2007/4 POLICE REPORT
In the absence of the police the Clerk read from a report that had been
provided. It read as follows: -
a) Crime: -
The Police reported that five crimes had been reported in the parish since the
last meeting, namely, theft (x 3) of a conveyance other than a motor vehicle
(undetected) and theft (x 2). (Noted)
b) Other Matters: -
The Police reported that in the same period six other incidents had been
reported in the parish, namely, x1 “transport/road related/highway
disruption”, x1 “transport/road traffic collision/injury”, x1 “theft”, x
1“admin/information”, x 1 “public safety/concern for safety” and x1 “public
safety/suspicious circumstances”. (Noted)
2007/5 PARISHIONERS
a) Request for Footpath from Elm Terrace to Huish Lane”: -
A parishioner asked whether a footpath could be placed between Elm Terrace and
Huish Lane for safety reasons. IPC RESOLVED to pass this request on to Cllr
Cann (DCC) for his consideration. (Action: Cllr Cann)
b) Planning Application – ndh Kiln Close Lane, Instow: -
The Clerk reported receipt of an email (dd 15.7.10) from a parishioner who
wished IPC to be made aware of his concerns for this proposed development that
had not, as yet, been received by IPC for its consideration. The Clerk said
the parishioner was concerned that the density of the proposed development was
too great and that some aspects were inappropriate given the conservation
area; he also had some more detailed concerns about loss of light and being
overlooked as well as pointing out that there had been little consultation to
date. (Noted)
c) Various Issues: -
The Clerk reported receipt of an email (dd 15.7.10) from a parishioner who
commented on matters of relevance to “Parking on slip-road and grass verge
near Atturm” (see later vide 2007/6 (b) and 2007/10 (i) (e)), “Instow Gateway”
(see later vide 2007/9 (c)), “Westleigh Link Road” (see later vide 2007/6 (a))
and “Fremington planning application – Bloor”. The Clerk said that Cllrs Cann
(DCC/NDC) and Moores (NDC) had been copied in on the original email and that
he was sure they would take any action that was necessary and within their
remit. IPC RESOLVED to take no further action. (Noted)
d) Planning Appeal (APP/X1118/A/10/2130095/NWF – 4 Chichester Close, Instow: -
(i) A parishioner spoke of this appeal and outlined the situation as she saw
it. (Noted)
(ii) The Clerk confirmed that the relevant papers had been received by IPC and
that it was on the agenda for discussion later in the meeting; see item
2007/12 (f). (Noted)
2007/6 REPORT COUNTY COUNCILLOR R CANN
a) A39 Westleigh Junction: -
(i) Cllr Cann said the DCC Cabinet had agreed at their meeting of the 14th
July to a traffic light system at this location and modifications to areas of
road layout at an estimated cost of £630,000 subject to consultation. Cllr
Cann showed Cllrs the relevant plans. (Noted)
(ii) After a discussion IPC RESOLVED to unanimously give its support to this
scheme and the Clerk was asked to convey this message to DCC and publicise
locally as necessary. (Action: The Clerk)
b) Anstey Way Lay By Parking – Atturm Contractors: -
Cllr Cann said that because of a number of local complaints (see item 2007/10
(i) (e)) DCC are inspecting this lay by to generate evidence for a written
request to Atturm asking that they manage the impact of their construction
site by considering parking arrangements that were more appropriate and
discourage contractors from causing damage to the highway and verges. Cllr
Cann was thanked by IPC for his proactiveness. (Noted)
c) General: -
Cllr Cann spoke of issues of relevance to “Street Lighting – Part Time Night
Lighting” (see late vide 2007/10 (i) (c)), “NDC Savings – Waste and Recycling
Services” (the leader of NDC had highlighted how the waste and recycling
service would have achieved £810,000 in savings over a three year period by
the end of this financial year; this was primarily down to bringing the
recycling service in-house back in May 2008. Despite widespread criticism
received by Cllr Cann at the time it was now felt that this vindicated his
decision completely) and “Tarka Trail – Management Projects” (i.e. Tarka Trail
crossing near to the old Power Station). (Noted)
d) Buses – Congestion Marine Parade and Speeding Anstey Way: -
(i) Cllr Crombie said he had received a number of complaints as regards buses
allegedly speeding along Anstey Way and asked what action was still intended
as regards bus related congestion on the seafront. (Noted)
(ii) Cllr Cann said a meeting with the Bus Companies and DCC Officers had
failed to materialise so he was of a mind to go it alone and would do so asap.
He said he would raise both issues. (Action: Cllr Cann)
(iii) Cllr Cann said that in the current financial climate he rather doubted
whether the new pinch point between the Boathouse and the Sand Dunes Car Park
would now materialise. (Noted)
2006/7 REPORT OF DISTRICT COUNCILLOR B MOORES
a) General: -
Cllr Moores spoke of “Charter Toilets – Quay Car Park” (nothing further to
add), “Management of Quay Car Park” (see item 2007/9 (a)), “Ransom Strip
Projects” (see item 2007/9 (d)), “New Government” (the impact of the recently
published budget was being digested; Councils were being encouraged not to
increase council tax, public sector pay freeze, pension scheme review, new VAT
rate {1/4/2011} will impact on both the council and local businesses),
“Support Services Update” (a report to full council showed that NDC performed
better than expected against the budget by £800,000 – this would go some way
to helping with next years budget – further detail provided), “Atlantic Array”
(a joint forum with NDC, TDC and DCC had been established to oversee the
development of this project ), “Quay Car Park – Rubbish Complaint”
(satisfactorily actioned) and “Marine Parade – Litter Bins” (awaiting response
from Environmental Health Dept). (Noted)
b) Instow Quay – “Listed Building/Victorian Lamp”: -
Cllr Moores said he was awaiting a response from NDC’s Conservation Officer as
regards the Victorian lamp. (Action: Cllr Moores)
c) Christie Estates: -
(i) Cllr Moores said he was pleased to report he had had a very productive
meeting recently with Raymond Coldwell of Christie Estates (CE), the purpose
being to try and establish a dialogue/working relationship with CE as NDC Ward
Member for Instow. He said they had discussed topics of relevance to “Banning
of Dogs on Instow Beach”, “Instow/Appledore Ferry”, “Land adjacent to the
Marine Camp (rabbit field)”, “Access to Beach by the Boathouse and Slipway”,
“New Charter Toilets – Quay Car Park” and “Working together for the Future”.

