Item 2107/12 (b) – Planning application/Leeward, Rectory Lane, Instow (reference number 52429); Cllrs Thomas and White declared a personal interest and did not speak. (Noted)

2107/4 POLICE REPORT
a) Report: -
In the absence of the police there was no report. (Noted)
b) Neighbourhood Policing: -
(i) The Clerk confirmed he had liaised with the Divisional Commander, Supt Harris, and received his assurances that Community Policing was high on his agenda albeit there had been recent glitches that were beyond his control. He added that Supt Harris had advised him that he would ensure a police attendance at the Community on Show (COS) Day (16th July). (Noted)
(ii) Cllr Harper advised Council that no police officer had attended the COS Day despite PC Hodgson liaising with the organisers beforehand and confirming his attendance. After a discussion IPC RESOLVED to bring this to the attention of Supt Harris and seek an explanation. (Action: The Clerk)

2107/5 PARISHIONERS

2107/6 REPORT COUNTY COUNCILLOR R CANN
Cllr Cann spoke of the following matters, namely “Instow Ferry” (successfully launched and operational; approx 270 passengers carried to date), “Chippings – Anstey Way Lay-by” (now moved and DCC aware not to place them at said location again), “Sale of Recycle Material” (£850,477 in 2010/11 as opposed to £568,502 in 2009/10), “Planning Enforcement” (NDC Executive very concerned at the current backlog and have asked for a report), “NDC Costs – Agency Employees” (costs to date = £877,000 with the biggest rise in recycling services; now being managed personally by Leader/Deputy leader) and “DCC Capital Maintenance Programme 2011/12” (£170,000 set aside for Fremington Community Primary School & Nursery and £350,000 for Instow School – Hall and Remodelling)). (Noted)

2107/7 REPORT OF DISTRICT COUNCILLOR B MOORES
Cllr Moores spoke of the following matters, namely “S 215 Town and Country Planning Act 1990 – Grot Spots” (meeting to be held with relevant planning officer), “Sands Development” (meeting to be held on site 10th August to discuss options, namely demolish rear area and provide 2 newly built 3 bedroom cottages with No 4 and 5 Bath Terrace becoming self contained – there are some conservation and heritage issues), “1-4 Kiln Close Lane” (because of vastly reduced grant rates, ND Homes are now considering developing 5 units, three of which will be affordable), “Instow Ferry” (now operational; well done to all concerned), “Sand – Marine Parade” (aware DCC is considering relevant action(s) to take), “Development of Fremington Army Camp” (discussions still in hand”, “Resignation of NDC/Parish Cllr Bell - Fremington” (there will be a by-election), “Batsworthy Wind Farm” (application to install nine 103m tall wind turbines set to be refused” “The Value of Second Homes – Instow Survey” (survey seeks an objective look at the value of second home ownership to local communities), “Leisure Centre Refurbishment” (starts October 2011) and “Council backs Local Radio Campaign” (NDC supports continuance of local radio). (Noted)

2107/8 MINUTES
It was RESOLVED that the June 2011 minutes of Instow Parish Council be approved and signed. (Noted)

2107/9 MATTERS ARISING FROM THE MINUTES
a) Item 2106/4 (a) Traffic Congestion/Obstruction New Road/Anstey Way
(i) The Clerk advised IPC that following further liaison with the parishioner (who had raised concerns as regards this matter), the police and Cllr Cann it had been agreed by DCC that it intended to introduce a double yellow line no parking order at this location (at least 22 metres on both side of New Road), DCC to advertise soonest. (Noted) (ii) The Clerk advised IPC that there was an original order for a double yellow lines system (August 2004) covering the same stretch of New Road but it had been revoked; hence the “old” yellow lines markings on the road that have now become virtually obliterated. (Noted)
b) Item 2106/6 (i) – Instow “Grot Spots” – S 215 Town and Country Planning Act 1990: -
(i) The Clerk advised IPC that since the last meeting he had received various copies of emails between Cllrs Harper (IPC) and Moores (NDC) that had included a number of other locations within the parish that have been considered “grot” spots by Cllr Harper; Cllrs Harper and Moores (NDC) addressed Council. (Noted)

