. (Noted)
d) Neighbourhood Policing (NP): -
(i) PC Hodgson explained that due to a shift to a new policing system to deal
with alcohol related matters, it had not been possible for him to perform his
NP duties as he would have liked. He also agreed that this change in policing
had also impinged on PCSO Meaker’s NP commitment even to the extent that she
could not attend and “police” the Community on Show Day in Instow (16th July).

(ii) IPC RESOLVED to convey its concerns as regards this unsatisfactory state
of affairs to the local Police Commander. (Action: The Clerk)
2106/5 PARISHIONERS
a) Traffic Congestion/Obstruction – New Road/Anstey Way: -
(i) A parishioner highlighted recent problems in this vicinity where, due to
the amount of parked cars, large vehicles, such as the refuse lorry, had
recently been unable to enter New Road. She expressed concern should ever a
fire engine, for example, try to pass in an emergency. (Noted)
(ii) After a discussion, PC Hodgson agreed to look at short term measures such
as placing cones in the vicinity. (Noted)
(iii) Cllr Cann also agreed to consider a suitable traffic order at said
location to combat this problem and in doing so told IPC he had already
liaised with DCC Highways with that in mind. (Action: Cllr Cann)
(iv) It was noted there were already some yellow lines in the vicinity, albeit
mostly covered by vegetation and the like although there were no signs of
relevance to a specific traffic order. (Noted)
b) Community on Show 2011: -
A parishioner asked for IPC’s assistance to organise this event from a
marshalling point of view and said that any volunteers Cllrs would really be
appreciated. (Noted)
c) Various Matters: -
(i) A parishioner spoke on Venn Cross Bus Shelter (broken glass), Webcam –
Marine Parade, Westward Ho! – Parking Meters and Street Trading. (Noted)
(ii) IPC RESOLVED to have the handyperson deal with the Venn Cross Bus Shelter
and note the other matters. (Noted)
2106/6 REPORT COUNTY COUNCILLOR R CANN
(i) General: - Cllr Cann spoke of the following matters, namely “All Saints
Chapel Community Project” (the grant of £2.5K had now been paid), “Westleigh
Junction” (contract as at 5th September with a completion date of 9th
December). “Councillor Allowance Scheme” (this had dropped by nearly £100,000
in the past 2 years), “Greater Local Decision Making” (more money was being
devolved to local Cllrs on improving their districts; a total of £300,000 was
being shared between the 8 county council committees), “Sand Management –
Instow” (is once again in discussions with NDCCS as regards measures to help
control the sand drifting on to the highway) and “Ferry Funding Update” (has
agreed a funding bid request for £3K to help this project). (Noted)
(ii) Street Parking: -
Cllr Cann said he was in the throes of arranging either a public exhibition or
public meeting to further this initiative adding that he had no intention of
imposing a system that was not to the liking of the community. (Noted)
2106/7 REPORT OF DISTRICT COUNCILLOR B MOORES
(i) Section 215 Town and Country Planning Act 1990:-
(a) Cllr Moores said that in response to a prompt by Cllr Harper he had
liaised with NDC’s Planning Department and had drawn up a list of dilapidated
and dirty buildings in the parish to which this act of parliament could
appertain. A discussion ensued at the conclusion of which IPC RESOLVED to
support this initiative and other similar buildings in the parish were
included. (Noted)
(b) Cllr Cann added that the current Executive had already recognised this
problem as being area-wide and that an internal enquiry was in hand to
establish the depth of the matter and what could be achieved. He said it would
eventually go to the Scrutiny Committee for review. (Noted)

(ii) The Sands, Marine Parade, Instow: -
Cllr Moores provided IPC with an update at the conclusion of which IPC
RESOLVED to write to NDC Planning and express its deep concern at the lack of
action and current dilapidated state of the building. (Action: The Clerk)
(iii) Kiln Close Lane Development: -
Cllr Moores provided IPC with an update (estimated start date November 2011)
at the conclusion of which IPC RESOLVED to write to NDC Planning and enquire
as to the current state of the planning process that, to date, had not been
conveyed to IPC. (Action: The Clerk)
(iv) Ferry Project: -
Cllr Moores confirmed that the DCC grant had been received. (Noted)
2106/8 MINUTES
It was RESOLVED that the May 2011 minutes of Instow Parish Council be approved
and signed. (Noted)
2106/9 MATTERS ARISING FROM THE MINUTES
a) Item 2105/12 (a) – Management of Quay Car Park/Refurbishment of Toilets: -
(i) The Clerk advised IPC of the receipt of a further email (dd 6.6.11) and
attachment from NDC providing answers to all the outstanding “pertinent”
questions originally posed by IPC. (Noted)
(ii) The Clerk provided a copy of the email and attachment (as at (i) above)
to Cllrs at the meeting. (Noted)
(iii) After a discussion IPC RESOLVED to have the Clerk liaise on its behalf
with the new Executive/Appropriate Portfolio Holder(s) of NDC in order to
establish that the deal, as offered by the previous Executive, was still
available and if so to commence to instruct a solicitor to act on its behalf
to facilitate the transfer of the car park to Instow Parish Council. (Action:

(i) The Clerk advised on progress since the last meeting, namely: -
a) Email (dd 27.5.11) and attachment from Cllr Green to Cllrs Thomas and
Harper reference “Instow Beach Surveys”; the Clerk elaborated. (Noted)
b) Email (dd 27.5.11) from Secretary of TTEF reference “EA – Barnstaple Yeo
Water Framework Directive Pilot”; the Clerk advised IPC that this paper had
already been received direct from EA and noted at the last meeting. (Noted)
c) The Clerk confirmed he had replied (29.5.11) to an email received (26.5.11)
from a regular visitor to Instow and that had been discussed at the last IPC
meeting. Cllrs were provided with a copy of the original email (dd 26.5.11),
the Clerk’s reply (dd 29.5.11) and the visitor acknowledgement email response
(dd 30.5.11). It was noted that the visitor had been grateful to receive a
full explanation of Instow’s water quality issues and which had put the recent
national publicity into context. (Noted)
d) Email (dd 31.5.11) and letter from NDCCS reference “Beach De-designation –
Consultation”; a copy of the letter was provided to Cllrs at the meeting for
their perusal. A discussion ensued during which time it was noted that
de-designation was apparently not the wish of the “landowner of a significant
part of the rest of the beach” (other than that leased by IPC from the CE)
albeit that IPC was still awaiting a reply to its letter (dd 3.5.11) from said

should be carried out; Defra had suggested between 11am and 3pm whereas it was
in the opinion of IPC better to do so 2 hours before and after high tide. The
Clerk was asked to write to Defra.

email that DCE does not appear to be of a mind to seek de-designation for its
parts of the beach. (Noted)
r) Email (dd 15.6.11) from EA reference “Feedback on Weekly Bathing Water
Report”; the Clerk advised IPC that he had responded to this survey and
commented that it was a shame that 100+ pages of results throughout the SW was
forwarded to all recipients when only 1 (maybe up to 2 pages) was relevant to

s) Email (dd 16.6.11) from EA reference “Weekly Bathing Water Update”; The
Clerk said it would seem that Instow still had no fails to date. (Noted)
ii) IPC then discussed the way forward by identifying actions necessary to
back up its possibly subsequent claim for de-designation as well as the
strategy for the continuance of bather surveys throughout the summer period.
It was RESOLVED that Cllrs White, Green, Harper and Thomas would lead on this
matter and report back to IPC on a needs basis. (Action: Cllrs White, Green,

(iii) It was further RESOLVED to communicate with DCE in order to facilitate a
response to IPC’s original de-designation letter of 3.5.11.

(iv) The Clerk advised IPC that the beach (warning) signs were on order and
awaiting production/collection; hopefully by w/c 20.6.11. He said once
received they would be erected. (Noted)
c) Item 2105/12 (c) – Salt/Grit Bins/Community Clusters: -
The Clerk advised IPC that a further entry had appeared in the June parish
magazine and that to date 4 persons had come forward; the Clerk suggested that
perhaps Cllrs could approach potential parishioners direct within their own
areas particularly where “winter road” problems were most likely. IPC RESOLVED
to adopt this suggestion and to act accordingly. (Noted)
d) Item 2105/12 (d) - Traders’ – Marine Parade: -
In response to the presentation on “Street Trading” at the beginning of the

(i) The Clerk advised Council that following liaison (various emails 27.5.11 -
1.6.11) with the Executor of the late Dr Alison Grant it had been agreed that
the copyright of the Instow Millennium Book should now rest solely with IPC.

(ii) The Clerk further advised IPC that following (i) above he had liaised
(emails of 1.6.11 to 11.6.11) with the publisher of the book (Honeytone
Printers) and she had confirmed that the copyright of the Instow Millennium
Book now rested with IPC and that any person(s) wishing to copy from the book
or borrow any of the original photos (from her) must pay IPC (whatever fee
Cllrs think appropriate). He said she had also confirmed she held the
remainder of the books and all the working papers. (Noted)
(iii) The Clerk reported receipt of an email (dd 15.6.11) from the publisher
of the book setting out a “Sitrep” Inventory of the Instow Millennium Book as
of 15th June 2011; the Clerk elaborated. A copy of that inventory is attached