(ii) Cllr Cann asked Cllr Moores if he could ask Mr Coldwell to respond to a
recent letter sent to him by the Clerk to Northam Town Council as regards the
proposed new Instow/Appledore Ferry. (Action: Cllr Moores)
2007/8 MINUTES
It was RESOLVED that the June 2010 minutes of Instow Parish Council be
approved and signed. (Noted)
2007/9 MATTERS ARISING FROM THE MINUTES
a) Item 2006/9 (b) – Management of Quay Car Park: -
(i) The Clerk reported that the delegated IPC Sub Committee had met on
Thursday 24th June to discuss the various options (1-6) as tabled by NDC and
were recommending that IPC seek an agreement with NDC for either option 5
(peppercorn rent) or 6 (transfer of freehold); these two options appeared, in
its view, to be the most beneficial in the long term to IPC. (Noted) (ii) The
Clerk told IPC he had informally spoken to Mr Ian Budge (Solicitor) and he had
advised that Option 6 ought to be the most favourable and that he would be
willing to scrutinise any legal agreement that was offered by NDC. (Noted)
(iii) After a discussion IPC RESOLVED to formally approach NDC with a view to
seeking a meeting to establish a way forward; it was further RESOLVED that the
option that appeared to be in the best interest of the community, was Option 6
(transfer of freehold); a sub committee consisting of the Chairman, Cllrs
Crombie and Thomas and The Clerk was appointed to represent IPC in these
negotiations.

