2206/5 PARISHIONERS
a) Planning Application Linwood, Marine Parade (Planning reference no
53688/53689) – see also item 2206/12 (i): -
A parishioner said he felt that this application’s design should reflect more
of the style of the late 19th/early 20th Century that would make it more in
keeping with adjoining properties and appropriate to a conservation area.

b) Cycling on the Footpath: -
A parishioner said she was witnessing more and more cyclists cycling on the
footpath despite there being signs forbidding it; she wondered if the current
signs could be made more prominent or indeed added to. IPC RESOLVED to seek
the guidance of DCC as regards signage although it was of a view that an
increase in signage was not necessarily the answer. It was further RESOLVED to
advise the police so as to enforce the legislation. (Action: The Clerk)
c) Urination in the Street/Kiosk (Marine Parade): -
(i) A parishioner said she had recently found it necessary to castigate
several people for using the vicinity of the kiosk (Commodore Slipway) as a
toilet area despite there being public toilets in the nearby car park. IPC
RESOLVED to advise the police with a request that they gave this matter
attention. (Action: The Clerk)
(ii) The parishioner was advised to contact the police (on non emergency
telephone number 101) if similar incidents were witnessed. (Action:
Parishioner)
d) “Poly” The Heron Sculpture – Anstey Way: -
A parishioner enquired if this damaged statue was to be repaired; the Clerk
advised her that from emails he had seen from IIB members this was highly
probable if it were easily achievable and at reasonable cost. (Noted)
2206/6 REPORT COUNTY COUNCILLOR R CANN
a) Marine Parade, Instow – Resurfacing: -
Cllr Cann said he was delighted to report that this project had now been
agreed to by DCC and would most probably take place after the summer tourist
season. It would cover the stretch from the slabs at the Quay end to the Dunes
car park entrance. The Chairman thanked Cllr Cann for his persistence with
this much needed project and for achieving such an excellent result. (Noted)
b) Residents Parking Update: -
Cllr Cann said he was to enlist the help of local supporters of this scheme to
“knock on doors” and thereby seek the views of the whole of the parish adding
that to date most of those who had responded were in favour of such a scheme
but that the numbers of parishioners so involved were in the minority overall.
He said such a scheme needed to have the support of the whole of the parish or
it would not take place. (Noted)
c) Instow Car Park: -
Cllr Cann said a draft “Heads of Agreement” was now with IPC (from NDC) and
that the Clerk would report further later in the meeting. (Noted)
d) General: -
Cllr Cann also spoke of “Former Fremington Army Camp – Development” (he said
he had taken the unusual step of “calling in” this application to DCC’s
Development Management Committee that had resulted in said committee resolving
to recommend approval of a traffic signal junction as a means of accessing the
proposed development site. It did, however, recognise that for the most part,
the site lay within a conservation area and as a result DCC would support a
simple junction which makes appropriate provision for all road users; DCC’s
recommendation concluded that NDC should encourage the developers to carry out
discussions with the relevant land owners), “Roundswell School Site” (he said
DCC had acquired this land for a school early in the development of Roundswell
but in recent years had declared it unsafe because of the close proximity of a
mobile aerial. He said DCC were now supporting an alternative site for a new
school at Tews Lane (as part of a major development) albeit was objecting to
its development as it forms part of a site of important mineral deposits {Fremington
Clay}. He added that DCC were now considering using the land at Roundswell for
the delivery of an Extra Care Housing Scheme comprising 50 flats with any
remaining land going for sale on the open market – he said he was not in
favour) and “Devon Waste Core Strategy (Roundswell Site)” (he said nearly all
parish councils in the immediate area had written to DCC in support of his
view that this much needed strategic waste recovery facility should be sited
at Brynsworthy and not Roundswell – he thanked IPC for its support). (Noted)
e) Roundabout – Sainsbury’s: -
Cllr Cook thanked Cllr Cann for arranging for this roundabout to be tidied up
and “lowered”; he said visibility had been much improved. Cllr Cann said that
regrettably it was now more of a traffic hazard than before. (Noted)
f) Torridge Bridge – Slip-road to Instow/Westleigh: -
Cllr Crombie said that visibility at this location, especially at the junction
of the slip road that came off the link road from the Bideford direction to
Instow/Westleigh and met the slip road from the Barnstaple direction to
Instow/Westleigh was seriously hampered by the tall growth of vegetation
(yellow rape plants) at said location. Cllr Cann agreed to report this to the
appropriate DCC department. (Action: Cllr Cann)
g) Rectory Lane – Overgrown Hedge: -
Cllr Cook said this hedge that had been reported many times before was again
seriously overgrown and making it impossible to walk up and down the hill
without having to walk in the middle of the road. This, he said, was dangerous
to the children attending the school and needed urgent intervention. Cllr Cann
agreed to report this to the appropriate DCC department. (Action: Cllr Cann)
h) Rectory Lane – Repairs to Highway: -
Cllr Thomas reported that this road had had its defects marked out with white
paint and that work had commenced on some of them. (Noted)
i)Venn Cross Bus Shelter – Solar Light: -
Cllr Cook said the light at this location was not working; IPC RESOLVED to
have the Clerk check it out as it belonged to IPC. (Action: The Clerk)
j) Rectory Close – Weeds: -
Cllr White said the weeds at this location were unsightly; Cllr Cann said it
was not the policy of DCC to deal with this. The Clerk agreed to see if the
Parish Lengthsman, when in the area, might deal with it. (Action: The Clerk)
2206/7 REPORT OF DISTRICT COUNCILLOR B MOORES
General: -
Cllr Moores referred to “The Sands” (he said he was to attend a meeting on
site with Cllr Cann and the Owner/Agent on Wednesday 27th June), “1-4 Kiln
Close Lane Development” (he said work had commenced on the demolition of the
existing flats) and “NDC/Torridge Joint Working” (he said NDC and Torridge
were to have joint management of Financial Services and Waste and Recycling
with possible savings up to £80,000). (Noted)