c) Item 2106/6 (ii) – The Sands, Marine Parade, Instow/Planning Update: -
(i) The Clerk advised IPC he had forwarded an email (dd 21.6.11) to NDC Planning advising it that IPC was deeply concerned at the inordinate amount of time it was taking to resolve the planning issues at this location that were an eyesore and becoming more and more dilapidated as time passes; an update was requested sooner than later. (Noted)
(ii) The Clerk then referred to a copy email (dd 28.6.11) between Cllr Moores (NDC) and NDC Planning concerning this matter; the Clerk elaborated as necessary. (Noted)
(iii) See item 2107/7 for action(s). (Noted)
d) Item 2106/6 (iii) – Kiln Close Lane Development, Instow/Planning Update: -
(i) The Clerk advised IPC the had forwarded an email (dd 17.6.11) to NDC Planning requesting an update on the planning decision. (Noted)
(ii) The Clerk reported receipt of an email (dd 4.7.11) from NDC Planning stating that the Ward Member (Cllr Moores) had agreed the application should be approved subject to conditions and as such instructions had been passed to Legal Services to start the section 106 agreement with the head of terms for affordable housing, maintenance of roads and pathways and maintenance of surface water systems. (Noted)
(iii) The Clerk confirmed he had thanked NDC Planning for the information and requested that IPC be advised in the normal manner once planning permission had been formalised. (Noted)
(iv) In the light of what Cllr Moores had reported (see item 2107/7) IPC RESOLVED to enquire of NDC Planning whether, as the original application was being tweaked, a fresh planning application was necessary and put out for consultation including to Instow Parish Council. (Action: The Clerk)
e) Item 2106/8 (a) – Management of Quay Car Park/Refurbishment of Toilets: -
(i) The Clerk advised IPC he had attended a meeting at the Civic Centre on Wednesday 29th June together with NDC’s Chief Executive (CE), Mike Mansell and Cllr Cann. The Clerk informed Council he had provided the NDC’s representatives with a list of requirements that it was felt by IPC would refurbish the current toilets to an acceptable state; the Clerk elaborated on those requirements as provided by Cllr Harper. (Noted)
(ii) The Clerk further advised IPC he had stated that IPC did not wish to “take-over” the toilets at any stage (prior to refurbishment or following refurbishment) but that it did want to take a hands-on interest in the refurbishment process; he said this had been noted and agreed. (Noted)
(iv) The Clerk advised IPC that NDC had hoped to get back to IPC before its next meeting (21.7.11) with a price for the toilet refurbishment; it would then be open for IPC to seek their own prices for such work on the basis it could well be cheaper to do it this way. (Noted)
(v) The Clerk then updated IPC from an email he had received from NDC’s CE of 15.7.11 that stated that the necessary refurbishment work had been estimated at just under £10K. The Clerk added, however, that he still awaited the precise specification on which this figure had been derived. Cllr Cann agreed to obtain it and forward it to the Clerk. (Action: Cllr Cann)
(vi) A discussion then ensued during which IPC RESOLVED to pay half of any sum in excess of £10K and to explore the possibility of electricity and hot water being installed in the toilets albeit this would not take place until the car park had been “secured” by IPC from NDC and prior to any resurfacing. (vii) The Clerk then confirmed he had advised NDC’s representatives that IPC did wish to take over the freehold of the Quay Car Park and that once NDC was ready to begin the relevant legal process of transfer that IPC would appoint a solicitor to act for it. This had been noted and agreed. (Noted)
f) Item 2106/8 (b) – Revised Bathing Water Directives: -
(i) The Clerk summarised on progress since the last meeting, namely: -
a) Email (dd 18.6.11) from Cllr Harper reference “Commodore Slipway – North Devon Biosphere Reserve Sign”; it was noted this map did not show Instow beach as a bathing beach. (Noted)
b) The Clerk advised IPC he had forwarded an email (dd 18.6.11) to Defra enquiring if the parish had been consulted at the time of designation – if so were there any records, seeking clarification on times of bather surveys i.e. could 11am – 3pm as recommended be substituted with 2 hours before and after high tide that would make more sense in Instow’s case and had Defra had any communication with or from DCE as regards designation/de-designation. (Noted)
c) The Clerk added he had subsequently forwarded (19.6.11) an email addendum to Defra that had been provided by Cllr Harper on the issue of relevance to bather survey times as at b) above. (Noted)
d) The Clerk reported receipt of an email (dd 20.6.11) from NDC reference “Bathing Water Directive Meeting, Civic Centre, Thursday 7th July 2011; the Clerk advised that Cllrs Harper and Thomas were to attend; Cllr Green and Clerk unavailable. (Noted)