(iv) The Clerk reported that it was reliably believed that NDC would not put
the surface of the car park “up to standard” prior to IPC taking it over and
suggested that maybe NDC could make use of some of the ransom strip monies to
do this prior to occupation by IPC (and maybe buy a new car park machine).

(v) After a discussion IPC RESOLVED to support this recommendation of the
Clerk although Cllr Harper said he would be abstaining from all future votes
and resolutions as regards the use of the ransom strip monies. (Action: The
Clerk)
b) Item 2006/9 (c) – Sand on Highway/Near Boathouse Bus Stop: -
(i) The Clerk advised IPC he had forwarded an email (dd 18.6.10, 25.6.10 and
2.7.10) to Major Lugg of Atturm seeking his cooperation and assistance in
shifting the sand at the end of the summer season but to date had received no
reply. He said the Chairman had also ensured that a copy of said email had
been personally delivered to his office for attention. (Noted)
(ii) The Clerk also advised IPC he had thanked Andy Bell (AB) for giving such
an interesting presentation at the last IPC meeting and that he was looking
forward to practically working with him and the NDCCS at the end of the summer
season in establishing some form of barrier to “hold” the sand back from the
seawall. (Noted)
c) Item 2005/11 (d) - Village Gateway Initiative: -
The Clerk advised IPC he was waiting to hear from Cllr Cann as to what the
ceiling was for the grant (already approved in 2008/9) to cover this
initiative and then he could price up the materials/labour and plan the work
for the autumn; he said he was hopeful that IIB would support and assist.

d) Item 2006/9 (e) – Ransom Strip Projects: -
(i) Play Areas/Tarka Trail: -
(a) Cllr Cann reported upon progress to date as regards the Signal Box and
Yacht Club sites; he said he felt the Signal Box site would attract complaints
from nearby residents but that the Tarka Trail/Yacht Club site had potential.
(Noted)
(b) Cllr Cann said he had liaised with two reliable companies who provided
play equipment and was awaiting quotations. (Noted) (c) After a discussion IPC
RESOLVED to drop the Signal Box site but to proceed with the Tarka Trail/Yacht
Club site subject to the quotations being received from the playground
companies and being subsequently considered by IPC. Cllr Harper abstained from
voting, (Noted)
(d) IPC RESOLVED to appoint the Chairman, Cllr Mrs Dipper and the Clerk to
liaise with Cllr Cann on all pressing issues of relevance to this project up
to and including the next meeting of IPC. (Action: Cllrs White/Mrs Dipper/The
Clerk)
(ii) Play Areas/Beach: -
(a) The Clerk advised IPC that NDC (Community Dept) had “suggested” that maybe
a play area situated on the beach might be a suitable project. (Noted)
(b) After a discussion IPC RESOLVED not to consider this possibility until the
Tarka Trail/Yacht Club site had been resolved one way or the other. (Noted)
(iii) Land (Agricultural Land) Purchase at Marsh Lane: -
(a) The Clerk reported that subsequent to the last meeting of IPC (June 2010)
and following an “accepted” bid of £35,000 for this land, by him, on behalf of
NDC/IPC, to the relevant Estate Agent, an Extraordinary Meeting of IPC was
held at the parish hall at 7.30 pm on Wednesday 30th June 2010 – 18
parishioners attended. (Noted)
(b) The Clerk advised Cllrs he had circulated a copy of the minutes of that
meeting to Cllrs with their agenda papers (8.7.10) – IPC RESOLVED to adopt
these minutes as being a true record of that meeting. (Noted)
(c) The Clerk then referred to the receipt (30.6.10) of a letter (dd 30.6.10)
from a parishioner who lived near the site of this land. The Clerk summarised
the content for the information of Council. (Noted)
(d) The Clerk then told IPC that on Thursday 1st July he had been advised, by
the relevant Estate Agent, that the land in question was being sold for a
price in excess of £35,000, a sum that NDC had said it was not prepared to
exceed on the advice of the District Valuer. The Clerk confirmed he had
advised all IPC Cllrs of this information together with Cllrs Moores (NDC) and
Cann (DCC/NDC). (Noted)
(e) The Clerk then told IPC he had been advised (15.7.10), by the relevant
Estate Agent that said agricultural land was now back on the market, the
previous “sale” having fallen through. (Noted)
(f) After a lengthy discussion IPC RESOLVED to take no further action as
regards the purchase of this land. It was noted that a large majority of
parishioners living in the vicinity of the land were not in favour of it being
used as allotments (nor indeed other “specified” uses) and that although 14
parishioners had recently registered an interest in acquiring an allotment,
there were only three on the current waiting list for the allotments along
Anstey Way (adjacent to All Saints Chapel) and that two of these were not
parishioners. (Noted)
(g) Cllr Moores (NDC) said that NDC were unlikely, in any event, to support
the purchase of the land for an “unspecified” purpose; Cllr Cann (DCC/NDC)
said he believed IPC would better serve its community by seeking “ransom
strip” monies to support the upgrade/maintenance of the Quay Car Park; this he
added would not only be an investment for the community but a tool for income
generation, and the children’s play area. (Noted)
e) Item 2006/9 (f) - Instow 30’ Highway: -
The Clerk update IPC as necessary; he said Mr Budge suggested that IPC waited
for a full reply from the Land Registry before deciding what other option(s)
might be open to it to adopt. IPC RESOLVED to accept this recommendation.

