Item 2101/6 (a) – Instow/Residents Parking Survey - Cllr Johns declared a

2101/4 POLICE REPORT
a) Crime: -
Constable Hodgson said that no crimes had been reported in the parish since
the last meeting. (Noted)
b) Other Matters: -
(i) PC Hodgson said that in the same period only two incidents had been
reported in the parish, namely, x 2 “admin/information. (Noted)
(ii) PC Hodgson then advised IPC of crime and akin initiatives that the police
had initiated in the area over the Xmas period involving pubic order and
drink/driving. He said there had been no arrests for drink/driving although
many motorist had been stopped and breathalysed. (Noted)
c) Traffic Matters: -
(i) PC Hodgson then spoke of speeding action taken in the area by both his
team and the Traffic Dept adding that it would be continued, following
complaints, especially along Anstey Way. (Noted)
(ii) Cllr Thomas said he had noticed motorists leaving the 40 mph limit at
Venn Cross (Anstey Way) and travelling towards Barnstaple at very high speeds
and felt it warranted attention; PC Hodgson said he would give this his
attention. (Noted)
(iii) In response to information provided by Cllr Crombie, PC Hodgson said he
would ensure that attention was paid to the Anstey Road/Quay Lane junction at
starting/ending of Instow Play School at the parish hall as cars were parking
indiscriminately at this location and causing an obstruction. (Action: PC
Hodgson)
2101/5 PARISHIONERS
a) Children’s Play Area: -
A parishioner enquired whether the proposed children’s play area on the Tarka
Trail would, in any way, be funded and/or maintained by the parish council.
The Clerk replied that as far as he was aware the parish council would not be
funding the play area but that it might well be responsible, once built, for
its maintenance. The parishioner said he did not agree with this and asked for
his views to be noted. (Noted)
b) All Saints Community Project: -
A parishioner provided an update on the fundraising for this project to date;
she said £40,243 had been raised so far and that it was anticipated the
project, overall, would cost about £67,000. She added that other funding/grant
streams were being explored and that her committee were very optimistic its
aims would be achieved. IPC congratulated her on the progress to date and
wished her committee well. (Noted)
c) Mobile Speed Sign – Anstey Way: -
A parishioner favourably commented upon the mobile speed sign that had been
erected part way along Anstey Way adding it was having a great effect. (Noted)
2101/6 REPORT OF COUNTY COUNCILLOR R CANN
(a) Instow – Residents Parking Survey: -
(i) Cllr Cann said he had personally delivered leaflets throughout Instow
setting out this scheme and was awaiting responses. (Noted)
(ii) The Clerk said he had received two emails (dd 13.1.11) from parishioners
that indicated they were not in favour of the proposals; he provided copies to
Cllr Cann and IPC Cllrs and read them out to Council. (Noted)
(iii) The Clerk said there was an article in the North Devon Journal (13.1.11)
in respect of this matter and in which parishioner(s) were speaking against
the proposals. (Noted)
(iii) After a discussion, IPC RESOLVED to await all responses that were being
collated by Cllr Cann and discuss the matter further at that time. The Clerk
reminded Council that it had previously RESOLVED to support the consultation
and have further discussions on the matter when all views were known. (Noted)