e) The Clerk reported receipt of an email (dd 20.6.11) from Cllr Harper advising he had secured the services of a consultant au fait with Defra who was prepared to assist IPC in its de-designation application. (Noted)
f) The Clerk reported receipt of an email (dd 23.6.11) from EA reference “Weekly Bathing Water Update”; he summarised the results. (Noted)
g) The Clerk reported receipt of an email (dd 25.6.11) from Cllr Harper reference “Beach De-designation Sub Committee Meeting – Monday 27th June 2011; the minutes of that meeting were provided to Cllrs with their agenda papers (14.7.11). (Noted)
h) The Clerk reported receipt of a copy email (dd 29.6.11) from Cllr Harper to Julie Girling MEP reference “EU Directive on Bathing Water”; Cllr Harper elaborated as necessary. (Noted)
i) The Clerk reported receipt of an email (dd 30.6.11) from EA reference “Weekly Bathing Water Update”; the Clerk said the sample taken at Instow beach on 26.6.11 was still in analysis but the portents were not good; the samples taken at Fremington Quay and Bideford Bridge on that same day both failed the E Coli test. j) The Clerk reported receipt of an email (dd 2.7.11) from Cllr Green reference “De-designation - Letter to Defra and Letter to Instow Community Groups”; the Clerk said the “Letter to Defra” had been forwarded by email (3.7.11) and the “Letter to Instow Community Groups” emailed (3.7.11) to Cllr Harper for hand delivery. k) The Clerk reported receipt of an email (dd 5.7.11) and attachment letter from Defra reference “Instow De-designation Application”; the email and letter had been forwarded to Cllrs Green, Harper, Thomas and White with a copy also being forwarded to Cllrs with their agenda papers (14.7.11). ii) The Clerk reported the receipt of an email (dd 20.7.11) from the Chief Executive of DCE reference “Instow Beach – Designation as a Bathing Water” following email prompts of his on 18.6.11, 14.7.11 and 20.7.11; the Clerk provided a copy of said email to Cllrs at the meeting for their perusal. jj) The Clerk reported receipt of an email (dd 21.7.11) from EA reference “Bathing Water Report – 21st July 2011; he said IPC should note that Instow now had 9 Pass Guidelines, 1 Pass Mandatory, one failure (16.6.11) with one sample (14.7.11) still in analysis (Noted)
(ii) (a) Cllrs Harper, Thomas and White then addressed Council on all the implications as above including recommended actions still necessary particularly bather surveys etc. After a discussion IPC RESOLVED to continue to seek de-designation and to follow the suggested action(s) as outlined by Defra.
(Action: IPC’s De-designation Sub Committee – Cllrs White, Green, Harper and Thomas)
(b) After a discussion it was RESOLVED that IPC ought to perhaps meet prior to the next meeting of IPC (15.9.11) in order that the de-designation paper (to be sent to Defra) could be reviewed and any amendments made prior to 15.9.11 where the final proof copy report could be adopted in time for submission to Defra by 30th September 2011; the Clerk was asked to provisionally book the parish hall for Thursday 1st September 2011. (c) It was also RESOLVED to invite a member(s) of the EA to the meeting of 1.9.11 so that any outstanding questions might be dealt with. (Action: The Clerk)
g) Item 2106/8 (c) – Salt/Grit Bins/Community Clusters: -
(i) The Clerk advised IPC that yet a further entry had appeared in the July parish magazine and that to date 4 persons had come forward. (Noted)
(ii) The Clerk then enquired whether any Cllrs had been able to identify other willing parishioners residing on their patch or in localities within the parish where snow problems could well emanate. There was a negative response. (Noted)
(iii) The Clerk then reported the receipt of an email (dd 4.7.11) and attachment from DCC reference “Winter Service - A New Local Initiative”; he said the relevant paperwork had been copied to Cllrs with their agenda papers (14.7.11). (Noted)
(iv) After a discussion IPC RESOLVED to participate in this DCC scheme and Cllr Cook was asked to establish a suitable location where any provided salt/sand could be safely and securely stored and distributed as necessary. (Action: Cllr Cook)
h) Item 2106/8 (f) - IPC Appointments/Cllr Details: -
(i) The Clerk provided Cllrs with a copy of the updated “Appointments” list (dd 21.7.11) that had been circulated by email (dd 21.6.11) in draft form to all Cllrs with email addresses; the Clerk advised that one minor amendment had been made. (Noted)
(ii) After a discussion IPC RESOLVED to adopt it as written. (Noted)
(iii) The Clerk then provided Cllrs with a copy of the most recent updated “Councillors Email/Address Contact” sheet (for publication – dd 21.7.11) and a copy of the most recent updated “Councillors Email/Address/Telephone No Contact” sheet (for internal circulation – 21.7.11). (Noted)
(ii) After a discussion IPC RESOLVED to adopt both as written. (Noted)