f) Item 2006/9 (g) - Parish Plan Update – Format: -
(i) The Clerk advised IPC he had forwarded to Cllrs, with their agendas papers
(8.7.10), a draft copy of what both he, Cllr Harper and the Chairman proposed
was a suitable document to publish within the parish and also copy on to DCC
(Cllr Cann) and NDC (Cllr Moores) for their attention as necessary. (Noted)
(ii) The Clerk then provided Cllrs with an amended copy; he explained the
minor differences at the conclusion of which IPC RESOLVED to approve the
latest document and agreed to appropriate circulation i.e. website, post
office, parish magazine and Cllrs Cann (DCC) and Moores (NDC). (Action: The
Clerk)
g) Item 2006/9 (h) – Instow Beach/Litter and Dogs: -
(i) The Clerk confirmed that the agreed flier had now been printed (and paid
for – see finance) and was now in the possession (part) of the Chairman of IIB
and the Clerk (part); copies were provided to Cllrs with their agenda papers
(8.7.10). (Noted)
(ii) The Clerk reported that IIB “volunteers” had again patrolled the beach on
Saturday 10th July and issued fliers; he said they had been well received
again by dog owners and that an article had appeared in the North Devon
Gazette (14.7.10). (Noted)
(iii) Cllr Moores (NDC) congratulated IPC and IIB and its volunteers for
originating and executing this excellent initiative. (Noted)
h) Item 2006/10 (i) m(a) – Revised Bathing Water Directives: -
(i) The Clerk advised IPC of the latest response received from Defra (email dd
25.6.10 refers). The Clerk read it to Council and confirmed he had supplied a
copy to Cllr Green. (Noted)
(ii) The Clerk advised IPC he was still to liaise with Andy Bell (NDCCS)
reference appropriate “signage” but that there was no urgency in this as the
new legislation didn’t commence until 2012. (Noted)
i) Item 2006/10 (i) (g) – Community on Show 16th July 2011: -
The Clerk advised IPC that as of the date of the meeting confirmation had not,
as yet, been received that the COS Committee’s insurance covered the proposed
activities on the beach. He said he would chase it as necessary. (Noted) j)
Item 2006/10 (i) (h) – Emergency Planning/Use of Volunteers and Equipment: -
The Clerk advised IPC of the response he had received from AON (email dd
21.6.10 refers); the Clerk briefed Council. He said that basically, all
volunteers were covered by IPC’s insurance policy but not the use of their own
tools or equipment; the use of volunteers did not have to be pre-registered
with AON, provided they are working under IPC’s “direction”, and using tools
or equipment as supplied by IPC (and safety equipment if applicable) the
liability is there. (Noted)
k) Item 2006/10 (i) (i) – Empowering Communities Seminar: -
The Clerk told IPC that 2 places had been booked for him and the Chairman –
Barnstaple 23rd July 2010 between 10am and 2pm. (Noted)
l) Item 2006/13 (b) – New Charter Toilets/Quay Car Park: -
(i) IPC then discussed NDC’s decision not to challenge DCE’s objection to the
build of these new toilets on covenant grounds (expense cited as the reason)
and which had already been granted planning permission. It also discussed, at
length, NDC’s current decision to refurbish the current toilets. (Noted) (ii)
After this discussion, IPC RESOLVED to write to the Leader of NDC, and his
Cabinet Members, to express its great dismay at NDC’s decision not to legally
challenge DCE’s covenant stance and to merely refurbish the current toilets
and not to a charter standard as was promised and planning permission granted
over 5 years ago. (Action: The Clerk)
2007/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 23.6.10 from NDC (Landscape and Countryside Officer) reference
“Workshop to Inform The Landscape Character Assessment of North Devon
District”: -
(i) The Clerk said this letter advised IPC that NDC/TDC, supported by DCC and
Natural England, had recently commissioned Land Use Consultants (LUC) to
undertake a Landscape Character Assessment of North Devon and Torridge
Districts. IPC was now invited to attend a workshop for the North Devon
District at 2pm on Monday 26th July 2010 to contribute to this important
study. It was to take place at The Henry Williamson Suite of the North Devon
Library in Barnstaple. (Noted)
(iii) The Clerk said a copy of the letter had been provided to Cllrs with
their agendas papers (8.7.10). (Noted)
(iv) After a discussion IPC ascertained that no Cllrs or the Clerk was
available to attend and the Clerk was asked to advise the organisers. (Action:
The Clerk)
b) Letter (undated – received 23.6.10) and poster from Exeter City Council
(Devon Wide Sustainable Housing Officer) reference “Recession Impact Campaign
(RIC)”:
(i) The Clerk said this letter stated that Devon Housing Options Partnership
represented the Housing Advice Departments of each Local Authority in Devon
and it was currently running a RIC in response to the recent downturn in the
economy. It wished to publicise the fact (through Cllrs and posters) that it
was available to householders who are experiencing or are expecting a change
in circumstances to look at the self-help options which were available to make
contact with the housing department early to prevent the risk of them losing
their homes. (Noted)
(ii) The Clerk said a copy of the letter had been provided to Cllrs with their
agendas papers (8.7.10). (Noted)
(iii) The Clerk confirmed that a copy of the poster had been placed on the
Quay Car Park notice board and a copy of the letter had been placed in the
parishioner’s folder at the post office. (Noted)
c) Letter (dd 17.6.10) and attachments (pamphlet and maps) from DCC reference
“Street Lighting – Part-Night Lighting Policy”: -
(i) The Clerk said DCC had entered the second year of a three to five year
programme to introduce part-night lighting in residential areas across Devon.
This was being implemented to reduce carbon emissions and energy costs.