It was RESOLVED that the May 2012 minutes of Instow Parish Council be approved
and signed. (Noted)
2206/9 MATTERS ARISING FROM THE MINUTES
a) Item 2205/7 (e) – “Complaint/IPC”: -
(i) The Clerk reported that a copy of the “complaint” letter, as promised by
the complainant at the last meeting, had not been received by him and from an
enquiry made of NDC’s Monitoring Officer (20.6.12) no complaint has reached
him that would have necessitated the setting up of an Assessment Committee.
The Clerk also confirmed that the complainant had not chosen to invoke IPC’s
complaints procedure as she had not been in contact with him. (Noted)
(ii) IPC, in noting the above facts, RESOLVED to take no further action.

b) Item 2205/11 (b) – “Residents Parking (RP) Consultation”: -

c) Item 2205/11 (c) and (f) - “Diamond Jubilee Celebrations (Village and
School)”: -
(i) Favourable feedback was provided to Council by Cllr Moores (Village and
School) and Cllr Thomas (School); IPC RESOLVED that the Clerk should send a
letter of thanks to the pupils who had invited Cllrs to their event and that
IPC should publicly thank all those members of the community who arranged the
parish’s very successful event, especially Cllr Cann (DCC) for funding it (by
a grant) to the tune of £600; it was RESOLVED to place an article in a
forthcoming parish magazine – Clerk to deal.