2107/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting
a) Letter (dd 17.6.11) from NDC reference “Parish Cllrs – Failure to Submit Election Expenses”: -
(i) The Clerk said this letter stated that all candidates (Cllrs), whether the election was contested or not, were required to make a return and declaration of their election expenses. If these were not delivered within 28 calendar days of the declaration of the result of the election, any elected candidate should not sit or vote in the council until either they are delivered or until there is an authorised allowance for the failure. If the elected candidate sits or votes the penalties are £50 for every day on which they sit or vote and failure, by any candidate, to make a return and declaration is an illegal practice. (Noted) (i) The Clerk said he had copied the letter to all relevant Cllrs for their attention; deadline (including Nil Returns) 3rd June 2011; a discussion ensued. (Noted)

(b) Email (dd 23.6.11) from Secretary of Instow/Appledore Ferry Committee reference “Ferry Service”: -
(i) The Clerk said this stated that the ferry service would resume on Saturday 25th June at 12.30 pm but would be a low key affair; the official launch would take place in 4-5 weeks time. It added that local support for the 25th June would be welcomed although formal invitations would be sent to IPC for the official launch in due course. (Noted)
(ii) The Clerk said he had copied the email to Cllrs with email addresses. (Noted)
(iii) During a discussion that then ensued, Cllr Moores stated that there was now not to be an official launch and that the service had been well received. (Noted)
(c) Email (dd 28.6.11) from Barnstaple/Torridge Pilot Gig Clubs reference “Instow Gig Regatta – Sunday 24th July from 9am to 6pm”: -
(i) The Clerk said this stated that the gigs would be launching from the Atturm slipway near to the North Devon Cricket Club and IPC was invited to attend. (Noted)
(ii) The Clerk reported the receipt of a telephone call (28.6.11) from the Chairman of the Barnstaple Pilot Gig Club reaffirming the information as above and confirming that DCE had given permission for the use of the launch site. (Noted)
(d) Email (dd 28.6.11) from NDC reference “Washed Up Margarine Tubs”: -
The Clerk said this stated that a container (containing margarine tubs) was washed off a tanker in the Irish Sea in January 2010 and that some of the tubs had recently washed up on the shore of Welcome Mouth and Hartland Point; he said the letter provided a point of contact to clear up any such tubs. (Noted)
(ii) The Clerk confirmed he had advised the Beach Cleaner (28.6.11). (Noted)
(e) Information of relevance to “The Queens Diamond Jubilee - Beacons”: -
(i) The Clerk said this provided advice and guidance in taking part – 4th June 2012; a discussion ensued during which time it was RESOLVED to take NFA. (Noted)
f) Letter (dd 30.6.11) from NDC reference “Chairing Skills for Parish Cllrs”: -
(i) The Clerk said he had copied this to Cllrs with email addresses; reply date 18th July 2011. (Noted)
(ii) The Clerk reported that Cllr Thomas has expressed an interest in attending. (Noted) (iii) The Clerk told IPC that as of 12.7.11 very few town/parish Councils had responded to this offer and that the cost, per candidate, was, therefore, likely to well exceed the estimated figure of £40. (Noted)
(iv) After a discussion, during which time Cllr Thomas withdrew his request, IPC RESOLVED to take NFA - Clerk to advise NDC. (Action: The Clerk)
g) Letter (dd 5.7.11) from NDC (Environment) reference “The Food Hygiene Rating Scheme”: -
(i) The Clerk said NDC was offering town and parish councils the opportunity to hear a presentation on the new scoring method (“0 – 5” as opposed to “Scores on the Doors”); he said the food hygiene rating system was a national scheme backed by the Food Standards Agency and was based on compliance with the requirements of food hygiene legislation. Food businesses are given a sticker and a certificate to display so that customers can see how well food safety is implemented and managed in their establishment. (Noted)
(iii) After a discussion IPC RESOLVED to take NFA; Clerk to advise NDC.

