Present: - Councillors P Cook, C Harper, A Johns, M Green (Vice Chairman), B Moores, B Thomas, and Mr R Jacob (Parish Clerk).
In the absence of the Chairman, Cllr White, Cllr Green (Vice Chairman) took the chair.

In Attendance: Cllr R Cann (DCC), Cllr B Moores (NDC) and 4 parishioners.

2109/4 POLICE REPORT
In the absence of the police, the Clerk read from a report that had been provided: -
a) Crime: -
24 crimes had been reported in the parish since 15th June when the police had last attended IPC, namely, Burglary (x 3), Theft (x 6), Criminal Damage (x 3), Non Crime – Domestic (x 3), Communications Act 2003 (x 1), Common Assault (x 1), Assault occasioning Actual Bodily Harm (x 2), Exposure (x 1), Possession of Drugs (x 1), Drunk and Disorderly (x 1), Harassment (x 1) and Making Off without Payment (x 1). (Noted)
b) Other Matters: -
32 other incidents had been made the subject of an incident log, namely, Anti Social behaviour (x 5), Crime Related (x 4), Administrative (x 2), Public Safety – Concern/Firearms/Domestic/Missing Person/Suspicious Circumstances/Wildlife (x 19),
Road Traffic Accident (x 1) Highway Disruption (x 1) (Noted)
c) General: -
(i) Cllrs expressed some concern at this apparent “crime wave” but did note it had taken place over a three month period and was at the “height” of the summer period. (Noted)
(ii) They further expressed concern that the police were, yet again, not present to explain the crime trend or be in a position to answer questions from Cllrs and members of the pubic. (Noted)
(iii) It was RESOLVED the Clerk should seek an explanation as to their sporadic attendance rate throughout the year to date. (Action: The Clerk)
d) Triathlon – Sunday 18th September 2011: -
It was said by Cllr Johns that this event was travelling along Anstey Way and wondered whether the police were aware and supervising it. IPC RESOLVED to advise the police as necessary. (Action: The Clerk)

2109/5 PARISHIONERS
a) Speeding Motorists – Anstey Way/Atturm to Venn Cross: -
A parishioner said that since the work had recently commenced on the Bideford Bridge more and more motorists were using the old road to access Barnstaple (because of congestion on the link road) and many were speeding especially at about 7 am. IPC RESOLVED to notify the police. (Action: The Clerk)
b) Atlantic Array: -
A parishioner expressed concern at the possible negative impact this would have on the area; she was advised by the Clerk that Cllrs would be discussing it later in the meeting. (Noted)

c) Instow Website: -
A parishioner said she was having difficulty in accessing IPC’s minutes after February 2011. The Clerk said this was the second time this anomaly had been brought to his attention and he would advise the webmaster. The parishioner was advised to persevere as all minutes were in situ on the website up to and including June 2011. (Noted)
d) Speedwatch: -
(i) A parishioner advised IPC she had now been trained in “Speed-watch”; she was congratulated on her public spiritedness. (Noted)
(ii) It was RESOLVED that IPC ought to know more about this initiative and the Clerk was asked to enquire of the police. (Action: The Clerk)