d) Item 2205/11 (d) – “Management of Quay Car Park/Refurbishment of Toilets”:
-
(i) The Clerk reported receipt of a letter (dd 11.6.12) and attachment (NDC
standard lease terms - for information only) from NDC Head of Property and
Technical reference “Instow Car Park”; the Clerk provided Cllrs with a copy of
the letter and recommended that a copy (and the NDC standard lease terms) be
forwarded to Ian Budge (Solicitor – Brewer, Harding and Rowe) for his
information and subsequent guidance to IPC adding that he was willing to carry
out this service. IPC RESOLVED to adopt this recommendation. (Action: The
Clerk)
(ii) The Clerk also reported receipt of a letter (dd 15.6.12) from
Non-Domestic Rates SW reference “Instow Car Park, The Quay, Instow”; he said
it stated they had been asked by NDC to review the rating assessment currently
placed on the car park as it currently included the car park and public
conveniences adding that the valuation date for the 2010 Rating List was 1st
April 2008 so income information around this date would be the most useful;
the Clerk reported that he had not, as yet, answered this letter and suggested
it be forwarded to Mr Budge (Solicitor) as at (i) above - IPC RESOLVED to
adopt this recommendation. (Action: The Clerk)
(iv) The Clerk enquired of Cllr Cann when the toilets were to be refurbished;
he said he would find out and report back. (Action: Cllr Cann)
e) Item 2205/11 (e) – “IPC’s Self Help Emergency Plan Update”: -
The Clerk reported that Cllrs Renshaw, Harper and he had been unable to meet
up as Cllr Harper had been on holiday; a suitable date would be arranged asap.

f) Item 2205/11 (j) – “Parish Online/Mapping Initiative”: -
(i) The Clerk reported that he had communicated with “Parish Online” (email dd
24.5.12 refers) and set up IPC’s account (for 12 months); he added that
details as regards access to site (password etc.) had been forwarded to Cllrs
with email address (email dd 24.5.12 refers). (Noted)
(ii) The Clerk reported that in order to facilitate the above initiative it
had been necessary for him to apply, on behalf of IPC, to join the Public
Sector Mapping Agreement (PSMA) at no cost; this had been done by email (dd
23.5.12) and IPC’s registration number was awaited – it was required by Parish
Online. (Noted)
(iii) The Clerk said that the cost of the 12-month initiative was £36 but that
this included £6 VAT that was recoverable - see finance later (2206/11).

g) Item 2205/12 (i) (a)_- “Instow Fun Day/Insurance”: -
(i) The Clerk referred to an email (dd 16.6.12) from the Secretary of the
Instow Fun Day regarding this matter; the Clerk elaborated and said he had
provided a copy to Cllr Crombie for perusal. (Noted)
(ii) A discussion then ensued, led by Cllr Crombie, who confirmed that all the
necessary assurances as regards insurance had been provided and that he
recommended approval of the use of Instow beach for the Fun Day; IPC RESOLVED
to adopt this recommendation – Clerk to advise organisers. (Action: The Clerk)
h) Item 2205/12 (i) (f) – “Commodore Slipway/Lockable Bollard”: -
(i) The Clerk reported that the NDCCS was in liaison with the EA (who own the
slipway) with a view to replacing the “missing” lockable bollard with a more
user-friendly variety. (Noted)
(ii) Cllr Cook said the existing bollard plate, which was still in place, was
a Health and Safety “trip” Hazard and that it ought to be removed. IPC
RESOLVED to notify NDCCS/EA. (Action: The Clerk) i) Item 2205/12 (i) (i) –
“Marine Parade/Blocking of Footpath”: -
(i) The Clerk reported receipt of a letter (dd 17.5.12) from DCE reference
“Christie Estates – Marine Parade/Ultra Vires Conduct of DCC”; he said a copy
of this letter had been forwarded to Cllrs with email addresses (19.5.12) and
copied to all Cllrs with their agenda papers (14.6.12). (Noted)
(ii) The Clerk also reported receipt of an email (dd 7.6.12) and copy letter
attachment from DCE to DCC (County Solicitors) regarding this matter; he said
he had forwarded a copy to Cllrs with email addresses (19.5.12) and copied to
all Cllrs with their agenda papers (14.6.12). (Noted)
(iii) Cllr Cann then updated IPC on information he had gleaned from DCC and
referred to a recent response letter that the County Solicitor had forwarded
to DCE. (Noted)
2206/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
a) NDC Weekly Information Sheet (25th May 2012) - Note to all Clerks to Town
and Parish Councils: New Standards Regime by Monitoring Officer”: -
(i) The Clerk said this stated that “At the request of the Standards
Committee, I have been asked to produce a note to all Clerks about some of the
pertinent issues arising out of the Localism Act. As you will all be aware no
doubt, there is an intended obligation to register and disclose any "disc
losable pecuniary interest" (DPI's). The meaning of DPI's is intended to be
defined by regulations from central Government. At the moment we still await
those regulations and a further briefing note will be issued as soon as we
have the information to hand. You will all be familiar with the keeping of
registers of interest as at present and of the need for those registers to be
available for public inspection at all reasonable hours. Under Section 29 of
the Act, there will be an additional need for the registers to be published on
the Parish/Town Council's website if it has one and also on the District
Council's Website in any event. Considerable work has been done on a County
wide Code of Conduct and we hope shortly to be in a position to circulate and
hopefully soon be able to adopt a Code for its Members and thereafter a series
of training events will be organised”. (Noted)
(ii) The Clerk then referred to an email (dd 19.6.12) from DALC reference
“Code of Conduct”; he said it stated that the final update version of NALC’s
Model Code of Conduct was now available following the publication of the
statutory instrument last week and could be found on DALC’s website
www.devonalc.org.uk. The recommendation was that councils adopt either the
NALC model or the model adopted by its district/borough council, the latter
being recommended when members are dual-hatted – it suggested the model code
should include the 7 Nolan principles and that keeping the number of different
codes in an area to a minimum would be clearer for Cllrs and the public.
According to the legislation a code should be adopted by 1st July and
registers of interest completed and returned to the local monitoring officer
in line with their timings and probably before the 28th July. The Clerk said
it added that whilst many councils’ would struggle to meet the timetable, it
was nonetheless now important to put a code in place as soon as possible.