(h) Letter (dd 18.7.11) and attachment from RWE npower renewables reference “Atlantic Array Offshore Wind Farm”: -
(i) The Clerk said this stated that said company was preparing a proposal for a wind farm in the outer Bristol Channel known as the “Atlantic Array Offshore Wind Farm”; at its closest it will be around 13 km from Lundy Island, 14 km from the North Devon coast and 16 km form the coast of South Wales. The Clerk added that as a result the company was obliged to prepare a Statement of Community Consultation – hence this letter and attachment - and that it would be carrying out a series of pubic exhibitions in the area throughout September 2011. (Noted)
(ii) During a discussion that then ensued, IPC noted that the onshore cable to the Alverdiscott Sub Station was now to come ashore at Cornborough Range and travel, underground, to Alverdiscott via Abbotsham and not the Taw Estuary as was first muted. (Noted)
(j) Letter (undated) from a Committee member of the Bideford Railway Heritage Centre reference “Instow Signal Box”: -
The Clerk said this stated that despite what IPC had been advised by a parishioner at the May 2011 meeting (the minutes of which had recently been published in the ND Journal), the signal box was first built in 1872/73 which would make it 138 years old and not 150 years. He said the letter added that there were no plans, therefore, in hand for a 150 year celebration as yet, (Noted)
j) Email (dd 18.7.11) from NDC reference “Coast to Coast Cycle Ride – Network Route 27 /Ilfracombe to Plymouth”: -
(i) The Clerk advised Cllrs that this was to commence at Ilfracombe on September 3rd and if they were interested they would be welcome to join in; the Clerk elaborated as necessary; a discussion ensued. (Noted)

The Clerk said this stated that IPC owed nothing; account in balance. (Noted)
(b) “Marine Car Park, Instow – Summer Let”: -
(i) The Clerk advised IPC that following enquiries with Metric he had ascertained that a new machine, as discussed at the last meeting, (Red - £550 plus VAT) would come with a 6 month warranty period but that this would only “kick-in” once it had been installed. (Noted)
(ii) The Clerk suggested that such a machine be purchased, placed in store, and installed immediately prior to the car park season 2012. He said the warranty period would then be “alive” whilst the machine was in use throughout the summer period of 2012. (Noted)
(iii) The Clerk advised IPC that if the current supply of tickets should run out before the end of September (2011) then the ticket supplier would provide small quantities in rolls of 1,000 (as opposed to a minimum order normally of 20,000). (Noted)
(iv) After a discussion IPC RESOLVED to purchase a machine as offered and to place it in store for installation in April (or thereabouts) 2012. (Action: The Clerk)
(c) Audit Commission- Annual Return for the Year ended 31st March 2011: -
(i) The Clerk confirmed that no requests had been received by him as a result of the publication of the “Exercise of Electors Rights” form at the post office (“Inspection Days” being Monday to Friday {9 am to 5 pm} for the period 20th May to the 17th June 2011 (i.e. 20 working days). (Noted)
(ii) The Clerk also confirmed he had removed the relevant paperwork on 14th July and had filed a copy for future reference. (Noted)
(iii) The Clerk reported receipt of a letter (dd 19.7.11) from the Audit Commission (AC) together with the Certified Annual Return for the financial year ending 31st March 2011. (Noted)
(iv) The Clerk advised Cllrs that the External Auditors (AC) Certificate and Opinion (Section 3) stated, “on the basis of our review, in our opinion the information contained in the annual return is in accordance with proper practices and no matters have come to our attention giving cause for concern that relevant legislation and regulatory requirements have not been met”. (v) The Clerk further reported that no other matters, not affecting the opinion of the Audit Commission, had been drawn to the attention of Council. (Noted)
(vi) The Clerk advised IPC he would be placing a notice, soonest, entitled “Notice of Conclusion of Audit and Right to Inspect the Annual Return Form” together with a copy of the Annual Return (sections 1-4) on the notice board at the Quay Car Park for the information of parishioners and would be leaving it there for in excess of a 14 day period. (vii) The Clerk confirmed he was to copy all correspondence to Mrs Mary John Scott (IPC’s IA) and would thank her for her work and support in performing the internal audit process. (Action: The Clerk)