b) Westleigh Junction: -
Cllr Cann said work was currently being done to identify a contractor. (Noted)
c) General: -
Cllr Cann spoke of “DCC Grass Cutting Proposals” (reduce number of cuts to 2
pa – he would speak against this), “Cllrs Locality Funds 2011/12” (proposals
to increase this from £10,000 to £15,000), “Investing in Devon” (proposal that
each Cllr will have a one-off award for a capital project for 2011/12 -
£25,000?), and “Winter Operational Report” (current estimated overspend is
£600k; the cost of repairing highway defects (mostly potholes) is £6m rising
to £7.5m at end of the financial year). (Noted)
c) Instow – Road Defects: -
(i) Potholes were reported on Anstey Way near Chandlers Court, Anstey Way at
the Yacht Club entrance and in Rectory Lane (from Venn Cross) on the left hand
side of the road going up by the first house. IPC RESOLVED to notify DCC of
these defects and ask that they be repaired. (Action: Cllr Cann)
(ii) It was also said that the road surface in Rectory Lane (between Atturm
and the Church) had not been repaired following a substantial leak at that
location and that quite serious dips in the road surface had materialised. The
Clerk said that DCC Highways had already been advised of this matter on two
previous occasions and attention had been promised. (Action: Cllr Cann)
2101/7 REPORT OF DISTRICT COUNCILLOR B MOORES
a) General: -
Cllr Moores spoke of “Formula Grant Review of Car Allowances” (will save £180k
pa after initial outlay of £270k to fund compensation), “Redevelopment of
Queens Street Car Park” (demolition/redevelopment will be brought forward to
2011/12), “Leisure Centre” (remedial work will be undertaken in 2011/12 at a
total cost of £998k – project scope has been reduced from £3972m), “Formula
Grant” (being reduced from 7.6m to 6.5m = 14% etc), “Council – Leader
Executive Cabinet” (NDC to continue to be run by a Leader/Executive Cabinet
and not a Mayor) and “Rough Sleeper Project” (gets more support – total
funding to date £225k). (Noted) b) NDC – Reserves: -
In answer to a question from Cllr Cook, Cllr Moores said that NDC did hold
reserves but only within the statutory level. (Noted)
c) Instow – Residents Parking Survey: -
Cllr Moores said he had much thought on this matter and would be writing to
Cllr Cann in the near future. He said he supported the initiative but would go
into more detail in his letter that he would share with IPC. (Noted)
d) Council/Business Tax: -
Cllr May said he would like to know how much NDC took each year on
Council/Business tax and how it was spent. Cllr Moores agreed to find out by
the next meeting. (Action: Cllr Moores)
e) NDC Cllr Community Grants: -
Cllr Moores said that regrettably these grants had been shelved due to the
current financial climate. (Noted)
2101/8 MINUTES
It was RESOLVED that the December 2010 minutes of Instow Parish Council be
approved and signed. (Noted)
2101/9 MATTERS ARISING FROM THE MINUTES
a) Item 2012/9 (b) – Management of Quay Car Park: -
(i) The Clerk reported that NDC had postponed an arranged meeting (12.1.11 -
at the Commodore Hotel) between it and IPC but that a re-scheduled date was
currently being negotiated. The Clerk outlined the background of said
arrangements adding that it was clear that NDC were not keen on meeting “away”
from the Civic Centre which was the expressed wish of IPC. (Noted)
(ii) A discussion then ensued during which Cllr Moores (NDC) said he agreed
that the best venue for such a meeting would be the Commodore Hotel (and not
the Civic Centre) and that he would do all he could to facilitate the Leader
of NDC to come to a swift decision as regards the re-scheduled meeting date.
The Clerk said he had already taken the initiative to contact NDC’s Leader’s
Secretary but as yet to no avail. (Action: Cllr Moores)
(iii) The Clerk advised IPC that it ought to perhaps be seeking reassurances
from NDC at this early stage that if the future long-term management of the
Quay Car Park could not be established soon that it would be granted the usual
lease from the 1st May to the 30th September 2011 to run the car park. IPC
RESOLVED unanimously to support this view. (Noted)
(iv) Cllr Moores (NDC) said he could see no reason why this assurance could
not be given but that he would check and report back at the next meeting.

b) Item 2012/9 (c) – Sand Dune Management/Sand on Highway : -
(i) The Clerk confirmed he has written (dd 5.1.11) to Major Steve Congreve OC
Atturm and thanked him for the support of the RM in clearing the sand. (Noted)
(ii) The Clerk also reported that an article, acknowledging IPC’s thanks to
the Marines, had appeared in the North Devon Gazette (dd 5.1.11). (Noted)
(iii) The Clerk reported that as regards the Dune Management Strategy (SDMS),
Andy Bell (AB) (NDCCS) was to arrange a meeting of the Technical Officer Group
of the Estuary in the first instant – likely late January 2011. The Clerk
confirmed he had forwarded AB all feedback received by IPC as a result of the
recent public consultation. (Noted)
(iv) The Clerk suggested that the SDMS now be left in the capable hands of AB,
monitored by himself on behalf of IPC and Cllr Cann as regards DCC. IPC
RESOLVED to support this recommendation. (Action: Cllr Cann/The Clerk)
c) Item 2012/9 (d) - Village Gateway Initiative: -
(i) The Clerk advised IPC that an advance payment of £800 had now been
received from DCC and banked – see Finance. (Noted)
(ii) The Clerk advised IPC that Cllr Cann (DCC) had prompted DCC Highways
reference additional road markings required and that once this had been
completed the remaining payment of the full grant (£1588) could be resolved
hopefully before the end of the current financial year. (Noted)
(iii) The Clerk advised IPC he is still awaited a suitable transfer of a DUKW
from SW Signs with a view to this replacing the existing ones on the current
Instow signs on Anstey Way; he said SW Signs had been given a number of
excellent pictures as provided by Atturm. (Noted)
d) Item 2012/9 (e) – Ransom Strip Projects Children’s Play Area etc): -
(i) The Clerk confirmed that the agreed “parishioner consultation” Play Area
article had appeared in the January 2011 parish magazine. (Noted)
(ii) The Clerk reported receipt of an email (dd 3.1.11) from a parishioner of
Yelland supporting the play area project; he said the writer had been duly
thanked for their response. (Noted)
(iii) The Clerk reported receipt (9.1.11) of a telephone call from a former
Chairman of the Instow School Governors stating that although IPC’s plans for
a children’s play area was good and much needed it should be linked, in his
view, with the provision of a new school. (Noted)
(iv) The Clerk reported receipt of an email (dd 10.1.11) from Pegasus Planning
Group for Chandlers Court Management Company reference “Parish Magazine Entry
– Children’s Play Area/Tarka Trail”; the Clerk provided Cllrs present with a
copy and read it to Council. The Clerk confirmed that said email had been