(iii) The Clerk advised IPC that in view of item (ii) above he had contacted
NDC’s Members Services (19.6.12) and left a message seeking further
information as regards NDC’s code in the light this would seem to be the most
appropriate for IPC to adopt.

(iv) The Clerk reported that he had spoken to NDC’s Monitoring Officer
(20.6.12) and had been advised that NDC’s new Code of Conduct had not, as yet,
been approved/adopted by NDC (albeit was in draft form) although he
anticipated this would be the case in about a week/10 days (i.e. NDC Meeting
of 27th June 2012). He further advised he was of the belief that the
commencement date of 1st July was not as prescriptive as had previously been
believed and that he was going to liaise with DALC to ascertain if it agreed
with his thinking adding that any current code of conduct would remain “live”
until such time as the new code was adopted. (Noted)
(v) A discussion then ensued at the conclusion of which IPC RESOLVED to adopt,
in principle, NDC’s code of conduct (as opposed to NALC’s) subject to
subsequent review/consideration, to note that IPC’s current code of conduct
was still “live” and await further communication from NDC as regards its code
of conduct code and training opportunities. The Clerk was asked to commence a
dialogue with NDC to ensure a swift conclusion. (Action: The Clerk)

c) Letter (dd 29.5.12) and attachment (Update Leaflet) from RWE npower
renewables reference ”Atlantic Array Offshore Wind Farm – Protect Update”: -
(i) The Clerk said this letter referred to the introduction of some changes
RWE had made to the project following last year’s public consultation and
considering the results of their comprehensive environmental and engineering
studies to date. It also stated that a further consultation would take place
between 4th July and 31st August with local exhibition events taking place and
offered attendance at parish council meetings.