2109/6 REPORT COUNTY COUNCILLOR R CANN
a) Quay Car Park/Toilet Update: -
Cllr Cann said that the new NDC administration was still considering the financial implications of this issue that had been agreed by the former NDC administration and he recommended as a result, that he together with the Clerk, Chairman (or Vice Chairman if not available) and Cllr Moores meet aside from the meeting and discuss the various options, reporting back to IPC at the earliest opportunity. IPC RESOLVED to adopt this suggestion. (Action: Cllr Cann/Chairman/Cllr Moores and The Clerk)
b) General: -
Cllr Cann spoke of the following matters, namely “Westleigh Junction” (work commenced on the site on 5th September for 14 weeks; he explained the strategy), “DCC Locality Budget” (contributions to Westleigh Cricket Club Pavilion {£5K}, Fremington Youth Football Team {£1k), Byways Bowling Club {£190} and Outdoor Gym Roundswell {£15K}). “Change to Refuse Collection Rounds” (rounds are being reviewed to ensure an efficient service yet financial savings), “Sand Management – Instow” (provisional approval to proceed has been given), “Snow Wardens” (about 30 parishes have signed up – wardens would be covered for third party insurance if work is carried out responsibly and within guidelines of scheme), “Ditch Junk Mail” (people being encouraged to sign up to Mail Preference Service {MPS} to reduce Junk Mail), “Side Waste” (to be introduced) and “Free Bulky Collection” (new administration had agreed to retain this service – collection by appointment). 2109/7 REPORT OF DISTRICT COUNCILLOR B MOORES
Cllr Moores spoke of the following matters, namely “S 215 Town and Country Planning Act 1990 – Grot Spots” (he referred to a meeting that had been held locally with a NDC Planning Officer adding he felt the vast majority of properties, as identified, did not have such an impact on the amenities of the area so as to warrant any action through the planning act with one exception), “Sands Development” (he spoke of a meeting that had been held on site on the 10th August and outlined the outcome – 4 dwellings ), “1-4 Kiln Close Lane” (he said it seemed that NDC Planning was happy with NDH’s current proposals), “Development of Fremington Army Camp” (he provided an update), “Mollands Garage” (spoke of privacy issues and an solution to resolve), “Multi Storey Car Park – Queens Street, Barnstaple” (plans to demolish/re-develop are moving forward) and “Economy and Housing – North Devon Agenda” (around 70 Cllrs, business leaders, developers and housing experts have met for a seminar on economy of housing in North Devon). (i) It was RESOLVED that the July 2011 minutes of Instow Parish Council be approved and signed. (Noted)
(ii) It was further RESOLVED that the minutes of the Extraordinary Meeting of Instow Parish Council held on Thursday 8th September 2011 be approved and signed. (Noted)
2109/9 MATTERS ARISING FROM THE MINUTES
a) Items 2107/7 & 2017/9 (b) – Instow “Grot Spots” – S 215 Town and Country Planning Act 1990: -
(i) Cllr Moores (NDC) provided an update to IPC on progress since the last meeting – see item 2109/7. (Noted)

(v) A discussion then ensued at the conclusion of which it was RESOLVED that a sub group of Cllrs would be appointed by IPC to establish a pecking order of grot spots so that NDC could be encouraged to concentrate on the worst 3 examples yet hopefully identify practical methods of dealing with the remainder. Cllrs Harper, Moores and Johns were appointed as members of the relevant sub group; they were asked to report their findings at the next meeting of IPC. (Action: Cllrs Harper, Johns and Moores)
(vi) The Clerk reminded IPC that Cllr Cann (Deputy Leader NDC) had said recently that the current Executive of NDC was reviewing the current activity of its planning department where enforcement was concerned and perhaps ought to be advised; IPC RESOLVED to pass its final recommendation back thought Cllr Cann. (ii) The Clerk reported he had forwarded an email (dd 25.7.11) to NDC Planning setting out IPC’s concerns following the last meeting; an acknowledged email (dd 26.7.11) had been received. (Noted)
(iii) The Clerk said that NDC Planning had subsequently advised him that there had been some correspondence from ND Homes indicating they wished to provide 3 affordable units and 2 open market units and that the overall implications were still being discussed as regards the process of the application and this involved a decision as regards further consultation or not. (ii) Extraordinary Meeting of IPC at 7.30 pm on Thursday 8th September 2011: -
The Clerk then reminded IPC of this meeting; there were no issues arising that required further discussion. (Noted)
(iii) Debate: -
a) Cllrs then discussed the pro and cons for de-designation following which it was RESOLVED not to seek de-designation on the basis: -
• It was felt that the majority of consultees were not in favour
• The current system of water quality testing (weekly during the summer months) provided better protection for those persons “using” the water off Instow Beach for whatever purpose than the alternative method (once per month pa).
• The Defra criterion for de-designation was sketchy and IPC could not be certain it was in a position to provide all the necessary evidence to substantiate de-designation.
• There were Defra criterion ambiguities and anomalies that required further explanation.
• Would it not be better to endeavour to work with the EA and other associated organisations to improve the water quality
• This would include encouraging and monitoring the relevant authorities to work more closely with the farming community and reduce run-off pollution.
• Press interest in Instow’s water quality might even be more heightened following de-designation. (Noted)
b) Cllrs also RESOLVED to: -
• Seek a more tangible and practical relationship with the EA and other associated bodies to further the above aims
• Develop a process, in conjunction with the EA, to engage further with the local community (tourism and business) and to increase a better understanding of the situation.
• Produce a generic and scripted press release that could be provided to the press as and when required.
• Liaise with Defra to establish its view on the detailed work carried out by IPC during the last few months to establish a de-designation claim and use that feedback to improve and enhance any subsequent claim for de-designation should that situation ever prevail.
• To clarify issues, that were currently unclear, with Defra so as to increase understanding of de-designation process. (Noted)
c) Finally, Cllrs RESOLVED to thank Cllr Harper most sincerely for all his hard work
in driving the de-designation process and for preparing the draft de-designation report
for Defra . (Noted)
f) Item 2107/9 (g) – Salt/Grit Bins/Community Clusters: -
(i) The Clerk advised IPC he had told DCC (email dd 26.7.11) that IPC wished to participate in its Winter Service initiative; this had been noted by DCC (email dd 28.7.11 refers). (Noted)
(ii) The Clerk reminded IPC there were currently 4 parishioners who had volunteered to act as “Snow Wardens” and who would require training. (Noted) (iii) Cllr Cook advised IPC that Mr Geoff May of Barton Farm, Rectory Lane had agreed to the storage of the sand/grit at his premises. (Noted)
(iv) The Clerk reported receipt of an email (dd 15.8.11) from DCC reference “DCC Snow Warden Scheme”; it enclosed a copy of the scheme that had been forwarded to Cllrs with their summer recess papers. (Noted)
(v) The Clerk said that DCC required the following information from IPC: -
 Name and contact details of the “parish responsible person”; IPC RESOLVED to accept Cllr Cook’s very kind offer to take on this onerous role. (Noted)
 Location for storage of salt; it had been noted, by IPC, (as at item (iii) above that this would be Barton Farm. (Noted)
 Brief outline of how and where the salt would be used; IPC RESOLVED that the salt/grit would be moved to agreed locations within the village by Mr G May (Barton Farm) at the behest of local Snow Wardens who would then, following appropriate training, manage the spread of the salt/grit with parishioner volunteers. (Noted)
 IPC noted that any queries on this scheme should be addressed to Bob Pettifer (DCC Neighbourhood Manager). (Noted)