(ii) The Clerk said that enclosed with the letter was a programme and plans
giving details where the changes were planned for the financial year and how
it might affect some, or all of the lighting in Instow; any lighting points
highlighted in yellow were to remain lit all night. (Noted)
(iii) The Clerk said that IPC was asked to consider the proposals and comment
as necessary. (Noted)
(iv) The Clerk reminded Cllrs he had forwarded a copy of the letter and
pamphlet to them with their agendas papers (8.7.10); he produced the relevant
maps at the meeting for Cllrs perusal. (Noted)
(v) After a discussion IPC RESOLVED to support the recommendations but not
those that referred to Rectory Lane/Close and New Road because of the number
of elderly parishioners living in these areas. (Action: The Clerk/Cllr Cann)
d) Letter (dd 5.7.10) from NDC reference “Street Collection Permit – ND Mini
Register on behalf of Children’s Hospice SW”:-
(i) The Clerk said this stated that this was to take place in Instow on Monday
30th August 2010 between 8am and 6pm. (Noted)
(ii) The Clerk advised IPC that in view of the fact this was a bone fide
charity and an annual collection he had told NDC that IPC would have no
objection. (Noted)
(iii) IPC RESOLVED to ratify this decision. (Noted)
e) Email (dd 13.7.10) from Cllr Thomas reference “Anstey Way lay-by Parking –
Atturm”: -
(i) The Clerk said this referred to a number of complaints from parishioners
as regards the amount of Atturm building workers using this car park to the
exclusion of locals and visitors; the Clerk said the email had been copied to
Cllr Cann (DCC). (Noted)
(ii) The Clerk said he had advised Cllr Thomas that this lay by was the
property of DCC and that no doubt Cllr Cann would liaise with Atturm/DCC
Highways in an endeavour to satisfactorily resolve the problem. (Noted)