(ii) The Clerk confirmed that the letter had been copied to Cllrs with their
agenda papers (14.7.12) and that a copy of the leaflet had been provided to
the Chairman; a copy was available at the meeting for Cllrs. (Noted)
(iii) The Clerk also reported receipt of a letter (dd 30.5.12) from Nick
Harvey MP reference “Atlantic Array”; he said it referred to a meeting he had
had with RWE project team on 28th May and also provided the dates and venues
of consultation events to be held in North Devon in July 2012; he said the
letter had been copied to Cllrs with their agenda papers (14.7.12). (Noted)
(iv) After a discussion IPC RESOLVED to defer this matter to the September
meeting so as to give Cllrs the opportunity of visiting the exhibitions and
thereby making themselves more familiar with the facts. (Action: IPC Cllrs)
d) Email (dd 31.5.12) from Clerk to PCSO Meaker reference “Damage at Instow –
30th/31st May 2012”: -
(i) The Clerk said that following information received from the parish
handyperson (31st May) he had advised PCSO Meaker that the following acts of
vandalism had occurred in and around Instow overnight 30th/31st May, namely
the “Heron (Egret?) Statute” situated on the grass verge (Anstey Way) had been
pushed over (and that it belonged to Instow in Bloom who had been advised
through a third party), a new car on Marine Parade (between the entrance to
the dunes car park and the Boathouse) had been covered in sand (the cars
either side were unaffected), 5 parish benches had been pulled out of their
pavement fittings (two were thrown on the beach); they were not damaged as
such and it was hoped to replace them later in the day, more fencing had been
pushed over in the dunes and would hopefully be repaired by the North Devon
Coast and Countryside Service who put them there, the signs left on Marine
Parade by DCC for the Diamond Jubilee road closure on Monday 4th June had been
thrown on the beach and the stone bus shelter at Venn Cross (seaward side) had
been used as a toilet again (this was the third night in a row) and vomit was
also deposited. The Clerk added that it would seem there had been a BBQ on the
beach that night (down near the cricket club) but apart from evidence of a
fire there was no rubbish left behind - more police patrols were requested.

(ii) The Clerk said he had forwarded the above email to all Cllrs with email

(iii) The Clerk said that Cllr Thomas (email dd 31.5.12 refers) had reported
that the windscreen of a vehicle parked in Rectory Lane had been sprayed with
white paint during the night of 29th/30th May; the details of this incident
was also passed to PCSO Meaker. (Noted)
(iv) The Clerk reported receipt of a copy email (dd 2.6.12) from IIB reference
“Repairing of Poly”; he elaborated on the content. (Noted)
(v) The Clerk reported receipt of an email (dd 7.6.12) from PCSO Meaker
stating that all matters had been noted and extra patrols were promised.

(vi) The Clerk advised IPC that according to the NDCCS (email of 21.6.12
refers) much of the collapsing of the dune fencing (as at (i) above and on
other occasions hitherto) was not due to vandals but due to sand settling
after being shifted. (Noted)
e) Email (dd 1.6.12) from DCC reference “Road Closure Order – Kiln Close Lane,
Instow/7/8th August 2012”: -
(i) The Clerk said this stated this was required by SWW for “utility
works/re-instatement works” and that said email had been copied to Cllrs with
email addresses (9.6.12) and the editor of the parish magazine for the
information of parishioners.

Water Regulations 2008”: -
(i) The Clerk said this provided an update on the recent consultation that
ended as of 4th May and that he had forwarded it to Cllrs with email addresses
and had also provided a copy to all Cllrs with their agenda papers (14.6.12).

(ii) The Clerk reported that Cllr Green advised (email dd 17.6.12 refers) that
“This email reports on the Defra consultation in which IPC recently
participated concerning whether responsibility for erecting bathing water
information signs on privately controlled beaches should be transferred to
local authorities. A majority of respondents were in favour, so Defra will be
arranging this transfer of responsibility. The only other significant point in
the email is that Defra have clarified that only one information sign is
needed for any one bathing water” (Noted)
g) Email (dd 13.6.12) from DCC reference “Questionnaire – Winter Review 2012”:
-
(i) The Clerk said DCC sought to provide the best possible winter service
within available resources and was currently reviewing the winter of
2011/2012, a winter that reverted to being a “typical winter (12,000 tonnes of
salt was used as opposed to over 26,000 in the previous severe winters). He
added that to carry out this review it had forwarded a proforma for
completion. (Noted)
(ii) The Clerk advised IPC that he had forwarded a copy of the email and
proforma to Cllr Thomas (IPC’s Lead Snow Warden) for his attention. (Noted)
(iii) The Clerk then reported receipt of a letter from DCC (undated – received
15.6.12) regarding this matter and to which was enclosed a hard copy of the
survey questionnaire. (Noted)
(iv) A discussion then ensued at the conclusion of which IPC RESOLVED that
Clerk, in liaison with Cllr Thomas, should complete the form as they saw fit.