2109/10 CORRESPONDENCE
(i) Matters for discussion/resolution or noting: -
a) Email (dd 8.8.11) from a resident of Coventry reference “Trade Enquiry – Hire of Pedalos’: -
(i) The Clerk said this letter sought an agreement with IPC to operate the hire of Pedalos’ from the beach; the Clerk said the email had been acknowledged and enquirer advised that IPC leases part of Instow Sands from the CE and that the remainder of the beach was owned by DCE. The Clerk reminded Cllrs he had forwarded a copy of said email to them with their summer recess memorandum (19.8.11). (Noted) (ii) After a discussion IPC RESOLVED to advise the enquirer that Instow would not be suitable for pedalo hire on those parts of Instow Sands as leased by the parish council from the Crown Estate i.e. the beach itself was tidal (there were strong currents from time to time), suffered, at low tide, from very soft sand, was “littered” with a large number of boat moorings spread throughout its length and was at the head of two major rivers (the Taw and the Torridge) and the Atlantic Ocean. (Action: The Clerk)
b) Email (dd 26.8.11) from the Clerk to Cllrs with email addresses reference “NDC/TDC – Strategic Housing Land Availability Assessment”: -
(i) The Clerk advised IPC that no official consultation paperwork had been received from NDC/TDC as regards this matter despite the fact it was published in the local press (11.8.11). (Noted)
(ii) The Clerk said that as a result he had spoken to Cllr Cann (Deputy Leader NDC) and expressed his concerns as a result of which a note appeared in NDC’s Members’ Weekly Newsletter (dd 26.8.11) drawing town and parish clerk’s attention to it and asking them to forward it to their Cllrs; this he had done. (Noted)
(ii) The Clerk added that at his request (26.8.11) a copy of the paperwork of relevance to Instow had been forwarded to him by NDC Policy Planning Dept (received 27.8.11) and that this had been copied and forwarded it to Cllrs for their information. (Noted)
(iii) The Clerk pointed out that two of the three identified brown/green field sites in Instow were subject of current planning applications (The Sands and Mollands Garage) and that the other was the triangular piece of land adjacent to Atturm. (Noted)
(iv) After a discussion IPC RESOLVED to advise NDC Planning Policy that it would not be in favour of building on this land (i.e. by Atturm) on the basis it would prefer it remained as open space. (Action: The Clerk)
c) Email (dd 8.9.11) from Honeytone Ltd reference “”Instow: A History – Copyright Fee”: -
(i) The Clerk said that the enquirer was in dialogue with a local person who was developing a website for the “Appledore and Instow Regatta” and wished to use some photographs from the above book and was enquiring if IPC wished to charge a fee as the sole copyright holder of the Instow book. (Noted)
(ii) After a discussion IPC RESOLVED to advise the enquirer that as the person was local and using the photographs for a project that was going to benefit the local community, the project itself was neither non-profit making nor a commercial enterprise, then no fee was necessary. IPC did add, however, that some recognition of IPC and the Instow Book should be mentioned on the relevant website.