(b) Crown Estate (CE) Beach Lease 2010 - 2034 : -
(i) The Clerk reported he had handed the signed CE Lease to Ian Budge
(Solicitor) on Friday 2nd July 2010 and that he now awaited a copy for
reference. (Noted)
(ii) The Clerk also advised IPC it was now necessary to have this lease
registered with the Land Registry; third parties were then aware of IPC’s
entitlement to the lease/land – see finance 2 above for relevant payment.

(c) MOD Beach Lease – 2010 - 2034: -
The Clerk advised IPC that this should proceed now that the CE’s Lease had
been signed; a copy was awaited for reference purposes. (Noted)
(d) Audit Commission- Annual Return for the Year ended 31st March 2010: -
(i) The Clerk confirmed that no requests had been received by him as a result
of the publication of the “Exercise of Electors Rights” form at the post
office (“Inspection Days” being Monday to Friday {9 am to 5 pm} for the period
21st May to the 18th June 2010 (i.e. 20 working days). (Noted)
(ii) The Clerk also confirmed he had removed the relevant paperwork from the
post office on or about 20th June and filed them for future reference. (Noted)
(e) DCC Grass/Verge Maintenance – Additional Grant 2010/11: -

(f) Beach Cleaning Grant 2010-2011 – NDC: -
The Clerk advised IPC he had been in contact with Cllrs Moores (NDC Instow)
and Brayley (Leader of NDC) (email dd 18.6.10 refers) and that IPC’s Beach
Grant 2010 was to go the Executive Meeting in August for ratification and
should be paid directly to IPC thereafter; the Clerk said he would monitor
this pledge. (Action: The Clerk)
(g) Internal Audit – April to June 2010: -
The Clerk reported that Cllr Crombie had carried out this internal audit
(13.7.09) and found all to be in order. Cllr Crombie confirmed this to be the

The Clerk referred to a copy of this paper that had been circulated to Cllrs
at the meeting; he said the figures had been checked and confirmed by Cllr

The Clerk said this referred to changes brought about by The Banking Conduct
of Business Sourcebook (BCOBS) and the Payment Services Regulations (PSR). The

to discuss “better interest terms” particularly on IPC’s Business account and

(i) The Clerk said this advised IPC, yet again, that all CE payments should be
made to its Office (KF) and not direct to the bank account of the CE. (Noted)
(ii) The Clerk said that on the basis that IPC had not made any “recent”
payments direct, or otherwise, to the CE’s bank account (in fact it always
pays by cheque) the Clerk advised IPC he had sent an email (dd 4.7.10) to KF
querying the reason for the letter. (Noted)
(iii) The Clerk reported receipt of an email (dd 5.7.10) from KF apologising
for receipt of the above letter; it seemed to have been sent out in error.