h) Email (dd 13.6.12) from DCC reference “Consultation on the Review of Waste
Management Strategy for Devon”: -
(i) The Clerk said that DCC was consulting on its strategy to dispose of
domestic waste and sought the help of the public (and in partnership with
district councils) to increase its current re-cycling rate of 55% (currently
best in the country). IPC was asked to contribute to this with consultation
officially ending 20th July but could be extended until 10th August. (Noted)
(ii) The Clerk reminded Cllrs he had forwarded a copy of said email to those
Cllrs with email addresses (14.6.12). (Noted)
(iii) IPC RESOLVED to take no further action. (Noted)
(i) Email (dd 12.6.12) from Burn The Curtain Theatrical Group reference “Tarka
Trail Picnic Site – The Adventures of Don Quixote by Bicycle”: -
(i) The Clerk said this advised that in mid-August (the Clerk provided
details) this group would be performing along the Tarka Trail from Fremington
Quay to Instow (including the picnic area) and wished IPC to be aware, and
hopefully supportive, of them using the picnic area that they were aware was
leased by IPC to DCC. (Noted)
(ii) The Clerk advised Cllrs he had told the group he was sure that IPC would
be supportive of their request, subject to confirmation of public liability
insurance; this, he said, had been provided - £5,000,000 together with an
agreement that they were working with the NDCCS to plan the event and would be
preparing the necessary risk assessments etc. (Noted)
(iii) IPC RESOLVED to ratify the decision of the Clerk as at (ii) above.

(j) Neighbourhood Planning – NDC Members Services Weekly Information (dd
15.6.12): -
(i) The Clerk drew Council’s attention to this article that provided the
principles of “Neighbourhood Planning” and set out what was happening in North
Devon in its regard; he provided a copy of the article to Cllrs. (Noted)

(b) Future Use of Marine (Quay) Car Park following transfer of 99 year Lease
by NDC to IPC:-
(i) The Clerk reported that IPC Car Park Sub Committee needed to meet once
more to formalise recommendations as regards the future of the car park so as
to present it to IPC for consideration/approval hopefully in July. It was
RESOLVED that the Clerk would facilitate such a meeting asap. (Action: The
Clerk)
(ii) The Clerk reported it was now believed that Instow Marine would not need
the car park this coming winter for a boat park as it would seem it is in
negotiations with the North Devon Yacht Club; he added this was to be
confirmed. (Noted)
(c) Weed Clearance – Marine Parade: -
(i) The Clerk reported this work had been completed over the weekend of
26/27th May 2012 and that he had received a letter (dd 17.5.12) from Cllr Cann
asking for some feedback on completion of the project; a discussion ensued.

(ii) The Clerk reported the receipt of some excellent feedback from
parishioners; see item 2 above for payment details. (Noted)
(d) Audit Commission - Annual Return for the Year ended 31st March 2011: -
(i) The Clerk confirmed he had returned the signed Annual Return 2011/12 form
to IPC’s IA (Mrs Mary Jane Scott) on 20.5.12 for final completion and onward
transmission to the AC. (Noted)
(ii) The Clerk confirmed that no requests, as of the date of the meeting, had
been received by him as result of the publication (23rd April 2012) of the
“Exercise of Electors Rights” form (plus copy of Annual Accounts 2011/12 –
post internal audit) on the Marine Car Park parish council noticeboard
(“Inspection Days” being Monday to Friday {9 am to 5 pm}) for the period for
the period 8th May to the 8th June 2012 (i.e. 20 working days) (i.e.20 working
days). (Noted)
(iii) The Clerk advised IPC he had removed the relevant paperwork from the
Marine Car Park noticeboard (14.6.12) and retained it for future information.