d) Letter (dd 5.9.11) from RWE npower renewables reference “Production of Preliminary Environmental Information and Timing of Public Exhibitions”: -
(i) The Clerk copied the letter to Cllrs at the meeting for their information. (Noted)
(ii) Cllr Cann (DCC/NDC) encouraged all Cllrs to visit the exhibitions that were taking place in the area as a matter of priority. He said it was his view that the environmental impact of the scheme would adversely impact on the North Devon coast with all the added benefits of electricity going primarily to South Wales. (Noted)
(iii) IPC RESOLVED to further discuss this matter at the next meeting.

e) Letter (dd August 2011) from DALC reference “DALC AGM – Saturday 8th October 2011 – Exeter”: -
The Clerk said he was in a position to attend and would report back at the next meeting adding there was an attendance fee of £15. IPC RESOLVED to support this action and associate cost. (Action: The Clerk)

(i) The Clerk advised IPC he had advised Metric (email of 18.8.11 refers) that IPC wished to purchase a second hand machine, namely red in colour at a cost of £550 plus VAT (includes installation) and which would come with a 6 month warranty period that would “kick-in” after installation – late April/early May 2012. (Noted)
(ii) The Clerk advised IPC he had negotiated for the machine to be delivered late November 2011 once the car parking charges for 2012 had been agreed; the machine would need to have a computer chip fitted bearing the charging structure prior to delivery/installation. (Noted)
(iii) The Clerk then referred to a letter (dd 12.9.11) from NDC (Parking Office) reference “North Devon Off-Street Parking Places Order – Car Park Charges 2012/2013”; he said NDC needed to know what IPC intended to charge for this period by mid October 2011. (Noted)
(iv) After a discussion it was RESOLVED that the members of IPC’s FSC should give this matter due consideration prior to the next meeting and come to said meeting with a proposal that could be discussed and agreed at that meeting with NDC being advised prior to its closure date. (c) Audit Commission- Annual Return for the Year ended 31st March 2011: -
(i) The Clerk advised IPC he had placed a notice (27.7.11), entitled “Notice of Conclusion of Audit and Right to Inspect the Annual Return Form” together with a copy of the Annual Return (sections 1-3) on the notice board at the Quay Car Park for the information of parishioners and left it there for a period in excess of a 14 days; it was removed (28.8.11) and retained for future information; no requests were made in that period to view audit papers. (vii) The Clerk confirmed he had copied all correspondence to Mrs Mary John Scott (IPC’s IA) and in doing so thanked her for her sterling work and proactive support in performing the internal audit process. (Noted)
(d) Mooring Fees 2011/12: -
The Clerk advised IPC that he had forwarded (5.8.11) an invoice in the sum of £1,500 to Instow Marine Services Ltd with a response date of 1.9.11; he said a cheque had been received (15.9.11) and it would be banked on 16.9.11. (Noted)

The Clerk reported that this meeting had been arranged for Monday 31st October 2011 (6.30 pm) so that the draft IPC budget 2012/2013 could be formulated for consideration of IPC at its November meeting. (ii) The Clerk said he had immediately contacted Lloyds TSB (30.8.11 – day letter received) - and it would seem that the Counter Clerk at Lloyds TSB (Barnstaple) only transferred £21.07 from IPC’s business a/c to its current a/c on 20.8.11 when the relevant transfer slip (copy retained on file plus receipt for transfer) was presented by Clerk instead of £2,107.00! He said Lloyds TSB were most apologetic and at the request of the Clerk transferred a further £785.93 to cover all cheques issues as at 19.8.11 (see item 4 (a) above). He said Lloyds TSB also confirmed that all charges incurred by this “error of theirs” would be deleted from IPC’s account. (Noted)

The Clerk said this letter referred to a notice of intent to carry out works to tree(s) which were in a conservation area; NDC does not consider that it is expedient to make a tree preservation order in response to the proposal provided it is done so within two years of the date of the notice and no more work is done on the tree(s) than is set out in the notice. He added that the letter then went on to provide information as regards Arboriculture Association Approved Contractors. (Noted)

a) Marine Parade – Weeds (Landward Side) : -
Cllr Cook said the weeds along this stretch of road required attention as they were making the village look untidy. IPC RESOLVED to advise DCC Local Services Dept for their urgent attention. (Action: The Clerk)
b) ND Homes Garages – Rectory Lane/Weeds: -
Cllr Thomas said the weeds within the forecourt of these garages were unsightly and required attention. IPC RESOLVED to notify ND Homes. (Action: Cllr Thomas)
c) Drains – Marine Parade: -
Cllr Moores said he was unsure if the drains on the landward side of Marine Parade were being cleaned out as were those on the seaward side. IPC RESOLVED to liaise with DCC Local Services Dept so as to ascertain the position. (Action: The Clerk)
d) IPC Meeting – October 2011: -