The Clerk advised IPC that as a result of an “incident”, reported to him by
Cllr Harper via a parishioner (email of 27.6.10 refers), a “Disabled Logo” had
been removed from the car park (near to the car park machine) leaving only two
disabled bays for use by registered disabled drivers; the Clerk elaborated.

was becoming unreliable and needed, in his view, replacing – it was 9/10 years

£50. Cllr Crombie said he had examined the phone and concurred with the

2007/12 PLANNING
a) NDC Planning - “Parish Council Forum”: -
(i) The Clerk confirmed he had attended the Parish Council Planning Forum at
the Civic Centre (Council Chamber) at 1.30 pm for 2 pm on Thursday 24th June
2010 and that in his opinion it was excellent. He said topics that had been
covered were ”Improved Communications in Planning Applications – Town and
Parish Charter”, “Liaison on Enforcement Cases”, “Notification and Prior
Approvals”, “Affordable Housing” etc. He added it was anticipated that these
forums would now be held about 3 times a year and attendance by IPC Cllrs, in
his view, was to be encouraged. (Noted)
(ii) The Clerk said copies of papers handed out at the forum, namely, “NDC -
Town and Parish Council’s Charter”, “Demolition”, and “Agricultural
Notifications/Telecommunication applications” had been copied to Cllrs with
their agendas papers. (Noted)
(iii) The Clerk distributed, at the meeting, a copy of “A Planning Guide for
Members” to all Cllrs that had been provided by NDC Planning at his request.

passed it immediately to the Chairman for the attention of IPC’s PSC; for

(ii) The Clerk confirmed that an entry had been placed on the Instow website
for the information of parishioners. (Noted)
(iii) After a discussion, led by IPC’s PSC, IPC RESOLVED to recommend
APPROVAL. (Action: The Clerk)
f) Letter (dd 1.7.10) from NDC Planning reference “APPEAL – Outline
Application for Erection of Dwelling and Formation of Access and Parking at
Gardens of 5 Chichester Close, Instow (Reference No 49716)”:-
(i) The Clerk said the letter advised IPC that an appeal had been lodged
regarding the proposal as above in that NDC Planning had refused planning
permission. He said the letter further advised IPC that as it was consulted at
the application state, its response had been forwarded to the Planning
Inspectorate; if IPC now wished to make any further observations, or amend its
original response in any way it should do so by 30.7.10 directly to the
Planning Inspectorate quoting reference: APP/X1118/A/10/2130095/NWF. (Noted)
(ii) The Clerk reminded Cllrs that at IPC’s February 2010 meeting it had
RESOLVED to recommend REFUSAL of this application on the grounds of: -
“………potential loss of privacy/light to neighbouring properties, a potential
over intensification of the site as well as presenting a likely adverse impact
on the amenities of adjoining properties (one of which is a listed building)
together with real and actual concerns as regards the road safety implications
of adding another vehicular access on to a very busy road (Anstey Way) and
near a current road junction. IPC notes that this application requests that
the proposed appearance and landscaping is a reserved matter for future
approval. It further notes that a recent (and similar) application was refused
and dismissed on appeal (2008) with the main issues being the effect that the
proposed development would have upon the character and appearance of the
surrounding area. It also refers to the importance of the appearance of the
proposal in terms of external finishes, windows, roofs etc; this has not been
addressed (one could argue ignored) in this application. In the appeal the
Inspector referred to the prominence of the original proposal being
exacerbated by its height; it would seem that the height of this application
has only been lowered by some 500mm (and the roof to be at 45 degrees) and
therefore the proposal would still form an unduly dominant form of
development. In summary, IPC feels that this application should be REFUSED
(for all the above reasons) and until such time as specific details are lodged
with the Planning Department of the design and appearance of any proposed
dwelling; a decision without these details could not consider whether the
proposal would cause considerable damage to the character and appearance of
the area as the Planning Inspector referred to in the previous proposal in her
summing up paragraph. IPC would also like to point out that it found some of
the supporting material misleading in that it did not, for example, indicate
any sign whatsoever of pedestrian islands that are in the vicinity of the
proposed new build and nor did it include the current house (known at 5
Chichester Close) so as to presumably exclude comparison purposes”. (Noted)
(iii) After a discussion IPC RESOLVED to write to the Planning Inspectorate to
reinforce its original recommendation and to draw to the Planning Inspectors’
attention to what IPC believed was a material change in planning legislation
since February 2010, namely, PPS 3: Housing – Removal of garden land from
definition of previously developed land and removal of indicative minimum
density. IPC was of a belief that this amendment to PPS 3, which was not in
force when the planning officer considered the above application, was a
material consideration and, therefore, should be considered at this appeal
stage. (Action: The Clerk)
g) Letter (received 10.7.10) from NDC Planning reference “Erection of steel
and glass balconies at first floor level on south and east elevations at 3
Chichester Close, Instow (Reference No 50279): -
The Clerk said this stated that NDC Planning had GRANTED permission for this