(i) The Clerk advised IPC that Cllr Green’s approved article had been included
in the January 2011 parish magazine and that, to date, no response(s) had been

(ii) The Clerk reported receipt of an email (dd 30.12.10) from the EA
reference “Bathing Water Directive 2006/7/EC”. He said it required to know
whether IPC was happy for the EA to include its details on the EA website of
relevance to bathing water profiles and if so, what contact details would IPC
like to be included; he said the email had been forwarded to Cllr Green (dd
30.12.10) for perusal and comments. (Noted)
(ii) Cllr Green then addressed Council at the conclusion of which it was
RESOLVED to agree to the request but to ask for sight of what was intended to
be used prior to it being published. It was noted that all the potential
information that would undoubtedly be used was already in the pubic domain and
would have to be published in any event in due course to abide by forthcoming

f) Item 2012/9 (g) – Refurbishment of Toilets - Quay Car Park: -

g) Item 2012/9 (i) - Parish Carol Singing Event 2010: -
(i) The Clerk reported that this event was well attended and that £167.12 was
collected for the nominated charities – see Finance. (Noted)
h) Item 2012/10 (i) (a) - Democracy Pack/Local Elections 2011: -
Cllr Green, who had agreed to review these papers, told Council he would
report in more detail at the next meeting. (Noted)
i) Item 2012/10 (i) (f) – Devon & Cornwall Police Authority Conference 2011: -
The Clerk reported he had booked two places at the above conference that was
to be held between 10 am and 3 pm on Tuesday 15th March 2011 at the Barnstaple
Hotel, Barnstaple. He said he anticipated being able to attend with a Cllr, to
be decided nearer the date. (Noted)
j) Item 2010/13 – The Heron/Egret Statuette, Anstey Way: -
(i) The Clerk reported that he had forwarded an email (dd 13.12.10) to the
Chairman of IIB requesting more information on the future of this statuette
and more particularly, costings if replaced. (Noted)
(ii) The Clerk reported receipt of a reply from IIB (email dd 13.12.10)
refers); he said all options were being considered and a note was to be placed
in a forthcoming parish magazine (appeared January 2011) seeking parishioners
views on the matter. The Clerk added that this matter had also been aired in
the Instow Community notes of the North Devon Journal (6.1.11). (Noted)

was information on the relevant website that could well be of use to

d) Email (dd 28.12.10) from Cllr Thomas reference “Salt/Grit Bins – Rectory
Close/Lane”:-
(i) Cllr Thomas addressed Council and suggested that permanent DCC grit bins
be installed at this location on the basis that during the recent period of
bad weather leading up to and over Xmas much of the salt/grit bags that had
been left there had either been “used” for private purposes or “taken” and
“used” elsewhere. (Noted)
(ii) After a discussion it was RESOLVED that the Clerk would enquire how much
salt/grit would cost and to explore the possibility of forming community
clusters in order that each group might store “their” salt/grit securely and
work together when it was necessary to use it. (Action: The Clerk)