(e) Email (dd 18.5.12) and attachments from NDC reference “Parish Grants”: -
(i) The Clerk told IPC that this notified IPC that a further meeting, to
discuss the future of Parish Grants, was to be held at The Civic Centre,
Barnstaple between 10 am and 12 Noon on Thursday 5th July 2012; the Clerk was
to attend with the Chairman. (Noted)
(ii) The Clerk further advised IPC that said email enclosed: -
• Notes of the last meeting (12th April 2012) and
• Questionnaire regarding Parish Grant 2012/13. (Noted)
(iii) The Clerk added that he had completed the questionnaire to indicate that
£1,250.00 was to be received by IPC from NDC for its Parish Grant 2012/13 and
that it would be distributed as follows; £650 Burial Ground, £300 Village Hall
and £300 for Open Spaces. (Noted)
(iv) The Clerk further advised Cllrs that the questionnaire also touched upon
an initiative that DCC/NDC were to introduce that would involve the setting up
of a sum of money to be given in grants (it would equate to £1.10 per elector
in the District) but only on the basis of communities working together to
deliver local projects with applications only being accepted from two or more
parish/town councils working together. The Clerk added that following a
discussion with the Chairman he answered this question in the negative in that
it was felt that to forge a partnership with an adjoining parish to work on a
common project was most unlikely – IPC RESOLVED to support this view. (Noted)
(v) The Clerk also advised that DCC/NDC were enquiring as to whether it was
felt there to be a need to improve communications between themselves and
parish/town councils and made a number of suggestions. Following a discussion
with the Chairman it had been decided to suggest that a NDC “link officer” was
appointed to provide support and advise as and when needed with said officer
having a remit to pull together meetings if required; also to support
bi-annual parish forums based on clusters of parishes – IPC RESOLVED to
support this view. (Noted)
(f) Instow Twinning Association (ITA) - Grant: -
(i) The Clerk advised IPC that he had told the ITA (email dd 18.5.12 refers)
that: - “Should you (ITA) wish to consider making an application for a small
grant for 2013 then IPC would give it due consideration on the basis that your
group will be hosting your French colleagues in Instow during that year and if
you were of a mind to arrange a local event to which representatives from the
Parish might be invited/involved. IPC has to ensure that any grants given do
provide value for the parish “at large” and not just for specific groups.
Having said that, IPC does not possess a large pot of money for grant giving
but it will consider deserving cases that fit the above criteria”. (Noted)
(ii) IPC RESOLVED to ratify this statement. (Noted)
(g) Nationwide/Instow Allotment and Recreation Ground Account – Interest: -
(i) The Clerk reminded IPC that a suggestion had been made from the floor at
the Annual Parish Meeting that enquiries were made by IPC to establish whether
a greater return of interest might be available in a different type of
account. (Noted)
(ii) The Clerk advised IPC he had made enquires of the Nationwide (at which
said account was kept – 16.6.12) and that he had been advised that “Treasurers
Trust” accounts such as this were no longer available and that to obtain a
greater return of interest the account would need to be in the name of an
individual; the Clerk reminded IPC that this would unquestionably not be
permissible under the Charities Act. (Noted)
(iii) After a discussion IPC RESOLVED to leave the account as it was. (Noted)
(h) Allianz Insurance – Certificate of Employers Liability Insurance: -
(i) The Clerk confirmed he had placed a copy at the parish hall (17.5.12).

(i) The Clerk told IPC he was in dialogue with NDCCS reference this 25 year
lease that expired this year (2012); he elaborated on progress to date.