(i) The Clerk provided Cllrs with a copy of the current “Appointments” list –

(c) “Marine Car Park, Instow – Summer Let”: -
(i) The Clerk advised IPC that following enquiries with Metric he had
ascertained that a new machine, as discussed at the last meeting, (Red - £550
plus VAT) would come with a 6 month guarantee only. He said it would be
useful, therefore, if the current machine could “last” the current summer
period and then have the new machine fitted for 1.5.12; the 6 month guarantee
period would then cover the summer of 2012. (Noted)
(iv) IPC RESOLVED to support this recommendation provided Metric would be
happy with the arrangement and that if the current tickets ran out before the
end of the season it did not mean buying replacement tickets in bulk; Clerk to
liaise with Metric to ascertain their thoughts on the matter and to establish
whether a small number of tickets could be purchased locally to see out the
season if required.

a) Extensions and alterations to dwellings and erection of replacement garage

(i) The Clerk reported receipt (dd 27.5.11) of this application and of having
passed it immediately to the Chairman for the attention of IPC’s PSC; for
response by 15.6.11 or an extension to be applied for. (Noted)

c) Email (dd 27.5.11) from DALC reference “Relaxation of Planning Rules”: -
(i) The Clerk said this stated that the government was committed to changing
the planning system so that it could contribute much better to economic growth
and free up more land for housing; the governments planning reforms sought to
incentivise growth from the bottom up. (Noted)
(ii) The Clerk added that it went on to say that in order to gauge the views
of relevant stakeholders etc a consultation exercise had been set up by the
Communities and Local Government Dept; this began on 8th April and closed on
30th June 2011. (Noted)
(iii) The Clerk said that NALC/DALC was keen to provide a measured response
and was asking that Councils advised them of their thoughts on the matter.

d) Emails (various – 31.5.11 etc) from Cllr Harper reference “Dirty/Derelict
Buildings – Section 215 Town and Country Planning Act 1990”: -
(i) Cllr Harper briefed IPC and elaborated on this Act’s possible usage in
Instow itemising particular properties that might be relevant. (Noted)
(ii) The Clerk advised IPC that he had forwarded the relevant emails to Cllr
Moores (NDC) so as to determine how NDC interpreted the powers of this act and
as to how they were used; it had been acknowledged by Cllr Moores. (Noted)
(iii) The Clerk reported receipt of an email (dd 13.6.11) from Cllr Harper
attaching a copy of Section 215 Town and Country Planning Act 1990; it was
noted that Cllr Harper had also copied it to other IPC Cllrs with email
addresses. (Noted)
(iv) The Clerk reported the receipt of an email (dd 16.6.11) from Cllr Harper
entitled “Grot Spots”; it was copied to Cllrs at the meeting - Cllr Harper
elaborated. (Noted)
(vi) IPC RESOLVED to have Cllr Moores (NDC) further liaise with NDC Planning
and come back to Council with a strategy. (Action: Cllr Moores)

f) (i) Extension of Time Limit for implementation of planning application
41172 for outline application for erection of 7 dwellings together with
improved access and visibility works on to Quay Lane at Mollands Garage, Quay
Lane, Instow (Reference No 52220) and (ii) Extension of Time Limit for
implementation of planning application 41173 for conservation area application
for demolition of non-listed buildings in connection with erection of 7
dwellings together with improved access and visibility works on to Quay Lane
at Mollands Garage, Quay Lane, Instow (Reference No 52222): -
(i) The Clerk reported receipt (2.6.11) of this application (having prompted
NDC Planning who alleged the original paperwork had been sent 23rd May 2011)
and having had a discussion with the Chairman and IPC’s PSC. (Noted)
(ii) The Clerk confirmed that both these applications had been posted on the
Instow Website for the information of parishioners. (Noted)
(iii) The Clerk advised IPC that IPC’s PSC had resolved to recommend APPROVAL
of these applications but to re-iterate the need (as previously expressed in
41172/41173) for affordable housing to be included in the development. (Noted)

(Reference No 51226): -
(i) The Clerk said this stated that an appeal had been made to the Secretary
of State against the decision of the local planning authority to refuse
planning permission for the above; the Planning Inspectorate considered that
it was appropriate for the appeal to be dealt with under the Householder
Appeal Service (HAS); this procedure does not offer the opportunity for
interested parties to comment at the appeal stage. (Noted)
(ii) The Clerk provided a copy of the letter to Cllrs at the meeting. (Noted)
(iv) The Clerk reminded IPC it had recommended APPROVAL of this application at
its February 2011 meeting. (Noted)

(i) The Clerk said this stated that the local planning authority had
determined that these (the “submitted details” – letter of 13.5.11 refers)
were acceptable as a non-material amended to application 49427 and that the
works were now required to be carried out in accordance with these details;
Cllrs were provided with a copy of the letter for their information. (Noted)