h) NDC Planning – Weekly Email “List of Planning Applications” and “Planning
Applications Determined by the Planning Manager Under Delegated Powers or
Withdrawn:-
The Clerk advised IPC that he now received these on a weekly basis and would
copy them on to all Cllrs for their information; he said these lists would
ensure IPC was aware of all planning applications for the parish and
neighbouring parishes that might have an affect on Instow. The Chairman said

development i.e. residential (not holiday flats), affordable housing quota,
car parking concerns, private rear access etc; he said he was also advised to
speak to NDC’s Planning Case Officer Keith Bines. (Noted)
k) Planning Proposal: Redevelopment of Flats at Kiln Close, Kiln Close Lane,
Instow: -
(i) The Clerk reported that despite an inference by ndh in previous
correspondence (IPC June 2010) that a planning application would be submitted
by the end of June 2010 no planning application had, as yet, been received by
IPC. (Noted) (ii) The Clerk reported receipt of an email (dd 13.7.10) from a
parishioner reference this proposed planning application; he said he had
advised the parishioner to attend IPC’s meeting of the 15th July where he
could address Council. (Noted)
(iii) The Clerk reported receipt of a further email (dd 14.7.10) from the same
parishioner (as at (ii) above) stating “…our concern is principally that the
density of the proposed development is too great and that some aspects are
inappropriate given the conservation area. We have more detailed concerns
about loss of light and being overlooked; there has been little consultation

a) Lockable Bollard Commodore Slipway/Dunes Access to Beach: -
Cllr Mrs Dipper said vehicles could still drive on to the beach via the
slipway even though the lockable bollard was in place (by driving to the side
of it) and that others appeared to be gaining access by driving to the rear of
the dunes having gained access at the entrance to the sand dunes car park.
After a discussion IPC RESOLVED to liaise with the NDCCS and Environment
Agency to establish what might be done in the circumstances. (Action: The

b) Damaged Bollard – Pedestrian Island opposite Former Methodist Chapel: -
Cllr Harper said this required attention; IPC RESOLVED to advise DCC Highways
so as to rectify the matter. (Action: The Clerk)
c) Cutting of Sea Bank Verge near Jetty: -
Cllr May said he had received complaints from parishioners that this bank had
been cut too short to the detriment of resident wildlife. IPC RESOLVED to

It was RESOLVED that the Chairman, Vice Chairman and Clerk take any necessary