(c) Investment of Surplus Income (Business a/c) with Lloyds TSB (i.e.
£10,000): -
(i) The Clerk reported he had forwarded a communication (emails of 13.12.10
and 4.1.11) to Lloyds TSB giving instructions to invest £10,000 (as previously
agreed by IPC) but as of 5.1.11 had received no response. (Noted)
(ii) The Clerk reported that on 6.1.11 he received a telephone call from
Lloyds TSB apologising for the delay and advising him that this investment was
to be actioned by a different employee than the one he had been negotiating
with; no explanation was given fro the delay. The Clerk said he had reaffirmed
the desire of IPC to invest the £10,000. (Noted)
(iii) The Clerk reported that on 7.1.11 he received an email confirming that
the investment had been made (reference number 5426890) and that it would run
until 7.1.2013. (Noted)
(iv) The Clerk reported that on 8.1.11 he received a confirmatory letter (dd
7.1.11) from Lloyds TSB setting out the details of the investment i.e. 2.6%; a
copy was provided to Cllrs who are cheque signatories. (Noted)
(v) The Clerk reported receipt of a letter (dd 10.1.11) from Lloyds TSB
reference “General Terms of Business and Your Classification”; the Clerk
elaborated and suggested this was filed with the other papers – IPC RESOLVED
to support this recommendation. (Action: The Clerk) (d) Email (dd 17.12.10)
and attachments from NDDC reference “Parish Council Expenditure (Precept and
Grant) 2011/12”: -
(i) The Clerk reported that this confirmed Instow’s precept as being £8,748
and grant at £1,300. (Noted)
(ii) The Clerk advised IPC that he had confirmed this information to be
correct to NDC (letter dd 5.1.11) and agreed to the precept and grant being
paid in two instalments with the annual DALC Subscription 2011 being deducted
from the first payment on 30.4.11; IPC RESOLVED to ratify this action. (Noted)
(e) DCC P3 Footpath Inspection 2010/11 - P3 Claim for 2011/12:-
(i) The Clerk reported that all the necessary forms had been completed and
sent to DCC Footpaths Dept at County Hall (6.1.10); a £390 P3 grant had been
requested to cover the annual cost of strimming footpaths as necessary and
administration. (Noted)
(ii) The Clerk reported that neither he nor the handyman had attended the P3
Xmas Workshop at Merton on 10.12.10 because of other commitments. (Noted)
(f) Email (dd 10.1.11) and attachments from EDF Energy reference “Pricing
Renewal”: -
(i) The Clerk reported receipt of this email that set out EDF’s pricing offer
to IPC for the next 3 years (car park machine), namely £663.31 divided by 3 =
£221.10 per annum plus VAT and CCL if applicable; IPC would also be charged £2
pa agent charges as listed. (Noted)
(ii) The Clerk advised IPC that it currently pays £248.36 pa (1 year
contract). (Noted)
(iii) IPC to discuss.
(g) Internal Audit – October to December 2010: -
The Clerk reported that Cllr Crombie had carried out this internal audit on
12th January 2011 and found all to be in order; Cllr Crombie confirmed this to
be the case. (Noted)
(h) Bank Reconciliation – 1st October 2010 to 31st December 2010: -
The Clerk circulated a copy of this to Cllrs at the meeting; he said the
figures had been checked and confirmed by Cllr Crombie (12th January 2010);
Cllr Crombie confirmed this to be the case. (Noted)
(i) Instow Allotment and Recreation Field a/c – Nationwide Building Society: -
(i) The Clerk reported that he had visited the Nationwide Building Society on
8.1.11 and had been advised that the sum of £0.51 interest had been added to
this account as interest for the year 2010/11; he said in 2008/9 the interest
payable was £142.19 and in 2009/10 £3.41 with the gross invested sum being
identical. (Noted)
(ii) A discussion then ensued at the conclusion of which IPC RESOLVED not to
draw a cheque in the sum of 51p made payable to the Instow Parish Hall
Committee as for previous years; Cllr Green agreed to explain the situation to
the parish hall committee at its next meeting. (Action: Cllr Green)
2101/12 PLANNING
(a) Tapeley Innovations Ltd (TIL) reference “Proposal for a Solar Array at
Huish Fields”:-
(i) The Clerk reported that he had communicated (email – dd 13.12.10) with TIL
and advised it that IPC would wish to attend a site meeting in due course.

(ii) The Clerk advised IPC that TIL had replied (email – dd 13.12.10) to the
effect that it was hoped to arrange a site meeting sometime in January weather
permitting.(Noted)
b) Letter (received 8.1.11) from NDC Planning reference “Alterations to front
deck to provide low level wall and glass screen guarding at The Instow Arms
(formerly The Decks), Marine Parade, Instow (Reference No 51168): -
The Clerk said this stated that NDC Planning had REFUSED permission for this
application for reasons as stated; the letter was copied to Cllrs at the
meeting. (Noted)
c) Letter (received 8.1.11) from NDC Planning reference “Alterations and
renovations to include formation of glazed balcony and insertion of larger
dormer window at Corona, Marine Parade, Instow (Reference No 51347): -
The Clerk said this stated that NDC Planning had GRANTED permission for this
application with conditions as listed. (Noted)
2101/13 ANY MATTER RAISED AT THE DISCRETION OF THE CHAIRMAN
a) Quay Car Park Gents Toilets/Graffiti: -
Cllr Harper said that some graffiti had recently appeared in these toilets;
IPC RESOLVED to advise NDC. (Action: The Clerk)
b) Overgrown Hedge (Rear of Rectory Close) – Rectory Lane: -
Cllr Cook said this overgrown hedge, which had previously been reported to DCC,
was further encroaching onto the highway and required trimming. IPC RESOLVED
to advise DCC and ask them to take immediate action. (Action: The Clerk)