(k) Letter (dd 11.6.12) from O J Williams (OJW) reference “Safety Data Sheet”:
-
(i) The Clerk said this stated that as suppliers of IPC’s (diesel) fuel OJW
were committed to ensuring that their customers were kept fully informed of
the legal implications of said supply; for IPC’s information REACH
(registration, evaluation, authorisation and restriction of chemicals) was the
system for controlling chemicals in Europe and as IPC’s distributor, O J
Williams had a legal duty under REACH to provide IPC with a safety data sheet
when they deliver fuel for the first time; they, therefore, enclosed, with
their letter, the relevant safety data sheet that suggested their letter and
safety date sheet (6 pages) was retained. (Noted)
(ii) The Clerk said he had provided Cllr Crombie (IPC’s H and S Cllr) with a
copy of said letter/form for him to review and advise IPC as regards any
implications that might impinge on IPC. (Noted)
(iii) Cllr Crombie said the form basically set out common sense
recommendations as regards the “handling” and “storage” of fuel and that maybe
IPC should take it into
account when reviewing its “Risk Assessment Policy” later in the year (i.e.
November Meeting). (Noted)
(iv) IPC RESOLVED to adopt this recommendation.

2206/12 PLANNING
a) Refurbishment and consolidation of the dwelling(s), removal of single
storey extension and addition of external insulation/white render at The
Roundhouse, Marine Parade, Instow (Reference No 53818): -
i) The Clerk reported receipt of an email (dd 24.5.12) from NDC’s Planning
Officer for this application stating: -
“I have spoken with the architects who advise me that the triangular roof
light in the middle of the roof will be glazed on top with a view of the sky
with solid lead panelled sides. This will really only allow views of the sky
or of the roof if a person were able to view out of the roof light. The
Conservation officer has responded to me on the external materials and roof
light with no objections and I am now in a position to determine the
application unless material planning objections are raised through the Parish
Council”. (Noted)
(ii) The Clerk advised IPC that he had negotiated a “recommendation” reply
date of 30th May 2012 for IPC to responds to this application. (Noted)
(iii) The Clerk reported receipt of a further email (dd 24.5.12) from NDC’s
Planning Officer for this application and to which was attached a response
from the applicant’s architect stating: -
“Following our telephone conversation, I can confirm that the glazed roof
light has solid, lead flashed up-stands on each of its elevations. Given the
subservience of the structure's scale in comparison to the surrounding pitched
roofs and parapet, it would therefore be impossible to either overlook others
from the window or be seen from any neighbouring building or from the street”.

parishioner in which she had expressed her objection to the application; he

application by way of an email (dd 14.6.12) to the appropriate NDC Planning

(ii) The Clerk then reported receipt of an email (dd 15.6.12) from NDC
Planning stating: - “I feel it would be helpful for the Parish Council to see
a sketch of the proposals, which might give a clearer idea of what the new
elevation would look like. The drawings which form part of the application do
not, perhaps, give the most accurate impression of what the frontage would
look like. I have asked the applicant’s Architect to prepare some sketches and
he is happy to do this in advance of your next meeting on Thursday 21 June;
they will be sent to you direct”. (Noted)
(iii) The Clerk advised IPC he had thanked NDC Planning and agreed to respond
immediately after the next meeting of IPC (21st June) subject to receipt of

(iv) The Clerk reported receipt of an email (dd 19.6.12) from the applicant’s
architect together with photographs/sketches of relevance to the above

to REFUSE these applications and recommended APPROVAL but on the basis, that
the shutters, as planned, remain “ad infinitum” (although IPC does understand
that to do so cannot be enforced) and that it would be appropriate if the
conservatory on the ground floor was constructed of a style commensurate to
the late 19th /early 20th Century; Clerk to advise NDC Planning. (Action: The

(i) Cllr Moores stated that this alleged unauthorised development had been
investigated by NDC Planning Enforcement who considered that no breach of
planning regulations had occurred, that planning permission was not required

a “public right of way” had been deemed to be a civil matter and that this was
